Venezuela looks to a New Horizon, Democrat Maduro Flip-Flop & Minnesota's very own Civil War Week In Review · The 47 Morning Update with Ben Ferguson

• 0:01
  Speaker 1: Welcome.
• 0:01
Speaker 2: It is verdict with Ted Cruz that we can review
• 0:03
Speaker 2: Ben Ferguson with you and hear are the big stories
• 0:05
Speaker 2: that you may have missed that we talked about. First up,
• 0:08
Speaker 2: what is next for Venezuela after Donald Trump went in
• 0:11
Speaker 2: to get one of the biggest narcotarists in the world.
• 0:14
Speaker 2: We'll have the answer to that for you in just
• 0:16
Speaker 2: a moment. Also, Democrats were actually in favor of getting
• 0:20
Speaker 2: Maduro and demanding it, even having money on the line
• 0:24
Speaker 2: for those that would turn him in. But now they
• 0:27
Speaker 2: hate Donald Trump because he got him. What's behind all that?
• 0:30
Speaker 2: And finally the Minnesota government, including the governor, now says
• 0:35
Speaker 2: he wants to go to civil war with the federal government.
• 0:39
Speaker 2: It's the weekend review and it starts right now.
• 0:42
  Speaker 1: What is next?
• 0:43
Speaker 2: And let me just I could look at my Twitter
• 0:46
Speaker 2: feed and I was on CNN last night and it
• 0:49
Speaker 2: was the topic of conversation, and that is there are
• 0:53
Speaker 2: a lot of people that believe that America First policy
• 0:57
Speaker 2: that Donald Trump ran on was not invading country reason
• 1:00
Speaker 2: staying indefinitely like Iraq, Afghanistan.
• 1:04
Speaker 1: There is a lot of concern. I heard it.
• 1:07
Speaker 2: You probably saw the clip of Lindsay Graham on Air
• 1:09
Speaker 2: Force One with the President saying, you know, this is
• 1:11
Speaker 2: a guy that loves to be in these forever wars,
• 1:13
Speaker 2: and there was people that were really concerned with that
• 1:15
  Speaker 2: image of if that's who's in his ear. I don't
• 1:19
Speaker 2: want to get bogged down in Venezuela. I don't want
• 1:22
Speaker 2: our men and women to be there and the loss
• 1:25
Speaker 2: of life to mount and grow because we decide to
• 1:28
Speaker 2: take over a country indefinitely.
• 1:30
Speaker 1: There's a lot of people that voted for Trump.
• 1:31
Speaker 2: They believe that's what he was never going to do,
• 1:34
Speaker 2: and now they're like, well, hold on, we're here, We're
• 1:36
Speaker 2: going to take it over. There is a lot of concerns,
• 1:38
Speaker 2: So let's dive into that and talk about what this
• 1:41
Speaker 2: looks like next in Venezuela. What is responsibility? What responsibility
• 1:46
Speaker 2: do we have to do it the right way? But
• 1:47
Speaker 2: also to not just sit there indefinitely.
• 1:50
Speaker 3: Well, listen, first of all, let me be clear, we
• 1:53
Speaker 3: are not at war with Venezuela.
• 1:56
Speaker 4: This is not a forever war. It's not even a war.
• 1:59
Speaker 3: This was a military operation to execute an arrest warrant.
• 2:03
Speaker 3: It was the military supporting the FBI and arresting indicted
• 2:07
Speaker 3: narco terrorists, and it took a couple of hours and
• 2:10
Speaker 3: was over. They went in, they got them, and they left.
• 2:13
Speaker 3: That was the conclusion of the military conflict.
• 2:16
  Speaker 4: It's not a war.
• 2:17
  Speaker 3: It's not, as I said, it's not a forever war.
• 2:19
Speaker 3: It was not even a five hour war. It was
• 2:21
Speaker 3: about a two hour war. And I wouldn't even call
• 2:23
Speaker 3: it a war. It was when you go and arrest someone,
• 2:26
Speaker 3: it was. It was an arrest, with the military supporting
• 2:30
Speaker 3: and protecting the law enforcement officers carrying out the arrest.
• 2:34
Speaker 3: What happens next. So the day after Maduro was arrested,
• 2:41
Speaker 3: Delci Rodriguez, who was the vice president, was sworn in
• 2:43
Speaker 3: as the interim president. Now, listen, no American should be
• 2:48
Speaker 3: happy with Delci Rodriguez as the president of Venezuela for
• 2:52
Speaker 3: any extended period of time. And I'm going to go
• 2:54
Speaker 3: into a little bit of background in terms of who
• 2:56
Speaker 3: she is and then talk about what should happen next. Now, Now,
• 2:59
Speaker 3: Delci Rodriguez a communist, Yes, she was the vice president.
• 3:03
Speaker 3: She hates America. Let me give you some of her background.
• 3:07
Speaker 3: She was the vice president. Before that, she was the
• 3:11
Speaker 3: oil minister, and she was she is a lawyer, to
• 3:16
Speaker 3: like the first lady. And she's been in in just
• 3:20
Speaker 3: about every post she was also, she was Foreign Minister,
• 3:23
Speaker 3: she was President of the Constituent Assembly, vice president and
• 3:27
Speaker 3: oil minister. She was sworn in as the interim president.
• 3:30
Speaker 3: You know who swore in. Here's that her brother, Jorge Rodriguez,
• 3:35
Speaker 3: who is the head of the National Assembly. So to
• 3:37
Speaker 3: understand this is is a corrupt Marxist, communist America hating woman.
• 3:45
Speaker 4: And let me give you her background. She was born
• 3:46
  Speaker 4: in Caracas.
• 3:48
Speaker 3: She is the daughter of a Marxist gorilla leader named
• 3:52
Speaker 3: Jorge Antonio Rodriguez, and she is rather rather her dad
• 3:57
Speaker 3: was a co founder.
• 3:58
Speaker 4: Of the Socialist League.
• 4:00
Speaker 3: Her dad was arrested in connection with the nineteen seventy
• 4:04
Speaker 3: six kidnapping of American businessman William f. Niehaus and died
• 4:10
Speaker 3: in police custody, and one source said the following that
• 4:16
Speaker 3: ordeal is the foundation and origin of Delce's hatred of
• 4:22
Speaker 3: the West and of democracy. Her whole background was Marxist,
• 4:29
Speaker 3: and in fact, the source continued, the Gorilla Marxist element
• 4:32
Speaker 3: kidnapped an American executive nineteen seventy six. He was held
• 4:36
Speaker 3: for three years until authorities located the group hiding in
• 4:40
  Speaker 3: the Amazon jungle.
• 4:44
Speaker 4: She is She was sanctioned.
• 4:49
Speaker 3: By the Treasury Department's Office of Foreign Asset Control because
• 4:54
Speaker 3: of her senior role in the Maduau administration. Those sanctions
• 4:58
Speaker 3: are still in place. She was also caught transporting gold
• 5:04
Speaker 3: illegally into Spain. She had forty bags four zero bags
• 5:09
Speaker 3: full of gold in a private jet as the vice president.
• 5:13
Speaker 3: And they put the bags through the X ray and
• 5:15
Speaker 3: they said, wait, you got forty bags full of gold,
• 5:18
Speaker 3: and she was She's.
• 5:19
Speaker 1: Like, I'm from Venezuela. This is normal. This is how
• 5:21
Speaker 1: we operate there. I'm the vice president. Right, that's some
• 5:24
  Speaker 1: big deal.
• 5:25
Speaker 3: Look, she is a communist leader and she is not
• 5:29
Speaker 3: a friend of the West. Now, I will say this
• 5:32
Speaker 3: right now, it appears she's cooperating with the Trump administration.
• 5:37
Speaker 3: I'm sure it made an impression seeing Delta for show
• 5:40
Speaker 3: up at Arrestmodua in the first lady.
• 5:42
Speaker 1: Yeah, she could be next.
• 5:45
Speaker 3: She's cooperating right now. We'll see if she continues to cooperate.
• 5:49
Speaker 3: By the way, there are multiple reports of violence on
• 5:51
Speaker 3: the ground. There have been reports of potential coups from
• 5:54
Speaker 3: other leaders in the government. There is some instability. But
• 5:57
Speaker 3: I'll tell you what needs to happen. No one should
• 5:59
Speaker 3: be happy. Number one, what you said is exactly right.
• 6:03
Speaker 3: We do not want to see an American occupation, We
• 6:06
Speaker 3: don't want to see an extended American presence on the ground,
• 6:10
Speaker 3: and we don't want to see this America hating communists, essentially,
• 6:16
Speaker 3: the Madua regime continuing. What should happen is free and
• 6:21
Speaker 3: fair elections. And free and fair elections. Look the last
• 6:24
Speaker 3: election we talked about in the last podcast that Madua
• 6:29
Speaker 3: was arrested because he's an arco trafficker, but he was
• 6:31
Speaker 3: also arrested because he's illegitimate because in the last election
• 6:35
Speaker 3: he lost decisively to the opposition party, and yet he
• 6:38
Speaker 3: stayed in power just as a thug and dictator. And
• 6:40
Speaker 3: that was part of the legal basis for why we
• 6:43
Speaker 3: could do this, because he was no longer legitimately ahead
• 6:46
Speaker 3: of state and he was not recognized as the head
• 6:48
Speaker 3: of state by the United States, including the Biden administration
• 6:51
Speaker 3: and much of the rest of the world. There should
• 6:56
Speaker 3: be free and fair elections, and I think it would
• 6:58
Speaker 3: be very very good for Venezuela up and very very
• 7:01
Speaker 3: good for America if they were to elect a leader
• 7:05
Speaker 3: who who is a pro America, pro free market leader,
• 7:11
Speaker 3: and Venezuela were to return to being a friend.
• 7:13
Speaker 4: Particularly. Look, one of the big things.
• 7:16
Speaker 3: They've got the largest proven oil reserves of any country
• 7:19
  Speaker 3: in the world.
• 7:20
Speaker 2: And it really is amazing that if you think about
• 7:23
Speaker 2: the amount of oil they have and also gold, that
• 7:26
Speaker 2: how quickly they could come out of this if they
• 7:29
Speaker 2: just didn't have communists running the country like this is
• 7:32
Speaker 2: this would be one of the easiest is I was
• 7:34
Speaker 2: described today by a banker and he was he was
• 7:37
Speaker 2: just trying to put in perspective. He's like, when other
• 7:39
Speaker 2: countries fall, then they need the World Bank. Then he'd
• 7:41
Speaker 2: be able to come in and give them cash and
• 7:43
Speaker 2: and and and to help just stabilize at the bare
• 7:46
Speaker 2: minimum of a total collapse in their economy. He said,
• 7:49
Speaker 2: if you ask me right now, what country would I
• 7:52
Speaker 2: want to be able to take over based on their
• 7:54
Speaker 2: resources to build them back up the fastest.
• 7:56
Speaker 1: He was like, Venezuela is like one.
• 7:58
Speaker 2: Of the easiest ones in the whole world to do
• 8:01
Speaker 2: because of how minutes they have to sell. They could
• 8:05
Speaker 2: get their economy up and roaring, and the people could
• 8:08
Speaker 2: have a great life and they used to have that.
• 8:10
Speaker 1: By the way, Venezuela people forget that.
• 8:12
  Speaker 4: Yeah.
• 8:13
Speaker 3: Remember in nineteen fifty Venezuela had the fourth highest GDP
• 8:17
Speaker 3: per capita in the world. The United States was first,
• 8:20
Speaker 3: then Switzerland, then New Zealand, and Venezuela was number four.
• 8:23
Speaker 3: That's what these communists screwed up.
• 8:26
  Speaker 4: And listen.
• 8:27
Speaker 3: President Trump has focused a great deal on trying to
• 8:29
Speaker 3: get US oil companies to go and invest in Venezuela
• 8:33
Speaker 3: now to produce the oil. And even though they have
• 8:35
Speaker 3: proven reserves, their infrastructure has collapsed.
• 8:38
  Speaker 4: It's good the.
• 8:39
Speaker 3: Corruption of the communism. They're not producing what they could,
• 8:44
Speaker 3: and to be able to produce will take an investment
• 8:48
Speaker 3: of likely hundreds of billions of dollars. It's not a
• 8:51
Speaker 3: cheap proposition. Now, the oil that will be produced would
• 8:55
Speaker 3: generate more revenue than that. But I'll tell you I
• 8:58
Speaker 3: actually spent a good chunk of the day talking to
• 9:01
Speaker 3: people in the energy industry and asking their views on Venezuela.
• 9:05
  Speaker 3: And a big question that if you're let's say you're
• 9:09
Speaker 3: the CEO of Chevron or the CEO of ex On Mobile,
• 9:12
Speaker 3: and you're trying to decide do I invest tens of
• 9:15
Speaker 3: billions or hundreds of billions. Your number one question is
• 9:19
Speaker 3: what's the government there? Are they stable? Is their rule
• 9:22
Speaker 3: of law? Are they going to protect me? Or are they
• 9:24
Speaker 3: going to seize am I going to invest one hundred
• 9:25
Speaker 3: billion dollars and they come seize the assets like they
• 9:28
Speaker 3: did before. If you don't trust the government there to
• 9:32
Speaker 3: protect your property, you're not going to invest. And it's
• 9:35
Speaker 3: why having free and fair elections and a stable government
• 9:39
Speaker 3: that is friends of the United States, that that is
• 9:41
Speaker 3: not communists is critical to the success not just to Venezuela,
• 9:48
Speaker 3: but to the success of America's relationship with Venezuela. And
• 9:53
Speaker 3: so I will say, you know, there's some folks you're
• 9:57
Speaker 3: seeing people are saying, well, no, no, no, this was not
• 10:00
Speaker 3: change because we just arrested Maduro. But the exact same
• 10:03
Speaker 3: regime is in place. And let me be clear this
• 10:06
Speaker 3: I very much hope will be regime change at the
• 10:09
Speaker 3: ballot box, which is a very different thing. That it
• 10:12
Speaker 3: will be the voters, that there will be a free
• 10:15
Speaker 3: and fair elections and the voters will choose We don't
• 10:18
Speaker 3: want these corrupt Marxist Narco traffickers. We want a leader
• 10:23
Speaker 3: that we choose to represent us and to bring us
• 10:26
Speaker 3: back to prosperity. And if you want prosperity in Venezuela,
• 10:30
Speaker 3: you want free enterprise, you want incentives for investment to
• 10:35
Speaker 3: develop the massive natural resources, and you want to trade
• 10:38
Speaker 3: with the United States of America. And so that's the
• 10:40
Speaker 3: outcome all of us should be rooting for. And I
• 10:43
Speaker 3: believe that's the outcome President Trump is working very hard
• 10:46
  Speaker 3: to produce.
• 10:47
Speaker 2: Now, if you want to hear the rest of this conversation,
• 10:50
Speaker 2: you can go back and listen to the full podcast
• 10:52
Speaker 2: from earlier this week. Now onto story number two.
• 10:56
Speaker 1: I want to go back.
• 10:57
Speaker 2: Can we go back to Chuck Schumer and just that
• 11:01
Speaker 2: I think it was twenty twenty when he had something
• 11:04
Speaker 2: very interesting to say. Can we play that for everybody
• 11:07
Speaker 2: real quick? Yep, all right, take a listen. This is
• 11:09
Speaker 2: Chuck Schumer back in twenty twenty. Listen carefully to the
• 11:13
Speaker 2: words that he has to say. You're gonna get a
• 11:14
Speaker 2: kick out of this.
• 11:15
Speaker 5: He brags about all these things he wants to do
• 11:18
Speaker 5: or is doing, but his actions belie his words. Maybe
• 11:21
Speaker 5: the best metaphor was his claim to bring democracy to Venezuela.
• 11:28
Speaker 5: There was a big policy there.
• 11:30
  Speaker 1: It flopped.
• 11:31
Speaker 5: If the policy was working, Juan Guido wouldn't be in
• 11:34
Speaker 5: the balcony here, he'd be in Venezuela. He'd be sitting
• 11:37
Speaker 5: in the president's palace or at least waging a fight
• 11:40
Speaker 5: to win. He's here, and the president brags about his
• 11:44
Speaker 5: Venezuela policy. Give us a break. He hasn't brought an
• 11:47
Speaker 5: end to the Maduro regime. The Meduro regime is more
• 11:51
Speaker 5: powerful today and more intrenched today than it was when
• 11:53
  Speaker 5: the president began.
• 11:54
Speaker 2: So here's my part about this that makes me laugh. Democrats,
• 11:58
Speaker 2: and there's a tweet that's very much like that, the
• 12:00
Speaker 2: same thing from Joe Biden.
• 12:02
  Speaker 4: Yeah, they were.
• 12:03
Speaker 2: Angry that Trump hadn't like taken out Maduro. Now Trump
• 12:07
Speaker 2: takes out Maduro, and now they're angry at Trump for
• 12:09
  Speaker 2: taking out Maduro.
• 12:10
Speaker 1: You cannot make it up.
• 12:11
Speaker 3: Yeah, and listen carefully to what Schumer just said. There,
• 12:15
Speaker 3: give us a break. He hasn't ended the Maduro regime.
• 12:19
Speaker 3: So he was on the floor of the Senate. This
• 12:21
Speaker 3: is a speech where he was blasting Trump in twenty
• 12:24
Speaker 3: twenty for not having taken Maduro out. And now in
• 12:30
Speaker 3: the wake of President Trump having another enormously successful military operation.
• 12:35
Speaker 3: The last just a few hours in actual execution, and
• 12:38
Speaker 3: then it was over, and then Maduro was gone, and
• 12:39
Speaker 3: he was on his way to the United States. Schumer
• 12:43
Speaker 3: and Kamala Harris and just about every Democrat you find
• 12:46
Speaker 3: are are are freaking out.
• 12:49
Speaker 4: And then they're just being hypocrites.
• 12:50
Speaker 3: They just hate Trump and and just like they're defending
• 12:54
Speaker 3: every illegal immigrant, they're defending all of the gang bangers
• 12:58
Speaker 3: who are here. In this case, the Democrats are becoming
• 13:03
Speaker 3: the chief defender of Nicholas Maduro. But as I mentioned
• 13:08
Speaker 3: on the legal front, if you look back to Noriega
• 13:12
Speaker 3: front and center in terms of the litigation that will
• 13:15
Speaker 3: happen over this is that in nineteen eighty nine, Bill
• 13:22
Speaker 3: Barr was the Assistant Attorney General for the Office of
• 13:25
Speaker 3: Legal Counsel. Now, Bill Barr, you have a call, ended
• 13:28
Speaker 3: up becoming George Herbert Walker Bush's attorney General, and then
• 13:31
Speaker 3: he was also a g for President Trump in the
• 13:33
Speaker 3: first term. Bill Barr at the time was leading what's
• 13:37
Speaker 3: called OLC, and OLC is charged under federal law with
• 13:41
Speaker 3: writing authoritative opinions on what is what is the constitution,
• 13:47
Speaker 3: what is legal? What are the constraints on the executive branch.
• 13:50
Speaker 3: And by the way, there is a long history of
• 13:53
Speaker 3: incredibly important jurist and scholars being the heads of OLC,
• 13:58
Speaker 3: including antonin Scalia he was the head of OLC, including
• 14:02
Speaker 3: William Renquist, for whom I clerked the Chief Justice of
• 14:05
Speaker 3: the Supreme Court. He was the head of OLC under Nixon,
• 14:09
Speaker 3: including Chuck Cooper, my first boss when I practiced law.
• 14:13
Speaker 3: So OLC that they are typically they are often US
• 14:16
Speaker 3: Supreme Court clerks themselves. They are constitutional experts. And Barr
• 14:21
Speaker 3: issued a detailed opinion making clear that the US government
• 14:25
Speaker 3: had the authority to go and apprehend Noriega and and
• 14:30
Speaker 3: and Barr said several things, So it's a detailed opinion.
• 14:33
Speaker 4: By the way, you could read the entire opinion. The
• 14:35
  Speaker 4: opinion is public.
• 14:37
Speaker 3: But Barr concluded that Number one, the FBI's statutory arrest
• 14:42
Speaker 3: authority quote authorizes extra territorial investigations and arrests. So that's
• 14:49
Speaker 3: in the statute existing US law. The FBI can go
• 14:53
Speaker 3: abroad and arrest someone. And and Barr concluded the President
• 14:56
Speaker 3: can lawfully order that extratorial to territorial arrest. And interestingly,
• 15:04
Speaker 3: bar so one of the main arguments that democrats in
• 15:08
Speaker 3: the media, although that's redundant because they're one and the
• 15:10
Speaker 3: same democrats in the media. And by the way, law
• 15:12
Speaker 3: professors fall into that same camp. They're all clutching their
• 15:15
Speaker 3: pearls and and and their main argument deals with the
• 15:18
Speaker 3: United Nations Charter and an Article two four of the
• 15:22
Speaker 3: UN Charter prohibits the quote use of force against the
• 15:26
Speaker 3: territorial integrity of any state. And so their main argument
• 15:29
Speaker 3: is this violates the un Charter. Well, what what Barr concluded?
• 15:34
Speaker 3: And this is a quote and by the way, it's
• 15:35
Speaker 3: not just Barr's opinion. This is a binding decision from
• 15:39
Speaker 3: OLC that binds the executive and lesson until it's overturned.
• 15:42
Speaker 3: So it is like a judicial opinion, but within the
• 15:45
Speaker 3: executive branch. Barr said that Article two four of the
• 15:50
Speaker 3: UN Charter does not quote prohibit the executive, as a
• 15:55
Speaker 3: matter of domestic law from authorizing forcible abductions. But another way, quote,
• 16:01
Speaker 3: as a matter of domestic law, the executive has the
• 16:04
Speaker 3: power to authorize actions inconsistent with Article two four of
• 16:08
  Speaker 3: the UN Charter.
• 16:10
Speaker 4: What does that mean? The UN Charter.
• 16:12
Speaker 3: Is not independently binding on the United States government. The
• 16:16
Speaker 3: Constitution is binding on the government. You know, back before
• 16:20
Speaker 3: I was in the Senate, what I did for a
• 16:22
Speaker 3: living is argued US Supreme Court cases. And the most
• 16:25
Speaker 3: consequential case that I argued before the Supreme Court was
• 16:28
Speaker 3: a case called medi Ing versus Texas. I ended up
• 16:31
Speaker 3: winning six y three. It was an incredibly consequential case.
• 16:34
Speaker 3: But it dealt with the authority of the International Court
• 16:38
Speaker 3: of Justice, the World Court, the judicial arm of the UN,
• 16:41
Speaker 3: to bind the US justice system. And and and I
• 16:45
Speaker 3: argued representing the State of Texas successfully. The UN doesn't
• 16:48
Speaker 3: have the authority to do that. The World Court doesn't
• 16:50
Speaker 3: have the authority to do it. It is the US Constitution,
• 16:53
Speaker 3: and it is US laws. And if Congress wants to
• 16:56
Speaker 3: pass a law, that can be binding. But Congress had
• 16:59
Speaker 3: not in that in median pastor law relevant to the
• 17:02
Speaker 3: issue there. Likewise, here the DOJ opinion was, even if
• 17:07
Speaker 3: the UN Charter says something different, as a matter of
• 17:10
Speaker 3: US constitutional law, the President can order this. And critically,
• 17:14
Speaker 3: the Bar opinion also concluded that a US arrest abroad
• 17:19
Speaker 3: quote in violation of foreign law does not violate the
• 17:24
Speaker 3: Fourth Amendments. And to be clear, the Bar opinion was
• 17:29
Speaker 3: litigated in the Norieega case and and Noriega state in jail,
• 17:33
Speaker 3: so he lost all of those claims. That is really
• 17:37
Speaker 3: powerful legal precedent, and it is very closely on point.
• 17:41
Speaker 2: You talk about the legal side this, I want to
• 17:43
Speaker 2: ask just real quickly, are there other legal aspects and
• 17:47
Speaker 2: challenges in this case? It could come up as well.
• 17:50
Speaker 3: Well, yes, and and look, there are distinctions that I
• 17:52
Speaker 3: would expect Maduro to argue between this case and the
• 17:57
  Speaker 3: Noriega case.
• 17:58
  Speaker 4: In in the.
• 17:59
Speaker 3: Noriega case, the the General Assembly in Panama had actually
• 18:03
Speaker 3: declared war on the United States.
• 18:06
  Speaker 4: Uh.
• 18:07
Speaker 3: Secondly, they had shot and killed a US marine. And
• 18:10
Speaker 3: so those are both both facts that that leaned in
• 18:14
Speaker 3: favor of Noriega the president being able to respond and
• 18:17
Speaker 3: respond militarily. In this instance, the government of of of
• 18:21
Speaker 3: Venezuela has not formally declared war on the United States.
• 18:25
Speaker 3: And they have not uh, they have not killed a
• 18:29
Speaker 3: marine or a service member. Although uh, Maduro's drug trafficking
• 18:33
Speaker 3: has killed countless Americans, thousands and and and and you know,
• 18:38
Speaker 3: hundreds of thousands, maybe even millions, a massive number of Americans.
• 18:42
Speaker 3: Maduro is responsible for killing through drug trafficking. I will
• 18:46
Speaker 3: say also that there is a second issue that will
• 18:50
Speaker 3: be litigated, which is what's called head of state immunity.
• 18:53
Speaker 3: So Maduro will go and argue that that the actions
• 18:57
Speaker 3: he carried out were as the leader of an and
• 19:00
Speaker 3: as a general principal US government. US courts don't impose
• 19:05
Speaker 3: criminal liability for the actions a head of state does.
• 19:10
Speaker 3: And Noriega was the de facto leader of Panama, but
• 19:14
Speaker 3: he was not elected by the people. In this case,
• 19:18
Speaker 3: the guy was recognized as a head of state, and
• 19:21
Speaker 3: so it's different from Noriega that will be litigated. I
• 19:25
Speaker 3: think the response to that is fine. That may have
• 19:29
Speaker 3: been he may have enjoyed that immunity back in twenty seventeen,
• 19:33
Speaker 3: twenty eighteen, but twenty nineteen when he ignored the results
• 19:37
Speaker 3: of the election and seized power illegitimately, everyone agrees he
• 19:42
Speaker 3: was illegitimate. The United States, by the way, the Biden
• 19:44
Speaker 3: administration agreed that. The first Trump administration agreed that. Most
• 19:48
Speaker 3: of the rest of the world is acknowledged that that
• 19:51
Speaker 3: Maduro state in power illegitimately. One exception from the head
• 19:57
Speaker 3: of state immunity is if the government invites you in.
• 20:00
Speaker 3: In this case, I think you would say there's not
• 20:04
Speaker 3: an operational government that is legitimate that he was he
• 20:08
Speaker 3: was an illegitimate dictator, but that will be a subject
• 20:11
Speaker 3: of litigation. It would not surprise me to see that
• 20:14
Speaker 3: question go all the way to the US Supreme Court.
• 20:16
Speaker 2: All right, And finally, I know I'm going to laugh
• 20:18
Speaker 2: because I know you're going to have an answer for this.
• 20:20
Speaker 2: Are there any other legal presidents that are going to
• 20:22
Speaker 2: come up in here as well as we wrap up
• 20:24
Speaker 2: the legal side of this.
• 20:25
Speaker 3: There are, And there's a line of cases that's known
• 20:28
Speaker 3: as the Kerf Frisbee doctrine, which says that that unlawful
• 20:33
Speaker 3: abductions of criminals on foreign soil does not stop the
• 20:39
Speaker 3: criminal prosecution of those individuals in US courts. And the
• 20:44
Speaker 3: lead case in this line of cases is a case
• 20:47
Speaker 3: called the United States versus alvarezma Chain. It was a
• 20:51
Speaker 3: nineteen ninety two ruling, and the Supreme Court six' three
• 20:54
Speaker 3: concluded that A mexican national who was forcibly abducted In
• 21:00
Speaker 3: mexico from his home brought to The United states that
• 21:04
Speaker 3: he could be criminally. Prosecuted it didn't matter if his
• 21:08
Speaker 3: being seized abroad was illegally and so that line of.
• 21:11
Speaker 3: Cases If maduro were just a run of the mill drug,
• 21:14
Speaker 3: dealer it would be a very easy question, that regardless
• 21:19
Speaker 3: of the circumstances of his, capture if he VIOLATED us criminal,
• 21:23
Speaker 3: laws he could be prosecuted. Here and so that line
• 21:25
Speaker 3: of CASES i think will be. Relevant and, again all
• 21:28
Speaker 3: the folks ON tv claiming this is illegal are ignoring
• 21:32
Speaker 3: both The constitution And Supreme court precedent not to mention
• 21:37
Speaker 3: the BINDING doj opinion from nineteen eighty.
• 21:40
Speaker 2: Nine as, before if you want to hear the rest
• 21:43
Speaker 2: of this conversation on this, topic you can go back
• 21:45
Speaker 2: and dow the podcasts from earlier this week to hear
• 21:48
Speaker 2: the entire. THING i want to get back to the
• 21:51
Speaker 2: big story number three of the.
• 21:53
Speaker 1: Week you may have Missed.
• 21:54
Speaker 2: CENTAER i want to go back to just the rhetoric,
• 21:57
Speaker 2: here and we mentioned the governor. Earlier Governor Tim waltz
• 22:01
Speaker 2: is now a disgraced. Governor he had to drop out
• 22:03
Speaker 2: of his re election campaign because of the fraud that
• 22:06
Speaker 2: is just continuing to grow in the dollar amount and
• 22:09
Speaker 2: the different sectors of the. Government i'm not sure there's
• 22:12
Speaker 2: any sector In minnesota that wasn't involved in fraud and.
• 22:15
Speaker 2: Corruption at this, point we're seeing it in, transportation child,
• 22:18
Speaker 2: care the list goes on and. On but the governor
• 22:21
Speaker 2: now seems to think this is like a moment to
• 22:23
Speaker 2: seize on and he's now going to go to war
• 22:26
  Speaker 2: with the federal.
• 22:27
  Speaker 1: Government it's very.
• 22:28
Speaker 3: Odd, Yeah, look The democrat politicians In minnesota are in
• 22:33
Speaker 3: crisis right now because This somali fraud is the worst
• 22:37
Speaker 3: instance of fraud that has ever been uncovered In american,
• 22:40
Speaker 3: history nine billion dollars in counting massive theft from the.
• 22:44
Speaker 3: Taxpayers it is so bad That Tim, WALTZ i mean,
• 22:47
Speaker 3: remember like twelve minutes ago The democrats said he was
• 22:50
Speaker 3: going to be vice president of The United, states and
• 22:52
Speaker 3: now he's ended his campaign for reelection even as, governor because,
• 22:58
Speaker 3: LOOK i think he's facing potentially very real criminal, liability,
• 23:02
Speaker 3: yeah for the fraud that unfolded under his. Leadership and
• 23:06
Speaker 3: and it is And waltz and the mayor In minneapolis
• 23:10
Speaker 3: that they're not the only. ONES i think there's an
• 23:12
Speaker 3: entire array Of democrats who are. Responsible and one of
• 23:17
Speaker 3: the reasons why they are so eager to foment. RIOTS i,
• 23:22
Speaker 3: mean look that they are rooting for a replay of
• 23:26
Speaker 3: The Black Lives matter and The antifa riots we saw
• 23:30
Speaker 3: all over the. Country they want people going to the.
• 23:32
Speaker 3: Streets they want them looting, stores they want them fire
• 23:34
Speaker 3: bombing police. Cars they are rooting for violence because they
• 23:38
Speaker 3: want to energize their voters and get everyone not talking
• 23:42
Speaker 3: about the. Fraud Here's Tim, waltz the, governor and here
• 23:45
Speaker 3: was his, response calling for all at.
• 23:49
Speaker 6: War, WELL i said this.
• 23:50
Speaker 1: Yesterday we've never been at war with our federal. GOVERNMENT
• 23:56
Speaker 1: i think in this case that The National guard is
• 23:59
Speaker 1: their main. Mission they have a dual.
• 24:00
Speaker 2: Mission when he said, that and it went, Viral I'm,
• 24:04
Speaker 2: mike let me get this. Straight you have a governor
• 24:06
Speaker 2: who is in a crisis. Situation i'm talking about The
• 24:09
Speaker 2: christs on the, ground whose job is to back law,
• 24:12
Speaker 2: enforcement and his job is also to ratchet down the
• 24:15
Speaker 2: rhetoric so we don't have a civil war. Breakout and he's,
• 24:18
Speaker 2: like maybe this is an opportunity for a civil. War
• 24:20
Speaker 2: he's saying That minnesota is at war with The United
• 24:23
  Speaker 2: states federal.
• 24:24
Speaker 1: Government the governor just said.
• 24:26
Speaker 3: That, yeah and, listen if you're an angry left wing,
• 24:30
Speaker 3: radical you already Hate, ice you already Hate Donald, trump
• 24:35
Speaker 3: and then you hear the Elected democrat governor Say minnesota
• 24:41
Speaker 3: is at war with the federal.
• 24:43
Speaker 4: Government that is a call to.
• 24:45
Speaker 3: Violence that is a call in, war people get, killed
• 24:50
Speaker 3: people get. Injured that Is democrats very deliberately calling to.
• 24:56
Speaker 3: Violence it is not we disagree over us see with
• 25:00
Speaker 3: the federal. Government it is we're we're at. War AND
• 25:03
Speaker 3: i think a huge part of this is a cya
• 25:07
Speaker 3: instinct because the fraud is so. Bad AND i want
• 25:10
Speaker 3: you to. Listen The House representatives had a hearing on
• 25:13

• 27:54
Speaker 2: just laying out the reality of the situation on the
• 27:56
Speaker 2: ground and how we got to a point where virtually
• 27:59
Speaker 2: every government program In minnesota has been compromised by The
• 28:02
Speaker 2: somali community in this way where they could grab money
• 28:05
Speaker 2: and create fraud with.
• 28:06
Speaker 3: It but by the Way brandon got, elected he had
• 28:09

• 29:07
  Speaker 4: It but.
• 29:09
Speaker 3: The somali immigrants come, here they have a lot of babies.

• 29:35
Speaker 3: The democrats did it, deliberately and they did it to buy.
• 29:38
Speaker 3: Votes they were importing votes to vote For. Democrats they
• 29:42
Speaker 3: allowed them to commit fraud to steal nine billion dollars
• 29:45
Speaker 3: and then to bundle those votes for The, democrats to
• 29:48
Speaker 3: bundle cash for The. Democrats and The democrats covered it.
• 29:51
Speaker 3: Up and it's Why Tim, Waltzon Jacob fray and so
• 29:53
