- 1:04SPEAKER_03: We've got Lisa and Lydia in the house with us today.
- 1:09SPEAKER_03: And we've got Caitlin.
- 1:10SPEAKER_03: Lisa throwing out the We were racing the roof.
- 1:13SPEAKER_03: Yeah, and we are going to talk about the truth about real estate offers, why handshakes just don't buy houses.
- 1:19SPEAKER_03: Handshakes are great, but they're not legally binding.
- 1:21SPEAKER_04: No.
- 1:21SPEAKER_03: Right?
- 1:22SPEAKER_03: Not like the good old days where if you broke the handshake, you got shot.
- 1:25SPEAKER_03: Right.
- 1:26SPEAKER_03: The days of the Western days.
- 1:27SPEAKER_04: Hung in the town square.
- 1:28SPEAKER_03: Yeah, well, okay, yeah.
- 1:30SPEAKER_03: All right.
- 1:35SPEAKER_03: At least they don't hang you, then shoot you.
- 1:36SPEAKER_05: That'd be terrible.
- 1:37SPEAKER_05: That was back when your words meant something.
- 1:39SPEAKER_03: See?
- 1:40SPEAKER_05: So you made sure that your word.
- 1:41SPEAKER_03: And they shoot.
- 1:42SPEAKER_04: I was just gonna say that people don't keep their word as much anymore.
- 1:45SPEAKER_03: They don't.
- 1:46SPEAKER_03: That's why we have to haper.
- 1:48SPEAKER_03: Well, we're gonna we're gonna break down one of the most misunderstood parts of real estate transaction, right?
- 1:53SPEAKER_03: Making that offer.
- 1:54SPEAKER_03: An offer, that offer, the offer, right?
- 1:56SPEAKER_03: The the holy grail.
- 1:57SPEAKER_03: The offer.
- 1:58SPEAKER_03: Many buyers and sellers hear terms like verbal offer, earnest money, written contract, but don't always understand why they matter.
- 2:06SPEAKER_03: So today we're gonna discuss that, right?
- 2:08SPEAKER_07: Yeah.
- 2:09SPEAKER_03: Why every offer should be in writing, right?
- 2:11SPEAKER_03: Why earnest money is and why it's important, what verbal offers are really worth, not worth the paper the written on, are they?
- 2:18SPEAKER_05: Well, there's no paper involved.
- 2:20SPEAKER_05: That's my point.
- 2:20SPEAKER_05: Yeah, exactly.
- 2:21SPEAKER_03: Zero doubt common mistakes buyers and sellers make during negotiations.
- 2:25SPEAKER_03: So we've talked about in the past negotiation.
- 2:27SPEAKER_03: So sounds like we're gonna be diving back into that, right?
- 2:30SPEAKER_03: So let's go into why everyone, every offer should be in writing.
- 2:34SPEAKER_03: Who wants to kick off first?
- 2:36SPEAKER_03: Lydia's got Lydia, I can see her wheels.
- 2:38SPEAKER_03: This guy could see it too.
- 2:40SPEAKER_03: Sorry, I was doing the cuckoo sound, but I guess that was the thinking.
- 2:43SPEAKER_03: Her wheels are her wheels are turning, not that she's woo-hoo! Correct both.
- 2:48SPEAKER_03: It's not the same as Lisa doesn't.
- 2:50SPEAKER_06: We can talk all day on the phone, verbally, say anything we want, but until a buyer or seller sees it on paper, it doesn't mean anything because you can change what you said five minutes later.
- 3:01SPEAKER_06: And we need it on paper.
- 3:03SPEAKER_06: We need the signatures from both sides to confirm that they both understand what's going on because we all know how phone calls happen and how talking in person and words get changed, they get jumbled.
- 3:14SPEAKER_06: We don't always understand unless it's in writing.
- 3:17SPEAKER_06: Right.
- 3:17SPEAKER_05: And emotions fly high.
- 3:19SPEAKER_05: Yes.
- 3:19SPEAKER_05: I get really excited, you know.
- 3:21SPEAKER_05: I'm a buyer and I'm excited about the house, and yeah, I will give the house.
- 3:27SPEAKER_05: And then we go back and we say, Hey, he says that he will give, blah blah blah.
- 3:32SPEAKER_05: Right.
- 3:33SPEAKER_05: And then he goes home and thinks about it.
- 3:35SPEAKER_04: The reality sets in, they're going, crap.
- 3:38SPEAKER_04: Buyer's remorse.
- 3:39SPEAKER_05: Yeah.
- 3:39SPEAKER_05: Immediately.
- 3:42SPEAKER_05: You haven't said anything yet, have you?
- 3:44SPEAKER_03: Well, yes, we have.
- 3:46SPEAKER_05: Yes, we have.
- 3:47SPEAKER_05: And so, and it just kind of gets everybody in a bad way because emotion supply high, and then that emotion goes breaks hit.
- 3:55SPEAKER_03: Or emotion hits emotion.
- 3:56SPEAKER_03: Buyer seller emotion hits the realtor right in the middle because they're the yeah, they're the go-to.
- 4:01SPEAKER_05: And it protects, you know, a written agreement protects both sides.
- 4:06SPEAKER_05: It is a clear path to where we're going.
- 4:09SPEAKER_05: Right.
- 4:09SPEAKER_05: We are purchasing a home, we are selling a home, and we are going to a closing table, and everybody knows.
- 4:15SPEAKER_05: We know what the price is, we know the terms, we know what kind of financing, we know the closing date.
- 4:22SPEAKER_05: All of those things are written down for a reason.
- 4:25SPEAKER_05: Because can we revisit those things?
- 4:28SPEAKER_05: Absolutely.
- 4:29SPEAKER_05: We can revisit.
- 4:30SPEAKER_03: Ink pin works.
- 4:31SPEAKER_04: Ink pin works.
- 4:33SPEAKER_04: So if say, and here's just a question that I have, and it it might it's probably we're gonna talk about it later on, but maybe not.
- 4:40SPEAKER_04: If someone's buying their or someone's selling their house on their own.
- 4:45SPEAKER_04: Selling their house.
- 4:45SPEAKER_04: Not not a for sale by owner.
- 4:47SPEAKER_07: Yes.
- 4:48SPEAKER_04: Yes, thank you.
- 4:48SPEAKER_04: Okay.
- 4:49SPEAKER_04: So I mean, and somebody else just walks up, it's like, hey, hey man, like I I want to buy your house.
- 4:53SPEAKER_03: Like hey woman, I want to buy your house.
- 4:55SPEAKER_04: Yeah, hey girl.
- 4:56SPEAKER_03: What's up, girl?
- 4:56SPEAKER_03: I'll buy your crib.
- 4:58SPEAKER_04: I I saw your curb appeal and it's a 10 out of 10.
- 5:00SPEAKER_03: Oh, wait, no, we're talking about houses, Caitlin.
- 5:02SPEAKER_03: Talking about houses.
- 5:03SPEAKER_03: Okay, go on.
- 5:05SPEAKER_04: Would they have to have is it legal for them to have to have paperwork if they're doing it themselves without a realtor?
- 5:11SPEAKER_04: They they can do the whole the whole shit.
- 5:14SPEAKER_04: Dude, see, I I don't like that.
- 5:16SPEAKER_04: I I thought it was illegal, like in the nation.
- 5:18SPEAKER_04: Well, you have to have title work done.
- 5:20SPEAKER_04: Okay.
- 5:20SPEAKER_06: And the title the title company will ask for a contract.
- 5:24SPEAKER_06: Yeah.
- 5:24SPEAKER_06: So they have generic contracts that they can give to the it's very generic, yeah.
- 5:29SPEAKER_05: But can it no, I don't like that.
- 5:30SPEAKER_05: Yeah.
- 5:35SPEAKER_03: I've done that.
- 5:36SPEAKER_03: I I bought a piece of property from someone selling it themselves.
- 5:40SPEAKER_05: Yeah.
- 5:40SPEAKER_03: I'm like, all right, I'll give you this for it.
- 5:42SPEAKER_03: Great, we'll take that for it.
- 5:44SPEAKER_03: We went and got a generic one from Lang title.
- 5:46SPEAKER_07: Yeah.
- 5:46SPEAKER_07: Yeah.
- 5:47SPEAKER_03: And we just filled out the details on it.
- 5:49SPEAKER_03: We took it up there.
- 5:50SPEAKER_03: They did the due diligence and we walked away 15 days or so later because there was nothing financing.
- 5:55SPEAKER_05: It was just numbers and dates you have to know.
- 5:58SPEAKER_05: And then who's buying so that they can create the colours?
- 6:00SPEAKER_05: So they can create the title.
- 6:01SPEAKER_04: And I guess it would and the deed.
- 6:02SPEAKER_04: Yeah, it would deter, I guess it would depend on like who I guess you're doing this deal with, like that.
- 6:08SPEAKER_04: Absolutely.
- 6:09SPEAKER_04: Right.
- 6:09SPEAKER_04: You probably want to do your homework.
- 6:10SPEAKER_04: But to be safe, obviously want to go with realtors.
- 6:14SPEAKER_05: Well, because I will go to talk to somebody that's getting ready to sell at home, and they'll say, you know, before you write that, you know, my neighbor or my friend says they want to buy this house.
- 6:26SPEAKER_05: Well, that's great.
- 6:27SPEAKER_05: And and I will put the halt on everything and let that right.
- 6:31SPEAKER_05: But do you have a pre-approval from them?
- 6:33SPEAKER_05: Do they have the money?
- 6:34SPEAKER_05: Yeah, all that's done.
- 6:36SPEAKER_05: You know, I'd like a boat, all right?
- 6:37SPEAKER_05: But I don't have the money for the boat.
- 6:39SPEAKER_03: Well, darn it, Lisa, just go buy a darn boat.
- 6:41SPEAKER_03: It's mine.
- 6:42SPEAKER_03: Randy says buy your wife a boat.
- 6:45SPEAKER_05: Lisa.
- 6:45SPEAKER_05: I know.
- 6:46SPEAKER_05: He says Lisa, we don't need a boat.
- 6:48SPEAKER_05: So but anyway, that's the thing.
- 6:50SPEAKER_05: You can say those things, but you don't have the cash behind you.
- 6:54SPEAKER_05: Now you've got the seller, they're like, Oh yeah, they're going to buy my no they're not because we haven't gone through.
- 7:03SPEAKER_05: So I don't say, go do your thing, call me when they decide or decide for real.
- 7:07SPEAKER_05: Yeah.
- 7:07SPEAKER_05: So you've got your purchase price, you've got your financing terms, you got your closing date, you got your earnest money amount, your inspection contingencies, the appraisal contingencies, the possession date, and any special requests.
- 7:20SPEAKER_05: Those are all in writing.
- 7:21SPEAKER_05: And some people would be like, Well, why do you have to have all that in writing?
- 7:25SPEAKER_05: Because a microwave can stop a deal.
- 7:29SPEAKER_05: Depending on the way you said that.
- 7:31SPEAKER_03: I was like, But like, what do you mean?
- 7:33SPEAKER_04: Like if it if it doesn't work.
- 7:35SPEAKER_03: Or if it's not there.
- 7:36SPEAKER_04: If somebody took it.
- 7:39SPEAKER_03: Point taken.
- 7:40SPEAKER_03: We we bought a house in Grafton, was fully furnished, supposed to stay fully furnished.
- 7:45SPEAKER_03: Everything was an Airbnb, just everything stays, right?
- 7:48SPEAKER_05: Yeah.
- 7:48SPEAKER_03: We bought it closing, then after closing, we went down there and there was stuff missing on the walls.
- 7:52SPEAKER_05: That's why we're gonna do another segment on another day on final walkthroughs and why they're so important.
- 7:58SPEAKER_05: Yeah, you have to do those final walkthroughs because you gotta know this stuff is there.
- 8:02SPEAKER_05: Yeah.
- 8:03SPEAKER_05: And see, you want that in writing.
- 8:04SPEAKER_04: You would, like you said, that would need to be a little bit more.
- 8:07SPEAKER_03: Okay, it was incidental picks that went with the theme of the house, but still.
- 8:12SPEAKER_03: All right, now we just had to replace those bare spots on the wall, which it was just crappy.
- 8:17SPEAKER_03: You know what I mean?
- 8:17SPEAKER_03: That they did.
- 8:18SPEAKER_04: It's almost like they did it like literally, like right before they locked the door.
- 8:22SPEAKER_04: Yes, like for the final time.
- 8:24SPEAKER_03: They hadn't been in the house for Airbnb.
- 8:26SPEAKER_03: So yeah, they went down.
- 8:28SPEAKER_05: And I can see people doing that, which is why the walkthrough.
- 8:31SPEAKER_05: For instance, we did a final walkthrough.
- 8:33SPEAKER_05: We went in and the refrigerator was not working.
- 8:36SPEAKER_05: It was supposedly new, stainless steel, all stainless steel appliances, refrigerator wasn't working.
- 8:41SPEAKER_05: So we said, refrigerator's not working, needs to be working before we close.
- 8:45SPEAKER_05: Well, they couldn't get it fixed.
- 8:47SPEAKER_05: It wasn't under warranty, whatever.
- 8:49SPEAKER_07: Right.
- 8:49SPEAKER_05: And so they had to buy a new one.
- 8:51SPEAKER_05: So when we went back to do the second, I was there early, met the seller, which I had never met before.
- 8:57SPEAKER_05: I'm on the buyer's side, and he I walked up to shake his hand, said, Hey, I'm Lisa Miller.
- 9:02SPEAKER_05: I he said, I know exactly who you are.
- 9:06SPEAKER_03: He made me buy a damn refrigerator.
- 9:08SPEAKER_05: Refrigerator was not the garage refrigerator was not good enough.
- 9:12SPEAKER_05: He said a few words that was not my favorite.
- 9:16SPEAKER_05: Right, right, right.
- 9:17SPEAKER_05: And so then I started backing up and I said, Sir, the listing sheet said all stainless steel appliances, that's what you offered, that's what they bought, and that's what we expect.
- 9:28SPEAKER_05: I'll be back when you get it in there.
- 9:30SPEAKER_05: So then I left.
- 9:32SPEAKER_05: Then we came back with the buyers, and he was gone, and we had a brand new refrigerator, and it was all taken care of.
- 9:39SPEAKER_04: But you know, if you don't if you didn't have that in writing, had he not signed it with the way he was acting, with what you're telling me, he could have just been a complete lunatic.
- 9:50SPEAKER_04: Right, right.
- 9:50SPEAKER_04: But you got you got it right here.
- 9:52SPEAKER_04: Hey, bro.
- 9:52SPEAKER_04: Yeah, I had it, I had it in writing, and that's why you know.
- 9:57SPEAKER_03: Hey man, hey girl, sub.
- 9:59SPEAKER_04: I don't know why am I like this today?
- 10:01SPEAKER_03: I don't know.
- 10:01SPEAKER_04: Did I listen to rap on the way here?
- 10:03SPEAKER_04: And it's like subconscious.
- 10:04SPEAKER_03: I don't know.
- 10:05SPEAKER_05: The listing sheets are what in writing.
- 10:08SPEAKER_05: Yeah, and so we go by those because it says what you are offering.
- 10:14SPEAKER_03: Correct.
- 10:14SPEAKER_05: So then we reiterate that.
- 10:17SPEAKER_07: When you're selling, right, right.
- 10:19SPEAKER_05: So that we make sure that all those things sometimes, and even when Lydia first started, she would say, but it's in the listing sheet.
- 10:27SPEAKER_05: And I said, Yeah, but we were we double degree.
- 10:29SPEAKER_05: We need to make yeah, you know my lists and my checklist.
- 10:33SPEAKER_05: Well, I then no one can.
- 10:34SPEAKER_03: She's like Santa Claus.
- 10:35SPEAKER_05: I know better.
- 10:37SPEAKER_04: It's why she's better.
- 10:38SPEAKER_04: She's better in Santa Claus, guys.
- 10:39SPEAKER_04: Seriously.
- 10:40SPEAKER_04: So all those things matter.
- 10:42SPEAKER_04: Delivering new homes.
- 10:43SPEAKER_03: Well, yeah, I know having it all in writing does matter.
- 10:46SPEAKER_03: And and with that, what needs to go with that offer that is in writing to cement that, hey, we are earnestly wanting to buy this home.
- 10:56SPEAKER_03: Hence the earnest money.
- 10:58SPEAKER_06: Earnest money.
- 10:59SPEAKER_06: Right.
- 11:00SPEAKER_06: Let's talk about earnings.
- 11:04SPEAKER_06: Like, hey, we are interested.
- 11:07SPEAKER_06: We want to buy your house.
- 11:08SPEAKER_06: And it's really just comfort for them knowing like they have money already involved in this, so they really do want to buy our house.
- 11:16SPEAKER_06: Everybody wants skin in the game.
- 11:17SPEAKER_06: Yes.
- 11:17SPEAKER_06: Yes.
- 11:18SPEAKER_06: Yes.
- 11:19SPEAKER_03: They're gonna have to spend it anyway if they're buying the home.
- 11:21SPEAKER_06: Yes.
- 11:21SPEAKER_06: And usually, so whenever the contract is accepted, it's within four days.
- 11:25SPEAKER_06: The earnest money has to be to the title company, and that's typically who we have hold it for us.
- 11:30SPEAKER_03: Oh gosh.
- 11:30SPEAKER_03: I usually if I'm making an offer, I usually have a check with it.
- 11:34SPEAKER_06: Well, well, and you do, yeah.
- 11:35SPEAKER_06: Most of the time they do, but you have four days, you have up to four days.
- 11:39SPEAKER_06: Because you might do it on a Friday, they're at work, and then gotcha.
- 11:42SPEAKER_06: Yeah.
- 11:42SPEAKER_04: Is the earnest money like a different amount for different like who who is that?
- 11:49SPEAKER_05: 1% of the seller company says, I would like to see 1%.
- 11:54SPEAKER_05: Yes.
- 11:54SPEAKER_05: That puts a little more skin in the game, and you're less apt to walk away.
- 11:59SPEAKER_05: So say it's a$500,000 house and I don't put$50 down.
- 12:02SPEAKER_05: You know, I'm putting earnest money down.
- 12:04SPEAKER_05: The seller that's looking at that is gonna say no.
- 12:07SPEAKER_05: The seller gets to ask for more earnest money.
- 12:10SPEAKER_05: Right.
- 12:10SPEAKER_05: More more skin in the game.
- 12:12SPEAKER_05: Right, right, right.
- 12:13SPEAKER_05: You're seriously serious about purchasing this.
- 12:16SPEAKER_05: I agree.
- 12:17SPEAKER_05: Yeah.
- 12:17SPEAKER_05: So if they if they only put something small down, are they really, really interested in the home?
- 12:24SPEAKER_05: Because they're gonna get it back.
- 12:25SPEAKER_03: Well, they won't get it back or it comes off the price of the home at Close.
- 12:28SPEAKER_03: Yeah, right, right.
- 12:28SPEAKER_04: Okay, because I was trying to remember, and because I couldn't understand this earnest money when I was buying my house.
- 12:34SPEAKER_03: You know, it's like a it's like a small down payment.
- 12:36SPEAKER_06: Well, because people do sometimes where's this money gonna go?
- 12:39SPEAKER_06: Like what does this go towards?
- 12:40SPEAKER_06: And it goes towards something at closing.
- 12:43SPEAKER_06: Correct.
- 12:44SPEAKER_06: Rather it be your like the closing cost.
- 12:46SPEAKER_06: Yes, yes.
- 12:46SPEAKER_06: Right, okay, okay.
- 12:47SPEAKER_05: And there's contingencies in place for you to be able to get that back.
- 12:51SPEAKER_05: Say the inspections come back and there's a lot of stuff, and the seller says they're not going to fix those things, then you have the right to get your earnest money back because the negotiation was not able to work its way out.
- 13:04SPEAKER_05: So now you get that back.
- 13:06SPEAKER_05: Now, the difference is uh a first-time homebuyer freaking out because I just bought a house and I don't want to, and I go home and I sleep on it the next day.
- 13:13SPEAKER_05: Lisa, I want that back.
- 13:14SPEAKER_05: I'm sorry, you can't get that back like that.
- 13:17SPEAKER_05: Right.
- 13:18SPEAKER_05: We have to have reasons.
- 13:18SPEAKER_05: So appraise them.
- 13:19SPEAKER_03: You can lose it.
- 13:20SPEAKER_05: You can lose it.
- 13:21SPEAKER_05: Okay.
- 13:22SPEAKER_04: It doesn't mean that the seller gets it.
- 13:24SPEAKER_04: Can so what if like two different, you know how these bidding wars or whatever.
- 13:28SPEAKER_04: Okay, so can like several people be putting down earnest money at a time?
- 13:33SPEAKER_05: So if there's four offers that come in, yeah, and you've got one that's a$50 or a hundred dollar earnest money, and you've got one that's a$2,500 earnest money, and then you've got one that says, I want to buy this house.
- 13:45SPEAKER_05: $25,000, I'm putting that in there, I'm serious.
- 13:48SPEAKER_05: Okay.
- 13:49SPEAKER_05: Okay.
- 13:49SPEAKER_05: So you're gonna look at it.
- 13:50SPEAKER_03: You would want to go at the$25k one unless there's something.
- 13:53SPEAKER_05: Unless you're you know, cash is king.
- 13:57SPEAKER_05: Is it a cash offer?
- 13:58SPEAKER_05: Is it a lender?
- 13:59SPEAKER_05: You know, there's all kinds of things that you look at.
- 14:02SPEAKER_05: But earnest money does matter.
- 14:04SPEAKER_05: Yeah.
- 14:04SPEAKER_05: So some people think that they can buy a home without any earnest money at all.
- 14:09SPEAKER_05: So say it's a first-time home buyer and they say, I don't really have any money to put down.
- 14:13SPEAKER_05: Well, that's a negotiation that we'll have to talk to the seller about.
- 14:16SPEAKER_05: Will they allow you not to put anything down?
- 14:19SPEAKER_05: Right.
- 14:19SPEAKER_05: Not normally.
- 14:20SPEAKER_05: They would like to do that.
- 14:21SPEAKER_04: Yeah, because it's just like a peace of mind.
- 14:23SPEAKER_03: Well, I was gonna say, would would there ever be a situation where you wouldn't have a buyer put earnest money down and the seller would take it off the market?
- 14:31SPEAKER_05: Yeah, and put it as active under contract?
- 14:33SPEAKER_03: Right.
- 14:33SPEAKER_05: Yeah, no.
- 14:34SPEAKER_03: Okay, no, not normally.
- 14:35SPEAKER_03: You as the real estate agents wouldn't recommend that either.
- 14:38SPEAKER_05: No, I would not recommend that.
- 14:39SPEAKER_05: Although it has happened.
- 14:40SPEAKER_05: Yeah.
- 14:41SPEAKER_05: Got the offer in, they said they weren't going to put any earnest money down.
- 14:44SPEAKER_05: They said it's not necessary.
- 14:46SPEAKER_05: They bought the meeting houses, the buyer said it.
- 14:49SPEAKER_05: Okay.
- 14:50SPEAKER_05: And I had to take that back and say, this is up to you.
- 14:53SPEAKER_05: We can come back and say we want earnest money, or you can just say, I'm gonna take it.
- 14:57SPEAKER_05: They kind of knew the family, so they took it and we did go ahead and proceed.
- 15:02SPEAKER_05: Went through without it.
- 15:03SPEAKER_04: Went through, but I don't recommend see, see, and that's like an exception one that kind of goes right as like a verbal.
- 15:10SPEAKER_03: It's a skin, skin in the game.
- 15:11SPEAKER_03: Yeah, right.
- 15:12SPEAKER_03: You know, skin in the game is the best way.
- 15:15SPEAKER_03: Yeah, no, that's that's awesome.
- 15:16SPEAKER_03: So Caitlin kind of brought it up about the verbal offer, right?
- 15:20SPEAKER_03: So, what is a verbal offer worth?
- 15:23SPEAKER_07: Nothing.
- 15:23SPEAKER_06: Very little.
- 15:24SPEAKER_06: Your word, that's it.
- 15:25SPEAKER_06: And word doesn't mean anything we said.
- 15:27SPEAKER_06: That's so sad, isn't it?
- 15:28SPEAKER_03: Well, it's not legally enforceable, right?
- 15:31SPEAKER_05: No, you you cannot say, you said I could say that all day long.
- 15:36SPEAKER_05: Right, right.
- 15:37SPEAKER_03: Well, sorry, I had a slight case of dementia for the last five minutes.
- 15:40SPEAKER_03: I don't know what I said.
- 15:41SPEAKER_05: Yes, there's no evidence, it's just the same thing.
- 15:43SPEAKER_05: Yeah, so so it's just like a buyer and a seller getting together without their real estate agents, and the seller says, Yeah, I'll throw that in, but he didn't talk to his wife, and now they're coming down to they're saying, but the but the seller said, Right, and did we put that in right?
- 16:01SPEAKER_03: But the wife didn't.
- 16:02SPEAKER_03: Yeah, yeah.
- 16:02SPEAKER_05: I mean, that's that's you know the wife is on writing, and you have both signatures, all three, you know, buyers, sellers, everybody's signatures, so that you know that you have it.
- 16:11SPEAKER_03: So, and there's a lot of blowhards out there, right?
- 16:13SPEAKER_03: Yeah, I'll buy this house, yeah, I'll buy it 100K right now.
- 16:18SPEAKER_03: Let's go.
- 16:18SPEAKER_04: I can see you dealing with more people like that, like with your business and men.
- 16:23SPEAKER_04: Like, I can because I know exactly what I'm saying.
- 16:27SPEAKER_03: Well, because I want this, this, this, and this, and I want it done now, and I'm not getting the down payment.
- 16:34SPEAKER_03: Sorry, yeah, find another contractor.
- 16:35SPEAKER_03: Yeah, see ya.
- 16:36SPEAKER_05: You have to have some kind of skin in the game.
- 16:38SPEAKER_05: Yes.
- 16:38SPEAKER_05: Are you gonna put your guys to work without skin in the game?
- 16:41SPEAKER_03: No, no, yeah.
- 16:42SPEAKER_04: And I see what you mean about like though, like I got so excited about my first house and did a lot of wrong things.
- 16:49SPEAKER_04: I'm too excited.
- 16:50SPEAKER_04: Okay, but then I someone like me, I went back and I talked to my mom and she was like, dude, you know, you're wrong, you're wrong.
- 16:56SPEAKER_04: So I had to call back to the set.
- 16:59SPEAKER_04: You see, so I know what you mean.
- 17:00SPEAKER_04: You just gotta keep it.
- 17:01SPEAKER_05: You have to be careful what you say that you will do because if you have time to think of in the moment, it sounds really good.
- 17:10SPEAKER_05: Yeah.
- 17:10SPEAKER_05: But now that you've had time to think about it, or you go to somebody who's bought houses before or in the business, and they say, Nope, you should have done this, this, and this, and then you go, now I feel that in my gut.
- 17:21SPEAKER_05: I truly did.
- 17:22SPEAKER_07: Yeah, I truly did.
- 17:23SPEAKER_07: I'm feeling it again.
- 17:25SPEAKER_05: It's like it's a kick in the gut.
- 17:27SPEAKER_05: Yeah.
- 17:27SPEAKER_05: But you know, can we call a like I could call Lydia if she has a house on the market and say, Hey Lydia, do you have any offers yet?
- 17:35SPEAKER_05: She would say, Yeah, I've got an offer, but it's not been, you know, approved yet.
- 17:40SPEAKER_05: And I could say, Well, I have, you know, I got somebody that wants to give, you know, and I could say a number and she'd say, Yeah, that's not gonna get it.
- 17:49SPEAKER_05: I know that's not gonna get it, you know.
- 17:51SPEAKER_05: So we can do someone that gave you a verbal I got somebody that gave me a verbal and wanted me to call.
- 17:56SPEAKER_05: They asked me to call before we put this in writing.
- 17:59SPEAKER_05: Let's see where we stand.
- 18:01SPEAKER_05: Yeah.
- 18:01SPEAKER_05: Because I'm only willing to give this much.
- 18:03SPEAKER_05: And so I can call her and then say, Here's what they'd like to give.
- 18:06SPEAKER_05: And she'd say, I already have one at that, and they've already said no.
- 18:10SPEAKER_04: Well, that's just a little fun little negotiation phone call.
- 18:13SPEAKER_05: Yeah, yeah.
- 18:13SPEAKER_05: Yeah.
- 18:14SPEAKER_05: It's just to see if you want to put it down on paper.
- 18:16SPEAKER_05: But I say sellers will do more with paper than they will with a verbal.
- 18:21SPEAKER_05: They see it in writing.
- 18:23SPEAKER_03: We we talk to our clients that way, and and we teach that to our our salespeople, right?
- 18:28SPEAKER_03: It's like people believe what they see, not what they hear.
- 18:31SPEAKER_07: Yes.
- 18:32SPEAKER_03: They get excited about what they hear, but they believe what they see.
- 18:35SPEAKER_03: And that's what you have to do, and that's why it's so important to yes, you can say, hey, I want to give$500,000 for this.
- 18:43SPEAKER_03: Oh, great.
- 18:43SPEAKER_03: All right, great.
- 18:44SPEAKER_03: Let's write it up now.
- 18:45SPEAKER_05: Let's write it up.
- 18:46SPEAKER_03: Let's put your money where your mouth is with that earnest money now.
- 18:49SPEAKER_03: Yeah, yes, right?
- 18:50SPEAKER_03: Let's give a a$5,000 check with that and let's roll.
- 18:53SPEAKER_05: Yeah.
- 18:53SPEAKER_05: Verbal offers can turn into contracts.
- 18:55SPEAKER_03: Correct.
- 18:56SPEAKER_03: Anytime.
- 18:56SPEAKER_05: Yeah.
- 18:57SPEAKER_03: So so should sellers get excited about those verbal offers?
- 19:00SPEAKER_06: Not until they're in on paper.
- 19:01SPEAKER_06: They usually don't.
- 19:02SPEAKER_06: Yeah.
- 19:03SPEAKER_06: Yeah.
- 19:03SPEAKER_06: When they see it on paper, then they I mean, come on.
- 19:05SPEAKER_03: A seller's gotta get excited.
- 19:07SPEAKER_03: They gotta get excited a little bit, right?
- 19:09SPEAKER_03: That there's interest.
- 19:10SPEAKER_06: I have a lot, at least I have a lot, that are like, can you come present it?
- 19:14SPEAKER_06: Can you show me?
- 19:15SPEAKER_06: Things like that.
- 19:15SPEAKER_06: Because like you said, you're gonna get the butterflies and be like, oh my gosh, this is happening.
- 19:20SPEAKER_06: But then if it isn't on paper, then it's not really happening.
- 19:22SPEAKER_06: So right, right.
- 19:24SPEAKER_05: Because even if it isn't on paper, we still have things that come up that we have to take care of.
- 19:30SPEAKER_05: So, you know.
- 19:31SPEAKER_04: Had there been like an influx of recent like was there a turning point at some point where the verbal offers really stopped and everything had to be on paper?
- 19:41SPEAKER_05: Like what things started falling apart, you know, but he said or she said, and things just didn't line out.
- 19:48SPEAKER_05: And then I mean, it has been like a a rule for me since the get-go.
- 19:52SPEAKER_05: Okay, it's not on paper.
- 19:54SPEAKER_05: 19 years, yeah.
- 19:55SPEAKER_05: Yeah, it's if it's not on paper, it's not real.
- 19:57SPEAKER_05: Yeah, yeah.
- 19:58SPEAKER_05: You know, I can do the verbal back and forth on the phone, but then especially with another agent.
- 20:03SPEAKER_05: Yeah, yeah, yeah.
- 20:04SPEAKER_03: Get it on paper and let's have a little sidetracker.
- 20:08SPEAKER_03: Have you ever had anybody walk in with a uh briefcase full of money and say, I want to buy this house and sit down with stacks of cash?
- 20:14SPEAKER_05: I had, well, he just said, I'm writing a check for it right now.
- 20:17SPEAKER_05: I mean, he just he didn't come in with cash, but he was an oncologist.
- 20:21SPEAKER_05: I knew that he had the money.
- 20:23SPEAKER_05: He said, I just want to get this done today, Lisa.
- 20:25SPEAKER_05: She said, Well, this is not Lisa.
- 20:28SPEAKER_03: So see, you've had it done to you.
- 20:29SPEAKER_03: It's not fun, is it?
- 20:30SPEAKER_03: Not fun, is it?
- 20:31SPEAKER_05: Well, it was kind of fun because he was buying a house.
- 20:34SPEAKER_05: Well, yeah and writing the check.
- 20:35SPEAKER_05: But um bumped Lisa, my face.
- 20:38SPEAKER_05: So anyway, they're writing out that check, and I said, Whoa, whoa, whoa, let's hold your role here.
- 20:43SPEAKER_05: And then that's yeah.
- 20:44SPEAKER_05: So so then he wrote out a check for$50,000 for the earnest money, and we got the ball.
- 20:50SPEAKER_04: Yeah, dang, yeah.
- 20:52SPEAKER_05: That was my first, like well, that was like 19 years ago when I saw butterflies go like, oh my gosh, I've got fifty thousand dollars I'm taking to the title company, you know.
- 21:00SPEAKER_04: So that was Lisa needs her own briefcase for the fifty yeah, for when she goes to the title company.
- 21:06SPEAKER_04: They can see her.
- 21:07SPEAKER_03: What what do buyers wish they knew before making an offer on a home?
- 21:11SPEAKER_03: What are some key things that they wish they knew before they made an offer?
- 21:14SPEAKER_06: The biggest thing is people start house hunting and they have no idea what they're pre-approved for.
- 21:20SPEAKER_06: So they might be looking at houses for$200,000 and they're only approved up to$120,000.
- 21:25SPEAKER_06: They are totally looking in the wrong market and then they are excited and they get upset because, oh crap, I want that house, but now I can't have it because I can't get pre-approved for that much.
- 21:34SPEAKER_06: That's one of the biggest things in my mind.
- 21:36SPEAKER_06: Well, and they don't know that they need earnest money.
- 21:38SPEAKER_06: Exactly.
- 21:39SPEAKER_06: They don't have that cash.
- 21:40SPEAKER_03: Yeah.
- 21:41SPEAKER_03: Or pay inspections.
- 21:42SPEAKER_03: Yeah.
- 21:42SPEAKER_06: And that's something that I'm always upfront about, and everyone should be is what comes with buying the house, your closing costs, your inspections, your earnest money, like you just said.
- 21:52SPEAKER_06: They have to pay for the money.
- 21:52SPEAKER_06: You have to pay, yes, everything that goes into buying a house, what you have to pay for up front.
- 21:57SPEAKER_03: Do you have to pay for the appraisal up front?
- 21:59SPEAKER_03: Does that come out of close?
- 22:00SPEAKER_06: Or at some point to be paid because it used up front.
- 22:03SPEAKER_03: Inspections and and appraisal that used to come out of closing.
- 22:06SPEAKER_03: Yeah.
- 22:06SPEAKER_05: Used to.
- 22:07SPEAKER_05: Now the the lenders, some of the lenders are asking for those appraisals because when it falls through, then they don't want to pay.
- 22:14SPEAKER_05: Yeah.
- 22:14SPEAKER_05: So I always make sure my appraisers, my inspectors are paid at the time of service because anything can happen and I they've already done the work.
- 22:23SPEAKER_05: Right.
- 22:23SPEAKER_05: I get it.
- 22:25SPEAKER_05: I get it.
- 22:25SPEAKER_05: Right.
- 22:25SPEAKER_05: So we've already done the work.
- 22:27SPEAKER_05: Now, will I get paid if it falls through?
- 22:29SPEAKER_05: No.
- 22:30SPEAKER_05: Will they get paid?
- 22:31SPEAKER_05: Absolutely, because I've made sure.
- 22:33SPEAKER_07: By the buyer.
- 22:33SPEAKER_05: Yeah.
- 22:34SPEAKER_07: Correct.
- 22:34SPEAKER_05: The other thing for buyers is some people don't realize they have to be at the closing.
- 22:40SPEAKER_05: You have to take off work to go to the closing.
- 22:42SPEAKER_05: And guess what?
- 22:43SPEAKER_05: The closing offices, they only work Monday through Friday.
- 22:47SPEAKER_05: They are off also on holidays.
- 22:49SPEAKER_05: They do not work on weekends.
- 22:51SPEAKER_05: And they work from like eight in the morning till about three or four in the afternoon.
- 22:55SPEAKER_05: But the banks, if we're waiting on money transfers, then about 2 30 is their cutoff because if we have to wait for we have to think about all those things.
- 23:05SPEAKER_05: And they'll be like, Well, I my husband doesn't have to be there, does he?
- 23:08SPEAKER_05: Yes.
- 23:09SPEAKER_03: His name's on the title indeed.
- 23:10SPEAKER_03: Yeah.
- 23:11SPEAKER_05: Yes, he has to be there.
- 23:12SPEAKER_05: Or we make provision for that so that they can sign outside.
- 23:16SPEAKER_05: Yeah.
- 23:16SPEAKER_05: But we got to know that.
- 23:17SPEAKER_05: Yeah, I mean.
- 23:18SPEAKER_05: Or do I have to be out of the home on the day of closing?
- 23:22SPEAKER_05: Yes.
- 23:22SPEAKER_05: That's that's you know, I it was like the week before the cellar the week before, and they they still hadn't moved.
- 23:29SPEAKER_05: And I thought, what are they doing?
- 23:31SPEAKER_05: So I did a little phone call and said, Hey, you guys getting ready to move.
- 23:34SPEAKER_05: And she said, Well, we have a few days after the closing, correct?
- 23:38SPEAKER_05: And I said, Did you ask for that?
- 23:40SPEAKER_05: And she said, Well, no, but I just assumed.
- 23:43SPEAKER_05: Don't assume.
- 23:46SPEAKER_05: Yeah, yeah.
- 23:46SPEAKER_05: Because closing day, the insurance goes off, all of those things, and the other the buyer's insurance starts.
- 23:54SPEAKER_05: They don't want to insure you taking things in and out of the house.
- 23:57SPEAKER_05: So make sure that you are out.
- 24:00SPEAKER_05: Get everything in the U-Haul, the whatever you're doing.
- 24:03SPEAKER_05: Yeah.
- 24:04SPEAKER_05: I mean, you've got to have that out.
- 24:06SPEAKER_03: After closing, they were still moving.
- 24:08SPEAKER_03: Yeah, they were still moving out of that house and ended up just leaving some junk behind.
- 24:13SPEAKER_03: And which, yeah.
- 24:15SPEAKER_05: That is not good either.
- 24:16SPEAKER_05: Mine did that too.
- 24:17SPEAKER_05: Yeah.
- 24:17SPEAKER_05: Yeah.
- 24:17SPEAKER_05: I I that's what those final walkthroughs were.
- 24:20SPEAKER_03: So here's here's what's interesting because growing up as a kid, yes, way back when it was like you were given like it used to be like 30 days after closing, right?
- 24:31SPEAKER_05: I I always thought it was 60.
- 24:33SPEAKER_05: Yeah, no, I did not know that.
- 24:34SPEAKER_03: Yeah.
- 24:35SPEAKER_03: So like growing up, it was like, okay, you're closing on this date, and then, well, yeah, even when I bought my first house, I the the buyer or the seller had 30 days to move out after closing.
- 24:46SPEAKER_03: I swear I feel like that's which I get, it's nervous because then okay, you you own a house, but now what are they doing in that house for 30 days?
- 24:53SPEAKER_05: Well, you can rent it.
- 24:55SPEAKER_05: I mean, you can pay rent.
- 24:56SPEAKER_03: That wasn't the case.
- 24:57SPEAKER_03: It was you know it's like it was it was just like that nomenclature.
- 24:59SPEAKER_03: It was like, okay, 30 closed 30 days, they the seller's got 30 days to get out.
- 25:03SPEAKER_05: That was back when the handshake meant something because the people weren't gonna mess up your house.
- 25:07SPEAKER_05: Right.
- 25:07SPEAKER_05: You know, yeah.
- 25:08SPEAKER_03: And sometimes that was in the 90s.
- 25:09SPEAKER_05: You know, a mover can knock a hole on the wall, a mover can take a handrail off and not put it on, you know.
- 25:18SPEAKER_02: It's a baby.
- 25:19SPEAKER_05: So these things can happen, and then when you do that final walkthrough, if you see that hole in the wall, I want that hole fixed.
- 25:24SPEAKER_05: Right.
- 25:24SPEAKER_05: We're not closing until that's done.
- 25:26SPEAKER_05: So all those things, they matter a ton.
- 25:29SPEAKER_06: And final walkthroughs, I always try to go honestly, I like to go the day before closing.
- 25:35SPEAKER_06: I like to go two days prior just in case we're like, oh crap, this needs done.
- 25:39SPEAKER_06: They didn't do this like they said, so they have time.
- 25:41SPEAKER_06: But if it's two days before, I like to go if it's like local and we're able to get in the day of.
- 25:48SPEAKER_06: I would I love to go before to make sure they have everything out and everything.
- 25:53SPEAKER_04: Just make sure everything's done correctly.
- 25:56SPEAKER_03: You like going two days before, or you like going by as the as the buyer's side.
- 26:00SPEAKER_05: On the buyer's side, on the buyer's side side to make sure everything's out.
- 26:03SPEAKER_05: But if it's not out, then I'm going on the day of closing and I switched through and I am having fits because I've had that on.
- 26:11SPEAKER_06: Where they're moving out an hour before closing, and I stay there because I'm like, I need to make sure all your stuff is out.
- 26:17SPEAKER_06: Like my buyers are moving out.
- 26:18SPEAKER_03: Well, that didn't happen with my son.
- 26:19SPEAKER_06: Yes, yeah, it did.
- 26:21SPEAKER_06: Yes, they were still there the day of, yeah.
- 26:23SPEAKER_03: Yeah, and that's what I mean.
- 26:24SPEAKER_03: They were there after closing too.
- 26:25SPEAKER_05: And they asked if they could come back and your son graciously said yes.
- 26:29SPEAKER_03: Because yeah, I raised him right.
- 26:30SPEAKER_03: We were not to be real.
- 26:31SPEAKER_05: Yeah, you're not mean, you're not mean, but there are some buyers, and not that they're mean, they're saying 30 to 45 days we have given you.
- 26:38SPEAKER_05: Yeah, you've got time.
- 26:39SPEAKER_05: You have time to get out of this house.
- 26:41SPEAKER_05: We want you out.
- 26:42SPEAKER_05: Now it is ours.
- 26:44SPEAKER_05: It is not our responsibility to get rid of your junk.
- 26:47SPEAKER_05: We want you out, and they're you know, and it's the same thing.
- 26:51SPEAKER_04: Those people, they followed the rules, they followed the directions.
- 26:54SPEAKER_04: It's not their fault that someone else can't do that.
- 26:57SPEAKER_05: Right, right.
- 26:58SPEAKER_03: Yeah, because there was an incident apparently where the mother of the people of the cellar was like, Well, I don't know why they're rushing them so much to get out of here.
- 27:07SPEAKER_03: It's like, well, because they just bought hundreds of thousands of dollars.
- 27:12SPEAKER_05: People don't understand she did not realize that and was not explained to that.
- 27:18SPEAKER_05: They had 30 days or 30 to 45 days to get out.
- 27:21SPEAKER_05: I think it was, I think they even had 45 days.
- 27:23SPEAKER_03: Or, or it was the mindset of me.
- 27:26SPEAKER_03: The the mother might have been like, Well, well, don't they have 30 days?
- 27:29SPEAKER_05: Yeah, okay.
- 27:30SPEAKER_05: She was right.
- 27:32SPEAKER_03: Don't say an age, don't you dare.
- 27:34SPEAKER_05: She was elderly.
- 27:36SPEAKER_05: No.
- 27:38SPEAKER_03: Lisa.
- 27:40SPEAKER_05: Lisa with the burr.
- 27:41SPEAKER_03: Randy, your wife's gonna get it.
- 27:43SPEAKER_05: Rand.
- 27:44SPEAKER_05: He's he would be like, I know, she's a mess.
- 27:47SPEAKER_05: Lisa.
- 27:47SPEAKER_03: She's crazy.
- 27:48SPEAKER_03: She's crazy, girl.
- 27:49SPEAKER_03: Yeah, I know.
- 27:50SPEAKER_03: I know.
- 27:51SPEAKER_03: Well, hey, I I did want to mention, I went to mention this at the beginning at the top of this podcast, that this podcast is often imitated, but will never be duplicated, right?
- 28:01SPEAKER_03: All right.
- 28:01SPEAKER_03: So I just want I just wanna I just want to state that, right?
- 28:04SPEAKER_03: Because we are bringing valuable information, relevant information, to all perspective sellers and buyers out there all across Mid-Illanois.
- 28:14SPEAKER_07: Yeah, right.
- 28:15SPEAKER_03: And we do it in a comedic, lighthearted way.
