  shores of South Texas draws thousands of eyes to the skies,

  but a question bubbles beneath the awe Who really owns the

  beach that it launches from? And what happens when SpaceX

  asks for more than just temporary permission to close

  down the only Rd. leading to one of the last free beaches left to
• 0:49
  the public? As new laws in Texas could hand
• 0:53
  SpaceX greater authority over Boca Chica Beach, which is a
• 0:57
  beloved refuge for people with fewer means.

  How did a strip of sand cherished for generations become
• 1:05
  the center of a growing struggle between public rights and
• 1:10
  SpaceX? Since 2019, Space XS Star based
• 1:14
  facility near Boca Chica Beach has turned South Texas into a
• 1:18
  focal point for space enthusiasts.
• 1:20
  Visitors to South Padre Island and the Rio Grande Valley often
• 1:24
  make a special trip for about 45 minutes just to glimpse a rocket
• 1:29
  test or witness the thunderous power of a Super Heavy launch
• 1:33
  vehicle. Spacex's ambitions to one day
• 1:37
  send its Starship to Mars are not just dreams.
• 1:41
  There are a reality and a tourist attraction which draws
• 1:46
  consistent crowds of thousands. But this progress comes at a
• 1:50
  cost. Every time a SpaceX prepares for
• 1:53
  a launch, conducts an engine test, or even needs to haul
• 1:57
  heavy machinery across its sprawling star based facility,
• 2:02
  it requires the closure of Hwy. 4.
• 2:05
  This narrow vital Rd. is the only artery leading to Boca
• 2:09
  Chica Beach in the adjacent State Park, which is a pristine
• 2:13
  stretch of coastline bordering the Brownsville Ship Channel in
• 2:17
  the Rio Grande River's mouth. Now the closure is designed to
• 2:21
  protect both workers and the public Have a secondary effect,
• 2:24
  though, that often goes unacknowledged.
• 2:27
  When Hwy. 4 shuts down, so too does public access to a beach
• 2:32
  that for generation has been known as the Poor People's
• 2:36
  Beach. It's a rare place where locals
• 2:39
  could enjoy the coast without facing the rising costs.
• 2:42
  Comment to other Texas beaches. Now, Boca Chica shoreline is
• 2:46
  more than a day trip destination ecological treasure trove home
• 2:51
  to rear wildlife and historic artifacts including 150 year old
• 2:56
  wooden shipwreck. The natural environment has
• 2:59
  remained largely untouched, one of the last coastal areas in
• 3:03
  Texas free from heavy commercial development.
• 3:06
  The federal regulations kept Spacex's closures at 500 hours
• 3:11
  per year, and by law, the company must announce planned
• 3:14
  shutdowns to the public through Cameron County's judge's office,
• 3:17
  led by Judge Eddie Trevino Junior, whose staff releases
• 3:21
  notices ahead of each event on their website.
• 3:24
  And until now, this process has maintained a balance between
• 3:27
  SpaceX and the public access. However, new legislative efforts
• 3:32
  in Austin are poised to change that arrangement, and they are
• 3:37
  drawing sharp reactions. Now there's two bills, House
• 3:40
  Bill 4660 and Senate Bill 2188, the proposed transferring
• 3:46
  authority over Rd. closures directly to municipalities that
• 3:51
  house space ports. This is for SpaceX, specifically
• 3:55
  the SpaceX itself, the Starbase, becomes an incorporated city
• 3:59
  now. The proposed laws would allow
• 4:02
  SpaceX to manage closures from Monday through Thursday, while
• 4:05
  the county would retain control over the weekends.
• 4:09
  And the critical detail buried in the Senate version of the
• 4:11
  bill gives the future mayor of Starbase sole power to decide
• 4:16
  closures, A mayor who, if elections succeed, would also be
• 4:22
  a SpaceX employee. Now this election looms over the
• 4:26
  entire issue. Residents living near Starbase,
• 4:29
  many of whom work for SpaceX and reside on company owned land,
• 4:32
  will vote early next month on whether to incorporate the area
• 4:36
  as its own city. And if passed, SpaceX employees
• 4:39
  would fill the first governmental posts, creating an
• 4:42
  arrangement. Many critics say as a classic
• 4:45
  company town, the concern is simple but weighty.
• 4:49
  Turning control of public access over to a private company risks
• 4:55
  eroding rights of Texans, who have fought to preserve this for
• 5:00
  centuries. Activists and environmentalists
• 5:03
  argue the SpaceX expansion of authority could lead to frequent
• 5:07
  unnecessary closures justified under the vague term of Space
• 5:12
  Flight activities, cutting the public off from Boca Chica Beach
• 5:16
  without meaningful oversight. Now, the history of Texans
• 5:20
  rights to coastal access is not a recent one.
• 5:22
  Rob Nixon, an activist with the Surfrider Foundation South Texas
• 5:26
  chapter, explained that the Texas Open Beaches Act draws
• 5:30
  from Justinian law, which is ancient Roman legal principles
• 5:34
  that define beaches as common resources belonging to the
• 5:38
  public. Nixon testified before the Texas
• 5:41
  House State Affairs Committee, warning that these bills
• 5:43
  effectively privatize Boca Chica Beach.
• 5:47
  He said Spacex's history with community negotiations has been
• 5:51
  fraught with unmet promises. Past discussions about
• 5:54
  mitigating access loss, including proposals for a ferry
• 5:58
  service to Isla Blanca Park, never materialized.
• 6:01
  And for many, these broken talks fuel the belief that the company
• 6:05
  sees public access as an obstacle rather than a
• 6:10
  responsibility. Nixon's group argues that once
• 6:13
  SpaceX holds that authority, they will have little incentive
• 6:17
  to consider anybody's needs, especially beachgoers who have
• 6:21
  no stake in the company's success.
• 6:24
  From a legal standpoint, shifting control from the county
• 6:28
  to SpaceX aligned officials raises concerns about the
• 6:31
  erosion of democratic accountability.
• 6:33
  Currently, residents can appeal to their elected county
• 6:36
  representatives when they feel closures are unreasonable, and
• 6:40
  if the bill passes, those complaints would instead go to
• 6:44
  SpaceX company employees wearing government hats, creating a
• 6:48
  potential conflict of interest that is troubling now.

  The bill's supporters argue that streamlining Rd. closures will
• 6:55
  allow for quicker, more efficient operations that better
• 6:58
  serve Space XS economic contributions and national
• 7:01
  security roles. Representative Jamie Lopez
• 7:04
  defended the bill by saying that a more centralized process is
• 7:08
  necessary given the large scale impacts of star bases
• 7:11
  activities. A SpaceX officials maintain that
• 7:15
  the company's work at Bocajaca brings major economic benefits
• 7:18
  to South Texas, including jobs, billions of dollars in revenue,
• 7:22
  increased tourism, and technological prestige.

  They assert that more control over closures is needed to keep
• 7:29
  projects on schedule and ensure public safety during hazardous
• 7:33
  operations. Yet for the public, efficiency
• 7:37
  cannot outweigh transparency and access.
• 7:41
  Protecting beach access is so deeply embedded in Texas culture
• 7:46
  that any perceived threat to it triggers widespread opposition,
• 7:50
  regardless of promises about economic growth or innovation.
• 7:54
  Local environmentalists also pointed to the fragile ecosystem
• 7:57
  at Boca Chica. It creates closures not only bar
• 8:00
  human visitors, but also disturb sensitive wildlife patterns,
• 8:03
  particularly for endangered species like the Kemp Ridley sea
• 8:07
  turtle, which uses the beach for nesting.
• 8:11
  Now the generations of families that spent their time fishing
• 8:15
  and swimming and celebrating and living on Boca Chica sands now
• 8:20
  the potential loss of Open Access is more than an
• 8:23
  inconvenience for them. It's a disruption of cultural
• 8:26
  traditions tied to the very identity of the region and the
• 8:31
  people there, and how quickly public rights can shift from
• 8:37
  when private enterprise and government authority become
• 8:41
  intertwined. SpaceX and the government would
• 8:43
  be one thing at Boca Chica, but once given away, public access
• 8:49
  to spaces like Boca Chica Beach may prove difficult, if not
• 8:53
  impossible, to reclaim. As Texans face the decision of
• 8:57
  whether Star Base become its own municipality, the outcome could
• 9:01
  set a precedent for how other natural treasures across the
• 9:04
  state are treated when commercial interests and money
• 9:09
  and billionaires seek more control.
• 9:13
  And this fight isn't over. If these two bills could hand
• 9:15
  SpaceX the keys to a public resource, a public beach that
• 9:20
  people have been using for centuries.

  This is reshaping access for thousands and raising serious
• 9:27
  concerns about the balance between progress flights to Mars
• 9:32
  and the future of people on Earth.
