- 0:00of Voices of Life. Did you know? In 2022, the
- 0:06Supreme Court of the United States issued a decision
- 0:08that changed the course of American law and conscience.
- 0:14Dobbs v. Jackson Women's Health Organization,
- 0:17a case that overturned Roe v. Wade, returned
- 0:20authority over abortion laws to the people and
- 0:23their elected representatives. It was a moment
- 0:27that ended nearly 50 years of federal precedent
- 0:30and began a new chapter in the story of life,
- 0:33liberty, and law within our constitutional republic.
- 0:39Today, Pastor David guides us through this defining
- 0:42decision, its origins, its arguments, and its
- 0:46lasting impact on the nation. This is Voices
- 0:49of Life. This is your Did You Know? This is Voices
- 1:00of Life, a ministry of the Church for Life. I'm
- 1:03Pastor David. Did you know that in 2022, the
- 1:08Supreme Court of our Constitutional Republic
- 1:10made one of the most consequential decisions
- 1:13in modern history? A ruling that overturned nearly
- 1:1850 years of precedent and reshaped the national
- 1:22conversation about life? liberty, and law. We
- 1:27are talking about Dobbs v Jackson Women's Health
- 1:30Organization, the case that reversed Roe v Wade,
- 1:35and Planned Parenthood v Casey, returning authority
- 1:39over abortion laws to the people and their elected
- 1:42representatives. To understand Dobbs, we must
- 1:46first remember Roe v Wade, a case we explored
- 1:49in a previous Voices of Life episode. In 1973,
- 1:53Roe established a constitutional right to abortion
- 1:56based on privacy. In 1992, Planned Parenthood
- 2:00v. Casey reaffirmed the right but replaced the
- 2:03trimester framework with undue burden standard.
- 2:07For nearly three decades, those rulings defined
- 2:11how states could regulate abortion until Mississippi
- 2:14passed a law that directly challenged them. In
- 2:182018, Mississippi enacted the Gestational Age
- 2:22Act banning most abortions after 15 weeks of
- 2:25pregnancy except for medical emergencies or severe
- 2:30fetal abnormalities. The law did not include
- 2:35exceptions for rape or incest. Because Roe and
- 2:38Casey prohibited bans before fetal viability
- 2:41around 23 to 24 weeks, Mississippi's law directly
- 2:46conflicted with existing precedent. The state's
- 2:50only abortion clinic, Jackson's Women's Health
- 2:52Organization, filed suit, and a case began its
- 2:56journey through the courts. By 2021, the Supreme
- 3:01Court agreed to hear the case. Mississippi argued
- 3:04that the Constitution contained no reference
- 3:06to abortion and that the issue should be decided
- 3:09by elected legislatures. The clinic argued that
- 3:13overturning Roe and Casey would undermine decades
- 3:16of presence and affect millions of women nationwide.
- 3:21Then came the unprecedented moment, the leak.
- 3:26On May 2, 2022, a draft majority opinion written
- 3:29by Justice Samuel Alito was leaked to the press.
- 3:34It revealed that the court intended to overturn
- 3:37Roe v. Wade. The leak sparked nationwide protests,
- 3:41congressional hearings, and internal Supreme
- 3:44Court investigation, a moment unlike any other
- 3:48in judicial history. On June 24, 2022, the court
- 3:53issued its final decision. By a vote of 6 to
- 3:553, it upheld Mississippi's law, and by a vote
- 3:59of 5 to 4, it overturned Roe and Casey entirely.
- 4:05Justice Alito wrote for the majority. The Constitution
- 4:09does not confer a right to abortion. The Court
- 4:13reasoned that the abortion is not mentioned in
- 4:16the Constitution and is not deeply rooted in
- 4:19this nation's history and tradition. The ruling
- 4:22returned authority over abortion regulation to
- 4:25the states and Congress. writing together that
- 4:33the majority had eliminated a constitutional
- 4:35protection recognized for nearly 50 years. They
- 4:40warned that the decision would profoundly affect
- 4:42women across the country and weaken respect for
- 4:46the president. Their closing words were somber.
- 4:50With sorrow for this court, but more for the
- 4:53many millions of American women who have today
- 4:56lost the fundamental constitutional protection,
- 4:59we dissent. Now remember we talked in a few podcasts
- 5:04ago about Marbury v. Madison, and we talked about
- 5:10things that were not in the Constitution, but
- 5:12the Supreme Court ruled anyway. Well, Roe v.
- 5:15Wade was one of those rulings, and so was the
- 5:19other one in 1992. There's nothing in the Constitution
- 5:22that talks about it, nothing in the Constitution
- 5:23that gives the federal government authority over
- 5:26it. So, in this case, the court went ahead and
- 5:32acknowledged it and said, yep, we can't do it.
- 5:36And therefore, here the states and Congress have
- 5:41control back to making the laws, which is what's
- 5:43supposed to happen, not the courts. The courts
- 5:46are not supposed to make laws. They're not supposed
- 5:49to even really interpret them or put in precedences
- 5:53that stop things that are contained in our laws.
- 5:57This is one of those cases where it's chipping
- 6:00away at Marbury v. Madison. But this decision
- 6:04had immediate impact. The decision triggered
- 6:08changes. Several states had trigger laws ready
- 6:11to take effect, banning or restricting abortion
- 6:14as soon as DOBS was decided. Other states expanded
- 6:18access, creating a patchwork of laws across the
- 6:22nation. The ruling reignited debates about federalism,
- 6:27judicial philosophy, and the meaning of liberty
- 6:29in a constitutional republic. Dobbs v. Jackson
- 6:32Women's Health Organization stands as a turning
- 6:34point in American legal history. It reminds us
- 6:37that the constitutional interpretation shapes
- 6:39not only law but culture, and that every generation
- 6:43must wrestle with how they balance the rights,
- 6:46responsibilities, and moral conviction. Thank
- 6:49you for joining us on this Voices of Life Did
- 6:52You Know episode. I'm Pastor David. We hope this
- 6:57journey has deepened your understanding of how
- 6:59Dobbs connects to Roe v. Wade and continues to
- 7:03influence our Constitutional Republic today.
- 7:06Until next time, stay encouraged, stay informed,
- 7:10and stay faithful. Thank you for joining us for
- 7:14this Voices of Life Did You Know? episode. Dobbs
- 7:19v. Jackson Women's Health Organization marked
- 7:21a turning point in the history of our Constitutional
- 7:23Republic, ending nearly 50 years of federal precedent
- 7:27and returning the question of abortion laws to
- 7:30the people and their elected representatives.
- 7:34As we shared in our Roe v. Wade episode, these
- 7:37decisions are more than legal milestones. They
- 7:39shape culture, conscience, and the ongoing national
- 7:42conversation about life, liberty, and the role
- 7:45of government. On behalf of Pastor David, we
- 7:49hope today's journey has strengthened your understanding
- 7:51of how Dobbs connects to Roe, and why both cases
- 7:54continue to influence our nation today. Until
- 7:58next time, stay encouraged, stay informed, and
- 8:02stay faithful.
