- 0:00Speaker 1: Oh, who are the people in your neighborhood?
- 0:05Speaker 2: In your neighborhood, In your.
- 0:07Speaker 3: Neighborhood, say who are the people in your neighborhood, the
- 0:12Speaker 3: people that.
- 0:13Speaker 4: You meet each day.
- 0:16Speaker 5: Yes, one of the people you might meet in your
- 0:18Speaker 5: neighborhood is Wade Taylor, attorney at law, family law, divorce law,
- 0:24Speaker 5: and one of the principles of the Salt Mediation Group.
- 0:29Speaker 5: And we're going to talk about divorce and mediation and
- 0:33Speaker 5: other family law related questions.
- 0:35Speaker 3: I suppose to absolutely. How are you, Wade? I'm doing well.
- 0:39Speaker 3: That was a song from when I first came on
- 0:41Speaker 3: That was amazing.
- 0:43Speaker 5: Was that the first time we met you, wasn't it?
- 0:45Speaker 3: Yeah, back in the old studio years and years ago?
- 0:48Speaker 5: So you I think you were. You listened to the
- 0:51Speaker 5: show and knew that we did this feature and thought, Hey,
- 0:54Speaker 5: would you like to talk to an attorney?
- 0:56Speaker 3: And yeah, I did. I reached out and you guys
- 0:58Speaker 3: invited me over and that was that.
- 1:01Speaker 5: And it's been made and I was expecting a loaf
- 1:07Speaker 5: of it is coming.
- 1:09Speaker 3: I made some. I had to make some for my
- 1:11Speaker 3: kids sandwiches first, and so I just didn't have time.
- 1:14Speaker 5: Sour Wayne has gotten into sourdough.
- 1:17Speaker 4: Oh really delicious.
- 1:18Speaker 6: So when we're talking family lots, it's divorce and what
- 1:22Speaker 6: what else falls under the family Just giving people.
- 1:24Speaker 3: Ideas of what to call about divorce, custody, parent time,
- 1:28Speaker 3: child support, anything, you know, property division, any of those
- 1:32Speaker 3: type of issues is what we deal with in family law,
- 1:36Speaker 3: last Will and testament. We do a state work too.
- 1:39Speaker 3: I've had the opportunity to do some with people around
- 1:43Speaker 3: all over the state and litigated those cases, some of
- 1:45Speaker 3: the people in this room and some of the people
- 1:47Speaker 3: in this room.
- 1:48Speaker 5: So let's go we already Okay, let's go to Jeanine. Hi, Janine,
- 1:56Speaker 5: how are you today? Doing good? Okay? What's your question
- 2:01Speaker 5: for mister Taylor?
- 2:04Speaker 7: I have my son. His wife took his daughter out
- 2:08Speaker 7: of state without his permission, and he's been working on
- 2:13Speaker 7: the last month filing orders trying to get her back.
- 2:17Speaker 7: He's filed a tro and that was denied, temporary restraining order,
- 2:24Speaker 7: thank you, And he's also filed an appeal to that
- 2:29Speaker 7: temporary restraining order and we're waiting on we don't know
- 2:34Speaker 7: why we're waiting on the appeal. He has a do
- 2:37Speaker 7: we have to wait? What do we have to wait for?
- 2:40Speaker 7: Is my big question.
- 2:42Speaker 5: Let's let's go with that.
- 2:43Speaker 3: First, you're gonna have to wait for the court. I mean,
- 2:46Speaker 3: that's the reality on any tro is an immediate order,
- 2:50Speaker 3: and if you're appealing it, you're going to be taking
- 2:52Speaker 3: it up to the judge, and you're looking at their timeline.
- 2:56Speaker 3: So he may schedule it quickly, he may schedule it
- 2:58Speaker 3: out a bit. But once the initial is denied, then
- 3:02Speaker 3: you have to wait for a hearing before the judge itself.
- 3:04Speaker 3: So that's what you're waiting on. And the courts are
- 3:07Speaker 3: and the courts are overburdened, Yeah, they are, and they're
- 3:10Speaker 3: not quick at getting anything in. If they find that
- 3:12Speaker 3: the immediate order is denied, then they'll take their time
- 3:15Speaker 3: in getting it scheduled. But that's sounds like he's doing
- 3:18Speaker 3: what he should be to address the situation.
- 3:21Speaker 7: All right, all right, thanks for the help.
- 3:24Speaker 5: All right, I wish there was a better answer. Yeah. Sorry,
- 3:28Speaker 5: Let's go to Aaron. Hi, Aaron, where are you calling from?
- 3:33Speaker 1: I'm calling from what Jordan?
- 3:34Speaker 5: Okay, what's your question for Wade Taylor?
- 3:38Speaker 1: Just this last week, I was granted a full protective
- 3:41Speaker 1: order for my daughter after four months of a temporary
- 3:46Speaker 1: protective order. So I understand I have one hundred and
- 3:48Speaker 1: fifty days of that. My question is is what are
- 3:51Speaker 1: my next steps to change the custody agreement and my
- 3:56Speaker 1: divorce decreed. That way my daughter can then live with
- 3:59Speaker 1: me full time and not be anywhere near her mother.
- 4:03Speaker 3: And that's a good question. You have two options. One
- 4:06Speaker 3: is you can file a petition to modify and litigate it.
- 4:09Speaker 3: The other option, and which you're going to have to
- 4:12Speaker 3: do anyway, is to sit down and try and mediate
- 4:14Speaker 3: it out. You will need to file that petition to modify,
- 4:18Speaker 3: But then I would say, go sit down with a mediator,
- 4:21Speaker 3: see if you guys can reach your resolution. But within
- 4:23Speaker 3: that one hundred and fifty days, you do have to
- 4:25Speaker 3: file that petition prior to the one hundred and fifty
- 4:28Speaker 3: days being up and getting some temporary orders in place
- 4:31Speaker 3: or mediating to an agreement.
- 4:32Speaker 5: And Aaron I would just point out we just had
- 4:34Speaker 5: a text or text in and say I use Salt
- 4:37Speaker 5: mediation for my divorce and subsequent odro qdro and had
- 4:43Speaker 5: a great experience. It was wonderful to work with Marie
- 4:48Speaker 5: somebody named Marie, So try try that. So try mediation,
- 4:53Speaker 5: and I might suggest Salt mediation. Okay, erin all.
- 4:57Speaker 1: Right, so good. I appreciate thank you, yeah, thank you.
- 5:00Speaker 5: All right.
- 5:00Speaker 4: People are lining up with their questions.
- 5:02Speaker 5: Back with Wade Taylor. There are questions of plenty here
- 5:06Speaker 5: for Waye Taylor. He's a divorced attorney. It's family law,
- 5:10Speaker 5: mediation and law. But if you would allow me before
- 5:13Speaker 5: you go to the phone, just one personal question about
- 5:15Speaker 5: this you bet for me? Where'd you get your sour dough? Starter?
- 5:19Speaker 3: I can give you some of my sour I got
- 5:21Speaker 3: it from another friend. Yeah, and it just seems to
- 5:24Speaker 3: people pass it around. It's like some type of viral disease.
- 5:27Speaker 3: I just pass it around.
- 5:28Speaker 5: So that's an important question from me. All right, let's
- 5:31Speaker 5: get to the phones. Then let's go to Jason. Hello Jason, Jason,
- 5:36Speaker 5: where are you calling from? Okay? What's your question? I
- 5:42Speaker 5: kind a question about cohabitation.
- 5:43Speaker 3: Like, I know my ax is living off and on
- 5:46Speaker 3: with her fiance right now, but I don't know what
- 5:49Speaker 3: it takes to prove cohabitation in the courts. So the question,
- 5:53Speaker 3: just so everybody else knows, relates to spousal support. If
- 5:57Speaker 3: someone is cohabitating, you typically can terminate support. Uh, it's
- 6:02Speaker 3: a lot of factors. Usually most people admit that they're
- 6:05Speaker 3: having a sexual relationship, but it's the living together. If
- 6:09Speaker 3: they have a separate residence, that is hard to prove
- 6:12Speaker 3: that they're actually cohabitating rather than just hanging out and
- 6:16Speaker 3: staying over while they're there. So that's going to be
- 6:18Speaker 3: your key is showing that that is their primary residence.
- 6:22Speaker 3: So it's just a fact intensive analysis of that portion.
- 6:25Speaker 3: So okay, continue to look into it and flat out asker.
- 6:29Speaker 3: I guess all right, all right, thank you later.
- 6:33Speaker 5: Let's go to Milo. Hello Milo, Hi guys, Hey, what's
- 6:37Speaker 5: your question? Milo?
- 6:39Speaker 8: I have a question for one of my friends. He
- 6:41Speaker 8: said that he and his kid's mom were separate for
- 6:43Speaker 8: a while and they got back together, but he said,
- 6:47Speaker 8: is act at the time put you out support and
- 6:50Speaker 8: now they are both in agreement to try to remove it,
- 6:52Speaker 8: but they don't know how to do that.
- 6:55Speaker 3: If they did it through OARS, which is the Office
- 6:59Speaker 3: of Avery Services, they just simply need to cancel the
- 7:04Speaker 3: case and that will actually cancel it. If they went
- 7:08Speaker 3: through the court system, then they actually need to go
- 7:11Speaker 3: through and get an order canceling it. But most likely
- 7:15Speaker 3: if there's no custody in parent time, orders. It was
- 7:17Speaker 3: done through the Office of Recovery Services, and they just
- 7:20Speaker 3: need to cancel the case with them.
- 7:21Speaker 5: That's pretty easy to do.
- 7:22Speaker 3: Yeah, it is. They just need to reach out to
- 7:24Speaker 3: them together. It's typically the one receiving the child sport
- 7:27Speaker 3: that can close the case.
- 7:28Speaker 8: All right, there you go, Okay, awesome, Thank you appreciate it.
- 7:32Speaker 4: Thank you very much.
- 7:33Speaker 5: Kimberly, Hi, Hey, Hey, where are you Kimberly? Where are you?
- 7:39Speaker 6: Hi?
- 7:39Speaker 5: Where are you going from?
- 7:42Speaker 9: Uh, well, downtown, I'm heading to work.
- 7:44Speaker 5: Okay, what what's what's your question for Wade?
- 7:48Speaker 10: So I was wondering, what's the next step.
- 7:50Speaker 9: I've gotten a judgment in a child support case where
- 7:54Speaker 9: there's a lot of arrears, and how do you collect
- 7:57Speaker 9: on that judgment? What do you need to file to
- 7:59Speaker 9: get the plus start of actually garnishing or starting executive you.
- 8:03Speaker 5: Find the biggest, meanest looking guy you can find.
- 8:06Speaker 3: Yeah, that is the hardest thing, because, as any any
- 8:09Speaker 3: lawyer will tell you, a judgment is a piece of
- 8:11Speaker 3: paper until you can actually collect on it. You'll need
- 8:14Speaker 3: to go in and get an order of garnishment from
- 8:16Speaker 3: the court that will allow you to bring him in.
- 8:21Speaker 3: You can collect on his bank accounts, but you need
- 8:24Speaker 3: to file a motion with the court to force him
- 8:26Speaker 3: to come in and then you can identify what assets
- 8:29Speaker 3: you can go after and get an order of garnishment
- 8:32Speaker 3: to be able to take it over to a bank
- 8:34Speaker 3: account or a bank. But you are faced with the
- 8:37Speaker 3: most difficult thing. If ors can't collect it for you
- 8:40Speaker 3: again the Office of Recovery Services, then you do have
- 8:43Speaker 3: to go through the court.
- 8:45Speaker 10: Okay, yeah, I mean that's the issue that I'm having.
- 8:48Speaker 10: So if you have an order from the court, you
- 8:50Speaker 10: obviously have to know the information of the other party,
- 8:53Speaker 10: like their bank or what you can collect on correct.
- 8:56Speaker 3: Yeah, And that's where you need to file a motion
- 8:58Speaker 3: to have him appear.
- 9:00Speaker 6: Or he'll be compelled to turn over that information.
- 9:03Speaker 3: Yes, then he's required to turn over that information, but
- 9:06Speaker 3: you may need to have an attorney involved for that.
- 9:08Speaker 3: It's actually collecting on judgments is a lot more difficult
- 9:11Speaker 3: than people think.
- 9:12Speaker 5: Or if you find a really big looking.
- 9:15Speaker 6: Guy bill.
- 9:22Speaker 5: All right, all right. You have questions about mediation of
- 9:28Speaker 5: a lot of these A lot of these things that
- 9:30Speaker 5: people are calling about it could have been just done
- 9:33Speaker 5: away with if they've gone through mediator.
- 9:35Speaker 3: Yeah, and a lot of them actually, we do deal
- 9:37Speaker 3: with a lot of post judgment issues. When you talked
- 9:39Speaker 3: about that q d R oh, that's a retirement order, and
- 9:42Speaker 3: we do also prepare retirement orders for people to be
- 9:45Speaker 3: able to submit them to the court and split them up.
- 9:47Speaker 3: But when you have a post judgment or a post
- 9:50Speaker 3: divorce issue, a lot of people will come in and
- 9:53Speaker 3: mediate them and just see if they can work out
- 9:55Speaker 3: a resolution, because there are situations where even if it's
- 9:59Speaker 3: child support and you're find twenty thirty thousand, you may
- 10:01Speaker 3: be able to negotiate something with the other side so
- 10:04Speaker 3: that both people come out of it. They may not
- 10:07Speaker 3: be exactly happy, but they'll come out with winning in
- 10:10Speaker 3: a situation through mediation.
- 10:13Speaker 5: Loreen is here. Hi there, Loreen, where are you?
- 10:17Speaker 2: I'm in mind?
- 10:19Speaker 5: Okay, I'll go ahead.
- 10:21Speaker 2: Yeah. So I have a question about child support and
- 10:27Speaker 2: the father of my child is in Texas. So I
- 10:30Speaker 2: feel like it's been really, really hard to get anything
- 10:34Speaker 2: moving to oors. I have received random payments here and there,
- 10:39Speaker 2: and I believe it's simply because when he gets to
- 10:43Speaker 2: a certain amount that he owes, he risks facing jail
- 10:47Speaker 2: time or possibly having his driver's license revoked and he's
- 10:52Speaker 2: a truck driver, so that wouldn't be good. So my
- 10:55Speaker 2: question really is do I is it better to just
- 10:58Speaker 2: get a lawyer since he's in another state, or is
- 11:01Speaker 2: that something ORS actually is going to continue to pursue.
- 11:07Speaker 3: Well, the difficulty you face is he's in another state.
- 11:11Speaker 3: I mean, you can get a OORS will do the judgment,
- 11:14Speaker 3: but they still have to work with the department in
- 11:18Speaker 3: Texas the collects child support, and so you're relying on
- 11:21Speaker 3: two different administrative organizations and it's never that effective. So
- 11:28Speaker 3: you can get the judgment, an attorney can come in
- 11:30Speaker 3: and get a judgment, but even then you'd have to
- 11:33Speaker 3: hire an attorney down in Texas to enforce the judgment.
- 11:36Speaker 3: And so you may want to work with OORS for
- 11:38Speaker 3: a little bit longer and then if you don't feel
- 11:41Speaker 3: like that's working out, contact an attorney.
- 11:44Speaker 2: Okay, So it would be better to contact an attorney
- 11:46Speaker 2: in Texas.
- 11:48Speaker 3: Yeah, because if you if OS Yeah, if OORS has
- 11:51Speaker 3: already obtained a judgment, then you can register it in
- 11:55Speaker 3: Texas and enforce it there.
- 11:56Speaker 5: Does the Office of Recovery Services make any recommends, like
- 12:00Speaker 5: if you need an attorney in Texas? They don't.
- 12:04Speaker 3: No, I don't think they'll know anybody down there. You'll
- 12:06Speaker 3: just have to find someone that does family law or
- 12:08Speaker 3: someone that can collect on a judgment down there.
- 12:10Speaker 5: Or you could hire a really big mean.
- 12:15Speaker 4: Bill and a cowboy hat and swim over to your
- 12:18Speaker 4: ex's house and say, all right, thanks Loreen Siah, thank you.
- 12:23Speaker 5: Let's go to Damien. Hello, Damien, Hello, Hey, where are
- 12:28Speaker 5: you calling from? Damien? American Fork? Okay, and what's your question?
- 12:34Speaker 5: My question is is I just need a clarification on
- 12:39Speaker 5: a child's age when they can decide which parent they
- 12:42Speaker 5: want to be with.
- 12:45Speaker 3: That is well, there's a lot of laura around that,
- 12:49Speaker 3: and really what it says in the statute is when
- 12:51Speaker 3: a child is fourteen years of age, the court will
- 12:55Speaker 3: give them their opinion greater weight. A child doesn't ever
- 12:58Speaker 3: get to decide where they live, but I do tell
- 13:00Speaker 3: parties as kids get older, that's the time. If a
- 13:03Speaker 3: child is expressing something, go sit down with a mediator
- 13:07Speaker 3: see if you can figure out what's going to be
- 13:08Speaker 3: the best schedule for that child, because at that point
- 13:12Speaker 3: in time, once they get to fourteen, fifteen, sixteen, it's
- 13:15Speaker 3: more about them than about you having sure quote unquote
- 13:19Speaker 3: possession of the child. It's what they need going forward.
- 13:22Speaker 3: So talk to the other side. And if they're a
- 13:25Speaker 3: thirteen year old and they're adultish they act more adult,
- 13:29Speaker 3: then that even would be a time to go sit
- 13:30Speaker 3: down and talk about it.
- 13:32Speaker 5: But if they act like adult, there you go.
- 13:36Speaker 4: All right, Damien, Thanks Damien, thank you, all right, thank you.
- 13:42Speaker 4: Let's see, here's a text question we can wrap things up.
- 13:45Speaker 4: Is Utah a common law state? How long until you
- 13:49Speaker 4: are considered common law married?
- 13:53Speaker 3: Utah is one of the few states that still allows
- 13:55Speaker 3: for a lawsuit over common law marriage. There is not
- 13:58Speaker 3: a specific time length. It is you have to put
- 14:02Speaker 3: yourself out as a married couple. People have to assume
- 14:05Speaker 3: you are a married couple based and you have a
- 14:08Speaker 3: reputation of it, and you take on the responsibilities of
- 14:13Speaker 3: a married.
- 14:13Speaker 6: Couple like shared bills, shared.
- 14:15Speaker 3: Bills, you take on the same name, you title things
- 14:20Speaker 3: in the same name as mister and missus. So that
- 14:24Speaker 3: is it is a fact intensive. Just living together and
- 14:27Speaker 3: owning property does not do that all right.
- 14:30Speaker 4: Well, as you can see, folks with salt mediation know
- 14:34Speaker 4: what they're doing.
- 14:34Speaker 5: Salt Mediation Group dot com.
- 14:37Speaker 3: Or salt Mediation dot com if that's easier.
- 14:39Speaker 5: To run mediation dot com. Get yourself some mediation. You'll feel,
- 14:45Speaker 5: you'll feel good about it. It Really it is a
- 14:48Speaker 5: better way. I mean, there was no my My divorce
- 14:51Speaker 5: was just mediated. I just showed up one day, and
- 14:55Speaker 5: Bill was his own tough guy. I said to myself,
- 14:59Speaker 5: I'll beat the about it. Don't show upation. You don't
- 15:03Speaker 5: show up at mediation. I'm in a bunch of and
- 15:06Speaker 5: that's how it works.
- 15:07Speaker 6: We'll have way back, I bet with I'm thank you,
- 15:11Speaker 6: thank you much, thank you.
- 15:13Speaker 3: Who say, who are the people in your neighborhood
- 15:18Speaker 5: The people that you meet each day
