Latest / Beyond The Horizon / Mega Edition: Opening Statements During Day 1 Of The Chad Daybell Trial (10/18/26)
Transcript
- 0:00Speaker 1: What's up, everyone, and welcome back to the program. On
- 0:03Speaker 1: today's episode, we're going to head up to Idaho, and
- 0:06Speaker 1: we're going to check in on the Chad Daybell trial
- 0:09Speaker 1: and see what transpired during opening statements. And to do that,
- 0:13Speaker 1: we have an article from East Idaho News, and this
- 0:16Speaker 1: article was authored by Nate Eaton. Headline, First witness takes
- 0:22Speaker 1: the stand in Chad Daybell's trial. Part one, 825 a.m.
- 0:29Speaker 1: We're in the courtroom. Members of the public are filing in.
- 0:32Speaker 1: It'll be full today. A line started forming outside the
- 0:35Speaker 1: courthouse at 7 a.m. Chad Daybell is sitting at the
- 0:38Speaker 1: defense table alone. Attorneys and the judge are not in
- 0:41Speaker 1: the courtroom yet. 8.32 a.m. Larry and Kay Woodcock are
- 0:46Speaker 1: in the courtroom. So is Vicki Hoban, Tammy Daybell's aunt.
- 0:50Speaker 1: Tom Evans, a juror in the Lori Vallow case, is
- 0:52Speaker 1: here with his wife and another former juror. 8.33 a.m.
- 0:58Speaker 1: Opening statements in Lori Vallow Daybell's trial were exactly one
- 1:01Speaker 1: year ago today, on April 10th, 2023. There were also
- 1:06Speaker 1: 10 men and 8 women on the jury in that case. 8.36 a.m.
- 1:11Speaker 1: Daybell's sitting stone-faced wearing a blue shirt and a blue tie.
- 1:15Speaker 1: The courtroom has been rearranged, so he is directly facing
- 1:18Speaker 1: the jury. Prosecutor's table will face the judge. 8.53 a.m.
- 1:23Speaker 1: Fremont County Prosecutor Lindsey Blake, Madison County Prosecutor Rob Wood,
- 1:28Speaker 1: Special Prosecutor Ingrid Beatty, Fremont County Deputy Prosecutor Rocky Wixom,
- 1:33Speaker 1: and Defense Attorney John Pryor just walked in. Pryor whispered
- 1:37Speaker 1: something into Daybell's ear. 8.56 a.m. Judge Boyce is on
- 1:43Speaker 1: the bench. 8.58 a.m. Boyce reminds everyone of the courtroom
- 1:47Speaker 1: conduct order. No noises from cell phones, no photos, no video.
- 1:52Speaker 1: He says if there is a technological issue during the
- 1:55Speaker 1: trial with a live stream, they will try to get
- 1:57Speaker 1: things fixed. If there are significant delays, court proceedings will
- 2:01Speaker 1: continue without the video. And I think that we can
- 2:04Speaker 1: take a lot from what's happening here in this Chad
- 2:07Speaker 1: Daybell trial as sort of the template for the way
- 2:10Speaker 1: the Kohlberger trial is going to be handled as well,
- 2:13Speaker 1: at least from a logistics standpoint. And what we have
- 2:17Speaker 1: learned up in Idaho with the Lori Vallow trial and
- 2:20Speaker 1: now with Chad Daybell's trial, We kind of get an
- 2:22Speaker 1: idea of how the state plans on handling someone like
- 2:26Speaker 1: Brian Koberger as well. 9 a.m. Boyce says all 18
- 2:30Speaker 1: jurors are here. State and defense are ready to proceed. 9.01 a.m.
- 2:36Speaker 1: Boyce mentions that witnesses are not allowed to watch court
- 2:39Speaker 1: proceedings unless they are legally classified as a victim. 9.03 a.m.
- 2:45Speaker 1: The jury enters the courtroom. They each have a notepad
- 2:48Speaker 1: and are allowed to take notes, but they can't take
- 2:51Speaker 1: them home. Boyce introduces himself and courtroom staff. 906 AM.
- 2:57Speaker 1: Clerk conducts roll call. Boyce introduces prosecutors and defense attorney
- 3:03Speaker 1: and asks them to stand. Boyce tells jurors Daybell has
- 3:06Speaker 1: pleaded not guilty to the charges listed in the indictment.
- 3:10Speaker 1: The clerk will read the indictment to the jurors. Boyce
- 3:13Speaker 1: tells jurors defendant is never required to prove his innocence
- 3:17Speaker 1: and never has to produce any evidence at all. Well,
- 3:20Speaker 1: I wouldn't suggest that move. considering it worked out so
- 3:23Speaker 1: well for Lori Vallow. Highly doubt that that's going to
- 3:26Speaker 1: be the strategy here. 9.10 a.m. Jurors are sworn in.
- 3:32Speaker 1: Boyce says normal trial schedule will be weekdays from 8.30 a.m.
- 3:36Speaker 1: to 3.30 p.m. Recesses will be held in the morning
- 3:40Speaker 1: and in the afternoon. 9.14 a.m. Jurors get $ 10 a day,
- 3:45Speaker 1: and after five days, it bumps up to $ 40 per day.
- 3:48Speaker 1: They're reimbursed for mileage They are fed lunch and snacks
- 3:51Speaker 1: while they are here. Jeez, $ 10 a day to go
- 3:54Speaker 1: and be a juror for this case? And then bump
- 3:56Speaker 1: it up to a measly $ 40? 9.15 a.m. State goes
- 4:01Speaker 1: first for opening statements because they have the burden of proof.
- 4:04Speaker 1: Defense can then present an opening statement or wait. After
- 4:08Speaker 1: all witnesses and evidence are presented, State and Defense will
- 4:11Speaker 1: present closing arguments. 9.18 a.m. Boyce tells the jurors that
- 4:16Speaker 1: they must determine Daybell's guilt or innocence based solely on
- 4:19Speaker 1: the evidence presented in court. He is presumed innocent until
- 4:23Speaker 1: proven guilty. 9.20 a.m. Boyce says he will not express
- 4:28Speaker 1: any opinions on witnesses and whether they are worthy to
- 4:32Speaker 1: be believed. He will not comment on the facts of
- 4:34Speaker 1: the case. He tells jurors they must follow the court
- 4:38Speaker 1: instructions regardless of their opinions on those instructions. 9.21 a.m.
- 4:43Speaker 1: Boyce explains there may be occasional sidebars where he speaks
- 4:46Speaker 1: with the attorneys in the corner of the courtroom and
- 4:49Speaker 1: white noise is played. And that's pretty common. So what
- 4:53Speaker 1: they're trying to do is drown out their conversation so
- 4:56Speaker 1: it's not picked up by microphones, members of the media,
- 4:59Speaker 1: or anyone in the courtroom for that matter. So they'll
- 5:02Speaker 1: bring everybody over to the side, they'll have their little sidebar,
- 5:06Speaker 1: and they'll pump that white noise into the room. 9.23 a.m.
- 5:10Speaker 1: Boyce continues with jury instruction. including the importance of weighing
- 5:14Speaker 1: witness testimony. 9.27 a.m. Boyce reminds jurors not to talk
- 5:20Speaker 1: about the case with anyone else, to keep an open mind,
- 5:23Speaker 1: not to reach a decision until the end, and don't
- 5:26Speaker 1: discuss it with other jurors until the very end in
- 5:29Speaker 1: the jury room. 9.29 a.m. Boyce finishes jury instruction. Clerk
- 5:35Speaker 1: will now read the amended redacted indictment to the jurors. 9.35 a.m.
- 5:41Speaker 1: A few jurors taking notes as the clerk reads the indictment.
- 5:45Speaker 1: Others listen intently. Chad Daybell sits still with his eyes
- 5:49Speaker 1: looking down. 9.36 a.m. Clerk finishes reading the amended indictment.
- 5:54Speaker 1: Boyce reminds the jurors the indictment is not evidence. It's
- 5:58Speaker 1: now time for opening statements. Rob Wood will give the
- 6:02Speaker 1: statement on behalf of the prosecutors. 9.38 a.m. Wood asks
- 6:07Speaker 1: for a hand mic and stands in front of the jury.
- 6:10Speaker 1: He has a PowerPoint presentation, and there's going to be
- 6:13Speaker 1: a lot of those throughout the trial, and they're going
- 6:16Speaker 1: to use those to slam their point home, just like
- 6:18Speaker 1: they did against Cafuza Lori Vallow. So I expect these
- 6:22Speaker 1: PowerPoints to be very impactful when it comes to the
- 6:26Speaker 1: jury and their interpretation of the evidence in this case. 9.39 a.m.
- 6:33Speaker 1: Two dead children found buried in Chad Daybell's backyard, Woodbegins.
- 6:38Speaker 1: He says Tammy Daybell was found dead in her bed
- 6:41Speaker 1: and 17 days later married his mistress on the beaches
- 6:45Speaker 1: of Hawaii. His desire for sex, money, and power led
- 6:49Speaker 1: to the deaths of his wife and two innocent children.
- 6:53Speaker 1: Same exact monologue, basically, that they used against Vallow. Money, power,
- 6:57Speaker 1: sex were the main motivators that drove Lori Vallow and
- 7:02Speaker 1: Chad Daybell to do what they did according to Lori
- 7:05Speaker 1: Vallow's indictment and according to the charges against Chad Daybell. 9.40 a.m.
- 7:12Speaker 1: He craves significance, Wood said, referring to Daybell. He says
- 7:16Speaker 1: Daybell was an author and explains the background of Chad
- 7:19Speaker 1: and Tammy. They had five children, moved to Idaho, where
- 7:22Speaker 1: Tammy became a beloved school librarian. For this defendant, that
- 7:27Speaker 1: ordinary existence was not enough. And you can tell right
- 7:30Speaker 1: from the get-go what the tone and the tenor of
- 7:33Speaker 1: this is going to be. It was all about power, greed,
- 7:36Speaker 1: and money. And every bit of evidence that the prosecution
- 7:40Speaker 1: is going to present is going to lead us to
- 7:42Speaker 1: that destination. Or at least that's the hope of the prosecution, right?
- 7:47Speaker 1: But considering what we saw with Lori Vallow and using
- 7:50Speaker 1: that as a measuring stick, I highly doubt that we're
- 7:54Speaker 1: going to see any sort of deviation from what we
- 7:57Speaker 1: saw in that trial. The blueprint is there already for
- 8:01Speaker 1: the prosecution to get a conviction. So there's no reason
- 8:05Speaker 1: for them to try and recreate the wheel here. 9.42 a.m.
- 8:10Speaker 1: There are some tech issues with the PowerPoint and the microphone.
- 8:12Speaker 1: Wood pauses while they get it checked out. Chapter 2.
- 8:16Speaker 1: Lori Vallow was a homemaker from Arizona. She was married
- 8:20Speaker 1: to her fourth husband, Charles Vallow, and was the mother
- 8:23Speaker 1: of Tylee Ryan and J.J. Vallow. 9.44 a.m. Wood. You'll
- 8:29Speaker 1: hear about a pivotal date. The day Chad Daybell and
- 8:32Speaker 1: Lori Vallow met at a religious conference in St. George, Utah.
- 8:36Speaker 1: That introduction set into motion... what you will hear about,
- 8:39Speaker 1: and talk about a bunch of batshit crazy people. Imagine
- 8:43Speaker 1: going to some conference and, you know, talking about the
- 8:46Speaker 1: end of the world, this, that, the other thing, and
- 8:48Speaker 1: believing what these people believe. It has to be like
- 8:51Speaker 1: being on a permanent acid trip. 9.45 a.m. Wood. In
- 8:56Speaker 1: his thirst for sex, power, and money, Chad created an
- 9:00Speaker 1: alternate reality where he called themselves James and Elena, or
- 9:04Speaker 1: as I like to call them, Stunad and Scafusa. Wood
- 9:08Speaker 1: says he was captivated by Lori's appearance and spoke about
- 9:11Speaker 1: their sexual encounters on many occasions. More than anything else,
- 9:16Speaker 1: Chad's obsession with Lori was rooted in her adoration for him.
- 9:21Speaker 1: He called her an exalted goddess. 9.46 a.m. Wood laying
- 9:25Speaker 1: out the statement with chapters, Wood says any who opposed
- 9:28Speaker 1: Chad and Lori were labeled as dark spirits or even zombies.
- 9:33Speaker 1: The evidence will show this was a convenient narrative to
- 9:36Speaker 1: dehumanize people who stood in their way. This narrative gave
- 9:39Speaker 1: them the pretext to remove people from the world for
- 9:43Speaker 1: their good. Like most knucklehead, religiously driven crazy people, they
- 9:48Speaker 1: wrap their nonsense up in the shield of, oh, this
- 9:51Speaker 1: is what God told me, or this is what the
- 9:54Speaker 1: angel Moroni told me, or insert spiritual figure here. Meanwhile,
- 9:59Speaker 1: all of that just a ruse to hide the fact
- 10:01Speaker 1: that these people, like Chad Daybell, like Lori Vallow, are
- 10:05Speaker 1: using the premise of religion and all this other stuff
- 10:08Speaker 1: simply to get their own way and to do what
- 10:11Speaker 1: they want to do and to make it a bit
- 10:14Speaker 1: easier for them to do it. So if they wrap
- 10:17Speaker 1: up their bullshit, in this whole entire, you know, religious shield,
- 10:22Speaker 1: then the people that are around them, they can justify it, right? Well,
- 10:25Speaker 1: we had to kill so-and-so, or so-and-so is an evil spirit,
- 10:29Speaker 1: so they have to go. And if you have everybody
- 10:31Speaker 1: believe in your bullshit, well, before you know it, everybody's
- 10:35Speaker 1: coming along for the ride. And that's pretty much what
- 10:38Speaker 1: happened here. All these people that were around them, all
- 10:41Speaker 1: these folks that were hanging out with Lori Vallow, Chad Daybell,
- 10:45Speaker 1: going to these silly-ass conferences... I mean, come on, really?
- 10:49Speaker 1: Chad Daybell is a prophet and he's gonna lead the 144,000, huh? Okay, sure.
- 10:55Speaker 1: And I'm the Sultan of Brunei. 9.47 a.m. Wood introduces
- 11:01Speaker 1: Alex Cox and two photos of him appear on the screen.
- 11:05Speaker 1: Wood references the blessing Chad gave to Alex. Wood says
- 11:09Speaker 1: text messages will be shown showing Alex told his wife
- 11:12Speaker 1: he was afraid he was going to be Chad and
- 11:14Speaker 1: Lori's fall guy. And that's why I've said from the beginning,
- 11:18Speaker 1: that I think that Alex Wood killed himself with an overdose.
- 11:22Speaker 1: Why else did he have Narcan in his system? Nobody
- 11:24Speaker 1: can explain that to me. You're not catching a buzz
- 11:27Speaker 1: off of Narcan. You're not going to take Narcan because
- 11:30Speaker 1: you want to get a opioid buzz. So what was
- 11:34Speaker 1: he doing with Narcan in his system? That's really the
- 11:36Speaker 1: question that I have. And thus far, there hasn't been
- 11:40Speaker 1: a good logical reason given to me as to why
- 11:43Speaker 1: that would be the case. Unless, of course, he was
- 11:45Speaker 1: overdosing and his wife, if you want to call her that,
- 11:49Speaker 1: came in there and gave him this Narcan, right? So
- 11:53Speaker 1: the whole, oh, it was a heart attack seems pretty
- 11:56Speaker 1: convenient to me. 9.48 a.m. Wood tells jurors Charles Vallow
- 12:01Speaker 1: was shot and killed by Alex in Arizona. Lori stood
- 12:04Speaker 1: to get $ 1 million and awaited it. only to learn
- 12:08Speaker 1: the beneficiary was no longer her. I'll still get $ 4, 000
- 12:11Speaker 1: a month from SS, Lori texted Chad. Chad responded, it'll
- 12:16Speaker 1: be interesting to see if it got changed after he
- 12:19Speaker 1: had two bullets in his chest. Imagine these two fucking
- 12:22Speaker 1: disgusting animals. And if anybody has ever deserved that helicopter ride, folks,
- 12:28Speaker 1: I'm telling you right now, it's these two. 9.49 a.m.
- 12:33Speaker 1: Which shows images of Tylee, JJ, and Tammy on the screen.
- 12:37Speaker 1: He explains that Daybell said Tylee and JJ were possessed.
- 12:41Speaker 1: They were found in Chad's backyard. Tammy Daybell, a vivacious
- 12:45Speaker 1: happy mother, was another individual labeled as a dark spirit
- 12:49Speaker 1: to be removed. 9.50 a.m. Wood explains Tammy's death and
- 12:54Speaker 1: Chad cashing in her life insurance policy. Chad and Lori
- 12:58Speaker 1: then went to Hawaii and rented a condo. You will
- 13:02Speaker 1: hear from multiple witnesses that Chad predicted multiple times that
- 13:05Speaker 1: Tammy would die an early death. Yeah, that's not suspect
- 13:09Speaker 1: or anything, huh? Run around talking about, oh, my wife's
- 13:12Speaker 1: going to die an early death. Then she dies an
- 13:15Speaker 1: early death, and you say you just found her there
- 13:17Speaker 1: like that? Oh, she rolled out of bed? Okay, buddy, sure. 9.51 a.m.
- 13:23Speaker 1: Wood shows photos of Chad and Lori on the beach.
- 13:26Speaker 1: He says they were preparing for their wedding well before
- 13:29Speaker 1: Tammy's death. 9.54 a.m. Wood shows a slide that says
- 13:34Speaker 1: the collapse of the dream. It lists the attempted murder
- 13:37Speaker 1: of Brandon Boudreau, concern for the missing children, lies to police,
- 13:41Speaker 1: unwillingness to produce the children, raccoon text. And remember the
- 13:45Speaker 1: raccoon text, he said that he had just shot a raccoon.
- 13:49Speaker 1: But meanwhile, the kids were dead by then. And really
- 13:53Speaker 1: what he meant was that these kids were killed. At
- 13:56Speaker 1: least that's what the prosecution has inferred. 9.55 a.m. Wood
- 14:00Speaker 1: explains that the trial will be lengthy and there will
- 14:03Speaker 1: be a lot of witnesses. He shows a timeline of
- 14:05Speaker 1: major events on the screen. It shows when Chad and
- 14:08Speaker 1: Lori met, Charles Vallow killed, Lori moves to Rexburg, Tylee's
- 14:12Speaker 1: last seen, raccoon text, JJ last seen, attempted homicide of
- 14:16Speaker 1: Brandon Boudreau, shooting at Tammy, Tammy's death, Chad and Lori's marriage,
- 14:21Speaker 1: welfare check on JJ, Chad and Lori lie to police
- 14:24Speaker 1: and leave town, children found buried, Children found buried on
- 14:28Speaker 1: Chad's property. 9.57 a.m. Slide on the screen says outline
- 14:32Speaker 1: of evidence to come. It includes financial evidence, law enforcement testimony,
- 14:37Speaker 1: unraveling the conspiracy, DNA testing, fingerprints, and the Hawaii police.
- 14:42Speaker 1: And they're almost following the Lori Vallow template to a
- 14:45Speaker 1: T here. When we're talking about the evidence presented, how
- 14:49Speaker 1: they go about it, this is exactly how they went
- 14:53Speaker 1: after Lori Vallow and how they got that conviction. And
- 14:56Speaker 1: my guess is when all is said and done, Chad
- 14:59Speaker 1: Daybell is going to be found guilty. 9.59 a.m. Wood,
- 15:04Speaker 1: you will hear many of this defendant's own words. You
- 15:07Speaker 1: will read multiple texts that he and Lori sent back
- 15:10Speaker 1: and forth. 10 a.m. News slide says, yet unwritten, and
- 15:15Speaker 1: lists all the charges Daybell faces. Two dead children buried
- 15:18Speaker 1: in this defendant's backyard. The next month, his wife is
- 15:21Speaker 1: dead in their bed. 17 days later, this defendant marries
- 15:25Speaker 1: Lori Vallow. Members of the jury, your verdict will be
- 15:29Speaker 1: the link that writes the final chapter of this tragic saga.
- 15:33Speaker 1: Wood finishes. His statement was around 22 minutes long. 10.01 a.m.
- 15:39Speaker 1: Pryor will give an opening statement after morning break. So
- 15:42Speaker 1: this seems like the perfect place for us to break too.
- 15:46Speaker 1: So what we're going to do is wrap up this
- 15:47Speaker 1: first episode. And in the next episode, we'll pick up
- 15:51Speaker 1: with Chad Daybell's lawyer giving their opening statement. All of
- 15:56Speaker 1: the information that goes with this episode can be found
- 15:59Speaker 1: in the description box. What's up, everyone, and welcome back
- 16:02Speaker 1: to the program. In this episode, we're going to pick
- 16:05Speaker 1: up where we left off, up in Idaho, at the
- 16:08Speaker 1: Chad Daybell trial. So, let's just get right back to it.
- 16:14Speaker 1: Once again, this article is provided by the East Idaho News,
- 16:18Speaker 1: and the author of this article is Nate Eaton. 1020 AM,
- 16:23Speaker 1: back in the courtroom. Chad Daybell is smiling as he
- 16:26Speaker 1: chats with his attorney. 10.30 a.m. All the attorneys and
- 16:30Speaker 1: Chad Daybell are in the courtroom waiting on the judge
- 16:33Speaker 1: and the jury. 10.31 a.m. Boyce is on the bench.
- 16:37Speaker 1: Jurors are being brought in. 10.34 a.m. Jurors are in.
- 16:42Speaker 1: Pryor has a handheld mic and stands in front of
- 16:44Speaker 1: the group. He introduces himself and says he's from Meridian. 10.34 a.m.
- 16:51Speaker 1: What's important are facts and evidence, Pryor says. He tells
- 16:56Speaker 1: jurors not to be distracted by speculation, guesses, assumptions, or hunches.
- 17:02Speaker 1: Pryor says Chad Daybell went on a mission to talk
- 17:05Speaker 1: to people about his religious beliefs, 10.35 a.m. Pryor says
- 17:10Speaker 1: Chad served his mission in New Jersey, returned home, and
- 17:13Speaker 1: then dated Tammy for six months. Then they got married
- 17:17Speaker 1: and had five children. They moved to Idaho and ran
- 17:20Speaker 1: a publishing company that was predominantly run by Tammy. 10.37am.
- 17:25Speaker 1: Pryor tells Jerry Chad wrote books about religious experiences. He
- 17:29Speaker 1: writes about his premonitions. He writes about good and evil
- 17:33Speaker 1: and what it means to be good and what it
- 17:35Speaker 1: means to be evil. He writes about dark and light.
- 17:38Speaker 1: He writes about death and the coming of the end
- 17:41Speaker 1: of things and when his savior in his mind is
- 17:43Speaker 1: going to come back. Pryor says all the books were
- 17:46Speaker 1: based on fiction. Now, look, it's one thing for Chad
- 17:49Speaker 1: Daybell to believe this bullshit. The fact that he got
- 17:52Speaker 1: other people to follow along with him is just crazy
- 17:55Speaker 1: to me. Now, I know it shouldn't be because there's
- 17:58Speaker 1: a lot of crazy people out there that are willing
- 18:00Speaker 1: to believe a lot of crazy shit as long as
- 18:03Speaker 1: that crazy shit lines up with their confirmation bias. So...
- 18:08Speaker 1: They're out here thinking that all this stuff is real.
- 18:11Speaker 1: Then they have a guy like Chad Daybell show up
- 18:13Speaker 1: talking about how he's a conduit to God, how he's
- 18:17Speaker 1: talking to angels, all this other bullshit. Well, the people
- 18:20Speaker 1: who want that to be real, they're going to be
- 18:23Speaker 1: the ones who believe you, right? And they're going to
- 18:25Speaker 1: be the ones that follow along with your bullshit. So
- 18:28Speaker 1: those people are already you know, preconditioned to believe this
- 18:32Speaker 1: stuff is true. But those of us who reside on
- 18:35Speaker 1: the plane of reality, we all know that that's a
- 18:37Speaker 1: bunch of BS. And there's no angels that are coming
- 18:40Speaker 1: down to talk to people, and certainly not coming down
- 18:43Speaker 1: to talk to somebody like Chad Daybell. And as far
- 18:46Speaker 1: as fiction goes, the books might be fiction, but you
- 18:49Speaker 1: know what else is fiction? The whole entire narrative that
- 18:52Speaker 1: Chad Daybell is trying to pitch. 10.38am. Pryor says in
- 18:56Speaker 1: late October 2018, Chad was invited to speak at an event.
- 19:01Speaker 1: While he was trying to sell his books, this beautifully
- 19:04Speaker 1: stunning woman named Lori Vallow comes up and she starts
- 19:08Speaker 1: giving him a lot of attention. She pursued him. She
- 19:11Speaker 1: encouraged him. She went so far as to go behind
- 19:13Speaker 1: the booth and help him selling his books. So there
- 19:17Speaker 1: you see the strategy right away. Daybell and his lawyer, Mr.
- 19:21Speaker 1: Pryor here, they're going right for the throat. Lori Vallow's fault?
- 19:26Speaker 1: She's the one who initiated all of the contact that
- 19:29Speaker 1: we had, and eventually she was the one who talked
- 19:33Speaker 1: Chad Daybell into this. Is that going to be the
- 19:36Speaker 1: way that they go and the strategy that they try
- 19:39Speaker 1: to use? That would be their best bet. Throw Lori
- 19:42Speaker 1: Vallow directly under the bus. 10.40 a.m. Pryor says that
- 19:47Speaker 1: after the seminar, there was a 1-2 month break where
- 19:51Speaker 1: Chad and Lori had no contact. Pryor says Chad had
- 19:54Speaker 1: a speeding ticket in 2005, but no other background. But
- 19:58Speaker 1: Lori Vallow was a different story. Lori Vallow was someone who,
- 20:02Speaker 1: right out of high school, married her first husband. That
- 20:05Speaker 1: marriage was very short-lived. Very short-lived. So he's inferring here, right?
- 20:11Speaker 1: And I think that we can tell a lot about
- 20:13Speaker 1: what their strategy is going to be as a defense
- 20:16Speaker 1: from just this little bit. And if this is the
- 20:19Speaker 1: way they're going to go, it's probably the best path
- 20:22Speaker 1: for them to take. Do I think it's going to
- 20:24Speaker 1: end up with Chad Daybell, you know, not getting convicted? No,
- 20:28Speaker 1: I don't believe that. But the strategy used by Lori Vallow,
- 20:32Speaker 1: that was a losing strategy from day one. If you're
- 20:35Speaker 1: not going to get up there, you're not going to
- 20:36Speaker 1: defend yourself. You have nothing to add. Well, I have
- 20:39Speaker 1: news for you. You're going to prison. 10.41 a.m. Pryor
- 20:42Speaker 1: mentions Lori's second short-lived marriage. He says Alex Cox, her brother,
- 20:47Speaker 1: would do anything to assist his sister without question. If
- 20:51Speaker 1: Alex Cox perceived there was a problem, Alex Cox reacted.
- 20:55Speaker 1: Pryor says jury will hear testimony that Lori's third marriage
- 20:58Speaker 1: to Joseph Ryan was tumultuous. 10.42 a.m. Pryor says Alex
- 21:04Speaker 1: Cox approached Joseph Ryan and shot him with a taser
- 21:07Speaker 1: in 2007, years before Lori knew Chad. It set the
- 21:12Speaker 1: pattern for what we are dealing with with Alex Cox.
- 21:15Speaker 1: Whenever there was a problem with Lori Vallow, Alex Cox
- 21:18Speaker 1: ran to the rescue. 10.43 a.m. Pryor says Chad and
- 21:23Speaker 1: Lori had an inappropriate relationship while their former spouses were
- 21:27Speaker 1: still alive. Pryor tells the jury that Alex Cox shot
- 21:30Speaker 1: and killed Charles. Prior, says the jury, they will see
- 21:35Speaker 1: Chad Daybell had nothing to do with the execution of
- 21:37Speaker 1: Charles Vallow or the shooting of Brandon Boudreau. Maybe not physically,
- 21:42Speaker 1: but conspiratorially. Behind the scenes, working it out, egging Alex
- 21:48Speaker 1: Cox on, egging Lori Vallow on. So let's not try
- 21:52Speaker 1: and set this up and frame it like Chad Daybell
- 21:54Speaker 1: was just a passenger on this ship. This fool was steering. 10.45 a.m.
- 22:01Speaker 1: Pryor says Chad had no background and then Miss Texas
- 22:04Speaker 1: Lori Vallow, a very sexual person, came into his life.
- 22:08Speaker 1: After that, eventually, yes, there was a murder and there
- 22:11Speaker 1: was a burial, Pryor says. He says the backyard of
- 22:14Speaker 1: Chad's property is a four-and-a-half-acre farm. 10.46 a.m. Pryor talks
- 22:20Speaker 1: about the burial locations of JJ and Tylee. Pryor plans
- 22:24Speaker 1: to bring forward four experts, including Dr. Greg Hampakian, a
- 22:29Speaker 1: DNA expert. Hampikian got Amanda Knox exonerated in Italy because
- 22:34Speaker 1: of DNA evidence, Pryor says. He is the guy. He's
- 22:37Speaker 1: going to talk a little bit about the DNA evidence
- 22:39Speaker 1: that was found at the scene. So, of course, it's
- 22:43Speaker 1: going to be a battle of experts. And they're both,
- 22:45Speaker 1: meaning prosecution and the defense, are going to try and
- 22:48Speaker 1: get an expert up there that's pitching their narrative. What
- 22:52Speaker 1: it's going to come down to, though, are the facts. 10.48 a.m.
- 22:57Speaker 1: Pryor says Hampikian will talk about several hairs found on
- 23:01Speaker 1: the plastic of J.J. Vallow. He's also going to say
- 23:05Speaker 1: there was no DNA evidence, no hair sample of Chad
- 23:08Speaker 1: Daybell on Tylee Ryan or J.J. Vallow. Pryor says the
- 23:12Speaker 1: jury will also hear from Dr. Raven, a forensic pathologist,
- 23:16Speaker 1: who will talk about the circumstances surrounding Tammy Daybell. He
- 23:20Speaker 1: says she will say there is no indication this was
- 23:22Speaker 1: a homicide or any other cause of death. 10.49 a.m.
- 23:28Speaker 1: Pryor says the jury will hear testimony from three to
- 23:31Speaker 1: four of Chad's children. They're going to talk about their
- 23:33Speaker 1: mother's health struggle. They're going to talk about their mother's
- 23:36Speaker 1: use of various medical treatments she would use, oils she
- 23:40Speaker 1: would put on her leg, medicine, and different herbs she
- 23:43Speaker 1: would take, and that their mother was suffering from a
- 23:46Speaker 1: number of maladies, and she would refuse to see a doctor.
- 23:50Speaker 1: So that's going to be the narrative? Another one of
- 23:52Speaker 1: these dudes that trots out their children to try and
- 23:55Speaker 1: get them off, huh? Is there anything worse than a
- 23:58Speaker 1: scumbag who uses his kids to try and get him
- 24:01Speaker 1: out of a crime? I mean, holy cow. Bro, just
- 24:04Speaker 1: own up to it already, okay? We all know the deal. Furthermore,
- 24:09Speaker 1: these kids were found buried on your property. And I've
- 24:13Speaker 1: said it from the beginning. I don't think that Chad
- 24:15Speaker 1: Daybell was the one who actually killed these kids as
- 24:18Speaker 1: far as the action itself. But I think that him,
- 24:22Speaker 1: Lori Vallow, and Alex Cox conspired to kill these children.
- 24:28Speaker 1: Vallow and Daybell were the ones who came up with
- 24:30Speaker 1: the plan, and then Alex Cox is the one who
- 24:32Speaker 1: carried it out. 10.50 a.m. Pryor says the jury will
- 24:36Speaker 1: hear from Patrick Eller, a data forensic examiner. Pryor says
- 24:40Speaker 1: the jury will hear testimony that Alex Cox visited the
- 24:43Speaker 1: Daybell property multiple times, and Eller will present information and
- 24:47Speaker 1: data to support it. Dr. Eric Bartolink will also testify,
- 24:54Speaker 1: Pryor says. He is a forensic pathologist. Well, that's all
- 24:58Speaker 1: fine and well, and you can have all of these
- 25:01Speaker 1: guys come up and say that there's no DNA from
- 25:04Speaker 1: Chad found at the crime scene or where these kids
- 25:07Speaker 1: were buried. That doesn't help you when it comes to conspiracy. Remember,
- 25:12Speaker 1: conspiracy to commit murder. That gets you the same sentence
- 25:16Speaker 1: as actually pulling the trigger. And if you remember back
- 25:19Speaker 1: to the jury selection phase, that's why the prosecution was
- 25:23Speaker 1: talking about the Kansas City Chiefs and winning the Super
- 25:26Speaker 1: Bowl and if everybody should get a ring. So it
- 25:30Speaker 1: was the analogy they were using to set things up
- 25:33Speaker 1: for all of this conspiracy talk that we're going to
- 25:36Speaker 1: hear about. 10.52 a.m. Pryor tells the jury to listen
- 25:40Speaker 1: to the arguments and not make their decision until the
- 25:43Speaker 1: very end. I'm going to ask you folks to return
- 25:46Speaker 1: a verdict if not guilty. Thank you, folks. Pryor's opening
- 25:49Speaker 1: statement was around 19 minutes. 10.53 a.m. Boyce now holding
- 25:54Speaker 1: a sidebar with attorneys to discuss the scheduling. 10.56 a.m.
- 26:00Speaker 1: First witness called to the stand is Rexburg police detective
- 26:03Speaker 1: Ray Hermosillo. 11 a.m. Hermosillo has been a detective with
- 26:09Speaker 1: Rexburg police for about five years. He was in law
- 26:12Speaker 1: enforcement for 18 years before becoming a detective in Rob
- 26:16Speaker 1: Wood is questioning Hermosillo. He says he was contacted on
- 26:20Speaker 1: November 1, 2019 by Fremont County Sheriff's Office saying there
- 26:25Speaker 1: was possibly a Jeep in Rexburg that was involved in
- 26:28Speaker 1: a homicide in Arizona. 11.01 a.m. Hermosillo contacted Gilbert, Arizona
- 26:34Speaker 1: police and they asked him to seize the Jeep if
- 26:37Speaker 1: it could be found. Gilbert asked Rexburg to conduct intermittent
- 26:41Speaker 1: surveillance on the residents. Hermosillo says They surveyed between November
- 26:47Speaker 1: 1st to 4th at 565 Pioneer Road in Rexburg. 11.02 a.m.
- 26:54Speaker 1: Hermosillo says Chad and Lori were observed a few times
- 26:57Speaker 1: at the location. His primary job was to look for
- 27:01Speaker 1: a Jeep. Wood asked to admit an exhibit for Hermosillo
- 27:04Speaker 1: to look at. 11.04 a.m. Four photos are admitted into evidence.
- 27:09Speaker 1: Pryor has some questions about the evidence. Chad scoots the
- 27:13Speaker 1: microphone over so Pryor can be heard. 11.06 a.m. Pryor
- 27:17Speaker 1: asks Hermosillo if he went through the Jeep or took
- 27:20Speaker 1: photos himself. Hermosillo says that he went through the Jeep personally.
- 27:25Speaker 1: Pryor has no further questions. Boyce asks for a quick sidebar.
- 27:29Speaker 1: White noise is played. And for those of you who
- 27:32Speaker 1: were following along during Lori Vallow's trial, you'll be very
- 27:36Speaker 1: familiar with a lot of the names that are going
- 27:38Speaker 1: to come up this time around. It's going to be
- 27:40Speaker 1: a lot of the same people as far as evidence-wise.
- 27:43Speaker 1: You're going to see a lot of the same witnesses
- 27:45Speaker 1: Get called to the stand. 11.10 a.m. Boyce back on
- 27:49Speaker 1: the bench. Wood is showing two photos of the Jeep
- 27:52Speaker 1: to the jurors. It's a gray Jeep that was registered
- 27:54Speaker 1: to Charles Vallow, but Tylee Ryan drove it. The next
- 27:58Speaker 1: photo shows the back of the Jeep with a Texas
- 28:01Speaker 1: license plate. 11.12 a.m. Hermosillo says he never saw children
- 28:06Speaker 1: with Lori or Chad. At that time, Hermosillo did not
- 28:09Speaker 1: know who JJ or Tylee were, and Rexburg police were
- 28:13Speaker 1: not asked to look for the kids at that time. 11.13 a.m.
- 28:17Speaker 1: After the Jeep was seized, Gilbert police detectives and crime
- 28:21Speaker 1: analysts flew to Rexburg. They served a warrant and were
- 28:24Speaker 1: looking for the infotainment system that contained the GPS locations.
- 28:29Speaker 1: They came on November 18, 2019, and asked Hermosillo if
- 28:33Speaker 1: they had seen any children. Rexburg police said they had not. So,
- 28:38Speaker 1: no children. The kids are missing. Not with Mom, not
- 28:42Speaker 1: with Chad Daybell, not with any of their friends. So
- 28:45Speaker 1: where are these kids? Well, now we all know that
- 28:47Speaker 1: they were dead. But at the time, nobody had any
- 28:50Speaker 1: idea where J.J. or Tylee was. Hermosillo says Gilbert Police
- 28:58Speaker 1: asked Rexburg to do a welfare check on J.J. Vallow.
- 29:01Speaker 1: They were provided with a brief description and where J.J.
- 29:04Speaker 1: should be, 565 Pioneer Road, where he lived with his mother,
- 29:08Speaker 1: Lori Vallow. and I think that we're even taking it
- 29:12Speaker 1: a step too far to call this lady a mother.
- 29:15Speaker 1: This skafooza should have never been a mother. 1118 AM.
- 29:20Speaker 1: Wood asked to admit three exhibits. The first is Kane
- 29:23Speaker 1: and Todd Trahan's birth certificate, place of birth, Lake Charles, Louisiana.
- 29:28Speaker 1: 1120 AM. The second exhibit is an adoption decree for
- 29:33Speaker 1: Kane and Trahan. Wood asked Hermosillo to read from the decree.
- 29:36Speaker 1: It says the name of Kanan Trahan is being changed
- 29:40Speaker 1: to Joshua Jackson Vallow. 1122 AM. Exhibit 3 is Joshua
- 29:45Speaker 1: Jackson Vallow's birth certificate. 1123 AM. Hermosillo says they received
- 29:50Speaker 1: a few photos of JJ from Gilbert Police and JJ's grandmother,
- 29:54Speaker 1: Kay Woodcock. Hermosillo says photos and video of JJ were
- 29:59Speaker 1: found on Lori Vallow's iCloud account. Wood admits Exhibit 4,
- 30:03Speaker 1: a photo of JJ Vallow. Pryor asks the source of
- 30:07Speaker 1: the photo. Hermosillo says it came from Vallow's iCloud. Pryor
- 30:11Speaker 1: asks to approach. White noise is played. 11.26 a.m. Boyce
- 30:16Speaker 1: is back on the bench. During testimony, many jurors are
- 30:18Speaker 1: taking notes. Others haven't written a thing. Some drink water, coffee,
- 30:23Speaker 1: Diet Coke. 11.27 a.m., which shows the photo of J.J.
- 30:28Speaker 1: to the jury and gallery. Hermosillo says on November 25, 2019,
- 30:34Speaker 1: he got a call from the Gilbert police, Detective Pilar.
- 30:37Speaker 1: He asked Hermosillo to do a welfare check on J.J.
- 30:40Speaker 1: the next morning. Hermosillo did the check on November 26.
- 30:44Speaker 1: He and Detective Dave Hope went to Vallow's home. As
- 30:48Speaker 1: we approached, we noticed the defendant, Chad Daybell, and Alex
- 30:51Speaker 1: Cox unloading a pickup near the garage area. 11.29 a.m.
- 30:57Speaker 1: Hermosillo knew who Chad and Alex were. He says he
- 31:00Speaker 1: got out of the vehicle and made contact with Alex.
- 31:03Speaker 1: He asked if Lori was home. Alex said she was
- 31:06Speaker 1: not home. Hermosillo asked if JJ was home. At that point,
- 31:10Speaker 1: Alex got surprised and a frightened look on his face
- 31:13Speaker 1: looked over across the pickup at defendant Daybell. Daybell then
- 31:17Speaker 1: looked back at Alex and said, and initially neither one
- 31:19Speaker 1: of them answered my question. Well, that's because they couldn't
- 31:22Speaker 1: answer the question, because this poor kid was already killed. 11.30 a.m.
- 31:29Speaker 1: Alex eventually said JJ was with his grandmother in Louisiana.
- 31:33Speaker 1: I informed Alex that it was unlikely JJ was with
- 31:35Speaker 1: his grandmother Kay, because she was the one who called
- 31:38Speaker 1: in the welfare check. Hermosillo says, He says Alex looked
- 31:42Speaker 1: over at Chad, and they both looked at each other.
- 31:45Speaker 1: I asked Alex where I could find Lori Vallow. Hermosillo says. Alex,
- 31:49Speaker 1: says Lori, was in apartment 107, the same complex, but
- 31:53Speaker 1: a few apartments down. Oh, all of a sudden, you
- 31:56Speaker 1: know where she is, huh? Yeah, none of this is suspect.
- 31:59Speaker 1: None of these interactions with Alex Cox and Chad Daybell
- 32:03Speaker 1: that the detective had were anything to be concerned about, right? Right? 11.32 a.m.
- 32:10Speaker 1: Hermosillo asks for Lori's cell phone number. Alex said he
- 32:14Speaker 1: didn't have it. Rexburg police knew Alex and Lori were
- 32:17Speaker 1: siblings and extremely close. When Alex told me he didn't
- 32:20Speaker 1: have his sister's cell phone number, I assumed he was
- 32:22Speaker 1: lying to me. 11.33 a.m. Hermosillo and Hope went to
- 32:27Speaker 1: the apartment to find J.J. Vallow. They knocked on apartment
- 32:31Speaker 1: 107 and there was no answer. Hope knocked on neighbor's doors.
- 32:35Speaker 1: Hermosillo walked back to his vehicle to call for more detectives.
- 32:39Speaker 1: He called for more because of the deception from Alex.
- 32:42Speaker 1: I wanted to figure out exactly what was going on.
- 32:44Speaker 1: and we were going to start canvassing the area and
- 32:47Speaker 1: knocking on doors. And at this point, for Chad Daybell,
- 32:51Speaker 1: Lori Vallow, and Alex Cox, this was the beginning of
- 32:54Speaker 1: the end. 11.35 a.m. As Hermosillo approached the car, Chad
- 33:00Speaker 1: drove toward him in a black Chevy Equinox. Hermosillo stopped
- 33:04Speaker 1: him to talk to him. He asked Chad when was
- 33:07Speaker 1: the last time he saw JJ Vallow. Chad said it
- 33:10Speaker 1: was in October in apartment 107 with Lori Vallow. Chad
- 33:14Speaker 1: told Hermosillo he had only met Lori a couple of
- 33:16Speaker 1: times and didn't know her very well. Bros out here
- 33:20Speaker 1: spitting all kinds of lies. That's not very godly of you,
- 33:23Speaker 1: by the way, Chad Daybell. What would the angels say? 11.36 a.m.
- 33:27Speaker 1: Hermosillo knew. Chad and Lori were married in Hawaii two
- 33:31Speaker 1: weeks prior. Hermosillo asked Chad for Lori's phone number. He
- 33:35Speaker 1: said he didn't have it. Detective Hope saw the two
- 33:38Speaker 1: talking and walked back towards them. Hermosillo asked again. for
- 33:42Speaker 1: Lori's number and Chad gave it to him. Chad said
- 33:45Speaker 1: he felt Hermosillo was accusing him of something and that's
- 33:48Speaker 1: why he didn't give him the number the first time.
- 33:50Speaker 1: Oh yeah, well, you're being accused, stupid, because you're guilty.
- 33:54Speaker 1: That's why you're being accused, you fucking stoonod. 11.37 a.m.
- 33:59Speaker 1: Hermosillo was not wearing a body camera. As a detective,
- 34:02Speaker 1: most of the interviews are done at the department in
- 34:05Speaker 1: a controlled environment with cameras. Patrol officers are assigned body cameras,
- 34:10Speaker 1: but detectives are not. 11.38 a.m. Hermosillo asked his lieutenant,
- 34:17Speaker 1: Ron Ball, to gather detectives and responded to the complex.
- 34:20Speaker 1: Ball arrived with another detective and they began knocking on doors.
- 34:25Speaker 1: They went to Lori's apartment and nobody answered. Hermosillo learned
- 34:29Speaker 1: Melanie Boudreau, now Pawlowski, Lori's niece, live right next door.
- 34:35Speaker 1: Nobody answered that door. 11.40 a.m. At that point, our
- 34:39Speaker 1: only focus was to find JJ, and we were going
- 34:42Speaker 1: to exhaust every means to do that. Hermosillo went to
- 34:45Speaker 1: the prosecutor's office to get a warrant. While he was
- 34:48Speaker 1: on the way, Detective Hope called and left a message.
- 34:51Speaker 1: Lori Vallow called Hope back, and they told her to
- 34:54Speaker 1: open the door. Detective Stubbs and Detective Ball made contact
- 34:58Speaker 1: with Lori that day. And all of these other people,
- 35:01Speaker 1: Melanie and the rest of them, Zaluma, they're lucky that
- 35:05Speaker 1: I wasn't the prosecutor. I would have charged them all.
- 35:09Speaker 1: In fact, they're lucky they didn't get hit with Rico. 11.43 a.m.
- 35:14Speaker 1: Hermosillo says police attempted to locate Melanie Gibb, Lori's friend.
- 35:19Speaker 1: Lori told police that JJ was with Gibb in Arizona.
- 35:23Speaker 1: Detective Pilar in Arizona went to the Gibb residence at
- 35:26Speaker 1: around 9 p.m. Rexburg police learned JJ was not there.
- 35:30Speaker 1: Hermosillo contacted Ball, and they agreed to meet at the
- 35:34Speaker 1: prosecutor's early the next morning. to get search warrants on
- 35:37Speaker 1: Apartments 175, Lurie's, 174, Melanie's, and 107. 11.46 a.m. The
- 35:46Speaker 1: warrants were executed on November 27, 2019. They searched Apartment
- 35:51Speaker 1: 175 first. Everything looked ordinary. There were couches, papers on
- 35:56Speaker 1: the table. There was food in the refrigerator and food
- 35:59Speaker 1: in the pantry. Hermosillo said it appeared people lived there.
- 36:02Speaker 1: but there were no clothes on any of the hangers
- 36:05Speaker 1: in the closet. J.J. was not in the apartment. 11.47 a.m.
- 36:10Speaker 1: Police found a child's Star Wars suitcase mixed in with
- 36:13Speaker 1: the 72-hour kits and an old prescription bottle for J.J.
- 36:18Speaker 1: There were also some scooters and a small child's bike
- 36:21Speaker 1: on the porch. Hermosillo sees the Risperidone prescription and the suitcase.
- 36:27Speaker 1: Police then searched apartment 174. Everything was normal, but no
- 36:31Speaker 1: signs of J.J., 11.48 a.m., apartment 107 was completely vacant.
- 36:37Speaker 1: In apartment 174, police found a large amount of cash
- 36:41Speaker 1: that they seized for safekeeping. In apartment 175, police found
- 36:46Speaker 1: several different styles of weapons in the garage. Handguns, rifles,
- 36:50Speaker 1: guns of various calibers, army knives, they were seized for safekeeping. 11.49 a.m.,
- 36:56Speaker 1: there was no evidence that J.J. Vallow had been in
- 36:59Speaker 1: apartment 174 or 107. In apartment 175, a storage unit
- 37:04Speaker 1: rental agreement contract was found. The name of Lori Ryan
- 37:08Speaker 1: was on the contract and it was a storage unit
- 37:10Speaker 1: number C-52. Police went to the storage unit. 11.51 a.m.
- 37:16Speaker 1: Hermosillo explains what was in the unit, photos, family items, etc.
- 37:21Speaker 1: Would ask for a brief sidebar. 11.52 a.m. We are
- 37:25Speaker 1: going to break for lunch. We'll be back in one hour.
- 37:28Speaker 1: So this is where we're going to break as well.
- 37:30Speaker 1: And in the next episode, we'll pick up where we
- 37:33Speaker 1: left off and finish up with the first day of
- 37:36Speaker 1: Chad Daybell's trial. All of the information that goes with
- 37:39Speaker 1: this episode can be found in the description box. What's up, everyone,
- 37:44Speaker 1: and welcome back to the program. In this episode, we're
- 37:47Speaker 1: going to finish off opening statements in the Chad Daybell trial.
- 37:52Speaker 1: And to do that, we're going to pick back up
- 37:54Speaker 1: where we left off with that EastIdahoNews.com article that was
- 37:58Speaker 1: authored by Nate Eaton. 1 p.m. We are back in
- 38:03Speaker 1: the courtroom. Detective Hermosillo remains on the stand. Chad Daybell
- 38:07Speaker 1: just walked in and is chatting with Pryor at the
- 38:09Speaker 1: defense table. Half of the right side of the gallery
- 38:12Speaker 1: is now blocked off, and the bailiff says the public
- 38:15Speaker 1: is no longer allowed to sit there. So that's interesting.
- 38:18Speaker 1: I wonder what went down. 1.04 p.m. Boyce enters the
- 38:22Speaker 1: courtroom and would ask for a sidebar to discuss an
- 38:25Speaker 1: evidence issue. Detective Hermosillo remains on the stand. 1.07 p.m.
- 38:30Speaker 1: Boyce back on the bench and the jurors are being
- 38:33Speaker 1: brought in to the courtroom. 1.10 p.m. Wood continues questioning
- 38:37Speaker 1: Hermosillo about the search of Lori's apartment. He asked to
- 38:41Speaker 1: admit more exhibits. 1.12 p.m. The exhibits are photos taken
- 38:47Speaker 1: from Lori's residence on November 27th, 2019. Pryor asked what
- 38:52Speaker 1: time the photos were taken. Hermosillo says between 10 a.m.
- 38:56Speaker 1: and noon. Pryor asked repeated questions about who took the pictures.
- 39:00Speaker 1: Hermosillo doesn't know who took the pictures. 1.16 p.m. Hermosillo
- 39:06Speaker 1: says around 10 people were in the apartment at the
- 39:08Speaker 1: time the photos were taken but doesn't know who took
- 39:11Speaker 1: the photos. Pryor objects to having the pictures admitted. Wood
- 39:15Speaker 1: wants to lay more foundation. 1.17 p.m. Pryor objects again
- 39:21Speaker 1: after Wood asks more questions. Boyce overrules the objection with
- 39:24Speaker 1: the exception of one photo and they are admitted. And
- 39:28Speaker 1: remember a lot of these objections... they know that they're
- 39:31Speaker 1: not going to be sustained and what they're trying to
- 39:34Speaker 1: do is set it up for later on down the
- 39:36Speaker 1: road when they're looking for that appeal. So sometimes when
- 39:39Speaker 1: you see them object to silly things like that and
- 39:41Speaker 1: you're wondering why, well, a lot of the time, that's
- 39:45Speaker 1: the reason they do that, especially in cases like this
- 39:48Speaker 1: where they know or, at the very least, think their
- 39:51Speaker 1: clients are cooked. 1.18 p.m. The photos are shown on
- 39:55Speaker 1: the screen and to the jury. The first picture is
- 39:57Speaker 1: the front porch area of apartment 175. The next photo
- 40:01Speaker 1: shows the front room kitchen area. A child's suitcase is
- 40:05Speaker 1: on the floor along with some other items. If there
- 40:07Speaker 1: were no kids there, why do you have kids' bikes?
- 40:10Speaker 1: Why do you have a kid's suitcase? Why do you
- 40:11Speaker 1: have all these toys? Why do you have pill bottles
- 40:14Speaker 1: with JJ's name on them? So these are questions that
- 40:17Speaker 1: my dumb ass is coming up with. You know the
- 40:20Speaker 1: investigators were all over it. 1.20pm The next photo shows
- 40:24Speaker 1: pictures on the walls, the TV, papers on the counter.
- 40:28Speaker 1: The next image is the Star Wars suitcase and some
- 40:32Speaker 1: 72-hour kits under the stairs. 1.22pm The next photo shows
- 40:38Speaker 1: the top of the stairwell looking down into the bottom
- 40:40Speaker 1: of the stairs. The following image shows the master bedroom,
- 40:44Speaker 1: bedding and pillows are on the mattress. 1.23 p.m. The
- 40:48Speaker 1: next photo caused some red flags for us when we
- 40:51Speaker 1: were searching the apartment, Hermosillo says. There were a lot
- 40:54Speaker 1: of empty hangers. It appears to us that she just
- 40:57Speaker 1: grabbed her clothes, left everything else, and took off. Yeah, well,
- 41:01Speaker 1: when you're on the lam and you're worried about being arrested,
- 41:04Speaker 1: you don't have time to clean up. take your gear
- 41:07Speaker 1: and you go. So Lori Vallow and Chad Daybell, they
- 41:11Speaker 1: all knew that eventually this was going to catch up
- 41:14Speaker 1: with them. So what they were going to do is
- 41:17Speaker 1: go and live their best life until that happened. And
- 41:20Speaker 1: for Scafusa and Stunad, their best life was walking around
- 41:24Speaker 1: the beaches in Hawaii. So like I always say, they
- 41:27Speaker 1: like Hawaii so much, no problem. Let's get that helicopter,
- 41:31Speaker 1: gas it up. Once Chad Daybell is convicted, which I
- 41:34Speaker 1: think is going to happen... Let's get him in that helicopter,
- 41:37Speaker 1: and we can throw him directly in the volcano, and
- 41:40Speaker 1: we'll be done with it. 1.24 p.m. The next picture
- 41:44Speaker 1: is the bedroom on the right-hand side. This is where
- 41:47Speaker 1: police found some of Alex's belongings, including a plastic tub,
- 41:51Speaker 1: hygiene items, etc. The new photo shows what was in
- 41:54Speaker 1: Alex's room. Two white Tyvek suits are laid out on
- 41:57Speaker 1: the floor. The room to the left has twin beds
- 42:00Speaker 1: with bedding. And to me... I know I've said this
- 42:03Speaker 1: a million times at this point when we're talking about this,
- 42:06Speaker 1: but Alex Cox, in my opinion, is the one who
- 42:09Speaker 1: actually murdered these kids. This disgusting, deranged individual with his
- 42:15Speaker 1: Lannister-type relationship with his sister? Yeah, he was a sick,
- 42:19Speaker 1: degenerate fuck. And the only thing I'm sorry about is
- 42:23Speaker 1: that he isn't around to face justice like Scafusa and Stunad.
- 42:27Speaker 1: And not to digress too far, but there's no way
- 42:30Speaker 1: you're going to convince me that this dude died of
- 42:31Speaker 1: a heart attack. Talk about convenient. 1.26 p.m. Wood asked
- 42:37Speaker 1: to admit a photo of a rental agreement Lori Ryan signed.
- 42:40Speaker 1: He shows the agreement to the jury. The agreement led
- 42:43Speaker 1: police to the storage unit. 1.32. Wood presents more exhibits
- 42:48Speaker 1: and asks Hermosillo to review them. They are photos taken
- 42:51Speaker 1: in apartment 175 in the garage on November 27, 2019.
- 42:56Speaker 1: Hermosillo was present in the garage. The items were in
- 43:00Speaker 1: the picture. were taken out to be photographed. 1.33 p.m.
- 43:06Speaker 1: Wood moves to admit the photos into evidence. Pryor objects.
- 43:10Speaker 1: He asks who took the photos. Hermosillo says Detective Dave
- 43:13Speaker 1: Hope took them. Boyce overrules the objection and the pictures
- 43:17Speaker 1: are admitted. 1.36 p.m. The photos are shown on the screen.
- 43:22Speaker 1: The first image shows rifle magazines on the floor that
- 43:25Speaker 1: were inside tubs. There was also suppressors, ammunition, a ghillie
- 43:30Speaker 1: camouflage suit, and some other items. The next photo shows
- 43:34Speaker 1: items found in a black plastic bag. The clothing and
- 43:37Speaker 1: items are laid out on the floor. 1.40 p.m. The
- 43:40Speaker 1: next picture is a close-up of the rifle. The following
- 43:43Speaker 1: photo shows two suppressors. The next picture shows knives found
- 43:47Speaker 1: among the ammunition in the tubs. The next exhibit shows
- 43:51Speaker 1: a handgun in a case found inside the garage. The
- 43:54Speaker 1: next exhibit shows a Halloween mask found in a plastic
- 43:57Speaker 1: bag in the garage along with duct tape and rope.
- 44:00Speaker 1: Oh yeah, that's not a serial killer starter kit or anything. 1.42 p.m.
- 44:05Speaker 1: The next photo shows the rope and the duct tape
- 44:08Speaker 1: in a Walmart bag. The last photo shows Alex Cox's
- 44:11Speaker 1: passport found in the belongings. 1.44 p.m. Wood moves to
- 44:17Speaker 1: admit more exhibits. Pryor's asking about police staging the items
- 44:21Speaker 1: and what items were photographed. Hermosillo says they took pictures
- 44:25Speaker 1: of anything they thought was of evidentiary value. So anything
- 44:29Speaker 1: that might end up being something they use later on
- 44:33Speaker 1: to get a conviction, they're taking pictures of it. They're
- 44:36Speaker 1: going to document it. They're going to make sure that
- 44:38Speaker 1: it's included with the evidence and that they're able to
- 44:41Speaker 1: go back and say, this was for that. This was
- 44:44Speaker 1: for this. And this is why this evidence matters. So
- 44:49Speaker 1: what Pryor is trying to do is to attack the
- 44:51Speaker 1: process itself. The evidence gathering process was the chain of
- 44:56Speaker 1: custody respected and who took the pictures, blah, blah, blah.
- 45:00Speaker 1: And for him, when you have a client like Chad Daybell,
- 45:03Speaker 1: who's guilty in my opinion, you really don't have much
- 45:06Speaker 1: else to use, right? Loopholes and technicalities is about the
- 45:11Speaker 1: extent of it. So I'm sure we're going to see
- 45:13Speaker 1: a lot of that from Mr. Pryor as things continue
- 45:15Speaker 1: to progress here. What I do find interesting, though, is
- 45:18Speaker 1: that they're already framing it and setting it up a
- 45:21Speaker 1: little bit to toss Lori Vallow under the bus. So
- 45:24Speaker 1: that's pretty significant in my opinion. 1.46 p.m. Prior asked
- 45:30Speaker 1: follow-up questions about the photos. The photos are admitted. The
- 45:34Speaker 1: first picture shows a printed email of what was located
- 45:37Speaker 1: in the garage. The paper shows names and numbers associated
- 45:41Speaker 1: with the names. The email was sent from Chad Daybell
- 45:44Speaker 1: in October of 2018. 1.49 p.m. The photos show continuations
- 45:50Speaker 1: of the emails. The following photo shows books written by
- 45:54Speaker 1: Chad Daybell that were found in a tub. The final
- 45:57Speaker 1: photo is the cell phone found in a tub in
- 45:59Speaker 1: the garage. And for any of you aspiring authors out there,
- 46:03Speaker 1: if Chad Daybell's bitch ass can do it, so can you.
- 46:07Speaker 1: If this do not confine an audience, anyone can. 1.51 p.m.
- 46:12Speaker 1: Hermosillo says J.J. Vallow was not located on November 27th.
- 46:17Speaker 1: The next step was to talk to anyone who would
- 46:19Speaker 1: take their phone calls. J.J., who we were looking for,
- 46:23Speaker 1: so we were exhausting every effort to find... JJ, Hermosillo says.
- 46:28Speaker 1: They called siblings, family members, anyone who might know the
- 46:31Speaker 1: whereabouts of JJ. 1.53 p.m. Police spoke with Brandon Boudreau,
- 46:37Speaker 1: Melanie Boudreau, and Colby Ryan. After speaking with Colby, the
- 46:41Speaker 1: search grew to include Tylee Ryan. 1.55 p.m. Wood moves
- 46:47Speaker 1: to enter an exhibit showing Tylee Ryan's birth certificate. 1.56 p.m.
- 46:53Speaker 1: On December 11, 2019, J.J. Vallow and Tylee Ryan were
- 46:58Speaker 1: entered into the National Center for Missing and Exploited Children.
- 47:01Speaker 1: The FBI, Chandler Police, and Gilbert Police were contacted to
- 47:05Speaker 1: help with the search. 2 p.m. Detectives tried to contact
- 47:10Speaker 1: Lori Vallow on her cell phone, but it was turned off.
- 47:13Speaker 1: Hermosillo says they contacted Chad Daybell by calling his cell,
- 47:17Speaker 1: but it was also shut off. Hermosillo says Lori and Chad...
- 47:21Speaker 1: never contacted Rexburg police about the missing children. So your
- 47:26Speaker 1: kids go missing and you don't even bother calling the cops, huh? Yeah,
- 47:30Speaker 1: you had nothing to do with it. And the more
- 47:31Speaker 1: we talk about this case, the more we talk about
- 47:34Speaker 1: these two people, the more my contempt grows for both
- 47:37Speaker 1: of them. 2.01 p.m. Police set up multiple tip hotlines
- 47:41Speaker 1: so anyone with information on JJ and Tylee could call.
- 47:44Speaker 1: Armacillo says they received tips and those tips were all
- 47:48Speaker 1: assigned numbers. They were followed up on by detectives and
- 47:52Speaker 1: other officers. 2.03 p.m. After police put out a news release,
- 47:57Speaker 1: they received more tips. 2.05 p.m. Hermosillo learned about the
- 48:02Speaker 1: location of Chad and Lori at the beginning of January 2020.
- 48:05Speaker 1: Eyewitnesses called into the police department and said the couple
- 48:09Speaker 1: was on Kauai. Hermosillo issued cell phone warrants that helped
- 48:13Speaker 1: locate Chad and Lori. 2.07 p.m. Hermosillo arrived in Hawaii
- 48:19Speaker 1: on on January 24, 2020. He went to assist in
- 48:23Speaker 1: serving a court order to produce Tylee and JJ in Rexburg.
- 48:27Speaker 1: Lori was served the order the next day. Hermosillo says
- 48:30Speaker 1: he observed the Kauai Police Department serve two search warrants,
- 48:34Speaker 1: one on Chad and Lori's condo, the other on their
- 48:37Speaker 1: rental car. 2.08 p.m. Hermosillo says everything looked normal at
- 48:42Speaker 1: the condo. There were beach towels, food in the fridge, couches,
- 48:46Speaker 1: everything seemed ordinary, he says. JJ and Tylee were not there.
- 48:50Speaker 1: There was nothing that showed a child or teenager lived
- 48:54Speaker 1: at the condo. And again, that's because these kids were
- 48:56Speaker 1: dead already. This lady's out here living her best life
- 48:59Speaker 1: with Mr. Stunat over here. And meanwhile, these kids are
- 49:03Speaker 1: buried in the pet cemetery at Chad Daybell's house. 2.09 p.m.
- 49:08Speaker 1: Lori Vallow never produced her children to the Rexburg Police
- 49:12Speaker 1: Department of Department of Health and Welfare. Wood asked to
- 49:15Speaker 1: present another exhibit. 210. The exhibit is a photo of
- 49:19Speaker 1: Tylee Ryan taken from her Instagram account. 212 PM. Wood
- 49:25Speaker 1: asked Hermosillo what the phrase proof of life means to him.
- 49:28Speaker 1: He says it's anything they can use to prove the
- 49:31Speaker 1: last time somebody was seen alive. Hermosillo says the last
- 49:34Speaker 1: known proof of life for Tylee was taken from Lori's
- 49:38Speaker 1: Lori for Style iCloud account. It was a picture of
- 49:41Speaker 1: Tylee taken at West Yellowstone. 2.14. Wood asked to admit
- 49:46Speaker 1: more photos. Boyce asked for a quick sidebar. 2.16 p.m.
- 49:51Speaker 1: The exhibits are admitted without objection. 2.18 p.m. Hermosillo says
- 49:56Speaker 1: they were unable to find any photos showing Tylee alive
- 50:00Speaker 1: after the Yellowstone picture. So that's just creepy. You look
- 50:03Speaker 1: at this picture of Tylee Ryan, J.J. Vallow, and that
- 50:08Speaker 1: beaver-faced piece of shit Alex Cox standing here at Yellowstone,
- 50:12Speaker 1: and my contempt just continues to grow. Not only were
- 50:15Speaker 1: these poor kids murdered, they were murdered by the people
- 50:18Speaker 1: they trust the most in this world. And to me,
- 50:20Speaker 1: that makes it even more abhorrent. This little boy went
- 50:23Speaker 1: with his uncle, thinking everything was all good, and then
- 50:26Speaker 1: his uncle kills him? There is not a hell hot
- 50:28Speaker 1: enough for somebody like Alex Cox. 2.21 p.m. Next exhibit
- 50:33Speaker 1: is a photo of JJ sitting on the couch in
- 50:36Speaker 1: apartment 175. The picture was on the Lori for Style account.
- 50:41Speaker 1: And he's wearing the red pajamas that he was actually
- 50:43Speaker 1: found in when his remains were located. 2.22 p.m. The
- 50:48Speaker 1: photo was taken September 22, 2019 at 11.46 a.m. Here
- 50:53Speaker 1: is the picture. And when you click on the link,
- 50:56Speaker 1: you'll be able to check these pictures out as well. 2.24 p.m.
- 51:00Speaker 1: Rexburg police reached out to the family, FBI, anybody that
- 51:04Speaker 1: would take our calls, in the search for the kids,
- 51:06Speaker 1: Hermosillo says, 2.25 p.m. During the search for the kids,
- 51:10Speaker 1: Hermosillo was aware of an investigation in Fremont County regarding
- 51:15Speaker 1: the suspicious death of Tammy Daybelt, Chad's wife. She died
- 51:18Speaker 1: on October 19, 2019. Imagine having all these deaths around you,
- 51:24Speaker 1: all these people who are relatively healthy, and then children
- 51:27Speaker 1: who are definitely healthy, just start dropping dead. Oh yeah,
- 51:30Speaker 1: nobody's going to have any questions for you and your
- 51:32Speaker 1: skafooza-ass girlfriend, wife, whatever you want to call her, as
- 51:36Speaker 1: you're traipsing around on the beach in Hawaii, you moron. 2.27 p.m.
- 51:42Speaker 1: Voice calls for an afternoon break. Court will be held
- 51:44Speaker 1: tomorrow from 8.30 to 3.30, but there will be no
- 51:47Speaker 1: court on Friday. 2.56 p.m. We're back in the courtroom.
- 51:52Speaker 1: Jurors take their seats. Hermosillo remains on the stand. 257.
- 51:57Speaker 1: Wood asked Hermosillo if he ever executed a search warrant
- 52:01Speaker 1: on Chad Daybell's house in Fremont County. He has. He
- 52:05Speaker 1: served the warrant on June 9, 2020. He arrived at
- 52:08Speaker 1: around 7 a.m. 3 p.m. Wood moves to admit a
- 52:12Speaker 1: Google Earth image showing Daybell's property. Hermosillo is familiar with
- 52:16Speaker 1: the general layout of the yard and the house. 303 p.m.
- 52:20Speaker 1: Hermosillo says the FBI, the FBI ERT, Evidence Recovery Team,
- 52:26Speaker 1: the AG, Fremont County Sheriff's Office, and Rexburg Police conducted
- 52:30Speaker 1: the search warrant. Boyce asked to have a sidebar with
- 52:33Speaker 1: the attorneys about the exhibit, and they go back into
- 52:36Speaker 1: the chambers. 3.10 p.m. Hermosillo explains who he was with
- 52:41Speaker 1: when they arrived at Chad's house. They knocked on the
- 52:44Speaker 1: front door, and Mark Daybell, Chad's son, answered. He was
- 52:47Speaker 1: eating cereal. Mark said his dad was still sleeping. Mark
- 52:51Speaker 1: let the police in and showed them where Chad was
- 52:53Speaker 1: sleeping in a bedroom above the garage. 3.11 p.m. Chad
- 52:57Speaker 1: asked to get dressed and met officers downstairs. They gave
- 53:01Speaker 1: him the warrant, and Chad asked to speak with his attorney.
- 53:04Speaker 1: Chad called Mark Means, his attorney at the time. Chad
- 53:07Speaker 1: sat on a recliner in the front room and read
- 53:09Speaker 1: through the search warrant. He asked if he needed to leave.
- 53:12Speaker 1: Police told him he didn't need to leave, but if
- 53:14Speaker 1: he chose to stay, he would be accompanied by an
- 53:17Speaker 1: officer for safety purposes. 3.13 p.m. Chad asked to make
- 53:22Speaker 1: a phone call and went outside. Hermosillo went with him.
- 53:26Speaker 1: Chad asked to sit in the car to make his call.
- 53:28Speaker 1: Hermosillo stood in the grass near the vehicle. Wood shows
- 53:31Speaker 1: a satellite map displaying Daybell's property. 3.14 p.m. Hermosillo uses
- 53:38Speaker 1: a laser pointer to show on the map where he
- 53:40Speaker 1: and Chad were in the front of the home. He
- 53:43Speaker 1: shows where the shop, back driveway, and pasture areas are. 3.16 p.m.
- 53:49Speaker 1: Hermosillo says as the call progressed, Chad had the phone
- 53:52Speaker 1: in his right hand and was intently looking over his
- 53:55Speaker 1: right shoulder. I found it odd. I wanted to see
- 53:57Speaker 1: what he was looking at, so I maneuvered myself to
- 54:00Speaker 1: see what he was so intently looking at. 3.17 p.m.
- 54:04Speaker 1: Hermosillo says law enforcement officers were marking off different areas
- 54:09Speaker 1: on the property. There were some ERT members marking off
- 54:12Speaker 1: a section under the tree right next to the pond area,
- 54:14Speaker 1: Hermosillo says, pointing with a laser to the area on
- 54:18Speaker 1: the map. 3.22 p.m. Hermosillo says ERT members marked off
- 54:23Speaker 1: places under the tree near the pond. They marked off
- 54:26Speaker 1: a 6x6 section. There was taller shrubs in the middle
- 54:30Speaker 1: of the 6x6 section. It looked like there was a
- 54:33Speaker 1: little bit of grass, the length of sod, and some
- 54:35Speaker 1: dirt protruding through the grass. So if it looks like
- 54:38Speaker 1: there's a burial ground somewhere or anything's been disturbed, you
- 54:41Speaker 1: better believe ERT is going to find out. These are
- 54:45Speaker 1: the best guys in the world, guys and gals in
- 54:46Speaker 1: the world, doing this job. So... When these guys show
- 54:50Speaker 1: up at your property, forget it. You're in big trouble. 3.24 p.m.
- 54:54Speaker 1: Hermosillo says as they remove the first layer of ground,
- 54:58Speaker 1: he smelled decomposing body. There were white rocks under the
- 55:02Speaker 1: dirt and there were boards below the white rocks. After
- 55:05Speaker 1: the boards were removed, there was a discoloration in the dirt.
- 55:09Speaker 1: It was wet and moist. Chad sits motionless as this
- 55:13Speaker 1: is being described. 3.26 p.m. After they removed the dirt,
- 55:18Speaker 1: police found a black round object. It appeared to take
- 55:21Speaker 1: the shape of the crown of a human head, Hermosillo says.
- 55:25Speaker 1: At that point, the ERT team leader made a slit
- 55:27Speaker 1: in the black plastic. He kind of opened it up
- 55:30Speaker 1: a little bit. Underneath the black plastic was another white
- 55:32Speaker 1: layer of plastic. Underneath that, it looked to be brown
- 55:36Speaker 1: human hair, Hermosillo says. 3.28 p.m. Hermosillo says at this point,
- 55:42Speaker 1: Chad was leaving his daughter's residence, Kitty Corner, to Chad's
- 55:45Speaker 1: house at a high rate of speed. Police followed him
- 55:48Speaker 1: and took him into custody. Why are you dipping? Why
- 55:51Speaker 1: are you driving away at a high rate of speed, stupid? 3.29 p.m.
- 55:56Speaker 1: Hermosillo says under the tree, they discovered a small body
- 55:59Speaker 1: wrapped in black plastic. And on that note, Boyce dismisses
- 56:03Speaker 1: the jurors. There is one additional item Boyce wishes to
