Attorney Warns Epstein Settlement Could Shut Out Future Survivors (9/28/26) · The Epstein Chronicles

• 0:00
Speaker 1: What's up everyone and welcome to another episode of the
• 0:03
Speaker 1: Epstein Chronicles. Over the past few months, there has been
• 0:07
Speaker 1: some negotiations going on down in the U.S. Virgin Islands
• 0:10
Speaker 1: about a settlement that would basically get Jeffrey Epstein's estate
• 0:16
Speaker 1: off the hook moving forward. And this is a settlement
• 0:20
Speaker 1: proposal that was brought forth by Boies and Schiller, lawyers
• 0:25
Speaker 1: representing roughly 40 Epstein survivors. The only problem is, this
• 0:31
Speaker 1: lawsuit's going to let the Epstein estate off the hook.
• 0:34
Speaker 1: And not only that, but also redistribute roughly $ 80 million
• 0:39
Speaker 1: to people like Indyke and Kahn. And frankly, I don't
• 0:42
Speaker 1: know how that's acceptable to anybody. Because this kind of
• 0:46
Speaker 1: settlement might be profitable to a few people that are
• 0:49
Speaker 1: involved in it, but what about all the people who
• 0:51
Speaker 1: haven't come forward yet? What about all the women with
• 0:53
Speaker 1: no names? Should they just be excluded? So I don't
• 0:58
Speaker 1: think that there should be any sort of lawsuit ever
• 1:01
Speaker 1: against the Epstein estate that bars people from coming forward
• 1:05
Speaker 1: and suing them later on. Because not everybody is going
• 1:08
Speaker 1: to operate at the pace everybody else does. Maybe it's
• 1:11
Speaker 1: going to take people a little bit longer. Maybe people
• 1:14
Speaker 1: aren't ready to come forward. So I don't think that
• 1:16
Speaker 1: there should ever be a deal that certain people enter
• 1:19
Speaker 1: into that bars other people from suing the estate. And
• 1:24
Speaker 1: in this article, that's what we're going to talk about.
• 1:27
Speaker 1: But before we jump into the article, here's a quick
• 1:30
Speaker 1: overview of what's going on. In February of 2026, a
• 1:34
Speaker 1: federal judge granted prelim approval for a new $ 35 million
• 1:38
Speaker 1: victim class action settlement targeting Jeffrey Epstein's longtime financial gatekeepers
• 1:43
Speaker 1: and estate co-executors Darren Indyke and Richard Kahn. The class
• 1:48
Speaker 1: action lawsuit specifically accused Indyke and Kahn, who managed Epstein's
• 1:52
Speaker 1: finances out of the U.S. Virgin Islands, of actively using
• 1:55
Speaker 1: shell companies, secret payments, and complex banking structures to conceal
• 2:00
Speaker 1: his sex trafficking enterprise. Now, the payout was approved by U.S.
• 2:04
Speaker 1: District Judge Aaron Submaranian, and you'll remember him from our
• 2:08
Speaker 1: Diddy coverage. He was the lawyer that oversaw the Diddy trial,
• 2:12
Speaker 1: and according to him, the deal should ensure that a
• 2:15
Speaker 1: payout between $ 25 million and $ 35 million occurs. It specifically
• 2:20
Speaker 1: compensates more than 40 survivors who were unfairly excluded from
• 2:25
Speaker 1: prior restitution funds. Now, there was a hearing on September 16th,
• 2:31
Speaker 1: 2026 about the status of where this is all at
• 2:35
Speaker 1: and if it was going to go forward. But as
• 2:36
Speaker 1: of now, we don't have any information from the court
• 2:40
Speaker 1: one way or the other. So there is the outline.
• 2:43
Speaker 1: There's what we're looking at. Now, let's dive into this article. Headline,
• 2:48
Speaker 1: VI attorney objects to broad Epstein settlement. This article was
• 2:52
Speaker 1: authored by Matt Probosco. A Virgin Islands attorney has objected
• 2:58
Speaker 1: to a proposed settlement of all sexual assault and trafficking
• 3:02
Speaker 1: suits against the estate of Jeffrey Epstein. The agreement would
• 3:05
Speaker 1: also block any future suits related to Epstein's abuse of
• 3:09
Speaker 1: women and girls, while setting aside tens of millions for
• 3:12
Speaker 1: Epstein's friends and his heirs. Boy, the U.S. Virgin Islands
• 3:16
Speaker 1: just really, really loves hooking Jeffrey Epstein up. Remember, they
• 3:21
Speaker 1: ate out of both sides of the trough. First, they
• 3:24
Speaker 1: were eating off Jeffrey Epstein's plate, and then After all
• 3:27
Speaker 1: was said and done, they claimed to be a victim
• 3:30
Speaker 1: and they started scooping up crumbs. And I told you
• 3:32
Speaker 1: at the time how disgusted it made me. Why in
• 3:35
Speaker 1: the hell should the USVI benefit to that kind of
• 3:38
Speaker 1: level when these women were hardly getting anything? Now, collectively, yeah,
• 3:43
Speaker 1: a lot of money was paid out and some survivors
• 3:46
Speaker 1: got a lot more than others. But you know what's
• 3:49
Speaker 1: not disputable? The fact that the USVI made more money
• 3:54
Speaker 1: than anybody else in this whole entire ordeal. while at
• 3:57
Speaker 1: the same time, they were enabling Jeffrey Epstein's bullshit. And
• 4:01
Speaker 1: if that doesn't get people more fired up and more upset,
• 4:04
Speaker 1: I don't know what to say. And another thing that
• 4:08
Speaker 1: needs to be addressed is that the vast majority of
• 4:11
Speaker 1: these people were elected Democrats, and there has never been
• 4:15
Speaker 1: a reckoning for that. It's just sort of been glazed over,
• 4:20
Speaker 1: and I find that to be completely unacceptable. A federal
• 4:25
Speaker 1: judge in New York preliminarily approved the proposed settlement brought
• 4:28
Speaker 1: by Florida-based attorneys for the lead plaintiff in a class
• 4:32
Speaker 1: action suit against Epstein's estate in February, setting a timeline
• 4:35
Speaker 1: for details to be hammered out through the summer. The
• 4:39
Speaker 1: settlement would cover all sex crime claims against Epstein between
• 4:43
  Speaker 1: January 1, 1995 and August 10, 2019, when Epstein died
• 4:49
Speaker 1: in a Manhattan jail cell at 66. It would release
• 4:52
Speaker 1: Epstein's estate estimated to have dwindled to around $ 120 million,
• 4:57
Speaker 1: as well as its managers, longtime attorney and accountant for
• 5:00
Speaker 1: the sex offender, Darren Indyke and Richard Kahn, from the
• 5:03
Speaker 1: current litigation and any future legal action related to Epstein's crimes,
• 5:08
Speaker 1: many of which allegedly took place in the territory. Well,
• 5:12
Speaker 1: no doubt about that. But I think that Jeffrey Epstein's
• 5:16
Speaker 1: most heinous crimes took place in Florida. And that's because
• 5:22
Speaker 1: the vast majority of those girls in Florida were underage. Now,
• 5:26
Speaker 1: does that mean that Jeffrey Epstein continued on that path?
• 5:29
Speaker 1: It does not. And anybody who's being honest about the topic,
• 5:32
Speaker 1: about the subject, will tell you that Jeffrey Epstein changed
• 5:36
Speaker 1: up his pattern, changed up what he was doing. And
• 5:39
Speaker 1: instead of getting little girls from the high school, this
• 5:42
Speaker 1: rotten bastard would bring them in from other countries, places
• 5:45
Speaker 1: with less regulation, and girls that had no voice. They
• 5:49
Speaker 1: were completely dependent on him and Jean-Luc Brunel, and once
• 5:52
Speaker 1: they got to America, forget it. Sanqua attorney Russell Pate,
• 6:00
Speaker 1: who represented Virgin Islanders in suits against tobacco, oil, and
• 6:03
Speaker 1: other industries, wrote to the court expressing his objection. The
• 6:07
Speaker 1: settlement would reserve $ 80 million to be distributed, as Epstein
• 6:11
Speaker 1: laid out in his will, potentially rewarding people who aided
• 6:14
Speaker 1: and abetted the financiers' notorious sex crimes, Pate said. Not
• 6:19
Speaker 1: one single dollar of this estate should go to anybody
• 6:22
Speaker 1: besides the people who were harmed, and any other restitution
• 6:26
Speaker 1: that might have to be paid. But how can you
• 6:29
Speaker 1: tell me for a single second that Darren Indyke or
• 6:32
Speaker 1: Richard Kahn should benefit from this? These two scoundrels were
• 6:37
Speaker 1: right in the middle of all of it, and if
• 6:39
Speaker 1: the reports about the investigation are true, then they most
• 6:42
Speaker 1: certainly should be barred. from profiting from crimes they were
• 6:46
Speaker 1: involved in, no? Just because you're the executor of the estate,
• 6:49
Speaker 1: that doesn't mean that you weren't complicit. That doesn't mean
• 6:52
Speaker 1: you didn't enable Jeffrey Epstein's bullshit. And that doesn't mean
• 6:55
Speaker 1: you didn't commit your own crimes. Pate wrote to the
• 6:59
Speaker 1: court Friday, saying he had just learned of the settlement plan.
• 7:03
Speaker 1: If it took a docket-watching attorney months to hear of
• 7:06
Speaker 1: the plan, what hope would a non-lawyer have, he asked.
• 7:09
Speaker 1: And that's certainly true. This isn't the kind of story
• 7:12
Speaker 1: that you hear on the legacy media or any of
• 7:14
Speaker 1: the salacious idiots out there, right? Because it's not something
• 7:17
Speaker 1: that really moves the needle. And for them, that's what
• 7:21
Speaker 1: it's all about, engagement. We're playing the long game here.
• 7:24
Speaker 1: And the way we go about business is that this
• 7:26
Speaker 1: is a reoccurring story each day. And we just pick
• 7:29
Speaker 1: up where we left off from the day before. That's
• 7:32
Speaker 1: how much content there is. That's how much is going on.
• 7:36
Speaker 1: And the vast majority of it isn't even reported. Like,
• 7:41
Speaker 1: where's this story? How come we're not hearing more about
• 7:44
Speaker 1: what's going on down in the USVI? Well, I'll tell
• 7:46
Speaker 1: you why. Because it's not salacious enough. And it doesn't
• 7:50
Speaker 1: move the engagement needle. And in the old days, the
• 7:52
Speaker 1: saying used to be, if it bleeds, it leads. And
• 7:56
Speaker 1: it's still true. It's just a different medium, right? Instead
• 8:00
Speaker 1: of the news. That shit's on the internet. That it's
• 8:03
Speaker 1: on podcasts or blogs or Twitter posts, whatever it might be.
• 8:07
Speaker 1: But everything's about the engagement. And everybody's trying to one-up
• 8:11
Speaker 1: the next person. when it comes to salacious nonsense. Meanwhile,
• 8:14
Speaker 1: the real heart of the story, the real meat of
• 8:17
Speaker 1: the story, is in situations like this. And not just
• 8:20
Speaker 1: one situation, all of them combined. Remember, you have to
• 8:24
Speaker 1: combine the evidence. It's not just one piece of evidence,
• 8:27
Speaker 1: it's the totality of it. And when you look at
• 8:29
Speaker 1: the totality of the evidence, it's damning. There could be
• 8:34
Speaker 1: dozens of unknown victims who have never received actual notice
• 8:37
Speaker 1: of this class action settlement, but would have their claims
• 8:40
Speaker 1: extinguished even though these victims may have timely claims pursuant
• 8:43
Speaker 1: to statute of limitation tolling available in the U.S. Virgin
• 8:47
Speaker 1: Islands or their home court jurisdictions. This is a due
• 8:51
Speaker 1: process problem, he wrote to the court on Friday. And
• 8:54
Speaker 1: everybody knows that. What, you think some woman in insert
• 8:57
Speaker 1: country here, some little village in Peru, knows about this
• 9:01
Speaker 1: class action suit? It's not all over the front page
• 9:05
Speaker 1: of the news. Nobody's on Fox News talking about it.
• 9:09
Speaker 1: We're all the idiots on MSNBC. You know, all the
• 9:13
Speaker 1: people that have shown up to this story over the
• 9:14
Speaker 1: past year, acting like they care so much. They only
• 9:18
Speaker 1: care when they have some salacious news that they think
• 9:21
Speaker 1: is going to be damaging to the quote-unquote other side.
• 9:25
Speaker 1: And anybody that's playing that game is not somebody that's
• 9:28
Speaker 1: serious about justice. The agreement should be altered, Pate said,
• 9:33
Speaker 1: to allow any potential victim to join the class in
• 9:36
Speaker 1: the future and not shield the estate from future suits. Further,
• 9:40
Speaker 1: the deal made in New York would undermine legal proceedings
• 9:43
Speaker 1: underway in the Virgin Islands, where the estate is situated.
• 9:47
Speaker 1: The Epstein estate, however, is a Virgin Islands entity administered
• 9:51
Speaker 1: under Virgin Islands law, and the estate, including its approximately
• 9:56
Speaker 1: $ 120 million in remaining assets, is in a U.S. Virgin
• 9:59
Speaker 1: Islands probate proceeding. The proposed judgment from this court would
• 10:03
Speaker 1: effectively adjudicate the rights of present and future tort claimants
• 10:07
Speaker 1: against the Epstein estate, including those who might sue in
• 10:11
Speaker 1: the Virgin Islands, Pate wrote. A key difference is how
• 10:14
Speaker 1: the wealth of a deceased person is treated in New York,
• 10:18
Speaker 1: where a named Epstein plaintiff could see $ 875, 000 versus the
• 10:22
Speaker 1: Virgin Islands where it paid estimated those same women could
• 10:26
Speaker 1: be estimated to millions. So it really comes down to jurisdiction, right?
• 10:30
Speaker 1: And each jurisdiction has different laws. And depending on where
• 10:34
Speaker 1: you're based, you have to find the right court that
• 10:37
Speaker 1: is going to oversee your allegations. So that is the
• 10:42
Speaker 1: battle for jurisdiction. And a lot of times you'll see
• 10:45
Speaker 1: a case get thrown out without prejudice. because it's not
• 10:49
Speaker 1: filed in the right jurisdiction. New York follows an archaic
• 10:54
Speaker 1: legal principle that when a defendant dies, like Jeffrey Epstein,
• 10:58
Speaker 1: victims can no longer seek punitive damages, despite Epstein's outrageous, egregious,
• 11:03
Speaker 1: and reprehensible intentional conduct. The Virgin Islands, like Pennsylvania, Ohio,
• 11:09
Speaker 1: and a minority of other states, follows a more enlightened approach,
• 11:13
Speaker 1: that the death of a defendant changes nothing in the case,
• 11:16
Speaker 1: not the claims or the damages. Essentially, Jeffrey Epstein's estate
• 11:21
Speaker 1: inherits the same liability and damages as every claim survives
• 11:25
Speaker 1: to his estate, including punitive damages, Pate wrote. And I
• 11:29
Speaker 1: think that's the right way to do it. So what,
• 11:31
Speaker 1: you die and your estate gets off the hook? You
• 11:34
Speaker 1: made the money for that estate, you built that estate.
• 11:36
Speaker 1: That's your legacy, right? Well, your legacy should be torn down.
• 11:40
Speaker 1: If you're a diddler especially, yeah, fuck you. Now look,
• 11:44
Speaker 1: I'm not saying every crime should have the same penalty, right?
• 11:48
Speaker 1: Some things are forgivable. Which one of us has never
• 11:52
Speaker 1: made a mistake? Which one of us has never done
• 11:55
Speaker 1: something we regret? But this is not that. You see,
• 11:59
Speaker 1: I'm not an unreasonable person. And I don't just get
• 12:02
Speaker 1: on this podcast and bash everybody for no reason. If
• 12:05
Speaker 1: you notice a trend here, every single person that we
• 12:08
Speaker 1: talk about in depth, well, how's it turned out for them?
• 12:12
Speaker 1: Not so well, right? There's a reason. And that reason is,
• 12:16
Speaker 1: there's a mountain of evidence pointing... at every single person
• 12:19
Speaker 1: we talk about on this podcast. So if you find
• 12:21
Speaker 1: your name on this podcast, there is a damn good reason. Further,
• 12:26
Speaker 1: it makes little sense to bar unknown victims who may
• 12:29
Speaker 1: live anywhere in the world from coming forward in the future.
• 12:32
Speaker 1: She may decide to come to the U.S. Virgin Islands
• 12:34
Speaker 1: to sue Epstein's estate in its home forum, Pate wrote
• 12:38
Speaker 1: to the court. New York should not rob that victim
• 12:40
Speaker 1: of pursuing punitive damages against Epstein's estate under the U.S.
• 12:44
Speaker 1: Virgin Islands law, the law that Jeffrey Epstein chose to
• 12:48
Speaker 1: live under and that his estate exists under, and that
• 12:51
Speaker 1: is 100% true. Everything should be governed by the USVI law.
• 12:57
Speaker 1: That's where the estate's managed. The court should set aside
• 13:02
Speaker 1: the $ 80 million for future claimants rather than pay out
• 13:05
Speaker 1: Epstein's heirs and enablers paid, argued, 1,000%. There should be
• 13:11
Speaker 1: no money left to the estate when all is said
• 13:13
Speaker 1: and done. In the plainest English possible, this settlement provides
• 13:17
Speaker 1: absolute immunity to the Epstein estate from any future victim lawsuit,
• 13:21
Speaker 1: which logically will protect tens of millions of dollars in
• 13:24
Speaker 1: Epstein's estate. The Epstein estate will then distribute this excess
• 13:28
Speaker 1: money to Indyke and Kahn as Epstein's heirs. This result
• 13:32
Speaker 1: is perverse, he wrote. Further, this class action settlement robs
• 13:36
Speaker 1: victims who may come forward of going to the best
• 13:38
Speaker 1: venue possible for justice, the U.S. Virgin Islands. The Southern
• 13:43
Speaker 1: District of New York planned a teleconference for Tuesday afternoon,
• 13:47
Speaker 1: but under the proposed agreement, the time for other victims
• 13:50
Speaker 1: to come forward has already passed. In order to receive
• 13:54
Speaker 1: funds from the settlement, women who were part of the
• 13:56
Speaker 1: class action suit must have filed out a questionnaire and
• 13:59
Speaker 1: other forms by May 12th. Just another way to screw people.
• 14:04
Speaker 1: And the court should be ashamed of itself. Every time
• 14:08
Speaker 1: you turn around, they're doing something to help these people out.
• 14:11
Speaker 1: And as far as boys in Schiller go, come on, really?
• 14:15
Speaker 1: Anything to get another buck, right? Screw everybody else who
• 14:18
Speaker 1: hasn't come forward as long as we get ours. And
• 14:21
Speaker 1: that's been an ongoing theme with all of these lawyers.
• 14:24
Speaker 1: It's all about the fazools. It's all about the money.
• 14:27
Speaker 1: So we're going to keep an eye on this. And
• 14:29
Speaker 1: when we get some details about what happened at that
• 14:31
Speaker 1: teleconference and about whatever decision was made, we'll get it
• 14:35
Speaker 1: added to the catalog. All the information that goes with
• 14:39
