SPEAKER_00: Hoy en español Cintia Natario, Commercial Researcher and Innovation Specialist in the Instituto, Commercial Contract Management Institute, and hoy habla de Monsore desblocking.
• 0:36
SPEAKER_01: Hola Cintia, muchas gracias por receber.
• 0:41
  SPEAKER_00: Muchas gracias, Oscar.
• 1:53
SPEAKER_00: My first question is what is the difference fundamental between the contratation based in results, OBC, and the contratation based on desempense or performance-based contracts, and what it's important to distinguish.
• 2:11
  SPEAKER_02: I think it's a question very well.
• 2:12
SPEAKER_02: I think normally I serve to enter the difference between different instruments contractual, trying to enter in what are you.
• 3:01
SPEAKER_02: This is in all the world, not in Students or in America Latin or in Europe.
• 3:08
SPEAKER_02: This is the vision prevalent of the content public.
• 3:26
SPEAKER_02: And the solution that we have traditionally is controlled and different that we can see.
• 6:41
SPEAKER_02: But I think in the end, what important really is more fun those contracts than whatever.
• 6:46
  SPEAKER_00: What mentioned, Oscar.
• 6:55
SPEAKER_00: The two BTs exist during.
• 8:56
SPEAKER_02: There are advances, you know, with the data that we have actually in the Open Contracting Partnership for advancing standards of data that exists, more information about the form in which we use the information, and the technology has the barrier of entrance for that government does.
• 9:13
SPEAKER_02: But having seen this, I think that there's an interest renovation, but today there's much to do for move to this really ejecut in the practice.
• 9:21
SPEAKER_00: Yeah, this is good to escuche.
• 9:22
SPEAKER_00: And it's tan difficult definar resultados claros y medibles, and how the organizations super.
• 9:59
SPEAKER_02: And if not the result, in the planet, all the time in the contrat collapse.
• 10:07
SPEAKER_02: But this type of what we're talking about, why is that the contracts don't have objectives?
• 10:10
  SPEAKER_02: The contrats have objectives.
• 10:11
SPEAKER_02: There are what is that, or the contracts have much provisions around which we have to do this, we're going to do this, and this is confusing with an objective.
• 10:19
SPEAKER_02: An objective can be an objective of political public.
• 10:29
SPEAKER_02: This is an objective in political political.
• 10:31
SPEAKER_02: For example, if you try to explore what is the big system of transport or what reforms, you have to say things like in this moment at the time of Bogotá, for an example, let me in two hours to get from the work, and we can reduce this in 30%.
• 10:49
SPEAKER_02: This is because I think about what are the solutions that can make the market to get these solutions, and a bit trying to make it sufficiently, but we have to reduce a little bit more, but the data is so ample for that for what.
• 11:07
SPEAKER_02: So this exhibits plan, exactly the company have, execute dialogue with the students and potential providers, and have a conversation of political public that many people have fragments, and also they go from the responsible.
• 11:24
SPEAKER_02: If I permit, I think there's an example that I wanted to do of a project in which I was in the municipality of Santiago in Chile about parking.
• 11:40
SPEAKER_02: The contracts previous were completely to specifically insumes.
• 11:48
SPEAKER_02: These are the packets exactly that you can use for the CESPET.
• 12:02
SPEAKER_02: And we said what antiquity were the people, but it's a provision that was in many ways and had all the time.
• 12:07
SPEAKER_02: But it was completely found in this content, but in no way of the contracts had a definition clear of what a park was.
• 12:15
  SPEAKER_02: What happened?
• 12:16
SPEAKER_02: The inspector municipalities were the time with the providers on the operatives.
• 12:22
SPEAKER_02: The providers anticipated multilaterals, and they implemented the prices afterwards to protect them to when we were the multiple, and the real deteriorated for this.
• 12:45
SPEAKER_02: We have to learn things like the longitudinal cesped, what is acceptable, the limpieza, all that costs and move to that implication, you know, really the bullets, but this was the essence difficult that we had to do.
• 13:04
SPEAKER_00: And how are the cultural and structural are necessary dental of the government and the industry for that the OVCs or outcome-based contracts or contracts based on results function?
• 13:19
SPEAKER_00: Do you have other signals?
• 13:40
SPEAKER_02: Obviously, I think there's a problem with the government that I mentioned, and is that in terms of cultural, there is really a cultural innovation in any government for definition.
• 13:59
SPEAKER_02: In many ways, we can have initiatives innovation.
• 14:02
SPEAKER_02: But normally what we do in government is a culture of the fact that if you have a content that is functioning optimally, I'm going to make problems.
• 14:16
SPEAKER_02: But if you try to do something completely new, you launch an initiative completely new, this will be a little bit more.
• 14:23
SPEAKER_02: An example that I wanted to do is we work in the city of Mexico of bicicletes compared to Ecovici, and this was a contract that functioned bastard.
• 14:46
SPEAKER_02: But we should have more in this moment with the lider of the Secretary of Mobility, and the government and had an interest in really the form in which we were operating this contribution, and much of this, and precisely to work with the industry to say to the industry, standards better and the results were very good.
• 15:19
SPEAKER_02: But I think for a little bit that we dispute, is that the culture of beneficial contratists, there are contratists who are in contrat with the government and are listed for doing one and other things.
• 15:35
SPEAKER_02: There's a link of Jennifer Palk in which you have this, in Students, and I said an example of a provider who said if you say that you construct a bar of concret, you will construct, see?
• 15:46
SPEAKER_02: Because if you're constructing, this is what I'm my problem, the problem is to define what we want to do.
• 15:53
SPEAKER_02: So I think we have to involve the industry into the definition of the requisition so that new actors can enter.
• 16:01
SPEAKER_02: In Paraguay we are doing this, generally a system that's Vigia, in which we permit that new empresas can enter, reducing much of the cost of opportunities relevant and we have opportunity to have comments about the plagues or the bases or what, because it is different in all the places after this, after that just adjudicated that we can do it.
• 16:23
SPEAKER_02: I think this type of initiatives can be the culture and the collaboration that exists between the government and the sector private.
• 16:58
SPEAKER_02: Inclusive, I was talking with a colleague who is academic, and just the weekend a paper.
• 17:36
SPEAKER_02: But we'll go to what the report is every when it is, right?
• 17:44
SPEAKER_02: And I think that's where we enter the pilot, right?
• 17:48
SPEAKER_02: The effect of this depends on the design of the metrics that we have, the collaboration that exists from the parties.
• 18:00
SPEAKER_02: I said the example of Santiago, the example of Ecovici.
• 18:02
SPEAKER_02: In Ecovici, after we had the contribution, we had six months, a little bit more because we extend to defining what were the standards of service for what had been in the operation and what was good for the contratist and happy for the government, right?
• 18:16
SPEAKER_02: So this is confidence for this experiment, right?
• 18:21
SPEAKER_02: So it value the model in the muscular institution, which notes in abstract, right?
• 18:29
SPEAKER_02: And I think that for this is the way.
• 18:41
SPEAKER_02: The one for contracts that are in execution, and it's to have the period of option of the contracts and convert it in a pilot.
• 18:47
SPEAKER_02: I mean, this is a very good idea, never been in the practice, but I mean it's good because I think it's a labour and the contratista to garantize this period additional, right?
• 18:56
SPEAKER_02: And the second for contracts new is a little bit of what we were talking about, right?
• 19:00
SPEAKER_02: And it's deciding in what you can innovation and in what not, and then comparing what function and what not function.
• 19:08
  SPEAKER_00: Totally.
• 19:08
  SPEAKER_00: Much Oscar.
• 19:09
SPEAKER_00: And for ultimately, what we have the industry in the co-creation of definitions of results and governance, and how we can make this collaboration.
• 19:27
SPEAKER_02: This is the manner in which function or not function the contracts oriented to results.
• 19:42
SPEAKER_02: The government will know in principle what they do and what.
• 19:54
SPEAKER_02: But the government has the connection to definition exactly if the market is less to do X or Y resultation.
• 20:01
SPEAKER_02: This technology is super clear, right?
• 20:04
SPEAKER_02: The government will start with the solutions that exist, what cost the technologies exist, what not, and what operators are in each type of service.
• 20:13
SPEAKER_02: This connection in the market.
• 20:15
SPEAKER_02: If you want to design a big content of results, you can estimate what they're doing the service after the process, or when there's a lot of players.
• 20:25
SPEAKER_02: So this is structural, and if it's not functional.
• 20:29
SPEAKER_02: So the process is already the possibility of dialogue and the market, and it's when we have markets in sort of manner of communication, and I think it's important if one of what you saw is a contrat, because a little bit of co-creation, right?
• 20:54
SPEAKER_02: I did the example of COVID, and the Santiago and in many ways where I think there are a lot of practices, which for me are important as the definition of the plan.
• 21:06
SPEAKER_02: So what is that you have reactions frequently with the service, to transform the relationship that you have from a dynamic adversary that normally forms between the contractor and the companion public, where one fiscalizes and the other simply trying to defend and work in resolve problems, so this implications are revenue of display frequently, mensual or data from the message, identification tendencies, practice, not only problems, and those disabilities in time, not even at the final year to say, you have standards of service, so we'll put this multiple, we don't have that, we don't have that, but really a dynamic of construct, and the contract is also like a document legal, and it will be more of the report from one of the principal of World Commercial Contracting is a very important thing.
• 22:00
SPEAKER_02: It's a relation in the whole inverter, cierto, and how construction this relationship and how it's all, pues precisely creating these types of instruments for many.
• 22:31
  SPEAKER_00: Much, Oscar.
• 22:33
SPEAKER_00: De verdad, what great conversation.
• 22:34
SPEAKER_00: Thanks for all your responsibility, for contests.
• 22:38
SPEAKER_00: And this is all the time that we have the day of hour in this episode of The Leading Edge.
• 22:58
SPEAKER_00: The OVCs don't have a solution, but a process that required patience, confiance, and clarity, empezando con project pilot, appreciate the experience, as ejemplos, and money el enfoque and impact, the process, the organizations would definitely come to desbloque the verdict of the model based on result.
• 23:26
SPEAKER_00: Manténganse atentos at our episode, donde continuaremos explorando las ideas, innovaciones, andos de liderazgo que están dando forma al futuro del comercio y la contratación.
• 23:36
SPEAKER_00: And recuerden, sigan siempre cuestionándose, adaptándose andereando.
• 23:40
  SPEAKER_00: Muchas gracias, Oscar.
