Katie Phang Goes Scorched Earth On Todd Blanche (10/5/26) · The Epstein Chronicles

Speaker 1: What's up everyone and welcome to another episode of the
• 0:02
Speaker 1: Epstein Chronicles. The battle between Katie Fang and Todd Blanche
• 0:07
Speaker 1: continues to rage on. And now, Katie Fang has accused
• 0:11
Speaker 1: Attorney General Todd Blanche of filing a motion that is
• 0:16
Speaker 1: completely full of BS. And she says the whole entire
• 0:20
Speaker 1: point is to try and stall the lawsuit and run
• 0:23
Speaker 1: out the clock. And boy, that sounds exactly on brand.
• 0:27
Speaker 1: Not only for Todd Blanche, but the whole administration. It's
• 0:30
Speaker 1: always about loopholes and technicalities. That's their go-to when they're
• 0:35
Speaker 1: trying to defend their bullshit narrative about Jeffrey Epstein. But
• 0:40
Speaker 1: that narrative has lost a lot of its bite. And
• 0:42
Speaker 1: a lot of people out there know, deep in their heart,
• 0:45
Speaker 1: that they're being dog-locked. And that the administration and Todd Blanche, well,
• 0:51
Speaker 1: not exactly being truthful. Today we have an article from
• 0:55
Speaker 1: Raw Story and the headline. Todd, which one is it?
• 1:00
Speaker 1: Attorney confronts Todd Blanche for latest Epstein delay ruse. This
• 1:05
Speaker 1: article was authored by David Edwards. Attorney Katie Fang accused
• 1:09
Speaker 1: Attorney General Todd Blanche of filing a motion chock full
• 1:13
Speaker 1: of lies to stall her lawsuit seeking unredacted files on
• 1:16
Speaker 1: the late sex offender Jeffrey Epstein. Fang made the accusation
• 1:21
Speaker 1: in a broadcast on her YouTube channel on Friday, a
• 1:24
Speaker 1: day after the Justice Department made a last-minute request to U.S.
• 1:28
Speaker 1: District Judge Emmett Sullivan and to postpone a deadline in
• 1:31
Speaker 1: the case. Sullivan had ordered Blanche to file a certified
• 1:35
Speaker 1: list of the administrative record, meaning the documents the department
• 1:38
Speaker 1: relied on, to decide what to release and redact by
• 1:41
Speaker 1: October 1st, according to the motion. Well, how'd that work out?
• 1:46
Speaker 1: Todd Blanche does whatever he wants. And so does the
• 1:49
Speaker 1: whole entire Justice Department, obviously. There's no checks and balances.
• 1:54
Speaker 1: These dudes are running roughshod over everybody. And then they
• 1:58
Speaker 1: jump on social media... and talk about what a great
• 2:00
Speaker 1: job they're doing, and how you should just believe the rhetoric.
• 2:04
Speaker 1: What you shouldn't do is believe your lying eyes. It's
• 2:07
Speaker 1: actually pretty illuminating, because it'll reveal again the process, the
• 2:11
Speaker 1: thought process, that went into the redactions, and the withholdings
• 2:15
Speaker 1: for the files that have been publicly produced thus far,
• 2:17
Speaker 1: Fang said. Sullivan's September 16th order also required the department
• 2:22
Speaker 1: to hand over the full record by October 15th, according
• 2:25
Speaker 1: to a copy Fang showed on air. Well, I don't
• 2:28
Speaker 1: think that they have any motivation or any plans to
• 2:32
Speaker 1: give these documents up. I think they're going to fight
• 2:35
Speaker 1: this and fight this until they can't fight it anymore.
• 2:39
Speaker 1: And the only way that they're going to give this
• 2:40
Speaker 1: stuff up is if they're ordered to do it. And
• 2:43
Speaker 1: even then, we see what's going on. So there has
• 2:46
Speaker 1: to be an order with some finality, right? Listen, if
• 2:50
Speaker 1: you don't turn this shit over, that's it. It's time
• 2:53
Speaker 1: for contempt. And I would hope that Judge Sullivan... is
• 2:58
Speaker 1: really thinking about it. Because in my opinion, this is
• 3:01
Speaker 1: blatant and it needs to be dealt with. Either way,
• 3:07
Speaker 1: we have Todd Blanche the day something's due, the night,
• 3:09
Speaker 1: more technically, that something's due. He's like, I need more time, Judge,
• 3:13
Speaker 1: Fang said, comparing Blanche to a child asking you for
• 3:16
Speaker 1: more time at the last minute. Well, that's how they operate.
• 3:20
Speaker 1: What they want to do is get you scrambling. And
• 3:23
Speaker 1: if they wait until the last minute, then it's harder
• 3:26
Speaker 1: for the other team, the plaintiff in this case, to
• 3:29
Speaker 1: file a motion. So what they're trying to do is
• 3:32
Speaker 1: win the docket game. And I just don't think that's
• 3:36
Speaker 1: going to work. Now, if it was somebody else, maybe, right?
• 3:40
Speaker 1: Somebody that didn't have the resources that Katie Fang has, maybe,
• 3:43
Speaker 1: but she's a lawyer herself. She can look at these
• 3:46
Speaker 1: documents and know what's bunk and what's not, or what
• 3:49
Speaker 1: can be challenged and what can't be. So it's not
• 3:53
Speaker 1: like Todd Blanche is dealing with just, you know, a
• 3:55
Speaker 1: regular member of the public. Now, with that said, that
• 3:57
Speaker 1: doesn't mean Katie Fang is some kind of, you know,
• 4:00
Speaker 1: legal genius and she's infallible. That's not the case either.
• 4:04
Speaker 1: And that's why we go through the court documents themselves.
• 4:09
Speaker 1: And when you look at the court documents that have
• 4:10
Speaker 1: been filed in this case, it's rather obvious which way
• 4:14
Speaker 1: the judge is leaning. But there is procedure and there
• 4:17
Speaker 1: are rings that you have to jump through. And unfortunately,
• 4:21
Speaker 1: that's where we're at. The department has sought delays before,
• 4:25
Speaker 1: asking Sullivan, in a July 2nd filing, to put on
• 4:28
Speaker 1: a hold for 60 days, any order to release more records,
• 4:32
Speaker 1: so the Solicitor General could consider an appeal. Well, don't
• 4:36
Speaker 1: release any records because, you know, we need more time
• 4:39
Speaker 1: to scrub them. The Solicitor General? An appeal, really? The
• 4:45
Speaker 1: court just told you to turn these documents over, multiple times.
• 4:49
Speaker 1: How many appeals do you get? Between Ghislaine Maxwell and
• 4:53
Speaker 1: the Department of Justice and the appeals, I don't think
• 4:56
Speaker 1: there's any appeals left for anybody else. In the new motion,
• 5:01
Speaker 1: the department accused Fang of trying to circumvent the Freedom
• 5:04
Speaker 1: of Information Act, the law the public uses to request
• 5:07
Speaker 1: government records, by suing under the Epstein Files Transparency Act,
• 5:12
Speaker 1: which it said gives private citizens no right to sue.
• 5:15
Speaker 1: Lie number one. I'm not suing pursuant to the Epstein
• 5:18
Speaker 1: Files Transparency Act, Fang said. I'm suing pursuant to the
• 5:22
Speaker 1: Administrative Procedure Act, the APA. And this is where we
• 5:26
Speaker 1: get into the legalese, right? As a lawyer, sometimes you
• 5:29
Speaker 1: have to get creative and you have to find a
• 5:31
Speaker 1: pathway to victory that might not exist. So you have to,
• 5:35
Speaker 1: you know, start looking at different cases, precedent, the whole thing.
• 5:39
Speaker 1: And then you hope that the judge sides with what
• 5:41
Speaker 1: you're motioning. In fact, if I wasn't suing pursuant to
• 5:44
Speaker 1: the APA, then why would there even be the requirement
• 5:47
Speaker 1: for him to produce the certified list in the administrative record? Duh,
• 5:52
Speaker 1: Fang said. And she's not wrong. I think that Todd
• 5:56
Speaker 1: Blanche and the DOJ is flying way too close to
• 5:59
Speaker 1: the sun when it comes to this lawsuit. And I
• 6:02
Speaker 1: think that Judge Sullivan ultimately is going to hold them accountable.
• 6:06
Speaker 1: The question is when, right? The motion also said the
• 6:11
Speaker 1: information Fang seeks is already available through FOIA, the statute
• 6:15
Speaker 1: it said she ought to use. Oh yeah, because that's
• 6:17
Speaker 1: so successful. They give up so much information when we
• 6:22
Speaker 1: file FOIA requests about Epstein. Hey, dum-dum, the whole entire
• 6:26
Speaker 1: reason that Congress needed to act was because the DOJ
• 6:30
Speaker 1: wasn't going to do it on their own. So save
• 6:34
Speaker 1: the whole entire, oh, well, you should go through FOIA. Well,
• 6:37
Speaker 1: that doesn't work. That shit gets laughed out of the room.
• 6:44
Speaker 1: Fang said her legal team gave Judge Sullivan a Justice
• 6:46
Speaker 1: Department reply to a FOIA request in a June 24th filing.
• 6:50
Speaker 1: The reply said, the Epstein Files Transparency Act directed a
• 6:54
Speaker 1: much broader and less redacted release of files than would
• 6:57
Speaker 1: have been made under the FOIA. Yeah, no shit. FOIA's
• 7:00
Speaker 1: a big joke, by the way. I love when people
• 7:03
Speaker 1: use FOIA like it's some holy grail. They're just going
• 7:06
Speaker 1: to give you what they want to give you. That's it.
• 7:09
Speaker 1: Nothing more, nothing less. So in other words, Todd Blanch's
• 7:13
Speaker 1: DOJ was telling somebody who was moving under FOIA for
• 7:16
Speaker 1: the records... You gotta do it under the transparency law,
• 7:19
Speaker 1: Fang said. Well, Todd, which one is it? Fang asked.
• 7:24
Speaker 1: In Thursday's motion, the department argued that preparing the record
• 7:27
Speaker 1: would waste the court's time and taxpayer resources because the
• 7:31
Speaker 1: case is likely to be dismissed. Well, that didn't seem
• 7:34
Speaker 1: to be the case with Judge Sullivan and what he
• 7:36
Speaker 1: had to say. Likely to be dismissed. Maybe if you
• 7:39
Speaker 1: got a different judge, a favorable one. What's Eileen Cannon doing?
• 7:45
Speaker 1: Get the F out of here, Fang said. Are you
• 7:47
Speaker 1: kidding me? You think it's a good use of taxpayers'
• 7:49
Speaker 1: time and money to be able to do illegal redactions
• 7:52
Speaker 1: and withholds that are now forcing me to have to
• 7:54
Speaker 1: go and sue? The motion also said there are no
• 7:58
Speaker 1: material facts in dispute, meaning the two sides agree on
• 8:02
Speaker 1: what happened and only legal questions remain. The entire lawsuit
• 8:07
Speaker 1: is premised on facts in dispute, Fang said. I say
• 8:10
Speaker 1: that they have illegally withheld records and that they've illegally
• 8:12
Speaker 1: redacted records. He says no. That's that, not the case. Well,
• 8:18
Speaker 1: that's what the whole argument is, right? Did he or
• 8:20
Speaker 1: did he, or the DOJ, unlawfully redact files? And I
• 8:26
Speaker 1: think they did. When you have three and a half
• 8:29
Speaker 1: million files that haven't been released, and there's still no
• 8:33
Speaker 1: explanation on what has been released, what do you think
• 8:36
Speaker 1: people are going to start to think? Unless, of course,
• 8:41
Speaker 1: you're somebody that buys in to whatever the administration tells you,
• 8:45
Speaker 1: And if that's the case, there's no hope for you.
• 8:48
Speaker 1: Fang said that her lawyer's reaction to the delay request was, well,
• 8:51
Speaker 1: hell no. In a statement the department included in its motion,
• 8:56
Speaker 1: the lawyer said the request should be denied on its
• 8:58
Speaker 1: face because a local court rule requires the certified list
• 9:01
Speaker 1: to be filed at the same time as any motion
• 9:04
Speaker 1: that could end the case. The department filed that kind
• 9:07
Speaker 1: of motion the same day, asking Sullivan, in a separate filing,
• 9:11
Speaker 1: to rule in its favor based only on the court
• 9:13
Speaker 1: papers filed so far. And look, there's going to be
• 9:17
Speaker 1: a lot of back and forth, right? Both sides are
• 9:19
Speaker 1: going to look for summary judgments. Both sides are going
• 9:21
Speaker 1: to look to try and get the upper hand. But
• 9:24
Speaker 1: I think when you start parsing through all of the information,
• 9:27
Speaker 1: all of the evidence and all of the motions, it's
• 9:31
Speaker 1: obvious to me that Katie Fang has a pathway to victory.
• 9:36
Speaker 1: And I think that she has a judge that's sympathetic
• 9:38
Speaker 1: to her cause. And that's because I think Judge Sullivan
• 9:41
Speaker 1: understands the true nature of what's going on here. And
• 9:44
Speaker 1: he understands the scope. And he understands the implications. Because
• 9:49
Speaker 1: if the DOJ can hide information about this, what else
• 9:53
Speaker 1: are they hiding? I mean, we're talking about one of
• 9:56
Speaker 1: the most public facing cases maybe we've ever seen and
• 10:01
Speaker 1: the DOJ is playing coy so can you imagine what
• 10:04
Speaker 1: they're doing with less known cases with cases that don't
• 10:08
Speaker 1: have as much publicity pretty terrifying isn't it just redact
• 10:14
Speaker 1: the victim's information turn over the rest who are you
• 10:17
Speaker 1: protecting Fang said Well, it starts with financial and it
• 10:21
Speaker 1: ends with sector. Okay, that's who's being protected. But as
• 10:25
Speaker 1: far as this battle goes, there's still a ways to go.
• 10:28
Speaker 1: And there's going to be a flurry of filings coming
• 10:31
Speaker 1: both ways. And as those filings hit the docket, we'll
• 10:35
Speaker 1: get them added to the catalog. All the information that
• 10:38
Speaker 1: goes with this episode can be found in the description box.
