- 0:00Lots of news to get to today. I don't think I can really avoid
- 0:03starting with what happened on Friday with the state of
- 0:07Virginia and the redistricting decision that was made just a
- 0:13couple weeks ago by voters in Virginia on a very narrow vote.
- 0:18Never mind because it's gone. My friends, I'm sure you saw the
- 0:22news, but we should talk about it once again, proving that
- 0:26right again. I always love it when I'm
- 0:27proving right about things. You thought the court would
- 0:31overturn it? I did.
- 0:32And I also thought that this was a really gigantic mistake for
- 0:34the Democrats to make because they are just, they're playing a
- 0:37numbers game they don't have the numbers for.
- 0:40Yeah, that's playing out right now, especially after, well, the
- 0:42two big whammies this past week. That and of course the Supreme
- 0:45Court hand down also of the gutting pretty much the Voting
- 0:49Rights Act, the 2nd chapter or whatever of the Voting Rights
- 0:53Act. I think gutting would be a
- 0:55strong word, but yeah, I get what you're saying.
- 0:58Yeah, no, exactly. But even without that, honestly,
- 1:00even without both of those, it was still not really a good
- 1:02numbers game for them to pick. But anyway, if you don't know
- 1:04what happened, I'll quickly update you here.
- 1:06The Virginia Supreme Court threw out the state Democrats
- 1:10redistricting referendum on Friday, ruling in a four to
- 1:13three ruling. By the way, nice little narrow
- 1:15decision that it did not follow the proper procedures and
- 1:20handing a huge political blow to the party in the process.
- 1:24The decision casts aside the state's new congressional map
- 1:27that would have given Democrats a 10 to 1 tilt in Virginia.
- 1:30Under the ruling, the six to five map is going to be staying
- 1:33in place. Quote.
- 1:35This violation irreparably undermines the integrity of the
- 1:39resulting referendum vote and renders it null and void.
- 1:43Justice Arthur Kelsey wrote for the majority.
- 1:46The decision could have large ramifications this fall in the
- 1:50battle for the House, where Democrats hope to win back the
- 1:52majority and put a curb on President Donald Trump during
- 1:57the second-half of his second term.
- 2:00Republicans can only lose a few seats and still hold the House
- 2:04majority. The political winds have been
- 2:06moving in the direction of the Democrats given President
- 2:08Trump's low approval rating in the president's party, usually
- 2:11losing seats in the midterms. But Republicans are doing
- 2:14everything they can to bolster Trump by redrawing congressional
- 2:18lines in the states that they control.
- 2:20This is the Hills take, by the way.
- 2:22It's like this is a story about Democrats redrawing the lines,
- 2:24but somehow it's the Republicans fault.
- 2:26But whatever. Democrats have fought back, most
- 2:28notably in California, but the Virginia decision would damage
- 2:32their chances by giving the candidates a more favorable map
- 2:36in that state. Virginia voters last month had
- 2:40narrowly approved a state constitutional amendment that
- 2:43allowed the Legislature to temporarily draw new lines mid
- 2:46decade, a move that was pitched by Democrats as a response to
- 2:50the redistricting in red states that was backed by President
- 2:53Trump. The map was set to give
- 2:55Democrats four more pickup opportunities this fall as the
- 2:59party fights to flip the House, but legal challenges contended
- 3:03the push violated procedural requirements backed baked excuse
- 3:07me into the Virginia Constitution.
- 3:10To pass an amendment, lawmakers must vote for it in two separate
- 3:14legislative sessions, with an intervening election in between.
- 3:20Virginia Democrats took the first vote on October 31st of
- 3:23last year, arguing that they could still act because Election
- 3:27Day was not until the the next week.
- 3:31But the state's High Court ruled that it was too late,
- 3:34emphasizing early voting was open at that point, with 40% of
- 3:38ballots already cast. While the Commonwealth is free
- 3:42by its by its lights to do the right thing for the right
- 3:45reason, the rule of law requires that it be done in the right
- 3:49way, Kelsey wrote. In A Descent, Chief Justice Cleo
- 3:53Powell said that the majority was broadening the definition of
- 3:56election. The majority's definition
- 3:58creates an infinite voting loop that appears to have no
- 4:02established beginning, only a definitive end Election Day,
- 4:06Powell wrote. The decision caps months of
- 4:09litigation over Virginia Democrats redistricting efforts.
- 4:11The Republican National Committee and other groups had
- 4:14fought the push across several different cases.
- 4:17By the way. That's worth noting too, by the
- 4:19way, that there was other challenges for other reasons,
- 4:22other cases that in my estimation actually had just as
- 4:26much, if not frankly, better chances of succeeding.
- 4:28So this one did it. So that stuff's kind of
- 4:30irrelevant at this point. But there were other things that
- 4:33were in the pipeline that were challenging this.
- 4:35And I must say this too, before I take a quick break, come back,
- 4:38take your calls, I must say this too, I don't particularly love
- 4:43their, their logic about the election date thing.
- 4:48I think that they blew a better opportunity in the, in the
- 4:54evaluation of what the legislature did wrong here.
- 4:57Because, and this comes a little bit back to our experience here
- 5:00in Maine. I I've had about all I can take
- 5:04of gamesmanship of the legislative calendar and the
- 5:08definitions of what is and is not a session and what's regular
- 5:10session. It was a special session and all
- 5:12this other stuff so that the Legislature can circumvent the
- 5:16rules to do things they want to do.
- 5:20I'm a little tired of that. And the reason I'm tired of it
- 5:22is because it happens in Maine all the time.
- 5:24And there was a lawsuit here just last year which ultimately
- 5:29challenged the Legislature doing exactly that, basically
- 5:34adjourning early when they had no intention of adjourning.
- 5:37They had plenty of business left.
- 5:38There was an unbelievable stash of stuff left on the legislative
- 5:43calendar, left on the table. They were just sitting there
- 5:45waiting to do stuff. But they technically adjourned,
- 5:50and I'm air quoting here, they adjourned so that they could
- 5:54then immediately call a special session so that they can define
- 5:59it as a different actual session of the legislature so that they
- 6:02may do things in a way that they wanted to.
- 6:05And that's just, that is far beyond the scope of what we
- 6:10design these systems to do. The whole reason we even have
- 6:13these definitions is to kind of avoid this kind of this
- 6:17nonsense. And the Virginia Democrats did
- 6:19the same thing in the legislature.
- 6:21It wasn't just about that election in the date and the
- 6:23start of the early voting and all that.
- 6:26It was also about their behavior trying to create 2 artificial
- 6:29sessions in in much the same way.
- 6:31So there was a lot of reasons to throw this out, but it's thrown
- 6:34out and they're appealing it. But where are you going to go?
