Speaker 1: What's up everyone, and welcome back to the program. A
• 0:04
Speaker 1: couple of days ago, we found out that Brian Colberger
• 0:07
Speaker 1: was appointed a new lawyer by the state of Idaho. Well,
• 0:10
Speaker 1: now we're finding out a little bit more about who
• 0:13
Speaker 1: that lawyer is, at the very least a name. And
• 0:16
Speaker 1: can you imagine being this poor sob You're just hanging
• 0:19
Speaker 1: out doing your job. You're a public defender or whatever,
• 0:23
Speaker 1: or you take clients as part of your pro bono
• 0:26
Speaker 1: work and this comes across your desk, that would be
• 0:30
Speaker 1: my Look, I'm the kind of person that would luck
• 0:33
Speaker 1: out and end up having to defend somebody like Brian Colberger. Now, look,
• 0:37
Speaker 1: he deserves to have a lawyer, right, he deserves to
• 0:41
Speaker 1: have some legal representation. I get it. But man, that
• 0:45
Speaker 1: has to be a tough job, especially considering that Brian
• 0:48
Speaker 1: Colberger's own experts have turned on him at least I ray,
• 0:52
Speaker 1: And I mean, as a defense attorney, you start reading
• 0:55
Speaker 1: stuff like that, seeing stuff like that can't exactly inspire
• 0:58
Speaker 1: a lot of confidence in your new client. So today
• 1:02
Speaker 1: we have an article from Fox News and the headline
• 1:05
Speaker 1: Brian Cohberger gets new attorney appointed after he asks court
• 1:09
Speaker 1: for post conviction relief in Idaho murders. You know, I'm
• 1:12
Speaker 1: glad I'm not paying taxes up in Idaho. As much
• 1:15
Speaker 1: as I understand why he has to get a lawyer
• 1:19
Speaker 1: appointed by the taxpayer, doesn't mean i'd like it, doesn't
• 1:22
Speaker 1: mean i'd want to pay for it. Look, I have
• 1:25
Speaker 1: two rules. Leave me alone and I don't want to
• 1:27
Speaker 1: pay for it. And when it comes to Coburger and
• 1:30
Speaker 1: this new appeal, he's ticking both those boxes, right, especially
• 1:35
Speaker 1: if you're a taxpayer in Idaho. Now the rest of
• 1:38
Speaker 1: us can take a look at it and say, you
• 1:39
Speaker 1: know what, that's shitty, But if you're somebody that's living
• 1:43
Speaker 1: there and now you're paying for a lawyer again, for
• 1:45
Speaker 1: Brian Colberger, I get it. I understand why people would
• 1:48
Speaker 1: be upset about that. But that said, he deserves legal representation.
• 1:54
Speaker 1: That's the way the systems set up. And in my opinion,
• 1:56
Speaker 1: I don't see this dragging on. I see the court
• 1:59
Speaker 1: take look at what Brian Colberger has to say and
• 2:02
Speaker 1: telling him to kick rocks. So I don't see this
• 2:05
Speaker 1: being something that's going to take a long period of
• 2:08
Speaker 1: time and cost a whole bunch of extra money. This
• 2:13
Speaker 1: article was authored by Michael Ruiz. Brian Colberger has been
• 2:17
Speaker 1: appointed a new attorney to represent him in his petition
• 2:20
Speaker 1: for post conviction relief, an attempt to withdraw his guilty
• 2:24
Speaker 1: plea that he filed on his own roughly a year
• 2:27
Speaker 1: after admitting to the murders of four University of Idaho
• 2:30
Speaker 1: students who were stabbed to death in November of twenty
• 2:33
Speaker 1: twenty two. Colberger, thirty, is now being represented by attorney
• 2:37
Speaker 1: Greg Rousch of Moscow, Idaho. Rauch told Fox News Digital
• 2:43
Speaker 1: he hasn't read the petition, the case file, or spoken
• 2:46
Speaker 1: of Coburger yet. He was just appointed Monday morning and
• 2:50
Speaker 1: said he expects to speak with Cohburger over the phone
• 2:53
Speaker 1: in the near future and then visit him in prison
• 2:56
Speaker 1: to talk face to face. I can't even imagine. Again, Look,
• 3:00
Speaker 1: I get it, these guys are lawyers, they're professionals, and
• 3:03
Speaker 1: most of them have dealt with really scummy people. But
• 3:06
Speaker 1: Brian Colberger is a different kind of scumbag. In my opinion,
• 3:11
Speaker 1: he's a serial killer, or at least has all the
• 3:13
Speaker 1: makings of it, and if he was never caught for
• 3:16
Speaker 1: these crimes, he definitely would have killed again. I one
• 3:20
Speaker 1: hundred percent believe that, and considering the evidence that's been
• 3:24
Speaker 1: collected against him, the evidence that we were privy to,
• 3:28
Speaker 1: Brian Colberger is going to have a very hard time
• 3:30
Speaker 1: changing that narrative. Now there's going to be people out
• 3:33
Speaker 1: there that are willing to bite right because people want
• 3:35
Speaker 1: to look at this as some form of entertainment. Oh,
• 3:39
Speaker 1: Coburger's innocent. He's trying. He's getting realleroaded by the government. Oh,
• 3:43
Speaker 1: the FBI showed up. It was chupacabras, it was Bigfoot. No,
• 3:47
Speaker 1: it wasn't. Sometimes it just is what it is, and
• 3:51
Speaker 1: in my opinion, this is one of those times. Today
• 3:54
Speaker 1: my goal is to set up phone contact with him,
• 3:56
Speaker 1: Rouch said, I got to read the case file, I
• 3:59
Speaker 1: got to check out the police reports. I got to
• 4:01
Speaker 1: talk to him. Coburger is being held in the J
• 4:03
Speaker 1: Block unit of the Idaho Maximum Security Institution in Kuna,
• 4:07
Speaker 1: about three hundred miles south of where the crimes took
• 4:09
Speaker 1: place in Moscow, near the University of Idaho campus. And
• 4:14
Speaker 1: if Coburger succeeds here, how many other criminals are going
• 4:17
Speaker 1: to follow that blueprint? Oh well, Coburger did it, why
• 4:20
Speaker 1: can't I? And as we all know, unless there's an
• 4:23
Speaker 1: egregious violation by the court. Very rarely are these kinds
• 4:27
Speaker 1: of convictions overturned. I mean, look at Glenn Maxwell. She
• 4:31
Speaker 1: went crazy over Scotty David and how did that turn
• 4:35
Speaker 1: out for her? And not just locally, but all the
• 4:38
Speaker 1: way up the ladder, all the way to the Supreme Court.
• 4:41
Speaker 1: So if Brian Colberger thinks he's going to have an
• 4:43
Speaker 1: easy ride here, or that he's going to be able to,
• 4:46
Speaker 1: you know, make some moves, I think he's going to
• 4:48
Speaker 1: be disappointed. And I think he knows that the motivation here,
• 4:53
Speaker 1: in my opinion, is to be cruel to the families,
• 4:57
Speaker 1: and I think that's exactly what Brian Colberger is doing.
• 5:01
Speaker 1: Coburger pleaded guilty in July of twenty twenty five to
• 5:04
Speaker 1: four counts of first degree murder as well as a
• 5:06
Speaker 1: charge of burglary. Judge Stephen Hitler sentenced him the four
• 5:10
Speaker 1: consecutive terms of life without the possibility of parole, plus
• 5:15
Speaker 1: another ten years. Eh, you know, ten more years for
• 5:18
Speaker 1: good measure. There's not enough years in the history of
• 5:23
Speaker 1: years for this dude to be punished correctly. Helicopters, volcanoes,
• 5:29
Speaker 1: that's the proper punishment. For people that are deranged. You
• 5:33
Speaker 1: know that you have cars that come out of the
• 5:34
Speaker 1: factory that are lemons. Sometimes you have people that are lemons.
• 5:38
Speaker 1: They're born fucked up, and in my opinion, Brian Colberger
• 5:41
Speaker 1: is one of those people. The plea deal required Colberger
• 5:45
Speaker 1: to waive his right to appeal. However, that doesn't block
• 5:48
Speaker 1: him from seeking post conviction relief, which could reopen the
• 5:51
Speaker 1: case if successful. Yo, if he's successful, I'd be shocked
• 5:56
Speaker 1: if we didn't see the families engage in some kind
• 5:58
Speaker 1: of law abiding citizens type shit. And I'm only half
• 6:01
Speaker 1: kidding when I say that. I mean, can you imagine
• 6:04
Speaker 1: being the family member of one of these kids who
• 6:06
Speaker 1: was murdered and this scumbag gets up there with that
• 6:09
Speaker 1: stupid grin, that dumb face of his, and says he
• 6:12
Speaker 1: wants to take the plea back. It's unconscionable. It really is.
• 6:17
Speaker 1: Then again, you look at the person that's doing it
• 6:19
Speaker 1: and you understand what's going on, because Brian Colberger certainly
• 6:23
Speaker 1: is a sick, demented son of a bitch. If he
• 6:26
Speaker 1: succeeds and withdrawing his guilty plea, the case could go
• 6:29
Speaker 1: to trial, where he would face the potential death penalty.
• 6:32
Speaker 1: So he killed four people, right, they should give him
• 6:35
Speaker 1: the death penalty, but bring them right to the brink
• 6:38
Speaker 1: of death three times, and then bring him back and
• 6:41
Speaker 1: then on the fourth time finally do away with them.
• 6:44
Speaker 1: I mean, he killed four people, right. Coburger, in a
• 6:47
Speaker 1: handwritten petition on July twenty seventh, twenty twenty six, claimed
• 6:51
Speaker 1: that he was convinced to falsely confess by his high
• 6:54
Speaker 1: profile defense team of Van Taylor, Alyssa Massof and Bico Barlow.
• 6:59
Speaker 1: He alleged they didn't tell about exculpatory discovery hair found
• 7:02
Speaker 1: at the scene that was not tested for DNA. It
• 7:05
Speaker 1: was excluded as Coburger's by a physical analysis. Ridiculous. You
• 7:11
Speaker 1: know how many people were in that house all the time.
• 7:15
Speaker 1: He wants you to look at that and say, oh, no,
• 7:17
Speaker 1: it's not Coburger. What about the other evidence? What about
• 7:20
Speaker 1: all the digital evidence, What about the DNA? What about
• 7:24
Speaker 1: everything that led up to it? All of it has
• 7:27
Speaker 1: to be looked at in total, right, It's not just
• 7:30
Speaker 1: one piece of evidence. And I think that's what a
• 7:33
Speaker 1: lot of people failed to realize in these kinds of cases.
• 7:36
Speaker 1: They get fixated on one piece of evidence. My friends,
• 7:40
Speaker 1: I'm telling you it's going to take a lot more
• 7:42
Speaker 1: to convict or get somebody off then one piece of evidence, unless,
• 7:46
Speaker 1: of course, it's consequential as fuck, and that's certainly not
• 7:49
Speaker 1: the case here Ida Who. Attorney General Raoul Labrador told
• 7:54
Speaker 1: Fox News Digital shortly after Coburger's petition was filed that
• 7:58
Speaker 1: his office is ready to do whatever is necessary to
• 8:01
Speaker 1: ensure justice is fully carried out. Well, I would hope so,
• 8:05
Speaker 1: considering you have a four time murderer sitting in your
• 8:08
Speaker 1: prison who's asking to get released now or get a
• 8:11
Speaker 1: new trial, I would hope that the Attorney General's office
• 8:14
Speaker 1: is ready to go. Police found Colburger's DNA on a
• 8:18
Speaker 1: knife sheath and a bed with two of the four victims,
• 8:21
Speaker 1: Mogan and Gounsolves. They also at tracked his vehicle coming
• 8:25
Speaker 1: and going, and forensic investigators were prepared to testify about
• 8:28
Speaker 1: how although he shut his phone off during the murders,
• 8:32
Speaker 1: the evidence suggested he drove to and from the crime
• 8:35
Speaker 1: scene anyway. And it's all damning when you look at
• 8:38
Speaker 1: all that evidence, it goes beyond a reasonable doubt. And
• 8:43
  Speaker 1: I know that if I was a juror and I
• 8:45
Speaker 1: saw the evidence that they provided, Brian Colberger was definitely
• 8:49
Speaker 1: getting the death penalty without a doubt. Now, look, things
• 8:52
Speaker 1: can happen in trial, right, we can get a surprise
• 8:55
Speaker 1: here or there. But I'm pretty confident that Colberger was
• 8:59
Speaker 1: good and the truth is, so was he. The only
• 9:03
Speaker 1: reason that he's doing this, in my opinion, is to
• 9:06
Speaker 1: be cruel. That's it. It has nothing to do with
• 9:08
Speaker 1: guilt or innocence or that he got screwed. He knows
• 9:11
Speaker 1: he didn't get screwed, and he knows that they had
• 9:13
Speaker 1: the evidence to convict him. That's why he accepted a plea.
• 9:17
Speaker 1: He wasn't coerced. Separately, Siray, a former expert witness working
• 9:22
Speaker 1: for Coburger's defense team, last week, alleged that there's additional
• 9:26
Speaker 1: damaging evidence that investigators hadn't introduced before Brian Colberger's guilty plea.
• 9:32
Speaker 1: They've got to release this report because the report that
• 9:35
Speaker 1: changes everything has not been released. Ray told Fox News
• 9:38
Speaker 1: Digital on Sunday. It hasn't been unsealed. That's interesting and
• 9:43
Speaker 1: I'd love to see it, and I hope that it
• 9:46
Speaker 1: gets unsealed soon so we can dive into it. Ray
• 9:49
Speaker 1: said that the document known as the Location Database of
• 9:52
Speaker 1: Record or LOCDBOR report contains pattern of life location data
• 9:58
Speaker 1: that he alleges shows Coburger's stock them victims, that he
• 10:01
Speaker 1: may have been inside the victims home before the murders,
• 10:04
Speaker 1: and contains clues as to where he may have disposed
• 10:07
Speaker 1: of evidence. Well, that would be huge, but like everything else,
• 10:12
Speaker 1: take it with a grain of salt until we have
• 10:14
Speaker 1: the evidence for ourselves and we can see it. That's
• 10:16
Speaker 1: always my advice. If he ever does walk, he will
• 10:21
Speaker 1: kill again. He said, Well, I certainly agree with that.
• 10:24
Speaker 1: When you have the kind of sociopathy that Brian Kolberger has, Yeah,
• 10:28
Speaker 1: that's definitely going to happen. So now that he has
• 10:32
Speaker 1: this lawyer, my guess is we're going to start to
• 10:34
Speaker 1: see some motions get filed both ways, And when those
• 10:38
Speaker 1: motions do get filed, we'll get those motions added to
• 10:41
Speaker 1: the catalog and will certainly discuss them. As for this one,
• 10:45
Speaker 1: well that's going to do it. All the information that
• 10:47
Speaker 1: goes with this episode can be found in the description box.
