- 0:00Speaker 1: What's up everyone and welcome to another episode of the
- 0:03Speaker 1: Epstein Chronicles. In this episode, we're going to dive right
- 0:06Speaker 1: back in to that amended lawsuit filed by the Epstein
- 0:09Speaker 1: survivors against the FBI, the DOJ, and the United States government. F.
- 0:16Speaker 1: Following the federal non-prosecution agreement, Epstein continued to abuse and
- 0:20Speaker 1: traffic children until 2019. After his 2008 non-prosecution agreement, the
- 0:26Speaker 1: FBI knew that Epstein orchestrated visas and passports for children.
- 0:32Speaker 1: After that non-prosecution agreement, the FBI knew about suspicious banking
- 0:36Speaker 1: activity and large cash withdrawals. Those payments funded Epstein's sex
- 0:41Speaker 1: trafficking operation. The FBI also knew that Epstein possessed CSAM.
- 0:46Speaker 1: For another decade, the FBI did nothing. Finally, on July 6, 2019,
- 0:51Speaker 1: Epstein was arrested for sex trafficking of children and conspiracy.
- 0:56Speaker 1: Epstein died in jail. on August 10, 2019, from an
- 1:00Speaker 1: apparent suicide before the case could be prosecuted. His co-conspirator,
- 1:04Speaker 1: Ghislaine Maxwell, was convicted of sex trafficking, which felony conviction
- 1:09Speaker 1: was affirmed on September 17, 2024. For decades, the FBI
- 1:15Speaker 1: knew that Epstein possessed CSAM and sexually abused and trafficked girls.
- 1:20Speaker 1: Epstein was never prosecuted for possessing CSAM. And for decades,
- 1:24Speaker 1: despite several victims, banks, and other law enforcement agencies relying
- 1:29Speaker 1: on them to investigate and stop Epstein, it negligently failed
- 1:32Speaker 1: to do so. The defendant itself has conceded that this
- 1:36Speaker 1: was not discretionary judgment. For example, during the Office of
- 1:40Speaker 1: Professional Responsibility Investigation, Senator Ben Sasse of Nebraska stated, letting
- 1:46Speaker 1: a well-connected billionaire get away with child rape and international
- 1:49Speaker 1: sex trafficking isn't poor judgment, it's a disgusting failure. That
- 2:02Speaker 1: disgusting failure resulted from the FBI's negligence and its failure
- 2:05Speaker 1: to follow mandatory policy and protocol about how to handle
- 2:10Speaker 1: CSAM sexual abuse and trafficking investigations. Many of the FBI's
- 2:15Speaker 1: policies and procedures are heavily redacted or classified. Still... Based
- 2:20Speaker 1: on publicly available protocols, it's clear that the FBI violated
- 2:23Speaker 1: mandatory policies and procedures. Many of the FBI's mandatory policies
- 2:29Speaker 1: and procedures are stored in the Manual of Investigative Operations
- 2:33Speaker 1: and Guidelines, or MIOG. The MIOG dictates that all investigations
- 2:38Speaker 1: of crime-related or crimes-related activity shall be undertaken in accordance
- 2:43Speaker 1: with one or more of these guidelines. The FBI must
- 2:47Speaker 1: conduct preliminary inquiries and investigations to prevent, detect, and prosecute
- 2:52Speaker 1: federal law violations. Prelim inquiries and investigations governed by these
- 2:57Speaker 1: guidelines are conducted for the purpose of preventing, detecting, or
- 3:02Speaker 1: prosecuting violations of federal law. The FBI violated this mandatory
- 3:07Speaker 1: policy here by failing to conduct prelim inquiries and investigations
- 3:12Speaker 1: into Jeffrey Epstein to prevent, detect, and prosecute his ongoing
- 3:16Speaker 1: sex crimes and as reported to the FBI in 1996
- 3:19Speaker 1: by Ms. Farmer and 2005 by Ms. Christensen. Per the
- 3:24Speaker 1: 1991 MIOG, most obscene matter cases required the interview of
- 3:28Speaker 1: the abuser. During the course of the investigation of most
- 3:33Speaker 1: obscene matter cases, it becomes necessary to interview the subject
- 3:37Speaker 1: and obtain obscene evidence from him or her. The obscene
- 3:40Speaker 1: evidence was obtainable by search warrant interview with the person,
- 3:44Speaker 1: and other means. The FBI violated this mandatory policy here
- 3:48Speaker 1: by not interviewing the abuser Jeffrey Epstein when his child
- 3:51Speaker 1: pornography was reported to the FBI by Ms. Farmer in 1996.
- 3:56Speaker 1: The FBI also initiated the Innocent Images National Initiative in 1995.
- 4:02Speaker 1: This was an initiative specifically focused on cracking down on
- 4:05Speaker 1: the creation and possession of child pornography. The FBI had
- 4:10Speaker 1: a non-discretionary obligation to governed by established protocol in the MIOG,
- 4:15Speaker 1: including from the Innocent Images National Initiative in 95 and elsewhere,
- 4:20Speaker 1: to handle and investigate tips concerning potential and ongoing underage
- 4:24Speaker 1: child erotica, rape, sex with minors, and human trafficking in
- 4:29Speaker 1: a reasonable manner, and to act against Jeffrey Epstein to
- 4:32Speaker 1: prevent him from committing repeated crimes. The FBI has mandatory
- 4:37Speaker 1: policies in the MIOG. arising from the Innocent Images National
- 4:42Speaker 1: Initiative in 1995 and elsewhere, which require agents to investigate
- 4:47Speaker 1: every allegation of possession of CSAM. Upon information and belief,
- 4:53Speaker 1: MIOG policy require FBI agents to draft an FD-71 form
- 4:58Speaker 1: and then conduct an investigation of every allegation of possession
- 5:01Speaker 1: of CSAM. The FBI violated these mandatory policies here by
- 5:06Speaker 1: neither drafting an FD-71 form nor investigating the allegations that
- 5:10Speaker 1: Epstein possessed child pornography. The FBI has mandatory policies in
- 5:15Speaker 1: the MIOG arising from the Innocent Images National Initiative in
- 5:21Speaker 1: 1995 and elsewhere, which require agents to investigate every allegation
- 5:26Speaker 1: of child sexual abuse. Upon information and belief, MIOG policy
- 5:30Speaker 1: requires FBI agents to draft an FD-71 form and then
- 5:35Speaker 1: conduct an investigation of every allegation of child sex abuse.
- 5:40Speaker 1: The FBI has mandatory policies in the MIOG arising from
- 5:44Speaker 1: the Innocent Images National Initiative in 95, which require agents
- 5:49Speaker 1: to investigate every allegation of child sexual trafficking. Upon information
- 5:53Speaker 1: and belief, MIOG policies require FBI agents to draft an
- 5:58Speaker 1: FD-71 form and then conduct an investigation of every allegation
- 6:02Speaker 1: of every allegation of child sex abuse. The FBI violated
- 6:07Speaker 1: These mandatory policies here, by neither drafting an FD71 form
- 6:11Speaker 1: nor investigating the allegations that Epstein committed sex abuse. These
- 6:17Speaker 1: aforementioned FBI policies found in the MIOG, including those arising
- 6:21Speaker 1: from the Innocent Images National Initiative in 95 and elsewhere,
- 6:26Speaker 1: are not discretionary. These policies required action by FBI agents.
- 6:32Speaker 1: Those requirements to investigate also mandate necessary steps during each investigation,
- 6:38Speaker 1: such as conducting a detailed interview of the complainant and
- 6:41Speaker 1: investigating the accused. The FBI violated these mandatory policies by
- 6:47Speaker 1: not conducting interviews nor investigating Epstein until 10 years after
- 6:51Speaker 1: the agency received its first reports of Epstein's sex abuse
- 6:55Speaker 1: and trafficking. It's widely known in the FBI that allegations
- 6:59Speaker 1: of possession of child pornography, child sex abuse, and sex
- 7:03Speaker 1: trafficking require urgent attention and as those crimes will typically
- 7:06Speaker 1: continue unless stopped by the FBI. The FBI violated its
- 7:11Speaker 1: duty to plaintiffs and failed to comply with its own
- 7:14Speaker 1: mission to protect the American people and uphold the Constitution
- 7:17Speaker 1: of the United States from 1996 through 2019. The FBI
- 7:23Speaker 1: instructs the public to report information about crimes. For example,
- 7:27Speaker 1: on the Contact Us page of the FBI's website, the
- 7:30Speaker 1: FBI instructs concerned citizens to submit a tip to report
- 7:34Speaker 1: suspected criminal activity. The website tells the public, if you
- 7:38Speaker 1: see something, say something. The FBI website says we protect
- 7:42Speaker 1: the American people and uphold the U.S. Constitution. The FBI
- 7:46Speaker 1: website states that the FBI works a case by world-class training, tactics,
- 7:52Speaker 1: science and technology, and intelligence. The FBI's guidebook explains tips
- 7:57Speaker 1: must all be taken seriously and thoroughly evaluated. The Attorney
- 8:00Speaker 1: General Handbook explains that the FBI... has a responsibility to
- 8:04Speaker 1: investigate all violations of federal law that are not exclusively
- 8:08Speaker 1: assigned to another federal agency. The policies emphasize the necessity
- 8:13Speaker 1: for thoroughly handling all Man Act investigations, which broadly criminalizes
- 8:18Speaker 1: sex trafficking. Specifically, the primary step in any sex trafficking
- 8:22Speaker 1: case is to secure a signed statement from the victim,
- 8:26Speaker 1: showing the interstate transportation for prostitution or any sexual activity
- 8:30Speaker 1: for which any person can be charged with a criminal offense.
- 8:35Speaker 1: After that primary step, the FBI manual instructs agents to
- 8:38Speaker 1: secure all possible evidence to corroborate the statement of the
- 8:42Speaker 1: victim by interviewing that individual's relatives and associates and other
- 8:46Speaker 1: persons in a position to give pertinent information and secure
- 8:50Speaker 1: all possible documentary evidence to corroborate the statement of the victim.
- 8:55Speaker 1: When securing that evidence in a sex trafficking case, the
- 8:58Speaker 1: manual also instructs agents about the essential facts to obtain. Specifically,
- 9:03Speaker 1: it's essential for agents to obtain names with aliases, descriptions,
- 9:08Speaker 1: brief personal histories, reputation, marital status, and identification records of
- 9:13Speaker 1: subject and victim. It's also essential to obtain previous acquaintances
- 9:19Speaker 1: and attendant relations between subject and the victim. The FBI
- 9:23Speaker 1: violated each of those mandatory policies in 1996 until Epstein
- 9:27Speaker 1: was finally arrested in 2019. For instance, the FBI... violated
- 9:32Speaker 1: those mandatory policies in response to Maria Farmer's report of
- 9:36Speaker 1: CSAM material, child sexual abuse, and human trafficking to the
- 9:41Speaker 1: FBI in 1996. The FBI violated those mandatory policies when Ms.
- 9:47Speaker 1: Christensen reported there was abuse in 2005. The FBI again
- 9:52Speaker 1: violated each of those mandatory policies when the Florida Palm
- 9:55Speaker 1: Beach Police Department turned their investigation over to the FBI
- 9:59Speaker 1: in 2006. The FBI violated those policies when it learned
- 10:04Speaker 1: a suspicious banking activity linking payment from Epstein's accounts to
- 10:08Speaker 1: minor girls. The FBI continued to violate those policies following
- 10:13Speaker 1: the federal non-prosecution agreement while continuing to learn of evidence
- 10:17Speaker 1: of Epstein's abuse and trafficking. The FBI did not interview
- 10:21Speaker 1: all the victims and failed to provide victim assistance and
- 10:24Speaker 1: concealed reports of a sex trafficking venture. The FBI did
- 10:29Speaker 1: not secure all possible evidence to corroborate the statement of
- 10:32Speaker 1: the victim by interviewing that individual's relatives and associates and
- 10:37Speaker 1: other persons in a position to give pertinent information. The
- 10:41Speaker 1: FBI did not secure all possible documentary evidence to corroborate
- 10:45Speaker 1: the statement of the victim. The FBI did not obtain
- 10:48Speaker 1: names and With aliases, descriptions, brief personal histories, reputation, marital status,
- 10:54Speaker 1: and identification records of all subjects and victims, the FBI
- 10:59Speaker 1: did not obtain previous acquaintances and attendant relations between all
- 11:02Speaker 1: subjects and all victims. Alright folks, we're going to wrap
- 11:06Speaker 1: this one up right here, and in the next episode,
- 11:08Speaker 1: we're going to finish this bad boy off. All the
- 11:11Speaker 1: information that goes with this episode can be found in
- 11:14Speaker 1: the description box.
