- 0:04This is a Bramble Jam podcast. This week on your gabble gabble. If
- 0:15your dog gets bitten by another dog in a dog park, can you sue
- 0:18them for vet bills? Judge Jerry Dodds head first into this ship zoo,
- 0:22Oh my gosh. And if you write a really long email, is it
- 0:28bad? Judge Faith thousands, real people, real cases, Thank Justice.
- 0:32This is your gavel gettle in the ropes, in the ropes, Wow in
- 0:39the ropes, Gavel gabble in the rope. I was in the road and
- 0:43off by the ship Zoo by the ship. Su I didn't you were like,
- 0:47did he just cuts? Are we live or we just record? All
- 0:53access members getting this get to see this show. And that's a bonus because
- 0:58people like to see us. It's a weird thing, that weird thing we're
- 1:02in robes were dancing around. You would have gotten to see Brand's reaction.
- 1:06Let me saying shit too love, big fun, big fun, big fun.
- 1:08So another reason to upgrade grade. Let me let me upgrade you,
- 1:14Dan, How are you? I'm great? How about you? But I'm
- 1:15so so good, so excited to be back in the chambers with you.
- 1:21The chambers of the Galmers the gall Well, that makes more sense. What
- 1:25is the chamber of commerce? I think it's just an area where trade happens.
- 1:30I'll give you two first rounds for a bunch of sour Patch kids.
- 1:37Yeah, deal, deal, What are you gonna do those first rounds?
- 1:41You're probably gonna flip them. I think I'm gonna flip them for the the
- 1:44Mambas Sour Mamas. Yeah. Do you think it'd be a good GM sports?
- 1:48I would enjoy it very much, I think, but I would have
- 1:51to really be just fully invested in that one. You really got to play
- 1:53in a long game. You really gotta Yeah, you gotta think ahead while
- 1:56also caring about the now going game short game, long game, both so
- 2:00both man, we got judge from Judge Faith. It's your first time on
- 2:04the Jerry, it's the first time. I could be wrong on that.
- 2:06Yes, yes, it is time and it's and he's canceled now, which
- 2:10I hate. But he canceled on the up and up like he can.
- 2:15As far as we know, Jerry hasn't done anything to get canceled. How
- 2:19is he not? I don't know. Yeah, that's as far as we
- 2:21know correct, But uh, yeah, I I feel like all of the
- 2:23Jerry Springer Show was one cancer canceled, canceled fast. The fact that he's
- 2:28not been canceled is unbelievable. I feel that way about Howard Stern. Yeah,
- 2:31dude. You know what else people go nuts about Howard Stern. I'm
- 2:35like, how's that guy not canceled? My favorite TV show of all time
- 2:37is Arrested Development. And if you watch that show now, I don't know
- 2:42how it gets like, well, that's a lot of shows I know,
- 2:45but it's more than I ever remembered. Yeah, it really is. There's
- 2:50a lot of stuff in community that I watch now and I'm like, huh,
- 2:52they did it. They were for it, dude, not as much
- 2:54as Arrested Developments. I mean, come on, they correct me if I'm
- 3:00right. They have a little Asian fellow that lives in Young Yeah, and
- 3:02and but that's not his actual name. They just that's the one word for
- 3:06hello. Yes, that lives in the attic. He lives all over the
- 3:08house. Yeah yeah, sometimes he's yeah, he's in the walls. Yeah
- 3:13on Young. I need to rewatch that show there. It makes me chuckle
- 3:20a good bit. It does. Turns out he's a spot Yeah, yeah,
- 3:27Oh gosh, yeah, good fun. What do you want to do?
- 3:30You want to go first? All right, let's get caught in the
- 3:34air. Heads. It's heads. Do you want to go first or second?
- 3:38Oh? Okay, go ahead. Let me introduce you to Richard Richard,
- 3:45who brings his puppy Jack into the courtroom with him. Jack walks in
- 3:50a musically not a ship, Sue, I just put that in there because
- 3:53it's a great dog. Pun looks like a mix of some sort maybe some
- 3:57sort of terrier mix. Okay, he can have some shit to it.
- 4:00I think he's a kid. He's a good boy. He's a good boy.
- 4:02He sits and lays down immediately right away. And Jerry's like, is
- 4:08that his temperament? And he said Jack is in it? Or Jack's owner,
- 4:12Richard is in a suit and is like, he's responding to the treat
- 4:14that's right here in my pocket, sitting waiting on it. Very very impressive.
- 4:17We learn later does everybody start clapping for Jack? They don't because it's
- 4:21COVID and it's like six people in the room with masks on. It's weird.
- 4:28We learned later that Jack works on movie sets. He actually gets a
- 4:31sag rate as a as a performer and works on different shows. Do you
- 4:35remember that time we did we're extras and we were sitting on the ship all
- 4:40day and we heard that guy bragging about all the shows. Is there a
- 4:44worse brag than that brag? That's the bottom of the barrel. So he
- 4:49claims that Maara's dog Maara attacked his dog at the dog park and is suing
- 4:57her for six hundred and fifteen dollars in bills. Now he's before Richard gets
- 5:02started. Jerry asked one question and then I'm pretty sure Jerry doesn't talk for
- 5:08the rest of the case, save for maybe one other question until oh wow,
- 5:12okay, he says, Now at this park, are you required to
- 5:15have your leash on the dog? And he says no, once you're in
- 5:17the park, your honor, you don't. And you get a picture of
- 5:20Jerry at that point doing this. Oh he doesn't like Brown shake his head
- 5:26like he doesn't like that, Like, I can't possibly rule for you because
- 5:30of this. He's never been to a dog park apparently, so, uh,
- 5:33that's kind of the whole Richard's dog park. That's how that works,
- 5:36Richard's Like I was out with Jack I decided to take him a dog park.
- 5:40Inside of the fence area is no leashes. But I was in that
- 5:44middle space, you know what I'm talking about. Yeah, there's this first
- 5:46fenced in area, yes, which is like a transition area. Is to
- 5:49make sure the dogs don't escape. So you open the first fenced in area,
- 5:53you go in there, you stay in that little leminal space there,
- 5:56and then once that gate is closed, then you open the next just want
- 6:00to let your dog in so if any dog gets out. Nbdstory dog purgatory,
- 6:04doggatory, doggatory. And uh so I'm in there and I'm waiting,
- 6:10he said, I'm waiting for other dogs to get an owner's to get a
- 6:13hold of their dogs to make sure they don't run off. And Mara is
- 6:18just not even in the picture. And her dog, she she, her
- 6:24dog comes in there. While I'm in there, I still have a hold
- 6:27of Jack, I still have him leashed up, and Marara pop just pops
- 6:30up and goes, how did my dog open the door? My dog didn't
- 6:34open that door, Like this is I think you opened the door. I
- 6:39think you open the second gate. My dog can't open the gate by himself.
- 6:43That's ridiculous, and Richard continues as like, I tried to get the
- 6:46gate open for Jack to get in the main area. I'm still I'm still
- 6:49got him on the leash. Mara's dog jumps on Jack, bites him in
- 6:54the ear, his ears bleeding. Mar's like, there's no proof of blood.
- 6:57There's no proof that there's any blood. I just want to let you
- 7:00know that, Richard, I haven't even gotten off the gotten him off the
- 7:02leash yet. This is one of the most aggressive dogs I've ever ever seen.
- 7:08Uh. And Mar's like, but who opened the gate? That's my
- 7:12question, Judge Jerry. My dog didn't open the gate. All of a
- 7:15sudden, the gate's open. Two dogs are fighting, isn't there Mar's dog
- 7:18is there? Oh, that's the whole Mars dog is already in there.
- 7:21No, I'm sorry, in the in the in the court. No,
- 7:25no, no, that would have been something. Yeah, I'd have been
- 7:27here for that. But Mar's like, my dog's been fine. In fact,
- 7:32she had three dogs there. This is the biggest one. My dog's
- 7:34been fine the whole time. He's not bothering any other dog there. All
- 7:39of a sudden, your dog shows up, the gate gets open. He
- 7:41goes nuts. Maybe it's your dog. Richard's like, she said, the
- 7:45reason my dog got attacked is because he's not fixed, apparently. But then
- 7:51he says, I've got a pick of her at the park. He's got
- 7:55a pick of Marra sitting at the park with her mask on, her two
- 8:00little dogs and her third dog all around her. She's on her phone.
- 8:03Richard says, this is her nonchalantly two verse four, nonchalantly sitting on a
- 8:07bench with the cell phone. She's not watching her dogs. This is what
- 8:11she did. This is the dog that bit Jack. The dog looks like
- 8:15a really good boy. Uh. I secured Jack. I got Jack away.
- 8:20Jack is bleeding. She's still on her phone. I don't know whose
- 8:24dog it is. I approach her, I said, is this your dog?
- 8:26Yes? She never apologized. She just said your dog must not be
- 8:30neutered. That's why this happened. She refused to do anything. And then
- 8:35Richard says Jack deserves justice because all he wanted to do was to play like
- 8:41the other dogs, and he never got the chance. This guy sounds fun.
- 8:45He is something. He's wearing a bow tie? Is he does I
- 8:48don't know if he's wearing one, but it certainly feels like he was.
- 8:52I don't remember. She didn't even get her dog off of Jack. I
- 8:58had to do everything Mar's like. There was no screaming. Dogs scream when
- 9:03they're hurt. They make noises, yelp. Yeah, there was no noise.
- 9:09There was no noise. I don't know how the gate got opened.
- 9:11I didn't see any blood. There isn't any noise anywhere. I just what
- 9:15he's saying doesn't line up with how my dog interacts with any other dog.
- 9:18And there's just no proof of it. And Richard says, your honor,
- 9:22you can see my dog's temperament. He works for a living. He's used
- 9:28to being on set. He does not go after other dogs. This is
- 9:31who this dog is. And the dog's there, literally still down the whole
- 9:35time. Wow, it's very impressive. Mars says, My dogs were all
- 9:39playing peacefully. Your dog showed up. I don't know what you're talking about.
- 9:41We can't say whose fault this is. Maybe he was only defending himself.
- 9:45We don't know. So Richard says, I have proofd from the vet.
- 9:48This was a dog bite. He was on meds for two weeks.
- 9:52I got marssel from her I sent her the vet bills. Mars says,
- 9:56the picks I saw and even show much of a laceration. We see a
- 10:01pick, there's clearly like four stitches. It's definitely a big bite, big
- 10:05boy bite. And then she's like, I'm looking at the receipt here and
- 10:09this bill is excessive. It is there's no way this should cost six hundred
- 10:13and fifteen dollars like these, These prices are like double what I would see,
- 10:18like normally, it's just too much. Normally are people sending you a
- 10:22lot of vet bills? She has three dogs, she goes to the vet,
- 10:24but for stitches, she just said, they're too they're double. Well,
- 10:28I don't know. Richard says, I sent her the bill. I
- 10:31texted her to her she immediately stopped texting me back. Mars says, there's
- 10:35no proof my dog did any of this. I'm not paying. Jerry's now
- 10:39ready to rule. Boy, oh boy, I do struggle here. It's
- 10:46a tough one because it is a lot of he said, she said,
- 10:48and it is a lot of She uh, the dog bit. There's no
- 10:54proof. There is no proof that the dog bits. The only proof we
- 10:58have is the medical bills. I think it's gonna be tough to make her
- 11:05pay without some sort of proof that it was her dog that did it.
- 11:11But I think Jerry's gonna give him the money, so uh we do.
- 11:16She does admit that her dog was in an altercation with him. Jerry says,
- 11:22I can't help but think that there is some assumption of risk if you're
- 11:26going into an area where with other dogs that you don't know, and you
- 11:31don't know if they're friendly or not, and you're sending your dog into a
- 11:35space where these things happen, there is enough evidence to suggest that both of
- 11:39you are at risk for something of this happening. And so I'm gonna split
- 11:41it. I'm gonna cut it in half. You're gonna get half that money.
- 11:46Three oh seven fifty is yours. You're welcome. That is the end
- 11:50of the case. I don't hate the ruling. I don't know if there's
- 11:52any five most boring case I've watched in this program in the years of this
- 11:56program. I don't know if it's a bad ruling. I don't think there's
- 12:01any legal presidents for it. Presidents yeah, but good lord, But I
- 12:07like the ruling. I don't think he's incorrect. There, like you go
- 12:09to a dog park. You're accepting that risk, but also stuff happens and
- 12:16you should be willing to pay pony up a little bit, pony up a
- 12:18little bit. So I think it's not a bad ruining. It is not
- 12:20a bad ruling because Mara, I think probably would have paid the three hundred,
- 12:24because according to her, it was just too double. It's double,
- 12:28it's double and up, it's double and half double and half. You know,
- 12:33I want to introduce you to Chuck Man, Chuck May. Chuck Man
- 12:39is injured, called Chuck May Chuck Man. Ummm. She He is suing
- 12:46his ex girlfriend Sarah Sarah for uh ten nineteen one nineteen dollars for a vacation
- 12:58reimbursement. Oh boy, she left him. Sarah is Sarah's countersuing him for
- 13:05one thousand dollars for a combination of reimbursement and harassment. That breakdown is six
- 13:13hundred dollars for reimbursement for him, four hundred for harassment. She came up
- 13:16with that number. I'm sure even and even thousands sounds right. So they
- 13:20met on match dot com. There's multiple mentions of match dot com. I
- 13:24don't know if they were a sponsor or? What but shout out to match
- 13:26dot com. Show up. They go on, they're talking, they love
- 13:31talking to each other, they love you know, they're really enjoying each other.
- 13:33They start to date and he says that she was everything that he was
- 13:39looking for. Wow, beautiful, smart, fun man to be around.
- 13:43How does go south? Well? Uh? They dated for six months and
- 13:48he has no idea why they broke up. No idea what? Uh?
- 13:52Sarah. Sarah says that she was recently divorced. She was with her husband
- 13:58for over twenty years. Her husband cheated on her for seven years and ended
- 14:05up getting the old divorce there and you know who can blame her? So
- 14:09she gets a divorce and a year later she joins Match. So she lets
- 14:13a year go by and truck. I'm ready. I'm ready to get back
- 14:16into the pool the love. I don't know if that's enough time twenty years,
- 14:20seven of which you rein cheated on. Everybody is different. I would
- 14:22have a hard time in a real time. I would have a hard time
- 14:26just from a trust I gotta stay. I can't imagine dating again at all.
- 14:30Yeah, well yeah, they we don't need to get into that.
- 14:31I can't imagine. Yeah, me either. So uh, she says,
- 14:37I met Chuck and it was great at first. We started dating. We
- 14:41went to Vegas on a trip, but both of us got very sick,
- 14:45and so we agreed that we would do a do over. What happens in
- 14:48Vegas stays in Vegas, especially if it's sickness. Hopefully again mull again.
- 14:54So they decide, uh to go to can Kun, Mexico. We're not
- 15:01messing around, no, and so this trip to can't Kun is the trip
- 15:05in question Dan, They're wondering. So they start to vacation and it gets
- 15:09to be more expensive than Chuck Old Chuck was anticipating, so he asks Sarah
- 15:16if she could chip in three hundred dollars. She says, no problem,
- 15:18totally not if he was paying for everything everything. Yes, Wow, by
- 15:22the end of the trip he needed another three hundred dollars, so six hundred
- 15:26dollars total. Chuck says, yes, that is what happened. About a
- 15:31week after Mexico, she breaks up with him. She says that she got
- 15:37to see who he really was on the trip. Big anger issue never stops
- 15:43talking, which I can you know see with this guy. He freaked out
- 15:48that I made a friend and left him for fifteen minutes. I come back
- 15:50in the room. He's crying, crying that I was gone for fifteen minutes.
- 15:54Chuck says, this is nonsense. She was jealous that I was at
- 16:00dinner. When we were at dinner, I started to talk up with some
- 16:03gals from Canada. So there you go, she says, you know,
- 16:07if you say the sentence I started to talk up with some gals from Canada,
- 16:11No one is jealous of you, that's right. Uh so she you
- 16:15know, She's like, no whatever, no, no, no. So
- 16:18after she breaks up, he asks for more of the money. He asked
- 16:22for one thy nineteen dollars for her half of the trip, so that would
- 16:26have been less than six hundred less. The six six sixteen nineteen would have
- 16:30been half of the trip, So thirty two thirty eight would have been the
- 16:32whole trip. Got wow, wow, show off. That would have taken
- 16:36me years. Go dude, ten nineteen That nineteen is a trigger. Tis
- 16:41thirty eight seventy six so six times. So after the trip, Sarah says
- 16:51that shuck fifty two. I was right the first time. Quid thank god?
- 16:55What hey for someone to think that you're in current After trip, Sarah
- 17:00says that Chuck starts to harass her every day, sending emails and texts just
- 17:07kind of like wanting the money, wanting to get back together, blah blah
- 17:10blah. These emails are crazy long. She brings a few of them.
- 17:12One of them is five pages long, single space, Oh my gosh,
- 17:17subject line my nightmare that is over, And Chuck is like, that's right,
- 17:22I'm gonna sell an ebook. Chuck's so. Judge Faith says, I
- 17:29see here that two months after you break up, you're still texting, You're
- 17:33still emailing every day. Two months in you send a text saying that you
- 17:38can't stop thinking about her and that every song makes you think of her,
- 17:42such as is it too late now to say sorry? To what? Sarah
- 17:47says, Yes it is. Judge Faith then goes on a little bit of
- 17:51a random says, you got a man up a little bit here, Chuck,
- 17:55Uh, you had good times? Move on? You think daily texts
- 17:57are going to work? And then she does whole lesson on break how to
- 18:00break up with somebody. When someone breaks up with you, they go the
- 18:04other way, and your instinct is to follow them in that direction. But
- 18:08what you should do is go the opposite direction. You want her to start
- 18:14wondering, why doesn't he text me? Why hasn't he called me? Play
- 18:15a little hard to get Chuckster, Chuckster, you can go your own way,
- 18:19So, Sarah says, it's not just that. It's not just a
- 18:23constant. There's a restraining order. By the way, Wow, she got
- 18:26a restraining order on him. Um, and Chuck's like, yes, that
- 18:30that that didn't happen. Faith. It's like, we didn't have to we
- 18:33didn't have to come to that, Chuck. She keeps saying his name,
- 18:36Chuck, which I really appreciate. Uh. Sarah says, it's not just
- 18:38that. Though while we were dating, he would say things like, if
- 18:41you ever leave me, I'll cut you up into a bunch of little pieces.
- 18:45What And Chuck says I may have joked here or there, and Faith
- 18:48cuts him office says there is no joke there, Chuck. Judge Faith asked
- 18:55Sarah if he stopped reaching out to her once the restraining order was put in
- 18:59place, and surprisingly to everybody, Chuck did stop reach out. Wow.
- 19:03And Judge Faith is ready for the verdict and to remind you, he is
- 19:08suing for oneenty nineteen dollars for her half of the trip, and she is
- 19:12suing for one thousand dollars six hundred dollars. She wants her six hundred dollars
- 19:15back, plus four hundred dollars for the five page emails. So an earlier,
- 19:21younger version of me hosting this show would have messed this up. I
- 19:23think there's a very distinct right answer here. I have learned that you can't
- 19:27ask for money for gifts or return that unless it is an engagement ring.
- 19:33That's the law. So if Faith doesn't go that way, then that's wrong.
- 19:37He cannot get anything back for buying her a trip. That's not how
- 19:40that works. She also cannot get anything back for lending him money that for
- 19:45the trip. That is not how the law works. She should have asked
- 19:48for way more for harassment because it would have been granted to her, because
- 19:52there are there is significant grounds for harassment here. She's gonna get the four
- 19:57hundred for harassment. He's getting nothing. She's getting a them for the trip
- 20:00four hundred dollars only in old you're close, you're what Faith? No,
- 20:04Well, let me get you, let me get you there. She's gonna
- 20:07give him more. Uh, So, she says to Chuckster, you can't
- 20:12just say, uh, this trip was only for while we were dating.
- 20:17After the fact, if they break up, you can't be like, I
- 20:19want more money. Now, That's not how those stings work. So no
- 20:22money for you. Your case is dismissed. Goes over to Sarah and uh,
- 20:29same thing. You paid the six hundred dollars while you're on the trip.
- 20:30You can't get that money back. Now. She's not going to give
- 20:36her any money for harassment because she followed the law. She got a restraining
- 20:41order for the harassment, and he followed the restraining order. If you would
- 20:45have continued to harass her after the restraining order, she would have gotten the
- 20:49four hundred dollars or whatever she asked for. But because he followed the law
- 20:52cost her money. That's exactly right, man. You have to file the
- 20:56restraining order and then if he follows the restraining order, no harassment. Interesting.
- 21:00So there you got to learn something new. Judge Faith, you're back
- 21:03in my good grace. There you go, there you go, we did
- 21:04everybody. Congratulations, What a great day, gable, what a great gavel.
- 21:08Indeed, always a good day when you get a good day when you
- 21:11get together. We did. Everybody Until next time, All Rise Yo.
