Intro: Welcome to the Wealthy Woman Lawyer Podcast. What if you could hang out with successful women lawyers, ask them about growing their firms, managing resources like time, team, and systems, mastering money issues, and more. Then take an insight or two to help you build a wealth generating law firm. Each week, your host, Devina Frederick, takes an in-depth look at how to think like a CEO, attract clients who you love to serve and will pay you on time, and create a profitable, sustainable firm you love. Devina is founder and CEO of Wealthy Woman Lawyer, and her goal is to give you the information you need to scale your law firm business from 6 to 7 figures in gross annual revenue so you can fully fund and still have time to enjoy the lifestyle of your dreams.

  Now here's to Vina.

Davina: Let me ask you something. If a new client called your office tomorrow ready to sign, ready to pay, ready to hand you exactly the kind of work you want more of, could you take it on? Not, could you find a way to squeeze it in? Not, could you say yes and then stay up until midnight for the next six weeks? I'm asking if your firm, as it is built right now, has the capacity to serve that client well, get paid what the work is worth, and still let you leave the office at a reasonable hour.

If you hesitated, you are exactly who this episode is for. But just to be clear, this episode is for you if you are a solo or small firm owner who dreams of building a wealth generating law firm, but more importantly, one that allows you some breathing room. Welcome or welcome back to the Wealthy Woman Lawyer Podcast. I am your host, Attorney Davina Frederick, two time author of books on law firm marketing and management and founder of Wealthy Woman Lawyer, a company that guides women law firm owners in cultivating the mindset, strategies, and systems to build wealth generating law firms without burning out in the process. I am so glad you are here with me.
• 2:01
Today, we are talking about expanding your law firm's capacity. Why? Because capacity is not a back office concern you get to someday. I believe it is the single most important action solo and small firm owners should be working on for the rest of 2026. Here is what we will cover in today's episode.
• 2:20
Why I'm just too busy is a capacity problem disguised as a scheduling problem. The three real levers you have for expanding capacity, what happens to your revenue and your personal income when you pull them, two stories of firm owners who did exactly this, and a straightforward way to think about the second half of twenty twenty six so that by January, you are running a bigger, more profitable firm that also gives you your evenings back. First up, let's discuss the capacity ceiling and why it's costing you more than you think. Most solo and small firm owners I talk to describe their business the same way. I have a full calendar, plenty of work to do, and not enough time to do it all.
• 3:06
I'm slammed seems to have become a badge of honor in this profession. But here's the truth no one's telling you. Being fully booked is not the same as being successful. It just means you have hit the ceiling of what one person working inside twenty four hours, seven days a week can produce. And once you hit that ceiling, three shifts start happening, usually all at once and usually without you noticing until months into it.
• 3:32
First, you start turning away work even though you would love to take it on. Because of your limited capacity, you have to say, we're not taking new clients right now or let me refer you to someone else. And every one of those is revenue that walked out the door and probably isn't coming back. Second, the clients you do keep start getting less of you, not because you don't care, but because you are one person and there are only so many hours in a day. Response times slip.
• 4:02
Maybe you start dropping the ball on deadlines. Good work becomes mediocre work. That's how practices that used to run on reputation and referrals start losing both. Third, your own income growth stalls even while you are working more hours than ever. You cannot bill your way past your own capacity.
• 4:22
There is a ceiling on how much revenue one attorney working alone can generate, and most solo owners hit it somewhere between $300,000 and $600,000 depending on practice area and how many hours they are willing to work. If you are at that ceiling right now, working harder will not move the number because really, how much harder can you work? Let me be clear, if you are a solo or small firm owner reading your calendar as a success metric, I'm booked solid, while that's a win, it's also a symptom. It's the symptom of a firm that has not yet built the capacity to grow beyond what your own two hands can do. Imagine two versions of your firm five years from now.
• 5:04
In the first version, you've kept doing what you're doing. You've kept saying yes to every client personally. You've kept being the one who drafts, reviews, calls back, and follows up on everything. And you've kept telling yourself that hiring or systems or technology were things you'd get to once you have time. Five years from now, in this version, you are busier than you are today, your revenue has grown modestly, if at all, and you likely are far behind your competitors in terms of capacity to serve clients at a high level.
• 5:37
In the second version, you've devoted the remainder of twenty twenty six to deliberately building capacity. You've brought on the right support, you've built systems around your core work, you've let technology absorb what didn't need your participation. Five years from now, in this version, your firm serves significantly more clients at the same or higher standard of quality. Your revenue and your personal income have both grown substantially, and you are working fewer hours than you are today. You have more leisure time and the money in your bank account to enjoy it.
• 6:11
The only difference between those two futures is whether you treat capacity as something you'll get to eventually, or as the primary strategic focus for the rest of this year. It's your choice to make. Now let's discuss the mindset shift needed to transition from more hours to more capacity. Here's where most solos or small firm owners go wrong when they finally admit the calendar is the problem. They think the answer is working harder, longer, or smarter with their own time, better time blocking, fewer distractions, a more disciplined morning routine.
• 6:47
Listen, all of that is good. But truthfully, you are optimizing the wrong variable. Enough. The issue is that you are likely doing the wrong activities. If you have a capacity problem in your firm, you can't solve it by doing more of anything and everything yourself.
• 7:07
The goal is not to become a faster version of yourself. The goal is to build a firm that can serve more clients well, generate more revenue, and put more money in your pocket using resources beyond your own personal hours. That's not a you thing. That's a we thing. If this resonates with you, I'm challenging you right now and for the rest of 2026 to shift your primary strategic focus above everything else to expanding your firm's capacity to make three shifts.
• 7:39
Serve more clients in a more streamlined but high touch way, drive up total revenue so have more capital to invest in your firm's growth and greater profitability, and more time to take extended breaks without worrying about everything falling apart in your absence. If that sounds like it's too good to be true, stay with me because I'm about to show you exactly how it works using two real transformations. There are only three real levers for expanding capacity in a law firm. I'm gonna walk through each one because most owners only ever pull one of them, usually the wrong one first. Lever one is people.
• 8:21
This is the most obvious lever, and it's also the one solo owners are most afraid of, usually because of a bad hiring experience in the past or fear of the added overhead. But people capacity does not have to mean hiring a full time attorney, at least not at first. In fact, for most solo firms, the fastest, lowest risk capacity gain comes from hiring support staff, a paralegal, a legal assistant, a case manager, someone who takes the administrative and preparatory work off your plate so that the hours you do work are spent exclusively on the work only you can do. That single shift moving from I do everything to I do only what requires my license and leadership is often worth 20% to 30% more effective capacity without adding a single billable hour to your own week. Lever two is systems.
• 9:16
This is the lever most solo owners tend to skip while they are still solos, and it's the one that makes Lever one work. Systems are the documented, repeatable processes that let someone else do the work to your standard without you supervising every step client intake, document preparation, case status updates, billing. If those processes live only in your head, then every new hire will simply create more work for you because they need you to train them, correct them, and answer their questions constantly. If those processes are documented, a new hire becomes productive in weeks instead of months, and your capacity multiplies with every person you add instead of merely adding one more variable for you to manage. Lever three is technology and automation, including AI.
• 10:06
This is the lever that has changed the fastest in the last two years, and most solo and small firm owners are dramatically underusing it. Document drafting, intake scheduling, client communication, legal research support, even first pass drafting of routine documents are just some of the ways law firm owners are using AI. There are seven essential systems every law firm needs to scale. I do not have time to get into all of them today, but I discuss all seven in my book, The Wealthy Woman Lawyer's Guide to a Systems Driven Law Firm Business. If you haven't read it yet, you can grab a copy on Amazon for less than $10 read it, and then consider which of those systems could be improved with the use of AI.
• 10:50
The right tools can do in minutes what used to take you or a staff member hours to complete. Technology does not replace your legal judgment and it should never replace your relationship with your clients, but it can absorb an enormous amount of the repetitive work that currently eats your capacity, freeing up real hours for the work that requires a law license and your expertise. It's important to understand that these three levers work together. People without systems can create more chaos and, quite frankly, more work for you. Systems without people just document what nobody is doing.
• 11:29
Technology without either of the first two won't do much for you. But when you build all three together, even in a small, simple way, You don't just add capacity, you multiply it exponentially. Let me tell you about two firm owners who did exactly this. The first is a solo estate planning attorney I'll call Michelle. When we started working together, Michelle was running her entire practice by herself, drafting every document, managing every client relationship, handling every piece of intake, and she was stuck right around $300,000 a year in gross revenue, a number she had not moved in three years no matter how many hours she added.
• 12:12
She was, by her own description, the problem. We didn't start by advising Michelle to hire an associate attorney. We started with getting her to understand that stepping away from working in the business a few hours a week and devoting that to working on the business would help her begin to expand her firm's capacity. It wasn't easy at first, but she soon got the hang of putting time on her calendar to work on expanding her firm's capacity and committing to the goal. First, she hired an experienced paralegal, and together, they spent six weeks documenting every step of her processes, building templates, and creating quality control checkpoints so the work could be done consistently without Michelle doing it all herself.
• 12:57
While that seemed impossible to her at first, we taught her an easy way to create systems while she was working. Let's be real, no solo has time to stop working in the business for six weeks to create systems. They must be created as we work. The paralegal also was able to help her do this. She didn't need to worry about getting all her systems documented on her own.
• 13:20
The added capacity of an experienced paralegal created more time to devote to setting up systems. Then she brought on a virtual marketing coordinator and independent contractor to handle content and referral relationships, work that had been eating hours of her week for very little strategic value. These three changes alone added another $200,000 to her revenue. Only after those two roles were in place and functioning and her revenue increased did she bring on an associate attorney to handle the routine estate planning matters, freeing Michelle to focus on complex cases and the relationships that grew her firm. The result?
• 14:03
Within two years, Michelle's revenue tripled. But the key takeaway is that she decreased her hours working in the business. Her team was handling most day to day operations while she focused on strategy, complex work, and growth. Michelle did not just scale her revenue, she scaled her Freedom, and her personal income grew right alongside the firms. The second story is a business litigation attorney I'll call Lexi.
• 14:30
Lexi's family law litigation practice had been stuck around $600,000 for three years. Her instinct, like most attorneys, was that she needed another associate attorney. She kept trying to find the right person and kept coming up empty, all while drowning in discovery management, document review, and case administration While she ultimately did need an associate attorney, in fact, a few of them, we didn't start there. We took a different approach with Lexi. Instead of hiring another attorney first, she hired a litigation paralegal and a client care specialist, and she spent eight weeks building systems for case management, discovery processing, and client communication.
• 15:14
Once those systems existed, her litigation paralegal could independently handle roughly 85% of the discovery and trial notebook preparation under Lexi's supervision, and her client care specialist took over scheduling, deadline tracking, and routine client communication entirely. That freed Lexi to spend her time on high level litigation, strategy, and business development, the two things that required her expertise and grew the firm. Within eighteen months, her revenue skyrocketed. And when she finally did hire an associate attorney, that attorney became productive almost immediately because the systems were already there to support them. Before long, she scaled her firm to multiple 7 figures and hired more team members.
• 16:03
Notice what Michelle and Lexi have in common neither of them started by hiring an attorney neither of them tried to outwork their capacity ceiling both built capacities deliberately in a specific order people first for the roles that create the most immediate relief, systems to make that support scalable and consistent, and only then did they add the more expensive, higher stakes hires, and both ended up with more revenue, more personal income, and more time back in their personal lives. The lesson here is not that we should wait to hire associate attorneys because associate attorneys are critical, particularly if you spend a lot of your time in court, but that capacity can be expanded in several ways. And the key is to focus on what you need first, second, and third. That will differ for everyone. Now let's talk math.
• 16:57
I think when solo owners see the numbers laid out, the case for capacity building becomes impossible to ignore. Let's say you're a solo owner billing at a rate that generates $300,000 a year, working roughly fifty hours a week, and you're at full capacity. Every new client you say yes to right now either comes at the cost of quality on your existing clients, or it comes at the cost of your own time, your evenings, your weekends, your family, and Slash, or your health. Imagine you invest in a part time paralegal twenty hours a week at a cost of perhaps $25,000 a year. If that paralegal takes over even ten hours a week of work that isn't billable or that is billed at a lower rate than your own tasks like intake coordination, document preparation, and status updates, for example, you have just freed up ten hours a week of your own capacity for the work that generates real revenue At even a conservative rate, that's $50,000 to $75,000 a year in additional capacity for a $25,000 investment.
• 18:04
That's a high return investment. Now stack systems on top of that. If documenting your core processes means that paralegal becomes fully productive in three weeks instead of three months, you have recaptured additional months of capacity you would otherwise have spent training and correcting. And if you layer in the right technology for the repetitive parts of your workflow, like drafting support, intake automation, scheduling, you compress even further the hours that don't require your license and expand the hours that do. This is why I keep saying, capacity is not an expense.
• 18:43
It is the highest leverage investment available to a solo or small firm owner right now. Marketing brings clients to your door. Capacity is what determines whether you can serve them. Get paid properly for it and still have a life. You can spend the rest of twenty twenty six chasing more leads into a firm that has no room for them, or you can spend it building the capacity to finally convert the demand you already have into revenue, income, and time.
• 19:14
Before we get to the practical roadmap, I want to address the objections I hear every time I talk to a solo or small firm owner about building capacity, because I guarantee at least one of these is running through your head right now. The first objection is, I can't afford to hire right now. I understand why it feels that way. Adding payroll feels like a risk when your revenue is already unpredictable. But flip the math around, what is it currently costing you not to have capacity?
• 19:45
Every client you turn away, every referral you can accept, every hour you spend on work that doesn't require your license instead of work that grows your firm, that is a cost too. It's just invisible because it never shows up as a line item. It shows up as a revenue ceiling you can't explain. The question isn't whether you can afford to build capacity. It's whether you can afford to keep operating without it.
• 20:11
The second objection is, I tried hiring before, and it didn't work out. I hear this one a lot, and it's almost always a systems problem wearing a hiring costume. If you hire someone and hand them no documented process, no training structure, and no clear standard for what done well looks like, you have set them up to fail and you have set yourself up to conclude that hiring doesn't work for you. It's not that hiring failed. It's that you hired before you had the systems to make that hire successful.
• 20:46
When you hire without systems in place, you spend your time not only doing your work, but grading their work. People management is a skill just like any other, and you must devote time to learning it. The third objection is, I don't have time to train someone or document anything. I'm too busy. I want to gently push back here because this is the exact trap that keeps solo owners stuck at their ceiling indefinitely.
• 21:14
Yes, documenting your process and training a new hire takes time upfront, but it is time you spend once in exchange for capacity you keep, even if that employee leaves and another replaces them. Compare that to the alternative, spending that same time week after week, year after year, doing the work yourself because you never built anything beyond your own two hands. One of those is an investment, the other is a grind. And the fourth objection is, what if I build capacity and it doesn't pay off? The truth is there is some risk in every investment.
• 21:49
But the far greater risk is staying exactly where you are. A firm that stays at its current ceiling doesn't hold steady. It erodes slowly as competitors who do build capacity out serve you, as burnout catches up with you and as the best years of your career pass by while you're still doing everything yourself. If you are listening to this and thinking, okay, Devina, I'm convinced, but how do I start figuring this out for myself? Here's what I recommend.
• 22:19
First, start with a capacity audit. For two weeks, track exactly where your hours go. Not what you think you are doing, but what you are really spending your time on. You're looking for three categories: work that only you, as the licensed attorney, can do work that requires discernment but not a law license and work that is purely administrative or repetitive. Most solo owners are shocked to discover that the third category, the purely administrative work, is devouring 20% to 30% of their time.
• 22:53
Once you see that clearly, identify the single highest impact hire or system you can put in place in the next ninety days. For some of you, that will be an associate attorney. For others, it may not. It may be support staff, like a paralegal, a legal assistant, or a case manager someone who can shoulder some of the administrative burden. My advice is to hire a more experienced person, even if it costs you a little more at the outset.
• 23:22
Personally, I look for people who are better than I am at the role I'm looking to fill. It not only saves a ton of time on training, but they also make you and your firm better. While you are onboarding that hire, document your core processes as you go. Do not wait until you have time to document your systems because you will never find that time. Document your intake process this month.
• 23:49
Document your most common matter type next month. Build it in parallel with bringing on support, not before it and not after it. And throughout, look for the places where technology can absorb work that doesn't need a human at all. This might look like first pass document drafting, appointment scheduling, or routine client updates, for example. You do not need an elaborate tech stack to start.
• 24:15
You need one or two tools that eliminate inefficiencies in routine tasks. If you do this deliberately for the rest of 2026, people first, systems built alongside them, automation layered in to remove the remaining friction, you will not recognize your firm by January. More importantly, you will not recognize your calendar. Based not only on my personal experience, but on coaching hundreds of women law firm owners over the past thirteen years, the firm owners who break through to 7 figures and beyond are not the ones who work the hardest or the longest. They are the ones who stop trying to be the entire firm and start intentionally building capacity beyond themselves.
