- 0:00Speaker 1: Books coming in through the sea by sea are down
- 0:04Speaker 1: ninety one percent.
- 0:06Speaker 2: And I don't know who the nine percent is.
- 0:08Speaker 1: I'm not sure either circus, but down ninety one percent
- 0:11Speaker 1: by sea.
- 0:13Speaker 2: And Secretary of warpete Hegsas said, it's only the beginning.
- 0:18Speaker 1: We've only just begun striking Narco boats and putting Narco
- 0:23Speaker 1: terrorists at the bottom of the ocean because they've been
- 0:26Speaker 1: poisoning the American people. And Joe Biden tried to approach
- 0:30Speaker 1: it with kid gloves and allow them to come across
- 0:33Speaker 1: the border. Cartels takeover community. Twenty million people, hundreds of
- 0:37Speaker 1: thousands of Americans poisoned, and President Trump said, no, we're
- 0:40Speaker 1: taking the bluffs off. We're taking the fight.
- 0:42Speaker 2: To these designated terror organizations. Now, the talk amongst Democrats
- 0:47Speaker 2: and much of the media has been that second boat strike,
- 0:50Speaker 2: and that was addressed by the secretary.
- 0:54Speaker 1: So you did see any survivors, to be clear, after
- 0:56Speaker 1: that first start, I did not personally see, but I
- 1:01Speaker 1: stand because the thing was on fire, that was exploded.
- 1:04Speaker 1: In fire or smoke, you can't see any digital there's
- 1:07Speaker 1: this is called the fog of war.
- 1:10Speaker 2: So let's look at the legal justification for just one
- 1:12Speaker 2: moment that deministration is using for the attack on these
- 1:15Speaker 2: drug boats. By combining several legal frames, they find the
- 1:20Speaker 2: legal ground for the strikes on these boats off Venezuela. One,
- 1:24Speaker 2: they look at the maritime drug control laws that allows
- 1:26Speaker 2: the Coastguard, for example, to board, inspect, and prosecute drug
- 1:32Speaker 2: cartel members. They've also designated the traffickers as terrorists unlawful combatants.
- 1:37Speaker 2: They've added in the idea that a non international armed
- 1:41Speaker 2: conflict exists with the drug cartels. And then their fourth
- 1:45Speaker 2: is the US constitutional right to self defense. Now, Democrat
- 1:51Speaker 2: Senator Mark Kelly, he doesn't buy it. That is against
- 1:55Speaker 2: the Geneva Conventions. That's against the laws of war, which
- 2:01Speaker 2: we should always be abiding by. We're the United States
- 2:04Speaker 2: of America. We are not Russia.
- 2:06Speaker 1: We're not a rack, We're not a ram.
- 2:08Speaker 2: We have to hold our people to a higher standard.
- 2:10Speaker 2: This is really serious. He's talking about the follow on strike,
- 2:14Speaker 2: the second strike on a singular drug boat, the one
- 2:18Speaker 2: that much of the press is talking about, where there
- 2:20Speaker 2: are reported the survivors after the first strike and a
- 2:22Speaker 2: second strike hit those survivors. Their initial report came from
- 2:27Speaker 2: the Washington Post, but the New York Times now has
- 2:29Speaker 2: a report out and it contradicts what was reported by
- 2:33Speaker 2: the Washington Post. In fact, it says that heg Seth
- 2:36Speaker 2: did not order the killing of the survivors. And for
- 2:39Speaker 2: all of this hand ringing, for all of this conversation,
- 2:42Speaker 2: it's important to remember is it genuine? Is this concern over,
- 2:45Speaker 2: for example, the Geneva Convention, or is this yet another
- 2:49Speaker 2: example of Trump derangement syndrome? Anything in everything to attack,
- 2:54Speaker 2: even through Pete Hegseth, the President Donald Trump. Well, one
- 2:59Speaker 2: indicator on the sincerity of this attack is how did
- 3:03Speaker 2: they react when President Obama launched over five hundred and
- 3:07Speaker 2: forty missile attacks during his terms, thousands and thousands of missiles,
- 3:12Speaker 2: one of which targeted and an American citizen. I'll let
- 3:16Speaker 2: you be the judge on the sincerity or yet another
- 3:19Speaker 2: opportunity to simply flex your TDS. Joining me now is
- 3:24Speaker 2: former Navy JAG officer Don Brown. Don, thanks for being
- 3:28Speaker 2: with us here today. You're a JAG officer. You are
- 3:30Speaker 2: of the type that are being invoked today a lot
- 3:34Speaker 2: of JAG officers appearing on CNN or MSNBC talking about
- 3:37Speaker 2: violations of the Geneva Convention. In this second boat strike.
- 3:40Speaker 3: What say you, well, good to be back with you
- 3:43Speaker 3: will I say that's ridiculous. Listen. The legality of protecting
- 3:47Speaker 3: American citizens on the high seas is vetted in international
- 3:51Speaker 3: law and goes back to the beginning of the Republic,
- 3:54Speaker 3: when Thomas Jefferson sent the Marines in the Navy and
- 3:56Speaker 3: the Mediterranean against the Barbary pirates. Lincoln sees the RMS
- 4:00Speaker 3: Trent and even FDR ordered the Navy to shoot and
- 4:03Speaker 3: sink German U boats almost a year before Pearl Harbor.
- 4:07Speaker 3: We can protect our people on the high seas. And
- 4:10Speaker 3: it goes into custom. The statues that you cited are important,
- 4:14Speaker 3: but the inherent right of the Commander in Chief under
- 4:16Speaker 3: Article two of the Constitution gives President trumpet right to
- 4:18Speaker 3: do this. But the difference is this, Well, we lost
- 4:21Speaker 3: more Americans in one year to fentanyl than ten years
- 4:24Speaker 3: of the Vietnam War. And you know, all of us
- 4:27Speaker 3: know folks who have lost their kids. This is these
- 4:30Speaker 3: are weapons of mass destruction. The consequences are high. And
- 4:34Speaker 3: at that boat was still in the water, we had
- 4:37Speaker 3: every right to take it out because it was carrying
- 4:39Speaker 3: about all accounts, weapons of mass destruction. Applaud Pete hedgseet's
- 4:43Speaker 3: the Secretary of War and President Trump and taking action
- 4:46Speaker 3: here to protect Americans.
- 4:47Speaker 2: Okay, I want to follow up on that last point,
- 4:49Speaker 2: But it seems that there's two buckets for this conversation.
- 4:51Speaker 2: One the legal framework which we've just laid out, and
- 4:55Speaker 2: you added the Article two powers of the President to
- 4:57Speaker 2: conduct these strikes, to conduct these strikes. The second bucket, though,
- 5:01Speaker 2: is the one that is currently at the forefront of
- 5:04Speaker 2: the conversation everywhere else, and that is the second strike
- 5:07Speaker 2: on this one drug boat where there were reported survivors.
- 5:11Speaker 2: Now you heard the Secretary of War, it's the fog
- 5:13Speaker 2: of war. Something the journalists are very and by the way,
- 5:16Speaker 2: I think you would probably say something similar about JAG
- 5:18Speaker 2: officers are very unfamiliar with. It's the second guessing. It's
- 5:21Speaker 2: the looking over the shoulder of guys that make critical
- 5:24Speaker 2: decisions in the moment. And it's very easy for a
- 5:27Speaker 2: journalist sitting in a studio in New York City to say,
- 5:29Speaker 2: you know what one should or shouldn't have done. But
- 5:32Speaker 2: what do you say about this conversation of the second
- 5:35Speaker 2: strike on that boat.
- 5:37Speaker 3: Sure, first off, it should not be the role of
- 5:39Speaker 3: JAG officers, the second guest commander in chief, but to
- 5:42Speaker 3: reinforce good order in discipline and military. Here's what I say.
- 5:46Speaker 3: Those boats have weapons of mass destruction that will take
- 5:50Speaker 3: out Americans. If the boat is still in the water
- 5:54Speaker 3: with those drugs on it, whether some terrorists is hanging
- 5:57Speaker 3: on or not, you blow up the hell out of
- 5:59Speaker 3: the water because it's going to kill Americans. That's exactly
- 6:02Speaker 3: what I say.
- 6:02Speaker 2: Will Okay, Well, we appreciate you joining us today to
- 6:06Speaker 2: look into this issue. Thank you, don thank you.
