Transcript
- 0:00Speaker 1: A landmark decision has been handed down in the War
- 0:02Speaker 1: against gangs. Judge Peter Andrew has ruled that Headhunter's boss
- 0:07Speaker 1: Wayne Boyle must forfeit fifteen million dollars in assets. Police
- 0:12Speaker 1: argued that Doyle's assets were a direct result of criminal
- 0:15Speaker 1: activity and he was, in fact the gang's president, not
- 0:17Speaker 1: just your average Joe Blog's member. Police Association President Chris
- 0:22Speaker 1: Carr hills with me. Now, Chris, good morning.
- 0:25Speaker 2: Good morning, Ryan.
- 0:25Speaker 1: Hey, it's a long time to get fifteen million dollars
- 0:29Speaker 1: ten years through the courts.
- 0:32Speaker 2: Yeah, it's been a very long process, a lot of
- 0:34Speaker 2: very hard work. But this is something police have looked
- 0:37Speaker 2: at for many, many years, and it took a change
- 0:40Speaker 2: in legislation to sort of enable police to be able
- 0:42Speaker 2: to get to where they've got. But it's a massive result.
- 0:45Speaker 2: I mean, normally when police sees assets are linked to
- 0:48Speaker 2: a specific offending, some drug importation, something like that. But
- 0:53Speaker 2: this is looking at long term leadership of a gang
- 0:57Speaker 2: who is established just to commit a legal action money
- 1:00Speaker 2: and he's lost homes, he's lost the clubrooms. It's a
- 1:05Speaker 2: magnificent result for police, but sends are very clear message
- 1:09Speaker 2: to gangs that their money isn't going to be safe,
- 1:12Speaker 2: but is it?
- 1:14Speaker 1: Does something else need to change so that doesn't take
- 1:16Speaker 1: ten years next time, or of the changes that have
- 1:18Speaker 1: already been made. Will that speed it up? Hopefully?
- 1:21Speaker 2: Yeah, this certainly needs to speed up. And I think
- 1:25Speaker 2: there's some lot of lessons to be learned out of
- 1:27Speaker 2: this sort of prosecution. And you know it'll be appealed,
- 1:31Speaker 2: We know that. But in some ways that may be
- 1:32Speaker 2: a good thing because it'll set the higher courts will
- 1:35Speaker 2: set the rules going forward as well, which I think
- 1:38Speaker 2: will be very helpful. The judge has taken a long
- 1:40Speaker 2: time to make a very considered opinion, so I think
- 1:42Speaker 2: it'll stand up in the higher court.
- 1:44Speaker 1: Ten months. He took ten months to deliberate. Do you
- 1:48Speaker 1: how hard is it to prove who's in charge of
- 1:50Speaker 1: a gang? I mean, is it not kind of obvious?
- 1:54Speaker 2: Yeah? Well, well I think with Doyle it was very obvious.
- 1:57Speaker 2: Everyone knew he was the chief. Now that was an
- 2:00Speaker 2: and he was the boss of that gang. But you know,
- 2:04Speaker 2: you've got to prove that to a standard of truth
- 2:07Speaker 2: beyond well in fact and the court it's on the
- 2:09Speaker 2: balance probabilities. So he was a very good example of
- 2:16Speaker 2: us and it will be a lot harder for some games.
- 2:19Speaker 2: But I'm saying that, you know, there's ways that police
- 2:22Speaker 2: can do this now and this it's a really good
- 2:25Speaker 2: example going forward. And what I like is it's not
- 2:28Speaker 2: just assets that he's accumulated, you know, in recent times.
- 2:32Speaker 2: These are assets he's owned for decades. And so it's
- 2:36Speaker 2: a big landmark ruling for police and it's one that
- 2:39Speaker 2: will have some real implications going forward.
- 2:41Speaker 1: Chris, thank you for that. Chris can't help Police Association
- 2:43Speaker 1: prison and I wonder when we'll see that house on
