Mega Edition: The Supreme Court And Their Epstein Side Step (10/14/26) · The Vault: The Epstein Files

Speaker 1: Alright, let's jump into our article for today. Now, we
0:04
Speaker 1: know that the 11th Circuit Court of Appeals absolutely shit
0:08
Speaker 1: the bed and dropped the ball. That NPA should have
0:12
Speaker 1: been overturned. There's no reason that that non-prosecution agreement should
0:18
Speaker 1: be live, should be kicking around still. That thing should
0:22
Speaker 1: have been done away with a very long time ago.
0:24
Speaker 1: In fact, it should have never been put on the
0:26
Speaker 1: books in the first place. So, After the 11th Circuit
0:32
Speaker 1: Court of Appeals dropped the ball, you're only left with
0:36
Speaker 1: one other option if you're the survivors, Courtney Wilde, and
0:39
Speaker 1: the lawyers. And that is elevating and escalating it all
0:44
Speaker 1: the way up to the Supreme Court. And that's where
0:49
Speaker 1: I said from the jump that this should end up.
0:52
Speaker 1: And according to a new article from ABC News, that's
0:57
Speaker 1: exactly the path we might be on. So let's jump
1:00
Speaker 1: into this article from ABC News and let's see what
1:04
Speaker 1: the author of the article, James Hill, has to say. Headline.
1:09
Speaker 1: Case over Jeffrey Epstein's sweetheart deal could be headed for
1:13
Speaker 1: Supreme Court. On a Friday afternoon in July 2008, 20-year-old
1:20
Speaker 1: Courtney Wilde appeared in federal court in West Palm Beach, Florida,
1:24
Speaker 1: demanding answers from federal prosecutors about their investigation of multimillionaire, pedophile,
1:31
Speaker 1: Jeffrey Epstein, who allegedly sexually abused Wilde and dozens of
1:35
Speaker 1: other underage girls at his waterfront mansion on Palm Beach Island. Now,
1:42
Speaker 1: first of all, what's allegedly even supposed to mean at
1:45
Speaker 1: this point? Jeffrey Epstein's estate's making these payouts. There's no
1:49
Speaker 1: allegedly left with Jeffrey Epstein. You could say allegedly with
1:53
Speaker 1: Ghislaine Maxwell because she's not convicted yet, right? But It's
1:56
Speaker 1: pretty much a foregone conclusion at this point that Epstein
1:59
Speaker 1: is guilty of everything that they said he did. Or else,
2:03
Speaker 1: why would his estate be paying out hundreds of millions
2:08
Speaker 1: of dollars? So let's just ax the allegedly part off
2:12
Speaker 1: of Jeffrey Epstein, shall we? Her legal action forced the
2:19
Speaker 1: government's admission that the U.S. Attorney's Office in Miami... already
2:23
Speaker 1: had reached a confidential deal with Epstein several months earlier
2:27
Speaker 1: without informing the alleged survivors. So the government was in
2:32
Speaker 1: the wrong. They knew that they had to tell these
2:35
Speaker 1: survivors what was going on, keep them aware of the situation.
2:40
Speaker 1: They didn't do any of that. They completely disrespected the
2:44
Speaker 1: survivors again, disrespected their rights, and absolutely ignored The law
2:54
Speaker 1: put on the books to prevent this exact thing from happening.
2:59
Speaker 1: And then, with all of that information, it goes to
3:03
Speaker 1: the esteemed 11th Circuit Court of Appeals. And those windbags,
3:11
Speaker 1: led by their Harvard Pied Piper, Mr. Newsom, decided in
3:17
Speaker 1: their infinite wisdom that the NPA was going to stand,
3:20
Speaker 1: but they're really sorry about it. I mean, really? That's
3:26
Speaker 1: what you're going to say to these gals after completely
3:30
Speaker 1: destroying their hopes for justice? Or at least putting a
3:34
Speaker 1: big roadblock in the way? I'm sorry, huh? Well, I
3:39
Speaker 1: have news for you. I'm sorry, 11th Circuit Court of
3:43
Speaker 1: Appeals is not going to cut it. That is not
3:45
Speaker 1: what you're there for. Her legal action forced the government's
3:55
Speaker 1: admission that the U.S. Attorney's Office in Miami already had
3:59
Speaker 1: reached a confidential deal with Epstein several months earlier without
4:03
Speaker 1: informing the alleged survivors. Over 12 years of litigation, Wilde's
4:08
Speaker 1: case ultimately exposed details of the secret negotiations between prosecutors
4:14
Speaker 1: and Epstein's high-priced legal team that led to the controversial agreement.
4:19
Speaker 1: So remember, if it wasn't for Courtney going ham over
4:22
Speaker 1: all of this, we probably would have never even known
4:26
Speaker 1: what the shitbag federal prosecutors and state prosecutors were up to.
4:31
Speaker 1: And that's how they like to operate, huh? They like
4:34
Speaker 1: to operate in the shadows. They like to operate in
4:37
Speaker 1: a manner that is concealed from the rest of us.
4:43
Speaker 1: Like they have some sort of special privilege that's afforded
4:47
Speaker 1: them by their office or their elected positions. And the
4:52
Speaker 1: rest of us should just listen to what they have
4:53
Speaker 1: to say because they're so smart. Without our case, probably
5:01
Speaker 1: no one would have seen the non-prosecution agreement, the secret agreement,
5:05
Speaker 1: said Brad Edwards, an attorney for Wilde. And he's not wrong.
5:09
Speaker 1: Without their case, no one would have been none the
5:12
Speaker 1: wiser to this. The government would have just swept it
5:14
Speaker 1: under the rug and they would have acted like they
5:17
Speaker 1: were the champions, the good guys. We went after Epstein.
5:21
Speaker 1: We did our jobs. No, not really. You really didn't, okay?
5:25
Speaker 1: You've been forced to do your jobs, alright? The public
5:31
Speaker 1: outcry is forcing you to do your job. And it's
5:39
Speaker 1: only a halfway job, by the way, so far. Without
5:47
Speaker 1: that action, nobody would have known just how bad Epstein
5:50
Speaker 1: and his other co-conspirators were. No one would have ever
5:54
Speaker 1: understood the whole story. And it's fact, right? Because when
5:59
Speaker 1: he said, she said, there's gray there. There's room to
6:06
Speaker 1: gaslight people. But when you have court documents and multiple, multiple,
6:11
Speaker 1: multiple dozens coming out with the same story, it's a
6:14
Speaker 1: little bit harder to discount what they're saying. Unless, of course,
6:18
Speaker 1: you're just engaging in cognitive dissonance, which some people just
6:23
Speaker 1: love to be in that state of mind, I guess.
6:28
Speaker 1: But now, the 11th Circuit Court of Appeals has ruled,
6:31
Speaker 1: in a 7-4 decision, that Wilde's case never should have
6:34
Speaker 1: gotten off the ground. The majority of judges concluded that
6:38
Speaker 1: the Federal Crimes Victims' Rights Act, enacted by Congress in 2004...
6:43
Speaker 1: did not allow Wilde to sue the Justice Department over
6:46
Speaker 1: Epstein's sweetheart deal in the absence of an existing criminal
6:50
Speaker 1: prosecution against Epstein. So that's their out, right? We always
6:54
Speaker 1: talk about loopholes, and that's another one of them. Another
6:57
Speaker 1: stupid-ass loophole that even in death, these scumbag so-called elites
7:02
Speaker 1: find a way to wiggle off of the hook. That's
7:05
Speaker 1: how the whole system's set up, folks. It's framed in
7:08
Speaker 1: that exact manner.
7:10
Speaker 2: Made plans for summer child care yet if not don't

7:40
Speaker 1: Oh what, you thought the system was fair? You thought
7:43
Speaker 1: you were going to get a fair shake? You thought
7:45
Speaker 1: the Justice Department was there to protect you? Sorry to
7:50
Speaker 1: break the news to you folks. That's just not reality.
7:58
Speaker 1: Federal prosecutors drafted a 53-page indictment of Epstein in 2007,
8:01
Speaker 1: but never filed it. opting to forego federal prosecution in
8:07
Speaker 1: exchange for Epstein's guilty pleas to two prostitution-related charges in
8:12
Speaker 1: Palm Beach County Court. So, I mean, talk about the
8:18
Speaker 1: whole thing stinking from the jump. 53 count federal gets
8:25
Speaker 1: just done away with and state charges are put in
8:28
Speaker 1: their place? Two state charges? Nah, nothing wrong with that.
8:33
Speaker 1: Nothing to see here, folks. And then you add the
8:37
Speaker 1: amicus brief that was filed on behalf of Courtney Wilde
8:41
Speaker 1: and the survivors by the very people who wrote this
8:45
Speaker 1: law saying that the way the court was interpreting it
8:49
Speaker 1: was incorrect. I think I'm going to side with the
8:53
Speaker 1: actual people who, you know, wrote the law in this instance,
8:57
Speaker 1: not the people who are looking at it and using
8:59
Speaker 1: their own judgment to decide what it means. Breaking news,
9:02
Speaker 1: all of you feudal lords sitting in courtrooms around America.
9:09
Speaker 1: Your job is to uphold the law, not to change
9:12
Speaker 1: it in your courtroom to fit your needs. The law
9:16
Speaker 1: is the law. And I don't want to hear about
9:20
Speaker 1: your interpretation of it, okay? Because the government never filed
9:27
Speaker 1: charges against Epstein, there was no pre-existing proceeding in which Ms.
9:31
Speaker 1: Wilde could have moved for relief under the CVRA. And
9:35
Speaker 1: the act does not sanction her standalone suit, U.S. Circuit
9:38
Speaker 1: Judge Kevin Newsom wrote in the court's majority opinion. And
9:43
Speaker 1: Kevin Newsom, as you remember, is another Harvard-educated scoundrel. Just
9:48
Speaker 1: another one of the good ol' boys network. I mean,
9:51
Speaker 1: we probably shouldn't have expected any redress from the 11th
9:54
Speaker 1: Circuit Court considering where it's located. Newsom acknowledged that the
10:01
Speaker 1: court's decision leaves Wilde and other alleged Epstein survivors largely empty-handed,
10:07
Speaker 1: and without any remedy for the U.S. government's alleged mistreatment
10:10
Speaker 1: of Epstein's survivors. Yeah, no shit, Mr. Newsom. You could
10:16
Speaker 1: have changed that. You could have made a difference, but
10:18
Speaker 1: you didn't. You took the easy way, right? I'll just
10:22
Speaker 1: interpret this the way I do it this way. And
10:28
Speaker 1: that's the problem with all of these judges, it seems.
10:31
Speaker 1: Very few judges that I've come across in my research
10:36
Speaker 1: or reading about, they all seem like they're all on
10:39
Speaker 1: a power trip, every last one of them. Like they're
10:42
Speaker 1: all these feudal lords. And inside of that courtroom is
10:46
Speaker 1: their fiefdom. And I don't dig it. I really don't
10:51
Speaker 1: dig it. I think that there needs to be oversight
10:53
Speaker 1: of these judges. More oversight of these judges, by the way.
11:01
Speaker 1: Wilde had argued for years that the Epstein deal, which
11:04
Speaker 1: also conferred immunity to any alleged co-conspirators, would be declared
11:08
Speaker 1: illegal and torn up. Yeah, it should have been. If
11:12
Speaker 1: we lived in a world with any justice and not
11:15
Speaker 1: a legal system dominated by loopholes and backdoors... This wouldn't
11:20
Speaker 1: even be an issue. But remember, all of these laws
11:25
Speaker 1: that they put on the books are not there to
11:27
Speaker 1: protect you, not there to make your life better. It's
11:31
Speaker 1: to make their lives more smooth in controlling us. We
11:39
Speaker 1: have the profoundest sympathy for Miss Wilde and others like
11:42
Speaker 1: her who suffer unspeakable horror at Epstein's hands. Okay, and
11:46
Speaker 1: right there the judge is even saying it. They suffered
11:49
Speaker 1: unspeakable horror at Epstein's hands. So can we drop the alleged, please? Okay,
11:55
Speaker 1: the judge is even saying it. So can we just
11:57
Speaker 1: drop the alleged nonsense with Jeffrey Epstein? And so it seems,
12:04
Speaker 1: affirmatively misled by government attorneys, Newsom wrote. Shameful all the
12:09
Speaker 1: way around. The whole thing makes me sick. But not
12:13
Speaker 1: sick enough to do the right thing, huh, judge? Not
12:15
Speaker 1: sick enough to stand up and do the right thing.
12:19
Speaker 1: I shouldn't be shocked. I mean, you know, Harvard, good
12:23
Speaker 1: old boys, everybody rallying around each other. In a dissenting opinion,
12:31
Speaker 1: Circuit Court Judge Frank Hull asserted that the court's majority
12:35
Speaker 1: decision eviscerates the CVRA. And she is not wrong. Judge
12:40
Speaker 1: Frank Hull has been fired up about this issue from
12:43
Speaker 1: the very beginning. And her dissent has been on point
12:49
Speaker 1: and very, very, very to the heart of the whole
12:52
Speaker 1: entire matter. Hull pointed to language in the CVRA that
12:59
Speaker 1: she argued allowed for Wilde to seek judicial enforcement of
13:03
Speaker 1: her rights if no prosecution is underway by filing a
13:06
Speaker 1: motion in the district court in the district in which
13:09
Speaker 1: the crime occurred. That is, Hull noted, exactly what Wilde
13:14
Speaker 1: did in 2008. And that's why the authors of the CVRA,
13:20
Speaker 1: who filed the amicus brief, Feinstein and the others, said
13:23
Speaker 1: the same exact thing. So once again, it comes down
13:26
Speaker 1: to one of these judges, Newsom, ruling over the court
13:31
Speaker 1: like it's his own personal kingdom. Ms. Wilde has spent
13:37
Speaker 1: 10 years seeking to vindicate her statutory rights expressly created
13:42
Speaker 1: by Congress. Today, The majority tells Ms. Wilde and Epstein's
13:47
Speaker 1: other survivors that all of that was for naught, since
13:51
Speaker 1: they never had the right to file their motion in
13:53
Speaker 1: the first place back in 2008, Hall wrote. And again,
13:58
Speaker 1: Judge Hall has not pulled any punches here. She has
14:01
Speaker 1: let her colleagues know that she is not happy with
14:04
Speaker 1: this decision. She is not happy with the way the
14:07
Speaker 1: court has ruled here. Weill's attorneys told ABC News this
14:13
Speaker 1: week they plan to ask the nation's highest court to
14:16
Speaker 1: take up the case and overturn a ruling they contend
14:20
Speaker 1: is outrageous and wrongheaded. Thank the maker, right? I said
14:24
Speaker 1: this right away. You've got to accelerate this all the
14:27
Speaker 1: way up to the Supreme Court. Now, the Supreme Court
14:29
Speaker 1: only takes a handful of cases a year, so there's
14:32
Speaker 1: no guarantee that they'll even hear this case. But you
14:35
Speaker 1: have to accelerate it. There's no way you just take
14:39
Speaker 1: this L, right? Oh, all right, well, that's it. We
14:41
Speaker 1: have no more redress. You know what? You've come this far.
14:44
Speaker 1: You have to go all the way at this point.
14:47
Speaker 1: And I'm very, very happy to hear Brad Edwards talk
14:49
Speaker 1: about bringing this all the way to the Supreme Court.
14:52
Speaker 1: Let's see what they have to say about it. We
14:57
Speaker 1: plan to seek review in the U.S. Supreme Court of
14:59
Speaker 1: this unfortunate, far-reaching decision, which makes victims' rights completely unenforceable
15:05
Speaker 1: in situations where federal prosecutors cut a secret deal with
15:09
Speaker 1: wealthy defendants, said attorney Paul Cassell, a former federal judge who,
15:14
Speaker 1: along with Edwards, has spent several thousand of pro bono
15:18
Speaker 1: hours on Wilde's case. And I'd love to hear that, too.
15:22
Speaker 1: Pro bono work? I mean, if I was a lawyer...
15:25
Speaker 1: I'd be looking for cases like this all the time
15:27
Speaker 1: to take on. Especially if I had already succeeded in
15:30
Speaker 1: my career and I had a bunch of money, like
15:33
Speaker 1: the Suck Squad, you know, Ghislaine Maxwell's team. I'd be
15:37
Speaker 1: looking for people to help, like Kalief Browder and others.
15:42
Speaker 1: But it's all lip service from these kinds of people.
15:45
Speaker 1: They're not interested in helping the poorest amongst us. If
15:49
Speaker 1: they did that, they'd have nobody to lord over. D.C.
15:53
Speaker 3: Politicians are proposing new tax increases on American industries. Just
15:57
Speaker 3: as we begin to recover from the pandemic, politicians want
16:01
Speaker 3: to experiment with risky new taxes, weakening the U.S. economy,
16:05
Speaker 3: making us less competitive when we can least afford it.
16:08
Speaker 3: America's recovery counts on all of us. We can't afford
16:11
Speaker 3: more taxes. Tell Catherine Cortez Masto, don't overtax American industry.
16:17
Speaker 3: Get the facts at coalitionforamericanjobs.org, paid for by the Coalition
16:21
Speaker 3: for American Jobs.
16:25
Speaker 1: Basically, Cassell added, what this means is if you're rich
16:28
Speaker 1: enough to hire a battery of lawyers to cut a
16:30
Speaker 1: pre-indictment deal, then you don't have to worry about the
16:33
Speaker 1: victims at all.
16:35
Speaker 3: 100%.
16:35
Speaker 1: Where's the lie in that? Mr. Cassell is 100% spot on.
16:39
Speaker 1: Money talks. If you got the right amount of dough
16:43
Speaker 1: and you can bring in the right lawyers who have
16:44
Speaker 1: the right connections, shit's going to be a lot easier
16:46
Speaker 1: for you. the ruling by the 11th Circuit effectively nullifies
16:52
Speaker 1: previous decisions by U.S. District Judge Kenneth Marra in West
16:56
Speaker 1: Palm Beach. Marra ruled in February 2019 that federal prosecutors
17:02
Speaker 1: had reached the deal with Epstein in violation of the
17:05
Speaker 1: rights of Epstein's survivors. But as Marra was considering potential
17:10
Speaker 1: remedies for the government's infraction, Epstein was arrested again in
17:14
Speaker 1: July 2019 and charged in New York with federal conspiracy
17:20
Speaker 1: and sex crimes against minors. So right as the judge
17:23
Speaker 1: was getting ready to make a decision on the NPA,
17:26
Speaker 1: Epstein gets swooped up again and then mysteriously dies in custody, huh? Yeah,
17:34
Speaker 1: nothing to see here, folks. Just keep it moving. I mean,
17:37
Speaker 1: how many coincidences do they want us to just accept?
17:46
Speaker 1: Epstein died by suicide, allegedly, a month later in a
17:49
Speaker 1: Manhattan federal jail, and Mara subsequently dismissed Wilde's case. Yeah,
17:55
Speaker 1: just so happened, huh? Jeffrey Epstein sure is a lucky guy,
17:58
Speaker 1: and all of his associates and the people that he
18:00
Speaker 1: was covering for must be real lucky too. He just
18:03
Speaker 1: happens to die, just all of a sudden becomes suicidal?
18:07
Speaker 1: Right on the heels of all of this? Oh, yeah, okay.
18:10
Speaker 1: Totally believable. Wilde appealed the dismissal, contending that Epstein's deal
18:16
Speaker 1: should still be invalidated because of the government's alleged breach
18:19
Speaker 1: of its legal obligations to the survivors. Her appeal received
18:23
Speaker 1: support from Senator Dianne Feinstein, California, and former Republican Senators
18:30
Speaker 1: Orrin Hatch of Utah and John Kyle of Arizona, who
18:34
Speaker 1: spearheaded the passage of the Crime Victims Rights Act in 2004.
18:37
Speaker 1: So there you go, folks. John Kyle, Orrin Hatch, Dianne Feinstein.
18:43
Speaker 1: Some heavy hitters. And what they have to say doesn't matter?
18:48
Speaker 1: They wrote the law, breaking news, 11th Circuit Court. They
18:52
Speaker 1: wrote the law. Probably want to listen to what they
18:54
Speaker 1: have to say, no? In a court filing, the lawmakers
18:59
Speaker 1: contended that the miscarriage of justice in the Epstein case
19:03
Speaker 1: was precisely what the act prevents. Drop the microphone and
19:07
Speaker 1: walk out, okay? In fact, what I think the lawyers
19:12
Speaker 1: for the survivors and Courtney should do is call Feinstein,
19:16
Speaker 1: Orrin Hatch, and Senator Kyle as witnesses. Bring them as
19:21
Speaker 1: witnesses and let them tell the court how the law
19:24
Speaker 1: is supposed to be applied. That's a bit awkward for
19:29
Speaker 1: the court majority to tell us that Congress never meant
19:31
Speaker 1: to do something when the three leading congressional sponsors of
19:35
Speaker 1: that very same act said, yes, we did, Cassell said.
19:39
Speaker 1: So again, that's my biggest contention here. That's my biggest
19:43
Speaker 1: point here. When an amicus brief is filed by three
19:46
Speaker 1: heavy hitters like this, who actually uh wrote the law
19:50
Speaker 1: you should probably listen to what they have to say
19:53
Speaker 1: once again the court thinks it always knows better and
19:56
Speaker 1: i'm tired of the arrogance shown by these judges in
20:00
Speaker 1: the united states enough is enough Cassell and Edwards acknowledge
20:11
Speaker 1: that the odds are against them in their pursuit of
20:13
Speaker 1: review by Supreme Court, which hears only about 2% of
20:17
Speaker 1: the cases presented to it each year. But Wilde's attorneys
20:21
Speaker 1: are also pushing for passage of a pending U.S. House bill,
20:25
Speaker 1: the Courtney Wilde Crime Victims Rights Reform Act, that would
20:28
Speaker 1: amend the CVRA to better protect survivors. They credit Wilde,
20:34
Speaker 1: now a 33-year-old mother of two, for her perseverance in
20:38
Speaker 1: her protracted legal battle for accountability. So we always talk
20:42
Speaker 1: about what can we do, what can we do? Call
20:44
Speaker 1: your congressperson and tell them you want the reformed, see
20:49
Speaker 1: the Courtney Wilde Crime Rights Victims Rights Reform Act amended.
20:55
Speaker 1: Call them and tell them that. Because if we get
21:00
Speaker 1: this law amended, then it opens things up. If the
21:06
Speaker 1: Supreme Court turns us down, then she is 100% all
21:09
Speaker 1: on board for testifying before Congress and making sure this
21:13
Speaker 1: doesn't happen again, Edwards said. Her attitude is, look, I'm
21:17
Speaker 1: proud of the fight. I'm proud of exposing the bad
21:19
Speaker 1: that the government did. She's definitely a fighter. She's not
21:23
Speaker 1: about to quit. I'll tell you what, Courtney, neither are we.
21:26
Speaker 1: Neither are we. Because enough is enough. What you ladies
21:30
Speaker 1: have been through, what someone like Courtney has done for
21:32
Speaker 1: all of these years to bring light to this matter,
21:34
Speaker 1: that could affect all of us moving forward? That's not
21:38
Speaker 1: somebody you abandon. That's not somebody you step back and say, oh,
21:42
Speaker 1: you're on your own now. It's when you bite down
21:46
Speaker 1: on your mouthpiece, move to the center of the octagon,
21:50
Speaker 1: and get busy. Now let's hope the Supreme Court does
21:56
Speaker 1: the right thing here. But until then, I would highly
22:00
Speaker 1: suggest writing to your congressman or your congresswoman and telling
22:03
Speaker 1: them you want this CVRA reformed. I think that's definitely
22:09
Speaker 1: a good idea. And like I always suggest as well,
22:13
Speaker 1: if you're writing letters to your congressmen or women, I
22:16
Speaker 1: wouldn't be too mean or aggressive. Write them and tell
22:22
Speaker 1: them what you think that they should be doing. Because...
22:27
Speaker 1: This law, if this is the way they're going to
22:31
Speaker 1: use it in the court, most certainly needs to be amended.
22:35
Speaker 1: And the only people that can do that, folks, are
22:39
Speaker 1: the very same people that we sent to Washington, D.C.
22:45
Speaker 1: So I think it's time to remind them that they
22:49
Speaker 1: work for us. If you'd like to contact me, you
22:53
Speaker 1: could do that at bobbycapucci at protonmail.com. That's B-O-B-B-Y-C-A-P-U-C-C-I at protonmail.com.

Speaker 1: All of the links that go with this episode can

23:18
Speaker 1: Our article tonight deals with the appeals court that has
23:23
Speaker 1: sided with the federal government in the Jeffrey Epstein case
23:27
Speaker 1: as far as the deal, the immunity deal that was
23:31
Speaker 1: doled out in Epstein's first arrest. So we're going to
23:35
Speaker 1: jump into this article from Politico and see just what
23:39
Speaker 1: it says. The headline, Appeals Court Sides with Feds on
23:45
Speaker 1: Jeffrey Epstein Deal. Author, Josh Gerstein. This article appeared in Politico.
23:55
Speaker 1: Federal prosecutors won what may amount to a Pyrrhic victory
23:58
Speaker 1: Tuesday in a long-running legal battle over their handling of
24:02
Speaker 1: the sex trafficking investigation into wealthy financier, pedophile, Jeffrey Epstein,
24:08
Speaker 1: with judges coming down on both sides of the case,
24:11
Speaker 1: savaging the prosecution team over its conduct. That's nice, right?
24:15
Speaker 1: Words are wind, though. Okay, you can savage them in
24:18
Speaker 1: your briefing or after the case or even admonish them
24:23
Speaker 1: during the case. But the fact of the matter is
24:26
Speaker 1: you sided with the federal government once again. Should we
24:29
Speaker 1: expect any different? Should we expect the federal government to
24:33
Speaker 1: throw themselves in front of the bus? You know, I
24:36
Speaker 1: don't have any faith in these appeals courts for the
24:38
Speaker 1: most part, right? We all know that these judges are
24:41
Speaker 1: activist judges. One of the judges that was sitting in,
24:44
Speaker 1: that sits in this appeal court is 90 years old.
24:47
Speaker 1: Another one of them, who sided with the feds, graduated
24:51
Speaker 1: from Harvard. And the one dissenting voice was the female
24:55
Speaker 1: judge on the panel. Shocking, I know. But, you know,
24:59
Speaker 1: I really just, I don't have any faith in these
25:00
Speaker 1: appeals courts. I don't have any faith in the justice
25:03
Speaker 1: system at this point. The 2-1 decision from the Atlanta-based
25:10
Speaker 1: 11th Circuit Court of Appeals said prosecutors did not violate
25:14
Speaker 1: a federal victim's rights law by leaving victims in the
25:17
Speaker 1: dark as a deal was cut a decade ago that
25:20
Speaker 1: headed off potential federal sex trafficking charges against Epstein in
25:25
Speaker 1: exchange for guilty pleas to lesser state charges. So... You're
25:32
Speaker 1: telling me that the prosecution... Pulling an end around on
25:40
Speaker 1: the survivors doesn't violate law? I don't even understand how
25:45
Speaker 1: they could come to this ruling, right? I don't understand.
25:48
Speaker 1: I mean, I can understand how a 90-year-old man can
25:51
Speaker 1: come to this ruling. He probably can't even spell his
25:53
Speaker 1: name correctly at this point. 90 years old? Why is
25:56
Speaker 1: he still sitting on the appeals court? I'm sorry, but
26:00
Speaker 1: come on. 90 years old? Go and enjoy your retirement, buddy.
26:04
Speaker 1: You have no business hearing these sort of cases. The
26:10
Speaker 1: decision overturns the core of a judge's ruling last year
26:13
Speaker 1: that contributed to the resignation of Labor Secretary Alex Acosta,
26:18
Speaker 1: who was U.S. Attorney for Southern Florida at the time
26:20
Speaker 1: the controversial non-prosecution agreement was hammered out with Epstein's high-powered
26:26
Speaker 1: legal team in 2007 and 2008. Of course, the federal
26:31
Speaker 1: government appealed the original ruling, right? They know that they
26:34
Speaker 1: were up to some scumbaggery, and they get it kicked
26:38
Speaker 1: up to this appeals court, and the appeals court, you know,
26:41
Speaker 1: finds an out for them once again. I would say
26:44
Speaker 1: that I'm upset by this, but at this point, it's
26:47
Speaker 1: expected when it comes to appeals courts... and hoping that
26:50
Speaker 1: they do the right thing. How many times have we
26:52
Speaker 1: seen it throughout the country when it comes to just
26:55
Speaker 1: about anything, any kind of issue, especially a high-profile issue,
27:00
Speaker 1: and one of these appeals courts gets involved? You have
27:03
Speaker 1: a judge like this knucklehead here who graduated from Stanford
27:09
Speaker 1: who is just completely missing the whole entire point when
27:15
Speaker 1: it comes to this case, in my opinion. Epstein died
27:20
Speaker 1: of an apparent suicide in a New York jail last
27:22
Speaker 1: August as he was awaiting trial on newly filed federal
27:26
Speaker 1: charges that he trafficked underage teenage girls for sexual purposes.
27:31
Speaker 1: The majority on the appeals court panel said the federal
27:34
Speaker 1: trial court judge in Florida erred when he ruled that prosecutors,
27:39
Speaker 1: including Acosta, violated the Crime Victims Rights Act by keeping
27:43
Speaker 1: victims in the dark about the deal where federal officials
27:47
Speaker 1: agreed not to charge Epstein if he pleaded guilty to
27:50
Speaker 1: a pair of related charges in state court of soliciting prostitution.
27:56
Speaker 1: I don't even, how can they come to, see, and
27:58
Speaker 1: here's the thing too, and a lot of times these
28:01
Speaker 1: judges are going by the strict rule of law, I
28:04
Speaker 1: guess you would say. Well, what does that tell you?
28:06
Speaker 1: Maybe the laws are wrong, okay? Maybe the laws need
28:09
Speaker 1: to be written by people who get it, people who
28:13
Speaker 1: aren't writing them so that they know that there's going
28:15
Speaker 1: to be loopholes for scumbags like this to get away
28:17
Speaker 1: with stuff like this. Right. So, again, it goes back
28:22
Speaker 1: to the justice system itself being completely and utterly destroyed
28:25
Speaker 1: and broken and how we need to overhaul it ASAP.
28:29
Speaker 1: It needs to be it's a matter of national security
28:31
Speaker 1: and and it needs to be fixed. However, the 11th
28:40
Speaker 1: Circuit's ruling was far from a complete vindication for Acosta,
28:44
Speaker 1: as it found that prosecutors appeared to have intentionally misled
28:48
Speaker 1: victims about the deal, even though the court ultimately concluded
28:52
Speaker 1: that deceit is not illegal. Are you kidding me right now?
28:56
Speaker 1: Deceit is not illegal. Folks. This is the federal government
29:01
Speaker 1: we're talking about right here, okay? The prosecutors who are
29:04
Speaker 1: in charge of making sure that bad people pay, supposedly,
29:09
Speaker 1: are the ones who flubbed all of this up. They're
29:11
Speaker 1: the ones that didn't tell the survivors what was going on.
29:14
Speaker 1: They're the ones that chose to lie. So you're telling
29:16
Speaker 1: me deceit is not illegal? And the court can't do
29:21
Speaker 1: anything about it, huh? So next time you're if you're
29:26
Speaker 1: ever in trouble with the law, just be deceitful. And
29:28
Speaker 1: then we can refer back to this case and say, well,
29:30
Speaker 1: there's precedent. I mean, the federal government was deceitful, but
29:33
Speaker 1: it's okay when it's the federal government being deceitful folks
29:36
Speaker 1: it's okay when the federal government finesses things in their
29:40
Speaker 1: direction it's okay when the federal government omits information But you,
29:46
Speaker 1: or me, or your Uncle Steve, or your friend, or
29:49
Speaker 1: obviously survivors of sexual abuse and human trafficking, we don't
29:54
Speaker 1: get the same kind of shake. We don't get the
29:56
Speaker 1: same sort of rules that they get. We have one
30:01
Speaker 1: set for us, for the lower people on the totem pole,
30:04
Speaker 1: and a whole other set of rules... for the people
30:07
Speaker 1: who are in charge, right? And it's okay to be deceitful.
30:10
Speaker 1: That's all right. You can be deceitful with survivors of
30:13
Speaker 1: sex trafficking. No big deal. You're not going to be
30:15
Speaker 1: held accountable for that as the prosecution. Acosta is an
30:20
Speaker 1: absolute scumbag. His prosecutorial team, scumbags. The state prosecutors, scumbags.
30:27
Speaker 1: All of these people involved, scumbags. We hold that at
30:34
Speaker 1: least as matters currently stand, which is to say at
30:37
Speaker 1: least as the CVRA is currently written, rights under the
30:41
Speaker 1: Act do not attach until criminal proceedings have been initiated
30:45
Speaker 1: against a defendant, either by complaint, information, or indictment. Judge
30:50
Speaker 1: Kevin Newsom wrote in an opinion joined by Judge Gerald Toflat. Now,
30:57
Speaker 1: Kevin Newsom graduated from Harvard. That's a shock, huh? I
31:00
Speaker 1: wonder if he's friendly with Dershowitz or any of the
31:04
Speaker 1: other Harvard boys. And Gerald Toflat is 90 years old.
31:10
Speaker 1: He has no business sitting on the bench, just like
31:13
Speaker 1: I don't think Ruth Ginsburg has any business sitting on
31:16
Speaker 1: the bench. When you're 90 years old... Go and enjoy
31:18
Speaker 1: your retirement, your few years left, okay? Your mind's not
31:22
Speaker 1: as sharp. It's not an indictment on him personally. I'm
31:25
Speaker 1: sure at one point he was a great lawyer, okay?
31:28
Speaker 1: I'm sure at one point he was phenomenal at his job.
31:31
Speaker 1: but you're 90 years old, man. All right. You can't
31:34
Speaker 1: even maneuver yourself down 15 or 20 stairs without falling
31:39
Speaker 1: and breaking your hip for Lord's sake. Really? And this
31:42
Speaker 1: is the guy sitting in. He's the head of the court.
31:44
Speaker 1: He's the one making these decisions and conducting how the
31:49
Speaker 1: business is going to be run in the courtroom of
31:52
Speaker 1: the 11th Circuit of Appeals. 90 years old? Because the
31:57
Speaker 1: government never filed charges or otherwise commenced criminal proceedings against Epstein,
32:02
Speaker 1: the CVRA was never triggered. It's not a result we like,
32:06
Speaker 1: but it's a result we think the law requires, Newsom added.
32:10
Speaker 1: Oh yeah, and it's always to hide behind the law.
32:12
Speaker 1: They love to hide behind the law when it's going
32:15
Speaker 1: to make them look bad, right? When the federal department of...
32:20
Speaker 1: corrections is going to look bad, or if the Attorney
32:23
Speaker 1: General is going to look bad, or even the state's
32:26
Speaker 1: going to look bad. Well, you know, these aren't the
32:28
Speaker 1: results we like, but you know, this is what the
32:31
Speaker 1: law says we have to do. Our hands are tied here.
32:35
Speaker 1: It's an absolute joke. The justice system in this country
32:38
Speaker 1: is abhorrent. It's built and stacked against normal people like us,
32:44
Speaker 1: and when People like Courtney Wilde and Virginia Roberts and
32:50
Speaker 1: Maria Farmer and Annie Farmer and the rest of all
32:53
Speaker 1: of the survivors can't get justice because they play games
32:56
Speaker 1: and they use loopholes and the laws are written in
33:00
Speaker 1: a manner that benefits the people conducting the abuse. We're
33:05
Speaker 1: lost as a society, folks, unless we stand up, flip
33:08
Speaker 1: the table over, and tell all of these MFers... that
33:11
Speaker 1: we're done playing games with them, we're done dancing to
33:14
Speaker 1: their drum, and times are going to change. And I'm
33:17
Speaker 1: telling you right now, this can't go on. We can't
33:22
Speaker 1: have a justice system and a two-tier justice system at
33:25
Speaker 1: that that conducts business this way. Equal justice under the
33:30
Speaker 1: law for everybody. Newsom called the case beyond scandalous and
33:38
Speaker 1: a tale of national disgrace. He also ascribed fault in
33:42
Speaker 1: various directions, accusing prosecutors of apparent mistreatment of the victims.
33:47
Speaker 1: So again, words are wind. It's nice and all that
33:51
Speaker 1: you're admonishing the prosecutors and saying that they treated the
33:54
Speaker 1: survivors badly and it's a national disgrace. But what did you,
33:59
Speaker 1: Judge Newsom, do to correct that? You had this case
34:02
Speaker 1: in your office. All it would have taken is a
34:04
Speaker 1: dissenting view by you or the 90-year-old, along with the
34:09
Speaker 1: other one judge that actually knows what the hell she's
34:11
Speaker 1: doing in that courtroom. All it would have taken is
34:14
Speaker 1: a dissenting view from you or the old man Withers,
34:17
Speaker 1: and we're talking about a different story here. But no, Mr.
34:21
Speaker 1: Harvard had to cast his vote and had to cast
34:24
Speaker 1: his judgment along with Jeffrey Epstein's protectors in the federal government.
34:31
Speaker 1: That shouldn't shock anybody. It's disgraceful, but at this point
34:35
Speaker 1: it shouldn't shock anybody. And the judge even swung at
34:41
Speaker 1: the national media for having essentially ignored Epstein's case for
34:45
Speaker 1: more than a decade, notwithstanding numerous reports about it in Politico,
34:49
Speaker 1: The Daily Beast, and elsewhere. Well, I don't think the
34:52
Speaker 1: judge is wrong about that. It's, you know, Politico can
34:55
Speaker 1: say what they want, but it's not like they're sending
34:58
Speaker 1: swarms of reporters to cover this case. Now, the Daily Beast,
35:02
Speaker 1: I've said it from the jump, the Daily Beast has
35:04
Speaker 1: done a great job. The Daily Beast has really covered
35:07
Speaker 1: this case, and they have done it in a manner
35:10
Speaker 1: where it doesn't seem like they're scared. The legacy media
35:13
Speaker 1: in general, they have tiptoed around this case. They're scared
35:16
Speaker 1: of Dershowitz. They're scared of Indyk. They're scared of Khan.
35:19
Speaker 1: They're scared of Ghislaine Maxwell. They're scared of everybody. They
35:24
Speaker 1: refuse to do good reporter work here. They refuse to
35:26
Speaker 1: do good journalism. They refuse to chase down the leads.
35:30
Speaker 1: They refuse to write the stories that might hurt, as
35:33
Speaker 1: Nancy Pelosi's daughter says, some of their faves. And it's
35:37
Speaker 1: an absolute joke. So I agree with Judge Newsom in
35:40
Speaker 1: that regard when it comes to the media not doing
35:43
Speaker 1: a good enough job covering this case. because they haven't. Look,
35:47
Speaker 1: if they did a good enough job covering this case,
35:50
Speaker 1: I wouldn't have 500,000 downloads of this podcast. You'd be
35:53
Speaker 1: getting your information from the actual media. The dissenter on
35:58
Speaker 1: the three-judge panel, Judge Frank Hull, said the actions by
36:02
Speaker 1: Acosta's office constituted egregious violations of the victim's rights law.
36:07
Speaker 1: Thank you, Judge Hull, Frank Hull. Thank you very much.
36:12
Speaker 1: the majority's contorted statutory interpretation materially revises the statute's plain
36:18
Speaker 1: text and guts victims rights under the c v r
36:22
Speaker 1: a nothing and i mean nothing in the c v
36:26
Speaker 1: r a s plain text requires the majority's result wrote
36:30
Speaker 1: hall I agree. Look, again, I'm not a lawyer. I'm
36:34
Speaker 1: not somebody that understands the law like these lawyers would
36:38
Speaker 1: and understands how to navigate through it like they would.
36:41
Speaker 1: But I am somebody who understands common sense and somebody
36:44
Speaker 1: who understands that when a wrong has been committed, there
36:47
Speaker 1: needs to be some redress, right? There needs to be
36:50
Speaker 1: some sort of... coming to Jesus moment, because we can't
36:55
Speaker 1: let this sort of thing occur. If they did this
36:58
Speaker 1: to Courtney Wilde, how many other people have they done
37:00
Speaker 1: this to? You see, the justice system in this country
37:05
Speaker 1: needs to be reined in. It needs to be reined in,
37:08
Speaker 1: and it needs to be overhauled from the top to
37:11
Speaker 1: the bottom. The decade-plus litigation challenging prosecutors' action in seeking
37:18
Speaker 1: to overturn Epstein's deal with the feds was brought by
37:21
Speaker 1: Epstein survivor Courtney Wilde and another woman who remains anonymous
37:25
Speaker 1: in court papers. A lawyer for the women, Brad Edwards,
37:29
Speaker 1: expressed disappointment in the decision and vowed to ask the
37:32
Speaker 1: full bench of the appeals court to weigh in. Yeah,
37:35
Speaker 1: you thought Bradley Edwards was going to be knocked into
37:39
Speaker 1: submission by this ruling? You thought Bradley Edwards, especially after
37:42
Speaker 1: reading Relentless Pursuit, wasn't going to go as high as
37:46
Speaker 1: he can, appeal to the highest levels that he possibly can? Oh,
37:50
Speaker 1: you knew he was going to do that, especially when
37:52
Speaker 1: one of the judges dissented, and not only dissented, but
37:55
Speaker 1: dissented with fury. It is clear that even the majority
38:02
Speaker 1: detested the government's treatment of the victims, but apparently felt
38:05
Speaker 1: there was a loophole in the CVRA that the prosecutors
38:09
Speaker 1: and Epstein successfully exploited. Yeah, what have I been talking
38:12
Speaker 1: about for how long here on the podcast about the loopholes?
38:15
Speaker 1: There are so many of them, right? But you and
38:18
Speaker 1: I won't ever have access to those loopholes. Do you
38:20
Speaker 1: know why? Because we don't have $ 250, 000 for a retainer
38:24
Speaker 1: for a lawyer. And we don't have $ 1, 500 an hour
38:27
Speaker 1: to pay them to sit in the room. And then
38:29
Speaker 1: we don't have the money to pay the specialists and
38:31
Speaker 1: all the other people involved in making sure guys like
38:34
Speaker 1: Epstein are able to use these loopholes that are written
38:38
Speaker 1: into these laws specifically to protect their friends. Edwards said
38:45
Speaker 1: in an email to Politico, For all the reasons given
38:48
Speaker 1: in the 60-page dissenting opinion, we strongly disagree with today's ruling,
38:53
Speaker 1: which leaves survivors like Ms. Wilde without any remedy, even
38:57
Speaker 1: for survivors like her who have been affirmatively misled by
39:01
Speaker 1: federal prosecutors. We will be seeking rehearing and bank before
39:06
Speaker 1: the full 11th Circuit. Bravo! Bravo. Oh, and you should, Mr. Edwards,
39:13
Speaker 1: and you should, because this is a case that should
39:16
Speaker 1: be overturned. This is a case that needs to be
39:19
Speaker 1: carefully looked at by the whole entire appeals bench. The
39:24
Speaker 1: whole circuit needs to take a look at it. Not
39:26
Speaker 1: these three lawyers. I mean, not these three judges, one
39:29
Speaker 1: a Harvard graduate. and another, another, an octogenarian. Okay. No,
39:34
Speaker 1: we need the whole 11th circuit to look at it
39:37
Speaker 1: and see what they have to say. And if they,
39:39
Speaker 1: they don't do the right thing, then appeal it even
39:42
Speaker 1: further up the chain, because let me tell you what,
39:44
Speaker 1: something stinks here, folks. Something really, really stinks here. Newsom
39:51
Speaker 1: was appointed by President Donald Trump. Tofflat is an appointee
39:55
Speaker 1: of Gerald Ford. Hull was appointed by President Bill Clinton.
39:59
Speaker 1: I don't really think that matters in this part of
40:02
Speaker 1: the case. Now, don't get me wrong, with some of
40:04
Speaker 1: these rulings with judges, a lot of them have political
40:06
Speaker 1: bends and it makes me mental, and I don't care
40:08
Speaker 1: what side of the aisle you fall down on, I
40:11
Speaker 1: don't think that a judge should ever be playing politics
40:14
Speaker 1: from the bench. And that's not what I'm saying is
40:16
Speaker 1: happening here, by... any stretch. What I think's happening here though,
40:21
Speaker 1: is there's definitely the loophole here and the prosecution, old
40:25
Speaker 1: man Withers and Judge Newsome, they understand the egg that
40:30
Speaker 1: this is going to leave on the face of the
40:32
Speaker 1: justice system and they don't want any part of that.
40:35
Speaker 1: So what they're going to do is this is basically
40:37
Speaker 1: them punting. Now the whole entire 11th circuit's going to
40:41
Speaker 1: get a look at it and we'll see what happens
40:42
Speaker 1: from there. The Justice Department's Office of Professional Responsibility investigation
40:48
Speaker 1: into the handling of the Epstein probe a decade ago
40:51
Speaker 1: is ongoing. Well, that's nice, right? But if we had
40:55
Speaker 1: a Justice Department that was worth anything, they would have
40:57
Speaker 1: already arrested Ghislaine Maxwell and the Corp 4 and all
41:01
Speaker 1: of the people involved. So we can't rely on the
41:04
Speaker 1: Justice Department either. What we have to hope for is
41:07
Speaker 1: that the whole entire 11th Circuit gets together and we
41:12
Speaker 1: hope that there's more judges like Frank Hull here who
41:16
Speaker 1: was willing to say exactly what this is. Absolutely, positively
41:22
Speaker 1: egregious behavior by the federal government to not inform the
41:27
Speaker 1: survivors of the deal Epstein was getting. How is that
41:31
Speaker 1: okay on any planet? How is that okay in any courtroom?
41:37
Speaker 1: Now the problem is, folks, the way these laws are written,
41:40
Speaker 1: and we have to hold people responsible, right? Our local officials,
41:44
Speaker 1: our federal officials, congressmen, senators, the people that actually make
41:48
Speaker 1: the laws. They need to be held responsible for making
41:53
Speaker 1: sure that there's loopholes for their rich friends to exploit
41:56
Speaker 1: when the shit goes down. I don't want to hear
41:58
Speaker 1: about these loopholes anymore, okay? I don't want to hear
42:01
Speaker 1: about it. Enough is enough. Just because they have a loophole,
42:05
Speaker 1: they get out of this whole entire thing being overturned
42:08
Speaker 1: even when the court knows that the federal government was
42:11
Speaker 1: in the wrong? It doesn't sit well with me, and
42:14
Speaker 1: the whole entire justice system does not sit well with me.
42:17
Speaker 1: The whole thing needs to be overhauled. We need it
42:20
Speaker 1: completely torn down from top to bottom and rebuilt. Because
42:25
Speaker 1: this is unacceptable. I don't think that anyone who's following
42:29
Speaker 1: this case is willing to accept rulings like this in
42:32
Speaker 1: courtrooms by three judges when a whole appeal circuit should
42:36
Speaker 1: be impaneled to oversee and hear this case. So... The
42:41
Speaker 1: good thing that we can count on is that Bradley
42:43
Speaker 1: Edwards isn't going to go quietly into the night. Bradley
42:46
Speaker 1: Edwards is going to kick this up and we'll see
42:48
Speaker 1: what happens when the whole entire 11th Circuit convenes and
42:53
Speaker 1: they all have a look at it. Let's see what
42:55
Speaker 1: the ruling is then. As of now, this is not,
42:58
Speaker 1: it's garbage, right? Obviously, it's garbage. We don't ever want
43:03
Speaker 1: to see People that are obviously in the wrong get
43:10
Speaker 1: off on technicalities or using loopholes, right? We want the
43:14
Speaker 1: people who are guilty of crimes or of wrongdoing to
43:18
Speaker 1: pay the price like any one of us would have to.
43:20
Speaker 1: And that goes for federal prosecutors doubly. And if these
43:24
Speaker 1: prosecutors weren't forthright, if they didn't inform the survivors like
43:28
Speaker 1: we know they didn't, then they should be held responsible
43:31
Speaker 1: for that. And they should not be protected by their
43:34
Speaker 1: Harvard buddy, an octogenarian, who probably doesn't even know where
43:41
Speaker 1: he is at this point. 90 years old? Come on!
43:46
Speaker 1: So hopefully when the 11th Circuit convenes and we have
43:50
Speaker 1: a full panel, we get a better outcome and a
43:53
Speaker 1: better result when it comes to movement in this part
43:57
Speaker 1: of the case. If you'd like to contact me, you
