- 0:01SPEAKER_00: I don't know if you remember me of uh doctoring in the exam.
- 0:07SPEAKER_00: Um I think it's a water.
- 0:11SPEAKER_00: Okay.
- 0:11SPEAKER_00: I don't care about you.
- 0:12SPEAKER_00: And then we'll walk over to it.
- 0:14SPEAKER_00: Okay.
- 0:18SPEAKER_00: So we're here at Destiny because um to to talk about uh what happened on Wednesday night.
- 0:25SPEAKER_00: I know that you have other concerns.
- 0:27SPEAKER_00: Um I've read your emails, and so those concerns are uh being addressed by the civil rights compliance officer.
- 0:39SPEAKER_00: Um but so for now this meeting is just about what happened on Wednesday night and how we're gonna move forward.
- 0:47SPEAKER_00: And I want to um let you know that um we never want to suspend students if we don't have to, and we also want always for students to have a successful learning experience.
- 1:04SPEAKER_00: So um I let me see, let me verify facts.
- 1:10SPEAKER_00: Um so what I understand is that you just need got um uh a score that that uh or you were marked down, um, and then you asked um your instructor about it, and then you weren't uh agreeing with the uh score.
- 1:34SPEAKER_00: And um is that correct?
- 1:37SPEAKER_00: Correct.
- 1:38SPEAKER_00: Okay.
- 1:39SPEAKER_00: And then um you you I want you to know you have a right to ask for more information about scores.
- 1:50SPEAKER_00: Absolutely.
- 1:51SPEAKER_00: I want you to know that you have the right to do follow-up um about your scores, but um there's also a time and place, and if it if it's in the middle of class, we can't do too much conversating conversations because what needs to happen is there's still a class going, and so um moving forward, if you've got concerns about your grades, which you might in the future, um then it's okay to do a quick check-in, but also if it's gonna be a more uh a longer conversation, you might want to save your questions for after class or before class um or even through email.
- 2:40SPEAKER_00: Okay, and um uh and then what I think I understood happening is that um is that after you heard the the the um the explanation of your scores, then it it got a little more uh disruptive to the student.
- 3:05SPEAKER_00: That's not true.
- 3:06SPEAKER_00: Not true.
- 3:07SPEAKER_00: That's absolutely not true.
- 3:09SPEAKER_00: Okay.
- 3:10SPEAKER_00: Alright.
- 3:11SPEAKER_00: And so you didn't feel like the way you were behaving was disruptive to the learning?
- 3:17SPEAKER_00: No.
- 3:17SPEAKER_00: I was sent home because I'm black.
- 3:20SPEAKER_00: My paper was written on because I'm black.
- 3:23unknown: The instructor has control issues and she's a racist.
- 3:28SPEAKER_00: I went up to her at 10 o'clock at cleanup time and asked about my grade.
- 3:34SPEAKER_00: Okay, and she said, she told me her lies.
- 3:37SPEAKER_00: She purposely marks my paper because I'm black and she's trying to fail me.
- 3:43SPEAKER_00: I said, I disagree with you, I'm recording you.
- 3:47SPEAKER_00: And I walked away.
- 3:48SPEAKER_00: She came over to my seat and told me to clock out and don't come back on Monday and do not come back until we have a meeting.
- 3:59SPEAKER_00: And when I went up to her to clarify, because I'm trying to make sure that yeah, I'm really getting sent home because I'm black, she told me to get away from her real loud.
- 4:09SPEAKER_00: I was did any of the students say I was being destructive?
- 4:12SPEAKER_00: Because that's not true.
- 4:14SPEAKER_00: I was not being destructive at all.
- 4:16SPEAKER_00: Okay, I haven't talked to any of the students.
- 4:18SPEAKER_00: And when I asked Miss Larry about my grade, Miss Larry didn't send me home.
- 4:23SPEAKER_01: Uh-huh.
- 4:24SPEAKER_00: Miss Larry didn't send any of the students home.
- 4:27SPEAKER_00: Uh-huh.
- 4:27SPEAKER_00: She talked about it very clear.
- 4:29SPEAKER_00: So it was 10 o'clock.
- 4:31SPEAKER_00: Okay.
- 4:32SPEAKER_00: So thank you for sharing your perspective, and thank you also for uh letting me know.
- 4:37SPEAKER_00: I know that there's, you know, heat and uh not uh not everyone is um on the same page.
- 4:48SPEAKER_00: So um can we make a plan moving forward that if you're gonna ask about a grade that you either do it um before class, after class, or in the email?
- 5:04SPEAKER_00: I want to not be deducted points for being black.
- 5:08SPEAKER_00: I want to not be sent home for being black.
- 5:12SPEAKER_00: She pays extra close attention and discriminating.
- 5:17SPEAKER_00: Did you read the notes from the other students?
- 5:19SPEAKER_00: She pays extra close attention in harassing me.
- 5:24SPEAKER_00: But when it comes to the other students, she's trying to be their friend, trying to be their girlfriend.
- 5:30SPEAKER_00: Like she's telling the other students, oh, you have nice lips, you have nice eyelashes, walking around taking their cotton rounds off.
- 5:38SPEAKER_00: See, I don't have an issue.
- 5:39SPEAKER_00: I've said from day one that I'm here to learn how to become a barber.
- 5:44SPEAKER_00: I help all the students.
- 5:46SPEAKER_00: She wants to send the students home for not having their supplies.
- 5:50SPEAKER_00: She doesn't even have her supplies.
- 5:53SPEAKER_00: So you know, so I don't I don't have an issue.
- 5:55SPEAKER_00: I'm just here to learn.
- 5:57SPEAKER_00: So if somebody's gonna put lies on my paper, I'm gonna bring it to their attention.
- 6:01SPEAKER_00: But I've already reported her to the state board and so on.
- 6:04SPEAKER_00: So every time she puts a lie on my paper, I don't have to say nothing.
- 6:08SPEAKER_00: I'll just take it to the board.
- 6:10SPEAKER_00: All right, so you have that right, and um, and I want you to know that your instructor has the right that if she feels like class is being disrupted, she has the right to suspension.
- 6:22SPEAKER_00: I was class being disrupted when I walked up to her, the class is clean, that it was 10 o'clock, it was just me and her, and I was standing next to her, and I said, What's I the students couldn't even hear.
- 6:35SPEAKER_00: So I don't know if you understand that she is lying and she did it on purpose.
- 6:41SPEAKER_00: So I'm being sent home because I'm black and she's a racist that hates me.
- 6:45SPEAKER_00: I'm not being sent home because I'm disruptive, because I was not disruptive.
- 6:49SPEAKER_00: Okay, and I think there's a difference of opinion because we definitely it has been reported by your instructor that you were disruptive.
- 6:59SPEAKER_00: Alright?
- 7:00SPEAKER_00: So I want you to know that it is absolutely your right to question your scores and question your grade, but it can't be disrupting the class.
- 7:12SPEAKER_00: So, what's the consequence when you guys find out that the instructor was lying and I wasn't being disrupted?
- 7:20SPEAKER_00: And that there's a that will happen, but it won't happen at this meeting right now.
- 7:26SPEAKER_00: Okay, what's your name again?
- 7:27SPEAKER_00: I'm sure you're what's your position?
- 7:29SPEAKER_00: I am the dean of career and technical.
- 7:31SPEAKER_00: Okay, so when you when you texted me over there, you didn't tell me you were the dean.
- 7:36SPEAKER_00: I thought you worked for the disability department.
- 7:39SPEAKER_00: No, I was just helping because there was no one at the DRC.
- 7:42SPEAKER_00: Oh, they didn't tell me that.
- 7:43SPEAKER_00: They told me that you worked for the disability department, so I don't like that.
- 7:47SPEAKER_00: Oh, well, that wasn't it wasn't meant to be a tricky.
- 7:50SPEAKER_00: I was just trying to help get you through that exam.
- 7:55SPEAKER_00: Especially because there was no one to do it.
- 7:59SPEAKER_00: No, they told me that somebody was coming from you, that you didn't introduce yourself as the dean.
- 8:04SPEAKER_00: Okay.
- 8:05SPEAKER_00: Well, I introduced myself with Sherry.
- 8:07SPEAKER_00: That's how I introduced you.
- 8:09SPEAKER_00: I'm telling you, the dean today.
- 8:10SPEAKER_00: I'm the dean.
- 8:11unknown: Okay.
- 8:12SPEAKER_00: Alright, and I am in charge of um the cosmetology is one of the many programs under my my belt.
- 8:20SPEAKER_00: So, um, so my goal is for you to get successfully through this program.
- 8:26SPEAKER_00: I want you to become a practitioner, I want you to become a barber, I want you to get your license, and I want you to live a happy, fulfilling dream of a life.
- 8:37SPEAKER_00: Um, I want to support everybody here, and um, and I want us to six, I want you to successfully get back into class tonight and be successful.
- 8:52SPEAKER_00: Um so one thing that that I I want to offer to you is that you have the right to question your scores, but I need you to do it in a um professional way, or wait till after class, well, still professional, after class, before class, or um through email.
- 9:17SPEAKER_00: Do you agree to that?
- 9:18SPEAKER_00: I'm very professional.
- 9:20SPEAKER_00: I've never been unprofessional.
- 9:22SPEAKER_00: I've been through a lot, and everybody knows I've done an amazing job keeping myself together after I have to be discriminated against on a daily basis.
- 9:34SPEAKER_00: Okay, so I don't have an issue with this area.
- 9:37SPEAKER_00: Okay, okay.
- 9:38SPEAKER_00: But what about are you agreeing that I agree, but I'm not doing anything.
- 9:43SPEAKER_00: Okay, I haven't done anything wrong.
- 9:45SPEAKER_00: So you are repeating to me what of someone that said that's not telling the truth on me.
- 9:50SPEAKER_00: And I don't like that.
- 9:51SPEAKER_00: I understand.
- 9:52SPEAKER_00: Um, also, when it comes to uh part of the classroom assignments, I know you've been bringing your daughters to work on as a model, and I like that, and you have the right to do that.
- 10:03SPEAKER_00: We've added that through the DRC.
- 10:06SPEAKER_00: Um, but the piece that you're missing of the learning opportunity is for someone to work on you, or that you are getting the services, the pair share, and it's called pair share in Cosmo.
- 10:22SPEAKER_00: So is there a student that you can um allow that you would be willing to allow to work on you as um the part of the pair share?
- 10:34SPEAKER_00: You can still work with your daughters, but can you work?
- 10:38SPEAKER_00: Is there a student that could do the face to do a facial that you would feel comfortable with sharing, parent sharing?
- 10:48SPEAKER_00: And a student or two that that you would be willing to.
- 10:52SPEAKER_00: I have a note that says I can bring my kids.
- 10:54SPEAKER_00: That's what I'm saying, absolutely.
- 10:56SPEAKER_00: I said that's absolutely okay.
- 10:57SPEAKER_00: What I'm wondering is who can do the activity to you.
- 11:03SPEAKER_00: So, like, and I don't know what I'm talking about, so you guys help me.
- 11:07SPEAKER_00: But let's say I'm gonna get my face washed.
- 11:10SPEAKER_00: Okay.
- 11:11SPEAKER_00: It's one thing for me to wash your face.
- 11:14SPEAKER_00: But it's an important element of education too.
- 11:16SPEAKER_00: What it feels like also So somebody has to do it to me.
- 11:19SPEAKER_00: So you're you can do it to your daughters, that's great.
- 11:22SPEAKER_00: Who's gonna do it to you?
- 11:24SPEAKER_00: I have to bring in my daughter because nobody's allowed to do it to me.
- 11:28SPEAKER_00: That's why they said I have to bring in my daughter.
- 11:31SPEAKER_00: The daughters, your daughters are used as a model, but someone you're missing a learning opportunity that needs to do it to you.
- 11:39SPEAKER_00: So you're just gonna say that to me, it's not in the paperwork to me.
- 11:43SPEAKER_00: Okay, so want me to contact DRC and and um clarify that?
- 11:50SPEAKER_00: I brought it to DRC's attention because the cosmetology department has if a student can't touch me, I can't touch them.
- 12:00SPEAKER_00: So that's why I have that's why I bring my daughter.
- 12:03SPEAKER_00: Is that a thing?
- 12:04SPEAKER_00: It is a thing.
- 12:05SPEAKER_00: We were just wondering for educational purposes if you'd be willing comfortable just just for educational purposes to expand your learning.
- 12:14SPEAKER_00: Are you willing to have someone help you?
- 12:17SPEAKER_00: Someone who helped us, I'll let you know.
- 12:20SPEAKER_00: Okay, and you know what?
- 12:21SPEAKER_00: That is a very fair answer.
- 12:23SPEAKER_00: Yes.
- 12:23SPEAKER_00: Because you might want to think about who you would choose.
- 12:27SPEAKER_00: Alright?
- 12:27SPEAKER_00: So, what let me just repeat again what I'm saying is that you I want you to continue, if you want to, bring your daughters as a model.
- 12:36SPEAKER_00: But what we need to also have happen is for you to be worked on as well in whatever way you guys are.
- 12:47SPEAKER_00: That's it.
- 12:48SPEAKER_00: Okay, and then you're gonna get back to us on who you're gonna choose in the class.
- 12:53SPEAKER_00: It could be another student, of course.
- 12:56SPEAKER_00: But because it can't be your daughter because she doesn't know what to do.
- 13:00SPEAKER_00: You know what I mean?
- 13:02SPEAKER_00: Yeah, but it excuses if I I'm gonna let a student actually I'm not gonna bring my daughter in.
- 13:08SPEAKER_00: Yeah, then you that's fine.
- 13:11SPEAKER_00: So then what you would do is you would work on the other student, and then the student would work on you.
- 13:19unknown: Right?
- 13:20unknown: That's that's correct.
- 13:21SPEAKER_00: Um, but if they do have an accommodation to have a model, but if you are willing for educational purposes, because it's a very important idea of skincare, knowing what something feels like, so you're able to communicate that to others.
- 13:34SPEAKER_00: So you have an accommodation and you can bring in a model.
- 13:37SPEAKER_00: Yeah, because no one's supposed to be touching it because it makes me feel uncomfortable.
- 13:42SPEAKER_00: But that's okay, but that's you working on them.
- 13:48SPEAKER_00: No, it's for people not to touch me, people not to touch you.
- 13:52SPEAKER_00: Okay.
- 13:54SPEAKER_00: Okay.
- 13:55SPEAKER_00: So I do need to clarify that with DRC because um, it was only brought to their detention because in the cosmology rules, it says that the students didn't have an issue with me touching them.
- 14:15SPEAKER_00: They said that if I couldn't let the students touch me, then I had to bring the model, so that's why I bring my kids in.
- 14:21SPEAKER_00: So you're uncomfortable having people touch you, correct?
- 14:25SPEAKER_00: So what but uh so I'm worried that you're missing out on a learning opportunity.
- 14:32SPEAKER_00: Like, um, if I'm gonna get a facial, it's very sensorial, right?
- 14:38SPEAKER_00: I I want to feel that so that I know how my future clients are gonna feel.
- 14:45SPEAKER_00: And and uh I think that's what we're talking about.
- 14:50SPEAKER_00: But I do want you to think about it and I want you to decide if there's someone in class that you would trust and want that to happen.
- 14:58SPEAKER_00: Not want.
- 14:59SPEAKER_00: Be okay with because you don't want to be touched, and then I will check with Dr.
- 15:06SPEAKER_00: Starr and DRC to see if that's part of the accommodation.
- 15:10SPEAKER_00: But I didn't know that piece about if you bring in a model.
- 15:15SPEAKER_00: There is a closer indication, a reason that um they can bring in a model, and so we just worry about the educational opportunity and knowing what something feels like being able to explain it to future clients.
- 15:27SPEAKER_00: That's a really important element of education.
- 15:30SPEAKER_00: So just to if you are willing, if you are comfortable.
- 15:34SPEAKER_00: And it sounds like you might not be and this is my first client worrying about this.
- 15:39SPEAKER_00: Okay, so I want you to think about it, process it, and let us know.
- 15:44SPEAKER_00: And what I'm gonna do is I'm gonna send you an email after this meeting just for the things that we talked about, um and um uh of what was um agreed upon.
- 15:59SPEAKER_00: So is there one thing I I want you to know is that I I need um you to know that um your instructor does have the right, if she feels like class is being disrupted, that she can suspend you again.
- 16:20SPEAKER_00: And then we would have to meet again before you're allowed to come back.
- 16:25SPEAKER_00: So I can go into class right now and she can lie on me like she did last time, and then I would be sent home.
- 16:33SPEAKER_00: And I put in my email that I would be taking a lie detector test.
- 16:36SPEAKER_00: So when my lie and lie detector tests are admissible in court, so when I have a lie detector test that says that the teacher sent me home and I was not being destructive, then I've lost hours in a grade.
- 16:50SPEAKER_00: Like so, you know, and you have an instructor putting everybody's life in everybody's job in the whole department at risk.
- 17:00SPEAKER_00: Yeah, we also have a student conduct policy.
- 17:04SPEAKER_00: Yeah, but I'm not doing anything wrong.
- 17:06SPEAKER_00: But I wonder if you're not realizing it.
- 17:09SPEAKER_00: No, because I went up to her respectfully, and when she told me, I said I disagree, and I said I'm gonna report you.
- 17:16SPEAKER_01: Okay.
- 17:16SPEAKER_00: And I have the right to say that.
- 17:18SPEAKER_00: And then you have the right to say that when you walk back, did it get loud?
- 17:22SPEAKER_00: No.
- 17:23SPEAKER_00: She came up to me.
- 17:24SPEAKER_00: See, I come let them say something.
- 17:26SPEAKER_00: I live a great life.
- 17:28SPEAKER_00: I don't have problems.
- 17:30SPEAKER_00: This is my only problem here.
- 17:32SPEAKER_00: I come to her hacky, I help all the students, I make sure they don't get sent home, I help them, they can talk to me and ask me anything.
- 17:41SPEAKER_00: And then I have the instructor paying extra close attention and being racist towards me, and I've handled the situation very well.
- 17:50SPEAKER_00: So she's she's sitting right here under the impression that she's gonna continue to send me home and get away with it.
- 17:58SPEAKER_00: And it's never gonna happen.
- 18:00SPEAKER_00: Like if I decided I'm not gonna come to this school anymore, she's still not gonna get away with being racist to me.
- 18:07unknown: Okay.
- 18:08SPEAKER_00: She's not gonna get away with it.
- 18:09SPEAKER_00: I thought I reported it to the board and in the California.
- 18:13SPEAKER_00: Okay.
- 18:14SPEAKER_00: And we're gonna let that process play out like I can address that.
- 18:18SPEAKER_00: That's not where I'm but you're telling me, like, I don't have a line problem.
- 18:25SPEAKER_00: My credibility is excellent.
- 18:28SPEAKER_00: Okay.
- 18:28SPEAKER_00: So I come here.
- 18:30SPEAKER_00: I'm trying to explain to you.
- 18:32SPEAKER_00: Yeah, but you're telling me that she's saying I'm being destructive, and I'm telling you that it's not true.
- 18:36SPEAKER_00: Black people in there right now, and she could send me home right now and pretend I'm being destructive.
- 18:43SPEAKER_00: And then what would we as a bit?
- 18:45SPEAKER_00: And we're gonna have more conversations.
- 18:48SPEAKER_00: And that piece you probably won't hear about or know about because that would be a personal issue, but you're going to continue to uh report what you feel is justified, and and uh you have a pathway forward, the the investigation or reports that you're making is with the the compliance officers that you're working with at the district.
- 19:17SPEAKER_00: That's aside from what's happening here.
- 19:20SPEAKER_00: What was happening here is just about Wednesday night, and I I just want you to know and that the instructors do have a right to do that.
- 19:30SPEAKER_00: So I want to not have this happen again.
- 19:34SPEAKER_00: But you want to keep doing it.
- 19:36SPEAKER_00: I don't know making it up.
- 19:38SPEAKER_00: Like I I totally understand what you're saying, like an instructor has a right, but instructors who are not racist send students home for doing something.
- 19:46SPEAKER_00: I'm being sent home because I'm black.
- 19:48SPEAKER_00: And I'm always gonna be black.
- 19:49SPEAKER_00: I love being black.
- 19:55SPEAKER_00: So in yeah, so it sounds like you're clear on on what she can do as part of her job, and then what you can do in reaction to that, um, and um is stay calm, like you're saying you are, stay professional, put it in writing, and continue on with your recording.
- 20:23SPEAKER_00: I I I I do feel like there are times where there are situations if I get a a score I'm not happy with, I might want to argue it, and I might want to um, I don't argue with people.
- 20:41SPEAKER_00: Okay.
- 20:42SPEAKER_00: I'm 40 years old and I'm an adult.
- 20:44SPEAKER_00: And so I said, she, when I tell her I disagree, she goes back and forth.
- 20:49SPEAKER_00: Running three for the other students will tell her that she doesn't like her grade.
- 20:54SPEAKER_00: Remind you, I we can be a lecture, so I have accommodations to record notes.
- 21:00SPEAKER_00: I have her on recording, going back with the other students, and she doesn't call them disjustice.
- 21:07SPEAKER_00: But I walked up to her very respectfully and said, What asked her about my grade, she explained it to me.
- 21:13SPEAKER_00: I said, I disagree on recording and walked away.
- 21:16SPEAKER_00: But her and the students will go back and forth and she'll have an attitude.
- 21:19SPEAKER_00: I have it on recording, and none of those students get sent home, but I get sent home.
- 21:25SPEAKER_00: See, that's the problem, and that's what they're gonna go to investigate and see.
- 21:28SPEAKER_00: Okay, because I have a lot of proof.
- 21:30SPEAKER_00: Okay, alrighty.
- 21:32SPEAKER_00: Um, so it sounds like what you're saying is you're doing everything right.
- 21:38SPEAKER_00: Correct.
- 21:38SPEAKER_00: Okay.
- 21:39SPEAKER_00: And um, and what I'm telling you is if it's if the instructor has a right, if she's feeling like your perspective isn't the same as hers, and that you're disrupting, she's going to clock you out and send you home.
- 21:56SPEAKER_00: Okay, and that's fine, and I'm going to report her.
- 21:58SPEAKER_00: That's good.
- 21:59SPEAKER_00: But she's wrong.
- 22:01SPEAKER_00: So when do we discuss so you she's telling you guys something and you guys are believing her, and then pretty soon it's gonna be out that she was not telling the truth.
- 22:14SPEAKER_00: So, what you guys can do when you guys learn that she's not been telling the truth this whole time, and she's just single in and not because I'm black, and I have recordings and I have witnesses of my kids and all that.
- 22:24SPEAKER_00: That's why remember, I gave the information to the school.
- 22:28SPEAKER_00: I had enough information for them to go through with it.
- 22:32SPEAKER_00: If I had no information, the school wouldn't even have put it through.
- 22:35SPEAKER_00: But the school put it through, they put it through to the investigator because I'm not lying.
- 22:41SPEAKER_00: And that I can't speak to I can't speak to the investigation, I can't speak to what we would do or not do if the investigation was found to be valid.
- 22:51SPEAKER_00: Um right now, all I know is um there's an investigation going on.

- 23:07SPEAKER_00: And I keep telling her, I keep telling her I don't play games, I keep telling her I have a very strong support system, I keep telling her that I'm very vocal, I don't allow people to pose my voice, that I will be reporting her, like I'm crystal clear, and she just keeps putting it on.
- 23:24SPEAKER_00: She doesn't care.
- 23:25SPEAKER_00: She does it in front of my kids, she does it in front of the other students, and I don't deserve it.

- 23:45SPEAKER_00: That's not.

- 25:50SPEAKER_00: God already told me that what's gonna happen.
- 25:53SPEAKER_00: So she could send me home every day, she could fail me.
