- 0:11with Congress. Question Okay, who found mister Epstein in his cell?
- 0:17Answer Thomas. Question Thomas, can you walk us through step
- 0:20by step the events unfolding of discovering mister Epstein in
- 0:25the cell? Answer? The breakfast came up, it was time
- 0:28to feed breakfast. Thomas said that he'll do it, because
- 0:31you know he was sleeping all night. I opened the grill.
- 0:34Epstein is the first cell, so we started there. Thomas,
- 0:37I'm standing out on the grill. Thomas goes in the
- 0:40cell block, knocks on the door, doesn't get an answer
- 0:43because he would have to come to the door to
- 0:45receive the tray. He knocks again, He doesn't get an answer.
- 0:48He opens the door. When he opens the door, he yelled,
- 0:51passed me a cutter. So I hit my body alarm
- 0:54and I go back down the stairs to go look
- 0:56for a cutter. When you hit the body alarm, the
- 0:58whole building's coming. Everybody's coming. When I went back up
- 1:03to the stairs, he had already ripped because you hear
- 1:06ripping and he was doing CPR. Question Officer Thomas was
- 1:10doing CPR. Answer correct question on mister Epstein. Answer correct
- 1:15question is that standard protocol? Answer no question. Why do
- 1:19you think he started administering CPR? Answer? The standard protocol
- 1:24is he's not supposed to open the door? Question so
- 1:27he decided to open the door? Answer correct question. Did
- 1:30he see mister Epstein? What did he see when he
- 1:33looked in? Answer? Oh, I don't know. We never spoke
- 1:36about the incident or after the incident, so I don't
- 1:38know what he's seen, and from where I'm standing, I
- 1:41can't see. Question at what point did you join him
- 1:45after he hit the body alarm or before then? Answer?
- 1:49After I hit the body alarm, I go downstairs to
- 1:51look for the cutter, and then I came back upstairs,
- 1:54and I could see like his feet, because by this
- 1:56time he has him on the floor. I could see
- 1:58his feet, but I'm still outside the grill. Foy whose feet?
- 2:02Noel Epstein feet? Question Epstein feet on the ground. Answer
- 2:07correct question. Did you ever go into the cell? Answer
- 2:11no question? Did you stand outside and wait for help?
- 2:14Answer yeah, and help came really fast? Question how fast
- 2:18would you say, answer like five minutes. Question okay, and
- 2:22his officer Thomas standing in the cell at that point. Answer,
- 2:26he's on the floor with him doing CPR. Question the
- 2:29entire five minutes answer correct. Question did mister Epstein respond
- 2:34to the CPR at all? Answer? I don't know. Question
- 2:38by mister Grant, You said that help derived in about
- 2:42five minutes. Do you know who came as part of
- 2:44the help, Noel, I don't remember everybody but Lieutenant Jean
- 2:48and the whole bunch of other people, But I can't
- 2:50remember exactly who Grant. Approximately how many people came, Noel?
- 2:55Maybe like five Grant? Thank you. Now back to Miss
- 3:00fire Bend. Question at no point during those events transpiring,
- 3:05did you see inside the cell? Answer yeah, no question okay,
- 3:08So just to be clear, you didn't see anything inside
- 3:11that cell that could have been out of place. Answer
- 3:14no question, No betting or linens. Answer no question. Did
- 3:18you ever see mister Epstein's body? Answer when they were
- 3:22bringing them out on the stretcher? Question how soon after
- 3:25help arrived were they bringing him out on the stretcher?
- 3:28Answer maybe ten minutes. Question you said he was doing CPR.
- 3:32If either one of you discovers an inmate that requires
- 3:35medical attention. Was there any specific procedure that you had
- 3:39to follow? Answer as far as the shoe goes, I
- 3:42know that you're not supposed to enter a cell alone.
- 3:44You're supposed to like call for help and wait for
- 3:47help and then you can start administering. But as far
- 3:50as that, I don't know. Question do you know why
- 3:52the procedure is that way? Answer no, I do not know. Question.
- 3:56And you said you never spoke to mister Thomas afterward?
- 4:00Answer no, question, so you don't know why he would
- 4:03have gone in by himself. Answer correct. Question. After mister
- 4:07Epstein's body was removed from the cell, well, he was
- 4:10pronounced dead at six thirty nine am in the morning.
- 4:13Did you what did you do after that? Answer? Next,
- 4:18I was in the shoe for a while because everybody
- 4:20was gone, and I was calling to ask where's my relief?
- 4:23Because remember by this time, now it's time for me
- 4:26to leave. Question sure answer. Psychologists came upstairs and asked,
- 4:30did I need to speak to anyone? I said no,
- 4:33I went downstairs after I don't remember who relieved me
- 4:36to be honest, and then I went downstairs and the
- 4:39lieutenant asked me what happened? But I spoke to my
- 4:41union rep and they told me not to say anything,
- 4:44and I left. Question who is your union rep? Answer?
- 4:48I can't even think of his name, and I see
- 4:50him in front of me. I can he works in
- 4:52R and D. I'm having a blank foy tyrone? Noel?
- 4:56Uh huh? Question that's okay. Was your union rep at
- 5:00MCC when you were talking to him about this? Answer? Yes?
- 5:04Question and why would he say not to talk about it? Answer?
- 5:09I don't. I guess because the lieutenant was asking me,
- 5:13and that's not like protocol. If you want to question
- 5:16me like the union rep should be there. Question did
- 5:19you leave your shift at the normal time at eight
- 5:21am in the morning? Answer? I think it was after
- 5:25eight am because there was not a lot going on,
- 5:27because because there was a lot going on. Question how
- 5:30long after eight do you think? Answer? Maybe a half
- 5:33an hour? Question okay, were you ever told anything before
- 5:37you were before you left? Answer? No? Question Was that
- 5:41your last ever shift at MCC? Answer correct? Question How
- 5:46soon after your last shift? So August tenth? Did you
- 5:49answer questions in an interview by MCC about what happened
- 5:53that day? Mister Foy, that was even after the OIG, right, Noel,
- 5:59I'm thinking so it was more than two years, Noel. Yeah,
- 6:02it was a long time ago for sure fire Bend
- 6:06about how long if you had to guess estimate, mister Foy,
- 6:10I'd say more than two years, because it was after OIG. Noel,
- 6:14like about two years, Foy, more than two years, faire
- 6:20Bend question. I know we discussed whether or that Officer
- 6:24Thomas was sleeping while on midnight to eight am shift.
- 6:27Correct answer correct question? How long was he sleeping? For answer?
- 6:32So it varies because he had went upstairs at one
- 6:35point to ten South, So I can't really say, like
- 6:38how long he was sleeping pretty much for like the
- 6:40duration of the shift. But at one point he left
- 6:43and he went upstairs to ten South, and then he
- 6:45came back and he went back to sleep. Question Okay,
- 6:49and Officer bon Haami on the shift before that, you said,
- 6:53I think you said he was sleeping, is that right? Answer?
- 6:55Correct question about how long was he sleeping? For answer?
- 7:00So he went to sleep towards the last hour or
- 7:03maybe the like last two hours of his shift. Question,
- 7:07And that was around the time that you had done
- 7:09your ten pm count answer correct question. And then we
- 7:13mentioned the ten thirty eight in the video you were
- 7:16walking off. Was Officer BONHAMI asleep by that time? Answer
- 7:19he was? Question okay, And to ten thirty nine when
- 7:23we discussed the flash of orange in the video camera,
- 7:26he would have been asleep then as well. Answer correct question, okay,
- 7:30Thank you. Were you at any point sleeping on your
- 7:32shift between four pm before excuse me, on the night
- 7:36of August ninth or the morning of August tenth? Answer
- 7:40no question. I'd like to ask a few more questions
- 7:44about the payments. JP Morgan Chase had reported that you
- 7:47received a total of twelve suspicious cash deposits beginning in
- 7:51April of twenty eighteen. These were included in the most
- 7:55recent release of the Epstein Files Transparency Act, and there's
- 7:59been lots of reporting about them since then. JP morgan
- 8:02suspicious activity report in the Epstein Files included the five
- 8:06thousand dollars cash deposit that we discussed earlier in the
- 8:09first hour, but it also included eleven deposits from an
- 8:13unknown sender. Cash deposits under ten thousand usually are not
- 8:18flagged as suspicious. However, they flagged all of these deposits.
- 8:23Are you familiar with these twelve suspicious deposits that they flagged?
- 8:28Answer so, Chase, never inform me of anything suspicious on
- 8:31my account. When you say unknown sender, nobody deposits money
- 8:35in my account, I do so. I don't know who
- 8:37or what would have been an unknown sender. Question So
- 8:41no one else had access to your JP Morgan account?
- 8:43Answer correct question? Just you answer me correct question. There
- 8:48was also bank records from the DOJ that showed that
- 8:52there were seven cash deposits totaling eleven thousand, eight hundred
- 8:55and eighty dollars that began in December of twenty eighteen.
- 8:59Was that also from you distributing the cash deposits? Answer
- 9:03correct question. Okay, is your testimony today that these cash
- 9:07deposits that were flagged by JP Morgan were sent to
- 9:10you by yourself within your own account? Answer not sent,
- 9:14I make the deposit question deposited? Answer uh huh question,
- 9:18and that none of these cash deposits had anything to
- 9:21do with Jeffrey Epstein or GALLAINN. Maxwell. Answer correct question.
- 9:28And we discussed that during the first hour. As far
- 9:30that you knew about mister Epstein when he was incarcerated.
- 9:34It seems at some point you learned that he was
- 9:36a wealthy individual. Is that right? Answer? I mean I
- 9:39knew he was high profile. Question would it be safe
- 9:42to assume that your co workers at MCC would have
- 9:45known that he was a wealthy individual? Answer? I don't know.
- 9:49Question So my question is are you aware of mister
- 9:51Epstein paying anyone else that was employed by MCC? Answer no,
- 9:56I'm not aware of that. Foy anyone else paying any
- 10:00employee at MCC for anything? Noell, no Emmer. You mentioned
- 10:06earlier that there was medication that mister Ebstein had in
- 10:08his cell that you didn't know, or that how he
- 10:12would have had access to it? Is that correct? Is
- 10:15it possible that an employee at MCC may have been
- 10:18working with mister Ebstein to bring medication to him. Answer?
- 10:22I don't know who that would be. Question Okay, I
- 10:25know we've mentioned this before, but for the record, were
- 10:28there any security cameras in the shoe? Answer? Yes? Question
- 10:32how many security cameras? Answer that I don't know how many? Question? Okay,
- 10:37where do you know there would be? Answer on the tiers?
- 10:40Question on the upper or lower tiers? Answer there's one
- 10:44on the upper and I'm not sure if there is
- 10:46one on every tier, but on the tier center. Question
- 10:50when you were working at your station, were you able
- 10:52to see the camera footage from that station? Answer like
- 10:56see what the camera is? Question typically, well maybe not.
- 11:00But were you able to see a screen that showed
- 11:03video surveillance? Answer no? Question. Would you ever see the
- 11:08security camera footage? Answer never? Question was that handled by
- 11:13other people? Answer? I don't know who handled it? Question
- 11:16MCC staff, I don't know. Question so you don't know
- 11:20whether MCC hired outside parties to install or manage? Answer yeah,
- 11:24I don't know how that works. Question Okay, do you
- 11:27know how often the MCC upgraded their security camera systems?
- 11:31Answer I don't know. Question do you know whether the
- 11:34cameras would often fail or malfunction? Answer that I don't know.
- 11:39Question during your time in the shu the Shoe, did
- 11:43you ever have problems with the security cameras not working?
- 11:46Answer no question. Did you ever know about the security
- 11:49cameras not working? No conversations other people that you would
- 11:53have had? Answer no question. Have you ever handled anything
- 11:57relating to security camera footage? Answer no question. Okay, all right, folks,
- 12:04we're gonna wrap up right here, and in the next episode,
- 12:07we're gonna pick up where we left off. All the
- 12:10information that goes with this episode can be found in
