- 0:26Welcome to the Punch List.
- 0:28Hey guys, welcome to the around the House show.
- 0:29I'm Eric G.
- 0:30Thanks for joining me today.
- 0:32This is our Punch List episode.
- 0:34This is the one we put the middle of the week that doesn't make it into the week of last weekend's show.
- 0:38But this is a new topic or next weekend show and I got a busy one today.
- 0:42I tell you what, I am going to be out at Rock the Locks Music Festival tomorrow.
- 0:46So come on out.
- 0:47And if you're in the Pacific Northwest and you want to see all those bands, I will be your mc.
- 0:53Come on out, say hello.
- 0:55This is going to be a lot of fun.
- 0:57I can't wait.
- 0:58And keep an eye on things.
- 1:00It's going to get interesting out there at this show.
- 1:01Watch our social media and you'll know what I'm talking about.
- 1:04And that's the only hint I'm going to give you.
- 1:08There's a big story out there and something I've been talking about for a long time.
- 1:12We are seeing mold become the new lead paint asbestos of your home.
- 1:18And new home builders are going to be paying the price for this.
- 1:23Most of these large home builders are not paying one bit of attention to humidity and mold inside the building envelope.
- 1:31How do I know this?
- 1:32Been watching it for my whole career of about 35 years.
- 1:36And now that we're making houses so much tighter and so much more efficient, they're not breathing as well and that mold is going everywhere.
- 1:44So here's the bigger story, Louis.
- 1:46In Louisiana there is a suit against Dr.
- 1:49Horton.
- 1:49In Florida, the Seminole Tribe's lawsuit against Lennar Homes are being cited nationally as a leading example of this broader trend.
- 1:57Mold claims against home builders are piling up and insurers are increasingly the ones footing the bill.
- 2:04So Dr.
- 2:05Horton's legal reserves, this is where they self insure and put money away for lawsuits is $1.1 billion.
- 2:16That's huge.
- 2:17Lennar's self insurance reserve rose 21% in fiscal 2025 to $336.9 million.
- 2:26Jury verdicts over 10 million in construction litigation rose 52% between 2023 and 2024.
- 2:36So what's the story of the Dixon case in Dr.
- 2:38Horton in Louisiana.
- 2:41So Alicia and West Dixon sued after buying a Dr.
- 2:45Horton home in 2014 that they said had H vac system that was too small for the Louisiana humidity.
- 2:53Mold, water intrusion, unlivable.
- 2:55Per their attorney.
- 2:57Louisiana appeals court just upheld keeping the case in state court instead of forcing it to arbitration.
- 3:03Which is interesting.
- 3:05It's now expanding towards a class action that that could include homeowners going back to 2007.
- 3:12Separately, in Slidell, homeowners in one of the Dr.
- 3:15Horton subdivisions have been finding mold and closets, laundry rooms, even garages, and organizing a ton of community forums.
- 3:24Now, Lennar and the Seminole tribe in Florida, they've got about 450 homes that are tied up in litigation.
- 3:31Across six reservations have defective roof and mold contaminated walls.
- 3:37Over a thousand tribal members are affected, many relocated with property damages and estimates topping $200 million.
- 3:46The builder's defense warranties and contracts should shield them.
- 3:49Some blame homeowner maintenance or the Louisiana humidity itself.
- 3:54A defense attorney for them has called the claims targeted at best.
- 3:58Now, here's the issue that I've got, and girlfriend's kid just bought a home who did buy it from Lennar.
- 4:08And I'll tell you what, I learned some good lessons watching this go down.
- 4:13Lennar had done some pretty horrible framing on the second floor.
- 4:18I called it out in the inspection and they had to go in and rip the siding off the second floor on the two long sides of this single family home and fix it so it didn't look like the
- 4:30ocean up there.
- 4:31I was surprised they took care of it because it was a big deal.
- 4:35They had people up there for a week working on that.
- 4:38Now here's the thing.
- 4:39The problem was, is towards the end, all the little stuff that should have gotten taken care of, the H Vac system, some of the other stuff on the punch list, including painting touchups, and that stuff was supposed to
- 4:53be done before closing.
- 4:54They acknowledged it.
- 4:56Did they do it?
- 4:56Heck, no.
- 4:58They kept telling us it was done.
- 5:00They went into the closing, and guess what?
- 5:02All this stuff wasn't done when they got their keys.
- 5:05So here's what happened.
- 5:06Lennar pushed it over into the home warranty.
- 5:10It's been about three weeks since they've moved in.
- 5:13They're still trying to get the H Vac people out there all under the warranty, all under all this.
- 5:20So there are some lessons that I've seen from this.
- 5:24First off, if you're buying a new home right now, especially if you're getting it from Lennar, Horton's probably going to be the same way, or any one of these other builders.
- 5:32Make sure that punch list is a hundred percent done before your clothes.
- 5:37And if you got to push off the clothes, which is completely crazy, do it.
- 5:42You got to hold these guys accountable.
- 5:44Otherwise it could be months before somebody gets out there to fix it.
- 5:48I don't buy this.
- 5:49Oh, it's not maintenance.
- 5:50If you're undersizing the H VAC system or incorrectly installed windows, doors, poorly ventilated active attics trapping moisture, all that classic building science stuff we talk about on this show every week, I just call that a failure.
- 6:07That's not bad luck weather.
- 6:08That is a failure.
- 6:11So these builders need to be building for that environment.
- 6:14Every one of those homes should have had a dehumidifier in it.
- 6:18Simple.
- 6:19Every one of those homes, they should have been checking for moisture before they start putting in the insulation and drywall.
- 6:26But do they?
- 6:27No.
- 6:28There is absolutely no standard for testing on that before.
- 6:33Now, on the builder stage that I ran for the national association of Home Builders, I told guys like this in my seminars that they should be doing mold testing, they should be doing air quality testing.
- 6:48They should be testing for moisture in the lumber before they get it in there.
- 6:52No one's doing it.
- 6:53And if they are, you'll see it in their ads because they're going to be promoting that.
- 6:58So mold spore counts can vary wildly by testing method.
- 7:03And the bad part is there's no accepted threshold for too much.
- 7:08You can get two dueling experts and have remediation costs from 500,000 to 50,000 to a million for the same house, which is crazy.
- 7:21And health claims get contested in court as well.
- 7:24Mold is medically linked to worsening asthma, respiratory issues.
- 7:28But some online wellness claims attribute much broader symptoms with a little scientific backing, but not much.
- 7:36So there's a lot of myth versus fact.
- 7:38Now here's the big deal.
- 7:40Your resale impact, one Texas homeowners property assessment reportedly dropped from 318,700 to 117,000 once mold was disclosed.
- 7:52That is a major loss.
- 7:55So here's the thing.
- 7:56If you're going to be buying a brand new home, this is where your inspector needs to go through and do some serious research as well as you.
- 8:07You need to look and see, did they undersize the H Vac?
- 8:12Do they have poor attic ventilation?
- 8:14What's going on there?
- 8:17So you need to do a load calculation for this.
- 8:20Did they do the vapor barrier?
- 8:22Was the house wrap done?
- 8:23Right.
- 8:24Here's the thing.
- 8:26If I today was going to be buying a newly built home from one of these major house builders.
- 8:33I would be having.
- 8:35I'd be paying somebody thousands of bucks to come out and do all the framing inspection, the pre drywall inspection, the plumbing inspection, all of those things.
- 8:47And that way you've got somebody managing that.
- 8:50If we would have done that with the kids place, we would have caught a lot of things early.
- 8:55And the bad part in this neighborhood, every single one of the homes that we walked around that we could see, especially ones that were still being framed, had that same wavy wall.
- 9:07And it wasn't just a little wave.
- 9:08It had half inch, almost three quarters of an inch of wave.
- 9:11If you put a four foot level on the wall.
- 9:13So that's a big deal.
- 9:15And if you watch a lot of the building inspector social media stuff, you can see the broken trusses, the lack of insulation, all this stuff that's going on.
- 9:25Especially if you watch the side channel down there and what he's doing down in the Phoenix area, the builders are trying to sue him because he's calling him out on it and they've tried to pull his license.
- 9:36It gets pretty crazy.
- 9:37But this is where if you're out there working, make sure that you get that house inspected all along the way.
- 9:45So you know what you're getting.
- 9:47This one here, it was fairly interesting with Lennar because they told us, oh, it didn't see it.
- 9:53Oh, there's a big blocking over the fireplace for the tv.
- 9:55We do that on every home.
- 9:57No, they don't.
- 9:59There was no blocking.
- 10:00When I got the stud finder out, started looking in the wall and taking a peek.
- 10:03No, it was just framed.
- 10:04There was no blocking there.
- 10:06Nice try, guys.
- 10:07No blocking at all.
- 10:08But that's what the project manager told us when we were walking through the house.
- 10:12So these are things you've got to trust but verify they might be true, it might not be.
- 10:18But they could also just be telling you a BS story to get you through it.
- 10:23So be careful.
- 10:25Now, what would I do if I was concerned about mold in my newer home?
- 10:31I would get a hold of someone like Caroline Blazowski, America's healthy home expert.
- 10:35Do some air quality testing in your home and see what you have.
- 10:38She's got a kit that she can send out and do that testing.
- 10:42That way you know what you got and then you can deal with it correctly.
- 10:46That way you can find the mold and see where it is.
- 10:50So take a peek around.
- 10:52If you think you might have mold issues, then that's what I would do.
- 10:55I would get a hold of her, get some air testing and you'll be good to go.
- 10:59All right, let's get into our recalls of the week.
- 11:02Let's see.
- 11:03JK Max recalls heated blankets and heating pads due to fire burn hazard.
- 11:07There's about 195,000 of those.
- 11:11A lot of kids toys again out there.
- 11:14Sauna 360 expands its recall of the Tylo, Helmstead and Karuna hybrid saunas due to fall hazard.

- 11:29Reg Fear recalls bed pink mattresses due to serious risk of injury or death from fire, does not meet the mandatory flammability standards for mattresses.
- 11:39We're seeing this more and more online from these online mattress retailers.
- 11:44There's about only 818 of those.
- 11:47Let's see more of the infrared saunas.
- 11:50So fire and burn hazard.
- 11:51The infrared panels and the saunas can short circuit.
- 11:54This is sauna360.
- 11:56That's a big one there.
- 11:57There's about 41,000 of those.
- 11:59Another pressure washer recall lanches.
- 12:03Pressure washers recalled due to serious risk of injury or death from shock.
- 12:07Electrocution hazards.
- 12:08Again, no gfci.
- 12:10Another one of those online retailers.
- 12:12Char Broil recalls Bistro Pro electric grills due to risk of electric shock.
- 12:18The grounding wire for the grill's heating element.
- 12:21So this is an electric one you'd put on your patio.
- 12:24Great for apartments.
- 12:25Can disconnect and lose fault protection.
- 12:28There's about 10,605 of those.
- 12:30These are these little tiny Charboil electric ones.
- 12:34And Hayward Industries recalls universal pool heaters due to risk of serious injury or death from carbon monoxide poisoning.
- 12:41So about 4,600 of those.
- 12:44And then Frederick Air Conditioning recalls the cool window air conditioners due to risk of serious injury or death from fire.
- 12:52The control board inside the motor of the recalled air conditioners can fail.
- 12:56There's about 2,000 of those out there.
- 13:00And that's the main ones.
- 13:02Those are the main ones.
- 13:03Tons of toys.
- 13:04And again, there's still the AGA range 1 2.
- 13:07There's about 3,992 of those.
- 13:10They're dual fuel ranges with a missing cap from the gas test port.
- 13:13Can cause a gas leak.
- 13:14So take a look there.
- 13:16Any of the questions on that stuff, just head to CP Recalls.
