- 0:00Speaker 1: What's up everyone, and welcome to another episode of the
- 0:03Speaker 1: Epstein Chronicles. In this episode, we're picking up where we
- 0:06Speaker 1: left off with the New Mexico Truth Commission and their
- 0:10Speaker 1: interim report about Jeffrey Epstein in his crimes in the
- 0:14Speaker 1: state of New Mexico chargeable criminal offenses. The Truth Commission
- 0:20Speaker 1: will continue to look for opportunities to refer matters for
- 0:23Speaker 1: criminal prosecution so that the perpetrators can be held accountable.
- 0:27Speaker 1: Based on survivor's statements and other evidence. Epstein, Maxwell, and
- 0:31Speaker 1: possibly others engaged in criminal conduct between ninety six and
- 0:35Speaker 1: twenty twelve. The following state statutes with corresponding limitation periods
- 0:40Speaker 1: were available as potential charges. Potentially chargeable offenses and limitation periods.

- 1:01Speaker 1: prostitutes five years misdemeanor, Section thirty Dash nine Dash four,
- 1:07Speaker 1: Promoting prostitution five years misdemeanor. Section thirty Dash nine Dash eleven,
- 1:14Speaker 1: Criminal sexual penetration six years or if a minor at
- 1:18Speaker 1: any time after the occurrence of the crime until the
- 1:20Speaker 1: alleged victim reaches the age of thirty five, subject to
- 1:23Speaker 1: possible tolling. Section thirty Dash nine Dash twelve Criminal sexual
- 1:30Speaker 1: contact six years or if a minor, at any time
- 1:34Speaker 1: after the occurrence of the crime until the alleged victim
- 1:36Speaker 1: reaches the age of thirty five, subject to possible tolling
- 1:40Speaker 1: Section thirty Dash nine Dash thirteen, Criminal sexual contact of
- 1:45Speaker 1: a minor six years. Section thirty Dash fifty two Dash
- 1:49Speaker 1: one Human trafficking six years if a second degree felony.
- 1:55Speaker 1: In two thousand and eight, the New Mexico Legislature enacted
- 1:58Speaker 1: Human Trafficking Criminal statutefied at NMSA Section thirty Dash fifty
- 2:04Speaker 1: two Dash one twenty twenty five. A person can be
- 2:08Speaker 1: convicted under this statute for knowingly one recruiting, soliciting, enticing, transporting,
- 2:13Speaker 1: or obtaining by any means another person with the intent
- 2:17Speaker 1: or knowledge that force, fraud, or coercion will be used
- 2:20Speaker 1: to subject to person to labor services or commercial sexual activity.
- 2:25Speaker 1: Two recruiting, soliciting, enticing, transporting, or obtaining by any means
- 2:30Speaker 1: of person under the age of eighteen years, with the
- 2:33Speaker 1: intent or knowledge that the person will be caused to
- 2:36Speaker 1: engage in commercial sexual activity or three benefiting financially or
- 2:41Speaker 1: by receiving anything of value from the labor services or
- 2:44Speaker 1: commercial sexual activity of another person, with the knowledge that force, fraud,
- 2:48Speaker 1: or coercion was used to obtain the labor services or
- 2:52Speaker 1: commercial sexual activity. New Mexico's Human Trafficking Statute sets forth
- 2:56Speaker 1: the definition and penalties, but does not include a special
- 3:00Speaker 1: limitation period. Accordingly, New Mexico's general limitation rules set forth
- 3:05Speaker 1: at NMSSAY Section thirty Dash one, Dash eight, nineteen seventy eight,
- 3:10Speaker 1: apply with different limits depending on degree eg. Six years
- 3:14Speaker 1: for second degree felonies, five years for third or fourth
- 3:17Speaker 1: degree felonies. However, House Bill one sixteen twenty twenty four
- 3:22Speaker 1: and Senate Bill thirty two twenty twenty six both proposed
- 3:26Speaker 1: amending section thirty Dash one eight to remove the limitation
- 3:30Speaker 1: for human trafficking for instances that are not already time barred.
- 3:34Speaker 1: The proposed amendment was as follows. For any crime against
- 3:38Speaker 1: or in violation of Section thirty Dash fifty two Dash
- 3:41Speaker 1: one NMSSAY, nineteen seventy eight, no limitation period shall exist,
- 3:46Speaker 1: and prosecution for these crimes may commence at any time
- 3:50Speaker 1: after the occurrence of the crime. If enacted, this would
- 3:53Speaker 1: eliminate the statute of limitations for human trafficking entirely, regardless
- 3:57Speaker 1: of the offense's degree, thereby allowing for future prosecution of
- 4:01Speaker 1: these crimes without having a time limit to prosecute. These
- 4:05Speaker 1: laws would not be retroactive, however, because of the ex
- 4:09Speaker 1: post facto restrictions rooted in Article one, Section nine, and
- 4:13Speaker 1: ten of the US Constitution. Investigative Area Number two Institutional failures.
- 4:20Speaker 1: The investigative Area covers the failure of governmental and private
- 4:23Speaker 1: entities to investigate, prosecute, or take action in response to
- 4:27Speaker 1: Epstein's known or suspected wrongdoing. This includes, but is not
- 4:31Speaker 1: limited to, the failure of the U s Attorney's Office
- 4:34Speaker 1: for the District of New Mexico to complete its investigation
- 4:38Speaker 1: of Epstein's activities in New Mexico, the failure of the
- 4:41Speaker 1: New Mexico Attorney General to complete its investigation of Epstein,
- 4:45Speaker 1: the New Mexico Attorney General's failure to maintain a copy
- 4:48Speaker 1: of records generated and collected in connection with its investigation
- 4:52Speaker 1: of Epstein, The Santa Fe District Attorney's failure to investigate Epstein,
- 4:57Speaker 1: the failure of the state authorities to monitor Epstein as
- 5:00Speaker 1: a sex offender, and the failure of the State Land
- 5:03Speaker 1: Office to enforce the terms of his land lease Sex
- 5:07Speaker 1: Offender Registration and Notification Act soorna oversight. On June thirtieth,
- 5:12Speaker 1: two thousand and eight, Epstein was convicted in pom Beach, Florida,
- 5:15Speaker 1: of procuring a person under the age of eighteen for
- 5:18Speaker 1: a prostitution in violation of Florida Statute seven ninety six
- 5:22Speaker 1: dot three. He was released from probation parole corrections on
- 5:26Speaker 1: July twenty one, twenty ten. The age of Epstein's victim
- 5:30Speaker 1: at the time of the offense for which he was
- 5:32Speaker 1: convicted was seventeen. Under New Mexico law applicable at the time,
- 5:37Speaker 1: a sex offender residing in the state was required to
- 5:40Speaker 1: register with the County Sheriff no later than ten days
- 5:43Speaker 1: after being released from custody or being placed on probation
- 5:46Speaker 1: or parole. When registering with the county sheriff, a sex
- 5:50Speaker 1: offender was required to provide certain information including name and alias's,
- 5:55Speaker 1: date of birth, social Security number, address, place of employment,
- 5:59Speaker 1: the sex offense committed, and the date in place of
- 6:02Speaker 1: the sex offense id at Section twenty nine Dash eleven
- 6:06Speaker 1: A Dash four B, two thousand and nine. New Mexico
- 6:10Speaker 1: law applicable at the time to find sex offense to
- 6:13Speaker 1: include specified offenses as set forth by New Mexico Statute,
- 6:17Speaker 1: including criminal sexual penetration in the first, second, third, or
- 6:21Speaker 1: fourth degree as provided in NMSA Section thirty dot nine
- 6:26Speaker 1: Dash eleven, two thousand and nine, or their equivalents, and
- 6:29Speaker 1: any other jurisdiction. Criminal sexual penetration in the fourth degree
- 6:33Speaker 1: consists of all criminal sexual penetration on a child thirteen
- 6:37Speaker 1: to sixteen years of age when the perpetrator is at
- 6:40Speaker 1: least eighteen years of age and is at least four
- 6:42Speaker 1: years older than the child and not the spouse of
- 6:45Speaker 1: that child. While under New Mexico law, Epstein would not
- 6:48Speaker 1: have committed a crime because the girl was seventeen if applicable.
- 6:53Speaker 1: SONA codified at thirty four USC Section twenty nine oh
- 6:57Speaker 1: one provides a comprehensive set of minimum standards for sex
- 7:01Speaker 1: offender registration and notification in the US. Among other things,
- 7:05Speaker 1: SOORNA require sex offenders to register and keep the registration
- 7:09Speaker 1: current in each jurisdiction where they live. Work or go
- 7:12Speaker 1: to school, and also require sex offenders to make periodic
- 7:16Speaker 1: in person appearances to verify and update their registration information.
- 7:21Speaker 1: Only those convicted of qualifying sex offenses must register. There
- 7:25Speaker 1: are five classes of qualifying offenses, one designated federal sex offenses,
- 7:31Speaker 1: two specified military offenses, three crimes identified as one of
- 7:35Speaker 1: the special offenses against a minor, four crimes in which
- 7:38Speaker 1: some sexual act or sexual conduct is an element, and
- 7:42Speaker 1: five attempts or conspiracy to commit any offense in one
- 7:46Speaker 1: of these other classes of qualifying offenses. On July twenty second,
- 7:51Speaker 1: twenty ten, the Florida Department of Law Enforcement sent the
- 7:55Speaker 1: New Mexico Department of Public Safety a letter notifying them
- 7:58Speaker 1: that Epstein was a sexual offender and had indicated a
- 8:01Speaker 1: forwarding address of forty nine Zoro Ranch Road, Stanley, New Mexico.
- 8:06Speaker 1: FDL also forwarded Epstein's FDL Sexual Predator Offender Registration form,
- 8:12Speaker 1: which listed the Virgin Islands as Epstein's then permanent address.
- 8:16Speaker 1: The form listed Epstein's other addresses, his employer, which he
- 8:19Speaker 1: listed as FTC sixty one hundred Red Hook Quarter Sweet
- 8:24Speaker 1: B three US Virgin Islands, and his vehicles also attached
- 8:28Speaker 1: to The letter was a notice of Sexual predator and
- 8:31Speaker 1: sexual offender obligations. By letter dated July twenty three, twenty ten,
- 8:37Speaker 1: NMDPS notified Epstein of his obligation to register with the
- 8:41Speaker 1: sheriff of the New Mexico County in which he intended
- 8:44Speaker 1: to reside no later than ten days after establishing residents
- 8:47Speaker 1: in New Mexico. On August twelfth, twenty ten, the detective
- 8:51Speaker 1: responsible for overseeing Epstein's sex offender registration sent an email
- 8:56Speaker 1: to the NMDPS indicating that she spoke with Epstein's attorney
- 9:00Speaker 1: and let him know that they're working on figuring out
- 9:03Speaker 1: if Jeffrey would have a state requirement to register or
- 9:06Speaker 1: just a federal requirement, and asking can you let me
- 9:10Speaker 1: know what will be his requirement. On the same day,
- 9:13Speaker 1: the program manager for the Sex Offender Registration Unit or
- 9:17Speaker 1: at the NMDPS advised the detective, I guess he's not
- 9:21Speaker 1: required to register in New Mexico. On August seventeenth, twenty ten,
- 9:25Speaker 1: Epstein completed a New Mexico sex offender registration form. According
- 9:30Speaker 1: to the form, Epstein was required to register within ten
- 9:33Speaker 1: days after establishing residents in New Mexico. The form characterized
- 9:38Speaker 1: Epstein as a temporary New Mexico resident with an address
- 9:42Speaker 1: at Zoro Ranch. The form notes next appointment not scheduled.
- 9:46Speaker 1: Have not received letter from DPS indicating that mister Epstein
- 9:50Speaker 1: is not required to register in New Mexico. As part
- 9:53Speaker 1: of the form, Epstein was required to acknowledge his sex
- 9:56Speaker 1: offender responsibilities. His responsibilities in included a requirement that Epstein,
- 10:02Speaker 1: in the event he intends to travel to another state
- 10:05Speaker 1: or a country for more than ten days, notify the
- 10:07Speaker 1: sheriff of the county he currently resides in and the
- 10:10Speaker 1: state he'll be traveling too. On the same date, an
- 10:14Speaker 1: offender questionnaire was completed for Epstein, although it does not
- 10:18Speaker 1: appear he filled it out personally. The questionnaire required Epstein
- 10:22Speaker 1: to identify all residents, ages of residence, and relation to
- 10:26Speaker 1: the offender for the location where the offender is residing.
- 10:30Speaker 1: No information was provided. The questionnaire also indicated that Epstein
- 10:34Speaker 1: previously had been arrested in nineteen seventy three by New
- 10:38Speaker 1: Scotland Yard London for unlawful possession of an offensive weapon
- 10:42Speaker 1: a swordstick. Epstein indicated yes to the question has the
- 10:46Speaker 1: offender ever lived with an adult lover male or female
- 10:49Speaker 1: for at least two years and continuous with the same person.
- 10:53Speaker 1: A table identifying Epstein's vehicles, two aircraft, four landlines twenty
- 10:58Speaker 1: four and cell phones won was attached by letter dated
- 11:02Speaker 1: August nineteenth, twenty ten. NMDPS advised Epstein that under the
- 11:07Speaker 1: current NMSA nineteen Dash twenty nine Dash eleven A, he
- 11:11Speaker 1: was not required to register with the State of New
- 11:14Speaker 1: Mexico for his two thousand and eight conviction, but that
- 11:17Speaker 1: he might be required to register under Title I of
- 11:20Speaker 1: the Adam Walsh Child Protection and Safety Act of two
- 11:23Speaker 1: thousand and six while he resides temporarily in New Mexico. Indeed,
- 11:28Speaker 1: Epstein was not convicted of any other crimes specified in
- 11:31Speaker 1: nm SA Section twenty nine Dash eleven A three E
- 11:35Speaker 1: two thousand and nine, or their equivalents in any other jurisdiction.
- 11:40Speaker 1: On the other hand, he was convicted of a crime
- 11:42Speaker 1: in which some sexual act or sexual conduct is an element,
- 11:46Speaker 1: and on the basis would appear to have been subject
- 11:48Speaker 1: to federal SOORNA requirements. Under SOORNA, a sex offender shall
- 11:53Speaker 1: appear in person, allow the jurisdiction to take a current
- 11:56Speaker 1: photograph and verify the information in each registry in which
- 12:00Speaker 1: that offender is required to be registered, not less frequently
- 12:03Speaker 1: than one each year if the offender is a Tier
- 12:07Speaker 1: one sex offender, two every six months if the offender
- 12:10Speaker 1: is a Tier two sex offender, and three every three
- 12:13Speaker 1: months if the offender is a Tier three sex offender.
- 12:17Speaker 1: By letter dated May twenty first, twenty twelve, Indyke provided
- 12:22Speaker 1: the detective with updated SONA notification information comprised of a
- 12:26Speaker 1: spreadsheet listing Epstein's residences, vehicles, boats, aircraft, landlines, cell phone websites,
- 12:33Speaker 1: Twitter accounts, and other social media accounts. By letter to
- 12:37Speaker 1: the Detective dated July twenty second, twenty thirteen, in Dyke
- 12:42Speaker 1: updated Epstein's SOORNA notification information with much the same information
- 12:47Speaker 1: as the year before, although with a marked increase in
- 12:50Speaker 1: the number of social media accounts. By letter dated April
- 12:54Speaker 1: twenty seventh, twenty seventeen, the New York State Sex Offender
- 12:57Speaker 1: Registry advised the NMDPS that Epstein had been assigned a
- 13:01Speaker 1: risk Level three, meaning the risk to community is high.
- 13:06Speaker 1: A comprehensive offender report dated July seventeenth, twenty nineteen, and
- 13:11Speaker 1: issued to the Santa Fe County Sheriff's office noted that
- 13:14Speaker 1: the offender is not required to register per stay law,
- 13:17Speaker 1: but will be required to register per Adam Walsh when
- 13:20Speaker 1: in MNM not releasable to WEB when registering. Between December
- 13:26Speaker 1: twenty ten and July twenty fifteen, either Epstein personally or
- 13:30Speaker 1: through his attorney in Dyke contacted the Santa Fe County
- 13:33Speaker 1: Sheriff's Office on thirteen occasions to inform them that Epstein's
- 13:37Speaker 1: intended presence in New Mexico. An internal Zoro Ranch document
- 13:41Speaker 1: noted that Jeffrey must email the detective two days prior
- 13:45Speaker 1: to going to the ranch. On April twenty fifth, twenty thirteen,
- 13:49Speaker 1: in Dyke email Leslie Groff requesting make a note that
- 13:52Speaker 1: any time he is scheduled to go to NM or PB,
- 13:56Speaker 1: remind me two days before his scheduled departure to tell
- 13:59Speaker 1: him to email Woods in Palm Beach and the detective
- 14:02Speaker 1: in New Mexico. All contact was made with the detective.
- 14:05Speaker 1: The Santa Fe County Sheriff's Office has provided no other
- 14:08Speaker 1: information indicating that Epstein personally or through anyone else informed
- 14:13Speaker 1: them of Epstein's intent to be in New Mexico. Documentation
- 14:17Speaker 1: from The Santa Fe County Sheriff's Office shows they were
- 14:20Speaker 1: informed of Epstein's presence in New Mexico as follows. December seventh,
- 14:24Speaker 1: twenty ten to date unknown in Dyke advised by email
- 14:28Speaker 1: that Epstein would be leaving New York and traveling to
- 14:31Speaker 1: New Mexico on December seventh, twenty ten. February twenty fifth,
- 14:35Speaker 1: twenty eleven. February twenty sixth to March second, twenty eleven,
- 14:41Speaker 1: Epstein emailed, stating, Detective Anaya has promised. I told you
- 14:45Speaker 1: I would notify you when I was again in New Mexico.
- 14:48Speaker 1: I'll be there from Saturday, February twenty sixth to Wednesday,
- 14:51Speaker 1: March second. You can call my cell if you have time.
- 14:55Speaker 1: March fourth to March seventh, twenty eleven, Epstein advised by email,
- 14:59Speaker 1: I've bad cold, so I returned to New Mexico tonight,
- 15:02Speaker 1: staying until Monday afternoon. July seventh through seventeenth, twenty eleven.
- 15:08Speaker 1: By email dated July seventh, twenty eleven, Epstein advised, I'll
- 15:11Speaker 1: be out the ranch starting tomorrow for seven days. Hope
- 15:14Speaker 1: you're well. February twenty first to March first, twenty twelve,
- 15:19Speaker 1: in Dyke advised that Epstein would be traveling from New
- 15:22Speaker 1: York to New Mexico on February twenty first, twenty twelve,
- 15:26Speaker 1: and would be staying in New Mexico no more than
- 15:28Speaker 1: eight days. July thirtieth to August twentieth, twenty twelve, Epstein emailed,
- 15:33Speaker 1: advising Detective I'll be staying in Santa Fe for approximately
- 15:36Speaker 1: three weeks starting next Monday the thirtieth. July thirty first
- 15:42Speaker 1: to August thirty first, twenty twelve, Epstein emailed, advising I
- 15:46Speaker 1: arrived in New Mexico. Will be in and out of
- 15:48Speaker 1: the state for the next month. Hope things you're well.
- 15:51Speaker 1: September fourteenth through eighteenth, twenty twelve, Epstein emailed, at an
- 15:55Speaker 1: abundance of caution, I write to tell you that I
- 15:58Speaker 1: arrived in New Mexico and I will leave on Tuesday
- 16:00Speaker 1: the eighteenth. Hope you were well. February twenty third through
- 16:04Speaker 1: twenty fifth, twenty thirteen, Epstein emailed, I'll be in New
- 16:07Speaker 1: Mexico the twenty third through twenty fifth. Hope you were well.
- 16:12Speaker 1: April twenty fifth through twenty ninth, Epstein emailed, I will
- 16:16Speaker 1: be in New Mexico for four days. Hope you were well.
- 16:19Speaker 1: August first through thirty first, twenty thirteen, Epstein emailed, I'll
- 16:23Speaker 1: be in Santa Fe from Thursday, August first to August
- 16:26Speaker 1: thirty first, Hope you were well. December twentieth through twenty eighth,
- 16:31Speaker 1: twenty thirteen, Epstein emailed, happy holiday again. Out of an
- 16:35Speaker 1: abundance of caution, please be advised that I'll be in
- 16:38Speaker 1: New Mexico for the week of the twentieth through twenty eighth.
- 16:41Speaker 1: Happy holiday. August first through the thirty first, twenty fifteen,
- 16:47Speaker 1: Epstein emailed, as an extra precaution, I'm letting you know
- 16:50Speaker 1: that I'll be on my ranch for the month of August.
- 16:52Speaker 1: Hope you were well. Epstein was subsequently removed from the
- 16:56Speaker 1: NM registry just two days after registering because it's conviction
- 17:00Speaker 1: involved a victim over sixteen, New Mexico's age of consent.
- 17:04Speaker 1: The New Mexico Legislature introduced HB four to forty five
- 17:08Speaker 1: in twenty twenty six to close this loophole. The Truth
- 17:12Speaker 1: Commission intends to do so in future legislation. For the
- 17:15Speaker 1: General session of twenty twenty seven, there's evidence that Epstein
- 17:19Speaker 1: appeared in the Santa Fe County Sheriff's Office on August seventeenth,
- 17:23Speaker 1: twenty ten, to complete his initial sex offender registration. However,
- 17:28Speaker 1: the Commission has yet to locate any evidence showing that
- 17:31Speaker 1: Epstein appeared in person to allow the Santa Fe County
- 17:34Speaker 1: Sheriff's Office to take a current photograph and verify the
- 17:37Speaker 1: information in each registry in which that offender is required
- 17:40Speaker 1: to be registered each year or more frequently as may
- 17:44Speaker 1: have been required under SONA through the local New Mexico attorney.
- 17:48Speaker 1: Epstein acknowledged after his first registration the follow up annual
- 17:52Speaker 1: registration appearance must be made before December thirty first of
- 17:56Speaker 1: each calendar year beginning December thirty first to tienty eleven.
- 18:01Speaker 1: If Jeffrey Epstein in that calendar year, follow up annual
- 18:05Speaker 1: registration appearances do not appear to have been made. All right, folks,
- 18:08Speaker 1: We're gonna wrap up right here, and in the next
- 18:10Speaker 1: episode dealing with the topic, we're gonna pick up where
- 18:12Speaker 1: we left off. All the information that goes with this
- 18:15Speaker 1: episode can be found in the description box.
