- 0:05Speaker 1: This is a Bramble Jam podcast.
- 0:14Speaker 2: This week on your gabble gabble.
- 0:16Speaker 3: If you sell someone a car that almost instantly kills them,
- 0:18Speaker 3: or you to blame.
- 0:20Speaker 2: Judge Faith determines who the lemon.
- 0:22Speaker 3: Is and if a fork left hurts your heel, are
- 0:25Speaker 3: you entitled to a boatload of money?
- 0:27Speaker 1: Or is Judge Gino turning heel? Real people? Faith Justice?
- 0:32Speaker 2: This is Joe Gabble. Wow, man, can I tell you this?
- 0:40Speaker 2: What good is that? Wins?
- 0:42Speaker 3: I wish I had said Judge Faith makes lemonade out
- 0:46Speaker 3: of limits.
- 0:46Speaker 1: That's good too.
- 0:48Speaker 3: The car you see that would have been bad what
- 0:51Speaker 3: I did. This is why we need to prep long
- 0:53Speaker 3: Judge Faith, Judge Faith. I love Judge Faith. I almost
- 0:56Speaker 3: went to Judge You want to tell anybody that judge
- 0:58Speaker 3: just their first episode what to do?
- 0:59Speaker 1: Here?
- 0:59Speaker 2: Is that just for the last.
- 1:00Speaker 1: One I could tell people, Yeah, this is your first time.
- 1:03Speaker 1: I'm gonna tell Dana Case of of TV Courtroom show
- 1:07Speaker 1: that he has not seen. He's gonna try to figure
- 1:09Speaker 1: out the verdict and then we're gonna do the exact
- 1:10Speaker 1: same thing.
- 1:12Speaker 2: That's exactly I'm.
- 1:13Speaker 1: In Judge Gino, which is personal injury courts, and we
- 1:18Speaker 1: are talking a sum of money I've never seen on
- 1:20Speaker 1: television before. H and Dan, you're going to judge faith,
- 1:23Speaker 1: which is your standard standard situation sanduation.
- 1:26Speaker 2: I'm gonna go first because I'm excited about this. Judge.
- 1:28Speaker 3: You don't want to give you the time. It is, okay,
- 1:29Speaker 3: so let me go ahead and go first. Here, Carlton
- 1:31Speaker 3: Henry is suing for thirty five hundred dollars of a
- 1:37Speaker 3: car that he bought how much thirty five hundred dollars
- 1:43Speaker 3: from Donald Gyram. Donald Gyram sold him the car, and uh,
- 1:48Speaker 3: he's suing him for.
- 1:48Speaker 2: Thirty five hundred dollars.
- 1:50Speaker 3: So Carlton in twenty eighteen purchased a two thousand and
- 1:53Speaker 3: nine Chevy Aveou from Dot Chevy.
- 1:57Speaker 1: Chevy get gyrammed into Benson.
- 2:00Speaker 2: We'll get to it. That's really nicely does the too? Uh?
- 2:04Speaker 3: Donald Jyram says, this was my personal vehicle that I
- 2:07Speaker 3: used to take my kids to school and go to
- 2:09Speaker 3: work every day. I'm a regular person too, just like
- 2:13Speaker 3: everyone And he says it just like that. He's He's like,
- 2:17Speaker 3: I'm a regular person too, just like everyone else. Wow,
- 2:21Speaker 3: He's wants to make it clear you think he's a
- 2:23Speaker 3: regular person. He is much older. Carlton is a young man.
- 2:26Speaker 3: He's probably twenty. Carlton's like, I'm a regular person too,
- 2:30Speaker 3: that almost lost his life. And Donald says, WHOA slow
- 2:34Speaker 3: your role there, buddy, Wow, Just like that, fantastic Faith
- 2:38Speaker 3: gabbles and calms everybody down. Tensions are heated. So Carlton
- 2:41Speaker 3: says he saw an ad on Craigslist. He has the
- 2:44Speaker 3: ad with him in court. He says, I want to
- 2:45Speaker 3: be clear, this ad never specifically mentions as is in
- 2:50Speaker 3: its description. It says it's in good condition. We have
- 2:53Speaker 3: texts and email chain back and forth. Says the car
- 2:55Speaker 3: is in good condition. Nowhere does it say as is.
- 2:58Speaker 3: Faith says, I think you're trying to reemptively get out
- 3:01Speaker 3: in front of this because you know that his argument
- 3:03Speaker 3: is going to be the car is as is?
- 3:05Speaker 2: Is that right? And she says yes.
- 3:07Speaker 3: He says yes, ma'am okay, and Faith says, but isn't
- 3:10Speaker 3: that the default with car sales that are used cars?
- 3:14Speaker 3: He says yeah, but he never he never said it.
- 3:16Speaker 3: So the ads for forty two hundred. He buys it
- 3:18Speaker 3: for thirty five hundred. Donald says, I bought this car
- 3:22Speaker 3: because I need a reliable car to drive me to Flagstaff, Arizona.
- 3:25Speaker 2: I think they're in Phoenix. I could be wrong. Why
- 3:28Speaker 2: wouldn't I make and then uh, oh no, I'm sorry. Not,
- 3:32Speaker 2: I'm sorry.
- 3:33Speaker 3: Carlton scratched that flag. Hold on, everyone, scratch out from
- 3:36Speaker 3: the record Bachshrad made read it back to me. Donald says, listen,
- 3:41Speaker 3: I bought this car because I need a reliable car.
- 3:43Speaker 3: Why wouldn't I make sure the car that I'm driving
- 3:45Speaker 3: my kids in is in good condition. I would never
- 3:47Speaker 3: knowingly sell a bad car to someone. And Faith, So
- 3:51Speaker 3: at this point, pretty cut and dry. Right here comes
- 3:53Speaker 3: the twist. Faith says, so you bought the car new.
- 3:56Speaker 3: He says, no, I bought it this year. So this
- 3:59Speaker 3: is a car and sold almost immediately after buying it.
- 4:03Speaker 3: So then we find out that he's also a mechanic.
- 4:09Speaker 2: Okay, he said I bought the car.
- 4:11Speaker 3: It was broken and I bought it to fix up
- 4:14Speaker 3: because that's what I do. And I thought he said
- 4:18Speaker 3: that he drives his car. We don't get into this.
- 4:21Speaker 3: Faith references this. He does not have a response to this.
- 4:26Speaker 1: Whether or not he actually used his car on a
- 4:28Speaker 1: daily basis.
- 4:29Speaker 3: Doesn't have a response. He is set on the record
- 4:31Speaker 3: that he does. But he also bought it this year
- 4:33Speaker 3: and sold it this year. Boy, So Faith says, did
- 4:37Speaker 3: you have the car checked out by a professional before
- 4:39Speaker 3: you purchased it? He said, the guy is a mechanic.
- 4:42Speaker 3: I bought it from his shop. That was enough for me.
- 4:45Speaker 3: He seemed like a nice man. He's a mechanic selling
- 4:47Speaker 3: a car. He was willing to go down from forty
- 4:49Speaker 3: two hundred to thirty five hundred, and so I trusted him.
- 4:54Speaker 1: Do we know how much Donald Donald is not the car?
- 4:59Speaker 2: For No, we do. Originally we don't.
- 5:02Speaker 3: He and faces you didn't have another mechanic check it out.
- 5:04Speaker 3: Carlton says, no, I didn't. Uh, she says, so what happened?
- 5:07Speaker 2: He goes.
- 5:07Speaker 3: I leave from there. Literally, I'm on my way to Flagstaff, Arizona.
- 5:12Speaker 3: An hour after I bought the car. My car, the
- 5:16Speaker 3: driver's side hits the rumble. He calls him a rumble stripe.
- 5:20Speaker 3: We found out it was rumble strips from from a
- 5:22Speaker 3: bry My car hits the rumble stripe. When it hits it,
- 5:26Speaker 3: it immediately goes flying in the air like the car
- 5:30Speaker 3: goes the car, the tire blows out, it goes tumbling over.
- 5:36Speaker 3: It flips three times. I blacked out. Someone called nine
- 5:39Speaker 3: to one one who saw the car and that saw
- 5:41Speaker 3: the accident happen. I crawled as when I come to,
- 5:44Speaker 3: I crawl out of the car, and witnesses say, I'm
- 5:46Speaker 3: lucky to be alive.
- 5:48Speaker 1: So he hits the rumble strip. The tire immediately bursts boom.
- 5:51Speaker 2: And it just starts. The car got of air.
- 5:53Speaker 3: Yes, there's photos from the accident. Holy cow, it's brutal.
- 5:57Speaker 3: I don't know how he got out of the car.
- 5:59Speaker 3: It's absolutely had a concussion, had two partially collapsed lungs.
- 6:03Speaker 3: I am not in any way, shape or form suing
- 6:07Speaker 3: this guy for any medical damage. I just the car
- 6:10Speaker 3: was defective. And she said, how do we know the
- 6:11Speaker 3: car was defective? That isn't good enough. And he says
- 6:14Speaker 3: I took it to someone after the incident and a
- 6:19Speaker 3: different mechanic.
- 6:20Speaker 2: A third party says.
- 6:22Speaker 3: That there was a faulty valves, that it could have
- 6:26Speaker 3: been a faulty valve stilm on the tire could have
- 6:30Speaker 3: done it.
- 6:30Speaker 2: A faulty valve stim on the tire. Now, Donald's like.
- 6:34Speaker 3: This is after the accident happened, your honor, I just
- 6:36Speaker 3: want that on the record, and she's like, it's on
- 6:38Speaker 3: the record. Were you aware of an issue with the tire,
- 6:43Speaker 3: That's what he asked, Donald Jimar. Donald Jaymar says, your honor,
- 6:46Speaker 3: I wasn't aware. I drove this car every day with
- 6:49Speaker 3: my kids. Judge Faith does not bring up again the
- 6:53Speaker 3: fact that he just bought the car this year and
- 6:54Speaker 3: sold it this year, and when he bought it it
- 6:56Speaker 3: was inoperable.
- 6:57Speaker 2: She does not even bring that up again. She just says, uh,
- 7:01Speaker 2: I'm ready to rule.
- 7:02Speaker 1: Wow, that's short. Correct, He's not getting any money. Ultimately,
- 7:11Speaker 1: you bought a car, you started to drift off the road,
- 7:15Speaker 1: hit the rumble strip. Now granted a rumble strip shouldn't
- 7:19Speaker 1: cause you to flip all of all like that, but
- 7:21Speaker 1: the tire tires, tires do things like that. Happens like
- 7:28Speaker 1: a tire. Ah, I don't know. That's not a mechanical issue.
- 7:34Speaker 1: In my mind, that is a tire potentially hitting all
- 7:38Speaker 1: sorts of things that can be on the side of
- 7:40Speaker 1: the road, including in the rumble strip. Unfortunately, don't think
- 7:43Speaker 1: it's gonna get any money.
- 7:44Speaker 3: So this is one of those cases where there's a
- 7:46Speaker 3: secret law that changes everything.
- 7:48Speaker 1: A secret law, and so.
- 7:50Speaker 3: Judge faith says, So the thing about buying a car
- 7:52Speaker 3: as is is that you buy it as is. Every
- 7:55Speaker 3: used car sale, unless otherwise stated, is as is. There's
- 7:58Speaker 3: nothing you can do about that. However, you in the
- 8:00Speaker 3: state of Arizona. In the state of Arizona, there's something
- 8:02Speaker 3: called an implied warranty of merchant ability, which means when
- 8:07Speaker 3: you sell a car in Arizona, it applies directly to
- 8:10Speaker 3: the safety and only the safety of a car, meaning
- 8:13Speaker 3: that as is includes the safety of operating that vehicle
- 8:17Speaker 3: unless otherwise stated, for fifteen days after the purchase of
- 8:20Speaker 3: the vehicle. Wow, that is a law in Arizona.
- 8:23Speaker 1: So if anything happens to the vehicle that could be
- 8:27Speaker 1: traced to safe, could be safety.
- 8:29Speaker 2: That's right.
- 8:30Speaker 3: He didn't have it for an hour. We have evidence
- 8:32Speaker 3: that suggests the car may have not been unsafe. That
- 8:35Speaker 3: is enough for me to rule in favor of Carlton.
- 8:38Speaker 3: This law supersedes and as is sell. He's getting every
- 8:41Speaker 3: penny thirty five hundred dollars. Now, if you see these
- 8:44Speaker 3: two people in the courtroom, you know why she does it.
- 8:46Speaker 3: It's because it's clear this dude's a snake. It's clear
- 8:50Speaker 3: that he is trying to turn profit on Lemon cars,
- 8:55Speaker 3: and that's why she I.
- 8:55Speaker 1: Think my only problem with this isn't that it just
- 8:58Speaker 1: happened out of the blue. It happened with going off
- 9:02Speaker 1: the road a little bit. That's right, when he got
- 9:04Speaker 1: out through road. That's all sorts of if the laws
- 9:06Speaker 1: in her favor or not.
- 9:07Speaker 3: But she does doesn't because this guy clearly took advantage
- 9:11Speaker 3: of this kid.
- 9:11Speaker 2: It was it was clear as day that he did.
- 9:13Speaker 1: Fair. Let's go to Judge Geno, to Judge g.
- 9:18Speaker 3: Donna Wilson, Donald Wilson, Donna Dona Wilson.
- 9:25Speaker 1: Is suing four. Are you ready?
- 9:28Speaker 2: It's not shatman.
- 9:29Speaker 1: Are you ready?
- 9:30Speaker 2: Yeah, Suing four, I'm ready.
- 9:33Speaker 1: Two hundred and fifty thousand dollars in past medical expensive
- 9:36Speaker 1: got it. One hundred and fifty thousand dollars for future medical.
- 9:39Speaker 2: Expension, okay.
- 9:40Speaker 1: Two million dollars for scarring and disfigurements, oh my god.
- 9:44Speaker 1: And two point seven million dollars for pain and suffering.
- 9:47Speaker 1: Total of five point one million dollars.
- 9:50Speaker 2: Oh. How is scarring in this memberment different than pain
- 9:52Speaker 2: and suffering?
- 9:54Speaker 1: I'm not entirely sure.
- 9:55Speaker 2: Okay, I'm here for Donna Wilson. Who is she suing?
- 9:57Speaker 1: Donna Wilson is suing uh, Henry Henry Henry Atkins, Henry
- 10:03Speaker 1: Henry Atkins. Donna Wilson Uh started working at a shipping warehouse.
- 10:12Speaker 1: Uh and a few months later she gets promoted to
- 10:15Speaker 1: the supervising manager position. So she is supervising the shipping warehouse.
- 10:22Speaker 2: Got it? It's a lot.
- 10:24Speaker 1: Gino says women are changing the world, and.
- 10:28Speaker 3: The craft goes I've never seen someone more behind on
- 10:31Speaker 3: things that thinks he's ahead of them than Gina.
- 10:33Speaker 2: Women are changing the world.
- 10:35Speaker 1: Crowd loves it.
- 10:36Speaker 3: Though Henry woman could be supervisor of a shipping room
- 10:39Speaker 3: Unbelievablet's get into the legal song.
- 10:41Speaker 1: Now, I will say she does bade him into that.
- 10:43Speaker 1: She says, I was promoted to a supervisor position and
- 10:48Speaker 1: a male dominated works. Okay, so it didn't come out
- 10:51Speaker 1: of nowhere, but women are changing the world. Henry Atkins
- 10:56Speaker 1: is a truck driver. His company works for fifty different companies,
- 11:03Speaker 1: so he provides shipping for fifty different companies, including the
- 11:07Speaker 1: company that Donna works for. Donna explains that one afternoon,
- 11:13Speaker 1: she goes back to the shipping room because everyone is
- 11:18Speaker 1: on break Okay. She typically doesn't spend a lot of
- 11:20Speaker 1: time in the shipping warehouse, so she has an office,
- 11:24Speaker 1: et cetera. But today, as she sends everybody to lunch,
- 11:28Speaker 1: and she goes to check on a few things to
- 11:30Speaker 1: make sure. I'm not entirely sure, I'm assuming she just says,
- 11:34Speaker 1: to make things sure things are ready. So I don't know.
- 11:36Speaker 1: She's checking boxes, see that things are where they're supposed
- 11:39Speaker 1: to be. Henry says, why would you send everybody lunch
- 11:42Speaker 1: at the same time. Nothing gets done. I don't know, man,
- 11:44Speaker 1: it's just the way she wants to do things. I
- 11:46Speaker 1: don't know to tell you. So Donna's in the warehouse,
- 11:50Speaker 1: she's checking on stuff. She looks at a few boxes,
- 11:53Speaker 1: and she says, she starts to step back to get
- 11:56Speaker 1: a bigger view of things, and she suddenly feels something
- 12:00Speaker 1: clip her heel and she has extreme pain. She falls down.
- 12:06Speaker 1: She says that Henry was driving a forklift, didn't see her,
- 12:11Speaker 1: clips her heel. She falls to the ground. Okay, Henry says,
- 12:15Speaker 1: I didn't see her, but I felt that I hit something,
- 12:18Speaker 1: so I stopped. I hear her screaming.
- 12:20Speaker 2: So the guy in charge of the company was driving
- 12:22Speaker 2: a forklift.
- 12:23Speaker 1: The guy who drives the truck. Now it is his
- 12:27Speaker 1: family business, but he is yes, we'll get to it.
- 12:30Speaker 1: Ok So he stops. She's on the ground, she blacks out,
- 12:36Speaker 1: she wakes up, she's in the hospital.
- 12:37Speaker 2: Okay.
- 12:38Speaker 1: Henry says that this is a company that he's been
- 12:42Speaker 1: working in relation with for four years now, and he
- 12:46Speaker 1: had a load in his truck to drop off. So
- 12:50Speaker 1: I show up and typically somebody is there to use
- 12:55Speaker 1: their forklift to the truck. On this day, everybody's at lunch.
- 13:02Speaker 1: So I decide I'm going to do it myself.
- 13:04Speaker 2: Got it.
- 13:04Speaker 1: I'm a certified forklift driver, so I can do this now.
- 13:08Speaker 1: Donna says policy is in place that says that he's
- 13:11Speaker 1: supposed to wait for somebody on staff at our facility
- 13:15Speaker 1: to unloaders. He's supposed to bring me the paperwork. I
- 13:21Speaker 1: sign off that he brought the things that he's supposed
- 13:23Speaker 1: to bring, and that is all that he is supposed
- 13:25Speaker 1: to do. Instead, today he got on a forklift and
- 13:28Speaker 1: decide that he's going to do whatever you want to do.
- 13:30Speaker 1: He explains that previous management told him that he could
- 13:34Speaker 1: operate the forklift if he wants to. He knew the policy,
- 13:38Speaker 1: but the previous management said he can go against the policy,
- 13:42Speaker 1: and Donna says that that is the reason why this
- 13:44Speaker 1: old management was fired in the first place. Wasn't following
- 13:47Speaker 1: the policy I was put in place because safety is
- 13:49Speaker 1: my number one priority, so all that I care about.
- 13:53Speaker 1: So Donna explains that there is about a this much
- 13:58Speaker 1: hole in her ankle. It's about three ashnches.
- 14:01Speaker 2: This is the only part of her body that's hurt.
- 14:03Speaker 1: Just hold on. So she explains that they had to
- 14:08Speaker 1: take muscle out of her thigh to put in her
- 14:11Speaker 1: heel to help balance. Never going to be the same,
- 14:16Speaker 1: She's always going to have a limp. She'll never be
- 14:18Speaker 1: able to wear heels again. My husband is sick. I'm
- 14:22Speaker 1: the breadwinner of my family and this has severely impacted
- 14:26Speaker 1: my life and will continue to severely impact my life. Now,
- 14:29Speaker 1: Gino brings in a doctor as as he laism. The
- 14:33Speaker 1: doctor does I saw plasma in the doctor they were
- 14:35Speaker 1: fantastic as uh. He explains that basically the forklift took
- 14:40Speaker 1: her heel off.
- 14:42Speaker 2: Okay, okay.
- 14:44Speaker 1: There are multiple surgeries to fight against the infection, to
- 14:48Speaker 1: try to help heal the heel, and sometimes this ultimately
- 14:53Speaker 1: leads to amputating below the knee because you can't heal
- 14:57Speaker 1: it now. In this case, the doctor luckily was able
- 15:01Speaker 1: to do enough to where right now that's not necessary
- 15:04Speaker 1: but the future good to Donna explains that she needs
- 15:08Speaker 1: a scooter everywhere that she goes. We do get a
- 15:11Speaker 1: picture Dan of not her exact heel, but of a
- 15:16Speaker 1: of a illustration of what her heel looked like. And
- 15:20Speaker 1: I am going to show this to you now. Oh my,
- 15:23Speaker 1: that's her heel.
- 15:25Speaker 3: That's that. That's her heel. Aeron, that's her heel. You
- 15:30Speaker 3: can't see it.
- 15:31Speaker 1: It's not good.
- 15:33Speaker 3: Basically, her foot is almost cut in half essentially, so
- 15:38Speaker 3: there's lots of surgeries that have already happened.
- 15:43Speaker 2: Medical past.
- 15:44Speaker 1: Yes, exactly right. She has to use a scooter now
- 15:47Speaker 1: everywhere that she goes.
- 15:48Speaker 3: Uh.
- 15:49Speaker 1: Gino asked to see her on her scooter. Henry rolls
- 15:52Speaker 1: his eyes. Can't believe that she's just going to be
- 15:55Speaker 1: riding around in the court room on the scooter to
- 15:57Speaker 1: just prove what it's like. And Gino says, I see
- 16:01Speaker 1: that you're wearing a boot. Can you wear shoes? And
- 16:04Speaker 1: she says no, And I'm not sure that I ever
- 16:06Speaker 1: will be able to. Now the doctor is still there
- 16:09Speaker 1: and explains that it takes about a year before you
- 16:13Speaker 1: can start to put weight on that foot. The scooter
- 16:18Speaker 1: may be a lifetime accessory that she's gonna have to
- 16:21Speaker 1: wear or used to get around, and that she that
- 16:26Speaker 1: she'll never like. It's basically always gonna be with Here's
- 16:29Speaker 1: always gonna be a limp. She's never gonna be able
- 16:32Speaker 1: to wear normal shoes again.
- 16:33Speaker 3: So best case scenario, she limps the rest of your life.
- 16:35Speaker 3: Worst case scooter or take her leg off below me.
- 16:39Speaker 1: Now, he says, you're never gonna be wearing normal shoes again,
- 16:41Speaker 1: to which Henry says, maybe she could wear flats or something. Dude,
- 16:46Speaker 1: what is this guy trying to do? Is he trying money?
- 16:50Speaker 1: Henry's annoyed. Henry's annoyed, and we'll get to why he's
- 16:53Speaker 1: annoyed here in a minute. Gino bangs the gavel, says,
- 16:58Speaker 1: you don't have to be so insensitive you cause this injury.
- 17:02Speaker 1: We're just trying to talk about what the injury is
- 17:04Speaker 1: right now. Uh Gino says, our society puts a lot
- 17:09Speaker 1: of pressure that a woman has to be perfect in
- 17:11Speaker 1: the workplace and she has to look perfect, and I am,
- 17:14Speaker 1: You're still beautiful. But I imagine that this is taking
- 17:17Speaker 1: a toll on you, knowing that you know that this
- 17:20Speaker 1: happened to you. And she says, she explains that she's
- 17:23Speaker 1: in therapy. There's disfigurement, there's scarring that's never gonna go away. Now,
- 17:29Speaker 1: Gino points out, you know you have the past medical expense.
- 17:32Speaker 1: You have one hundred and fifty thousand dollars for future
- 17:34Speaker 1: medical expense. He asked a doctor, is that a reasonable
- 17:39Speaker 1: number to be asking for? And he says, it is
- 17:41Speaker 1: it reasonable? And now, listen, she's not out of the woods.
- 17:45Speaker 1: She likely has more surgeries ahead. And oftentimes with an
- 17:51Speaker 1: injury like this, a patient will seem to be doing
- 17:55Speaker 1: well and then a few years down the road, things
- 17:58Speaker 1: will deteriorate and we up having to do a below
- 18:01Speaker 1: knee amputation.
- 18:02Speaker 2: So why is she only asking for one hundred and
- 18:04Speaker 2: fifty thousand in future.
- 18:05Speaker 1: Medical Because that's how much it's that's a reasonable amount.
- 18:09Speaker 2: Man, I feel like it should be more than.
- 18:11Speaker 1: That, okay, Henry says. Henry says, if they're professionals, they
- 18:16Speaker 1: should be able to save it.
- 18:18Speaker 3: God, I like I man, I'm trying to like Henry
- 18:22Speaker 3: here and it's just not working.
- 18:23Speaker 1: Gino says, Oh, so you're a doctor. He says, no,
- 18:26Speaker 1: but they're professionals.
- 18:27Speaker 2: It's what they do. They should be able to save it.
- 18:30Speaker 1: Gino says, Henry, I know you're passionate about your job
- 18:35Speaker 1: and that you try to do a good job, but
- 18:37Speaker 1: you need to stay in your lane.
- 18:39Speaker 2: You're not a doctor.
- 18:40Speaker 1: Henry explains, I'm not saying that this isn't my fault.
- 18:44Speaker 1: I'm saying that when it comes to doing my job,
- 18:47Speaker 1: I did everything correct. What she was in the wrong
- 18:51Speaker 1: place at the wrong time. She works in a factory.
- 18:55Speaker 1: She sent all of her employees to work. She was
- 18:58Speaker 1: walking backwards in a danger zone. We go over to
- 19:02Speaker 1: the plasma and there is a map of this facility
- 19:06Speaker 1: and the walkway. You know, there's racks and racks of boxes,
- 19:10Speaker 1: and the walkway has you know, the caution stripe on
- 19:14Speaker 1: either side to show you that if you're walking in
- 19:17Speaker 1: this area, you need to be aware of your surrounding
- 19:19Speaker 1: because there's gonna be things going across or down it.
- 19:22Speaker 1: This is called the danger zone of a shipping warehouse.
- 19:25Speaker 2: But she wasn't walking backwards down there.
- 19:27Speaker 3: She was on an aisle and step back into the
- 19:30Speaker 3: oncoming like it was perpendicular.
- 19:32Speaker 1: So according to the map here we see her and
- 19:39Speaker 1: she is she's backed up, and then she's backing this
- 19:42Speaker 1: way down, straight down, zone down, and I'm not entirely
- 19:48Speaker 1: sure she's all. The question also is so he's basically
- 19:52Speaker 1: like she was in the danger zone. She sent everybody away.
- 19:56Speaker 1: You need to be aware of your surroundings, especially if
- 19:58Speaker 1: you're in the danger zone. Uh. Gino asked her if
- 20:02Speaker 1: this is correct, and she says, yes, I was walking
- 20:05Speaker 1: backwards in the danger zone, but the zone was clear
- 20:10Speaker 1: at the time. Now, Gino says this, there's one thing
- 20:13Speaker 1: I know about Forkliss. I don't know much, but it's
- 20:15Speaker 1: that they're loud, and she says, yes, I was wearing
- 20:20Speaker 1: safety earphones at the time because it's loud in the factory. Gino,
- 20:25Speaker 1: she brings the ears phones and he puts them on
- 20:28Speaker 1: and he's like, okay, I can see how you would
- 20:30Speaker 1: not be able to hear that. Henry points out that
- 20:33Speaker 1: everybody was at lunch. Why are you wearing the headphones
- 20:39Speaker 1: while everybody's gone, nobody's doing work. It's not loud in there,
- 20:43Speaker 1: and she didn't have an answer for that, and Gino
- 20:46Speaker 1: is ready to rule.
- 20:48Speaker 3: So here's my issue is that that those are good points.
- 20:52Speaker 3: But Henry is operating in a forklift in a building
- 20:57Speaker 3: he doesn't work in for a company he only works
- 21:01Speaker 3: for through contract work and is not by policy allowed
- 21:05Speaker 3: to do that.
- 21:06Speaker 1: So he's certified, but he is.
- 21:08Speaker 2: At least fifty one percent at fault. He has to be.
- 21:11Speaker 3: He's operating forklift where he doesn't have permission to operate
- 21:15Speaker 3: a forklift. But she's not completely at fault because of
- 21:19Speaker 3: everything else, the headphones, the danger zone, the walking backwards.
- 21:24Speaker 2: Here's what I think. I think.
- 21:25Speaker 3: I think she's gonna get all the money for past
- 21:29Speaker 3: uh and future medical that's four hundred thousand dollars. Of
- 21:33Speaker 3: the other four point six million dollars, I'm gonna give
- 21:43Speaker 3: her one point one million. I'm gonna go one point
- 21:46Speaker 3: one million for the pain and suffering, none for the
- 21:49Speaker 3: starring indismemberment, and I'm gonna go one.
- 21:51Speaker 2: Point five out of the door. That's what I'm going with.
- 21:54Speaker 1: So Gino says to uh to, to what's her name, Donna, Donna, Donna,
- 22:03Speaker 1: you can't be in the danger zone. Even if everybody
- 22:06Speaker 1: is at lunch. You can't be in the danger zone.
- 22:10Speaker 1: But Henry, you came into a facility and you didn't
- 22:14Speaker 1: follow the policy. The policy trumps everything else. You are
- 22:18Speaker 1: one hundred fault. Awards her five million dollars.
- 22:26Speaker 2: No, No, that's unbelievable.
- 22:30Speaker 3: I can't I don't know if I agree with judge
- 22:33Speaker 3: Gino million dollars. This seems she's in the dangers. It
- 22:38Speaker 3: seems like he's just mad at Henry. I feel like
- 22:40Speaker 3: sometimes his judgments are like who he likes more. She
- 22:44Speaker 3: was in the date with headphones on. But I can
- 22:46Speaker 3: understand the frustration.
- 22:47Speaker 1: For the reason why Henry was being a dankle is
- 22:50Speaker 1: because he's frustrated because she's doing all this stuff, getting
- 22:53Speaker 1: all this sympathy, when ultimately she was the one walking
- 22:56Speaker 1: backwards in a danger absolutely gotten.
- 23:00Speaker 2: What would you give her? I would I would I.
- 23:02Speaker 1: Would have gone in your Yeah, similar, And it's just normal.
- 23:06Speaker 2: Gino gets us again.
- 23:08Speaker 1: It's unbelievable that man awarded five point one million dollars
- 23:12Speaker 1: with the swing of a gavel.
- 23:14Speaker 2: Just like that five point one gone Gino does it.
- 23:18Speaker 1: I honestly don't even know how that works, because, like
- 23:20Speaker 1: you know what we know about short the show. So
- 23:24Speaker 1: this network, that's five point one million dollars down on
- 23:27Speaker 1: the hook for I guarantee you.
- 23:28Speaker 2: They have a budget for the year and they just
- 23:30Speaker 2: have to come under it.
- 23:31Speaker 1: So he has to be the most expensive courtroom. Yeah,
- 23:35Speaker 1: that's probably why they don't do it. They do that
- 23:37Speaker 1: show anymore. I don't know who knows that's expensive. That's
- 23:40Speaker 1: an expensive afternoon episodes and episodes call. So we had
- 23:43Speaker 1: a five thousand dollars cap on these other shows, and
- 23:45Speaker 1: he's swinging around five point one million dollars.
- 23:48Speaker 2: Maybe they do have to pay it. I don't know.
- 23:50Speaker 2: I don't know.
- 23:50Speaker 3: That's how you would that's crazy. Yeah, that's Christian insurance
- 23:54Speaker 3: companies involvedople.
- 23:55Speaker 1: We'll try to find out. Yeah, I can hurt you,
- 23:57Speaker 1: you can hurt me.
- 23:58Speaker 2: That will figure it out.
- 23:58Speaker 1: There's millions we did.
- 24:00Speaker 3: Everybody.
- 24:00Speaker 1: Congratulations.
- 24:01Speaker 3: Another gavel is in the book the books, and we
- 24:05Speaker 3: are going to be back next time with another one.
- 24:08Speaker 1: Until then, all rise.
- 24:14Speaker 2: Yo.
