Latest / The Vault: The Epstein Files / Mega Edition: Judge Kaplan Blasts Prince Andrew And His Legal Team (7/16/26)
Transcript
- 0:00Speaker 1: The phone call took place today between Prince Andrew's representatives,
- 0:04Speaker 1: his new lawyers that are based in Hollywood, and the
- 0:08Speaker 1: prosecutors and the judge. And it looks like from the
- 0:12Speaker 1: reports we're hearing that the judge wasn't having any of
- 0:15Speaker 1: Prince Andrew and his legal team's nonsense. In fact, when
- 0:19Speaker 1: it's so far as admonishing them for making things way
- 0:23Speaker 1: more difficult than they had to be. Pretty much figure
- 0:29Speaker 1: that would be the case, right, Look, these judges, like
- 0:32Speaker 1: I said earlier, they're like feudal lords.
- 0:35Speaker 2: Right.
- 0:36Speaker 1: You mess with these dudes, it's like going into a
- 0:39Speaker 1: badger den and taking a whiz on one and expecting
- 0:42Speaker 1: it not to, you know, go crazy on you. So
- 0:46Speaker 1: with Andrew and his team all of the bluster about
- 0:50Speaker 1: how they were just going to ignore all of this,
- 0:52Speaker 1: we knew that wasn't going to be the case, because
- 0:55Speaker 1: being tried in absentia is never the proper route to
- 0:59Speaker 1: go if you're looking to you prove your innocence.
- 1:02Speaker 2: So I figure that.
- 1:04Speaker 1: They'd be ready to feel this call. But it's nice
- 1:08Speaker 1: to see the judge giving them a bit of a
- 1:10Speaker 1: slap here and telling them that he's not playing games.
- 1:13Speaker 1: Pretty much no more, bs, Let's get down to it
- 1:18Speaker 1: is basically what the judge is telling them. So let's
- 1:21Speaker 1: jump into this article from law and crime and author
- 1:25Speaker 1: Adam Klasfeld, and let's see exactly what in the hell
- 1:29Speaker 1: went on today during that phone call. Headline Federal judge
- 1:35Speaker 1: skewer's lawyer for Prince Andrew for making service more complicated
- 1:40Speaker 1: than it is. And again it really that's really what
- 1:43Speaker 1: it comes down to, right, this guy is ducking and
- 1:46Speaker 1: dodging like Rip Torrens throwing wrenches at him and he's
- 1:50Speaker 1: in dodgeball when in reality he should accept this summons
- 1:56Speaker 1: and come and challenge these accusations in court. He's such
- 1:59Speaker 1: a big tough guy, right, He's such a war hero,
- 2:03Speaker 1: such an honorable dude. Then what are you running for? Bro?
- 2:07Speaker 1: What are you hiding out at your mom's house for?
- 2:13Speaker 1: Don't make it more complicated than it needs to be.
- 2:21Speaker 1: Prince Andrew has disputed that the woman accusing him of
- 2:23Speaker 1: sexually abusing her as a seventeen year old served him
- 2:27Speaker 1: properly with a lawsuit. That argument appeared to land poorly
- 2:31Speaker 1: in court on Monday, when a federal judge signaled that
- 2:34Speaker 1: this is a losing battle. Look, there was no doubt
- 2:38Speaker 1: in my mind that this was going to be the result. Right,
- 2:43Speaker 1: he wasn't gonna get off on the service of this warrant.
- 2:47Speaker 1: They weren't going.
- 2:48Speaker 2: To be able to.
- 2:50Speaker 1: Use that as a way for him to wiggle off
- 2:53Speaker 1: the hook. I was pretty confident that Boys and Schiller
- 2:58Speaker 1: and the rest of the legal team would have been
- 3:01Speaker 1: very thorough leading up to all of this.
- 3:04Speaker 2: This is very high profile.
- 3:05Speaker 1: This isn't something you throw together in a day or two, right,
- 3:08Speaker 1: and with the legal office, I am sure that this
- 3:11Speaker 1: is something they've been preparing for for quite some time.
- 3:14Speaker 1: So I am sure that they went through everything they
- 3:17Speaker 1: needed to go through. You know, had a mock situation
- 3:21Speaker 1: that they ran before them and came up with the
- 3:24Speaker 1: best way to go about serving this guy that would
- 3:27Speaker 1: have some weight with the court.
- 3:31Speaker 2: It's not like they just.
- 3:32Speaker 1: Woke up one day and they were like, all right,
- 3:33Speaker 1: we'll show up at insert castle.
- 3:36Speaker 2: Here and we'll just do whatever we.
- 3:38Speaker 1: Want and say we serve them. There's a certain process
- 3:41Speaker 1: that goes along with it, and those steps have to
- 3:44Speaker 1: be followed, and according to this judge, those steps were
- 3:49Speaker 1: obviously followed. And Andrew and his team are the ones
- 3:53Speaker 1: playing games. You have a pretty high degree of certainty
- 3:59Speaker 1: that he can be served sooner than later. US District
- 4:01Speaker 1: Judge Lewis Kaplan told the Prince's lawyers during a telephone conference.
- 4:06Speaker 1: Let's cut out all the technicalities and get to the substance.
- 4:09Speaker 1: He added, Man, is this judge hanging out listening to
- 4:12Speaker 1: the podcast? This me and this guy might be kindred souls.
- 4:17Speaker 1: I am so tired of technicalities when it comes to
- 4:20Speaker 1: these trials and these situations of law. How about we
- 4:23Speaker 1: get down to who's innocent and who's guilty. Shouldn't that matters?
- 4:28Speaker 1: Shouldn't that be like the most important thing? But it's
- 4:31Speaker 1: really not right. It's a game of technicalities and loopholes
- 4:34Speaker 1: that these people are playing, and the one who's the
- 4:37Speaker 1: most proficient at that, the one who is the most
- 4:40Speaker 1: skilled at that, is going to be the best lawyer
- 4:43Speaker 1: in the room. It has nothing to do with guilt
- 4:45Speaker 1: or innocence anymore, and hell, maybe it never has. Again,
- 4:49Speaker 1: I'm not some kind of expert in the field of
- 4:52Speaker 1: you know, a judicial law. I most certainly am not.
- 4:56Speaker 1: But I'm also not going to be gas lit or
- 4:59Speaker 1: bullshit by these people. So when it comes down to
- 5:04Speaker 1: this kind of situation. It's nice to see the judge
- 5:09Speaker 1: himself bringing up technicalities and pointing out that he's not
- 5:14Speaker 1: gonna stand for it. Let's get to the substance. Let's
- 5:17Speaker 1: get to the meat on the bone. Why are we
- 5:19Speaker 1: dicking around around the edges. With that remark, the judge
- 5:27Speaker 1: made clear that ducking service is not likely to be
- 5:30Speaker 1: a successful gambit to avoid a lawsuit by Virginia Roberts,
- 5:35Speaker 1: one of the most outspoken victims of the now deceased
- 5:38Speaker 1: pedophile Jeffrey Epstein. And so this can only be considered
- 5:43Speaker 1: a w for Virginia here in round one. Right, So
- 5:47Speaker 1: they're gonna have to answer for this. There's gonna be
- 5:49Speaker 1: no running, there's gonna be no avoiding the service. And
- 5:53Speaker 1: if him and his law team don't show up to
- 5:56Speaker 1: any of these trials or whatever, then this judge is
- 6:00Speaker 1: going to render a decision in absentia and it's not
- 6:03Speaker 1: going to turn out well for Prince Andrew. So, like
- 6:07Speaker 1: I thought from the jump, old boy is over the barrel.
- 6:10Speaker 1: And all of those people who thought, oh, because he's
- 6:12Speaker 1: a royal, he's gonna avoid this, well, a lot of
- 6:14Speaker 1: people didn't have any clue about what's really going on here.
- 6:20Speaker 1: There are all sorts of different levers and methods put
- 6:25Speaker 1: into place via treaties for these exact kinds of situations. Now,
- 6:31Speaker 1: of course, him being a royal definitely throws a wrench
- 6:34Speaker 1: into things. But obviously this judge and I'm sure other
- 6:38Speaker 1: judges don't really care about that, and pretty much proving
- 6:43Speaker 1: it right here by telling Andrew he's gonna have to
- 6:45Speaker 1: answer for this in court. You're not gonna get off
- 6:47Speaker 1: on this on a technicality. You're not going to just
- 6:49Speaker 1: push this away. You're gonna have to sit down and
- 6:52Speaker 1: you're gonna have to, you know, defend yourself here. Roberts
- 7:02Speaker 1: alleges in her lawsuit that the Duke of York sexually
- 7:04Speaker 1: assaulted her as a teenager in three places Epstein's New
- 7:08Speaker 1: York mansion and private island in the US Virgin Islands,
- 7:12Speaker 1: and accused sex trafficking Gallaine Maxwell's London home. So Prince Andrew,
- 7:19Speaker 1: it wasn't a one time thing either, right, multiple times
- 7:22Speaker 1: he's accused of this. You would think that a guy
- 7:28Speaker 1: like Prince Andrew wouldn't need to be hanging out with
- 7:32Speaker 1: Jeffrey Epstein and Furthermore, imagine Jeffrey Epstein or anybody showing
- 7:38Speaker 1: up with their buddy Gallaine Maxwell and some little young
- 7:41Speaker 1: girl who looks like she's about Oh if you look
- 7:42Speaker 1: at the picture sixteen seventeen, maybe they show up with
- 7:46Speaker 1: her in tow and you're the Prince of England. You
- 7:48Speaker 1: don't ask any questions. You don't say, all right, hold up,
- 7:52Speaker 1: who's the kid?
- 7:53Speaker 2: Guys?
- 7:53Speaker 1: What's going on here? Is this someone's niece? What are
- 7:55Speaker 1: you guys doing with this kid?
- 7:56Speaker 2: Here?
- 7:57Speaker 1: She on like a school field trip or something. Can
- 7:59Speaker 1: I can I see her parents' release for him? That's
- 8:04Speaker 1: allowing her to go? I mean, nobody asks any questions
- 8:07Speaker 1: with these all these young looking girls hanging out. Oh
- 8:11Speaker 1: it's not my business. Oh it's not, bitch, It is
- 8:13Speaker 1: your business. Do you think that if you're hanging out
- 8:18Speaker 1: at the dope spot and it gets rated, you're not
- 8:20Speaker 1: going to jail. So why should these motherfuckers be allowed
- 8:23Speaker 1: to get away with enabling and in some spots, even
- 8:27Speaker 1: being an accessory. It would seem.
- 8:31Speaker 2: Because the law.
- 8:33Speaker 1: Is not put on the books for you or me.
- 8:36Speaker 1: It's meant for people like Prince Andrew. It's meant for
- 8:38Speaker 1: people like his whole circle, his whole entourage, all of
- 8:42Speaker 1: his friends. Notice how long they were able to get
- 8:46Speaker 1: away with the shit they were getting away with. Doesn't
- 8:52Speaker 1: work like that for everybody else, does it. So again,
- 8:56Speaker 1: it's nice to see this judge at the very least
- 8:59Speaker 1: make this guy will go on the hook for a
- 9:00Speaker 1: little while. Maxwell, whom Roberts claim turned her into a
- 9:10Speaker 1: sex slave, can be seen in the background of a
- 9:12Speaker 1: photograph showing the Prince's arm around the then teenager's waist.
- 9:16Speaker 1: Roberts made the same allegations against the Prince during her
- 9:19Speaker 1: since settled twenty fifteen lawsuit against Maxwell. So this dude
- 9:25Speaker 1: has been under the microscope for all of this time, right,
- 9:28Speaker 1: everybody has at the very least gotten a whiff of
- 9:32Speaker 1: what's going on, and still nobody has forced him to
- 9:37Speaker 1: speak to the authorities. So that shows you what the
- 9:39Speaker 1: royal family thinks about the survivors of sexual abuse. It
- 9:45Speaker 1: shows you what the Queen herself thinks about these girls,
- 9:48Speaker 1: and it's pretty pathetic. Sometimes you have a defective child,
- 9:55Speaker 1: and the Queen most certainly has a defective child with
- 9:57Speaker 1: Prince Andrew. Dude's head is not right hanging out with
- 10:02Speaker 1: Jeffrey fucking Epstein after he was a convicted sex offender. Look,
- 10:06Speaker 1: remember before you these guys can make the excuse, oh,
- 10:08Speaker 1: we had no idea what he was, even though they did, right,
- 10:12Speaker 1: but they can at least make that excuse. Afterwards, well,
- 10:16Speaker 1: that excuse goes bye bye, So there is no excuse
- 10:20Speaker 1: for you hanging out with him at that point. But
- 10:25Speaker 1: Monday's hearing revolved the less around the allegations of the
- 10:28Speaker 1: lawsuit than the proprietary of US courts to hear the
- 10:32Speaker 1: case at all. And that exactly was That was what
- 10:36Speaker 1: the meat and potatoes of today was. Will this case
- 10:40Speaker 1: stand on its own two feet here in America? Will
- 10:43Speaker 1: this case be something that is worth the court looking at.
- 10:48Speaker 1: That's what this whole entire thing was today. And it
- 10:50Speaker 1: certainly looks like the judge is signaling that Andrew better
- 10:54Speaker 1: bring his lunch. We believe that this is a baseless,
- 10:59Speaker 1: non violent, bull and potentially unlawful suit, argue the Prince's lawyer,
- 11:04Speaker 1: Andrew B. Brettler, a Los Angeles based attorney known for
- 11:08Speaker 1: representing Hollywood luminaries accused of sexual misconduct. Look at this
- 11:13Speaker 1: cast of characters. Armie Hammer, I mean, did his parents
- 11:17Speaker 1: hate him, by the way, who's gonna last name's Hammer already?
- 11:20Speaker 1: Now you're gonna name me Army dude who was bound
- 11:23Speaker 1: to be a sickle from the jump? Huh, Danny Masterson.
- 11:26Speaker 1: Another fine member of society, Brian Singer's gross disgusting close ass?
- 11:32Speaker 1: Did I say gross enough? And then Brett Ratner as well. Boy,
- 11:36Speaker 1: this guy has a nice stable almost one parrival. Mister,
- 11:40Speaker 1: I kept my underpants on Dershowitz. Huh, pretty nice.
- 11:44Speaker 2: How that works.
- 11:45Speaker 1: Look, these lawyers, they're gonna do whatever they possibly can
- 11:49Speaker 1: to make sure that this case does not go to trial.
- 11:52Speaker 1: They don't want this in front of a jury or
- 11:55Speaker 1: a They don't want that. Everything that they do, every
- 11:59Speaker 1: move that they make, is to try and set this
- 12:02Speaker 1: up as an illegal service of this warrant or the
- 12:06Speaker 1: whole entire thing in general is illegal. All about technicalities.
- 12:11Speaker 1: You notice nobody's running around screaming from the rooftops about
- 12:14Speaker 1: how innocent Prince Andrew is. Right, where's his legal team
- 12:18Speaker 1: with oppressor talking about here's this evidence, that evidence, this
- 12:21Speaker 1: and this and this is why our client is innocent.
- 12:26Speaker 1: They can't even do that, They can't even bring that
- 12:29Speaker 1: to the table. And try and swing the narrative in
- 12:31Speaker 1: their way. That's how hard or pressed they are here
- 12:34Speaker 1: for the facts, and when the facts are in short supply,
- 12:38Speaker 1: it's probably a good idea to keep you a yap shut.
- 12:44Speaker 1: Robert's attorney, David Boyce, insisted that the service was proper.
- 12:49Speaker 2: We've proceeded to.
- 12:50Speaker 1: Serve Prince Andrew in several ways pursuing to Article ten
- 12:54Speaker 1: of the Hay Convention, Boys said, And that's what I
- 12:57Speaker 1: was talking about a little bit ago. There's all kinds
- 12:59Speaker 1: of different conventions that have been signed, a treaties between
- 13:02Speaker 1: the United States and the UK and elsewhere obviously, but
- 13:06Speaker 1: in this case, specifically between these two nations. And to
- 13:12Speaker 1: think that David Boyce and his team wouldn't know what
- 13:14Speaker 1: they're doing here as far as making sure all their
- 13:17Speaker 1: ducks are in a row and everything's lined up correctly,
- 13:20Speaker 1: I just that that was a step too far for
- 13:22Speaker 1: me to take. I highly doubt that a legal team
- 13:27Speaker 1: such as this is not going to have everything in
- 13:30Speaker 1: order right. So when people were talking about how it
- 13:35Speaker 1: wasn't even gonna, you know, get by the judge, the
- 13:38Speaker 1: judge is gonna get rid of it because it wasn't
- 13:40Speaker 1: served correctly. I just I had my doubts that would
- 13:44Speaker 1: be the resolution now from here. Who the hell knows,
- 13:48Speaker 1: But I kind of figured from the jump that he
- 13:53Speaker 1: wasn't going to be able to ignore this. Right what
- 13:55Speaker 1: I've been pretty consistent in that messaging. He can't just
- 13:59Speaker 1: ignore this, going to have to face it one way
- 14:01Speaker 1: or the other. That is the treaty under which Prince
- 14:06Speaker 1: Andrew disputes service. But Judge Caplan skewered the Prince's lawyer
- 14:11Speaker 1: for making matters more complicated than they need to be.
- 14:14Speaker 1: And that's the mo of these guys, right, these high
- 14:17Speaker 1: profile lawyers, that they're looking to make things way more
- 14:21Speaker 1: complicated than they need to be. The longer they can
- 14:25Speaker 1: draw this out, the more chance that the prosecution's case crumbles.
- 14:29Speaker 1: That's exactly how it always works with these guys, and
- 14:32Speaker 1: that's what you're seeing here. They want to battle over
- 14:35Speaker 1: technicalities until the cows come home. What they don't want
- 14:38Speaker 1: to battle over is truth and lies. I'm sure you
- 14:45Speaker 1: know that the Hague Convention is supplemental, Caplin told Brettler,
- 14:49Speaker 1: adding that he can order service effected upon a foreign
- 14:52Speaker 1: national under federal rule for f three of the United
- 14:57Speaker 1: States code. Again. Anyone who thinks that the long arm
- 15:02Speaker 1: of the federal government can't reach out and touch you
- 15:05Speaker 1: if you're in a different country, they are sorely mistaken.
- 15:10Speaker 1: It all comes down to the will of the United States.
- 15:13Speaker 1: If the federal government wants to pressure allies into turning
- 15:16Speaker 1: people over, they're going to turn people over. If they
- 15:21Speaker 1: want to press their allies into getting statements, they're going
- 15:24Speaker 1: to get whatever cooperation that they want for the most part.
- 15:27Speaker 1: But the caveat is does the federal government have the
- 15:32Speaker 1: will power to expand the political capital necessary to do so?
- 15:38Speaker 1: And in this instance, I do not think that we
- 15:41Speaker 1: will see that, right the extra pressure, the you know,
- 15:46Speaker 1: complete tightening of the fist, if you will, because I
- 15:50Speaker 1: don't think it's going to be necessary. I think that
- 15:53Speaker 1: Andrew is in a position now, especially now, where he's
- 15:57Speaker 1: going to have to answer these charges, and all of
- 16:00Speaker 1: the technicalities, all of the loopholes, all of the slippery
- 16:03Speaker 1: slopes on Earth or in the universe aren't going to
- 16:07Speaker 1: be able to help him from the eventual reality that
- 16:11Speaker 1: the train.
- 16:13Speaker 2: Of justice has left the station.
- 16:18Speaker 1: That rule offers wide latitude for serving a foreign person
- 16:21Speaker 1: by other means not prohibited by international agreement as the
- 16:25Speaker 1: court orders. Judge Caplan indicated that he would likely grant
- 16:30Speaker 1: that order and is unlikely to change his mind on
- 16:32Speaker 1: that front. So Judge Kaplan looks like he's gung ho
- 16:36Speaker 1: here on at the very least hearing all of the
- 16:39Speaker 1: evidence in this case. And at the end of the day,
- 16:41Speaker 1: that is exactly what you have to hope for. Right
- 16:43Speaker 1: It's the first step getting this through, the first barrage
- 16:48Speaker 1: of you know, anti aircraft fire that the defense is
- 16:52Speaker 1: going to throw up into the sky. And thankfully, it
- 16:56Speaker 1: looks like Judge Kaplan is seeing the bs here, has
- 16:59Speaker 1: seen the nonsense and doesn't want to deal with it
- 17:02Speaker 1: and wants to get right to the substance of the matter.
- 17:04Speaker 1: What kind of evidence do you have, Let's see it.
- 17:06Speaker 1: I'm busy, I want to go play golf, Me and
- 17:08Speaker 1: the rest of my soul called elite buddies have a
- 17:11Speaker 1: ten thousand dollars a day, a ten thousand dollars a
- 17:14Speaker 1: plate function to go to. Let's go, let's get things moving.
- 17:20Speaker 1: So I don't think we'll see any sort of tom
- 17:24Speaker 1: foolery going on here with this. Judge seems like he
- 17:27Speaker 1: wants to streamline this and get it rocking and rolling.
- 17:31Speaker 1: The Duke of York denies the allegations. For years, federal
- 17:35Speaker 1: prosecutors in the Southern District of New York described the
- 17:38Speaker 1: Prince as unhelpful in their investigation into the Epstein case.
- 17:43Speaker 1: The district's former US attorney, Jeffrey Berman, released a statement
- 17:47Speaker 1: declaring that Prince Andrew provided zero cooperation in connection with
- 17:52Speaker 1: the matter, and when that happened, we discussed how irregular
- 17:56Speaker 1: that is. That is not the kind of thing that
- 18:00Speaker 1: the federal government usually does, especially in a high profile
- 18:03Speaker 1: case like this. What it looks like is they were
- 18:07Speaker 1: trying to leverage him. They were trying to use a
- 18:10Speaker 1: public opinion in their favor to get him to start
- 18:13Speaker 1: to yap. While it was a decent try, There's no
- 18:20Speaker 1: way that this guy is speaking to anybody at this point.
- 18:26Speaker 1: I mean, is there anybody out there listening that thinks
- 18:29Speaker 1: he's innocent of these charges? And if so, look I
- 18:32Speaker 1: would love to hear why you think he's innocent and
- 18:35Speaker 1: see some of the at least circumstantial evidence that points
- 18:38Speaker 1: in that direction. Because every path I take, every alley
- 18:44Speaker 1: I look down, every trail I traverse, I come to
- 18:51Speaker 1: the same destination, and that destination is this dude is
- 18:55Speaker 1: guilty as fuck. His successor, current US Attorney Audrey Strauss,
- 19:03Speaker 1: made a point to say that her office would like
- 19:06Speaker 1: to have the benefit of the Prince's statement when Maxwell's
- 19:09Speaker 1: charges were made public. Well, yeah, it would definitely help, right,
- 19:14Speaker 1: And it's another reason why he didn't give that statement.
- 19:18Speaker 1: Him and Glenn Maxwell are thick as thieves, aren't They
- 19:21Speaker 1: real close friends, and they understand that their fates are
- 19:25Speaker 1: intertwined at this point, Andrew's more so than Gallan's, because
- 19:30Speaker 1: Galliane's already rotting in a cell. So I would not
- 19:36Speaker 1: even think for a second that, you know, the old
- 19:42Speaker 1: princely boy here is feeling comfortable. Maxwell's criminal case will
- 19:48Speaker 1: go to trial in November inside the Southern District of
- 19:51Speaker 1: New York, the same courthouse where Roberts filed her civil
- 19:54Speaker 1: lawsuits against the Prince and Maxwell.
- 19:57Speaker 2: All right, folks, well there you have it, hop a right, folks.
- 20:01Speaker 1: So the phone call took place today between Prince Andrew's representatives,
- 20:06Speaker 1: his new lawyers that are based in Hollywood, and the
- 20:10Speaker 1: prosecutors and the judge. And it looks like from the
- 20:14Speaker 1: reports we're hearing that the judge wasn't having any of
- 20:17Speaker 1: Prince Andrew and his legal team's nonsense. In fact, when
- 20:21Speaker 1: is so far as admonishing them for making things way
- 20:25Speaker 1: more difficult than they had to be. Pretty much figure
- 20:31Speaker 1: that would be the case, right. Look, these judges, like
- 20:34Speaker 1: I said earlier, they're like feudal wards. Right. You mess
- 20:39Speaker 1: with these dudes, it's like going into a badger den
- 20:41Speaker 1: and taking a whiz on one and expecting it not
- 20:44Speaker 1: to you know, go crazy on you. So with Andrew
- 20:49Speaker 1: and his team all of the bluster about how they
- 20:52Speaker 1: were just going to ignore all of this, we knew
- 20:54Speaker 1: that wasn't gonna be the case, because being tried in
- 20:59Speaker 1: absentia is never the proper route to go if you're
- 21:01Speaker 1: looking to you know, prove your innocence.
- 21:04Speaker 2: So I figure that.
- 21:06Speaker 1: They'd be ready to feel this call. But it's nice
- 21:10Speaker 1: to see the judge giving them a bit of a
- 21:11Speaker 1: slap here and telling them that he's not playing games
- 21:15Speaker 1: pretty much no more, bs, Let's get down to it
- 21:19Speaker 1: is basically what the judge is telling them.
- 21:22Speaker 2: So let's jump into.
- 21:24Speaker 1: This article from Law and Crime and author Adam Klasfeld,
- 21:29Speaker 1: and let's see exactly what in the hell went on
- 21:32Speaker 1: today during that phone call, headline Federal judge Skewer's lawyer
- 21:38Speaker 1: for Prince Andrew for making service more complicated than it is.
- 21:43Speaker 1: And again it really that's really what it comes down to. Right,
- 21:47Speaker 1: this guy is ducking and dodging like Rip Torrens throwing
- 21:51Speaker 1: wrenches at him and he's in dodgeball when in reality
- 21:56Speaker 1: he should accept this summons and come and challenge these
- 22:00Speaker 1: accusations in court. He's such a big, tough guy, right,
- 22:03Speaker 1: he's such a war hero, such an honorable dude. Then
- 22:07Speaker 1: what are you running for, bro? What are you hiding
- 22:10Speaker 1: out at your mom's house for? Don't make it more
- 22:15Speaker 1: complicated than it needs to be. Prince Andrew has disputed
- 22:24Speaker 1: that the woman accusing him of sexually abusing her as
- 22:27Speaker 1: a seventeen year old served him properly with a lawsuit.
- 22:30Speaker 1: That argument appeared to land poorly in court on Monday,
- 22:34Speaker 1: when a federal judge signaled that this is a losing battle. Look,
- 22:39Speaker 1: there was no doubt in my mind that this was
- 22:42Speaker 1: going to be the result. Right, he wasn't going to
- 22:46Speaker 1: get off on the service of this warrant. They weren't going.
- 22:50Speaker 2: To be able to.
- 22:52Speaker 1: Use that as a way for him to wiggle off
- 22:55Speaker 1: the hook. I was pretty confident that Boys and Schiller
- 23:00Speaker 1: and the rest of the legal team would have been
- 23:03Speaker 1: very thorough leading up to all of this.
- 23:06Speaker 2: This is very high profile.
- 23:07Speaker 1: This isn't something you throw together in a day or two, right,
- 23:10Speaker 1: and with the legal office, I am sure that this
- 23:13Speaker 1: is something they've been preparing for for quite some time.
- 23:16Speaker 1: So I am sure that they went through everything they
- 23:19Speaker 1: needed to go through, you know, had a mock situation
- 23:23Speaker 1: that they ran before them and came up with the
- 23:26Speaker 1: best way to go about serving this guy that would
- 23:29Speaker 1: have some weight with the court.
- 23:33Speaker 2: It's not like they.
- 23:33Speaker 1: Just woke up one day and they were like, all right,
- 23:35Speaker 1: we'll show up at insert.
- 23:37Speaker 2: Castle here and we'll just do whatever we.
- 23:40Speaker 1: Want and say we serve them. There's a certain process
- 23:43Speaker 1: that goes along with it, and those steps have to
- 23:46Speaker 1: be followed. And according to this judge, those steps were
- 23:51Speaker 1: obviously followed. And Andrew and his team are the ones
- 23:55Speaker 1: playing games. You have a pretty high degree of certainty
- 24:00Speaker 1: that he can be served sooner than later. US District
- 24:03Speaker 1: Judge Lewis Kaplan told the Prince's lawyers during a telephone conference.
- 24:08Speaker 1: Let's cut out all the technicalities and get to the substance.
- 24:11Speaker 1: He added, Man, is this judge hanging out listening to
- 24:14Speaker 1: the podcast? This me and this guy might be kindred souls.
- 24:19Speaker 1: I am so tired of technicalities when it comes to
- 24:22Speaker 1: these trials and these situations of law. How about we
- 24:25Speaker 1: get down to who's innocent and who's guilty. Shouldn't that matters?
- 24:29Speaker 1: Shouldn't that be like the most important thing? But it's
- 24:33Speaker 1: really not right. It's a game of technicalities and loopholes
- 24:36Speaker 1: that these people are playing, and the one who's the
- 24:39Speaker 1: most proficient at that, the one who is the most
- 24:42Speaker 1: skilled at that, is going to be the best lawyer
- 24:45Speaker 1: in the room. It has nothing to do with guilt
- 24:47Speaker 1: or innocence anymore, and hell maybe it never has. Again,
- 24:51Speaker 1: I'm not some kind of expert in the field of,
- 24:54Speaker 1: you know, a judicial law. I most certainly am not.
- 24:58Speaker 1: But I'm also not going to be gas lit or
- 25:01Speaker 1: bullshitted by these people. So when it comes down to
- 25:06Speaker 1: this kind of situation, it's nice to see the judge
- 25:11Speaker 1: himself bringing up technicalities and pointing out that he's not
- 25:15Speaker 1: gonna stand for it. Let's get to the substance. Let's
- 25:19Speaker 1: get to the meat on the bone. Why are we
- 25:21Speaker 1: dicking around around the edges? With that remark, the judge
- 25:29Speaker 1: made clear that ducking service is not likely to be
- 25:32Speaker 1: a successful gambit to avoid a lawsuit by Virginia Roberts,
- 25:37Speaker 1: one of the most outspoken victims of the now deceased
- 25:40Speaker 1: pedophile Jeffrey Epstein. And so this can only be considered
- 25:45Speaker 1: a w for Virginia here in round one, right, So
- 25:48Speaker 1: they're gonna have to answer for this. There's gonna be
- 25:51Speaker 1: no running, there's gonna be no avoiding the service. And
- 25:55Speaker 1: if him and his law team don't show up to
- 25:58Speaker 1: any of these trials or what, then this judge is
- 26:01Speaker 1: going to render a decision in absentia and it's not
- 26:05Speaker 1: gonna turn out well for Prince Andrew. So, like I
- 26:09Speaker 1: thought from the jump, old boy is over the barrel.
- 26:11Speaker 1: And all of those people who thought, oh, because he's
- 26:14Speaker 1: a royal, he's gonna avoid this, well, a lot of
- 26:16Speaker 1: people didn't have any clue about what's really going on here.
- 26:22Speaker 1: There are all sorts of different levers and methods put
- 26:27Speaker 1: into place via treaties for these exact kinds of situations. Now,
- 26:33Speaker 1: of course, and being a royal definitely throws a wrench
- 26:36Speaker 1: into things. But obviously this judge and I'm sure other
- 26:40Speaker 1: judges don't really care about that, and pretty much proving
- 26:45Speaker 1: it right here by telling Andrew he's gonna have to
- 26:47Speaker 1: answer for this in court. You're not gonna get off
- 26:49Speaker 1: on this on a technicality. You're not gonna just push
- 26:52Speaker 1: this away. You're gonna have to sit down and you're
- 26:55Speaker 1: gonna have to, you know, defend yourself here. Roberts alleges
- 27:04Speaker 1: in her lawsuit that the Duke of York sexually assaulted
- 27:07Speaker 1: her as a teenager in three places Epstein's New York
- 27:11Speaker 1: mansion and private island in the US Virgin Islands, and
- 27:14Speaker 1: accuse sex trafficking Glaine Maxwell's London home. So Prince Andrew
- 27:21Speaker 1: it wasn't a one time thing either, right, multiple times
- 27:24Speaker 1: he's accused of this. You would think that a guy
- 27:30Speaker 1: like Prince Andrew wouldn't need to be hanging out with
- 27:34Speaker 1: Jeffrey Epstein. And furthermore, imagine Jeffrey Epstein or anybody showing
- 27:40Speaker 1: up with their buddy Gallaine Maxwell and some little young
- 27:43Speaker 1: girl who looks like she's about oh, if you look
- 27:44Speaker 1: at the picture sixteen seventeen, maybe they show up with
- 27:48Speaker 1: her in tow and you're the Prince of England. You
- 27:50Speaker 1: don't ask any questions. You don't say all right, hold up,
- 27:54Speaker 1: who's the kid?
- 27:54Speaker 2: Guys?
- 27:55Speaker 1: What's going on here? Is this someone's niece? What are
- 27:57Speaker 1: you guys doing with this kid here? Like a school
- 28:00Speaker 1: field trip or something? Can I can I see her
- 28:03Speaker 1: her parents' release for him? That's allowing her to go.
- 28:07Speaker 1: I mean, nobody asks any questions with these all these
- 28:10Speaker 1: young looking girls hanging out. Oh it's not my business.
- 28:14Speaker 1: Oh it's not, bitch, it is your business. Do you
- 28:19Speaker 1: think that if you're hanging out at the dope spot
- 28:21Speaker 1: and it gets rated, you're not going to jail. So
- 28:24Speaker 1: why should these motherfuckers be allowed to get away with
- 28:26Speaker 1: enabling and in some spots, even being an accessory. It
- 28:30Speaker 1: would seem because the law is not put on the
- 28:36Speaker 1: books for you or me. It's meant for people like
- 28:39Speaker 1: Prince Andrew. It's meant for people like his whole circle,
- 28:42Speaker 1: his whole entourage, all of his friends. Notice how long
- 28:47Speaker 1: they were able to get away with the shit they
- 28:49Speaker 1: were getting away with. Doesn't work like that for everybody else,
- 28:56Speaker 1: does it? So again, it's nice to see this judge
- 28:59Speaker 1: at the very least make this guy wiggle on the
- 29:02Speaker 1: hook for a little while. Maxwell, whom Roberts claim turned
- 29:11Speaker 1: her into a sex slave, can be seen in the
- 29:13Speaker 1: background of a photograph showing the Prince's arm around the
- 29:16Speaker 1: then teenager's waist. Roberts made the same allegations against the
- 29:20Speaker 1: Prince during her since settled twenty fifteen lawsuit against Maxwell.
- 29:26Speaker 1: So this dude has been under the microscope for all
- 29:29Speaker 1: of this time, right, everybody has at the very least
- 29:32Speaker 1: gotten a whiff of what's going on, and still nobody
- 29:38Speaker 1: has forced him to speak to the authorities. So that
- 29:41Speaker 1: shows you what the royal family thinks about these survivors
- 29:44Speaker 1: of sexual abuse. It shows you what the Queen herself
- 29:48Speaker 1: thinks about these girls, and it's pretty pathetic. Sometimes you
- 29:55Speaker 1: have a defective child, and the Queen most certainly has
- 29:58Speaker 1: a defective child with Prince Andrew. Dude's head is not
- 30:01Speaker 1: right hanging out with Jeffrey fucking Epstein after he was
- 30:06Speaker 1: a convicted sex offender. Look, remember before you these guys
- 30:09Speaker 1: can make the excuse, oh, we had no idea what
- 30:12Speaker 1: he was, even though they did, right, but they can
- 30:14Speaker 1: at least make that excuse afterwards, Well that excuse goes
- 30:19Speaker 1: bye bye, So there is no excuse for you hanging
- 30:22Speaker 1: out with him at that point. But Monday's hearing revolved
- 30:29Speaker 1: the less around the allegations of the lawsuit than the
- 30:31Speaker 1: proprietary of US courts to hear the case at all.
- 30:36Speaker 1: And that exactly was That was what the meat and
- 30:39Speaker 1: potatoes of today was. Will this case stand on its
- 30:43Speaker 1: own two feet here in America? Will this case be
- 30:47Speaker 1: something that is worth the court looking at? That's what
- 30:50Speaker 1: this whole entire thing was today. And it certainly looks
- 30:53Speaker 1: like the judge is signaling that Andrew better bring his lunch.
- 30:58Speaker 1: We believe that this is a baseless, non viable, and
- 31:01Speaker 1: potentially unlawful suit, argue the Prince's lawyer, Andrew B. Brettler,
- 31:07Speaker 1: a Los Angeles based attorney known for representing Hollywood luminaries
- 31:11Speaker 1: accused of sexual misconduct. Look at this cast of characters.
- 31:15Speaker 1: Armie Hammer, I mean, did his parents hate him? By
- 31:18Speaker 1: the way, who's gonna last name's Hammer already? Now you're
- 31:21Speaker 1: gonna name me Army dude who was bound to be
- 31:24Speaker 1: a sickle from the jump?
- 31:25Speaker 2: Huh.
- 31:25Speaker 1: Danny Masterson, another fine member of Society, Brian Singer's gross disgusting,
- 31:32Speaker 1: gross ass Did I say gross enough? And then Brett
- 31:35Speaker 1: Ratner as well, Boy, this guy has a nice stable,
- 31:39Speaker 1: almost one to rival. Mister, I kept my underpants on Dershowitz.
- 31:43Speaker 1: Huh pretty nice, how that works. Look, these lawyers, they're
- 31:48Speaker 1: gonna do whatever they possibly can to make sure that
- 31:51Speaker 1: this case does not go to a trial. They don't
- 31:54Speaker 1: want this in front of a jury or a they
- 31:57Speaker 1: don't want that. Everything that they do, remove that they
- 32:00Speaker 1: make is to try and set this up as an
- 32:04Speaker 1: illegal service of this warrant or the whole entire thing
- 32:08Speaker 1: in general is illegal. All about technicalities. You notice nobody's
- 32:13Speaker 1: running around screaming from the rooftops about how innocent Prince
- 32:16Speaker 1: Andrew is. Right, where's his legal team with oppressor talking
- 32:20Speaker 1: about here's this evidence, that evidence, this and this and
- 32:23Speaker 1: this is why our client is innocent. They can't even
- 32:28Speaker 1: do that. They can't even bring that to the table
- 32:31Speaker 1: and try and swing the narrative in their way. That's
- 32:33Speaker 1: how hard or pressed they are. Here for the facts,
- 32:37Speaker 1: and when the facts are in short supply, it's probably
- 32:41Speaker 1: a good idea to keep you a yap shut. Robert's
- 32:46Speaker 1: attorney David Boyce insisted that the service was proper. We've
- 32:50Speaker 1: proceeded to serve Prince Andrew in several ways pursuing to
- 32:54Speaker 1: Article ten of the Hay Convention, Boys said, And that's
- 32:57Speaker 1: what I was talking about a little bit ago. So
- 33:00Speaker 1: there's all kinds of different conventions that have been signed,
- 33:03Speaker 1: a treaties between the United States and the UK and elsewhere, obviously,
- 33:07Speaker 1: but in this case, specifically between these two nations. And
- 33:13Speaker 1: to think that David Boyce and his team wouldn't know
- 33:15Speaker 1: what they're doing here as far as making sure all
- 33:18Speaker 1: their ducks are in a row and everything's lined up correctly,
- 33:21Speaker 1: I just that that.
- 33:22Speaker 2: Was a step too far for me to take.
- 33:24Speaker 1: I highly doubt that a legal team such as this
- 33:29Speaker 1: is not going to have everything in order right. So
- 33:34Speaker 1: when people were talking about how it wasn't even gonna,
- 33:37Speaker 1: you know, get by the judge, the judge is gonna
- 33:40Speaker 1: get rid of it because it wasn't served correctly, I
- 33:43Speaker 1: just I had my doubts that would be the resolution
- 33:46Speaker 1: now from here. Who the hell knows, but I kind
- 33:52Speaker 1: of figured from the jump that he wasn't going to
- 33:55Speaker 1: be able to ignore this.
- 33:56Speaker 2: Right.
- 33:56Speaker 1: What I've been pretty consistent in that messaging. He can't
- 34:00Speaker 1: just ignore this. He's going to have to face it
- 34:02Speaker 1: one way or the other. That is the treaty under
- 34:07Speaker 1: which Prince Andrew disputes service. But Judge Caplan skewered the
- 34:11Speaker 1: Prince's lawyer for making matters more complicated than they need
- 34:14Speaker 1: to be. And that's the mo of these guys, right,
- 34:17Speaker 1: these high profile lawyers, that they're looking to make things
- 34:21Speaker 1: way more complicated than they need to be. The longer
- 34:26Speaker 1: they can draw this out, the more chance that the
- 34:28Speaker 1: prosecution's case crumbles. That's exactly how it always works with
- 34:32Speaker 1: these guys, and that's what you're seeing here. They want
- 34:35Speaker 1: to battle over technicalities until the cows come home. What
- 34:38Speaker 1: they don't want to battle over is truth and lies.
- 34:46Speaker 1: I'm sure you know that the Hague Convention is supplemental
- 34:49Speaker 1: Caplin told Brettler, adding that he can order service effected
- 34:53Speaker 1: upon a foreign national under federal rule for f three
- 34:57Speaker 1: of the United States Code. Again, and anyone who thinks
- 35:02Speaker 1: that the long arm of the federal government can't reach
- 35:05Speaker 1: out and touch you if you're in a different country,
- 35:08Speaker 1: they are sorely mistaken. It all comes down to the
- 35:12Speaker 1: will of the United States. If the federal government wants
- 35:16Speaker 1: to pressure allies into turning people over, they're going to
- 35:19Speaker 1: turn people over. If they want to press their allies
- 35:23Speaker 1: into getting statements, they're gonna get whatever cooperation that they
- 35:27Speaker 1: want for the most part. But the caveat is, does
- 35:31Speaker 1: the federal government have the will power to expend the
- 35:36Speaker 1: political capital necessary.
- 35:38Speaker 2: To do so?
- 35:39Speaker 1: And in this instance, I do not think that we
- 35:42Speaker 1: will see that, right, the extra pressure, the you know,
- 35:47Speaker 1: complete tightening of the fist, if you will, because I
- 35:51Speaker 1: don't think it's going to be necessary. I think that
- 35:54Speaker 1: Andrew is in a position now, especially now, where he's
- 35:58Speaker 1: going to have to answer the charges, and all of
- 36:01Speaker 1: the technicalities, all of the loopholes, all of the slippery
- 36:04Speaker 1: slopes on Earth or in the universe aren't going to
- 36:08Speaker 1: be able to help him from the eventual reality that
- 36:13Speaker 1: the train of justice has left the station. That rule
- 36:19Speaker 1: offers wide latitude for serving a foreign person by other
- 36:23Speaker 1: means not prohibited by international agreement.
- 36:26Speaker 2: As the court orders.
- 36:28Speaker 1: Judge Caplan indicated that he would likely grant that order
- 36:31Speaker 1: and is unlikely to change his mind on that front.
- 36:34Speaker 1: So Judge Kaplan is looks like he's gung ho here
- 36:38Speaker 1: on at the very least hearing all of the evidence
- 36:40Speaker 1: in this case, and at the end of the day,
- 36:42Speaker 1: that is exactly what you have to hope for. Right
- 36:44Speaker 1: It's the first step getting this through, the first barrage
- 36:49Speaker 1: of you know, anti aircraft fire that the defense is
- 36:53Speaker 1: going to throw up into the sky. And thankfully, it
- 36:57Speaker 1: looks like Judge Kaplan has seen the bare, has seen
- 37:01Speaker 1: the nonsense, and doesn't want to deal with it and
- 37:03Speaker 1: wants to get right to the substance of the matter.
- 37:05Speaker 1: What kind of evidence do you have, Let's see it.
- 37:07Speaker 1: I'm busy. I want to go play golf. Me and
- 37:10Speaker 1: the rest of my soul called elite buddies have a
- 37:12Speaker 1: ten thousand dollars a day, a ten thousand dollars a
- 37:15Speaker 1: plate function to go to. Let's go. Let's get things moving.
- 37:21Speaker 1: So I don't think we'll see any sort of tom
- 37:25Speaker 1: foolery going on here with this. Judge seems like he
- 37:28Speaker 1: wants to streamline this and get it rocking and rolling.
- 37:33Speaker 1: The Duke of York denies the allegations. For years, federal
- 37:36Speaker 1: prosecutors in the Southern District of New York described the
- 37:39Speaker 1: Prince as unhelpful in their investigation into the Epstein case.
- 37:44Speaker 1: The district's former US attorney, Jeffrey Berman, released a statement
- 37:48Speaker 1: declaring that Prince Andrew provided zero cooperation in connection with
- 37:53Speaker 1: the matter, and when that happened, we discussed how irregular
- 37:58Speaker 1: that is. That is not the kind of thing that
- 38:01Speaker 1: the federal government usually does, especially in a high profile
- 38:04Speaker 1: case like this. What it looks like is they were
- 38:08Speaker 1: trying to leverage him. They were trying to use a
- 38:11Speaker 1: public opinion in their favor to get him to start
- 38:14Speaker 1: to yap. While it was a decent try, There's no
- 38:21Speaker 1: way that this guy is speaking to anybody at this point.
- 38:27Speaker 1: I mean, is there anybody out there listening that thinks
- 38:30Speaker 1: he's innocent of these charges? And if so, look, I
- 38:33Speaker 1: would love to hear why you think he's innocent and
- 38:37Speaker 1: see some of the at least circumstantial evidence that points
- 38:39Speaker 1: in that direction. Because every path I take, every alley
- 38:45Speaker 1: I look down, every trail I traverse, I come to
- 38:52Speaker 1: the same destination, and that destination is this dude is
- 38:57Speaker 1: guilty as fuck. His successor, current US Attorney Audrey Strauss,
- 39:04Speaker 1: made a point to say that her office would like
- 39:07Speaker 1: to have the benefit of the Prince's statement when Maxwell's
- 39:10Speaker 1: charges were made public, Well, yeah, it would definitely help, right,
- 39:15Speaker 1: And it's another reason why he didn't give that statement.
- 39:19Speaker 1: Him and Glenn Maxwell are thick as thieves, aren't They
- 39:22Speaker 1: real close friends, and they understand that their fates are
- 39:26Speaker 1: intertwined at this point, Andrew's more so than Gallan's because
- 39:31Speaker 1: Glaiane's already rotting in a cell. So I would not
- 39:37Speaker 1: even think for a second that, you know, the old
- 39:43Speaker 1: princely boy here is feeling comfortable. Maxwell's criminal case will
- 39:49Speaker 1: go to trial in November inside the Southern District of
- 39:52Speaker 1: New York, the same courthouse where Roberts filed her civil
- 39:55Speaker 1: lawsuits against the Prince and Maxwell.
- 39:59Speaker 2: All right, folks, well so there you have it.
- 40:01Speaker 1: Figured i'd hop in the studio when we'd update that
- 40:04Speaker 1: right now while it was hot off the press, and
- 40:06Speaker 1: then we'll move on tomorrow morning and we'll add some
