- 0:00Speaker 1: What's up, everyone, and welcome back to the program. Day
- 0:04Speaker 1: number 31 of the Chad Daybell trial saw the jury
- 0:08Speaker 1: get their instructions from the court, and now all that's
- 0:11Speaker 1: left to do is wait on a verdict. So let's
- 0:15Speaker 1: dive into day number 31, and let's recap what went down.
- 0:18Speaker 1: This article was published by eastidahonews.com, and the author of
- 0:24Speaker 1: this article is Nate Eaton. 9.49 a.m., in line outside
- 0:29Speaker 1: the courtroom, Inside the Ada County Courthouse, people without tickets
- 0:32Speaker 1: started lining up at 5 a.m. to try to get
- 0:35Speaker 1: into closing arguments. Proceedings begin at 10 a.m. Larry and
- 0:39Speaker 1: Kay Woodcock just walked by and entered the courtroom. Law
- 0:43Speaker 1: enforcement officers from multiple agencies just walked into the courtroom. 9.52 a.m.
- 0:49Speaker 1: Spectators are now seated in the gallery. Idaho Attorney General
- 0:52Speaker 1: Raul Labrador is in the courtroom. Many of the officers
- 0:56Speaker 1: and deputies who testified are here. Chad Daybell is sitting
- 0:59Speaker 1: next to John Pryor at the defense table. Prosecutors are
- 1:03Speaker 1: at their table. Madison County Prosecuting Attorney Rob Wood did
- 1:07Speaker 1: opening statements. My guest is Fremont County Prosecuting Attorney Lindsay
- 1:11Speaker 1: Blake does closing arguments. 9.53 a.m. I'm sitting next to
- 1:16Speaker 1: three jurors from the Lori Vallow trial, Tom Evans, Laura,
- 1:20Speaker 1: who I interviewed a few weeks ago, and another lady
- 1:22Speaker 1: who served on the jury. They have regularly attended Chad
- 1:26Speaker 1: Daybell's trial since it started on April 10th. Jury selection
- 1:30Speaker 1: for this trial began April 1st, over eight weeks ago.
- 1:34Speaker 1: And I'll tell you what, just like with the Lori
- 1:36Speaker 1: Vallow trial, not exactly my idea of fun. So I'll
- 1:40Speaker 1: be very happy when this is over and done with,
- 1:43Speaker 1: and we don't have to talk about Chad Daybell or
- 1:45Speaker 1: Lori Vallow again for quite some time. 9.58 a.m. Over
- 1:50Speaker 1: the past two months, prosecutors called 67 Witnesses six of
- 1:53Speaker 1: whom were recalled to testify again. Defense called 11 witnesses.
- 1:58Speaker 1: Six rebuttal witnesses were called. 10 a.m. Judge Boyce will
- 2:02Speaker 1: read the jury 41 instructions before closing arguments. Last year,
- 2:06Speaker 1: that took around an hour. Prosecution took an hour and
- 2:09Speaker 1: 15 minutes last year for closing. Defense took about an hour.
- 2:13Speaker 1: And then prosecution did a final closing that was around
- 2:16Speaker 1: 20 minutes. 10.02 a.m. Boyce is on the bench. Jurors
- 2:20Speaker 1: are being brought in. 10.05 a.m. Jurors are in their seats.

- 2:30Speaker 1: will have a copy of the instructions. They can follow
- 2:33Speaker 1: along and make notes if they wish while Boyce reads,
- 2:36Speaker 1: but there will be one set of original instructions that
- 2:39Speaker 1: cannot be written on. 10.06 a.m. Instructions 1 through 12
- 2:43Speaker 1: were previously read to jurors. Boyce won't read them all,
- 2:46Speaker 1: but will read a few today. There are 41 total instructions.
- 2:50Speaker 1: Boyce reads instruction number 3. It talks about the crime
- 2:54Speaker 1: of conspiracy and jurors should only consider the evidence against

- 3:03Speaker 1: number five. The state must prove the crimes beyond a

- 8:01Speaker 1: Verdict must be unanimous. 1040 a.m. Arguments and statements of
- 8:06Speaker 1: attorneys are not evidence. If you remember facts differently than
- 8:09Speaker 1: what attorneys say, go with what you remember. Attitude and
- 8:12Speaker 1: conduct at the beginning of deliberations are very important for jurors. 10.42 a.m.
- 8:18Speaker 1: That concludes reading of jury instructions. Lindsey Blake will present
- 8:22Speaker 1: closing arguments. Blake asked to approach. 10.44 a.m. Boyce calls
- 8:28Speaker 1: for a quick recess while the state sets something up
- 8:30Speaker 1: for a closing argument. We'll be right back in 15 minutes.
- 8:33Speaker 1: 11 a.m. Boyce is on the bench and jurors are
- 8:36Speaker 1: in their seats. An easel has been set up in
- 8:39Speaker 1: front of the jury box. 11.02 a.m. Lindsey Blake begins
- 8:43Speaker 1: closing arguments. By playing jail phone calls between Chad and
- 8:46Speaker 1: Lori on June 9th, 2020, the day JJ and Tylee
- 8:50Speaker 1: were found. We see an overhead image of Chad Daybell's property.
- 8:54Speaker 1: Chad says on the call, they are searching the property.
- 8:57Speaker 1: Lori says, the house right now? Chad says, yeah, I'm
- 9:00Speaker 1: at Emma's. 11.04 a.m. We now see photos of JJ, Tylee,
- 9:04Speaker 1: and Tammy on the screen. Blake says this case was
- 9:07Speaker 1: about money, power, and sex. Blake describes how Chad and
- 9:10Speaker 1: Lori met at a conference. Lori was flirting. She came
- 9:13Speaker 1: on to Chad, and Chad was receptive. 11.05 a.m. Blake
- 9:17Speaker 1: says Lori and Chad were both married, and their spouses
- 9:20Speaker 1: were alive and well. But Chad was Googling Lori. Blake
- 9:23Speaker 1: says the jury heard about multiple probations, creations. It was
- 9:28Speaker 1: a way to justify the affair to people around them,
- 9:30Speaker 1: and maybe justify the affair to themselves. And I think
- 9:33Speaker 1: there's a lot of truth in that. Sometimes when you
- 9:37Speaker 1: want to fool yourself, fake yourself out, cognitive dissonance is
- 9:41Speaker 1: certainly the way to go. 11.06 a.m. Because they were
- 9:44Speaker 1: married in previous lives, they said it was okay. Blake says,
- 9:48Speaker 1: Chad was the one teaching. He was the one teaching
- 9:51Speaker 1: these ideas and these concepts. He was sharing them with Lori. 11.07 a.m.
- 9:56Speaker 1: Blake reminds the jury that Chad and Lori went by
- 9:58Speaker 1: different names. James. Elena, Raphael, and Lily. Or Scafusa and Stunad.
- 10:04Speaker 1: Blake shows part of the James and Elena on the screen.
- 10:08Speaker 1: A long-awaited make-out session took place in the lobby. He
- 10:11Speaker 1: resisted an impulse to kiss her, but his entire body
- 10:14Speaker 1: was on fire. Loin fire is used. Really? Loin fire?
- 10:19Speaker 1: Can you imagine these two disgustoids copulating? This was about
- 10:24Speaker 1: the first meeting with Lori. 11.09 a.m. What is this about?
- 10:29Speaker 1: He wants to have sex with her? He had to
- 10:31Speaker 1: wait an entire month to see her? Blake talks about
- 10:34Speaker 1: two positions Chad and Lori liked. This was about sex. 11.10 a.m.
- 10:40Speaker 1: Chad is still married as he's writing the story for Lori.
- 10:43Speaker 1: Blake now shows a slide showing Chad's writing that James
- 10:46Speaker 1: had served in an important position in the Lord's church.
- 10:49Speaker 1: and Elena had been his beloved spouse and best friend.
- 10:53Speaker 1: Chad's the one with information. He's the one with knowledge,
- 10:56Speaker 1: and he's the one who shared it with others. 11.12 a.m.
- 10:59Speaker 1: Blake says, through all the communication and evidence, there was
- 11:03Speaker 1: no indication ever that Chad ever intended to divorce or
- 11:06Speaker 1: separate from Tammy, but he wants to be married to Lori.
- 11:10Speaker 1: They would advance together as translated beings. 11.13 a.m. Blake
- 11:15Speaker 1: shows the drawings Zulima Pastanis made, detailing multiple probations. Zulema
- 11:20Speaker 1: made journal entries about Chad's teachings. The jurors seemed engaged
- 11:24Speaker 1: with Blake, and a couple are writing notes. 11.14 a.m.
- 11:29Speaker 1: Common theme. Chad has the answers. Chad has the knowledge.
- 11:33Speaker 1: Chad has the special ability. Blake says, In early 2019,
- 11:37Speaker 1: Charles is deemed dark. Chad Daybell deemed Charles Vallow dark.
- 11:41Speaker 1: He actually said he was possessed by an entity named
- 11:44Speaker 1: Ned Schneider. Chad was Googling Ned Schneider in early 2019.
- 11:50Speaker 1: All right, we're going to wrap up this first episode
- 11:52Speaker 1: right here. And in the next episode, we're going to
- 11:54Speaker 1: pick up where we left off. All of the information
- 11:57Speaker 1: that goes with this episode can be found in the
- 12:00Speaker 1: description box. What's up, everyone? And welcome back to the program.
- 12:04Speaker 1: This episode, we're getting right back to it with day
- 12:07Speaker 1: number 31 of the Chad Daybell trial. Once again, this
- 12:11Speaker 1: article was published by EastIdahoNews.com. And the author of this
- 12:15Speaker 1: article is Nate Eaton. 1113 a.m. Blake shows the drawings
- 12:20Speaker 1: Zulema Pastanis made detailing multiple probations. Zulema made journal entries
- 12:25Speaker 1: about Chad's teachings. The jurors seem engaged with Blake in
- 12:29Speaker 1: a couple of writing notes. 11.14 a.m. Common theme. Chad
- 12:33Speaker 1: had the answers. Chad had the knowledge. Chad has that
- 12:35Speaker 1: special ability, Blake says. In early 2019, Charles is deemed dark.
- 12:41Speaker 1: Chad Daybell deemed Charles Vallow dark. He actually said he
- 12:44Speaker 1: was possessed by an entity named Ned Schneider. Chad was
- 12:48Speaker 1: Googling Ned Schneider in early 2019. 11.15 a.m. Chad was
- 12:53Speaker 1: sometimes at castings and prayer circles. To find out if
- 12:57Speaker 1: a casting was successful, Laurie would call Chad. Ned was
- 13:00Speaker 1: gone out of Charles after a casting. Chad taught that
- 13:03Speaker 1: if a person was possessed, the body had to die.
- 13:06Speaker 1: In order to set that person free, the body had
- 13:09Speaker 1: to die. 11.16 a.m. Charles confronted Laurie about her affair
- 13:14Speaker 1: with Chad. Around June 29th, 2019, Charles says he's going
- 13:19Speaker 1: to email Tammy, and he does. Charles also emails Chad
- 13:23Speaker 1: about the affair. On July 1st, Charles tells Lori he's
- 13:26Speaker 1: going to meet with Tammy in person. Lori says, she
- 13:29Speaker 1: won't talk to you, she's my friend. Lori and Chad
- 13:32Speaker 1: were in constant communication with burner phones. 11.18am. Ten days
- 13:37Speaker 1: after Charles threatens to go tell Tammy about the affair,
- 13:40Speaker 1: Charles is shot and killed. Charles showed up to take
- 13:43Speaker 1: JJ to school. Instead of taking his son to school,
- 13:46Speaker 1: he wound up dead. Why? Charles was dark. Charles was
- 13:49Speaker 1: a zombie. And if someone is a zombie, if someone
- 13:52Speaker 1: is dark, the body has to die. 11.19 a.m. Zulema
- 13:56Speaker 1: and Alex believe Chad 100%. No signs of grief or
- 14:00Speaker 1: remorse from Lori after Charles died. Chad and Lori were
- 14:03Speaker 1: in constant contact with each other. 11.21 a.m. Blake reminds
- 14:08Speaker 1: the jury that Chad designated Alex as Lori's protector. Alex
- 14:11Speaker 1: relished that role. He relished anything... having a purpose. He
- 14:15Speaker 1: relished being part of it. Zulema asked Lori if Charles
- 14:18Speaker 1: is a zombie, why are you back with him? Lori responded,
- 14:22Speaker 1: I need to get my finances in order. 11.22 a.m.
- 14:26Speaker 1: No remorse or grief after Charles died. Blake shows a
- 14:29Speaker 1: text from Lori to Chad saying it was probably Ned
- 14:32Speaker 1: before we got rid of him, referring to Charles changing
- 14:35Speaker 1: the life insurance policy. Blake emphasizes the we. 11.23 a.m.
- 14:41Speaker 1: Seven days after Charles died, Chad texted Lori saying he
- 14:44Speaker 1: feels extreme changes are coming for me, and I welcome them.
- 14:48Speaker 1: Blake shows more texts between Chad and Lori in July. 11.24 a.m.
- 14:54Speaker 1: Blake references the pain tolerance text Chad sent to Lori
- 14:57Speaker 1: about the children. Do you want me to cause pain
- 15:00Speaker 1: yet to these two threes you're riding with? We'll at
- 15:03Speaker 1: least give them a reason to scream. So all of
- 15:06Speaker 1: this is just bad news for Chad Daybell, right? You're
- 15:09Speaker 1: talking about causing these kids pain? And then they end
- 15:12Speaker 1: up dying? And not only do they end up dying,
- 15:14Speaker 1: they end up being buried in your backyard? Helicopters? Volcanoes?
- 15:20Speaker 1: 1126 AM Blake refers to the text Chad sent Lori
- 15:24Speaker 1: about being Harry Potter under the stairs and feeling trapped
- 15:27Speaker 1: but permanent freedom is coming. Blake talks about Chad and
- 15:30Speaker 1: Lori manipulating each other. 1126 AM Chad manipulated Lori with power.
- 15:36Speaker 1: Lori was frustrated. Her husband's gone. Chad's wife is still alive.
- 15:40Speaker 1: Chad and Tammy have five children. They have a grandchild.
- 15:43Speaker 1: Chad's life is undisturbed, Blake says. 11.28 a.m. Lori manipulates
- 15:49Speaker 1: Chad with sex. From the minute he met her, he
- 15:51Speaker 1: wanted to be with her, and she knew it. A
- 15:54Speaker 1: month after Charles died, Lori texted Chad about a perfectly
- 15:57Speaker 1: orchestrated plan to take the children. Chad responds, there is
- 16:00Speaker 1: a plan being orchestrated for the children. 11.29 a.m. Blake
- 16:05Speaker 1: plays a clip of Lori talking to Chad from jail
- 16:08Speaker 1: on June 8, 2020. The day before the kids were found.
- 16:11Speaker 1: Lori wants reassurance from Chad that things will work out.
- 16:15Speaker 1: Chad responds by saying, there's a marvelous plan and things
- 16:18Speaker 1: will work out. Lori asks Chad how he knows. Chad responds,
- 16:23Speaker 1: it's been shown to me. I've seen beautiful eyes. I've
- 16:26Speaker 1: seen that wonderful body dance to heavenly songs. Your purpose
- 16:29Speaker 1: is only beginning. It's hardly begun. Now, mind you, Lori
- 16:34Speaker 1: Vallow's behind bars at this time. And this clown sitting
- 16:37Speaker 1: here still pumping her tires full of air. 11.31 a.m.
- 16:40Speaker 1: Chad tells Lori some things won't be altered. Lori reaches
- 16:43Speaker 1: out to Chad. She needs affirmations from him, Blake says. 11.32 a.m.
- 16:49Speaker 1: Chad tells Lori on August 10th, 2019, we're so close
- 16:52Speaker 1: to the finish line. Lori texts Alex that they are
- 16:55Speaker 1: close to getting to the bottom of what they need
- 16:58Speaker 1: to do to eliminate zombies. Chad gave the information. 11.34 a.m.
- 17:04Speaker 1: Chad tells Lori he wants to be with her. This
- 17:06Speaker 1: is the greatest hope and dream. Blake shows a timeline
- 17:09Speaker 1: of Tylee Ryan's social security benefits deposit history. 11.35 a.m.
- 17:15Speaker 1: Blake references the blessings Chad gave to Alex and the
- 17:18Speaker 1: fact Alex moved to Rexburg to be with Chad. Blake
- 17:21Speaker 1: says Alex was taught that what he did in this
- 17:24Speaker 1: life didn't matter because he had been exalted in another life. 11.37 a.m.
- 17:29Speaker 1: Lori's connection to Rexburg was Chad Daybell. Before she moved,
- 17:32Speaker 1: Lori switched Tylee's Social Security money to go into an
- 17:35Speaker 1: account only associated with Lori Vallow. This change was made
- 17:39Speaker 1: on August 16, 2019. Lori and the kids moved to
- 17:44Speaker 1: Idaho in early September. Before they moved to Rexburg, Chad
- 17:47Speaker 1: told Lori that JJ and Tylee were both dark. 11.38 a.m.
- 17:52Speaker 1: Blake reminds jurors about Chad texting Lori concerning turning the
- 17:55Speaker 1: pain up to 10 on Tylee. Later, Lori texts Chad,
- 17:59Speaker 1: and asked him to check Tylee because she was being
- 18:01Speaker 1: super sweet. 11.40 a.m. Blake tells the jurors about the
- 18:05Speaker 1: trip Lori, Alex, and the kids took to Yellowstone. That
- 18:09Speaker 1: same day, Chad was looking up south, southwest winds. It
- 18:12Speaker 1: was the last time Tylee was seen alive. 11.42 a.m.
- 18:18Speaker 1: Blake shows Google location history for Alex and tells them
- 18:21Speaker 1: the only time his device was at Lori's apartment in
- 18:24Speaker 1: the early morning hours was on September 9th. Hours later,
- 18:27Speaker 1: Alex went to Chad's property. 11.43 a.m. Blake reminds the
- 18:32Speaker 1: jurors about the raccoon and limb debris burning message sent
- 18:35Speaker 1: to Tammy on Monday, September 9th. Where was Tylee Ryan's
- 18:39Speaker 1: body found? Chad Daybell's Pet Cemetery. Some of the remains
- 18:43Speaker 1: in the fire pit. 11.44 a.m. Blake shows the last
- 18:47Speaker 1: known picture of Tylee on the screen. There is little
- 18:50Speaker 1: movement on the pic. Where was the young lady found?
- 18:53Speaker 1: Chad Daybell's property. Next to the photo is the site
- 18:56Speaker 1: on Chad Daybell's property where Tylee was found. 11.45 a.m.
- 19:01Speaker 1: Blake reminds the jurors about the condition of Tylee's remains
- 19:04Speaker 1: and her DNA being found on a pickaxe and shovel
- 19:07Speaker 1: in Chad's garage. 11.46 a.m. Tylee was now gone, but
- 19:12Speaker 1: JJ was still alive. Zulema visited Lori and asked Lori
- 19:16Speaker 1: where Tylee was. Don't ask, Lori responds. Lori continued to
- 19:20Speaker 1: receive social security payments following Tylee's death. 11.48 a.m. Blake
- 19:26Speaker 1: shows the text message Chad sent to Lori about J.J.
- 19:30Speaker 1: getting close, and more text messages where Chad said J.J.
- 19:33Speaker 1: was at zero. Chad determines the death percentages. When the
- 19:37Speaker 1: death percentage hits zero, that person has been marked for death,
- 19:40Speaker 1: Blake says. 11.49 a.m. Blake talks about the last time J.J.
- 19:44Speaker 1: was seen alive, the night before he died. She recalls
- 19:47Speaker 1: David Warwick's nightmare and how Melanie Gibb tried to get
- 19:50Speaker 1: a hold of Chad or Lori for help, but they
- 19:53Speaker 1: did not respond. Blake shows a picture of JJ in
- 19:57Speaker 1: his red pajamas on the screen next to his burial site.
- 20:00Speaker 1: JJ had been buried with his arms duct taped together,
- 20:03Speaker 1: the duct tape running around from elbow to elbow. He
- 20:06Speaker 1: had duct tape over his mouth, A plastic bag over
- 20:09Speaker 1: his head and taped, wrapped around, Blake says. Chad labeled
- 20:13Speaker 1: them dark. Chad said his death percentage was at zero.
- 20:18Speaker 1: Chad said his plan was for him and Lori to
- 20:20Speaker 1: be together, unencumbered by earthly obstacles. 11.53 a.m. Chad labeled
- 20:25Speaker 1: Lori's children dark. Their bodies were buried on his property,
- 20:29Speaker 1: hidden from those looking for them. With them gone, he
- 20:32Speaker 1: could be with Lori, and knowing if the bodies weren't discovered,
- 20:35Speaker 1: Lori could continue to receive that money, Blake says. 11.55 a.m.
- 20:40Speaker 1: Melanie Pawlowski turned to Chad for guidance and direction. She
- 20:44Speaker 1: turned to him to find out if people were darker light,
- 20:46Speaker 1: Blake says. She reminds the jury about Brandon Boudreau and
- 20:50Speaker 1: him being shot at in Arizona. 11.56 a.m. Blake reminds
- 20:55Speaker 1: the jury about Tammy Daybell traveling to Utah by herself
- 20:58Speaker 1: on October 14th, 2019. She didn't like to drive alone.
- 21:02Speaker 1: Chad was supposed to go with her, but he backed out.
- 21:05Speaker 1: When Tammy went to Utah, Lori told Alex that she
- 21:08Speaker 1: and Chad were finally going to be able to go
- 21:10Speaker 1: on a real date. 11.58 a.m. Samantha Gwilliam, Tammy's sister,
- 21:16Speaker 1: reported Tammy looked just fine when she arrived in Utah.
- 21:19Speaker 1: Tammy put on a clogging routine and visited with her family.
- 21:22Speaker 1: Samantha and her husband Jason had noticed changes with Chad
- 21:26Speaker 1: before this visit. He was distant and Chad was awkward.
- 21:29Speaker 1: 12 p.m. Later, Tammy and Chad visited Samantha's house with
- 21:34Speaker 1: a birthday gift late at night. Chad didn't get out
- 21:36Speaker 1: of the car, which was unusual. Blake shows text messages
- 21:40Speaker 1: from Chad to Lori about death percentages and Tammy being
- 21:43Speaker 1: very close. 12.01 p.m. Blake shows text messages to the
- 21:48Speaker 1: jury from Chad to Lori saying there is big news
- 21:51Speaker 1: about Tammy and Tammy has been switched. 12.02 p.m. Blake
- 21:56Speaker 1: reminds jurors about Alex Cox visiting Sportsman's Warehouse. and the
- 22:00Speaker 1: movements of his device on the night Tammy was shot
- 22:03Speaker 1: at in the driveway. Blake tells jurors multiple searches were
- 22:06Speaker 1: done on the Homer J. Maximus account concerning AR, shooting
- 22:10Speaker 1: through Dodge Dakota, shooting through the windshield, etc. 12.05 p.m.
- 22:15Speaker 1: Blake talks about the casting ceremony on October 9, 2019
- 22:18Speaker 1: at 9.15 p.m. When the group of ladies gathered with
- 22:23Speaker 1: Lori to cast the evil spirit out of Tammy, that
- 22:25Speaker 1: night Lori got a call and was furious. That idiot
- 22:29Speaker 1: can't do anything right. This was the same night Tammy
- 22:32Speaker 1: was shot at in her driveway. 12.08 p.m. Blake goes
- 22:36Speaker 1: through the timeline of the night of the shooting and
- 22:38Speaker 1: Fremont County Deputy Coulter Cannon's report. Cannon wrote that Joseph
- 22:42Speaker 1: Murray heard his mother-in-law scream. Joe then called 911. Tammy
- 22:47Speaker 1: sent an email to Mark on his mission about the incident. 12.09 p.m.
- 22:52Speaker 1: Blake reminds the jury that earlier that day, Alex had
- 22:55Speaker 1: purchased items at the store, including a ski mask, pants, etc.,
- 22:59Speaker 1: The gun misfired and Alex searched online about how to
- 23:02Speaker 1: shoot an AR in the cold. 12.10pm. Tammy was scared.
- 23:06Speaker 1: Tammy sent a Facebook message warning people. In her email
- 23:09Speaker 1: to Mark, Tammy said, The scared part came later when
- 23:13Speaker 1: I realized what could have happened. I didn't want to
- 23:15Speaker 1: go outside again the next night after dark. Tammy had
- 23:18Speaker 1: no idea someone wanted her dead, Blake says. And why
- 23:22Speaker 1: would she know that, right? Regular old lady librarian doing
- 23:25Speaker 1: clogging classes? Who's looking to clip her? Well, Chad Daybell
- 23:29Speaker 1: and Lori Vallow, that's who. 12.12 p.m. Blake shows the
- 23:33Speaker 1: text Chad sent to Lori the day after Tammy died.
- 23:36Speaker 1: I'm feeling sad, but it isn't for the reason everyone thinks.
- 23:40Speaker 1: A photo on the screen showing the bedroom where Tammy
- 23:42Speaker 1: was found dead. 12.13 p.m. Blake plays the 911 call
- 23:46Speaker 1: to Chad crying and saying, oh, oh, she's frozen. The
- 23:49Speaker 1: message to Lori was sent 24 hours later. 12.14pm. Blake
- 23:54Speaker 1: reminds jurors of when Lori was in Hawaii. Alex drove
- 23:58Speaker 1: her to Las Vegas to take her to the airport.
- 24:00Speaker 1: Alex was supposed to go with him, but Alex didn't
- 24:02Speaker 1: go because Chad needed help with something. Tammy was possessed
- 24:06Speaker 1: and her death percentage was low. Alex believed Chad 100%,
- 24:10Speaker 1: Blake says. 12.16pm. Blake walks through the timeline of events
- 24:15Speaker 1: the night Tammy died. She shows a map of the
- 24:18Speaker 1: Google location history of the Homer J. Maximus account. Blake
- 24:21Speaker 1: reminds jurors that Garth Daybell told his friend at work
- 24:25Speaker 1: a conflicting story about finding his mom dead and his
- 24:27Speaker 1: dad was nowhere to be found. 12.18 p.m. Nothing in
- 24:32Speaker 1: Tammy's medical records support low blood pressure, seizures, negative reactions
- 24:36Speaker 1: with homeopathic medicines. Those were statements provided by Chad Daybell,
- 24:41Speaker 1: Blake says. 12.20 p.m. Tammy died on Saturday in Rexburg.
- 24:46Speaker 1: The funeral was held in Springville, Utah on Tuesday. Chad
- 24:49Speaker 1: just wanted to get it over with. Blake says Chad
- 24:52Speaker 1: didn't want his name on the headstone. Chad's talk was
- 24:54Speaker 1: disturbing at the funeral. He spoke about Tammy's depression and
- 24:58Speaker 1: how she's hard to work with. 12.21 p.m. Blake shows
- 25:03Speaker 1: the timeline of text messages between October 18th and 19th, 2019.
- 25:08Speaker 1: We now see an image of Tammy, and next to
- 25:10Speaker 1: her is her casket in the ground. Blake reminds the
- 25:13Speaker 1: jurors about the life insurance policy that was changed before
- 25:16Speaker 1: Tammy died. 12.23 p.m. Days after Tammy's death, Chad went
- 25:21Speaker 1: to visit with Alice and Todd Gilbert. Chad later brought
- 25:24Speaker 1: Lori over to meet his friends. They spoke about their future.
- 25:28Speaker 1: Chad and Lori were asked about kids. Chad responded that
- 25:31Speaker 1: Lori had a daughter who died. Tylee had not been
- 25:34Speaker 1: found yet. 12.25 p.m. Blake's been talking for an hour
- 25:38Speaker 1: and 22 minutes. She shows the wedding photo of Chad
- 25:41Speaker 1: and Lori's wedding rings. One juror appears to be fighting
- 25:44Speaker 1: to stay awake. 12.27 p.m. Blake talks about Rexburg police
- 25:48Speaker 1: responding to Lori's apartment in November of 2019 to do
- 25:52Speaker 1: a welfare check on JJ. Blake shows a clip of
- 25:55Speaker 1: Lori telling the officers that JJ was with Melanie Gibb
- 25:58Speaker 1: in Arizona and they were going to Frozen 2. 12.28 p.m.
- 26:03Speaker 1: The police body camera footage is being shown of Lori
- 26:06Speaker 1: telling police that Alex is her protector and everyone is
- 26:09Speaker 1: causing her trouble. Lori says her daughter is going to BYU, I,
- 26:14Speaker 1: and Chad is her brother's friend. 12.30 p.m. Blake plays
- 26:18Speaker 1: the phone call Melanie Gibb made to Chad and Lori
- 26:21Speaker 1: where she confronted them about the whereabouts of JJ. Lori
- 26:24Speaker 1: told Melanie she didn't want anyone to know so JJ
- 26:27Speaker 1: can be safe. 12.32 p.m. Blake reminds the jury how
- 26:31Speaker 1: JJ was found, discarded, in Chad's backyard. Blake plays the
- 26:36Speaker 1: call from Jason William about the kids. Lori tells Jason
- 26:39Speaker 1: a bunch of people are starting trouble for no reason. 12.33 p.m.
- 26:44Speaker 1: Blake tells jurors that Chad determined death percentages, who was possessed,
- 26:48Speaker 1: and when people were possessed, they had to die. She
- 26:51Speaker 1: plays a clip of Jason talking to Chad and Lori. 12.36 p.m.
- 26:56Speaker 1: Blake reminds the jurors about calls that Ian recorded. Chad
- 26:59Speaker 1: and Lori told Ian and Melanie that some disciples were dark.
- 27:04Speaker 1: Blake shows more text messages between Lori to Chad. 12.37 p.m.
- 27:09Speaker 1: We see the photos of Chad and Alex standing next
- 27:11Speaker 1: to pictures of Jesus Christ. Blake plays part of the
- 27:14Speaker 1: patriarchal blessing Chad gave to Alex, with Chad telling Alex
- 27:18Speaker 1: that he is his sister's protector. 12.39 p.m. Blake tells
- 27:22Speaker 1: the jury that Chad was a self-appointed leader of the
- 27:25Speaker 1: Church of the Firstborn. She plays the clip of the
- 27:27Speaker 1: blessings where Chad tells Alex he could never be repaid
- 27:31Speaker 1: for all he has done for them. Chad tells Alex
- 27:33Speaker 1: he will begin his terrestrial phase of his existence and
- 27:37Speaker 1: will move forward as a true warrior. 12.42 p.m. Blake
- 27:41Speaker 1: explains how the experts reach their conclusions on determining Tammy's
- 27:45Speaker 1: cause of death and manner of death. Chad told people
- 27:48Speaker 1: different things regarding Tammy's death. Blake shows Chad inconsistent statements
- 27:53Speaker 1: regarding the death on the screen. 12.45 p.m. Blake says
- 27:57Speaker 1: once the kids and Tammy were gone, Chad and Lori
- 27:59Speaker 1: could have power, money, and sex. Chad and Lori never
- 28:02Speaker 1: came forward with information on the whereabouts of the kids.
- 28:07Speaker 1: 1247 p.m. Blake shows the last photo, Tylee and JJ.
- 28:10Speaker 1: It's next to another photo showing the burial site of Tylee.
- 28:13Speaker 1: Tylee had a whole life ahead of herself, Blake says.
- 28:16Speaker 1: She shows a picture of JJ, and next to the
- 28:19Speaker 1: picture is his burial site. 1249 p.m. Blake reminds the
- 28:23Speaker 1: jurors what a conspiracy is, an agreement between two or
- 28:26Speaker 1: more persons to commit a crime. Only one of those
- 28:29Speaker 1: persons has to commit an overt act. 12.51 p.m. Blake
- 28:34Speaker 1: lists several of the overt acts committed by Lori. Blake
- 28:37Speaker 1: says Lori and Chad used religious beliefs to justify their actions.
- 28:42Speaker 1: Blake reminds jurors about burner phones, text messages, Chad increasing
- 28:45Speaker 1: life insurance, firearms, and more. 12.55 p.m. Blake tells the
- 28:50Speaker 1: jury all Chad had to do was advise, encourage, plan
- 28:53Speaker 1: the murder to be found guilty of the murder charge.
- 28:56Speaker 1: Blake shows photos of Tylee, JJ, and Tammy on the screen.
- 29:00Speaker 1: She says they all became dark. And we know what happened. 12.57 p.m.
- 29:05Speaker 1: All three victims gone too soon. Blake's final words. Total time,
- 29:09Speaker 1: one hour, 54 minutes. Boyce says we are recessing for lunch.
- 29:14Speaker 1: Be back with the defense closings at 2 p.m. All right,
- 29:18Speaker 1: so we're going to wrap up here. And in the
- 29:19Speaker 1: next episode, we're going to finish off day number 31
- 29:23Speaker 1: of the Chad Daybell trial. All the information that goes
- 29:26Speaker 1: with this episode can be found in the description box.
- 29:30Speaker 1: What's up everyone and welcome back to the program. This
- 29:33Speaker 1: episode we're going to finish off day number 31 of
- 29:36Speaker 1: the Chad Daybell trial. And to do that, once again,
- 29:40Speaker 1: we're using eastidahonews.com, and the author of this article is
- 29:44Speaker 1: Nate Eaton. 1.56 p.m. Back in the courtroom after lunch,
- 29:48Speaker 1: Chad Daybell just walked in. He has an ankle monitor
- 29:52Speaker 1: on his leg. He is sitting next to John Pryor.
- 29:54Speaker 1: Prosecutors are at their table. There is nobody in the
- 29:57Speaker 1: gallery in support of Chad. Larry and Kay Woodcock are
- 30:00Speaker 1: in the courtroom. 2.01 p.m. Voices on the bench. Jurors
- 30:04Speaker 1: are being brought into the courtroom. 2.02 p.m. Jurors have
- 30:08Speaker 1: been seated. Defense attorney John Pryor will begin his closing argument. 2.04 p.m.
- 30:15Speaker 1: Pryor says he has 15 slides and won't be too long.
- 30:19Speaker 1: I promise you this isn't going to take two hours,
- 30:21Speaker 1: he says. The first slide says a criminal case is
- 30:25Speaker 1: like a chain. Each link represents an aspect of the case. 2.05 p.m.
- 30:30Speaker 1: Pryor reminds the jury the entire burden is on the state,
- 30:34Speaker 1: and the state must prove every element beyond a reasonable doubt.
- 30:37Speaker 1: He says the state must prove that there was an
- 30:40Speaker 1: agreement between the co-conspirators. The state has to prove that
- 30:43Speaker 1: Chad Daybell was with Lori Vallow, Alex Cox, or other co-conspirators,
- 30:48Speaker 1: and they entered into some sort of an agreement to
- 30:50Speaker 1: kill the children and to kill Tammy Daybell. Well, yeah,
- 30:54Speaker 1: that's the exact argument that's been made, and that's the
- 30:57Speaker 1: evidence that's been shown. And I don't think anyone who's
- 31:00Speaker 1: even halfway reasonable could look at the evidence, hear the evidence,
- 31:04Speaker 1: and not realize that Chad Daybell is guilty of conspiracy.
- 31:08Speaker 1: Because that's exactly what the evidence has shown us. 2.07 p.m.
- 31:12Speaker 1: Pryor talks about the crime of conspiracy. It can't be
- 31:16Speaker 1: an agreement that we have consistent religious beliefs, Pryor says.
- 31:19Speaker 1: The extra step in the agreement has to be we're
- 31:22Speaker 1: going to kill these children. We're going to agree to
- 31:24Speaker 1: kill Tammy Daybell, Pryor explains. You can hear all the
- 31:28Speaker 1: testimony in the world about dark spirits, light and dark,
- 31:31Speaker 1: death percentages. And then Pryor reminds the jury about text
- 31:35Speaker 1: messages between Chad and Tammy about death percentages. 2.09 p.m.
- 31:40Speaker 1: Pryor says there was an enormous amount of evidence here.
- 31:43Speaker 1: He references his expert and the six terabytes of information
- 31:47Speaker 1: he references. Pryor says you've been shown a handful of
- 31:49Speaker 1: messages and there were thousands and thousands of other messages
- 31:53Speaker 1: that talked about religious beliefs and other topics. 2.10pm. Pryor
- 31:57Speaker 1: says text messages are often misconstrued. At no time did
- 32:01Speaker 1: the prosecutor show you a text message that said, let's
- 32:04Speaker 1: kill the kids. Let's kill Tammy. Pryor calls Chad a
- 32:07Speaker 1: gatherer of the 144,000, and he wanted to gather people.
- 32:12Speaker 1: The sick, the elderly, the children, the impoverished, those that
- 32:15Speaker 1: can't handle for themselves. Oh yeah, a modern day Jesus
- 32:19Speaker 1: fucking Christ. Is that really what you're trying to pitch us, Mr. Pryor?
- 32:24Speaker 1: Because I'm not buying it, nobody who's listening is buying it,
- 32:27Speaker 1: and the jury is not buying it. 2.12pm. Pryor says
- 32:31Speaker 1: it doesn't matter if you agree with Chad. Death percentages,
- 32:35Speaker 1: light and dark, it doesn't matter. Chad's entitled to his beliefs.
- 32:38Speaker 1: Pryor says everybody has beliefs and they aren't all rational. Yeah, well,
- 32:42Speaker 1: we all don't kill kids. We all don't kill our wives.
- 32:45Speaker 1: And we all don't run away to Hawaii to be
- 32:47Speaker 1: with our skafooza. 2.13pm Pryor says for years Chad was
- 32:51Speaker 1: writing books about things he was passionate about. He became
- 32:55Speaker 1: a little bit of a celebrity. Pryor says he doesn't
- 32:57Speaker 1: want to become a celebrity. He's had enough at this point.
- 33:01Speaker 1: Chad went to the conferences and talked about his premonitions
- 33:04Speaker 1: and things that he could predict. 2.15pm You don't get
- 33:09Speaker 1: to the overt acts. You don't get to all of
- 33:11Speaker 1: the things the prosecutor has said about all the things
- 33:14Speaker 1: these people have done. until you establish that Chad Daybell,
- 33:17Speaker 1: by evidence and testimony, has shown there has been an
- 33:20Speaker 1: agreement between him, Lori, him and Alex, or anyone else,
- 33:23Speaker 1: Pryor says. Well, that's what the evidence has shown us.
- 33:27Speaker 1: Is this guy for real right now? And then he's
- 33:29Speaker 1: going to try and frame it like Chad's being targeted
- 33:32Speaker 1: because of his goofy beliefs. Yeah, okay, sure. That's exactly
- 33:35Speaker 1: what's going on here. 2.16 p.m. Pryor says Chad had
- 33:40Speaker 1: traditional Mormon beliefs, and it's not a crime if you
- 33:42Speaker 1: have beliefs. Sure, you can believe whatever you want, but
- 33:45Speaker 1: if you act out on those beliefs, there's repercussions. 2.17 p.m.
- 33:50Speaker 1: Pryor points to the prosecution and says they have not
- 33:53Speaker 1: established an agreement. Pryor says Chad espoused religious beliefs, but
- 33:58Speaker 1: there was no argument between Chad and the co-conspirators. Unless
- 34:01Speaker 1: there's an agreement to commit a crime, you can talk
- 34:05Speaker 1: all day long about your religious beliefs. 2.19 p.m. Pryor
- 34:09Speaker 1: talks about the Googling of the South Southwest winds the
- 34:12Speaker 1: day before Tylee was buried And says Emma Murray testified
- 34:15Speaker 1: she Googled it, not Chad. Well, we don't believe Emma.
- 34:19Speaker 1: How about that? I said before I think she impeached herself.
- 34:22Speaker 1: So what do you even mean right now? Talk about
- 34:24Speaker 1: an unreliable narrator. Pryor reminds the jury that he called
- 34:28Speaker 1: Officer Duncan from Arizona to the stand. Duncan said the
- 34:31Speaker 1: prosecutor in Arizona says there was no reasonable likelihood of
- 34:35Speaker 1: conviction for Chad Daybell and Charles Vallow's homicide. Oh, well,
- 34:38Speaker 1: isn't that nice? 221 p.m. Pryor says all Chad did
- 34:43Speaker 1: before the attempted shooting of Brandon Boudreau was Chad carrying
- 34:47Speaker 1: a Jeep tire and that he isn't connected to the shooting. Fact,
- 34:51Speaker 1: Chad Daybell was not invited with Charles Vallow. Fact, Chad
- 34:54Speaker 1: Daybell was not implicated with Brandon Boudreau. Fact, Chad Daybell
- 34:58Speaker 1: espoused religious beliefs. Where is the agreement? Where is the agreement?
- 35:02Speaker 1: It's not there. 2.23 p.m. Pryor, we don't speculate. We
- 35:07Speaker 1: do not engage in conjecture. We do not guess facts
- 35:10Speaker 1: and evidence. Facts and evidence. 2.24 p.m. Pryor tells the
- 35:17Speaker 1: jury to remember the judge's instructions, rely on their memory,
- 35:20Speaker 1: not on what the lawyers say. If they say something
- 35:23Speaker 1: different than what you remember, you rely on your notes.
- 35:26Speaker 1: You rely on your memory, Pryor says, pointing to the prosecutors. 2.25 p.m.
- 35:32Speaker 1: Pryor reminds the jury the defendant never has to prove
- 35:35Speaker 1: his innocence and he does not have to speak. They
- 35:38Speaker 1: have the burden to prove there was an agreement. They
- 35:40Speaker 1: have the duty to prove Chad in some way was
- 35:43Speaker 1: involved in the murder, Pryor says, referring to the prosecutors. 2.26 p.m.
- 35:48Speaker 1: Pryor explains juror instruction number five, reasonable doubt. He tells
- 35:52Speaker 1: the jurors if they don't know which way this is
- 35:55Speaker 1: supposed to go, the verdict is not guilty. And under
- 35:58Speaker 1: our system of justice, it has to be not guilty.
- 36:02Speaker 1: Pryor references the teachers and principal and everyone else who
- 36:05Speaker 1: was dragged in to testify about Tammy's health. He tells
- 36:09Speaker 1: the jury to use common sense. 2.29 p.m. If you
- 36:13Speaker 1: have doubt about what happened here, the verdict has to
- 36:15Speaker 1: be not guilty. That's what the law says, Pryor says. 2.30 p.m.
- 36:20Speaker 1: There has not been any evidence saying we're going to
- 36:23Speaker 1: kill the kids. We're going to kill Tammy, Pryor says.
- 36:26Speaker 1: There was talk about a plan, 144,000 building a village
- 36:30Speaker 1: for the sick, etc. It wasn't a plan to kill folks.
- 36:33Speaker 1: It was a plan to gather by a traditional Mormon. 2.32 p.m.
- 36:38Speaker 1: Pryor talks about jury instruction number 8 and 18. He
- 36:42Speaker 1: points to the last sentence of number 18. Mere presence at,
- 36:46Speaker 1: acquiescence in, or silent consent to the planning and commission
- 36:50Speaker 1: of a crime is not sufficient to make one an accomplice.
- 36:53Speaker 1: Pryor reminds the jury there has to be an agreement. 2.35 p.m.
- 36:58Speaker 1: Pryor tells jurors to listen to the testimony of Jason
- 37:01Speaker 1: William and the call he recorded between him, Chad, and Lori.
- 37:05Speaker 1: Lori told Jason to refer... Law enforcement to their family attorney. 2.36 p.m.
- 37:10Speaker 1: Chad didn't know where the kids were. Chad didn't know
- 37:13Speaker 1: where the kids were until that faithful day on June
- 37:16Speaker 1: 9th when the kids were found on his property, Pryor says.
- 37:19Speaker 1: Pryor says Lori Vallow was selling the plan that the
- 37:21Speaker 1: kids were fine and nobody else knew where they were.
- 37:25Speaker 1: That was the dupe on Chad Daybell. The kids were fine.
- 37:28Speaker 1: It's all going to be cleared up. So they did
- 37:30Speaker 1: throw Lori under the bus here at the end. I
- 37:33Speaker 1: was waiting for that to happen. and they were doing
- 37:35Speaker 1: it a little bit throughout the trial, but here, they're
- 37:38Speaker 1: throwing her directly under the bus and saying it was
- 37:41Speaker 1: all Lori Vallow. Guess what? Not gonna work. 2.37 p.m.
- 37:46Speaker 1: Pryor apologizes that he's running long. I didn't mean to
- 37:49Speaker 1: go on this long, he says. Pryor references the police
- 37:52Speaker 1: body camera footage with Detective Ron Ball in November of 2019,
- 37:57Speaker 1: where Lori says she's planning to move in with her
- 37:59Speaker 1: friend Melanie Gibb. 2.40 p.m. Pryor, again, says there was
- 38:04Speaker 1: no agreement between Chad and the co-conspirators. 2.42 p.m. Pryor
- 38:09Speaker 1: shows a slide displaying jury instruction number 20. It talks
- 38:12Speaker 1: about the crime of conspiracy and there needing to be
- 38:15Speaker 1: an agreement. Pryor wants to talk about two exhibits. The
- 38:18Speaker 1: first picture is of the tools in the garage. Pryor
- 38:21Speaker 1: says the first picture of the shovel shows there aren't
- 38:24Speaker 1: any scuff marks. He says the second picture, taken later
- 38:27Speaker 1: in the day, shows scuff marks. 2.45 p.m. Pryor refers
- 38:31Speaker 1: to Officer Schmidt's testimony. Grab some shovels and start digging.
- 38:35Speaker 1: How do we know he's telling the truth? Pryor tells
- 38:38Speaker 1: jurors to review the pictures of the shovels and says
- 38:41Speaker 1: the police used Chad Daybell's shovels while they were looking
- 38:43Speaker 1: for Tylee and JJ. Magically, we get a pickaxe and
- 38:47Speaker 1: another shovel, and guess what? Surprisingly, of the 18 tools,
- 38:51Speaker 1: not a drop of DNA of Chad Daybell is on
- 38:53Speaker 1: any of the tools. Well, that's because he coerced Alex
- 38:57Speaker 1: Cox into doing his killing. It's no different than if
- 39:01Speaker 1: a mafia boss sends a hitman to go kill someone, right?
- 39:05Speaker 1: They conspired to murder insert person here. And if you're
- 39:09Speaker 1: involved in that and you're the one giving the orders,
- 39:11Speaker 1: my friend, you're just as guilty. 2.46 p.m. Pryor talks
- 39:16Speaker 1: about motive and says Alex Cox shot Charles Vallow. He
- 39:19Speaker 1: says there were two expendable people who witnessed the murder
- 39:22Speaker 1: of Charles Vallow, Tylee Ryan and J.J. Vallow. They became
- 39:26Speaker 1: expendable because the one thing they could cause Alex Cox
- 39:29Speaker 1: to spend the rest of his life or far worse
- 39:31Speaker 1: in Arizona is a 16-year-old girl and an autistic 7-year-old
- 39:35Speaker 1: little boy. Chad Daybell was not charged in that crime. 2.48 p.m.
- 39:41Speaker 1: Pryor says Lori Vallow cared about money, Lori Vallow and
- 39:43Speaker 1: Alex Cox. He talks about Lori trying to get her
- 39:46Speaker 1: greedy hands on money. And the next victim, husband number five,
- 39:50Speaker 1: referring to Chad Daybell. Just get insurance. Just say it's
- 39:54Speaker 1: me and you. Pryor says Chad usually drove the Dodge
- 39:57Speaker 1: Dakota and the target of the gunman was not Tammy Daybell.
- 40:00Speaker 1: He was the target, pointing at Chad. Wow, that is something, huh?
- 40:05Speaker 1: Pryor really going for the gusto here and going for broke.
- 40:08Speaker 1: So Chad Daybell's the victim in this whole story? Okay,
- 40:12Speaker 1: I'm sure the jury's gonna love that. 2.51 p.m. Alex
- 40:15Speaker 1: Cox had motive. Alex Cox would be either spending the
- 40:19Speaker 1: rest of his life in prison or far worse, fade
- 40:21Speaker 1: if JJ or Tylee opened their mouth and said anything,
- 40:24Speaker 1: Pryor says. 2.53 p.m. Pryor says Dr. Christensen, the man
- 40:30Speaker 1: who did the autopsy on Tammy in Utah, never called
- 40:33Speaker 1: Chad and Tammy's kids. Pryor talks about confirmation bias and
- 40:37Speaker 1: all in the audience with the suits referring to the police.
- 40:40Speaker 1: That's exactly what they did. Pryor says Melanie Gibb and
- 40:43Speaker 1: David Warwick were ignored. They did nothing. Referring to the
- 40:46Speaker 1: police not investigating Gibb and Warwick. 2.55 p.m. Pryor says
- 40:51Speaker 1: Melanie Gibb was trying to cover her tracks and all
- 40:54Speaker 1: these religious teachings came from Melanie Gibb. He references how
- 40:58Speaker 1: Chad's phone had zero location data. 2.58 p.m. Pryor talks
- 41:02Speaker 1: about September 9th. The same cast of characters, same people.
- 41:06Speaker 1: Alex Cox, Lori Vallow, Tylee Ryan. Pryor references the raccoon text.
- 41:11Speaker 1: and how there was no location to show where Chad was.
- 41:15Speaker 1: Earlier in the day, yeah, he shot a raccoon. Then
- 41:18Speaker 1: he started a small fire and burned some limbs. We
- 41:21Speaker 1: know he shot a raccoon, Pryor says. Referring to Reagan
- 41:24Speaker 1: Price's testimony, a neighbor, the earlier that morning, she heard
- 41:27Speaker 1: a gunshot. 3 p.m. Pryor mentions Dr. Bartolink's testimony, the
- 41:32Speaker 1: guy who researched how much it takes to burn a body.
- 41:35Speaker 1: Where was the bonfire on September 9th? There was no bonfire.
- 41:39Speaker 1: It wasn't there. I can't prove to you where Alex
- 41:41Speaker 1: Cox burned the body, but the body was burned as
- 41:44Speaker 1: a whole, Pryor says. 3.02 p.m. You can't say the
- 41:48Speaker 1: police didn't try. They brought out a bulldozer. They made
- 41:51Speaker 1: an effort to find whatever they could find, but they
- 41:55Speaker 1: couldn't find all the pieces. The question remains is this.
- 41:58Speaker 1: If Alex Cox put the body in the ground and
- 42:00Speaker 1: put Quikrete to cover up the burial, when did the
- 42:03Speaker 1: carnivore bite take place? When did we get the carnivore
- 42:06Speaker 1: bite if Alex Cox took the body directly from his apartment?
- 42:10Speaker 1: brought it to Chad's like they're suggesting, threw it in
- 42:12Speaker 1: the ground. When did the carnivore bite take place? Pryor
- 42:16Speaker 1: says Alex Cox murdered Tylee Ryan and Lori Vallow knew
- 42:19Speaker 1: what was going on. Yeah, so did Chad Daybell. He
- 42:21Speaker 1: was in on it, stupid. 3.04 p.m. Pryor says Alex
- 42:26Speaker 1: burned Tylee's body somewhere in Fremont or Madison County and
- 42:29Speaker 1: then put it in the ground. He says Lori's intent
- 42:32Speaker 1: was to finish off husband number five. Pryor says, pointing
- 42:35Speaker 1: to Chad, and then says Lori tried to set Chad up.
- 42:38Speaker 1: Alex Cox is a murderer, and he is not shy
- 42:41Speaker 1: about shooting people. He shot at Brandon Boudreau, he murdered
- 42:44Speaker 1: Charles Vallow, and Chad Daybell was next. 3.07 p.m. Pryor
- 42:49Speaker 1: says Alex was going to kill Chad next. He refers
- 42:52Speaker 1: to text messages between Melanie Gibb and Rod Wood, including
- 42:56Speaker 1: one exchange Melanie Gibb had with Keith Morrison about Melanie's
- 43:00Speaker 1: intent to protect the church. Why is Melanie Gibb telling
- 43:03Speaker 1: a prosecutor in a criminal case that we need to
- 43:06Speaker 1: protect the church, Pryor says? 3.09 p.m. Pryor lists people
- 43:10Speaker 1: who Chad said were dark. Heather Daybell, Detective Hermosillo, Samantha Gwilliam.
- 43:15Speaker 1: They were all dark, but they're not dead. Chad was
- 43:17Speaker 1: the target. This author writes and talks about uncomfortable things.
- 43:21Speaker 1: But he has every right to talk about it, and
- 43:23Speaker 1: you cannot hold it against him because you don't like
- 43:25Speaker 1: the topic. So much for not going long, huh? So,
- 43:29Speaker 1: stupid-ass Pryor here tries to, you know, get a shot
- 43:33Speaker 1: in at the prosecution in the beginning. Oh, well, I'm
- 43:35Speaker 1: not going to take this long time that the prosecution took, blah, blah, blah. Meanwhile,
- 43:39Speaker 1: here he is rambling on about a bunch of bullshit. 3.11 p.m.
- 43:44Speaker 1: Pryor lists his experts on the screen. Dr. Raven, Dr. Bartolink,
- 43:48Speaker 1: Patrick Eller, and Dr. Hampikian. 3.13 p.m. Pryor talks with
- 43:53Speaker 1: the jury about Dark and Light, cashing, and Chad being
- 43:56Speaker 1: a traditional Mormon. Pryor says Chad can go off into
- 44:00Speaker 1: a 35 or 40 minute patriarchal prayer and still don't
- 44:03Speaker 1: even know what he's talking about. Chad smiles and shakes
- 44:05Speaker 1: his head. 3.15pm. Pryor tells the jury that silence cannot
- 44:09Speaker 1: be used against Chad. You can't do that. If he
- 44:12Speaker 1: chooses not to talk, you can't even consider that, Pryor says. 3.17pm.
- 44:18Speaker 1: Pryor wants to talk about Tammy and the Fitbit. You
- 44:21Speaker 1: heard from Emma and Garth that their mother wasn't doing
- 44:23Speaker 1: that great. Pryor tells the jury they can't speculate about
- 44:26Speaker 1: Tammy's health. 3.19pm, Pryor says Melanie Gibb waited 10 days
- 44:32Speaker 1: to tell the police that she knew where JJ was.
- 44:35Speaker 1: He calls Zulema Pastanis another complainer, married to the murderer
- 44:39Speaker 1: of JJ Vallow, married to the murderer of Tylee Ryan,
- 44:42Speaker 1: married to the murderer of Charles Vallow, and married to
- 44:45Speaker 1: the attempted murderer of Brandon Boudreau. Well, all that's true,
- 44:48Speaker 1: because Alex Cox is a dirtbag scumbag son of a bitch.
- 44:52Speaker 1: And I've told you since the very beginning that he's
- 44:54Speaker 1: the one that actually did the wet work. 3.22 p.m.
- 44:58Speaker 1: Pryor says, Tammy got the bruises on her arms and
- 45:00Speaker 1: chest from carrying books at the book fair. There was
- 45:03Speaker 1: no asphyxiation here. This was not a homicide. 3.23 p.m.
- 45:08Speaker 1: These officers failed this investigation. They absolutely failed in their
- 45:11Speaker 1: investigation looking up the facts of this case. If there
- 45:15Speaker 1: is reasonable doubt, and there is reasonable doubt, you must
- 45:18Speaker 1: return a verdict of not guilty. I'm respectfully asking all
- 45:22Speaker 1: of you to return a verdict of not guilty. Prior
- 45:25Speaker 1: as done, his total time was an hour and 19 minutes. 3.25 p.m.
- 45:31Speaker 1: We're taking a 15-minute recess before Lindsay Blake does rebuttal,
- 45:34Speaker 1: closing arguments. 3.49 p.m. Back in the courtroom. Boyce is
- 45:39Speaker 1: on the bench and the jurors are being brought in. 3.50 p.m.
- 45:42Speaker 1: Lindsay Blake will offer a rebuttal. She begins by talking
- 45:46Speaker 1: about jury instructions. Instruction number 18, aiding and abetting is defined.
- 45:51Speaker 1: as before or during the commission, intentionally aiding, assisting, encouraging, counseling, inviting, helping,
- 45:57Speaker 1: or hiring another to commit a crime. If you find
- 46:00Speaker 1: any of those acts occurred, when we are talking about
- 46:03Speaker 1: first degree and conspiracy, you don't have to find the
- 46:06Speaker 1: defendant actually committed the physical act to end someone's life.
- 46:10Speaker 1: You have to find that the defendant did one of
- 46:12Speaker 1: those things. 3.53 p.m. The state absolutely recognizes we have
- 46:18Speaker 1: the burden of proof in this case. We told you
- 46:21Speaker 1: that in the beginning. We're not shying away from that.
- 46:23Speaker 1: It's our burden, Blake says. 3.55 p.m. Blake says a
- 46:27Speaker 1: conspiracy requires a plan to commit a crime, and one
- 46:31Speaker 1: of the actors commits one overt act. Not every actor
- 46:34Speaker 1: needs to commit the act, and not every act has
- 46:37Speaker 1: to be committed. 3.54 p.m. Conspirators need not agree on
- 46:41Speaker 1: every detail. The agreement may be established in any manner
- 46:45Speaker 1: sufficient to show an understanding with the parties, Blake says,
- 46:48Speaker 1: reading from the rules. 3.55 p.m. Blake says there doesn't
- 46:52Speaker 1: have to be a written agreement. It can be implied. 3.57 p.m.
- 46:57Speaker 1: Blake mentions Detective Mattingly trying to show autopsy results to
- 47:00Speaker 1: Emma Daybell Murray. He told her she didn't have to
- 47:03Speaker 1: do an interview. They could just show him to her. 3.58 p.m.
- 47:07Speaker 1: Blake reminds the jury of Jason William testifying that Chad
- 47:10Speaker 1: told him, my kids know how to keep a secret. 3.59 p.m.
- 47:16Speaker 1: Blake talks about Chad not facing charges. In relation to
- 47:19Speaker 1: Brandon Boudreau and Charles Vallow, Blake says he's not on
- 47:22Speaker 1: trial for those crimes, but Brandon and Charles were both
- 47:24Speaker 1: labeled dark by Chad. 4 p.m. Lori and Alex weren't
- 47:28Speaker 1: the ones labeling people dark in the messages. Lori and
- 47:32Speaker 1: Alex weren't the ones assigning death percentages, Blake says. Chad was. 4.04 p.m.
- 47:37Speaker 1: Blake reminds jurors about Chad Daybell's house having an upstairs
- 47:41Speaker 1: and the recording of Chad and Emma chatting with each
- 47:43Speaker 1: other when he was in the backseat of a police
- 47:46Speaker 1: car on June 9th. Blake says Alex isn't just on
- 47:49Speaker 1: the property the day JJ was buried. He was in
- 47:52Speaker 1: the actual spot where JJ was buried. 4.07 p.m. Blake
- 47:55Speaker 1: reminds the jury of the recordings Ian Polowski made with
- 47:58Speaker 1: his new wife, Lori and Chad. On one of the recordings,
- 48:02Speaker 1: they're upset that Melanie Gibb is going to police. 4.09 p.m.
- 48:06Speaker 1: Blake reminds JJ and Tylee were both last seen after
- 48:10Speaker 1: it was confirmed that Lori was receiving their Social Security payments.
- 48:13Speaker 1: Chad's the one who determined someone was dark. Chad's the
- 48:16Speaker 1: one who determined death percentages. The kids were buried on
- 48:19Speaker 1: Chad's property. 4.10 p.m. Blake says there were never any
- 48:24Speaker 1: reports made to the sheriff's office that Chad was afraid
- 48:27Speaker 1: of Alex Cox. After Alex Cox shot Chad, Chad was
- 48:31Speaker 1: back in Arizona visiting with Alex and Lori. Chad gave
- 48:34Speaker 1: Alex a blessing. 4.13 p.m. Blake reminds the jury that
- 48:37Speaker 1: Emma testified. Her dad told her the kids were safe.
- 48:41Speaker 1: He tells the jury that Dr. Raven, the defense expert,
- 48:44Speaker 1: didn't review medical records or other records while the state's
- 48:47Speaker 1: witnesses reviewed records. 4.15 p.m. Blake reminds jurors that for conspiracy,
- 48:52Speaker 1: there is no requirement that the defendant committed a physical
- 48:56Speaker 1: act to end the life. 4.18 p.m. Blake tells the
- 48:59Speaker 1: jurors law enforcement did not have on blinders. They went
- 49:02Speaker 1: where the evidence led and followed up on lots of tips.
- 49:05Speaker 1: The kids were found dead in his yard and Tammy
- 49:08Speaker 1: was found dead in the house. You go where the
- 49:10Speaker 1: evidence leads. 4.18 p.m. People that Chad labeled zombies were obstacles,
- 49:15Speaker 1: Blake says. The people he could get financial gain from
- 49:19Speaker 1: would die. Zombies is designated by Chad. Blake references the
- 49:23Speaker 1: messages Pryor referred to and says they're messages that resulted
- 49:27Speaker 1: in three people dying. 4.20 p.m. Blake shows a text
- 49:31Speaker 1: message between Chad and Lori on the screen where Chad
- 49:34Speaker 1: said relatives were obstacles. 4.23 p.m. Blake plays part of
- 49:38Speaker 1: the patriarchal blessing Chad gave to Alex. Alex had already
- 49:41Speaker 1: helped him in ways they could never repay. Blake emphasizes
- 49:45Speaker 1: after she stops playing. 4.24 p.m. Chad says who's dark.
- 49:49Speaker 1: Chad says whose death percentages are what and three bodies
- 49:52Speaker 1: are located on his property. Three obstacles that were in
- 49:55Speaker 1: their way, Blake says. She then plays a clip of
- 49:58Speaker 1: Chad in the backseat of the police car where he says,
- 50:00Speaker 1: I'm not coming back. 4.25 p.m. The recording was made
- 50:04Speaker 1: on the same day Tylee and JJ were found on
- 50:06Speaker 1: the property. I ask you to hold the state to
- 50:09Speaker 1: our burden. Review the jury instructions. Apply common sense. Review
- 50:13Speaker 1: the testimony and evidence. Thank you. Total time of rebuttal
- 50:16Speaker 1: was 35 minutes. 4.26 p.m. Boyce will now draw numbers
- 50:21Speaker 1: of the alternate jurors. It will be random. Their service
- 50:24Speaker 1: isn't over in case a juror becomes sick or cannot serve.
- 50:27Speaker 1: The alternates will also be sequestered. 4.28 p.m. Clerk draws
- 50:32Speaker 1: the five numbers of the alternates. Six men. Sixteen women.
- 50:36Speaker 1: 18 woman, 17 man, 13 woman. 4.30 p.m. All jurors
- 50:42Speaker 1: will be sequestered, including the alternates. Three bailiffs were sworn
- 50:45Speaker 1: in yesterday to serve the juror, and three additional bailiffs
- 50:49Speaker 1: will be sworn in now. Clerks, where's the men? 4.31 p.m.
- 50:54Speaker 1: Jurors have left the courtroom. Boyce tells attorneys they need
- 50:57Speaker 1: to stay close in case there's a verdict or a
- 50:59Speaker 1: question from the juror. We are now in recess. All right, folks,
- 51:03Speaker 1: so we're there, right? We're at the point where... we're
- 51:07Speaker 1: about to get a verdict. And my guess is we're
- 51:09Speaker 1: going to have that verdict either today or tomorrow. So
- 51:13Speaker 1: we'll be here waiting for that verdict to drop. And
- 51:15Speaker 1: when it does, we'll get it added to the catalog.
- 51:18Speaker 1: But until then, that's going to do it for this one.
- 51:20Speaker 1: All of the information that goes with this episode can
- 51:23Speaker 1: be found in the description box.
