Transcript
- 0:00Speaker 1: What's up everyone and welcome to another episode of the
- 0:03Speaker 1: Epstein Chronicles. In this episode, we're going to begin taking
- 0:08Speaker 1: a look at the Tova Noel deposition that she gave
- 0:11Speaker 1: to the OIG investigators as part of the investigation into
- 0:16Speaker 1: the death of Jeffrey Epstein. So we're going to skip
- 0:20Speaker 1: over all of the swearing in and all of that
- 0:23Speaker 1: and we're just going to dive in. So once again,
- 0:26Speaker 1: the person asking questions has his name redacted. And Tova
- 0:31Speaker 1: Noel's lawyer is named Mr. Foy. So when Mr. Foy interjects,
- 0:37Speaker 1: and you hear me say Foy, that's what I'm talking about.
- 0:40Speaker 1: And she also has a second attorney with her, Mr. Saraga.
- 0:47Speaker 1: So when either of them object, I'll make sure to
- 0:50Speaker 1: notate that as we're making our way through this. And
- 0:53Speaker 1: the final person that's involved in this is Ms. Gregg,
- 0:57Speaker 1: who is part of the union, I believe, for the
- 1:00Speaker 1: corrections officer, Tova Noel. Redacted, thank you everyone. Ms. Noel,
- 1:07Speaker 1: you're here today as a subject in this DOJ OIG investigation.
- 1:12Speaker 1: This DOJ OIG investigation concerns your alleged misconduct to include
- 1:17Speaker 1: allegations of false statements, job performance failure, security failure, and
- 1:21Speaker 1: reporting false information. This is an official DOJ OIG investigation
- 1:28Speaker 1: and you're being asked... to voluntarily provide answers to our questions.
- 1:32Speaker 1: Will you agree to voluntarily interview with the DOJ, OIG? Ms. Noel, yes. Question,
- 1:38Speaker 1: all right, great. And then everybody that does voluntary interviews
- 1:42Speaker 1: with the DOJ, we provide them with voluntary interview forms.
- 1:46Speaker 1: I don't know if you guys were sent that at
- 1:49Speaker 1: the time, but it says United States Department of Justice,
- 1:52Speaker 1: Office of the Inspector General, warnings and assurances to employee-requested
- 1:57Speaker 1: to provide information on a voluntary basis. You are being
- 2:01Speaker 1: asked to provide information as part of an investigation being
- 2:04Speaker 1: conducted by the Office of the Inspector General. This investigation
- 2:10Speaker 1: is being conducted pursuant to the Inspector General Act of
- 2:13Speaker 1: 1978 as amended. This investigation pertains to your alleged misconduct
- 2:19Speaker 1: to include allegations of false statements, job performance failure, security failure,
- 2:24Speaker 1: and reporting false information. This is a voluntary interview. Accordingly,
- 2:30Speaker 1: you do not have to answer questions. No disciplinary action
- 2:33Speaker 1: will be taken against you if you choose not to
- 2:35Speaker 1: answer questions. Any statement that you furnish may be used
- 2:39Speaker 1: as evidence in any future criminal proceeding or agency, disciplinary proceedings,
- 2:44Speaker 1: or both. And of course, there's the DPA waiver. I
- 2:48Speaker 1: understand the warnings and assurances started above or stated above,
- 2:53Speaker 1: and I'm willing to make a statement or answer questions.
- 2:56Speaker 1: No promises or threats have been made to me and
- 2:59Speaker 1: no pressure or coercion of any kind has been used
- 3:02Speaker 1: against me. You can take a look at this and
- 3:05Speaker 1: review it. If you agree, there's a section there for
- 3:08Speaker 1: your name and signature. Foy, so the only thing that
- 3:12Speaker 1: this is actually subject to is the deferred prosecution agreement? Redacted, well,
- 3:17Speaker 1: so there's the agreement that you had. So that's the
- 3:20Speaker 1: part where I'm talking about the specific part where it
- 3:23Speaker 1: says criminal. That's something I think that was worked out
- 3:27Speaker 1: with the U.S. Attorney's Office. Foy, right, exactly. I know
- 3:31Speaker 1: there is no sort of protection with regard to the
- 3:34Speaker 1: disciplinary internally, the administrative thing. Will happen at some point,
- 3:39Speaker 1: but I just wanted to make that clear. But go ahead,
- 3:41Speaker 1: you can sign, Tova. Redacted, now obviously, that is pursuant
- 3:46Speaker 1: to you answering questions truthfully. Foy, right, of course. That's
- 3:50Speaker 1: the exception to our agreement. Noel, uh-huh. Redacted, all right,
- 3:56Speaker 1: and the rest will be filled out by the two
- 3:58Speaker 1: of us. Foy, okay. Redacted, and thank you for signing, Ms. Noel.
- 4:03Speaker 1: All right, so I'm going to sign where it says
- 4:05Speaker 1: signature of the office of the Inspector General Special Agent. Again,
- 4:10Speaker 1: this is redacted. I'm printing my name. And Special Agent Redacted,
- 4:14Speaker 1: can you fill out the rest of the signature of witness,
- 4:17Speaker 1: name of witness, date, time, and place? Mr. Redacted, this
- 4:22Speaker 1: is Agent Redacted signing on the signature of of witness. Redacted,
- 4:26Speaker 1: and then do you understand the form as you read
- 4:29Speaker 1: and you review? Noelle, yes, I do. Redacted, great, thank you.
- 4:34Speaker 1: Before starting the interview, I'd like to place you under oath.
- 4:37Speaker 1: Can you please raise your right hand? Do you swear
- 4:40Speaker 1: to tell the truth and nothing but the truth during
- 4:42Speaker 1: the interview? Miss Noelle, yes. Question? Thank you, ma'am. All right,
- 4:48Speaker 1: please let me know if you do not understand any
- 4:51Speaker 1: of my questions. Redacted, try to rephrase or ask it
- 4:54Speaker 1: a different way. Noel, okay. Redacted, question. All right, so
- 4:59Speaker 1: this is something we ask everybody. What's your current home address? Noel, redacted.
- 5:06Speaker 1: Thank you. What's your date of birth? Noel, redacted. Question,
- 5:12Speaker 1: and your last four of your social security number? Noel, redacted. Question,
- 5:17Speaker 1: thank you. What's the highest level of education? Noel, bachelor's degree. Question,
- 5:23Speaker 1: and what was your bachelor's degree in? Noel, criminal justice. Redacted,
- 5:27Speaker 1: and where did you receive your degree from? Noel, John Jay. Question,
- 5:32Speaker 1: John Jay in New York City? Noel, yes, sir. Question,
- 5:35Speaker 1: and when did you graduate? Miss Noel, 2017. Redacted, thank you.
- 5:40Speaker 1: What did you do, just briefly, prior to working with
- 5:43Speaker 1: the BOP? Redacted, prior to working with the BOP, I
- 5:49Speaker 1: worked in the post office. Redacted, okay, what did you
- 5:52Speaker 1: do there? Noel, I was a mail handler. Redacted, and
- 5:55Speaker 1: for how long? Noel, six months. Redacted, six months. Noel, uh-huh. Question,
- 6:01Speaker 1: and that was in 2016. When did you do that? Noel, yes. Redacted,
- 6:07Speaker 1: 2015 and 2016. Noel, no, not at the post office.
- 6:11Speaker 1: I was there 2017. Noel, 16, 17. Uh-huh. Redacted, oh, okay.
- 6:18Speaker 1: And do you have any military service? Noel, yes. Question,
- 6:22Speaker 1: and what is that? Noel, military service. Question, yeah. Can
- 6:26Speaker 1: you tell me what the service? Noel, the army. Redacted,
- 6:31Speaker 1: the army. And how long were you in the army? Noel,
- 6:34Speaker 1: six years. Redacted, from when until when? Noel, 2008 to 2014. Redacted,
- 6:41Speaker 1: and what did you do in the military? Noel, I
- 6:44Speaker 1: was a patient administrative specialist. Redacted, and what is that? Noel,
- 6:48Speaker 1: patient admin. Redacted, patient as in, like a hospital? Noelle, yes. Question, okay.
- 6:55Speaker 1: So you worked in a hospital, and what was your
- 6:57Speaker 1: rank when you left the military? Noelle, E4 specialist. Redacted.
- 7:02Speaker 1: And did you leave? Were you honorably discharged? Noelle, yes. Redacted, okay. Foy,
- 7:09Speaker 1: this is the lawyer for Tova Noelle. Can I, one second,
- 7:13Speaker 1: real quick. For the post office, you said 16-17, but
- 7:15Speaker 1: you started MCC in 2018. So would it be 17
- 7:22Speaker 1: into 18? Noelle, 18, yeah. Redacted, you did start with
- 7:26Speaker 1: the BOP in 18? Noelle, yes. Question, not in 16? Noelle, no.
- 7:32Speaker 1: That was an error in Indiscernible. Foy, right. So it's
- 7:37Speaker 1: 18 when she left the post office in 17, going to,
- 7:40Speaker 1: so I think it's 16, no 17, 18. Noelle, 18. Foy,
- 7:46Speaker 1: post office, then MCC. Redacted, Okay, and did you work
- 7:50Speaker 1: for anybody prior or in between your military service and
- 7:54Speaker 1: the post office? Noelle, no. Redacted, no. Okay, so were
- 7:59Speaker 1: you unemployed at that time? Noelle, no, I was going
- 8:02Speaker 1: to school. Redacted, oh, that's when you went to John Jay. Noelle,
- 8:06Speaker 1: that's when I was going to John Jay, yeah. Redacted, okay,
- 8:09Speaker 1: thank you. And then when was your enter on duty
- 8:13Speaker 1: date with BOP? Miss Noelle, June 24th, 2018. Redacted. Okay.
- 8:20Speaker 1: And when did you graduate from BOP training down at
- 8:22Speaker 1: the Federal Law Enforcement Training Center? Noel. I want to
- 8:27Speaker 1: say September of 2018. Redacted. Okay. But you did graduate
- 8:31Speaker 1: from there. Noel. Yes, I did. Redacted. Was that a
- 8:35Speaker 1: correctional officer training? Noel. Yes. Redacted. All right. And when
- 8:40Speaker 1: was your first office assignment with the BOP? Noel. Say
- 8:44Speaker 1: that again. Redacted. when was your first office assignment with
- 8:48Speaker 1: the BOP? So where did you start? Did you start
- 8:52Speaker 1: working in MCC and work there the entire time? Noel, yes, sir. Redacted, okay.
- 8:59Speaker 1: And what position have you had with the BOP? Noel,
- 9:02Speaker 1: correctional officer. Redacted, okay, the entire time? Noel, yes, sir. Redacted,
- 9:08Speaker 1: all right. And when you were there last? You did.
- 9:11Speaker 1: Who did you report to? Who was your direct supervisor?
- 9:14Speaker 1: Or did you have one? Noelle, Lieutenant Redacted. Redacted. And
- 9:19Speaker 1: do you know how to spell that last name? Noelle Redacted.
- 9:23Speaker 1: Question from Redacted. Thank you. What is your current? Again,
- 9:26Speaker 1: this is something we ask everybody. We won't be contacting
- 9:29Speaker 1: your client. But what is your current cell number? Noelle Redacted. Mr. Redacted. Okay.
- 9:35Speaker 1: And how long have you had that number? Noelle, years. Redacted, years. Noelle, uh-huh. Redacted,
- 9:41Speaker 1: so for a long time. Noel, yes. Redacted, and to
- 9:45Speaker 1: include in 2019? Noel, yes. Redacted, okay, so any other
- 9:50Speaker 1: cell phone numbers? Noel, no. Redacted, okay, and your current
- 9:55Speaker 1: email address? Noelle, um, redacted. Redacted, ask a question. Okay, great.
- 10:01Speaker 1: And have you had that one for years also? Noelle, yes. Redacted, okay.
- 10:06Speaker 1: Any others? Noelle, yes. Redacted. What are the others? Noelle, uh, redacted. Mr. Redacted,
- 10:15Speaker 1: you've had that for years? Noelle, yes. Questioned. Okay, both
- 10:20Speaker 1: in 2019? Noel, yes. Redacted, okay, thank you. Do you
- 10:24Speaker 1: have any current? I should have asked this. Are you
- 10:26Speaker 1: currently employed right now? Noel, no. Redacted, by no other means? Noel, no. Question, okay,
- 10:33Speaker 1: and when did you last work at the MCC? Noel,
- 10:37Speaker 1: August 10th, 2019. Redacted, and was that the same supervisor
- 10:42Speaker 1: that you mentioned? Noel, yes. Redacted, okay, briefly, what training
- 10:47Speaker 1: have you attended or conducted during your employment with the BOP?
- 10:51Speaker 1: You mentioned the correctional officer training at FLETC. What other
- 10:56Speaker 1: training have they provided you? Noel, there's two-week training when
- 11:01Speaker 1: you first start at BOP. I forget what it's called. Redacted,
- 11:05Speaker 1: I have training. Noel, uh-huh. Redacted, and any other training? Noel, no. Redacted,
- 11:11Speaker 1: annual refresher training? Noel, I have one. Redacted, okay, so
- 11:16Speaker 1: you've gone to annual, and what about like a shoe
- 11:19Speaker 1: training course? Noel, no. Redacted, okay, but you did, and
- 11:24Speaker 1: this is just, you guys can take a look at
- 11:26Speaker 1: this if you would like. This is the training that
- 11:28Speaker 1: we have for you, that we asked for your list
- 11:31Speaker 1: of training. I'm not asking you to necessarily verify that
- 11:35Speaker 1: you've conducted all of it, but it shows the last
- 11:37Speaker 1: time you did your annual training was on 3-8-2019. was
- 11:42Speaker 1: when you actually completed that week of training. Noelle, yes. Redacted,
- 11:46Speaker 1: does that sound correct? Noelle, correct. Question again. This just
- 11:51Speaker 1: goes along with it. It shows what the syllabus was,
- 11:54Speaker 1: as well as the sign-in sheet where Ms. Noelle signed in. Again,
- 11:58Speaker 1: we're not asking you to, or for. If you want
- 12:01Speaker 1: to take a look at this, you can. It shows
- 12:04Speaker 1: that you did the training in March of 2019. And
- 12:07Speaker 1: anything that I'm going to provide to you, can you
- 12:10Speaker 1: just initial and date? And that's just a way for
- 12:12Speaker 1: us to verify that that's what we showed you. Noelle, okay. Foy,
- 12:17Speaker 1: each page or just the top? Redacted, nope, just the
- 12:20Speaker 1: top of the page. Foy, okay. Redacted, no, you do
- 12:25Speaker 1: have that. So just briefly, you don't have to like
- 12:28Speaker 1: list off the course syllabus. But what did they cover
- 12:31Speaker 1: during the annual training? Noelle, they spoke about different areas,
- 12:35Speaker 1: like dealing with inmates. They spoke about the issues on
- 12:38Speaker 1: the job, like dealing with shortages. They spoke about basically
- 12:42Speaker 1: like mask fitted, I remember. Redacted mask fitting? Noelle, uh-huh. Redacted.
- 12:49Speaker 1: Was that back in 2019? People were wearing masks as well? Noelle, no,
- 12:53Speaker 1: like redacted. It's for OC sprays? Redacted. Oh, for OC spray. Noelle, yeah. Redacted. Okay.
- 13:02Speaker 1: Did they include things like ethics standards or conduct? Noelle, yes. Redacted.
- 13:07Speaker 1: What about like counts and rounds? Noelle. I don't recall
- 13:11Speaker 1: them talking about counts and rounds. Redacted, okay, so did
- 13:14Speaker 1: they go over like MCC policy and guidance? Noelle, yes. Redacted, okay,
- 13:20Speaker 1: and did they ever provide you with the policies and
- 13:23Speaker 1: guidelines or did they just speak to you about it? Noelle,
- 13:26Speaker 1: for in training? Redacted, yes. Noelle, they just spoke about it. Question,
- 13:32Speaker 1: at another time did they provide you with the policies
- 13:35Speaker 1: and guidelines? Noelle, yeah, it's on like the computer. Redacted, okay.
- 13:41Speaker 1: Do you have to certify that you like received it
- 13:44Speaker 1: and you reviewed it? Policies and guidelines? No, well, I
- 13:47Speaker 1: think I signed that like you received it. Redacted, right. Okay,
- 13:52Speaker 1: if you don't mind. He asked her to sign the paper.
- 13:57Speaker 1: You want it in the lower right? Redacted, doesn't matter.
- 14:00Speaker 1: Top or bottom? You know, wherever there's room. I typically
- 14:03Speaker 1: do the top, but bottom is totally fine. All right, folks,
- 14:05Speaker 1: we're going to wrap up with the first episode here.
- 14:08Speaker 1: And in the next episode dealing with the topic, we're
- 14:10Speaker 1: going to pick up where we left off. All the
- 14:13Speaker 1: information that goes with this episode can be found in
- 14:16Speaker 1: the description box. What's up everyone and welcome to another
- 14:20Speaker 1: episode of the Epstein Chronicles. In this episode, we're getting
- 14:24Speaker 1: right back to that Tova Noel interview with the OIG investigators. Redacted,
- 14:30Speaker 1: and now you mentioned that you didn't quite remember them
- 14:33Speaker 1: going over training when conducting counts and rounds in this training.
- 14:37Speaker 1: Did you, were you, did you ever receive training on
- 14:40Speaker 1: conducting counts and rounds? Miss Noel, yes. Redacted, okay. When
- 14:45Speaker 1: would that have been? Noel, in an IF training. Redacted,
- 14:49Speaker 1: and what does IF stand for? Noel, huh? Redacted, you
- 14:55Speaker 1: want some clarity? I can tell you. Mr. Redacted, sure. Redacted,
- 15:00Speaker 1: just what it stands for. Institution familiarization training. Redacted, okay, great.
- 15:06Speaker 1: And that's something that the MCC provided directly, Ms. Noel? Yes. Redacted, okay, great.
- 15:14Speaker 1: And then you had mentioned, did you ever receive policy
- 15:17Speaker 1: on counts and rounds? Noel, no. Redacted, I know you
- 15:23Speaker 1: said you certified. Do you remember that specific policy, like
- 15:27Speaker 1: receiving that? Noel, like specifically on counts and rounds? Redacted,
- 15:33Speaker 1: I'm not asking you to like verbatim tell me what
- 15:35Speaker 1: it was. I'm just saying. Like, were you provided and
- 15:38Speaker 1: you reviewed it? Do you remember? Noelle, not specifically on
- 15:42Speaker 1: counts and rounds. Just like a general. She gets cut off, right? Noelle, like?
- 15:48Speaker 1: She gets cut off again. Like, you know, the housing
- 15:50Speaker 1: orders or unit policy and things like that. When you're
- 15:53Speaker 1: supposed to conduct counts. When you're supposed to do rounds.
- 15:57Speaker 1: That type of thing. Redacted the post orders. Redacted post orders, right. Okay, great.
- 16:04Speaker 1: You mentioned you didn't remember. Ever going to quarterly shoe training?
- 16:08Speaker 1: This is a sign-in sheet for quarterly shoe training. Is
- 16:12Speaker 1: this your signature? On there for June 26, 2019? Noelle,
- 16:17Speaker 1: you see how I'm last one on the bottom of
- 16:19Speaker 1: all of them? Redacted, correct? Noelle, because I wasn't at
- 16:22Speaker 1: the training. When I came. Redacted, did they provide it
- 16:26Speaker 1: to you one-on-one though? Noelle, no. Redacted, so how come?
- 16:30Speaker 1: He gets cut off by Noelle. Because when I came
- 16:33Speaker 1: back from an injury, the lieutenant asked me to sign
- 16:36Speaker 1: because they had program review. They need to show that
- 16:39Speaker 1: I received the training, but I never did. She just
- 16:42Speaker 1: asked me to sign. That's why I wonder why. Redacted,
- 16:45Speaker 1: who asked you to do that? Noelle, lieutenant redacted. Redacted,
- 16:50Speaker 1: so that supervisor you mentioned was your first line supervisor?
- 16:54Speaker 1: Ask you to sign without providing you the training? Noelle, yes. Redacted,
- 16:58Speaker 1: and she didn't like provide you anything to review? Noelle, no. Redacted,
- 17:03Speaker 1: she didn't go over anything with you? Noel, no. Redacted,
- 17:07Speaker 1: did you discuss this with her? That how you can
- 17:10Speaker 1: sign something without being provided the training? Noel, well, I
- 17:14Speaker 1: just told her I wasn't here. I was out on
- 17:17Speaker 1: an injury. She said she knows, but she needed me
- 17:19Speaker 1: to sign because they need it for a program review. Redacted,
- 17:24Speaker 1: what's her first name? Noel, redacted. Question, and is she
- 17:29Speaker 1: a lieutenant? Noel, I don't know what she is now.
- 17:32Speaker 1: But she's not at MCC anymore. She's somewhere in Jersey. Redacted.
- 17:36Speaker 1: I'm sorry, before you go, are you done with that question? Redacted. Actually,
- 17:41Speaker 1: let me. Um, I didn't do this. And I did
- 17:45Speaker 1: forget to do this. There's an advisory to the union representative. Redacted. Question.
- 17:52Speaker 1: Can you review this? And I do apologize. But since
- 17:55Speaker 1: you're speaking up a little bit, let me hand this
- 17:57Speaker 1: to you. And then you can review that. And then
- 18:00Speaker 1: if you want to just take a look after you're
- 18:02Speaker 1: done reviewing, you may sign it if you agree. Redacted,
- 18:06Speaker 1: will you be able to give me a copy of it? Question, yeah.
- 18:10Speaker 1: I think it says on that that there will be
- 18:12Speaker 1: forwarded a copy to you. Redacted, I didn't even see
- 18:15Speaker 1: that part. Question, should I continue asking questions while she's
- 18:19Speaker 1: reviewing that? Or do you want to wait? Foy, yeah,
- 18:22Speaker 1: you can ask questions, absolutely. Redacted, sure. So there's another
- 18:26Speaker 1: training that you, it says that you conducted. On July 26, 2019,
- 18:32Speaker 1: for shoe suicide prevention training. Do you also not receive
- 18:35Speaker 1: that training? Noelle, yeah, I didn't. Redacted, you did not
- 18:39Speaker 1: receive that training. Noelle, no. Redacted, did you receive? So
- 18:43Speaker 1: there are slides in the back that show the training
- 18:46Speaker 1: and how they conducted it. Did they provide you with
- 18:48Speaker 1: those slides? Noelle, no, because I wasn't there. Redacted, you
- 18:54Speaker 1: weren't there. Noelle, I was out with an injury. Redacted, okay.
- 18:58Speaker 1: When were you out with an injury? What are the dates?
- 19:01Speaker 1: Noel from March 2019. I came back in June. So
- 19:05Speaker 1: when I came back in June, that's when I was
- 19:07Speaker 1: told to sign this. Redacted, okay. Question, all right. Thank
- 19:12Speaker 1: you for signing the advisory to union representative. Redacted, I'm
- 19:18Speaker 1: just going to sign that form as name of OIG
- 19:21Speaker 1: special agent. Again, I do apologize for not providing that
- 19:24Speaker 1: up front. Noelle, I want to call because, indiscernible, I'm
- 19:30Speaker 1: just saying that, well, I know that the dynamics are
- 19:33Speaker 1: that I should interrupt you in the middle of a question,
- 19:36Speaker 1: but interrupt her answering a question. So I was just asking,
- 19:39Speaker 1: were you done? Because I wanted to just step out
- 19:41Speaker 1: for a second. Redacted, you want to step out? Noelle, uh-huh. Redacted, okay.
- 19:46Speaker 1: We don't want to interrupt the interview because we have
- 19:49Speaker 1: a lot of questions to get through. Redacted, mm-hmm. Question,
- 19:53Speaker 1: if the attorneys ask that, that's not really, but if
- 19:56Speaker 1: you would like to. Redacted, so based on the agreement
- 19:59Speaker 1: we just signed, right? Redacted, sure. The union rep, it
- 20:03Speaker 1: acknowledges the right to have me representing her, and part
- 20:06Speaker 1: of those rights are the ability to assist in representing her, right?
- 20:10Speaker 1: And so I don't want to dispute, and I don't
- 20:12Speaker 1: want to hold up the process at all. I just
- 20:15Speaker 1: want to say something to her. Redacted, sure. Let that, redacted,
- 20:19Speaker 1: do that this time. But if this continues to happen,
- 20:22Speaker 1: I'm going to have to give you a different form
- 20:24Speaker 1: that says you can stay here voluntarily if you want,
- 20:26Speaker 1: but we're going to ask you not to interrupt the interview.
- 20:29Speaker 1: And if you do, we're going to ask her if
- 20:32Speaker 1: she wants to continue with the interview without you. Misredacted, so...
- 20:37Speaker 1: But that form says something contrary to what you're saying. Redacted,
- 20:42Speaker 1: I'm going to give you a different form that says
- 20:44Speaker 1: that I'm going to let you interrupt the interview now
- 20:46Speaker 1: to talk to her out there. And if you do
- 20:48Speaker 1: it again, I'm going to ask you not to be
- 20:51Speaker 1: here any longer so that we can continue with the interview. Obviously,
- 20:55Speaker 1: her attorneys would stay here. So I just want to
- 20:57Speaker 1: make sure that we don't just continue. Miss Redacted, I
- 21:03Speaker 1: just need clarity then. I need clarity. Redacted, sure. Miss Redacted,
- 21:07Speaker 1: so the representing of and talking to the employee who
- 21:10Speaker 1: I have the right to represent is considered by you
- 21:13Speaker 1: an interruption of the interview? Mr. Redacted, we haven't even
- 21:16Speaker 1: gotten to the questions yet. Miss Redacted, well, she gets
- 21:21Speaker 1: cut off by the OIG investigator. Yes, we need to
- 21:24Speaker 1: continue with the interview, but we're now, I can allow
- 21:27Speaker 1: you to do that now. I'm just not going to
- 21:29Speaker 1: be able to allow you to continue to stop the
- 21:31Speaker 1: interview and leave the room. Miss Redacted, I'm just asking
- 21:35Speaker 1: for clarity, right? So it was kind of. He cuts
- 21:38Speaker 1: her off. Sure, absolutely. Misredacted. And I don't mean to
- 21:42Speaker 1: be difficult. It kind of was yes or no. So
- 21:45Speaker 1: you're saying to me, based on the document that I signed, Mr. Redacted,
- 21:49Speaker 1: I'm saying that you can assist her. Redacted. I didn't
- 21:52Speaker 1: get to. Mr. Sure, go ahead. Misredacted. Okay, so you're saying,
- 21:57Speaker 1: based on the document that I signed, it's my right
- 22:00Speaker 1: to represent the employee. which is asking to caucus and
- 22:04Speaker 1: say something to Ms. Noel, is interrupting the interview, even
- 22:07Speaker 1: though I have the right to do so based on
- 22:09Speaker 1: the document I signed. Mr. Redacted, it's more for her
- 22:13Speaker 1: to be able to ask you for a question. Redacted,
- 22:17Speaker 1: so it's just a yes or no. The interviewer, oh, oh, no, no.
- 22:22Speaker 1: I'm the one that's leading the interview here. So if
- 22:24Speaker 1: she stops and asks you for clarity, absolutely. You stopping
- 22:27Speaker 1: to inform her, no. Redacted, I never identified to you
- 22:31Speaker 1: that I would be informing her of anything. Mr. Redacted, okay,
- 22:35Speaker 1: but so yes. To answer your question, you can be here.
- 22:39Speaker 1: To represent her, if she's asking you for information, I
- 22:42Speaker 1: don't want you stopping our interview. Ms. Redacted, mm-hmm. Question,
- 22:47Speaker 1: and then asking to leave the room. I'm going to
- 22:50Speaker 1: allow it this time. After that, I'll consider that an
- 22:52Speaker 1: interruption of the interview. Ms. Redacted, mm-hmm. Question, and then...
- 22:59Speaker 1: We have to proceed from there. And then there's different
- 23:01Speaker 1: form to provide you. So does that make sense? Misredacted. No,
- 23:04Speaker 1: it doesn't. Question. Okay. So I'm asking you not to interrupt. Misredacted. Wait.
- 23:10Speaker 1: It doesn't make sense, but I'm not. That was. He
- 23:13Speaker 1: cuts her off. So I'm asking you not to interrupt
- 23:15Speaker 1: the interview. She may defer to you and ask you
- 23:18Speaker 1: for questions. Misredacted. Uh-huh. I'm asking you not to interrupt
- 23:23Speaker 1: my questions. Misredacted. Okay. It doesn't make sense to me.
- 23:27Speaker 1: What I'm. Interpreting is my ability to represent is only
- 23:31Speaker 1: if the employee asks a question. That's what you're saying
- 23:34Speaker 1: to me. Redacted. Correct. So her attorneys are here. Misredacted.
- 23:41Speaker 1: I got it. I got it. Redacted. Her attorneys are here.
- 23:44Speaker 1: I'm asking if she has a question from her union representative. Misredacted. Uh-huh. Redacted.
- 23:50Speaker 1: She may have a question for you. Misredacted. I got it. Question.
- 23:54Speaker 1: I'm asking you not to interrupt. Miss Redacted, I got it. Redacted,
- 24:00Speaker 1: these questions are not for you. They're not directed at you.
- 24:04Speaker 1: They're directed at Miss Noel. Miss Redacted, I'm not answering questions.
- 24:09Speaker 1: I'm just trying to. I'm representing her. But I understand
- 24:12Speaker 1: that there has been a determination of how I'm able
- 24:14Speaker 1: to represent. And so, Redacted, deal with that in a
- 24:17Speaker 1: different venue. You can move forward. Mr. Redacted, all right,
- 24:21Speaker 1: let me read this real quick in the paperwork so
- 24:24Speaker 1: that we're not going to have any disputes. Ms. Redacted,
- 24:29Speaker 1: we don't have to. You don't have to continue, right?
- 24:31Speaker 1: Because I don't want to interrupt. So you can go
- 24:33Speaker 1: forward and ask questions. Redacted, okay, so it just says
- 24:37Speaker 1: that you may not attempt to answer the questions or
- 24:41Speaker 1: dictate the employee's actions to question or otherwise take charge
- 24:45Speaker 1: of proceedings. But again, please feel free to go confer
- 24:49Speaker 1: with Ms. Noel. Ms. Redacted, I appreciate it. Thank you. Redacted,
- 24:54Speaker 1: I'm going to pause the recording. It's currently 10.32 a.m.,
- 24:58Speaker 1: whereupon the above entitled matter went off the record and
- 25:02Speaker 1: went back on the record. Okay, the recorder is back on.
- 25:05Speaker 1: This is 10.38 a.m., Tuesday, June 22, 2021. This is
- 25:10Speaker 1: Senior Special Agent Redacted. We're resuming the interview. Ms. Noel,
- 25:15Speaker 1: I just remind you that you are under oath, and
- 25:18Speaker 1: this is a voluntary interview. What was your question? Redacted.
- 25:23Speaker 1: You need me to initial? Redacted. If you don't mind.
- 25:26Speaker 1: And again, it's just to show that you know what
- 25:28Speaker 1: we're looking at. Redacted. Now, since we took that break,
- 25:32Speaker 1: is there anything else? He gets cut off by the
- 25:36Speaker 1: union rep. No, we can move forward. No, well, no,
- 25:38Speaker 1: thank you. Redacted. Thank you again very much for your
- 25:42Speaker 1: cooperation in this matter. Is there anything else you wanted?
- 25:46Speaker 1: All right. Do you know where we left off? What
- 25:48Speaker 1: was the last question that we asked? It was what
- 25:51Speaker 1: we asked for in Discernible about the injuries. All right, folks,
- 25:55Speaker 1: we're going to wrap up right here. And in the
- 25:57Speaker 1: next episode dealing with the topic, we're going to pick
- 25:59Speaker 1: up where we left off. All the information that goes
- 26:03Speaker 1: with this episode can be found in the description box.
- 26:06Speaker 1: What's up, everyone? And welcome to another episode of the
- 26:10Speaker 1: Epstein Chronicles. In this episode, we're going to pick up
- 26:13Speaker 1: where we left off with the deposition given by Tova
- 26:18Speaker 1: Noel to the OIG investigators. Question, okay, so you were
- 26:23Speaker 1: telling us you said March through June you were injured. Ms. Noel, yes. Question,
- 26:29Speaker 1: and you were not actually working during that time? Noel, no. Question,
- 26:34Speaker 1: do you remember around when in March and when did
- 26:37Speaker 1: it end? Was it the beginning of March and the
- 26:39Speaker 1: March middle? Noel, I'm not sure. I just know it
- 26:42Speaker 1: was March. Redacted sometime in March? Noel, yes. Redacted, but
- 26:47Speaker 1: when you came back, was it around the 26th when
- 26:50Speaker 1: they asked you to sign those? Noelle, I came back
- 26:53Speaker 1: in June. I don't recall the exact date. Redacted, okay. Noelle,
- 26:59Speaker 1: but I remember the day that I came into work,
- 27:02Speaker 1: and the lieutenant asked me to go see Lieutenant Redacted,
- 27:05Speaker 1: and she asked me to sign, and I said, but
- 27:07Speaker 1: I wasn't here. I was out on injury. And she
- 27:10Speaker 1: said she's aware, but they need me to sign it
- 27:13Speaker 1: for the program review. Redacted, okay. Noelle, so I signed. Redacted,
- 27:18Speaker 1: so both training, when you signed, they didn't actually even
- 27:21Speaker 1: provide you anything? Noelle, no. Redacted verbally, electronically, nothing? Noelle, no. Question, okay,
- 27:29Speaker 1: and what was on the date that was signed that
- 27:32Speaker 1: that happened? Noelle, actually, she told me not to date it.
- 27:36Speaker 1: I remember when I was signing, she said, don't date it. Redacted,
- 27:40Speaker 1: but you dated it anyway? Did you have a conversation
- 27:42Speaker 1: about that? Noelle, no. Redacted, After you dated it, she
- 27:47Speaker 1: didn't say. Why did you date it or anything like that? Noel, no. Redacted. Question. Okay.
- 27:54Speaker 1: Did you receive that training through in the annual training
- 27:57Speaker 1: courses as well? Like the suicide prevention, you know, how
- 28:01Speaker 1: to operate in the shoe during MCC annual or the,
- 28:05Speaker 1: I think you call it the IF training or during
- 28:08Speaker 1: the correctional officer training at FLETC. Noel, those trainings are
- 28:13Speaker 1: like general overall training. It's not specifically speaking about shoe.
- 28:20Speaker 1: Like shoe may come up in the conversations, but it's
- 28:22Speaker 1: not specific to shoe or how to operate or run
- 28:25Speaker 1: the shoe. Redacted, okay. Noel, uh-huh. Redacted, do you know
- 28:32Speaker 1: if they were doing this with other employees as well,
- 28:34Speaker 1: having them sign training that weren't actually conducting? Noel, I
- 28:38Speaker 1: don't know. Redacted, okay. But did you do this per
- 28:42Speaker 1: the directions of your supervisor? Noel, supervisor, yes. Redacted. So she,
- 28:48Speaker 1: did she, specifically, you must sign this? Noelle, yes. Redacted. Okay, again.
- 28:52Speaker 1: And that was redacted. Noelle, redacted. Question. And you said,
- 28:58Speaker 1: and I apologize, I don't know if we interrupted when.
- 29:02Speaker 1: Where did you say she is currently? Noelle, she is
- 29:05Speaker 1: in Jersey. I know. I'm trying to. Redacted. At the
- 29:09Speaker 1: FCI Fort Dix? Noelle, yes. Redacted. Okay. Mr. Foye. question
- 29:15Speaker 1: real quick. Redacted, absolutely. Do you want a more precise
- 29:18Speaker 1: answer to when she was out and when she came back? Foy,
- 29:23Speaker 1: because I happen to know the approximate dates. Redacted, sure,
- 29:27Speaker 1: you can provide that. Foy, and this is based on
- 29:30Speaker 1: my review of Discovery and Conversations with Miss Noelle. We're
- 29:34Speaker 1: looking at about March 15th to June 24th-ish. Redacted, okay. Foy,
- 29:40Speaker 1: And I note that the execution was on the 26th.
- 29:43Speaker 1: But I think there was some time, you know. It's
- 29:45Speaker 1: not like the first minute. She was there. They had
- 29:48Speaker 1: her sign the document. Redacted, okay. Noelle, right. Foy. So
- 29:54Speaker 1: those are the estimated times. I could be off by
- 29:56Speaker 1: a day or two, but... The 15th of March. To
- 29:59Speaker 1: June 24th. Redacted. During your time at the MCC, how
- 30:04Speaker 1: often were you assigned to the special housing unit, also
- 30:07Speaker 1: known as the SHU? Noel? Hmm. Redacted. And this is
- 30:13Speaker 1: an approximate. I'm not asking you for like the exact amount. Noel,
- 30:18Speaker 1: when I came back from injury, my assignment was the SHU.
- 30:21Speaker 1: So from June 20, whatever, to August 10th, I worked
- 30:25Speaker 1: the SHU. Redacted. Okay. and that was your quarterly assignment,
- 30:29Speaker 1: was in the SHU for the whole summer in 2019? Noelle, yes. Redacted, okay,
- 30:35Speaker 1: thank you. So I know that you said you didn't.
- 30:38Speaker 1: They didn't provide you with SHU training. Did they provide
- 30:41Speaker 1: you with the policies of the SHU? Noelle, no. Redacted,
- 30:46Speaker 1: so you never received those policies. Would it have been
- 30:50Speaker 1: when you received and you said you had initial and
- 30:52Speaker 1: date something electronically? I think you said when you were provided...
- 30:56Speaker 1: He gets cut off by Noel. That's the employee code
- 30:59Speaker 1: of conduct. Redacted. Okay. Noel. Like the handbook that's online. Redacted.
- 31:05Speaker 1: Should have they provided you with the policies and post
- 31:09Speaker 1: orders in the shoe? Noel. In the shoe, there is
- 31:12Speaker 1: post orders. Redacted. Oh, okay. So in the shoe. There's
- 31:16Speaker 1: the post orders. Noelle, yes. Redacted. And you were provided
- 31:20Speaker 1: with a copy of that to review? Noelle, yes. Redacted.
- 31:24Speaker 1: And had you reviewed that? Noelle, yes. Redacted. Okay. And
- 31:28Speaker 1: when did you review that? Noelle, when I came back. Redacted.
- 31:32Speaker 1: So sometime in June. Noelle, in June. Question. Okay. So
- 31:38Speaker 1: aside from those post orders, did you receive any other
- 31:41Speaker 1: shoe training? Noel, no. Redacted, no. And who was responsible
- 31:48Speaker 1: for making sure that you actually did receive shoe training? Noel,
- 31:52Speaker 1: I don't know. Redacted, you don't know? Was that a
- 31:55Speaker 1: lieutenant issue? Or your first line supervisor? Noel, I would
- 31:59Speaker 1: assume the lieutenant, my supervisor, I don't know. Redacted, and
- 32:04Speaker 1: when you say the lieutenant, who was the lieutenant in
- 32:06Speaker 1: the shoe at the time? Noel, Lieutenant Redacted. Mr. Redacted, question,
- 32:12Speaker 1: do you know his first name? Noel, redacted. Question, okay.
- 32:16Speaker 1: And would he be responsible for making sure that you
- 32:19Speaker 1: were training when you were in the shoe? Noel, I mean,
- 32:22Speaker 1: I'm going to direct that question to her. I don't know. Question,
- 32:28Speaker 1: I don't want you to direct a question to her. Noel, okay. Redacted.
- 32:32Speaker 1: But if you need to like, yeah, that's fine. Redacted, yeah. Noel, yeah. Redacted.
- 32:38Speaker 1: And if you don't know, that's totally acceptable. Noel, yeah,
- 32:42Speaker 1: because I don't know. Redacted, okay, no, no, that's a
- 32:46Speaker 1: totally acceptable answer. Noel, uh-huh. Redacted, so yeah, if you know,
- 32:51Speaker 1: if you don't know something, or you know something, that's great.
- 32:54Speaker 1: You don't really want to ask other people for the answers. Noel, right. Redacted,
- 32:59Speaker 1: you know, obviously, if you need to confer, and you know,
- 33:03Speaker 1: with your attorneys or your union rep, absolutely fine. But
- 33:07Speaker 1: we just want to try to get away from them
- 33:09Speaker 1: answering for you. Noel, okay. Redacted, all right. And then
- 33:13Speaker 1: from your recollection though, you don't remember receiving shoe training
- 33:17Speaker 1: during the annual refresher training? Noelle, no. Redacted, no. Okay.
- 33:22Speaker 1: Did you receive training on how to conduct rounds? Noelle, yes. Redacted.
- 33:27Speaker 1: And when was that? Noelle, NIF. Redacted, NIF. Noelle, yep. Question, okay.
- 33:35Speaker 1: And what did it teach you about conducting rounds? Noelle,
- 33:39Speaker 1: that you need two people to count and conduct rounds.
- 33:42Speaker 1: And one person goes and counts. The other person goes
- 33:45Speaker 1: and counts. And then you confirm the numbers of counting. Question, okay, Noel.
- 33:52Speaker 1: And make sure, when you're counting, that you're counting everybody
- 33:55Speaker 1: standing at their bed when you're counting. Redacted, okay, and
- 33:59Speaker 1: did you receive suicide prevention training during the MCC annual
- 34:03Speaker 1: refresher training? Noel, I don't recall. Redacted, question, you don't recall. Noel, uh-huh. Question, okay,
- 34:12Speaker 1: what was your understanding if an inmate was placed, you know,
- 34:15Speaker 1: is suicidal, or placed on suicide watch? What was your
- 34:19Speaker 1: understanding of how you should treat those inmates? Noel, if
- 34:22Speaker 1: an inmate is placed on suicide watch, I don't deal
- 34:25Speaker 1: with them. They go downstairs to suicide watch, and they're
- 34:29Speaker 1: being watched by other inmates. Question, uh-huh, Noel, but, and then,
- 34:35Speaker 1: when they're cleared, they come back to the unit. Question,
- 34:40Speaker 1: and you're trained. Are you supposed to handle them differently
- 34:43Speaker 1: when they come back to the unit? Noel, uh-huh, no. Redacted,
- 34:47Speaker 1: you're not. Noel, you're not. Question, you're not supposed to
- 34:52Speaker 1: handle them differently. Noel, no. Question, not at all. Noel,
- 34:57Speaker 1: because they're cleared to come back. Question, okay. Noel, so
- 35:01Speaker 1: once you're cleared, you're back to normal. Redacted, okay, and
- 35:05Speaker 1: were you assigned to the SHU on August 9th and
- 35:07Speaker 1: 10th of 2019? Noel, yes. Redacted, do you recall what
- 35:12Speaker 1: time you began working on the shoe? On August 9th, Noel,
- 35:16Speaker 1: 4 to midnight. Redacted, 4 to midnight. And then on
- 35:20Speaker 1: August 10th, it was Noel, midnight to 8 in the morning. Question, okay.
- 35:27Speaker 1: You said again, that was your quarterly bidded post. Noel, yes.
- 35:31Speaker 1: Redacted quarterly assignment. And what were your overall duties and
- 35:35Speaker 1: responsibilities when you were assigned to the shoe? No, well,
- 35:40Speaker 1: it varies because I'm new and because I don't know
- 35:42Speaker 1: how to run the shoe. I just always rely on
- 35:45Speaker 1: the senior person that I'm working with. So even if
- 35:48Speaker 1: the roster reflects that on the senior officer, because sometimes
- 35:51Speaker 1: I'm assigned to the shoe, I don't do what shoe
- 35:54Speaker 1: is supposed to do because I don't know how to
- 35:57Speaker 1: do it. I rely on the senior officer that I'm
- 35:59Speaker 1: working with. Question. Okay, so you didn't really know what
- 36:04Speaker 1: your duties and responsibilities were. Is that what you're saying? Noelle,
- 36:08Speaker 1: in the shoe like um, to give out food, to
- 36:11Speaker 1: collect the trays, to give out linen, collect linen. Whenever
- 36:14Speaker 1: we would go downrange to give out those, we count
- 36:17Speaker 1: that as a round to make sure the inmates are good.
- 36:20Speaker 1: You shower every other day, count, that's it. Redacted so
- 36:24Speaker 1: rounds and counts are part of that though. Noelle, rounds
- 36:28Speaker 1: and counts are part of it, but I never worked
- 36:30Speaker 1: in the shoe and actually done rounds every 30 minutes.
- 36:33Speaker 1: We go downrange to do stuff and we count it
- 36:36Speaker 1: as a round. Redacted, perfect. That's going to be something
- 36:40Speaker 1: that we're going to discuss. Noel, uh-huh. Redacted. And ask
- 36:45Speaker 1: you things like, who told you that? And how's that?
- 36:48Speaker 1: You know, who should have provided you with the proper
- 36:50Speaker 1: training and information on how it was technically supposed to
- 36:54Speaker 1: be done? Noel, uh-huh. Redacted. Question. And were there any requirements,
- 37:00Speaker 1: special requirements, for inmates who were assigned to the SHU? Noel,
- 37:04Speaker 1: I don't know. Question. That's fine. Do inmates in the
- 37:08Speaker 1: shoe have cellmates? Noelle, yes. Question. Okay. And are they
- 37:12Speaker 1: required to have a cellmate? Noelle, I'm not sure. Question.
- 37:16Speaker 1: You're not sure. Noelle, uh-huh. Redacted. Question. And do you
- 37:21Speaker 1: know why they wouldn't have a cellmate? Noelle, I don't know. Question.
- 37:25Speaker 1: Did you ever, were you ever told it's because another
- 37:28Speaker 1: inmate could harm that inmate? Or there were certain classifications
- 37:32Speaker 1: of inmates. They never discussed that with you? Noelle, no. Question. No. Okay, no.
- 37:38Speaker 1: Did you ever see training on medical emergencies with inmates? Noelle, no.
- 37:43Speaker 1: I just know like if you were making a round
- 37:46Speaker 1: and something happens to an inmate, you call and you
- 37:49Speaker 1: wait for somebody to come before you enter the cell.
- 37:52Speaker 1: That's all I know. Question, okay, but did you, were
- 37:56Speaker 1: you provided like CPR training or any kind of like,
- 37:59Speaker 1: you know, if something were to happen in front of you,
- 38:02Speaker 1: how would you respond? Noelle, yes, we also need bear training. Redacted, okay,
- 38:09Speaker 1: and when would you conduct training like that CPR training or,
- 38:13Speaker 1: you know, if someone is trying to kill themselves or
- 38:15Speaker 1: something like that? When did you receive the training? How
- 38:18Speaker 1: would you respond to a medical emergency? Noelle, that was
- 38:22Speaker 1: an IF. Question, IF as well? Noelle, uh-huh. Question, okay,
- 38:28Speaker 1: so who is or was inmate Jeffrey Epstein? Noelle, who
- 38:32Speaker 1: was he? Question, who was he? Was he an inmate
