• 1:41
Speaker 3: It's Restaurant Week here in Charleston. It kicks off today
• 1:44
Speaker 3: and tomorrow. I say today and tomorrow because if your
• 1:47
Speaker 3: favorite restaurant is closed today, as many are on Mondays,
• 1:50
Speaker 3: then it will start for you tomorrow. Some will begin tonight, though.
• 1:54
Speaker 3: We'll talk to Restaurant tour and one of the folks
• 1:55
Speaker 3: associated with the Downtown Charleston Association, Kevin Madison, about restaurant
• 2:00
Speaker 3: also Jason Huffman from American Prosperity standing by, and we'll
• 2:03
Speaker 3: get into some things in the news as well. I
• 2:05
Speaker 3: do want to start though, going to the newsroom bringing
• 2:07
Speaker 3: in Jeff Jenkins with a recap of the testimony Friday
• 2:10
Speaker 3: and the White Feather Lance Trild. Jeff, good morning, talk
• 2:13
Speaker 3: about Friday in the courtroom.
• 2:14
Speaker 5: Okay, so today, Dave, just we'll mention what's going on today.
• 2:19
Speaker 5: So the defense could rest its case today, probably will
• 2:23
Speaker 5: rest its case. They may have one or two more witnesses,
• 2:26
Speaker 5: and then there might be a rebuttal witness coming up
• 2:29
Speaker 5: for the prosecution, so we could have all testimony. Possibility
• 2:33
Speaker 5: that all testimony will be in on this trial by
• 2:35
Speaker 5: the end of the day today, and I think there's
• 2:37
Speaker 5: an outside chance that we could get jury instructions and
• 2:40
Speaker 5: closing arguments today. So it's possible that the jury could
• 2:43
Speaker 5: get the case by the end of the day. If not,
• 2:45
Speaker 5: that would happen tomorrow, I would think. And so the
• 2:49
Speaker 5: defense continued to put on its case on Friday. Donald
• 2:53
Speaker 5: Ray Lance, one of the defendants, testify in the morning.
• 2:57
Speaker 5: Then the afternoon they had a forensic psychologist on the stand.
• 3:00
Speaker 5: This was the defense and basically part of the defense's
• 3:03
Speaker 5: case is these parents were, uh, you know, Jenny K.
• 3:06
Speaker 5: Whitefeather and uh and Donald ray Lance were uh caring
• 3:11
Speaker 5: for these kids, their adopted children.
• 3:13
  Speaker 2: UH.
• 3:13
Speaker 5: And they were overwhelmed because of some of the behavior
• 3:18
Speaker 5: of the oldest child.
• 3:19
  Speaker 3: UH.
• 3:20
Speaker 5: And he was one of the two that was found
• 3:21
Speaker 5: locked in the shed because of his struggles with mental health.
• 3:27
Speaker 5: And so they put a forensic psychologist on the standard
• 3:29
Speaker 5: basically testified yet you know, parents can become overwhelmed, uh,
• 3:33
Speaker 5: and said some other things uh. Probably probably the key
• 3:36
Speaker 5: part of the test.
• 3:36
  Speaker 6: Note.
• 3:37
Speaker 5: The key part of the day was cross examination from
• 3:41
Speaker 5: Madison Tuck, who's the Knaw County assistant prosecutors handling this case, uh,
• 3:46
Speaker 5: to Donald ray Lance, and she questioned him directly, you
• 3:50
Speaker 5: know about so you never locked these kids in the shed.
• 3:53
Speaker 5: There are two locks on this shed, and you didn't
• 3:54
Speaker 5: do that. You never withheld food from these kids and
• 3:58
Speaker 5: just gave him peanut butter sandwichers or took away the sandwiches.
• 4:00
Speaker 5: And so she and he his answers sometimes were long pauses,
• 4:07
Speaker 5: not direct answers, kind of long answers. The judge, Judge
• 4:11
Speaker 5: Mary Clareaker's had to step in a couple of times
• 4:12
Speaker 5: and tell him to answer the question. So you know
• 4:15
Speaker 5: that that may end up being, you know, key testimony.
• 4:19
Speaker 5: We'll have to see obviously what the jury does. But
• 4:22
Speaker 5: we're winding it down today. Jury could get it today.
• 4:25
Speaker 5: If not today, they'll probably get it tomorrow.
• 4:27
Speaker 3: That's what I was going to say. I mean, as
• 4:28
Speaker 3: you said at the outset there, Jeff, today could be it.
• 4:31
Speaker 3: I mean that's all indications are kind of kind of
• 4:33
Speaker 3: pointing in that direction.
• 4:35
Speaker 5: Yeah, it is, and I think maybe one or two
• 4:37
Speaker 5: defense witnesses left. If that, then a rebuttal witness, and
• 4:41
Speaker 5: then you get then you get into the final stages
• 4:44
  Speaker 5: of the trial.
• 4:44
Speaker 3: All right, of course we'll have if there's a decision today,
• 4:47
Speaker 3: and even if there's not, we'll be covered and we
• 4:49
Speaker 3: get folks in the courtroom. We'll have it on air
• 4:51
Speaker 3: and online. Jeff, I appreciate you being here, man. Thanks

• 5:19
Speaker 3: be getting a little later start the normal because this
• 5:22
Speaker 3: is the year that the new governor is taking over.
• 5:24
Speaker 3: That's generally what happens. Regular session set to start on
• 5:28
Speaker 3: February eleventh. The Group of Americans for Prosperity will be
• 5:30
Speaker 3: keeping an eye on things under the domas they always do.
• 5:32
Speaker 3: The executive director of the group, Jason Huffman, is here now.
• 5:35
Speaker 3: Good morning, Sarah, Welcome to the show, Dave, thanks for
• 5:37
Speaker 3: having me on. Thank you for being here. And you
• 5:39
Speaker 3: folks have released to the media and others something that
• 5:44
Speaker 3: you're calling the Pathway to Prosperity Legislative Agenda with a
• 5:48
Speaker 3: subtitle I guess back by a six figure spent long title.
• 5:52
Speaker 3: So let's get to it. What are you folks looking
• 5:54
Speaker 3: for in the session this year? And I could take it,
• 5:58
Speaker 3: we can take it piece by piece. I guess let's
• 6:00
Speaker 3: start with one part of it, which is regulatory reform.
• 6:02
Speaker 3: What are you looking for in regulatory reform sure.
• 6:05
Speaker 7: So every year since twenty eighteen, we've released a Pathway
• 6:07
Speaker 7: to Prosperity legislative agenda. This year we anticipate given just
• 6:11
Speaker 7: what a historic landscape we're in, with an overwhelming election
• 6:15
Speaker 7: of Governor Patrick Morrissey, very many principal champions in the
• 6:19
Speaker 7: state legislature, a lot of really bold reforms. This is
• 6:22
Speaker 7: a roadmap to help principled lawmakers be able to make
• 6:25
Speaker 7: the state a better place to live, work, and raise
• 6:27
Speaker 7: a family. So, when we're talking about regulatory reform, a
• 6:30
Speaker 7: lot of states don't have the rulemaking process that we
• 6:33
Speaker 7: have currently. A lot of states have a situation where
• 6:36
Speaker 7: agencies are just making law without any oversight from lawmakers.
• 6:40
Speaker 7: Now that's not the case in West Virginia. It's great
• 6:42
Speaker 7: that we have a rulemaking process, and we want to
• 6:44
Speaker 7: beef up that process.
• 6:46
Speaker 3: We want it so that when.
• 6:47
Speaker 7: An agency rolls out a rule or a rag that
• 6:50
Speaker 7: is going to cost the private economy over a million
• 6:53
Speaker 7: dollars over four years, they have to tell lawmakers about that,
• 6:56
Speaker 7: so that lawmakers are aware of this information and apply
• 6:59
Speaker 7: additional scrutiny to that rulemaking process. It's called the Rains Act.
• 7:04
Speaker 3: The Rains Act. Okay, again, we're talking with Jason Huffman
• 7:06
Speaker 3: for Americans for Prosperity. I want to move on to
• 7:09
Speaker 3: one part of this was to make health care more affordable.
• 7:12
Speaker 7: Absolutely one of the major things that states can do
• 7:16
Speaker 7: if they haven't done so already, and many of them have.
• 7:18
Speaker 7: I think we're one of thirty five states that still
• 7:20
Speaker 7: has certificate of need laws on the books. We want
• 7:24
Speaker 7: to fully repeal all certificate and need laws. And Dave,
• 7:26
Speaker 7: we've talked about this more, but explain I want to.
• 7:28
Speaker 3: Jump in there. Explain what certificate of need is. I
• 7:30
Speaker 3: know you have talked about it in the past, but
• 7:33
Speaker 3: explain what certificate of need is.
• 7:35
Speaker 7: So essentially, it was a thing that was set up
• 7:36
Speaker 7: in the seventies. The federal government said that states had
• 7:38
Speaker 7: to adopt it, so they all did. Since then, the
• 7:40
Speaker 7: federal government has said, you know, doesn't matter if it's
• 7:43
Speaker 7: a Department Justice under Republicans or Democrats, this is a
• 7:46
Speaker 7: terrible idea. Please repeal it. In West Virginia hasn't done
• 7:49
Speaker 7: so yet. Essentially, what certificate of need does? It allows
• 7:53
Speaker 7: unelected bureaucrats to come into your community and say you
• 7:56
Speaker 7: don't need that health care service. You don't need those
• 7:59
Speaker 7: extra hot hospital bets, you don't need that new CT machine.
• 8:03
Speaker 7: And so what we've seen is it's a huge detriment.
• 8:08
Speaker 7: It drives up costs, it lowers the accessibility of healthcare.
• 8:13
Speaker 7: And you know, all of the research, there's volumes and
• 8:15
Speaker 7: volumes of research on this day. All of the data
• 8:18
Speaker 7: suggests that there is no benefit to a certificate need
• 8:22
Speaker 7: and we really need to repeal all of those laws
• 8:24
Speaker 7: in West Virginia, and so that will be our top
• 8:25
  Speaker 7: priority in the.
• 8:26
Speaker 3: Session you had Expanding educational freedom. That's a big that's
• 8:32
Speaker 3: a big thing these days, talk about that. Sure.
• 8:34
Speaker 7: So when we passed the law on twenty twenty one
• 8:36
Speaker 7: to become the first state in the country to have
• 8:38
Speaker 7: a universal education savings account, the Hope Scholarship, that law
• 8:42
Speaker 7: contained to trigger and essentially what it says is that
• 8:45
Speaker 7: in twenty twenty six, it will expand eligibility to all
• 8:49
Speaker 7: school aged kids in the state. So forty thousand more
• 8:52
Speaker 7: kids are going to be eligible for the Hope Scholarship
• 8:54
Speaker 7: in twenty twenty six to enroll in that program and
• 8:56
Speaker 7: have their tax dollars put in their parents' hands to
• 9:00
Speaker 7: be able to choose the education that best suits their needs.
• 9:03
Speaker 7: We want to make sure that expansion happens without incident,
• 9:06
Speaker 7: and so that's something that we're prioritizing the session.
• 9:10
Speaker 3: And supporting Governor Morrissey's economic agenda. I want to jump
• 9:14
Speaker 3: in before I get you to explain that, because you, folks,
• 9:17
Speaker 3: Americans for Prosperity, if I remember correctly, were one of
• 9:20
Speaker 3: the first groups that endorsed now Governor Morrissey in that
• 9:23
Speaker 3: crowded primary field last year in the Republican ticket. So
• 9:28
Speaker 3: supporting Governor Morrissey's economic agenda. Talking about that, well.
• 9:32
Speaker 7: I'll just say, you know, going back to the primary,
• 9:33
Speaker 7: it was the most I think within recent memory competitive
• 9:37
Speaker 7: primaries for the role of governor in the state. And
• 9:40
Speaker 7: so I think, you know, Governor Morrissey won that primary,
• 9:44
Speaker 7: he won the general very decidedly, and I think what
• 9:47
Speaker 7: that tells us is that we have a mandate from
• 9:48
Speaker 7: the people when it comes to bold policies that we
• 9:52
Speaker 7: know are going to make the state a better place
• 9:53
Speaker 7: to live, work and raise a family. I think Governor
• 9:56
Speaker 7: Morrissey is going to be one of the most transformational
• 9:59
Speaker 7: governors in America. He's a policy guy, he does not
• 10:02
Speaker 7: back down from a fight with the special interests to
• 10:04
Speaker 7: make sure that West Virginians are being put first. And
• 10:07
Speaker 7: so we're very excited to see him and along with
• 10:09
Speaker 7: the you know, the legislature, a lot of principal policy
• 10:12
Speaker 7: champions there, and so we've just got a great landscape
• 10:15
Speaker 7: to really advance a lot of reforms rapidly that are
• 10:18
Speaker 7: going to make the average person's life better.
• 10:20
Speaker 3: I don't want to talk about what we've seen so
• 10:22
Speaker 3: far from Governor Morrisey. I mean, the session, as I mentioned,
• 10:26
Speaker 3: hasn't started yet. It'll start February eleven. But he came
• 10:29
Speaker 3: out of the gate in day one with executive orders,
• 10:32
Speaker 3: much like President Trump did with some executive orders and
• 10:34
Speaker 3: so on and so on. I would imagine you folks
• 10:36
Speaker 3: have been pretty happy with what you've seen so far.
• 10:38
Speaker 7: Sure, yeah, I mean, you know, the elimination of DEI,
• 10:41
Speaker 7: him coming out and saying that this administration is going
• 10:43
Speaker 7: to be one of the most pro educational freedom administrations
• 10:47
Speaker 7: in the nation. Listen, he wanted to make a statement,
• 10:49
Speaker 7: and he's a guy that understands what the people want.
• 10:53
Speaker 7: He's demonstrated that all the way through the campaign and
• 10:55
Speaker 7: now as a governor, he's wasting no time with getting
• 10:58
Speaker 7: to business with the work of the people.
• 11:00
Speaker 3: You mentioned the I and that's been a those three
• 11:04
Speaker 3: letters have been in the news a whole lot over
• 11:07
Speaker 3: the last cup, not only from you know, from from
• 11:09
Speaker 3: Governor Morrincy, but also President Trump and others. Only get
• 11:12
Speaker 3: into the I a little bit later on.
• 11:14
  Speaker 7: What is it about the d e I de I
• 11:17
Speaker 7: that concerns you folks so much? Well, I mean it's
• 11:20
  Speaker 7: it's anti meerocratic. We're we're republic for a reason, right.
• 11:24
Speaker 7: I think that when it comes to the role of government,
• 11:28
Speaker 7: the proper role of government, dee I really has no
• 11:30
Speaker 7: place there. Folks should be put in a position because
• 11:33
Speaker 7: they could do the job well, not because you know,
• 11:35
Speaker 7: we're picking one version of a person over another. And
• 11:39
Speaker 7: so I'm glad to see the governor did that.
• 11:42
Speaker 3: And you guys are spending some cash to get your
• 11:44
Speaker 3: word out now this now, this segment is a news segment.
• 11:46
Speaker 3: You're not paying to be here. But but I mean,
• 11:48
Speaker 3: but you are spending some cash, right, Why why is
• 11:50
  Speaker 3: that so important?
• 11:52
Speaker 7: Well, because Dave, there's a lot of special interests out
• 11:54
Speaker 7: there that want to see the system continue to be rigged.
• 11:57
Speaker 7: They're they're working take certificate and needs. In the example,
• 12:01
Speaker 7: they like the way the system is because they benefit
• 12:03
Speaker 7: from it. They put up these barriers to progress because
• 12:08
Speaker 7: it's something that benefits their bottom line. So what we're
• 12:11
Speaker 7: doing is the same thing we do every year, Dave.
• 12:13
Speaker 7: We're going to bolster to lawmakers, encourage them, give them
• 12:16
Speaker 7: the political courage that they need to go and do
• 12:19
Speaker 7: the tough thing, the right policy move because it's the
• 12:22
Speaker 7: right thing to do. That's going to look like, you know,
• 12:25
Speaker 7: calls going into lawmakers, citizens reaching out to lawmakers, writing
• 12:29
Speaker 7: them a postcard. You know, We're going to run digital
• 12:32
Speaker 7: ads that educate the public on these issues and why
• 12:35
Speaker 7: they're so important, you know, send direct mail to those folks,
• 12:39
Speaker 7: just so that they can become a part of the movement,
• 12:42
Speaker 7: become a part of folks that are engaged in the
• 12:44
Speaker 7: legislative process, because guess what democracy belongs to those that show.
• 12:48
Speaker 3: Up and for those who may not have heard you
• 12:50
Speaker 3: and Kressen Gallagher, who's the deputy state director of the
• 12:53
Speaker 3: organization of the show in the past, give us the
• 12:54
Speaker 3: basic idea behind Americans for Prospering. Sure.
• 12:57
Speaker 7: So, we're a nonprofit, nonpartisan organization that is trying to
• 13:00
Speaker 7: tackle the toughest issues facing the state. Center right policy
• 13:05
Speaker 7: minded organization. We have a set of principles with regards
• 13:10
Speaker 7: to the free market. We think that the free market
• 13:13
Speaker 7: is a thing that has lifted more people out of
• 13:14
Speaker 7: poverty than any government program ever thought about. And so
• 13:18
Speaker 7: we want to instill those principles into reforms that lawmakers
• 13:22
Speaker 7: are adopting very rapidly, so that we can make a
• 13:26
Speaker 7: place where folks confined their version of the American dream
• 13:29
  Speaker 7: more easily.
• 13:30
Speaker 3: And where can people learn more about your organization?

Speaker 3: as I told you on Friday's show, Restaurant Week kicks

Speaker 3: off either today or tomorrow in Charleston. I say that
• 16:52
Speaker 3: because if your favorite place is normally closed on Mondays,
• 16:57
Speaker 3: then it will start for them tomorrow, and they're open today,
• 17:01
Speaker 3: it will start this evening. As you may have figured now,
• 17:04
Speaker 3: I'm scheduled to have Kevin Madison on to talk about
• 17:08
Speaker 3: but don't know where Kevin is not heard from mister Madison.
• 17:11
Speaker 3: We booked him on the show last week and not
• 17:13
Speaker 3: here as of now, so I guess we'll just move
• 17:17
Speaker 3: on I will tell you that I do have on
• 17:20
Speaker 3: my social media and Dave alland Radio, I have a
• 17:22
Speaker 3: list of the restaurants that are taking part in Restaurant Week.
• 17:25
Speaker 3: And if you can go to any of the restaurants pages,
• 17:28
Speaker 3: their social media pages, their websites or whatever, you can
• 17:30
Speaker 3: find more information about what their exact menus are. Under
• 17:35
Speaker 3: the Gazette Mail last week actually printed some of those.
• 17:38
Speaker 3: Some of the restaurants that are taking part in Restaurant
• 17:40
Speaker 3: Week again starts today or tomorrow here in Charleston. Some
• 17:44
Speaker 3: of the restaurants are Adelphia ten ten Bridge, Barcada's at
• 17:47
Speaker 3: the Fort, Black Sheep, Britos and Bruce, Bricks and Barrels, DT, Prime, Dim,
• 17:52
Speaker 3: Two Brothers and a Grill, Fernbank Public House, itchubon the Lookout,
• 17:57
Speaker 3: Pies and Pints, a Restaurant, A Bruise, a restaurant, A Brews,
• 18:01
Speaker 3: Sam's Uptown Cafe, Sergio's, Sohos, the Capitol Market and the
• 18:05
Speaker 3: Volsted Rooms some of the restaurants that are taking part
• 18:08
Speaker 3: in the Restaurant Week festivities in Charleston. And again had
• 18:12
Speaker 3: Stephen Keith, the food Guy on from the Gazette Mail
• 18:16
Speaker 3: on Friday, and he and asked me a little bit
• 18:18
Speaker 3: of time talking about it as well. And you know,
• 18:21
Speaker 3: our restaurants here in Charleston have really really suffered a
• 18:26
Speaker 3: whole lot over there. Well, I mean, let's just go
• 18:29
Speaker 3: back in time. Let's go back to twenty twenty with COVID,
• 18:32
Speaker 3: and Restaurant Week actually started after the water crisis back
• 18:36
Speaker 3: in what twenty twenty twelve, I guess, and our twenty
• 18:42
Speaker 3: twenty thirteen, and that's when it actually kind of got
• 18:44
Speaker 3: started to kind of tell people, hey, these are restaurants
• 18:47
Speaker 3: because of the water crisis. If you remember what happened
• 18:49
Speaker 3: back then, these restaurants have really really suffered. And so
• 18:52
Speaker 3: what we want to do, we meaning these businesses, is
• 18:54
Speaker 3: try to get people to come back into these particular restaurants.
• 18:58
Speaker 3: And it's been going strong ever since. And then with COVID,
• 19:01
Speaker 3: and you know what COVID did to the restaurant business
• 19:03
Speaker 3: across America and not only here in Charleston obviously, but
• 19:06
Speaker 3: across America even more important, and let's face it, at
• 19:09
Speaker 3: any time I say anything negative about the snow and
• 19:14
Speaker 3: the ice in the cold weather, I always get a
• 19:16
Speaker 3: phone call, our a text from a good buddy Joe
• 19:18
Speaker 3: Stevens from the West Virginia Ski Areas Association. But it's
• 19:21
Speaker 3: been a rough winter, I'll say that. And when you
• 19:24
Speaker 3: have what we've had for the first couple of weeks
• 19:26
Speaker 3: of January, people just aren't heading out to the restaurants
• 19:28
Speaker 3: as much. People can't get their employees can't get there.
• 19:32
Speaker 3: Many of them had to close for several days. And
• 19:35
Speaker 3: again it's not just not being able to get there,
• 19:37
Speaker 3: but a lot of time their employees couldn't get there
• 19:39
Speaker 3: and so on and so forth. So it's been rough
• 19:41
Speaker 3: on our restaurant. So the weather is fantastic. Would be
• 19:43
Speaker 3: a great opportunity for you to call ahead of time,
• 19:46
Speaker 3: and you probably should in most cases with those restaurants
• 19:50
Speaker 3: I listed, you probably should at least give them a
• 19:52
Speaker 3: call ahead, send them a message or whatever, and say
• 19:54
Speaker 3: do I need a reservation? You are going to need
• 19:56
Speaker 3: for some of those that I mentioned earlier. And again
• 19:58
Speaker 3: I've got the complete list of restaurant here in Charleston
• 20:00
Speaker 3: taking part in it posted on Dave Allen Radio on Facebook.
• 20:04
Speaker 3: You probably should go ahead and plan on making a
• 20:06
Speaker 3: reservation and so so get out there and support these
• 20:09
Speaker 3: local businesses. I mean, they they really need you. These
• 20:12
Speaker 3: local restaurants have really suffered in the early part of
• 20:14
Speaker 3: twenty twenty five with the weather that we've had, so
• 20:17
Speaker 3: so get out there and try to try to support
• 20:21
Speaker 3: and we'll try and then I've got another restaurant tour
• 20:23
Speaker 3: scheduled to be on the show on Wednesday, so well,
• 20:27
Speaker 3: we'll see how that goes. Older adults should protect themselves

Speaker 3: No Prosperity, and warn anyone from recommending people associated with
• 21:04
Speaker 3: AFP from being sent his way for consideration in the administration.
• 21:09
Speaker 3: That's an interesting occurrence because our governor has always surrounded
• 21:12
Speaker 3: himself heavily with AFP folks, creates an odd situation. I
• 21:17
Speaker 3: was unaware of that. I did not know that President
• 21:19
Speaker 3: Trump had said that, So look into that a little
• 21:22
Speaker 3: bit for the a is. It's kind of interesting that
• 21:26
Speaker 3: he would say that. I don't know what the reason
• 21:27
Speaker 3: for that would be, but I'll dive into it a
• 21:30
Speaker 3: little bit. Tex says doing away with the certificate of
• 21:33
Speaker 3: need would solve a problem where none exist. For locally
• 21:36
Speaker 3: owned hospice agencies that have provided excellent care to West
• 21:39
Speaker 3: Virginia families for forty five years and invested hundreds of
• 21:42
Speaker 3: millions of dollars establishing, maintaining, and growing hospice and bereavementcare
• 21:47
Speaker 3: services paliative services throughout the states. Doing away with cons
• 21:52
Speaker 3: certificate of need would allow large out of state, for
• 21:55
Speaker 3: profit corporate healthcare companies to come in and cherry pick
• 21:58
Speaker 3: patients who they can make money off of instead of
• 22:01
Speaker 3: caring for everyone who needs care, which is the exact
• 22:05
Speaker 3: opposite of what Pathways to Progress claims, says a texture.
• 22:16
Speaker 3: As I recall when DEI was called tokenism, there was
• 22:20
Speaker 3: an anger, an offense being offered a job or special
• 22:23
Speaker 3: treatment because of your race, gender, religion, sexual preferences, et cetera,
• 22:28
Speaker 3: instead of your qualifications and merit. When did this switch happen?
• 22:32
Speaker 3: I'm gonna get into the DEI thing coming up a
• 22:34
Speaker 3: little bit later on in the show Texas Dave, can
• 22:39
Speaker 3: you confirm or deny the rumors of ICE doing raids?
• 22:43
Speaker 3: And Canali have Putnam Counties? Also? Can you confirm or
• 22:46
Speaker 3: deny the rumors that J. C. Penny is closing at
• 22:49
Speaker 3: the town Center. Well, I like you if you were
• 22:52
Speaker 3: perusing social media at all yesterday. I did see some
• 22:55
Speaker 3: postings about ICE agents in in Kanah and Putnam. Actually
• 23:02
Speaker 3: I saw Cable County was the one that I saw.
• 23:05
Speaker 3: I didn't see Kanaw. I did see Putnam and Cabull Counties. Listen,
• 23:08
Speaker 3: and again, I hate to get into speculation because I
• 23:10
Speaker 3: don't know whether it is true or not. I can
• 23:12
Speaker 3: tell you that nothing officially came out. I did see
• 23:16
Speaker 3: a lot of folks posting about it on social media,
• 23:19
Speaker 3: warning people that ICE agents were in town, which sound
• 23:24
Speaker 3: kind of sounds like eighty o A betting to me.
• 23:26
  Speaker 3: But that's beside the point. I don't know. I cannot
• 23:29
Speaker 3: confirm nor deny any of that. Because nothing official has
• 23:32
Speaker 3: come out, and I don't know of any news organizations
• 23:34
Speaker 3: that are reporting that that is definitely the case. As
• 23:37
Speaker 3: far as the rumors that JC Penny is closing at
• 23:40
Speaker 3: the Town Center again, I don't know. I know just
• 23:43
Speaker 3: what you have, what you've probably heard, or what you

Speaker 3: we originally had Canall circu Judge Mary Claire Acres scheduled

• 24:53
Speaker 3: Valentine's tradition, which is the marathon of weddings the judge
• 24:57
Speaker 3: Acres performs that day. She, as Jeff told you at
• 25:00
Speaker 3: the top of the show, she is still tied up
• 25:02
Speaker 3: in the White Feather Lance trial in Canon Circuit Court.
• 25:05
Speaker 3: So we will get her rescheduled for another another show.
• 25:11
  Speaker 3: I don't know exactly when that'll be, but one I
• 25:15
Speaker 3: will work on getting her back on the shop becase
• 25:17
Speaker 3: that's always a big deal. And of course I know
• 25:19
Speaker 3: that she always takes time from her schedule on Valentine's Day,
• 25:21
Speaker 3: which is on a Friday this year, to call us
• 25:24
Speaker 3: up to kind of update some of the numbers down there.
• 25:26
Speaker 3: But I will get Judge Aacers rescheduled for another show
• 25:30
Speaker 3: coming up. On tomorrow's show, Josh being from Jude Security.

• 25:49
Speaker 3: New businesses opening up and the annual Putnam County Chamber
• 25:52

• 25:58
Speaker 3: talked to her last week, and there won't a whole
• 25:59
Speaker 3: lot less if there are any at all. I mean,
• 26:01
Speaker 3: this is a big, big event. If you live in
• 26:03
Speaker 3: Putnam County or the surrounding areas, you know that. I
• 26:06
Speaker 3: mean we're talking about like a thousand people show, a

• 26:36
Speaker 3: I actually did see the gentleman who performed the national anthem. Now,
• 26:42
Speaker 3: I think the one I saw was prior to the Kara,
• 26:46
Speaker 3: prior to the Kansas City and Buffalo game. I think
• 26:49
Speaker 3: that's the one I saw that was especially good. In
• 26:53
Speaker 3: my opinion, I don't think I saw the first time.
• 26:55
Speaker 3: Might be wrong about that, because you know, at this

• 27:01
Speaker 3: really don't care. And for I'm kidding for all of

Speaker 3: people that and I don't want to turn this into

Speaker 3: people that are anti Kansas City Chiefs and whatever. Well,
• 27:15
Speaker 3: as they used to say about the Golden State Warriors,
• 27:18

Speaker 3: in the thirty seventh annual West Virginia Hunting a Fishing
• 27:40
Speaker 3: Show at the Condolsteam Convention Center Friday, Saturday and Sunday.
• 27:44
Speaker 3: And what a night for Charleston. Friday night, I mean,
• 27:48
Speaker 3: we had the hunting and Fishing show, We had the
• 27:50
Speaker 3: Reds Caravan at the over at the theater at the
• 27:54
Speaker 3: Coddlesteum Convention Center. Jeff Jenkins and Brian Bradley, myself were
• 27:58
Speaker 3: over there for that, and then we had the Dark
• 28:00
Speaker 3: and McCollum concert all going on at the same time.
• 28:04
Speaker 3: Those three big events all happening in one building or
• 28:08
Speaker 3: at least segmented parts of the building, all at one time.
• 28:12
Speaker 3: That was pretty cool. But somehow they pulled off. So
• 28:15
Speaker 3: hands off to the folks involved with the Kytle Seemen
• 28:18
Speaker 3: Convention Center for pulling that off. It was absolutely incredible.
• 28:23
Speaker 3: The hunting and Fishing show, of course, continued on Saturday
• 28:25
Speaker 3: and now I worked the show Saturday morning into the
• 28:27
Speaker 3: afternoon hours. Had a great time hanging out with people.
• 28:30
Speaker 3: And I'll have to talk to Jim Strawn about this,
• 28:33
Speaker 3: but man, I tell you, the numbers that I saw
• 28:36
Speaker 3: on Saturday afternoon were fantastic. I think people just wanted
• 28:40
Speaker 3: to get out of the house, to be honest with you,
• 28:42
Speaker 3: and they were there at the Hunting and Fishing Show,
• 28:45
Speaker 3: and more importantly for the vendors there, they were spending
• 28:48
Speaker 3: a lot of money, That's what important, and brought a
• 28:50
Speaker 3: whole lot of people into Charleston, and for the restaurants
• 28:54
Speaker 3: and the hotels and so on and so forth. But
• 28:56
Speaker 3: it was a great night. Of course, there was another
• 28:58
Speaker 3: concert Saturday night at the Cottleseum and Convention Center with
• 29:02
Speaker 3: Rodney Carrington, and then the Hunting Fishing Show wrapped up yesterday.
• 29:06
Speaker 3: It was a lot going on for one weekend. And
• 29:12
Speaker 3: I do really appreciate folks hanging out with us for
• 29:14
Speaker 3: all four events, the Hunting and Fishing Show, the two concerts,
• 29:17
Speaker 3: and the Red's Caravan. And also I want to say
• 29:20
Speaker 3: thanks to everyone who helped out with our second annual
• 29:23
Speaker 3: Panhandle Cleaning and Restoration WVRC Media Charleston Sock Drop for
• 29:28
Speaker 3: Union Mission. We had well over two thousand two thousand
• 29:31
Speaker 3: pairs of socks that were collected, and then more were
• 29:36
Speaker 3: added to that Saturday night as one of the local
• 29:42
Speaker 3: motorcycle groups had a birthday party for their leader. And
• 29:45
Speaker 3: from what I was not there, but from what I
• 29:47
Speaker 3: have been told, as part of the price of admission,
• 29:50
Speaker 3: in order to get in you had to donate socks,
• 29:53
Speaker 3: and so we were able to pick up another couple
• 29:56
Speaker 3: hundreds of pairs of socks to be given to those

Speaker 3: good stuff. Kind of a bizarre story here in the
• 36:07
Speaker 3: capital city from early yesterday morning. Jeff Jenkins writes about
• 36:11
Speaker 3: it this morning wv Metronews dot com. According to Charleston Police,
• 36:16
Speaker 3: a man identified as thirty four year old Ethan Chick
• 36:19
Speaker 3: Colbert of Saint Albans was murdered of the Easton of
• 36:23
Speaker 3: Charleston early Sunday morning. That's the city's first murder in
• 36:27
Speaker 3: the new year, and police, from what I understand, according
• 36:31
Speaker 3: to the story, are still looking for the shooter. Now
• 36:33
Speaker 3: you may recall that name. He served several years in
• 36:38
Speaker 3: prison after being convicted in twenty twelve and a domestic
• 36:41
Speaker 3: assault case. He was found to have beaten up his
• 36:45
Speaker 3: girlfriend on the side of the road on I seventy
• 36:48
Speaker 3: seven near Charleston. And the tragic well, the whole story
• 36:53
Speaker 3: was tragic. But to make it even more tragic, I
• 36:56
Speaker 3: guess you could say, if you remember that story, the
• 36:59
Speaker 3: woman then eleven year old son was with her and
• 37:05
Speaker 3: when he got out of the car to run to
• 37:08
Speaker 3: get help, he was struck and killed by a vehicle.
• 37:13
Speaker 3: Now again, as of showtime, no motive and no one

Speaker 3: They have their workers on H two A work visas. Now,
• 37:37
Speaker 3: whether that documentation is valid or not is a question,
• 37:41
Speaker 3: but the employers have plausible deniability to avoid repercussions of
• 37:44
Speaker 3: hiring documented workers. And I've talked about this on the show.
• 37:47
Speaker 3: I have a good friend of mine who owns a
• 37:50
Speaker 3: company and he frequently uses out of the country workers,
• 37:55
Speaker 3: but they are legal to be here because they are
• 37:58
Speaker 3: on work visas. He works with the government on this.
• 38:01
Speaker 3: If he was doing anything illegal, he wouldn't be more
• 38:04
Speaker 3: than likely working with the government on this. But again,
• 38:08
Speaker 3: I'm talking about the employers that don't go through the
• 38:11
Speaker 3: proper process. And I don't know that you see it
• 38:15
Speaker 3: so much in West Virginia, but you certainly see it
• 38:18
Speaker 3: down south. The first time I saw it was about
• 38:21
Speaker 3: ten fifteen years ago. My wife and I were visiting
• 38:23
Speaker 3: some of her family in North Carolina and jumped in
• 38:26
Speaker 3: the truck with my brother in law to go down
• 38:28
Speaker 3: to a local hardware store, a big chain store it something.
• 38:31
Speaker 3: He was working on something, and I just rode with him,
• 38:34
Speaker 3: and I saw a great number of these workers that
• 38:40
Speaker 3: were kind of standing around, and I asked my brother
• 38:42
Speaker 3: in law, I said, well, what exactly are they doing?
• 38:45
Speaker 3: He said, Oh, they come down here in front of
• 38:46
Speaker 3: your low's or home depot or whatever the case was
• 38:49
Speaker 3: down there, and they just kind of hang out here.
• 38:51
Speaker 3: And then somebody that's got a roofing job or some
• 38:54
Speaker 3: sort of a farming this is kind of in a
• 38:56
Speaker 3: rural area, kind of a farming thing going on, they'll
• 38:59
Speaker 3: just pull up, say give me him, him him, and
• 39:02
Speaker 3: put him in the back of the truck. And so, yeah,
• 39:05
Speaker 3: that's that's the kind of thing I think that needs
• 39:07
Speaker 3: to be cracked down on it. Again, make no mistake
• 39:09
Speaker 3: about it. I'm not saying that illegal immigrants should should
• 39:13
Speaker 3: not be you know, the ones that are not making
• 39:16
Speaker 3: any effort to become legal, not not doing about the
• 39:20
Speaker 3: right the right way. I have no issue with that.
• 39:23
Speaker 3: But I think that something needs to be done with
• 39:25
Speaker 3: the employers as well. Texas Dave Baron Trump was born
• 39:30
Speaker 3: in America when Malatia was not a citizen, and she
• 39:33
Speaker 3: broke immigration laws, that is automatic deportation by Trump standards. Well,
• 39:37
Speaker 3: maybe maybe he just wants rid of his wife. I
• 39:40
Speaker 3: don't know. Text says these illegals show more entrepreneurial spirit
• 39:44
Speaker 3: than most white Americans. You know what, I don't disagree.
• 39:50
Speaker 3: For the most part, that's not going to make me
• 39:51
Speaker 3: very popular, But for the most part, I for the
• 39:55
Speaker 3: most I'm not talking about the ones that are coming
• 39:57
Speaker 3: here and committing crimes. I'm talking about the ones that
• 39:59
Speaker 3: are actually working. There's something to be said for entrepreneurial spirit,
• 40:04
Speaker 3: but there's also something to be said for doing it
• 40:06
Speaker 3: the right way. Restoring sanity. I don't think on the
• 40:13
Speaker 3: surface anyone would argue with that term. Brad McIlhenny has
• 40:18
Speaker 3: a story posted about this this morning wv Metronews dot com.
• 40:22
Speaker 3: Senator Patricia Rucker, who is the newly named chair of
• 40:25
Speaker 3: the Senate Government Organization Committee, says she will bring back
• 40:29
Speaker 3: legislation that she calls the Restoring Sanity Act that would
• 40:37
Speaker 3: codify restrictions on the use of DEI diversity, equity and
• 40:43
Speaker 3: inclusion standards. Now, speaking on talk Line last week with
• 40:47
Speaker 3: Dave Wilson and TJ. Meadow, Senator Rucker said she has
• 40:51
Speaker 3: asked to reintroduce it this session, which gets underway next month,
• 40:58
Speaker 3: and if it goes anywhere, the bill would be, according
• 41:03
Speaker 3: to Brad's story, another in a series of state and
• 41:06
Speaker 3: federal actions designed to crack down on DEI. Now, you know,
• 41:12
Speaker 3: the whole concept of DEI is a set of policies
• 41:17
Speaker 3: in business, government, and the world of higher education to
• 41:22
Speaker 3: address what some see as systemic inequities faced by certain groups.
• 41:30
Speaker 3: President Trump, Governor Morrissey, and others have talked about it
• 41:34
Speaker 3: a lot. Now. President Trump's executive order was titled Ending
• 41:40
Speaker 3: Illegal Discrimination and Restoring Merit Based Opportunities. That's the exact title.
• 41:47
Speaker 3: President Trump has referred to such DEI policies as his words, dangerous, demeaning,
• 41:54
Speaker 3: and immoral. The executive Order, I'm the President, also addresses
• 42:02
Speaker 3: federal contracts and other private entities. Now, last week, President
• 42:10
Speaker 3: Trump ordered all US government staff that had been working
• 42:15
Speaker 3: on DEI stuff to be placed on paid administrative leave.
• 42:21
Speaker 3: The administra You're so you're gonna have them stay home
• 42:24
Speaker 3: and pay him. That makes sense. The administration has also
• 42:29
Speaker 3: as federal employees to expose any of their co workers
• 42:35
Speaker 3: who may still be working on DEI programs. Now, now,
• 42:41
Speaker 3: let's go back stateside for a moment. On day one
• 42:46
Speaker 3: in office, Governor Morrissey issued his own executive order to
• 42:50
Speaker 3: quote order the cessation of DEI.
• 42:55
  Speaker 2: Now.
• 42:55
Speaker 3: The order, according to the governor, says, no state office,
• 42:59
Speaker 3: under the govern authority, or in any entity receiving state funds,
• 43:05
Speaker 3: may allow again quoting preferences based on one's particular race, color, sex,
• 43:13
Speaker 3: or national origin, et cetera end quote. House Minority Leader
• 43:18
Speaker 3: Sean Hornbuckle referred to the governor's DEI initiative as again
• 43:23
Speaker 3: quoting a lot of quotes here, creating a DEI boogeyman
• 43:27
Speaker 3: that doesn't exist in quote. Senator Patricia Rucker, who was
• 43:33
Speaker 3: born in Venezuela, says voters expect these things to be addressed,
• 43:39
Speaker 3: and she was on talk line last week again with
• 43:43
Speaker 3: Wilson and Meadows, saying, quote, we continue to get stories
• 43:46
Speaker 3: from our constituents who are facing what I call discrimination
• 43:51
Speaker 3: based on these types of policies end quote. She went
• 43:55
Speaker 3: on to say that she considered DEI policies to be offensive.
• 44:01
Speaker 3: And going back to last year, the Restoring Sanity Act
• 44:06
Speaker 3: or his SB eight seventy from last year was sponsored
• 44:09
Speaker 3: by Senator Rucker and advanced through the Senate Education Committee,
• 44:13
Speaker 3: but then it stalled in the Senate Judiciary Committee. Now
• 44:16
Speaker 3: Brand has a very detailed story about it, as I said,
• 44:19
Speaker 3: posted at wv metronews dot com. And anytime you start
• 44:23
Speaker 3: talking about DEI, it really gets people fired up. I
• 44:30
Speaker 3: was in a text exchange, a very polite exchange, by
• 44:33
Speaker 3: the way, with a good friend of mine over the weekend,
• 44:37
Speaker 3: who happens to be a person of color, and he
• 44:40
Speaker 3: texted me about that, and I just asked, and we were
• 44:43
Speaker 3: kind of just talking about opinions. Funny thing was, we
• 44:46
Speaker 3: started out disagreeing on a couple of things. Again it
• 44:50
Speaker 3: is very, very very cordial conversation as best you can
• 44:53

• 44:57

• 45:03

Speaker 3: lookause here it's our good friend TJ. Meadows, co host
• 49:08
Speaker 3: of Metro News talk line. Good morning, sir, how are
• 49:11
Speaker 3: you man? So I've spent a lot of time this
• 49:14
Speaker 3: morning reading text. I had a lot of text to
• 49:16
Speaker 3: get you. One of those was a text somebody asking
• 49:19
Speaker 3: me about the rumors that there were several ice arrests
• 49:25
Speaker 3: I guess or whatever in the area yesterday. Again, we
• 49:27
Speaker 3: have no confirmation of that. I saw it on social media,
• 49:30
Speaker 3: as I'm sure you did, and you know it's on
• 49:32
Speaker 3: social media. It must be true. It must be true.
• 49:33
Speaker 3: But one of the texts I found particularly entertaining, TJ said,
• 49:39
Speaker 3: if Ice is raiding West Virginia, say goodbye to the
• 49:41
Speaker 3: quality of Mexican food. I have already, it's already catered
• 49:44
Speaker 3: to the West Virginia palle but now it'll taste like
• 49:47
Speaker 3: mayonnaise and marinara sauce. I don't know if I should
• 49:51
Speaker 3: be if that is offensive or wat, but it's pretty
• 49:53
Speaker 3: dang funny whatever it is.
• 49:54
Speaker 12: Yeah, I think that's just trying to, you know, get
• 49:56
Speaker 12: a funny end of this situation.
• 49:58
Speaker 3: Well it worked because I laughed. Yeah, oh yeah, I
• 50:00
Speaker 3: appreciate the humor. I was.
• 50:02
Speaker 12: I was looking on the xbox here to see if
• 50:05
Speaker 12: I could find how many people ICE actually arrested yesterday.
• 50:08
Speaker 3: They put a daily number out and this is nationwide.
• 50:11
Speaker 3: But yeah, it was Does nine hundred sound hot? Sounds?
• 50:16
Speaker 3: I think not? Maybe nine eighty four? Even I thought,
• 50:18
Speaker 3: is how about nine four? Now day? I thought it
• 50:21
Speaker 3: was in the nine hundreds. It was in the nine hut.
• 50:23
Speaker 3: And that's nationwide. That's calm down people. That's not in
• 50:26
Speaker 3: Taye Valley in honey Nuts. That's that's nationwide. Well, you
• 50:29
Speaker 3: got on a big show today, my friend. Yeah, we
• 50:31
Speaker 3: got a lot going on. So coming up right tople
• 50:33
Speaker 3: show of ten oh six minority whipping the House. Delegate
• 50:36
Speaker 3: Sean flew Hardy from up in the Northern Panhandle joins us.
• 50:40
  Speaker 3: We'll ask him.
• 50:41
Speaker 12: About this situation with the the de Soto seat in
• 50:43
Speaker 12: the ninety first. You know, it broke on Friday with
• 50:46
Speaker 12: clarification from the Supreme Court that the automatic stay was
• 50:49
Speaker 12: just that from Roger Hanshaw. There's a provision in the
• 50:52
Speaker 12: law that says you can't sue someone before or after
• 50:56
Speaker 12: the legislature. I don't have the exact days in front
• 50:57
Speaker 12: of me. I'll get it for the show, but you
• 51:00
Speaker 12: can't sue him. And so he was part of that suit.
• 51:02
Speaker 12: So he said, hey, I'm putting the Cabash on this,
• 51:04
Speaker 12: I'm stopping it allows me to do that. So we'll
• 51:08
Speaker 12: talk with Sean kind of see how the Democrats are
• 51:10
Speaker 12: going to regroup, what they'll do, how we move on,
• 51:12
Speaker 12: because if the status holds, Dave, I mean we're talking
• 51:16
Speaker 12: May the twelfth, now before this gets adjudicated with the
• 51:20
Speaker 12: Supreme Court, which will long be after session.
• 51:22
Speaker 3: And then with the session is starting in February eleven.
• 51:24
Speaker 3: That's that's somewhat problematic, somewhat problematic. And you know, what
• 51:28
Speaker 3: good is one seat when you've got ninety others if
• 51:30
Speaker 3: you're the Republican. So we'll get into that with Sean.
• 51:32
  Speaker 3: Ten thirty three.
• 51:33
Speaker 12: There have been reports of whooping cough in Putnam County
• 51:37
Speaker 12: and Cabal County. We'll talk with an infectious disease specialist
• 51:40
Speaker 12: from Vandelia Health talk about that issue and also get
• 51:43
Speaker 12: into vaccines in general. There's been a lot of call
• 51:46
Speaker 12: on my show to explain how vaccines work. I've told
• 51:50
Speaker 12: people what I think and what I read, but they
• 51:52
Speaker 12: want to hear it straight from an MD.
• 51:54
  Speaker 3: So we'll do that a litlevent. You're not a doctor.
• 51:56
Speaker 12: No, No, I'm many things, but doctor is not one
• 51:58
Speaker 12: of But doctor's not one of them. I did stay
• 52:00
Speaker 12: at a holiday and express a long time ago. But anyway,
• 52:04
Speaker 12: So coming up at eleven oh six, a lot going
• 52:06
Speaker 12: on in the Mountain State this week.
• 52:07
Speaker 3: We had a murder here in Charleston. We had a
• 52:09
Speaker 3: resort catch fire in the EP.
• 52:11
Speaker 12: We had a trailer explode in Clarksburg, supposedly from a
• 52:14
Speaker 12: gas leak. We'll learn more about that eleven thirty, our
• 52:16
Speaker 12: friend Steven Adams stops by. Plus the text line's been crazy,
• 52:20
Speaker 12: keep it coming. We'll get your thoughts, concerns, questions. It
• 52:23
Speaker 12: would be a good show.
