- 0:00Joe, we tried to get rid of him, but he came back.
- 0:06Welcome to Tour TALK. I'm Mark Ryu and joined as
- 0:09always by John Robinson and Joe Fantini.
- 0:12This week, we are counting down our top ten mass tort power
- 0:16rankings. The litigations you need to
- 0:18watch right now. We're breaking down why Hair
- 0:21Relaxer is holding its crown, how Uber's $8.5 million verdict
- 0:26is shaking up the top three, and why Roundup has hit a historic
- 0:29low. And a new tort breaking to the
- 0:32top 10. Plus, we've got the latest on
- 0:34the social media trial, the brand new Roblox MDL.
- 0:38Which cases are moving up? Which cases are falling off?
- 0:41Let's dive into it. It's great to be back from Los
- 0:45Angeles. I was there for the social media
- 0:46addiction trial last week. You want to see my interview
- 0:49with Matt Bergman that actually went live a couple days ago.
- 0:52You should check that out. There's all kinds of great
- 0:54insights about what's going on behind the scenes in that trial.
- 0:58It's closed door, You can't get inside.
- 1:00And we hear from Matt. And it's really is a great
- 1:02interview. We're going to start the Mass
- 1:03Tort Power rankings for February off at #10 We have Bear Hugger
- 1:09finally cracking the top 10 Joe Legacy Mass with over 9000
- 1:13cases. Has there been some good
- 1:14progress in this litigation? There has finally John so this
- 1:18mass towards more than 10 years old, but the numbers are.
- 1:21Up there we. Have over 9000.
- 1:23Filed cases. We're continued to see a couple
- 1:26100 cases filed each month, but finally we're starting to get
- 1:30some pressure on the defendants 3 M by basically getting these
- 1:34cases worked up and ready. For trial, so.
- 1:37The judge ordered 100 and. 50 cases to be worked.
- 1:41Up in. Five separate groups.
- 1:43Each one of them are going through the.
- 1:45Traditional discovery expert. And then if there isn't some
- 1:49sort of resolution, getting remanded.
- 1:51To trials all across the country, so those cases.
- 1:54Are finally moving and then we have some action outside of them
- 1:58DL. A couple cases.
- 1:59Filed in various. States across the country.
- 2:02With a big trial kicking off next week in Texas.
- 2:05So with the Texas trial? And these reman cases, they'll
- 2:09be some movement this year. There's a lot of cases out there
- 2:12with Bear. Hugger controlling 80 to 85% of
- 2:15the market share. Yeah, it's great to see a new
- 2:17entrant into the top ten with Bear Hugger at #9 We have some
- 2:21disappointing news. Talcum powder.
- 2:24The bellwether verdict out of Philadelphia resulted in only
- 2:27250,000. What happens next with talc?
- 2:31Surprising verdict there like you mentioned.
- 2:33Out of Philadelphia. Almost a month long trial came
- 2:36back with. 50. 1000 in compensatory damages and 200,000
- 2:41in punitive damages for an estate of a woman who used
- 2:46Johnson and Johnson. Products for years.
- 2:48And then diagnosed with ovarian cancer.
- 2:51Obviously we're hoping for a much higher number.
- 2:53I think the. Positive takeaways are the
- 2:56experts survive. The jury was on our.
- 2:59Side we got. Punitive damages, certainly a
- 3:02lot less than what we were hoping for, saw in.
- 3:04Prior trials, but. I think this reinforces that the
- 3:07jury is on our side and so is the science.
- 3:10So we'll continue to move forward with this litigation
- 3:13getting some. More bellwether trials worked up
- 3:16cases towards trial. In the MDL we have almost 70,000
- 3:21cases. So this is.
- 3:22The largest MDLI think we're going to keep getting more
- 3:25pressure applied to the defendants and I'm still
- 3:28optimistic get a resolution before the end of 2026.
- 3:32Coming in at #8 weight loss drugs, so staying flat over last
- 3:36month with two lines of cases. Again, we've got the vision
- 3:38cases, we've got the gastrointestinal cases, we've
- 3:41got about 3000 gastrointestinal injuries filed in the MDL.
- 3:44What comes next in the litigation?
- 3:46Yeah. So like you said, we have
- 3:47parallel cases going on. We just had the MDL form for the
- 3:51vision loss cases in December. Right now we're seeing a lot of
- 3:55the momentum in the gastrointestinal cases, over
- 3:583000 cases pending right now. We're doing some.
- 4:01Discovery we're. Getting these cases.
- 4:03Worked up. We'll have some summary
- 4:05judgement motion. Practice.
- 4:07Probably in the late spring here get some rulings and if we get.
- 4:11That stage. I think we can start looking.
- 4:14For bellwethers about. Spring or summer of next?
- 4:17Year so those. Gastrointestinal cases, once we
- 4:20get some positive rulings, I think the litigation is really
- 4:24going to pick up. The vision cases are going to be
- 4:26dragging a little bit, a lot less plaintiffs out there.
- 4:30But I think the gastrointestinal litigation, we get past that
- 4:3310,000 threshold maybe a year, 15 months once we get some good
- 4:39rulings. Yep, keep making progress on
- 4:41weight loss at #7 we have the relatively recently consolidated
- 4:46Roblox, the newest mass toward on the list.
- 4:48How's the MDL shaping out? Yeah.
- 4:50So it's. Kind of the who's who getting
- 4:53appointed. To Co lead.
- 4:54Counsel in this. We got a.
- 4:56Lot of excitement about who's going to be on that plaintiff
- 4:59steering committee kind of guiding the litigation.
- 5:02As more time comes out and I'm speaking to some of our
- 5:05colleagues, it seems like there's going to be a lot.
- 5:07More cases out. There than I initially
- 5:09anticipated. I didn't think we were going to
- 5:11get past maybe 5000 cases, but I know firms that are
- 5:15investigating a lot of really serious incidents involving
- 5:19roadblocks. So this is one that's going to
- 5:21be kind of to watch as we move forward.
- 5:24Robox is really focusing on trying to get these cases into
- 5:28arbitration. They don't want them to.
- 5:30See court they. Don't want to go in front of a
- 5:32jury so once we. Fight back that.
- 5:35I think we can get some good momentum going and then we'll
- 5:38see. The dockets?
- 5:39Really. Building in this litigation
- 5:41probably in the second-half or the fourth quarter of 2020 26.
- 5:45Yeah, there was some news about that last week, with Roblox
- 5:47making some public statements about wanting to keep all these
- 5:51lawsuits behind closed doors. Yeah, that, that's always.
- 5:54What they want to try to do, not uncommon to see that from these
- 5:58big powerful defendants, right? They don't want people to know
- 6:01really what they're. Up to what?
- 6:03They've done the injuries they've.
- 6:04Caused so. I think we have some good
- 6:06arguments to overcome that, whether the parents were able to
- 6:09truly consent, maybe in some of the instance and some of the
- 6:12cases. Out there.
- 6:13Where the children consent, sending kind of minor consent to
- 6:16something like this, all really important issues that are going
- 6:19to be flushed out, but I think we can overcome that and this
- 6:23litigation moves forward. My prediction, this continues to
- 6:26move up the power rankings and we will see a lot of progress in
- 6:30roadblocks over the next couple of years.
- 6:32Yeah, I. Think you're right on that.
- 6:33At #6 we have Depot Provera holding steady at number six.
- 6:37Can we see a bellwether trial before the end of the year?
- 6:41That's what we're scheduled. For right now, supposedly, we're
- 6:44going to have. The first Bellwether trial kick
- 6:46off. In December of 2026.
- 6:49We were all a. Little bit concerned potentially
- 6:52about a potential preemption ruling.
- 6:54We're still waiting for that. Seems like we're going to be
- 6:57able to survive that with no problem.
- 6:59We have these pilot cases. That are being worked up.
- 7:02So if we're able to get the bellwether scheduled about two.
- 7:05Years out from the MDL forming. That would be great not only for
- 7:08this litigation but also for all mass torts in the future.
- 7:12Hopefully a road map to help. Us get these cases to the jury
- 7:16because that's. When we know the.
- 7:17Pressure really starts. Applying to the defendants so
- 7:20we'll continue to see movement here in depo probera science
- 7:24seems pretty strong the. Label was updated.
- 7:27Things are in favor. So this will.
- 7:29Keep rising, I think as well in 2026.
- 7:31What is going on at #5 with Roundup?
- 7:35The Power Rangers darling is falling.
- 7:37It's coming in at #5 It's not to say, you know, people don't
- 7:41believe in this. Case we still.
- 7:43Think this is a winner. I think one of the biggest
- 7:46developments recently was the oral argument is scheduled for
- 7:49the Supreme Court. I believe that's going to be
- 7:52April 27th and then we'll hear from the court before the end of
- 7:56June on the ruling. So that's going to have a huge
- 7:58impact. We actually saw.
- 8:00In Paraquat, the defendants trying to stay the litigation or
- 8:04seeking to dismiss missed the. Cases based.
- 8:07Upon this issue being brought. Up to the.
- 8:09Supreme Court, so not as much excitement right now.
- 8:12I know people that. Are out there still.
- 8:14Acquiring new cases. But it it looks like somehow,
- 8:18someway, this litigation is really going to wind down before
- 8:21the end of 2026. Bears set out.
- 8:24To make that. Their goal?
- 8:25This. Year, I think they're going to
- 8:27accomplish it so. We'll keep our ear.
- 8:30And eyes to the docket, see what type of filings come out,
- 8:33anything unique we'll keep. You guys updated but still a lot
- 8:36of people. Out there that need help these.
- 8:38Cases are still. Viable.
- 8:40We know the defendants already paid more than 10 billion.
- 8:43It's just there's some. Hotter torts out there with
- 8:46better. Opportunity right now to get
- 8:48involved and help more people. Moving up the chain to #4 we
- 8:52have video game addiction. It fell a little bit in the
- 8:55rankings, but is this because of the strength of other cases or
- 8:58is this because of issues with VGA?
- 9:01I think it's because we have strength in other.
- 9:03Cases. We have a lot of momentum going
- 9:04on right now. There's been a lot.
- 9:06Of trials to. Kick off 2026 and I think we're
- 9:10learning a lot in this social media addiction trial.
- 9:13So that's going to give us a little bit of a road map.
- 9:16But I have and we have social media addiction ranked higher.
- 9:20Because that's further. Along we're in front of a
- 9:22jewelry right now. We kind of flushed everything
- 9:25out, so video game addiction is going to take a little bit more
- 9:28time. There's a lot of people.
- 9:29Out there that need help, we're still formulating that
- 9:32litigation it it's growing a little bit slower than we
- 9:35thought had there been an MDL, but this one's going to keep in
- 9:40the top five I think throughout 2026 and probably be around most
- 9:44of 27 as well. Yeah, just so many people who
- 9:48are involved in that litigation. So many possible defendants and
- 9:51remember our our power rankings are the masked towards we
- 9:54recommend getting involved with right now or at least
- 9:56investigating, getting involved with so early on VGA.
- 10:00This is one side I think take a look at just because there's,
- 10:02there's just the breath of this potential litigation.
- 10:05Moving on to #3 we did see a results come back a couple weeks
- 10:09ago in the Uber sex abuse trial. It has now cracked into the top
- 10:13three following that $8.5 million verdict.
- 10:15Is Uber continuing to fight? What does this look like as we
- 10:18move on to the next bellwether in the coming months?
- 10:21Uber definitely is continuing to fight.
- 10:23They've been one of the most fiercely defendant MDLS that
- 10:27I've ever seen. But we.
- 10:29Were able to have that huge. Breakthrough like you mentioned
- 10:31that Arizona trial returned the verdict 8.5 million for a very
- 10:36deserving client and this really is going to help the litigation
- 10:40going forward because now Uber knows that we can and we have
- 10:43one other. Trial so.
- 10:44We're going to continue to get the.
- 10:46Cases worked up they'll. Probably be another.
- 10:48Series of bellwether trials. As you remember, Uber won the
- 10:52first trial that came back. With a 0 sum verdict.
- 10:55Now we won one for the good. Guys.
- 10:57One for Uber. I think we're going to have to
- 11:00do the dance another two or three more times before.
- 11:03We see a global but. Uber's making changes to their
- 11:06platform. It it is.
- 11:07Helping bring about change which?
- 11:09We all set out to do but this. Is 1 to get involved with?
- 11:13There's still some. Cases out there.
- 11:15We've been successful in trial, but they're going to continue to
- 11:18fight us. I don't see.
- 11:20A global. And the immediate future right
- 11:22now? Yeah, It's just good to see that
- 11:24we're making progress here. We did have Lyft consolidate
- 11:27couple weeks ago. So, you know, Uber will continue
- 11:31throughout 2026, and we'll see what happens as we move forward
- 11:34to the next bellwether. At #2 We have social media
- 11:37addiction. So this is the trial going on
- 11:39right now in Los Angeles. We had Adam Mosseri take the
- 11:43stand last week. Believe we have Zuckerberg
- 11:46slated to take the stand this week at #2 This is a very, very
- 11:49interesting litigation. What else can you tell us about
- 11:52what's happening here? I think everybody's waiting to
- 11:55see this Mark Zuckerberg versus Mark Lanier battle.
- 11:59This is going to be 1, you know, for.
- 12:01The history books, but there's a lot of.
- 12:03Positive momentum on this litigation where in front of a
- 12:07jewelry where we want to be right now.
- 12:10I think if we come out victorious in this case, there's
- 12:13going to be other bellwether trials coming up already.
- 12:15Scheduled we have. School district ones.
- 12:18Set as well, so there's already 56. 1000 cases between the MDL.
- 12:23The state court, we have the various AGS.
- 12:26Are in on it, so the. Pressure.
- 12:28Is definitely mounting on these social media big tech companies.
- 12:32We. Already saw two of them.
- 12:34Settle out so. I think they.
- 12:35Realize that. They have problems.
- 12:37Here across the. Country and across.
- 12:40The world. We're seeing changes being made.
- 12:42We see. Spain is banning minors under
- 12:45the age of 16. We're seeing similar laws being
- 12:48enacted in Australia. So things are definitely
- 12:51changing, but I think we're going to get a good result here
- 12:55and then everybody's going to be in on it.
- 12:57John, what what do you think? Do you think something can come
- 13:00out of this trial that makes this the number one mass tort
- 13:03out there? I do.
- 13:05So I I've been paying very close attention to this and having sat
- 13:08down talked with Matt Bergman. It was actually I sat down with
- 13:11him the day that the defense did their opening statement and we
- 13:15went right into one of the plaintiffs experts.
- 13:17And one of the claims made by the defense is that for YouTube,
- 13:22YouTube is not social media and YouTube is not addictive.
- 13:25And that just makes absolutely no sense.
- 13:27The these platforms are addictive.
- 13:29They are social media. The claims are against them as
- 13:33like product defects, which if if you eliminate the content
- 13:37from the conversation, which I think Bergman and Lanier have
- 13:40done a really great job at setting the table for, you wind
- 13:43up looking at these in isolation from the content that's actually
- 13:46on the platforms. And realizing that it doesn't
- 13:49matter if someone's looking at things related to depression or
- 13:52suicide or if they're looking at teddy bears and they're looking
- 13:56at food places. It's the mechanisms that are
- 13:59keeping people engaged that they can't look away from.
- 14:03It's triggering things in people's brains that are keeping
- 14:05them addicted and constantly swiping.
- 14:08I don't see a way that Meta and, and Google step away from this
- 14:13without losing this trial. Or, you know, maybe there's
- 14:16still a chance that there is a settlement before this winds up
- 14:19getting to verdict. But I think that this is
- 14:22absolutely going to be in the plaintiff's favor.
- 14:24And I think that moving forward, we're going to continue to see
- 14:27plaintiffs do well here. And also in parallel, as you
- 14:30mentioned, the social media companies start to put more
- 14:33changes in effect as we're seeing it being forced upon the
- 14:36companies in other countries. Here in the United States, we're
- 14:40kind of leaving it up to the the companies to implement the
- 14:43changes that are necessary themselves, which they're they
- 14:46are going to have to start doing or they're just going to
- 14:48continue to face lawsuit after lawsuit after lawsuit.
- 14:51Yeah, and I, I. Agree with what you said, we
- 14:53could. See a settlement.
- 14:54I would be shocked if this. Comes out in the full defense
- 14:58verdict even. If it does.
- 14:59Right, even if that under 1% chance?
- 15:02It does. It's going to give us the road
- 15:03map like we saw an Uber. There's no way.
- 15:06That we lose back-to-back. Trials in this litigation, I
- 15:09think it's going to give us a good.
- 15:10Idea about what's the value? Of one of these cases and then
- 15:13hopefully we can work with the defendants, wrap our arms around
- 15:17the total number. Of cases out there.
- 15:19Come up with some reasonable settlement that's not only
- 15:22monetary and compensates all these victims, but brings about
- 15:26this change that's really need it.
- 15:27So this one could be the number one, maybe as soon as next
- 15:31month. We'll see what happens.
- 15:32I think maybe by the time people are watching this, we've got
- 15:36Zuckerberg on the stand and we'll, we'll see where the chips
- 15:39fall before we hit #1 we're going to give you the ones to
- 15:42watch that didn't quite crack the top ten.
- 15:45We've got toxic baby food which is currently waiting on Daubert.
- 15:49Yep, waiting for that Daubert opinion to come out in the MDL.
- 15:52Where more than two two months out from argument, so should be
- 15:55here within the next. 30 to 60 days.
- 15:57We also have. Do I believe it's pronounced
- 16:00duplexate or duplicate? Yep, that that's the new one on
- 16:04the block. Right, so this.
- 16:05Is a medication that's used to. Treat various.
- 16:08Type of ailments it could be. Used for severe.
- 16:11Eczema. It could be used for asthma and
- 16:14it causes. A very rare.
- 16:15Type of cancer, T cell lymphoma actually.
- 16:18Got word today that they're. Filing for JPML, Beasley Allen's
- 16:22taking the lead on that one. So we'll we'll have a hearing on
- 16:25that in a couple months. Could be a mass tort by the
- 16:28second-half of the year. Moving quick, definitely want to
- 16:31keep our eye on and ones that we're kind of holding onto, wait
- 16:36and see. We're still waiting on Tylenol.
- 16:38Does the Second Circuit breathe new life into this litigation,
- 16:41or does it go back to where it was a year ago?
- 16:44Yeah, we'll have to wait and see if that opens up.
- 16:47We'll have a ton of cases coming in and a ton of people to help.
- 16:50So no decisions imminent. I, I think we'll get in the
- 16:53first half of the year. Whether you're looking to break
- 16:55into mass torts or you're just looking for a partner you can
- 16:58finally trust, RR Digital is the answer.
- 17:01We have over a decade of experience in the mass torts
- 17:04space. We're reputable, we're proven,
- 17:06and we're relentless when it comes to exceeding our clients
- 17:08goals. If you're ready to get started,
- 17:10visit rrdigitalmedia.com. And coming in at #1 we have hair
- 17:18relaxer. It remains in the top spot from
- 17:21January. We currently have over 11,000
- 17:24active cases. What are some key dates everyone
- 17:26needs to keep an eye on as this litigation holds its number one
- 17:29spot in the power rankings? Yeah, the key.
- 17:31Date we're trying to get. Is the bellwether.
- 17:33Trial. So we don't have a firm.
- 17:35Date set. I don't think it's going to be
- 17:37in 26. It's probably going to be in 27.
- 17:40Hoping for a scheduling order with regard to that on the next
- 17:43month or two. We'll.
- 17:45Have some summary judgment motion?
- 17:47We'll have some experts. We'll keep.
- 17:49You guys updated when that briefing comes out, but.
- 17:51We like this tort because. It's got the numerosity, it's
- 17:54really mature, the defendants are there, the science is on our
- 17:58side and there's still a little bit of time, another year or so
- 18:02to get involved. So.
- 18:03Coming in and #1 staying there to.
- 18:05Start the year but. Social media addictions,
- 18:08definitely on the heels of hair. Relaxer.
- 18:10We'll see how it. Shakes out next month it.
- 18:12Is great to see mass torts really making progress over the
- 18:16last month. I mean, 2026 has been great.
- 18:19So much activity. We're heading into conference
- 18:22season. You got MTMP coming up in a
- 18:24couple of months, a few other conferences that are happening
- 18:26in the next few weeks. Just so much going on.
- 18:30Thank you for joining us. Joe, thanks for.
- 18:32Having me guys.
