- 0:00Hi, everyone. This is Chris Sosa with Becker's
- 0:01Healthcare. Thank you so much for tuning in
- 0:03today's podcast of the Becker's Healthcare podcast series.
- 0:07Today, we're going to talk about the next
- 0:08chapter of IDR, trends, metrics, and provider strategies.
- 0:12Joining me for today's discussion is Patrick Velleke.
- 0:14He is the chief external affairs officer at
- 0:16HaloMD.
- 0:17Patrick, thank you for being here today. Pleasure
- 0:19having me, Chris. Awesome. Well, Patrick, to kick
- 0:21us off, can you share a little bit
- 0:22about yourself and how you work in health
- 0:24care? Yeah. Thanks. So I got my start
- 0:26in health care on Capitol Hill. Worked for
- 0:29a member of the US Senate, for a
- 0:30number of years and then moved over to
- 0:31the house side handling policy,
- 0:33issues for for both of those members. I've
- 0:35worked on the payer side on, advocacy issues,
- 0:38worked in house for, Humana and then for
- 0:41Anthem, which is now Ellevance.
- 0:42I've also worked for the Federation of American
- 0:44Hospitals, so I've sat on the hospital side
- 0:46of the table, and most recently was with
- 0:49with Envision Healthcare, a large multi state, multi
- 0:51specialty medical group. Joined Halo, about two and
- 0:54a half months ago. And, I'm really, really
- 0:56excited to be,
- 0:58bringing some of these IDR solutions to, to
- 1:00clients on this side. Excellent. So, yeah, you've
- 1:02been all over the place having, worn a
- 1:04number of different hats. So, that experience, I'm
- 1:06sure, comes in handy with your position now.
- 1:08Yeah. I like to say, I I think
- 1:09the only,
- 1:10sides of the table I haven't sat on
- 1:12are are probably pharma and med device.
- 1:14So, yeah, I've either heard or sort of
- 1:18put out, just about every angle on on
- 1:20health care policy. So Oh, fantastic. Excited for
- 1:23this discussion. Alright. So first question I have
- 1:25to you is for you is simply we're
- 1:27starting to see patterns emerge from early IVR
- 1:28cases under the No Surprises Act.
- 1:31What trends are you seeing in arbitration outcomes,
- 1:33and what do they signal for providers moving
- 1:35forward? Yeah. So the trends have been really
- 1:37positive for providers and and facilities.
- 1:40There's publicly available data known as the, CMS
- 1:42public use files that detail the actual outcomes
- 1:46from arbitration.
- 1:47And they've shown consistently about an 80% or
- 1:50higher success rate on the provider side of
- 1:52the equation. Which means when providers engage in
- 1:55the arbitration process,
- 1:56they usually win. And they are able to
- 1:59obtain
- 1:59fair and sustainable rates through utilizing that process.
- 2:03So, really, the messages
- 2:05on that, Look, if you are thinking about
- 2:08engaging the IDR process and concerned about out
- 2:10of network reimbursement,
- 2:12the IDR process might be a solution worth
- 2:15considering.
- 2:16Definitely good to know. Second question I have
- 2:18for you simply, Patrick, is as finance leaders
- 2:21plan budgets for the next year, what key
- 2:23metrics or benchmarks should they be watching for,
- 2:25to better anticipate IDR related revenue shifts? Yeah.
- 2:29There are a lot of challenges coming down
- 2:30the pike for facilities especially, but on the
- 2:32provider side as well.
- 2:35And, like, it's never been easy to run
- 2:38a hospital, but I really looking at at
- 2:40next year, there's some challenges that facilities are
- 2:42going to have to get ahead of. You
- 2:44look at some of the impacts of the
- 2:46OBBBA,
- 2:47legislation,
- 2:48that will almost certainly result in some level
- 2:51of increased uncompensated care.
- 2:53You look at the potential sunset of the
- 2:56exchange subsidies,
- 2:57also likely leading to,
- 2:59changes in coverage for, millions of Americans.
- 3:03Facilities are are likely to see increased rates
- 3:06of of uncompensated care and, increased rates of,
- 3:09unfavorable
- 3:10prepare mix.
- 3:11So being aware of that on the front
- 3:13end will, hopefully, if they are aware and
- 3:16then start to look into the potential impact
- 3:18for their specific facilities,
- 3:20allow them to
- 3:21identify the need to close gaps. And IDR
- 3:24is one way that they may be able
- 3:26to to close those gaps.
- 3:28It'll also be important for facilities to understand,
- 3:30their
- 3:31sort of relationships with contracted provider groups. Most
- 3:34facilities,
- 3:35contract out for at least some of the
- 3:37services that they offer within their four walls.
- 3:40And a lot of those different service lines
- 3:42are often subsidized. Right? Where the,
- 3:44the physicians providing those services,
- 3:47would be operating at a loss of just
- 3:50on on revenue. Right? So the facility has
- 3:52to make up that that delta through, a
- 3:54subsidy arrangement.
- 3:56Providers are also going to be facing some
- 3:58challenges that could erode some of their reimbursement.
- 4:00The Medicare vision fee schedule final rule just
- 4:03came out on Friday. And it finalizes some
- 4:06pretty significant reductions in practice expense, RBUs,
- 4:10for facility based physicians.
- 4:12So you may see some of these specialties
- 4:14that are already seeking subsidy in order to
- 4:16provide services,
- 4:18come back in a couple of weeks to
- 4:19months to say, hey, we need to talk
- 4:22again about about more subsidy. So
- 4:25facilities really, like I said, need to understand
- 4:27those different risks and,
- 4:29start to identify opportunities
- 4:32to fill those holes or solutions for efficiency
- 4:35and improvement of of their operations.
- 4:38And the facilities that do that now are
- 4:40going to be in a whole lot better
- 4:40shape than the ones that do it six
- 4:42months from now when some of those changes
- 4:44are already taking place. So I I think
- 4:46the real message here is there are real
- 4:48challenges
- 4:49that require
- 4:51understanding and urgency to ensure facilities aren't negatively
- 4:54impacted.
- 4:55Certainly a lot to think about there. Thank
- 4:57you so much for laying all that out,
- 4:58Patrick. So based on your experience, how can
- 5:00CFOs and revenue cycle leaders strengthen their negotiation
- 5:03strategies with payers in light of these IDR
- 5:06decisions? Yeah. One of the great things about
- 5:08IDR and the NSA generally is that when
- 5:11it was originally drafted, one of the key
- 5:13purposes behind it was to encourage in network
- 5:15arrangements that are sustainable and durable.
- 5:18The idea is that you might go through
- 5:20an arbitration process for several rounds, maybe couple
- 5:23of months, between a a payer and a
- 5:26provider or facility.
- 5:27And that process ought to help both parties
- 5:30understand where the economic equilibrium is. Right? And
- 5:34if you are on either side of the
- 5:36equation, you keep losing over and over again.
- 5:38Let's say, an 80 of the time rate.
- 5:41You start to understand, hey, it would be
- 5:42a whole lot less expensive for me if
- 5:44I were to just contract
- 5:46at something approaching that rate. Save the fees
- 5:49on both sides and reduce overall costs.
- 5:51So,
- 5:52really, behind the NSA is a mechanism
- 5:55to help reach those sustainable long term arrangements.
- 5:58It's a little discouraging that we haven't seen
- 6:00that really take place yet. I think the
- 6:03adjustment period is taking a little longer than,
- 6:05most of us anticipated.
- 6:07But
- 6:08facilities especially, but provider groups as well, should
- 6:11really be looking at the IDR process as
- 6:13an avenue toward in network arrangements.
- 6:16Folks shouldn't want to be on a network.
- 6:18We should want to be streamlined and
- 6:21and, you know, on a process that lets
- 6:24both sides
- 6:25be sustainable.
- 6:26I'm hopeful that the IDR process will still
- 6:28get us there, but that's really the way
- 6:30that most folks ought to be thinking about
- 6:32their engagement in the process.
- 6:34It is not the last resort when negotiations
- 6:36fall apart.
- 6:37It's a tool in the toolbox toward finding
- 6:40that sustainable equilibrium rate and demonstrating its validity
- 6:44to drive toward a durable in network arrangement.
- 6:48Do you think, the current
- 6:50climate is pushing more organizations toward this process?
- 6:54And have you seen a tipping point in
- 6:55in this process? I think we're approaching it.
- 6:58I think
- 6:59the process is so consistently led to
- 7:02a result. Right? Like I said, since the
- 7:04public use files have started coming out, the
- 7:07rate of success on the physician and and
- 7:09facility side has been 80% plus. Yeah. That's
- 7:12a pretty clear demonstration that the the more
- 7:15reasonable offers here are coming from the provider
- 7:18and facility side.
- 7:20I I obviously, it takes two to tango
- 7:21here. Right? It takes both parties coming together,
- 7:23negotiating on a rate.
- 7:25But I I I'm hopeful, like I said,
- 7:27that the consistency and the outcomes,
- 7:30will start to drive that consensus toward, hey,
- 7:34let's network.
- 7:35There are unnecessary costs in the system from
- 7:38arbitration fees and and from the cost of
- 7:40the process.
- 7:41That's intentional. The arbitration process was designed to
- 7:44be cumbersome and expensive
- 7:46so that folks didn't rely on it, on
- 7:48on either side of the equation.
- 7:51If we wanna address some of those costs,
- 7:52the answer is
- 7:54get in network at the rates that have
- 7:56been prevailing in the idea process. So there's
- 7:59a lot of opportunity there. I think we
- 8:01are, again, with with such a trend
- 8:04and and consistency
- 8:06in the direction of these,
- 8:08you know, fair,
- 8:09reasonable,
- 8:10sustainable rates and and winning on the provider
- 8:12side.
- 8:13I'm hopeful we start to see some of
- 8:15that transition in the networking
- 8:16and that sort of leveling out of of
- 8:19utilization.
- 8:20Understood. Patrick, is there anything that you'd like
- 8:22to touch on that that we haven't covered
- 8:24in this conversation so far? Yeah. I think
- 8:25more than anything else, I think facilities likely,
- 8:28at this point, underutilized the RDR process. I
- 8:30think there's a misconception
- 8:32as to,
- 8:33the the services available
- 8:36to the arbitration process on the facility side
- 8:38and those being limited to
- 8:40really just ED visits.
- 8:43There's a whole lot more opportunity than I
- 8:45think a lot of facilities realize in in
- 8:47engaging in IDR and understanding how the NSA
- 8:50applies to their facilities. And even, you know,
- 8:52worth noting, I think just last week, maybe
- 8:54the week before, in on the HCA earnings
- 8:57call, they identified,
- 8:59improved outcomes in the IDR process as one
- 9:01of the drivers of of growth. Right? So
- 9:04there really are opportunities in the space on
- 9:06the hospital side. And,
- 9:08for folks who have maybe written that off
- 9:09and and thought, hey, this is really mostly
- 9:11for for providers,
- 9:13facilities really ought to take a look and
- 9:15see whether there's, an opportunity to stabilize revenue
- 9:18through some of those IDR opportunities.
- 9:20Excellent. Thank you so much, Patrick, for all
- 9:22your time and insights. We also, of course,
- 9:24wanna thank our podcast sponsor, which is HaloMD.
