Speaker 1: Now we turn to the Mountain Eagle to read news
0:03
from Whitesburg. Your reader today is Bill van Arsdale. We
0:08
will begin with the addition dated February twenty five, twenty
0:11
twenty six, which the publishers have donated to RADIOI as
0:16
a reminder. RADIOI as a reading service intended for people
0:20
who are blind or have other disabilities that make it
0:22
difficult to read printed material. The first story is massive
0:28
window replacement underway at Caudle Library. The Harry M. Caudle
0:36
Library in Whitesburg is receiving its first major exterior upgrade
0:41
since the building was constructed more than five decades ago.
0:45
The Electra County Public Libraries has hired Lewis Brothers Construction
0:50
to replace the massive front windows of the building, which
0:54
were installed in nineteen seventy four on Hobb's five and
0:57
ten cent store, rebuilt on the site after a previous
1:01
structure burned. The original windows were single pane glass with
1:06
virtually no insulation value. The new windows are double pain
1:12
low immissivity low E glass units designed to improve energy efficiency.
1:18
The glass includes a thin, invisible metallic coating that helps
1:23
block ultra violet light, reducing sun damage to books. Carpet
1:28
and furniture while reflecting infrared heat away during summer and
1:33
back into the building during winter. The upgrade is expected
1:38
to significantly reduce heating and cooling costs in the two
1:41
climate controlled floors of the building. The basement level is
1:46
not conditioned. Originally bid at about on one hundred sixty
1:51
thousand dollars, the final cost is expected to be closer
1:55
to one hundred fifty five thousand dollars, according to Brian
1:58
Lewis of Lewis Brothers Construction. The reduction came after required
2:04
asbestos testing of the calk returned negative results. The total
2:09
includes replacement of all front facing windows and doors. Replacing
2:14
the windows is no small task. Each of the four
2:18
main window units originally held three panes of glass approximately
2:23
one quarter inch thick. The lower sections of each unit
2:27
included two panes measuring about ten feet tall by three
2:31
and a half feet wide. Above them, a fan light
2:35
style section spans the seven foot width and adds another
2:39
three and a half feet in height including frames, Each
2:43
unit stands about fourteen feet tall. From the time we start,
2:48
it takes about three hours to demo one of those
2:51
units and get ready to put the new one in.
2:53
Lois said. Demolition involves removing the glass, calk and entire
3:00
frame before installing HUE three hundred pound frames. The replacement
3:05
glass is one inch thick insulated low E glass. Because
3:11
of the increased thickness and double pain construction, the new
3:15
window units include a horizontal mullion across the middle, something
3:19
the original windows did not have. The added support improves
3:23
structural integrity and reduces the weight of each pane. Larger
3:28
panes would require thicker glass to meet wind load standards
3:33
and would be substantially heavier. I'm not saying it would
3:37
be impossible to install low E glass and the original size,
3:40
Lewis said, but it would be impractical. Each of those
3:44
panes would weigh about fifteen hundred pounds, even if the
3:49
reduced size. Installation requires careful coordination. Free workers inside the
3:55
building use suction cups while another operates a man lift
4:00
outside to position each pane safely. The lift has a
4:05
capacity of five hundred pounds, so you can't put two
4:08
men in the basket and pick up the glass. Lewis said.
4:12
Weather has also posed challenges. Work was canceled one day
4:16
last week due to high winds, which can make handling
4:20
large panes unsafe. In addition to the four fourteen foot windows,
4:27
crews will replace a shorter, wider unit above the front entry,
4:31
as well as lower level windows, front doors, and sidelights.
4:37
The building's history stretches back decades. The original George Hogg building,
4:43
which housed RH Hobbs when it first opened, burned in
4:47
nineteen forty nine. Hobbs rebuilt, but that structure also burned
4:52
in nineteen seventy one. The current building was constructed in
4:56
nineteen seventy two with fire resistant material. The only significant
5:02
exterior changes since then were made in nineteen ninety four
5:06
when the library moved in, including the addition of a
5:10
semicircular awning and modifications to the entry glass. Although new
5:17
libraries have been built in Jenkins, Fleming, Neon and Blackie,
5:21
the Harry M. Cabell Library has never undergone extensive renovation,
5:26
aside from interior partitioning and the addition of a circulation
5:30
desk before the library relocated there. The window project represents
5:35
the largest exterior improvement since the lower level was remodeled
5:40
in nineteen ninety nine for Image Entry, a data processing
5:44
company that later moved to Jenkins and has since closed.
5:50
Lewis Brothers Construction also completed minor brick repairs and installed
5:55
metal flashing over a large arch on the front of
5:58
the building several years ago. The next story is judge
6:05
denies key motions ahead of trial in federal case, with
6:11
trials set to begin March third. A surge of motions
6:15
and court orders has reshaped the civil rights lawsuit against
6:20
former lecturer, District court bailoff Ben Fields, and the Leccher
6:23
County Sheriff's office. Since early February, the court docket reflects
6:29
twenty two motions and thirteen orders, underscoring intense pre trial
6:34
maneuvering as the case heads toward a jury. In a
6:39
series of rulings this month, U S District Judge Robert E.
6:43
Weir denied several key motions filed by the plaintiff Sabrina acts,
6:48
as well as some requests by the defense. In one
6:53
order were cautioned both sides that repeated consideration requests were
6:58
testing the court's patience. The court's patients with reconsideration requests
7:03
is near its end, Weir wrote in denying a motion
7:07
to reconsider an earlier ruling. Among the more significant rulings,
7:13
were denied Atkinson's request for a rent of habeas corpus
7:17
that would have required the state to transport former Electra
7:21
County Sheriff Mickey Steins from the Leslie County Detention Center
7:25
to testify in London. He later denied a motion to
7:29
reconsider that ruling. The judge also denied Atkinson's motion seeking
7:35
to prevent Fields from introducing evidence that she consented to
7:39
have sex with him. A subsequent motion to reconsider that
7:43
ruling was also denied. The court has likewise ruled on
7:48
several defense motions, denying some efforts to limit witnesses while
7:53
granting others. Weir approved the defense request to exclude testimony
7:58
from Whitesburg attorney DANGL Dotson, but denied a motion to
8:02
exclude testimony from an expert witness. Atkinson's attorney plans to
8:06
call additional motions remained pending, including proposed jury instructions and
8:13
war deer questions. The lawsuit was filed January thirty first,
8:19
twenty twenty two. It originally named Fields, then Sheriff Steins,
8:26
and East Kentucky Correctional Services Incorporated EKCS of South Shore
8:32
as defendants. Fields worked as a deputy sheriff and court
8:37
security officer. He also performed part time work for EKCS,
8:43
placing electronic monitoring bracelets on individuals released on bond and
8:48
collecting payments. Atkins alleges that Fields coerced her into having
8:53
sex in exchange for keeping her monitoring bracelet deactivated so
8:58
she would not have to pay associated fees. She further
9:03
alleged e KCS failed to properly train and supervise him.
9:08
EKCS is no longer in business and has reached an
9:12
undisclosed settlement with Atkins. Steins was dismissed from the lawsuit
9:18
because the claim was filed against the Sheriff's office rather
9:22
than him personally. Sheriff Billy Jones, who was appointed after
9:26
Steins was later charged with murder in an unrelated case,
9:31
was added to the suit in his official capacity. Fields
9:36
pleaded guilty in Lector Circuit court to third degree rape,
9:40
reflecting that he held a position of authority over Atkins.
9:45
He admitted to having sex with her in the district
9:47
Judge's office after hours and in his police vehicle. In
9:52
the civil case, however, Fuels disputes liability and contends the
9:57
encounters were consensual. He seeks to introduce text messages. He
10:02
says show Atkins sent him a photo of herself wearing
10:05
a bra and made sexually suggestive statements. Barring further delay,
10:12
the trial is scheduled to begin at eight thirty am
10:15
Tuesday in US District Court in London. And In the
10:20
next story, old post Office finds new life. Callen Community
10:26
Center is expanding its footprint in Whitesburg with the acceptance
10:31
of the historic Whitesburg Post Office building as a gift.
10:35
Brooke Smith, a Louible businessman and philanthropist who purchased the
10:40
eighty nine year old building about eight years ago, sent
10:43
donating it to Callen Community Center. Made sense. I didn't
10:48
have a plan for it when I bought it, Smith said,
10:50
I knew it would figure itself out, and it did.
10:55
Smith spent much of his early adult life working on
10:58
projects for coal companies before becoming a successful businessman in Louisville.
11:04
He and his wife, Pamela later founded the Appalachian Impact Fund,
11:09
a social impact investment fund that provides grants to nonprofits
11:14
throughout eastern Kentucky. Smith said he bought the former post
11:18
office building on a whim an initially rented office space
11:22
to small businesses. That arrangement didn't last long. We realized
11:27
the best thing was just to let them have the space,
11:30
he said. Over the years, the building has housed various
11:34
community uses. Smith said nearly every one he meets in
11:38
Whitesburg has a story about the old post office or
11:42
its long time postmaster. The late R. C. Day, a
11:47
Wetlands mitigation group, operated there for several years. More recently,
11:52
Callan Community Center has used the building for the past
11:55
couple of years. In the aftermath of the twenty twenty
11:59
two flood, the Small Business Administration used the space to
12:03
process loan applications for residents who did not qualify for
12:08
FEMA assistance. It's a neat building, it has good bones,
12:13
Smith said, and it says something about where we came from.
12:19
Built in nineteen thirty seven, the structure was announced and
12:22
completed in less than a year during the height of
12:25
the Great Depression. Local workers were hired through federal New
12:29
Deal programs under President Franklin D. Roosevelt. The building was
12:35
designed by Louis A. Simon, supervising architect of the Public
12:39
Works Branch of the U. S. Treasury. Simon later designed
12:43
President Roosevelt's presidential Library and museum. Valerie Iisen of Cowan
12:49
Community Center praised Smith's generosity and said the building will
12:54
continue to serve the public, though plans for its long
12:57
term use are still developing. It will continue to serve
13:01
as a base for the Farmer's Market and for activities.
13:04
Eisen said, we invite the community to share their ideas.
13:10
The gift further expands Cowan Community Center's growing presents in Witsburg.
13:16
In recent years, the non profit has secured state and
13:19
federal grants, hosted the Levitt A m p concert series,
13:24
operated Caine Kitchen in the former Whitesburg High School building,
13:28
and organized a Farmer's market that draws vendors and visitors
13:32
from across the region. The addition of the former post
13:35
office building gives the organization another permanent foothold in the
13:39
downtown area. The center is also preparing to begin construction
13:44
of a pavilion near the Veteran's Museum that will provide
13:49
space for the Farmer's market, restrooms, and a demonstration kitchen.
13:54
The pavilion, designed and manufactured off site, will first be
13:58
assembled on local along with plumbing, electrical and other infrastructure.
14:04
The remainder of the project will be completed under a
14:06
second bid. The pavilion project will be funded through a
14:11
five hundred thousand dollars grant from the abandoned mine Land's
14:15
Economic Revitalization a m l e R program. In the
14:20
next headline. Fifty years later, Scotia remembered on March ninth,
14:27
nineteen seventy six, at eleven thirty a m Blue Diamond
14:31
Coal Companies Scotia mine at oven Fork and Electric County
14:35
blew up that afternoon. Miners from beth Elkhorn and Jenkins
14:40
National Mines in Wayland, International Harvester in Benham, u S
14:45
Steel in Lynch, and Westmoreland Coal across Black Mountain and Apalachia,
14:50
Virginia were called away from their shifts and told to
14:54
gather their mine rescue gear. They were being sent to
14:57
oven Fork in the hope of saving wives. At the
15:01
time of the blast, more than one hundred men were
15:04
underground in Scotia's bottom scene. By mid afternoon, rescue teams
15:10
began arriving amid a scene of confusion, with very little
15:14
information about what they would face underground. They had no
15:18
idea whether there was an active fire, what caused the explosion,
15:22
whether anyone had survived or whether the mine had collapsed.
15:28
The best information came from a Scotia miner who had
15:31
been about two thousand feet from the blast and instead
15:34
of retreating out of the mine, went forward to see
15:37
if he could help survivors. That miner, John Hackworth, ran
15:42
into bad air within about four hundred feet of the
15:46
working face and was forced back, but he was able
15:49
to tell authorities what he had seen. He continued working
15:53
throughout the night, bringing materials in to re established ventilation,
15:58
earning the respect and admiration of the rescue team. With
16:03
Federal mind inspectors managing the crisis, rescue teams went underground
16:08
and began restoring ventilation so fresh air could be brought
16:12
to a point from which they could explore for bodies.
16:16
With fifteen men known to be missing in several hours
16:20
having passed since the explosion, they expected the worst the
16:26
first explosion. The first team sent in to explore was
16:30
from International Harvester. Next was Westmoreland. At around ten pm,
16:36
the Westmoreland team entered this section where the men had
16:39
been working and found the first body. After reporting the discovery,
16:45
the team was pulled to the surface. Replacing them was
16:49
a team from US Steel, which found twelve more bodies
16:53
before running alow on oxygen. Ray McKinney was a member
16:57
of that team. He had worked at Scotia just two
17:01
months earlier before taking a job with US Steel. Now
17:05
he was locating the bodies of men he had once
17:07
worked beside. He knew every victim. Of the twelve men
17:13
found by McKinney and the US Steel team, six had
17:17
survived the initial blast and attempted to walk out, likely
17:22
overcome by the same bad air that had forced Hackworth back.
17:26
They retreated into their workspace and erected a loose barricade,
17:31
hoping to hold out until rescuers with oxygen could reach them.
17:35
They could not. About eight hundred feet farther in were
17:40
the last two bodies near an old locomotive equipped with
17:43
an air compressor to operate the brakes, a system that
17:47
threw a visible spark when it kicked on. At the time,
17:51
no one understood the significance of that detail. Members of
17:55
the beth Elkhorn Mine twenty nine team were sent forward
17:59
to retrieve them. The two men, Scotia miners Roy mc
18:04
knight and Lawrence Peavey, had been working with the locomotive
18:08
that morning. They died milliseconds before the other thirteen. Both
18:14
were large men, and Leonard Fleming of the Beth Elkhorn
18:17
team later recalled how difficult it was to carry them
18:20
more than eight hundred feet back to the fresh air base. Exhausted,
18:26
the team from National Mines joined Beth Elcorn to help
18:30
retrieve the final victim a second blast nearly sixty hours later.
18:39
Most rescuers were home in bed when word came of
18:42
a second explosion at the Scotia mine. Leonard Fleming, who
18:47
passed away in October twenty twenty five, would later remember
18:51
that responding to the first explosion was like going to
18:55
their first ballgame or something, with everyone anxious to do
18:58
their part. Let's go, let's go, let's get in there.
19:01
There might be somebody alive. Fleming said, we're losing time
19:04
and it's count. But he added when that second explosion hit,
19:10
there wasn't anybody wanting to go in. The ones that
19:13
went into that mind didn't want to go in. There
19:16
wasn't anybody saying much of anything. Rescuer Jim Vissini agreed,
19:23
I wasn't nearly as scared the first time as I
19:25
was the second McKinney told a similar story as he wrote,
19:31
A man trip into the mouth of the mine for
19:33
the second time. John Dixon, sitting beside him, asked, do
19:37
you think they know what they're doing here? McKinney responded,
19:42
I don't know how you blow a mine up twice
19:44
in a week. It takes a little bit to blow
19:46
a mine up once. When federal authorities arrived on the
19:51
scene March ninth, the Mine Enforcement and Safety Administration MESA
19:57
took control. When the mine exploded again on March eleventh,
20:01
it became Mace's crisis. Down the borehole. Rescue teams again assembled,
20:09
and the men from International Harvester and US Steel were
20:13
sent into the drift mouth to explore. The mine extended
20:17
three and a half miles underground, and it quickly became
20:21
clear that rebuilding ventilation through the drift mouth would take weeks.
20:26
Another entry point was needed. The previous year, Scotia had
20:30
drilled a thirteen and a half foot concrete lined borehole
20:34
three hundred seventy four feet deep at one of its
20:37
furthest points intended initially for an elevator. By March nineteen
20:43
seventy six, it was simply a hollow ventilation shaft. Westmoreland
20:48
teams were transported by bus to Aeolia, where an aging
20:52
crane lowered men three at a time in a four
20:55
foot square steel basket. The crane was missing a tooth
21:00
in its gearing, causing the basket to drop suddenly about
21:04
every fifteen feet, enough to terrify the men inside. Remembered
21:09
Westmoreland's Gerald Tait and j. R. Kimberlin. At the bottom,
21:14
more than twenty men were assembled, all of whom would
21:17
have to be raised out three at a time if
21:19
something went wrong. Moving toward the second blast site, teams
21:25
leap frogged two thousand, six hundred feet in sequences of
21:28
five hundred feet. As they approached the area where bodies
21:32
were expected, they advanced together. They first saw three Federal men.
21:38
You could see those coveralls. They had reflective material on them.
21:44
Matt Smith of Westmoreland had befriended John Hackworth after the
21:48
first explosion and did not know Hackworth had volunteered to
21:52
return underground. He was right there, lying in a supply car.
21:56
Smith recalled, it had to bend over pretty low with
22:00
that apparatus on to get by, But as you're passing
22:03
him you're looking right down and he's lying on his back.
22:07
Your face is within about a foot of his. And
22:12
to be twenty three years old and really never been
22:14
around death that much, it's a sight you'll never forget.
22:20
After mapping the bodies, the teams hurried back to the borehole.
22:24
We picked them up and laid them down to get
22:26
out of there, Smith said. Back at the borehole, they
22:31
began the slow ascent. In the final basket were three
22:35
Westmoreland men and Bill Clemens, the federal inspector in charge
22:39
during both crises. Initially anxious about the thin steel cable
22:45
separating them from life and death, the men soon realized
22:49
Clemens was crying. He cried like a baby all the
22:53
way up. One rescuer remembered sealing the mine. Two days later,
23:02
Mesa decided to seal the mine and the bodies within it.
23:06
The decision was agonizing for families who wanted proper burials
23:10
for their loved ones. The mine remained sealed until mid
23:15
November two hundred forty three, days before it was reopened
23:19
and the bodies recovered. When investigators returned, they found the
23:26
victims exactly where Gerald Tate and Lloyd Robinette had mapped
23:30
them with b P three eleven seventy six written in
23:36
chalk overhead on a roof bolt plate, the date recorded
23:40
by Westmoreland Captain Bill Person. The mine had not exploded again.
23:46
Persons footprint beneath the plate remained undisturbed. In total, twenty
23:53
six men died in the two explosions, leaving behind twenty
23:57
five widows. The family place filed suit against Blue Diamond
24:02
Coal and Scotia Settlements provided lump sum payments for widows
24:07
and annuities for children. For the families of the three
24:12
federal inspectors who died March eleventh, compensation was limited to
24:16
life insurance policies ranging from nineteen thousand dollars to thirty
24:20
three thousand dollars. Lasting change. The deaths of the twenty
24:27
three Scotia miners and the three federal inspectors led to
24:32
the Mine Act of nineteen seventy seven, which fundamentally reshaped
24:36
Federal Mind Safety Enforcement MESA was reorganized into what is
24:41
now the Mine Safety and Health Administration MSHA. In the
24:47
five years between the Hurricane Creek disaster and Leslie County
24:50
in nineteen seventy and Scotia in nineteen seventy six, one
24:55
hundred two miners died in Kentucky after the Mine Act
25:00
became law. It took until nineteen eighty four to reach
25:03
that number, and from nineteen eighty five until two thousand
25:06
and six to reach it again. Coal Mining remains dangerous work,
25:13
but it is significantly safer because of what happened between
25:16
March ninth and March twelfth, nineteen seventy six in oven Fourth.
25:23
This article was written by Brian D mc knight, a
25:26
professor of history at the University of Virginia's College at
25:29
Wise and founding director of the school's Center for Appalachian Studies.
25:36
Scotia Mine Disaster's fiftieth anniversary to be remembered at events
25:41
On Monday, March ninth. Historian Brian D mc knight will
25:45
lead a public moment of reflection at the Scotia Mine
25:48
Portal site at eleven thirty a m followed by a
25:52
program at the Kentucky Coal Museum in Benham. The next
25:59
story is EXCFO files lawsuit against mental health agency. The
26:06
former chief financial officer of a Prestonsburg based mental health
26:09
agency with offices in Lectric County has filed a whistleblower
26:13
lawsuit alleging she was forced to resign after refusing to
26:18
participate in what she describes as Medicaid and Medicare fraud.
26:24
Rebecca Hall of Prestonsburg, who says she worked for Mountain
26:27
Comprehensive Care Center Incorporated MCCC for twenty six years, has
26:33
sued MCCC and its subsidiary, Mountain Plus Services, Incorporated, in
26:39
Floyd's Circuit Court. She seeks unspecified compensatory and punitive damages
26:45
for alleged harm to her physical and mental health, lost
26:48
wages and retirement benefits, and attorney fees. MCCC is not
26:54
affiliated with Mountain Comprehensive Health Corporation, which is based in
26:59
Electric County. In her complaint, Hall alleges that MCCC and
27:05
its chief executive Officer, Promad Bishnoid, directed administrative staff to
27:10
submit Medicaid claims through the organization's Federally Qualified Health Center
27:15
FQHC for services that were performed at other locations. Fqhc's
27:22
received higher reimbursement rates from Medicare and Medicaid than other
27:26
types of clinics. Hall further alleges that Bishnoit directed her
27:31
to refrain from responding to Medicaid and Medicare requests for
27:35
clarification of certain charges, instructed her to submit some claims
27:41
as if services were provided by licensed providers when they
27:44
were not, prevented the billing department from establishing updated billing
27:49
codes after COVID nineteen policy changes to reflect audio only
27:54
physician visits, and directed the company's audit department to change
27:59
billing locations despite being advised that doing so would violate
28:03
state law. This concludes the reading of The Mountain Eagle.
