- 2:35back here right or try the weakness? What do they want? I don't
- 2:38know if that they want to see you? Oh all right anyway, cap'n.
- 2:43I see you now right in here. Thank you, Captain mcgeel.
- 2:47Yes, I believe you've just had a murder. Reproaches what about it?
- 2:53I feel that I might be of assistant or men can handle it. And
- 2:57I see you don't understand me what I meant? And is I might be
- 3:00able to what that is? Tell you something about the king were you're with
- 3:05this very much. So, captain, come in and sit down. Mister
- 3:09do we say Brown? If you wish, Thank you, captain, have
- 3:15this chair. Thank you. As you were saying, I was saying that
- 3:20I could tell you something of interest about the murder of Andrew Adams. Adams
- 3:24I believe he's known as Andrew Spider. Now at mister Brown, you're not
- 3:30the man who killed him, although I have my doubts if you'll be able
- 3:35to do anything to him. Why do you say that? The answer to
- 3:38that is a long story, Captain, a story you will find hard to
- 3:42believe. But as I say, the police will find it very difficult to
- 3:45punish the murderer. John Plemming not think out very carefully before he killed Andrew
- 3:52Adams. Would you like to hear the whole story? I would very well.
- 3:58John Fleming, the man who killed Adams, is a rather small man,
- 4:01much the same build as myself. He is no longer young. Years
- 4:06have put the mark on him. Only two months ago he was released from
- 4:10stone Hill Prison. Oh, hex godic man. Good, we'll have a
- 4:14complete ride on him. I think he realizes that. But to continue with
- 4:18my story, John Fleming was a hard working farmer before his misfortune. It
- 4:25was well caught up in the community well like by everyone except one man,
- 4:30a neighbor of Flemings. This man hated Fleming, and Fleming returned that hatred.
- 4:35One morning, a neighbor's body was found in the burned ruins of his
- 4:39home. Two bullets were found embedded in the body, and those bullets were
- 4:44taced to the gun of John Fleming. Needless to say, after a trial
- 4:47by a jury, John Fleming was called to face the bar of ju course
- 4:59chance the jury. Have you reached a verdict? We have, your honor.
- 5:03Will you read that verdict? We find that the planet John Fleming your
- 5:08second degree murderers Jahn with the recommendation for order. John Fleming, will your
- 5:17rise and face the cord. You have been jury tried and convicted on a
- 5:24charge of murder in the second degree. The jury has handed the court of
- 5:28recommendation for mercy. Is there anything you wished to say before sentences passed upon
- 5:34your nothing, your honor, other than to once again maintain that I am
- 5:39innocent of this crime. On the witness span, I readily admitted the enmity
- 5:43between the deceased and myself. However, I did not kill him. That
- 5:46is all I have to say, John Fleming. It is the order of
- 5:54this cord that you'll be taken to the State's prison at Stornhill, and there
- 5:59being result for a term not to exceed twenty years. And so John Fleming
- 6:25was convicted of a crime which he strongly maintained he did not commit. I
- 6:29say, when all does it connect with you? Okay, I'm coming to
- 6:32that. Captain John Fleming served eighteen years, two months and three days of
- 6:38that sentence. At noon on the last day of his confinement, he was
- 6:42called into the office of the warden. The warden was busy. Oh,
- 6:46come in planning you wanted to see the warden? Yes, soda, thank
- 6:50you sir. Today is the big day for you planning. Yeah, I
- 6:56know, sir. Today you become a free man. Today. Your death
- 6:59is societ. He is faith paid in full. You've been a model prisoner,
- 7:02Fleming. Your work in our regricostural department will long be remembered. I'm
- 7:08sorry to see you go, but I frush you'll not be back no shift.
- 7:13Before you leave. There's one question I'd like to ask you cause me
- 7:16great concerns as I assume my duties. Here is warden, how do you
- 7:20feel about your conviction? Now? I am not guilty of the crime with
- 7:25which I was charged and convicted. I see, well, you're free,
- 7:30Fleming, free to go, and may you enjoy the best of luck.
- 7:34Here's my hand. And so Captain John Fleming walked out between the great iron
- 7:42gates of the prison alone. He had a cheap suit of clothes on.
- 7:46He's back in twelve dollars in his pocket. Yet he resolved to start life,
- 7:50and you start where he left off. I don't know just what you're
- 7:54leading up to, mister Brown, but you'll have to hurry your story.
- 7:56We've worked to do in this department. I won't take up much more of
- 7:59your time. Captain Well. Fleming tried to find work, you have my
- 8:03word for that, but love just didn't break for him. Finally he came
- 8:07back here to his hometown. No one recognized him. He found a job
- 8:11in the trucking company. It was hard work for an old man. Each
- 8:16evening in dragons out home, utterly exhausted from the day's work. One evening
- 8:22he opened the door to his room and found me, good evening, Fleming,
- 8:28Adams, No you're alive. Oh yes, I'm very much alive.
- 8:33Don't stand there staring Come in. Okay. I know you were told I
- 8:37was dead. You were convicted for my murder. You're slaved eighteen years for
- 8:43it, not knowing that it was alive and prospering. You mean that,
- 8:46I mean you were framed, Fleming, frame by me. I caused you
- 8:52to suffer a living hell for eighteen years because you married the woman I love
- 8:58but Mary. Yes, I know your wife died during the second year of
- 9:01your imprisonment, but no matter. I've had my revenge. I wanted to
- 9:05see you suffer. I wanted to see you in agony, even though it
- 9:09meant burning my home and leaving town for fifteen years. I'm careful, Fleming,
- 9:16I have a gun. I wouldn't hesitate to kill you like I would
- 9:20have done. I thought perhaps the hardship of prison life would do it for
- 9:24me, But you are too hardy. Never mind, you're dying. Your
- 9:30face shows it, every movement of your body showed it. And you came
- 9:35up here to goat over it, to enjoy my misery. Andrew Adams,
- 9:39I hope you can't do anything. Andrew Adams is dead. My name is
- 9:45Spicer. I am a well to do, Merchant, nobody would believe you.
- 9:50Look the body, a body which the authority mistook for mine. Oh,
- 9:54I planned things camply, my friend. I stole your gun and your
- 9:58absence. The body was out of a tramp who came to my house begging
- 10:03food. I shot him with your gun, poured oil on my house,
- 10:07and disappeared. You can imagine what joy I had reading of your arrest and
- 10:11conviction. You you you haven't longed to live, Fleming. I had intended
- 10:20killing you, but I've changed my mind. I shall let you suffer.
- 10:24Suffer the knowledge that I Andrew Adams wrecked your life as you try to wreck
- 10:28mind, but I didn't. I shall leave it. Now, leave you
- 10:31in your misery, Fleming, Leave you to ponder on the wreckage you have
- 10:35made of things you haven't long to live. Fleming, I can see that
- 10:56you're becoming interested. Captain. We come now to the last scene of this
- 11:01story. John Fleming was left alone to think things out. Prison had dulled
- 11:07his senses and took him several days to map out his course. Then Fleming
- 11:13took what little money had saved and purchased a revolver. Next, he made
- 11:18arrangements to meet Adams at a downtown building. He was waiting when Adams arrived.
- 11:26You have a nerve to call on me for help. Did you do
- 11:31you think I'd help you? Do you think I'll give him one cent for
- 11:33doctors for medicine. I didn't come to you for aid, Adams. I
- 11:39came to talk things over with your talk things over. What do I have
- 11:43to talk to you about? Several things? I believe. First, I
- 11:48want to compliment you upon the planning and executing of such a diabolical scheme to
- 11:52revengeance upon a fellow man. It was a bit of planning as only the
- 11:56devil himself could have accomplished. You have anything to pay to me, Adams.
- 12:01You knew exactly what you were doing. You knew that I'd be arrested
- 12:03and convicted for a crime which I did not commit. I believe the irony
- 12:07is this thing amused. You knew just how everything would happen. I thought
- 12:13it all out in great detail. But there's one thing that you didn't oh
- 12:16that you did, Adams. He overlooked the fact that a man can only
- 12:18pay once for the same time, once, and once only. I've paid
- 12:22for your murder, Adams. No I'm glad to know you. Where can
- 12:31I find this flamming? Why do you want to bother him? Captain?
- 12:35You can't convict him. I'm not assure that he's already paid for the crime,
- 12:39paid in full. He can't be made to pay again. But it's
- 12:43not up to me. I'll have to arrest him, arrest him for the
- 12:46murder of a dead man. Very well, Captain, I'm John Fleming Police
- 13:09Headquarters. Just a minute, please, the tective you're at Kevin Young.
- 13:18This is Jero Saxon, the president of the Investors Real decent. Yes,
- 13:20mister Samson, I met the Third naighty Bank forty Daveney. Yes, I
- 13:24want you to send an officer over here immediately to arrest the president of this
- 13:28bank, one of them. I want you to send someone over here.
- 13:31Well, that's the president of this bank. What he done? I'll explain
- 13:33that to the officer. Well, I'll be ready for myself. All right,
- 13:37I'll wait for you here. Thank the that's for three minutes, nots
- 13:45and I'm going over to the Third National Bank. What's up? Oh?
- 13:46Something that wants me to arrest roller? See Morgan the president stay in the
- 14:15carpader goes any you. I'll call you right well win the number nine players?
- 14:24Oh, I said, where can I check? Please? Yes,
- 14:26I'm Japane Young from Headwater. There you are here. I want you to
- 14:31arrest this cowgod. I want you to take him down and throw him in
- 14:35jail. That's what I'm dam it the Sampson. If you will just come
- 14:37your ill shout me by you you arrest him, arrest him, I say,
- 14:43on my constitutional rights, I demand that you arrest this this seef up,
- 14:46my dear sir, I because just a minute, just a minute,
- 14:50let's cut to the bottom of this trouble. You're a Samson of the real
- 14:52Sam. Yes, and this man just a minute, just a minute,
- 14:54and I don't hear your story first. If you're a mind mister Morgan,
- 14:56I'd rather you had it the Simpsons. I'll have to admit it all very
- 15:00mister, time to me very well. You'll hear my side of it all
- 15:03right. I'm representing one of the largest real estate firms in this city.
- 15:07I came in this tank that one week to go today and borrowed two hundred
- 15:09thousand dollars. You borrowed how much? Two hundred thousand dollars? What did
- 15:15you borrow the money for my company was ditting on a new tract of land.
- 15:18We wanted the cash to close the deal. I see as collateral on
- 15:20alone. I put up two hundred and fifty thousand dollars worth of New York
- 15:24and Boston Railroad bonds. The real estate deals fell through, and I brought
- 15:28my check for two hundred thousand dollars plus the interest to day and asked for
- 15:31my bonds. Well, well, I was met with a cock and bull
- 15:35story that they couldn't make a child believe. What about this, mister Morgan,
- 15:37What mister Sampson tells you is absolutely true. This bank loaned him two
- 15:43hundred thousand on the bars, that that was just a week ago today,
- 15:46And what happened to the bond, I don't know. You don't know either
- 15:48than stolen or misplaced. I've tried to tell mister Sampson that if you'll give
- 15:54us a few days day, you're bank piling up interest on the loan.
- 15:56Not a chance. Don't care, Morgan. You produce my bonds immediately or
- 16:02I'll swear out of warrant. But you're a ratlist. I'll look into this
- 16:06thing. And man who handled the pants action, mister Evans, the cashier.
- 16:10Where in this office did you see the bonds, mister Morgan? And
- 16:14were they in New York and Boston rail Road? Yes, what happened after
- 16:18you inspected and fast on the bonds. I instructed mister Evans to god check
- 16:22for the amount and make the necessary arrangements with mister Simpson here, and those
- 16:26arrangements were made. Then your cashier Evans was the last man to handle a
- 16:30bond. That is correct. And if the bonds were stolen, Captain Young,
- 16:33we're not sure that they were stolen. You see, when we opened
- 16:37mister Sampson's envelope this morning, expecting to find the bonds, we found these
- 16:41instead. And if you asked me, they tried to pass this worthless stuff
- 16:45up onto me, thinking that I'd not noticed it. Now, what are
- 16:48these bonds? By master? They are an old issue of German municipal bonds.
- 16:52They're absolutely worstless. And you found these in the envelope instead of the
- 16:56railroad boonder? Yes, well, where were these bonds kept during the past
- 17:00week? In the vault? We have a special section for a collateral,
- 17:03and they weren't moved until you went to get them today. As far as
- 17:06I know, they were not who went from today Evans the cashier I see,
- 17:11mister Markhan. How many people in this bank would have access to the
- 17:14collaboral three mister Evans, mister Turner, the vice president, and myself and
- 17:18one of your fake books took my bottle. Mister Sampson, I'm going to
- 17:22ask that you let me finish when I have started without interruption. All right,
- 17:26but I want something done and we'll do all we can now, mister
- 17:30Morgan, if you'll arrange for me to talk to the cashier Evans, I'll
- 17:33see what we can do now. Mister Evans, you're positive that you placed
- 17:57the bonds in a envelope? All can set me? Do it right?
- 18:00Mister Morgan, Yes, I was watching. There's absolutely no chance that an
- 18:04error with me and you took the Samblope directly to the volve Evans k and
- 18:08it's been an a volt ever since. Yeah, that is until I went
- 18:12for it today. Have you ever seen these German minutes of a bond before?
- 18:15No, it's beyond me, Morgan. You've loan Sanson two hundred thousand
- 18:22on some New York and Boston Railroad bonds. Those bonds were interrupted to you
- 18:26for safe keeping, and he's ready to pay back the loan, and you
- 18:30can't produce the bonds, not to me, as though you have to pay
- 18:33him the full price of the bonds, that is, if we're not found,
- 18:36and of course the bank will do it. We're fully protected by insurance.
- 18:41Captain Young, you've made quite a reputation locally as a slut, and
- 18:45I'd appreciate it very much if you took a hand in this matter. Of
- 18:48course, the bank will call it all investigators, but I'd feel better about
- 18:52it personally if you took tis, even if the trail led to one of
- 18:56your officers or yourself. Even then on to Margan. Now, first I
- 19:02want the serial numbers and all the missing boonds, and then I want to
- 19:04talk to each and every one of them. Oh, here comes to Captain.
- 19:18Oh boys, I'm glad to see you're all here. I have to
- 19:22call you on such short notice that I was afraid I miss some of you.
- 19:25And here's what we're here for. Somebody pulled a fast one on a
- 19:26third Nationals, kidding the amount of two hundred and fifty thousand in railroad bombs
- 19:30New York and Boston. Of course, the bank has called its private diction
- 19:34on the job, and ordinarily I have let them handle it, except that
- 19:37I want to show these bank officials that we can turn the trick form.
- 19:41Now. I have here anny raph copies of the serial numbers on the missing
- 19:44bonds. Here's a description of the case, and some other dope that you
- 19:47will need a downing. You get on the phone. Cover every banking institution
- 19:52in the state. The bond are probably on the move. Now find out
- 19:55if any of these bonds will pass through the buffers. Yes, Turner,
- 19:59you're an the hand of this game. Given a teletype wire every section in
- 20:03the country. If these bonds have been taken out of state, it's your
- 20:06job to handle it right. Uh, yes, you tail Morgan night and
- 20:10day, and for the love of night, don't let them know it.
- 20:11Right Hiller? Are you and Tubby? You got after Evans the cashier and
- 20:15any comments that he might run into. Make a complete report. Buye today.
- 20:18We got the capitol. That's you boys. Circulate a button, keep
- 20:22your eyes and ears open. Send to your routine duty. But remember this
- 20:25apartment is on the trail of two hundred and fifty thousand dollars worth of hot
- 20:29bond detective, you're a Captain Young's office in just a minute. Dead Downing's
- 20:51on the phone, Capitol, Hello, Oh they did fine yesterday. Now
- 20:59we're getting hot. Keep after him. What news? Down and found out
- 21:03that the firm of over Lockham Dailey sold a big bunch of the bond yesterday
- 21:06for a client named Smith. Smith name is probably a phony. He was
- 21:08described that Downing as a dapper little guy with a gray mustache, had a
- 21:11letter of reference from the Third National. I'll get it. Hello, yeah,
- 21:19okay, nothing, yeah, down he just called into the similar report.
- 21:22Keep right after it. Milton found out at the Harrison Company he sold
- 21:26some of them the same bond this morning for the same smith. Get the
- 21:30commissioner farm me right, he said, he'd be over Hello, yeah nothing.
- 21:37Oh, now you're getting somewhere. I'll stick around and pinch him money
- 21:41shows out. No, no, wait a minute, don't think him.
- 21:44You got one of the boys after over there right away, and when he
- 21:47gets there, let him make the transaction and then tail him. Keep your
- 21:49eye on him every minute. I thought a hunch, and if it works
- 21:52out, there a certain gentleman and this town is going to be very surprised.
- 22:04Glad you got here, Kat, And I'm waiting for him to come
- 22:07out. Man in that office? Who is he? I don't know,
- 22:10but it all checks. He's a little old man about five feet four,
- 22:14ray mustache and walks with a sort of a swing. I do that,
- 22:17believe. When I was coming to town, like you told me, I
- 22:18asked about New York and Boston Railroad buns at Adams and Sons, and they
- 22:22told me that they had a fellow in to sell some to a client if
- 22:25there's at two o'clock. So I hiked at the phone and called you.
- 22:29Then, Well, I thought of them, like you said. As soon
- 22:30as I saw I knew that he fipped description of a guy who's been passing
- 22:33him at the other places. So I kept right on his tackle. He
- 22:36stopped ten and I called you again, and he came right over. How
- 22:40long has you been in that office? How about twenty minutes or so?
- 22:42Whose office is it? All? I don't know? Names around the corner,
- 22:45I think, wait a minute, Oh, I was on the door
- 22:48over here. Hey, Hey, what cat, We're going into that office?
- 22:52All right, come on right behind me and keep your eyes open,
- 22:56all right? All right, up that's it up high all right? See
- 23:00what the well? See what in that little guy's hand, Milton. Some
- 23:03of the bonds, captain. And just as I thought, and on the
- 23:07desk is the marked money for the system at Adams and Sons where they just
- 23:11sold some of the bonds. He listen, it's time for you to listen,
- 23:14Sampson. Oh yeah, well you've got nothing on me. I'll tell
- 23:17you. You find a shut up or do I shut you up? What
- 23:18the car, captain, Milton? We just caught a couple of slickers.
- 23:22Sampson here thought the plan and plan all out. He was a smart guy,
- 23:26but he got too bold. He should have held the bond for a
- 23:29couple of years. I don't get you, captain. Isn't this yeah yeah
- 23:32yeah. Sampson is a man who owned the bonds. Originally, he saw
- 23:34a way to make two hundred thousand on them by pulling a fatman in the
- 23:37bank. He borrowed the money on the bonds and then saw to it that
- 23:41they disappeared out of the vault so he could force the Third National to pay
- 23:44him face value for the bond. How did he get him out of the
- 23:47bank? Easy? Yeah, you see that little short guy standing there in
- 23:51front of him. Well he did it. Sampson hired him to steal the
- 23:53bonds out of the bank and pass him for him. You mean this little
- 23:56guy is a back driver. Oh no, not at all, jerk.
- 24:00That pony mustache off of his upper lip. That see, he is not
- 24:06a bank robbery a bank cashier. You're under a rat even welcome back.
- 24:51Uh. One thing I find interesting is the golden Age of entertainment had all
- 24:55these very fanciful interpretations of the U constitutional provision against double jeopardy. The fact
- 25:06that you were convicted of murdering someone in a fire doesn't mean that you can
- 25:11shoot them and get away with it because you were convicted of previously murdering them.
- 25:18I doubt there are a whole lot of presidents on that, just because
- 25:22when people are murdered, they tend to stay murdered. Those are two separate
- 25:26crimes, separated by more than twenty years. I remember it was a children's
- 25:32book written I think in the nineteen forties, where the hero had committed a
- 25:38crime and then been put on trial and acquitted it. I think it was
- 25:42a burglary, and then he went ahead and committed another burglary of the same
- 25:48place, and someone said he couldn't be tried again because he couldn't be tried
- 25:52for the same crime twice. Oh, there are two different crimes, two
- 25:56different occurrences, though I do think in the case of the Police Headquarters,
- 26:00the prosecutor might make a decision to dispense with it, or to at least
- 26:06arrange some other arrangement, particularly with the state of health of the defendant.
- 26:12The second one, I had a kind of a conchest of how it was
- 26:15going to turn out. I was surprised that the bank clerk was an accomplice.
- 26:23I was thinking something had happened at the moment where the guy who deposited
- 26:30the bond switched him, but didn't quite get that part right. All right,
- 26:34Well, that will do it for today. Join us tomorrow for a
