- 0:00Speaker 1: What's up, everyone, and welcome back to the program. In
- 0:03Speaker 1: this episode, we're going to pick back up where we
- 0:05Speaker 1: left off with day number six of the Tyler Robinson

- 0:14Speaker 1: parties and Mr. Robinson, Ms. Kirk as well. I appreciate
- 0:18Speaker 1: your patience with the court. The court takes this responsibility
- 0:22Speaker 1: very seriously. And going into today's hearing, I read the briefs.
- 0:26Speaker 1: I looked at the evidence time and time again. and
- 0:29Speaker 1: came in with a basic format of my ruling. But
- 0:32Speaker 1: I saved, I felt it was important not to reach
- 0:34Speaker 1: ultimate conclusions until after the oral argument. And so that's
- 0:38Speaker 1: what's taking additional time to keep an open mind, even
- 0:42Speaker 1: up until this point. With that in mind, I just
- 0:45Speaker 1: remind the parties that I understand that this can affect
- 0:48Speaker 1: all sides. Mr. Robinson and those associated with him, Ms.
- 0:52Speaker 1: Kirk and those associated with her. So I ask you
- 0:56Speaker 1: to do your best as we move forward and the
- 0:58Speaker 1: court will begin reading its ruling. Before the court is

- 1:46Speaker 1: And I'm going to admit reading the citations just in
- 1:51Speaker 1: the interest of time. I will be filing this within
- 1:54Speaker 1: 24 hours, so that will be there. The court acting
- 1:58Speaker 1: as a magistrate conducted a five-day prelim hearing from July
- 2:01Speaker 1: 6th to July 10th this year. The court received testimony
- 2:05Speaker 1: from several witnesses, including Utah State Bureau of Investigation agent
- 2:09Speaker 1: Brian Davis and David Hull, FBI forensic, DNA examiner Amanda Baker,
- 2:15Speaker 1: and Bureau of Alcohol, Tobacco, Firearms, and Explosives Samantha Karner.
- 2:20Speaker 1: The court also provisionally admitted and reviewed extensive video and
- 2:24Speaker 1: other exhibits. Following the evidentiary hearing, the court ordered post-hearing briefing.
- 2:30Speaker 1: The state filed its memorandum in support of a prelim
- 2:33Speaker 1: hearing bind over on July 28, 2026. Defendant filed his
- 2:38Speaker 1: prelim hearing briefing on August 11, 2026, and the state
- 2:42Speaker 1: filed its reply memorandum on August 18, 2026. Oral argument
- 2:48Speaker 1: was heard today. Having considered the party's written submissions, the
- 2:52Speaker 1: evidence admitted at the prelim hearing The arguments of counsel
- 2:56Speaker 1: and governing authorities the court enters this ruling and order.
- 3:00Speaker 1: The findings and conclusions in this ruling and order are
- 3:03Speaker 1: preliminary and apply only to the standards governing a Utah
- 3:07Speaker 1: prelim hearing. They do not determine defendant's guilt, the ultimate
- 3:11Speaker 1: credibility of witnesses, the weight of the evidence, or the
- 3:15Speaker 1: admissibility of evidence at trial. On September 10, 2025, Turning
- 3:20Speaker 1: Point USA hosted an event at Utah Valley University in Orem, Utah.
- 3:25Speaker 1: The event included public discussion of political and social, cultural,
- 3:30Speaker 1: and religious issues. Charlie Kirk, the founder of Turning Point USA,
- 3:35Speaker 1: was the headline speaker and was scheduled to speak to
- 3:37Speaker 1: participants and answer the questions. The event took place in
- 3:41Speaker 1: the campus courtyard, an outdoor amphitheater located in the middle
- 3:45Speaker 1: of several campus buildings. Thousands of participants gathered in the
- 3:49Speaker 1: courtyard and surrounding areas, including at least two children. A
- 3:54Speaker 1: white canopy tent was set up on the west side
- 3:56Speaker 1: of the courtyard adjacent to the Hall of Flags, a
- 3:59Speaker 1: raised walkway that runs north and south through campus. Mr.
- 4:03Speaker 1: Kirk entered the courtyard by walking underneath the Hall of
- 4:06Speaker 1: Flags to the white tent. At approximately 12.20, Mr. Kirk
- 4:11Speaker 1: was seated on the raised chair under the middle of
- 4:14Speaker 1: the tent behind a U-shaped table, a man standing to
- 4:16Speaker 1: the right of and behind Mr. Kirk southwest at an
- 4:20Speaker 1: unknown distance from Mr. Kirk. The man was close enough
- 4:23Speaker 1: that his body is positioned under the tent. Another man
- 4:27Speaker 1: was standing to the left of and in front of Mr. Kirk,
- 4:30Speaker 1: the tent northeast, at an unknown distance from Mr. Kirk.
- 4:35Speaker 1: Another man was standing to the right and in front
- 4:37Speaker 1: of Mr. Kirk and the tent southeast. A participant was
- 4:41Speaker 1: standing at the microphone positioned in front of the tent
- 4:44Speaker 1: east at an unknown distance from Mr. Kirk. The front
- 4:48Speaker 1: row of the crowd of participants was located east of
- 4:50Speaker 1: the microphone and at an unknown distance from Mr. Kirk.
- 4:54Speaker 1: The participant at the microphone and the crowd were separated
- 4:58Speaker 1: from Mr. Kirk's tent by a patch of grass of
- 5:01Speaker 1: unknown dimensions and barriers. At approximately 12.23 that afternoon, Mr.
- 5:06Speaker 1: Kirk was answering a question from a participant standing at
- 5:09Speaker 1: the microphone. Officer Christopher Bailey with the Utah Valley University
- 5:14Speaker 1: Campus Police heard a rifle shot from the east. He
- 5:18Speaker 1: saw Mr. Kirk lean, fall to his left, The man
- 5:22Speaker 1: standing to Mr. Kirk's right took more than two steps
- 5:25Speaker 1: to reach Mr. Kirk's side. Mr. Kirk's security team carried
- 5:29Speaker 1: him out of the courtyard, under the Hall of Flags,
- 5:32Speaker 1: and to the hospital where he was pronounced dead. Mr.
- 5:36Speaker 1: Kirk died by a gunshot wound to his neck. Forensic
- 5:39Speaker 1: examination of bullet fragments found in Mr. Kirk's body revealed
- 5:43Speaker 1: the bullet to be a. 30 caliber class round. The
- 5:46Speaker 1: trajectory of the bullet was anatomically from the front to back,
- 5:49Speaker 1: slightly left to right, and downward. The bullet did not
- 5:53Speaker 1: exit Mr. Kirk's body, but came to rest and tissues
- 5:57Speaker 1: in his upper back, left of the middle line. Officer
- 6:01Speaker 1: Bagley searched the roof of the Losey Center, a campus
- 6:03Speaker 1: building east of, but not directly adjacent to the courtyard.
- 6:08Speaker 1: The top of the Losey building is made up of
- 6:10Speaker 1: two shades of gravel, a dark gray and a lighter gray.
- 6:14Speaker 1: It has four stories, including an atrium on the roof.
- 6:18Speaker 1: There's public outside stairway attached to the building, that leads
- 6:21Speaker 1: to the pathway going east. A guardrail protects the roof
- 6:25Speaker 1: of the Losey Center from the pathway, but the guardrail
- 6:28Speaker 1: is short enough to be jumped over. When persons stand
- 6:32Speaker 1: on the southwest corner of the roof of the Losey Center,
- 6:35Speaker 1: there is a clear line of sight to the white
- 6:36Speaker 1: canopy tent where Charlie Kirk was sitting. Officer Bagley found
- 6:41Speaker 1: a red and black screwdriver approximately 10 to 15 feet
- 6:44Speaker 1: west of the guardrail on the roof of the Losey Center.
- 6:48Speaker 1: He saw disturbances in the rooftop gravel On the southwest
- 6:51Speaker 1: corner of the building, the disturbances were described by Officer
- 6:55Speaker 1: Bagley as consistent with a sniper pad, meaning a place
- 6:59Speaker 1: where a person was lying in a prone position with
- 7:01Speaker 1: a line of sight to where Mr. Kirk had been seated.
- 7:05Speaker 1: The distance from the perch area to the tent was
- 7:07Speaker 1: approximately 415 feet angled downward. The elevation difference between the
- 7:13Speaker 1: perch and the tent is approximately 68 feet. Around 6 p.m.
- 7:18Speaker 1: that day, Investigators located a rifle wrapped in a black
- 7:21Speaker 1: towel in a wooded area on the north side of
- 7:24Speaker 1: Campus Drive, an area to the northeast of the Losee Center.
- 7:28Speaker 1: The rifle was a Mauser Model 98 bolt-action that had
- 7:32Speaker 1: been retrofitted to a. 30- 06 barrel and was in operable condition.
- 7:38Speaker 1: It contained an optical accessory. A bolt-action rifle requires a
- 7:41Speaker 1: user to manipulate the bolt to load it, lock it,
- 7:44Speaker 1: and extract anything that's in it, including a spent shell casing.
- 7:49Speaker 1: When investigators located the rifle, they found one. 36 fired cartridge,
- 7:54Speaker 1: casing as well as three unfired cartridges. The casing and
- 7:59Speaker 1: unfired cartridge had engravings on them. The towel, rifle, casing,
- 8:03Speaker 1: and cartridges were sent to the FBI for testing. Further
- 8:07Speaker 1: investigation revealed that in the early morning hours of September 10, 2025, Mr.
- 8:13Speaker 1: Robinson left his apartment in St. George, Utah and traveled
- 8:17Speaker 1: to Utah Valley Campus in Orem, Utah. At 8.30 a.m.,
- 8:21Speaker 1: a gray or silver Dodge Charger entered the parking garage
- 8:25Speaker 1: on campus. The Charger, including its distinctive wheels, is consistent
- 8:29Speaker 1: with a car owned by Mr. Robinson. A person identified
- 8:33Speaker 1: as Mr. Robinson exited the Charger and walked on foot
- 8:36Speaker 1: out of the parking garage toward the outdoor amphitheater on campus.
- 8:40Speaker 1: He was wearing a maroon short-sleeved shirt, shorts, a hat,
- 8:44Speaker 1: and a backpack. He spoke with representatives from Turning Point USA,
- 8:49Speaker 1: then returned to his vehicle and at approximately 9.25 a.m.
- 8:53Speaker 1: He drove out of the parking garage. Video surveillance captured
- 8:56Speaker 1: a person identified as Mr. Robinson returning to campus on
- 9:01Speaker 1: foot from the northeast just after 10 a.m. He had
- 9:05Speaker 1: had a Chick-fil-A in the Sorenson Center, one of the
- 9:07Speaker 1: buildings adjacent to the outdoor amphitheater. He then walked to
- 9:11Speaker 1: the northeast of campus to a wooded area and on
- 9:14Speaker 1: to the north side of the campus drive. Just prior
- 9:17Speaker 1: to 11 a.m., he returned to campus and walked up
- 9:20Speaker 1: the exterior stairway of the low-sea center building to the
- 9:23Speaker 1: guardrail that, if climbed over, could give access to the
- 9:26Speaker 1: roof of the building. He then walked back down the
- 9:30Speaker 1: stairs and off campus. At 11.53 a.m., a person identified
- 9:34Speaker 1: as Mr. Robinson then returned to campus, wearing the same
- 9:38Speaker 1: shoes but different clothing, a dark long-sleeved shirt, jeans, and
- 9:42Speaker 1: a backpack. He walked with a gait or a limp,
- 9:45Speaker 1: his right leg stiff. He had nothing in his hands.
- 9:49Speaker 1: Video surveillance just afternoon captured a person wearing a dark
- 9:52Speaker 1: clothing and a backpack slowly walking and limping down the
- 9:56Speaker 1: sidewalk in front of the Losey Center toward the exterior
- 9:59Speaker 1: staircase that leads to the roof. At approximately 12.15 p.m.,
- 10:04Speaker 1: video surveillance captured the person wearing a dark long-sleeved shirt
- 10:08Speaker 1: and pants at the top of the exterior staircase of
- 10:12Speaker 1: the Losey Center. The person climbs or rolls over the
- 10:17Speaker 1: guardrail separating the walkway from the roof of the At
- 10:20Speaker 1: approximately 12.22pm, the same person is seen running toward the
- 10:24Speaker 1: southwest corner of the rooftop of the Losey Center. He
- 10:28Speaker 1: crouches down, crawls and stops in a prone position for
- 10:31Speaker 1: approximately 45 seconds. He then gets up and runs from
- 10:36Speaker 1: the southwest corner of the roof to the northeast corner
- 10:39Speaker 1: of the roof. He is holding a long skinny dark
- 10:42Speaker 1: object in his hand. He lowers himself off the roof
- 10:46Speaker 1: and lands on the grass. He walks towards Campus Drive.
- 10:49Speaker 1: crosses the street, and enters the wooded area. At approximately
- 10:53Speaker 1: 11 p.m., Mr. Lance Twiggs, Mr. Robinson's roommate, whom he
- 10:59Speaker 1: had been dating, received a text from Mr. Robinson, phone number.
- 11:02Speaker 1: The text told Mr. Twiggs to look under his keyboard.
- 11:06Speaker 1: Under the keyboard was a note purportedly written by Robinson
- 11:09Speaker 1: explaining that he had left the house that morning on
- 11:12Speaker 1: a mission. All right, folks, we're going to wrap up
- 11:14Speaker 1: right here, and in the next episode, we're going to
- 11:16Speaker 1: pick up where we left off. All the information that
- 11:20Speaker 1: goes with this episode can be found in the description box.
