Transcript
- 0:03Voices for VoicesⓇ, Justin Alan Hayes: Hey everyone, it's Justin with Voices for Voices.
- 0:06Voices for VoicesⓇ, Justin Alan Hayes: We are glad that you are with us for this episode of the show.
- 0:12Voices for VoicesⓇ, Justin Alan Hayes: We have some more troubling news that has crossed our desk, and this takes us to the state of California.
- 0:29Voices for VoicesⓇ, Justin Alan Hayes: So it was last week, maybe the week before.
- 0:36Voices for VoicesⓇ, Justin Alan Hayes: In a recent episode, we had the San Diego County District Attorney, summer Stephanon, and we walked through what he's doing and trying to help decrease the amount of human trafficking, sex trafficking, labor trafficking in her county.
- 1:12Voices for VoicesⓇ, Justin Alan Hayes: And so, as we know or we don't know, san Diego County includes the state.
- 1:19Voices for VoicesⓇ, Justin Alan Hayes: San Diego County includes the city of San Diego, which is also in the state of California, and that's where the story comes to us from.
- 1:33Voices for VoicesⓇ, Justin Alan Hayes: So we're going to be quoting and sharing information from a multitude of sources and we're going to share that as we get to them.
- 1:46Voices for VoicesⓇ, Justin Alan Hayes: It just helps us tell the story.
- 1:49Voices for VoicesⓇ, Justin Alan Hayes: I'm not an attorney and so for me to read through quite a few pages and then understand the legalese just outside of my expertise.
- 2:06Voices for VoicesⓇ, Justin Alan Hayes: So we're going to throw it right now to the California Family Council.
- 2:13Voices for VoicesⓇ, Justin Alan Hayes: So the following information was shared and so we're talking in this episode about Assembly Bill 495.
- 2:25Voices for VoicesⓇ, Justin Alan Hayes: In a previous show we talked about a different assembly bill in the state of California.
- 2:37Voices for VoicesⓇ, Justin Alan Hayes: So I just want to be clear that we're talking about California Assembly Bill 495, this episode and kind of a summary quote that the California Family Council has right on their website.
- 2:56Voices for VoicesⓇ, Justin Alan Hayes: Anybody can look at it, californiafamilyorg and right at the top we have news and stories it talks about literally right there, quote presto, someone walks away with your child.
- 3:16Voices for VoicesⓇ, Justin Alan Hayes: Critics slam AB Assembly Bill 495's threat to parental rights, and so this really takes us right into the heart.
- 3:33Voices for VoicesⓇ, Justin Alan Hayes: And so Assembly Bill 495 at a high level has been at least from Governor Gavin Newsom's point of view, and Assemblywoman Celeste Rodriguez from the San Fernando area, a Democrat and we're not.
- 4:00Voices for VoicesⓇ, Justin Alan Hayes: We don't care about affiliated party.
- 4:04Voices for VoicesⓇ, Justin Alan Hayes: We're talking about human beings, and so that's where we're coming at this from.
- 4:11Voices for VoicesⓇ, Justin Alan Hayes: So this is not a knock on any particular party.
- 4:19Voices for VoicesⓇ, Justin Alan Hayes: If it was a Republican, if it was an independent libertarian and this bill was introduced by them, we would still be doing this episode and so this bill.
- 4:33Voices for VoicesⓇ, Justin Alan Hayes: Assembly Bill 495 in Canberra.
- 4:38Voices for VoicesⓇ, Justin Alan Hayes: We're talking about the California Family Council site.
- 4:44Voices for VoicesⓇ, Justin Alan Hayes: We're still sharing information about that website, that organization.
- 4:50Voices for VoicesⓇ, Justin Alan Hayes: Please check them out.
- 5:02Voices for VoicesⓇ, Justin Alan Hayes: In response to the deportation or detention of individuals that are in the United States of America illegally not legally, illegally with an I, illegally with an I but really what this is getting at the heart of the issue, and this is coming from attorneys, this is coming from parental right advocates, as we're sharing here.
- 5:39Voices for VoicesⓇ, Justin Alan Hayes: We're talking about families up in arms all over TikTok today, faith-based organizations are warning that really, this assembly bill that does get through and Gavin does find this that it will dangerously redefine guardianship.
- 6:05Voices for VoicesⓇ, Justin Alan Hayes: It really just strips away those parental rights and it creates legal loopholes that make kidnapping children easy.
- 6:16Voices for VoicesⓇ, Justin Alan Hayes: Now we're going to stop right there, because there's some heavy words.
- 6:20Voices for VoicesⓇ, Justin Alan Hayes: We don't take that lightly.
- 6:23Voices for VoicesⓇ, Justin Alan Hayes: As we always say, we're sharing this information public safety, and so, from what we've gathered in good faith, is this assembly bill is really, I want to say a kidnapper, a trafficker's dream, really giving literally free access to children, and that's why we're doing this episode Definitely public safety concern.
- 7:18Voices for VoicesⓇ, Justin Alan Hayes: You know, the author of this bill claims that, you know, no child should really face uncertainty and that they don't want to, or that they want to ensure that those children unexpectedly, if their parent, has been detained unexpectedly by, you know, ice, federal immigration officials.
- 7:50Voices for VoicesⓇ, Justin Alan Hayes: What Celeste wants to do with this bill, which is interesting, and so what it intends to do is to streamline guardianship by allowing and I'll get this straight, we're going to quote this quote non-relative family member, end quote.
- 8:17Voices for VoicesⓇ, Justin Alan Hayes: Did you hear what I just said?
- 8:21Voices for VoicesⓇ, Justin Alan Hayes: Non-family or non-relative extended family member.
- 8:29Voices for VoicesⓇ, Justin Alan Hayes: So that basically says they're not a family member, an extended family member, it's a non-relative Well, if they're not a relative, they're not a family member.
- 8:45Voices for VoicesⓇ, Justin Alan Hayes: It's a non-relative Well, if they're not a relative, they're not a family member.
- 8:47Voices for VoicesⓇ, Justin Alan Hayes: So this is just, you know, trying to use fancy words and, you know, think that we, the people are, you know, stupid and dumb, and we're not.
- 9:01Voices for VoicesⓇ, Justin Alan Hayes: And so, really, the definition of this non-relative extended family member is defined really broadly as anyone with a mentoring relationship to assume control over a child through a one-page affidavit which is really easy to put together.
- 9:34Voices for VoicesⓇ, Justin Alan Hayes: And one of the big reasons it's easy to put together is that there's no court review of this document, there's no notarizationization and no parental consent is required.
- 9:47Voices for VoicesⓇ, Justin Alan Hayes: I don't get it.
- 9:58Voices for VoicesⓇ, Justin Alan Hayes: I don't get it.
- 9:59Voices for VoicesⓇ, Justin Alan Hayes: I don't get it.
- 9:59Voices for VoicesⓇ, Justin Alan Hayes: Maybe I think Celeste means well, maybe I think Celeste Meanswell, likes the family together, but a non-relative extended family member.
- 10:16Voices for VoicesⓇ, Justin Alan Hayes: You can't use family member and say non-relative, like it doesn't go together.
- 10:24Voices for VoicesⓇ, Justin Alan Hayes: You're either a relative or you're not.
- 10:30Voices for VoicesⓇ, Justin Alan Hayes: And so this mentoring relationship, this could be a coach, this could be anybody.
- 10:38Voices for VoicesⓇ, Justin Alan Hayes: And again, this one-page affidavit has no court review, no notarization required and the kicker is, no parental consent is required.
- 10:56Voices for VoicesⓇ, Justin Alan Hayes: You can't make this up, folks.
- 11:09Voices for VoicesⓇ, Justin Alan Hayes: And Rodriguez goes on to say that this bill, this caregiver's authorization affidavit, lacks clarity and forcibility.
- 11:24Voices for VoicesⓇ, Justin Alan Hayes: And she insists that assembly bill 495 enhances there we go, another fancy term.
- 11:32Voices for VoicesⓇ, Justin Alan Hayes: It enhances child welfare by giving caregivers.
- 11:37Voices for VoicesⓇ, Justin Alan Hayes: Well, wait, wait a minute.
- 11:39Voices for VoicesⓇ, Justin Alan Hayes: We we didn't.
- 11:40Voices for VoicesⓇ, Justin Alan Hayes: We didn't say caregiver up above, we said non-relative extended family member.
- 11:47Voices for VoicesⓇ, Justin Alan Hayes: We didn't say caregiver.
- 11:49Voices for VoicesⓇ, Justin Alan Hayes: So I don't know what Rodriguez is really talking about here.
- 11:58Voices for VoicesⓇ, Justin Alan Hayes: Enhancing the child welfare when you're giving these again not mentioned above, these caregivers legal that are giving, let's just say it's a coach and I have nothing.
- 12:23Voices for VoicesⓇ, Justin Alan Hayes: We have nothing against coaches, we're just throwing.
- 12:24Voices for VoicesⓇ, Justin Alan Hayes: It's a coach and I have nothing.
- 12:25Voices for VoicesⓇ, Justin Alan Hayes: We have nothing against coaches, we're just throwing it out.
- 12:27Voices for VoicesⓇ, Justin Alan Hayes: For an example so coach says I have a mentoring relationship with my team and so in California this would mean, you know, it isn't specific.
- 12:50Voices for VoicesⓇ, Justin Alan Hayes: See, this is the thing that I I struggle with and a lot of us are struggling with, is it doesn't appear to be specific.
- 12:59Voices for VoicesⓇ, Justin Alan Hayes: You know, in in the rollout.
- 13:02Voices for VoicesⓇ, Justin Alan Hayes: It's saying you saying somebody's taken away unexpectedly.
- 13:08Voices for VoicesⓇ, Justin Alan Hayes: Well, what if a child's at home At home, their parent goes to the bathroom, somebody looks in the window and says, oh, that child is unaccompanied and I don't see a family member, so I'm going to come to the rescue and I'm going to rescue this child.
- 13:41Voices for VoicesⓇ, Justin Alan Hayes: Then, and let's say, that's that coach and this hypothesis, well then the coach would be able to show the school, show doctors, you know, this one page affidavit.
- 14:00Voices for VoicesⓇ, Justin Alan Hayes: It doesn't have to be notarized, it doesn't have to be reviewed by a court, it doesn't even have to be consented from the parent.
- 14:14Voices for VoicesⓇ, Justin Alan Hayes: And so let's say, the parent comes out of the bathroom and they're looking around Where's my child?
- 14:24Voices for VoicesⓇ, Justin Alan Hayes: Where'd they go?
- 14:28Voices for VoicesⓇ, Justin Alan Hayes: I just went to the bathroom.
- 14:31Voices for VoicesⓇ, Justin Alan Hayes: And I know some of you are like yeah, okay, justin, well, doesn't say that's not the case, doesn't say it's not the case.
- 14:41Voices for VoicesⓇ, Justin Alan Hayes: It doesn't say it's not the case.
- 14:44Voices for VoicesⓇ, Justin Alan Hayes: It doesn't say it's not the case.
- 14:46Voices for VoicesⓇ, Justin Alan Hayes: It doesn't say it's not the case.
- 14:47Voices for VoicesⓇ, Justin Alan Hayes: So we have to look at things and say, well, if it happens to a parent with a child and they get surprisingly detained by immigration authorities, so I get it, I get it, california, I get that a lot of you are upset with President Trump and this is a way to, you know, kind of get at the man.
- 15:40Voices for VoicesⓇ, Justin Alan Hayes: Why don't we look at things a little bit differently?
- 15:43Voices for VoicesⓇ, Justin Alan Hayes: And why does it have to be a non-relative extended family member?
- 15:54Voices for VoicesⓇ, Justin Alan Hayes: Why does it have to be a coach?
- 15:55Voices for VoicesⓇ, Justin Alan Hayes: And it doesn't even have to be a coach, it can just be anybody perusing the neighborhood up to no good.
- 16:07Voices for VoicesⓇ, Justin Alan Hayes: And again, like I said, look into the window.
- 16:11Voices for VoicesⓇ, Justin Alan Hayes: Oh, there's an accompanying child.
- 16:14Voices for VoicesⓇ, Justin Alan Hayes: They must be in danger.
- 16:16Voices for VoicesⓇ, Justin Alan Hayes: So you know, the parents go into the bathroom, maybe they're grabbing a quick shower.
- 16:25Voices for VoicesⓇ, Justin Alan Hayes: They're in their own home.
- 16:28Voices for VoicesⓇ, Justin Alan Hayes: They're in their own home and again, like it is mentioned, presto, someone walks away with their child.
- 16:43Voices for VoicesⓇ, Justin Alan Hayes: I don't know how to be any more clear than that.
- 16:45Voices for VoicesⓇ, Justin Alan Hayes: So we can put it under immigration and we get that and that's a fair argument.
- 17:02Voices for VoicesⓇ, Justin Alan Hayes: I'm talking about whether you're for or against the illegal immigrants here.
- 17:15Voices for VoicesⓇ, Justin Alan Hayes: We can be either for or against it, but if we don't get super specific, then again what I just said can become truth and again we're going to dig right into this.
- 17:38Voices for VoicesⓇ, Justin Alan Hayes: So Aaron Friday is an attorney and president of Our Duty USA, which is a parent-led advocacy group, and it called uh ab for for assembly bill 495, a child traffickers and kidnappers dream bill.
- 18:00Voices for VoicesⓇ, Justin Alan Hayes: So you heard me say it above earlier in the show and now I'm giving you like a direct quote, quote AB495 is a child trafficker's and kidnapper's dream bill.
- 18:31Voices for VoicesⓇ, Justin Alan Hayes: End quote.
- 18:31Voices for VoicesⓇ, Justin Alan Hayes: And Aaron goes on to say, quote there's no background check, there's no welfare check on that child, there's no court oversight and there's no verification.
- 18:48Voices for VoicesⓇ, Justin Alan Hayes: All you need is a piece of paper and some form of identification of who you are.
- 18:59Voices for VoicesⓇ, Justin Alan Hayes: But there's no obligation for the adult hand in hand, there's no obligation by the actual parent, the adult handing a child over, to verify that identification.
- 19:14Voices for VoicesⓇ, Justin Alan Hayes: So it's not like the parents in the bathroom.
- 19:18Voices for VoicesⓇ, Justin Alan Hayes: They come out and the person sitting in their house and they're like you know, this child was unaccompanied and so I'm going to show you my ID.
- 19:31Voices for VoicesⓇ, Justin Alan Hayes: I'm going to be taking this out under this AB-495.
- 19:40Voices for VoicesⓇ, Justin Alan Hayes: And press fill Gone.
- 19:58Voices for VoicesⓇ, Justin Alan Hayes: And this Aaron Friday goes on to say that they reject Rodriguez's claim that the bill is narrowly tailored to immigration emergencies.
- 20:11Voices for VoicesⓇ, Justin Alan Hayes: Like I said, if you don't specifically say it, then it has to be implied that it's the case.
- 20:22Voices for VoicesⓇ, Justin Alan Hayes: And Friday says that the bill's language so words, letters, numbers, sentences included applies.
- 20:39Voices for VoicesⓇ, Justin Alan Hayes: Now we're really getting into it.
- 20:42Voices for VoicesⓇ, Justin Alan Hayes: The bill's language applies to any child for any reason, regardless of immigration status.
- 20:53Voices for VoicesⓇ, Justin Alan Hayes: So that's buried in there, see that's.
- 20:58Voices for VoicesⓇ, Justin Alan Hayes: You know Gavin Newsom and Rodriguez doesn't want you to find that part of them.
- 21:07Voices for VoicesⓇ, Justin Alan Hayes: So this applies to any child for any reason, regardless of immigration status, and grants temporary legal rights to individuals with no blood relation, including people who may not even be known to the child's parents.
- 21:34Voices for VoicesⓇ, Justin Alan Hayes: And all this stranger has to do is consent oh no, the stranger is able to consent to medical treatments for the child, and this assembly bill absolves the doctors from any liability.
- 21:55Voices for VoicesⓇ, Justin Alan Hayes: Does that sound familiar?
- 21:59Voices for VoicesⓇ, Justin Alan Hayes: Pfizer, moderna, the COVID shots, before it all was rolled out, what are we not able to do as citizens?
- 22:11Voices for VoicesⓇ, Justin Alan Hayes: I don't believe we're able to bring legal action towards them.
- 22:20Voices for VoicesⓇ, Justin Alan Hayes: They want to help, they want to help, they want to help, except if it doesn't help, then they don't want to be held liable and they didn't want that guarantee.
- 22:35Voices for VoicesⓇ, Justin Alan Hayes: And that guarantee was made Plain and simple.
- 22:42Voices for VoicesⓇ, Justin Alan Hayes: So people, wake wake up.
- 22:47Voices for VoicesⓇ, Justin Alan Hayes: No blood relation, wake up.
- 22:49Voices for VoicesⓇ, Justin Alan Hayes: No blood relation, including people who may not even be known to a child's parents.
- 22:56Voices for VoicesⓇ, Justin Alan Hayes: For this person and this hypothetical that I was mentioning earlier, I see the child.
- 23:05Voices for VoicesⓇ, Justin Alan Hayes: Maybe they ring the doorbell, I don't know, I don't know how they get the doorbell.
- 23:11Voices for VoicesⓇ, Justin Alan Hayes: I don't know, I don't know how they get in the home.
- 23:14Voices for VoicesⓇ, Justin Alan Hayes: But they get in the home and they say I don't see Aaron Guardian, and the parent could be in the bathroom, literally say hold on, hold on, I'm just in the bathroom.
- 23:31Voices for VoicesⓇ, Justin Alan Hayes: That person leaves with the child and they have no blood relation, again may not be known to the parents, to the child's parents, and so not only is a stranger able to take the child and or children maybe it's more than one, maybe it's one, I don't know they're able to consent to medical treatments for the child and again, it absolved the doctors from any liability should the adult consenting not have any actual legal connection to the child.
- 24:24Voices for VoicesⓇ, Justin Alan Hayes: So, doctor, has an adult and a child, come in, I have an appointment for Justin.
- 24:37Voices for VoicesⓇ, Justin Alan Hayes: Okay, I don't recognize you.
- 24:42Voices for VoicesⓇ, Justin Alan Hayes: Oh, okay, well, but it's okay.
- 24:44Voices for VoicesⓇ, Justin Alan Hayes: So here's this one-page affidavit, okay, so here's this one page affidavit.
- 24:55Voices for VoicesⓇ, Justin Alan Hayes: And oh, by the way, there's this assembly bill 495, and Gavin Newsom, our governor, signed it into an act into law.
- 25:11Voices for VoicesⓇ, Justin Alan Hayes: So I don't really need to show you any identification, but I'm here on behalf of the family and so I'm just helping out.
- 25:27Voices for VoicesⓇ, Justin Alan Hayes: Yeah, I don't have any bloodline, no connection, and the doctor says, okay, bring him in, what would you like?
- 25:42Voices for VoicesⓇ, Justin Alan Hayes: And whatever the request is, the doctor does but they've been given consent by this person because it's all under this bill.
- 25:58Voices for VoicesⓇ, Justin Alan Hayes: It goes in the law For the state of California, and the doctor's like, all right, well, oh yeah, I was reading about that.
- 26:11Voices for VoicesⓇ, Justin Alan Hayes: Yeah, I don't, we're not going to have any.
- 26:13Voices for VoicesⓇ, Justin Alan Hayes: You know, as a doctor, I'm not going to have any liability if this consenting adult doesn't actually have any legal connection to the child.
- 26:26Voices for VoicesⓇ, Justin Alan Hayes: So they go ahead and put them in the path.
- 26:31Voices for VoicesⓇ, Justin Alan Hayes: So quote Friday.
- 26:36Voices for VoicesⓇ, Justin Alan Hayes: So quote we're talking about a legal pathway for predators to operate in plain sight.
- 26:46Voices for VoicesⓇ, Justin Alan Hayes: End, quote, end quote.
- 26:50Voices for VoicesⓇ, Justin Alan Hayes: This bill is not about immigration, it's about relinquishing parental rights to unvetted, what we call, basically, strangers that we don't know, we don't know.
- 27:11Voices for VoicesⓇ, Justin Alan Hayes: And so this bill, this selling bill, relinquishes parental rights to unvetted strangers under the guise G-U-I-S-E, not G-U-I-S, under the guise kind of like the like.
- 27:29Voices for VoicesⓇ, Justin Alan Hayes: Here we're going to put the.
- 27:30Voices for VoicesⓇ, Justin Alan Hayes: You know we're going to put the.
- 27:30Voices for VoicesⓇ, Justin Alan Hayes: You know we're going to pull the wool over the you know, the sheep's eye by the wolf, and so the wolf is saying oh, yeah, yeah, we're being compassionate, and the sheep's like?
- 27:46Voices for VoicesⓇ, Justin Alan Hayes: I don't think so doesn't matter.
- 27:51Voices for VoicesⓇ, Justin Alan Hayes: The sheep's the wool like?
- 27:52Voices for VoicesⓇ, Justin Alan Hayes: I don't think so it doesn't matter what the sheep said.
- 27:55Voices for VoicesⓇ, Justin Alan Hayes: The wool was pulled over by the wolf, so it doesn't matter.
- 28:05Voices for VoicesⓇ, Justin Alan Hayes: We also have another attorney, nicole Pearson, and the founder of FACTS Law Truth Justice also echoed these concerns in the testimony before the Senate Human Services Committee.
- 28:27Voices for VoicesⓇ, Justin Alan Hayes: Quote California wants to let someone that is not related to your child remove him or her from school, enroll him or her in any other school in the state, in the state, authorize any medical treatment of his or her, including mental health services and drugs, without the parents' notice.
- 29:00Voices for VoicesⓇ, Justin Alan Hayes: They don't notify them either, so without the parents' notice and knowledge of consent.
- 29:08Voices for VoicesⓇ, Justin Alan Hayes: This is not fear-mongering, I am not being hyperbolic.
- 29:13Voices for VoicesⓇ, Justin Alan Hayes: These unintended consequences are terrifying and they're unavoidable.
- 29:23Voices for VoicesⓇ, Justin Alan Hayes: And Pearson has represented immigration families and trafficking survivors and noted that the bill feels vague, which means it's very broad and open to interpretation, not just talking about immigration, the children that are affected by this unexpected detention or deportation of an illegal immigrant, not legal, illegal, i-l-l-e-g-a-l.
- 30:10Voices for VoicesⓇ, Justin Alan Hayes: Illegal.
- 30:11Voices for VoicesⓇ, Justin Alan Hayes: And Pearson goes on to say that because of this bill's vague definitions, the open to interpretation.
- 30:23Voices for VoicesⓇ, Justin Alan Hayes: So the last Rodriguez says oh, this is what it is, it's all about compassion and it's only for these specific cases, but it's not, because here we have a couple of folks that say that the bill is vague in its definitions and lacks the procedural safeguards and this is where it gets scary and are eerily similar to the federal mishandlings that led to over 600,000 unaccounted for unaccompanied minors in 2021.
- 31:19Voices for VoicesⓇ, Justin Alan Hayes: Pearson goes on quote.
- 31:26Voices for VoicesⓇ, Justin Alan Hayes: Yet AB495 goes even further.
- 31:31Voices for VoicesⓇ, Justin Alan Hayes: Even further than that.
- 31:33Voices for VoicesⓇ, Justin Alan Hayes: The bill co-ops the term non-relative extended family member from dependency, like foster care court, but since it's a termed caretaker's authorization affidavit will not be used with any official legal proceeding and it completely sidesteps the system's safeguards, such as background checks, fingerprinting, home visits, welfare checks, interviews, hearings and liability if the child is harmed.
- 32:21Voices for VoicesⓇ, Justin Alan Hayes: In quote this is not a compassionate bill designed to help the children of undocumented immigrants.
- 32:30Voices for VoicesⓇ, Justin Alan Hayes: Designed to help the children of undocumented immigrants.
- 32:32Voices for VoicesⓇ, Justin Alan Hayes: Remember this person that's saying this.
- 32:36Voices for VoicesⓇ, Justin Alan Hayes: They've helped individuals that this bill is supposedly supposed to help and only help, and they're saying this is not the case.
- 32:47Voices for VoicesⓇ, Justin Alan Hayes: This is not what Assembly Bill 495 is.
- 32:50Voices for VoicesⓇ, Justin Alan Hayes: This is not the case.
- 33:02Voices for VoicesⓇ, Justin Alan Hayes: This is not what Assembly Bill 495 is.
- 33:09Voices for VoicesⓇ, Justin Alan Hayes: It's much more than that.
- 33:10Voices for VoicesⓇ, Justin Alan Hayes: It is a license to take vulnerable children and make them disappear, she said in a later interview.
- 33:21Voices for VoicesⓇ, Justin Alan Hayes: So what does the bill actually do?
- 33:23Voices for VoicesⓇ, Justin Alan Hayes: It's promoted as compassionate safeguard for children of detained immigrant parents, but it in fact expands who qualifies as a caregiver to include, as I mentioned multiple times, quote, non-relative extended family members, and this is defined as any adult with an established familial or mentoring relationship with a child or with a relative of a child a broad and loosely defined category.
- 34:12Voices for VoicesⓇ, Justin Alan Hayes: It authorizes this use of what's been called a caregiver authorization affidavit Again, this is all just to confuse us lay people by these individuals.
- 34:27Voices for VoicesⓇ, Justin Alan Hayes: It allows them to assume decision-making, which we talked about, over a child's schooling, medical care, without a court appearance, a notarization or a parental signature.
- 34:45Voices for VoicesⓇ, Justin Alan Hayes: It grants caregivers.
- 34:49Voices for VoicesⓇ, Justin Alan Hayes: If we look on, it grants caregivers the legal ability to enroll a child in school and authorize dental, medical, mental health treatments, including treatments related to school participation.
- 35:04Voices for VoicesⓇ, Justin Alan Hayes: This includes sex trait modification procedures.
- 35:14Voices for VoicesⓇ, Justin Alan Hayes: I'll say that again, this includes sex trait modification procedures.
- 35:21Voices for VoicesⓇ, Justin Alan Hayes: So this person can come and take this job.
- 35:25Voices for VoicesⓇ, Justin Alan Hayes: It also does not require schools or daycare facilities to verify the identity, relationship or even the legitimacy of the adult presenting the caregiver's authorization affidavit, while absolving them of any liability.
- 35:58Voices for VoicesⓇ, Justin Alan Hayes: Did the child be handed over to a stranger or trafficker?
- 36:02Voices for VoicesⓇ, Justin Alan Hayes: And it required court documents related to joint guardianship arrangements, which is appointed in anticipation of a parent's temporary unavailability, will also include immigration-related detention.
- 36:29Voices for VoicesⓇ, Justin Alan Hayes: It's not only for immigration-related detention.
- 36:32Voices for VoicesⓇ, Justin Alan Hayes: It's not only for immigration-related detention.
- 36:36Voices for VoicesⓇ, Justin Alan Hayes: And so what this is really getting at is any court documents related to joint guardianship, etc.
- 36:49Voices for VoicesⓇ, Justin Alan Hayes: Including all these different statuses, are to be kept confidential and only accessible to parties in the case.
- 37:00Voices for VoicesⓇ, Justin Alan Hayes: Disclosure to immigration authorities is prohibited without a court order based on compelling necessity unrelated to immigration enforcement.
- 37:14Voices for VoicesⓇ, Justin Alan Hayes: We need a court order down here, but all these other things we don't need a court order to take the job.
- 37:25Voices for VoicesⓇ, Justin Alan Hayes: In short, ab 45 significantly reduces oversight and verification in assigning authority over children, introducing the potential of confusion and misuse in situations where parental rights and child safety are at stake.
- 37:55Voices for VoicesⓇ, Justin Alan Hayes: Call to action With lawmakers back in their districts.
- 38:00Voices for VoicesⓇ, Justin Alan Hayes: Now's the moment for parents, pastors, citizens to speak up.
- 38:07Voices for VoicesⓇ, Justin Alan Hayes: Call your state senator and urge a no vote on AB495.
- 38:14Voices for VoicesⓇ, Justin Alan Hayes: Share this on social media.
- 38:18Voices for VoicesⓇ, Justin Alan Hayes: Alert your community.
- 38:20Voices for VoicesⓇ, Justin Alan Hayes: Pray for the protection of California's children and the restoration of biblical parental authority.
- 38:29Voices for VoicesⓇ, Justin Alan Hayes: Pretty deep stuff here, isn't it?
- 38:33Voices for VoicesⓇ, Justin Alan Hayes: Folks, I've got one One last tonight.
- 38:48Voices for VoicesⓇ, Justin Alan Hayes: Folks, I've got one last section here for this episode.
- 38:51Voices for VoicesⓇ, Justin Alan Hayes: And again, this is all under the California Family Council, which is californiafamilyorg, and so this particular section is very is shorter.
- 39:04Voices for VoicesⓇ, Justin Alan Hayes: This is Pastor Jack Hibbs, raleigh's parent to Sacramento.
- 39:10Voices for VoicesⓇ, Justin Alan Hayes: He says if AB, so if Assembly Bill 495 passes, and quote run with the green.
- 39:27Voices for VoicesⓇ, Justin Alan Hayes: Back here he says quote, run with your it.
- 39:32Voices for VoicesⓇ, Justin Alan Hayes: Okay, this is a pastor.
- 39:40Voices for VoicesⓇ, Justin Alan Hayes: Says if you have children in California, that if this AB-495 passes, run with your kids.
- 39:50Voices for VoicesⓇ, Justin Alan Hayes: Pastor Hibbs says quote I have to tell you if this bill passes, I'm going to ask you to leave the state of California.
- 40:04Voices for VoicesⓇ, Justin Alan Hayes: End quote, pastor Hibbs does.
- 40:08Voices for VoicesⓇ, Justin Alan Hayes: He declared from the pulpit quote you got to get out, you got to run with your kids, you got to go.
- 40:16Voices for VoicesⓇ, Justin Alan Hayes: End quote very, you got to get out, you got to run with your kids, you got to go.
- 40:18Voices for VoicesⓇ, Justin Alan Hayes: End quote Very, oh my gosh, this is just.
- 40:30Voices for VoicesⓇ, Justin Alan Hayes: It is a wake up call.
- 40:33Voices for VoicesⓇ, Justin Alan Hayes: As he says, this is an urgent message and we need to share and we need to keep talking about it.
- 40:40Voices for VoicesⓇ, Justin Alan Hayes: Please share this episode on social media.
- 40:44Voices for VoicesⓇ, Justin Alan Hayes: Let everybody know that it was in the state of California that has kids.
- 40:50Voices for VoicesⓇ, Justin Alan Hayes: Jack Hibbs says on his after.
- 40:55Voices for VoicesⓇ, Justin Alan Hayes: Jack Hibbs says on his looks like Instagram.
- 41:01Voices for VoicesⓇ, Justin Alan Hayes: California's AB-495 is the most dangerous bill we've ever seen and it is being pushed right now by lawmakers in Sacramento this bill so this is an addition to what I shared for the first half of the show this bill according to Jack Gibbs Dr Jack Gibbs this bill would allow any non-related adult and so this is my point that this could be a neighbor, this could be a teacher, this could be an ex-relative or even a complete stranger to take custody of your child without your knowledge or consent.
- 41:59Voices for VoicesⓇ, Justin Alan Hayes: No background check, no court order, no parent signature, just a piece of paper.
- 42:08Voices for VoicesⓇ, Justin Alan Hayes: It doesn't need to be verified.
- 42:11Voices for VoicesⓇ, Justin Alan Hayes: So Pastor Jack Yates joins the call and says we're calling on every parent, grandparent and concerned citizen to show up on August 19th at the Capitol Step in Sacramento.
- 42:31Voices for VoicesⓇ, Justin Alan Hayes: This, he said, is the hill to die on and that your attendance matters.
- 42:43Voices for VoicesⓇ, Justin Alan Hayes: And then a California Family Council post on social media looks like Instagram quote California wants to let someone that is not related to your child remove him or her from school, enroll him or her in any other school in the state, her including mental health services and drugs without the parents' notice or knowledge or consent.
- 43:26Voices for VoicesⓇ, Justin Alan Hayes: This is not fear-mongering, we're not being hyperbolic.
- 43:28Voices for VoicesⓇ, Justin Alan Hayes: These unintended consequences are terrifying and they're unavoidable, and they're unavoidable.
- 43:41Voices for VoicesⓇ, Justin Alan Hayes: I hope I made myself clear with Assembly Bill 495.
- 43:48Voices for VoicesⓇ, Justin Alan Hayes: During California, august 19th Capitol Step in Sacramento.
- 43:53Voices for VoicesⓇ, Justin Alan Hayes: You want to be there, make your voice heard, make your voice heard, make your voices heard.
- 44:05Voices for VoicesⓇ, Justin Alan Hayes: And for Pastor Jack Hibbs to say this is the hell to die on, that's a pretty strong statement.
- 44:12Voices for VoicesⓇ, Justin Alan Hayes: It means it's important, it means if this goes forward, who knows what else is next.
- 44:26Voices for VoicesⓇ, Justin Alan Hayes: And for the pastor to say the pastor, you need to get out, you need to take your kids, get out of the state of California.
- 44:38Voices for VoicesⓇ, Justin Alan Hayes: So he doesn't care if it's attendance.
- 44:44Voices for VoicesⓇ, Justin Alan Hayes: That worshiper goes down, he's saying get out.
- 44:53Voices for VoicesⓇ, Justin Alan Hayes: And so this is a very good example of, again, regardless of party, regardless of Republican, democrat, libertarian, independent it's a good reminder that all of our voices matter.
- 45:20Voices for VoicesⓇ, Justin Alan Hayes: I don't even live in the state of California and I've gotten so many messages about this that I couldn't believe at first.
- 45:38Voices for VoicesⓇ, Justin Alan Hayes: Right, you know, sometimes you get a message or two and you look into something and it's like all right, this can be viewed a couple different ways.
- 45:57Voices for VoicesⓇ, Justin Alan Hayes: Not this though, not this.
- 46:06Voices for VoicesⓇ, Justin Alan Hayes: And there's also, from what I understand, maybe some other subsection through AB495 that may impact the view section to AB 495.
- 46:20Voices for VoicesⓇ, Justin Alan Hayes: It may impact if you homeschool your child or children.
- 46:28Voices for VoicesⓇ, Justin Alan Hayes: I haven't had a chance to truly verify all those, not to say it's not the truth, but I wanted to get this show out.
- 46:45Voices for VoicesⓇ, Justin Alan Hayes: We wanted to get this show out as soon as possible.
- 46:49Voices for VoicesⓇ, Justin Alan Hayes: Again, it took some vetting for us to do.
- 46:55Voices for VoicesⓇ, Justin Alan Hayes: Again, it took some vetting for us to do, but once we did that, we knew it was an important thing to do, that we needed to get on this, we needed to put this together, we needed to share information, share other reporting and share other reporting and get this in front of as many people in the state of California, california with children or maybe you have a relative there, maybe you know somebody, maybe you go to college there, you know somebody goes to college there.
- 47:56Voices for VoicesⓇ, Justin Alan Hayes: Again, this is what you see up here voices for voices.
- 48:00Voices for VoicesⓇ, Justin Alan Hayes: These are the types of issues that transcend political affiliation, transcend the pettiness, the if-past and Gavin, if you signed us, just remember.
- 48:46Voices for VoicesⓇ, Justin Alan Hayes: We're all going to be judged one day and I read one of the things that's probably going to be asked is did you help people or did you hurt people?
- 49:14Voices for VoicesⓇ, Justin Alan Hayes: I think it's a pretty basic question and you can't lie to the maker of the universe.
- 49:31Voices for VoicesⓇ, Justin Alan Hayes: I mean you can try it if you want.
- 49:36Voices for VoicesⓇ, Justin Alan Hayes: I mean you can try if you want, but God can write legally, he can read legalese, put things together.
- 49:55Voices for VoicesⓇ, Justin Alan Hayes: And in this case, this specific case I'm not judging anybody or sharing information, because this is a public safety concern in the city of California.
- 50:20Voices for VoicesⓇ, Justin Alan Hayes: That even the fact that it has this report, that it has now, is really really kind of troubling that we're even at this point.
- 50:41Voices for VoicesⓇ, Justin Alan Hayes: And so I would ask any lawmaker, any advocacy group, anybody who is for AB495, I want to ask you point blank Are you okay with this?
- 51:06Voices for VoicesⓇ, Justin Alan Hayes: Oh, my children are grown, they're adults, they're grown.
- 51:11Voices for VoicesⓇ, Justin Alan Hayes: Well, I bet there's at least one, one lawmaker that's for it, that has children.
- 51:25Voices for VoicesⓇ, Justin Alan Hayes: So you're cool with that.
- 51:30Voices for VoicesⓇ, Justin Alan Hayes: You're cool with going to the bathroom in your own house, your child playing and coming out of the bathroom after washing your hands and sanitizing and all that, and you're like where is my child?
- 51:54Voices for VoicesⓇ, Justin Alan Hayes: So you're cool with that.
- 52:00Voices for VoicesⓇ, Justin Alan Hayes: Just say, yeah, you know what, whoever has done.
- 52:06Voices for VoicesⓇ, Justin Alan Hayes: Yeah, yeah, I trust them.
- 52:11Voices for VoicesⓇ, Justin Alan Hayes: That's basically what you're doing.
- 52:17Voices for VoicesⓇ, Justin Alan Hayes: That's basically what you're doing.
- 52:23Voices for VoicesⓇ, Justin Alan Hayes: You know the.
- 52:23Voices for VoicesⓇ, Justin Alan Hayes: The one of those sayings goes do as I say, not as I do.
- 52:33Voices for VoicesⓇ, Justin Alan Hayes: And so, lawmakers, you have children and you're cool with this going into effect and you're cool with this impacting you, then I guess you know the route that you're going to vote.
- 52:59Voices for VoicesⓇ, Justin Alan Hayes: But if you actually go, hmm, is reelecting, is getting reelected more important or less important?
- 53:13Voices for VoicesⓇ, Justin Alan Hayes: From my kids, my family, one would think that your kids, your children, your family, is more important than politics.
- 53:30Voices for VoicesⓇ, Justin Alan Hayes: And so that's why I'm hoping to appeal to everybody and say you know what, you're okay finishing your shower, finishing going to the bathroom, finish mowing the grass and then going inside and seeing your child's gone, you're like, well, no, no, no, that's different, that's not related to the immigration part.
- 54:12Voices for VoicesⓇ, Justin Alan Hayes: Well, the assembly bill doesn't carve only that piece out In the PR statement.
- 54:30Voices for VoicesⓇ, Justin Alan Hayes: You carve that piece out to make it sound like that's what the assembly bill, or 95, is all about.
- 54:37Voices for VoicesⓇ, Justin Alan Hayes: But, as I stated, other people, other people not me, other people have said it doesn't say it's only the.
- 54:52Voices for VoicesⓇ, Justin Alan Hayes: You know the folks impacted.
- 54:54Voices for VoicesⓇ, Justin Alan Hayes: You know the folks impacted with the.
- 55:15Voices for VoicesⓇ, Justin Alan Hayes: You know the immigration, unexpected detention, et cetera.
- 55:17Voices for VoicesⓇ, Justin Alan Hayes: So you're okay with the big, baddest criminal roaming the streets.
- 55:21Voices for VoicesⓇ, Justin Alan Hayes: It doesn't even matter if it's the first time or the 10th time, if they're up to no good and you want to say, yes, I want to pass AB-495, and I have children and I'm okay if that were to happen.
- 55:45Voices for VoicesⓇ, Justin Alan Hayes: By all means vote your conscience, but just know this, that your conscience, but just know this, that your conscience says that politics is more important than family.
- 56:08Voices for VoicesⓇ, Justin Alan Hayes: If you think this way and get off the PR terms, the PR talking point, talk about the full bill.
- 56:21Voices for VoicesⓇ, Justin Alan Hayes: That's what we don't talk about enough in this country and other areas.
- 56:26Voices for VoicesⓇ, Justin Alan Hayes: We talk about what's convenient for us, convenient for our platform, convenient for our lobbyists, the ones that are lining our pockets, that make Nancy Pelosi have a net worth of hundreds of millions of dollars when her salary is like $150,000, $200,000 a year.
- 56:49Voices for VoicesⓇ, Justin Alan Hayes: How does that?
- 56:53Voices for VoicesⓇ, Justin Alan Hayes: How does that?
- 56:54Voices for VoicesⓇ, Justin Alan Hayes: The math don't work like that.
- 56:58Voices for VoicesⓇ, Justin Alan Hayes: They're making $200,000 in five years.
- 57:06Voices for VoicesⓇ, Justin Alan Hayes: That's a million dollars, but that before taxes.
- 57:10Voices for VoicesⓇ, Justin Alan Hayes: So what would it be worth?
- 57:23Voices for VoicesⓇ, Justin Alan Hayes: A few million, okay, but hundreds of millions?
- 57:28Voices for VoicesⓇ, Justin Alan Hayes: Career politician.
- 57:31Voices for VoicesⓇ, Justin Alan Hayes: It's the same type of logic here, folks, if all you have is time to read your talking points.
- 58:02Voices for VoicesⓇ, Justin Alan Hayes: And again, we think family, loved ones, blood relatives, are more important than politics, blood relatives are more important than politics.
- 58:17Voices for VoicesⓇ, Justin Alan Hayes: That's why, with me not living and us not living in the state of California, why it's why we had to put this together, because we're not trying to just help certain people.
- 58:42Voices for VoicesⓇ, Justin Alan Hayes: We want to help everybody.
- 58:45Voices for VoicesⓇ, Justin Alan Hayes: We want to help 3 billion people over the course of my lifetime and beyond.
- 58:53Voices for VoicesⓇ, Justin Alan Hayes: I don't care what party you're in political party affiliation Democrat, republican, libertarian, independent it doesn't matter.
- 59:14Voices for VoicesⓇ, Justin Alan Hayes: I'm talking about everybody's children and I really don't think you would be okay with that.
- 59:28Voices for VoicesⓇ, Justin Alan Hayes: Have that happen to you and be cool with that, just like.
- 59:45Voices for VoicesⓇ, Justin Alan Hayes: Oh yeah, so we just want to bring some information to you.
- 59:47Voices for VoicesⓇ, Justin Alan Hayes: We were against California Assembly Bill 495.
- 59:57Voices for VoicesⓇ, Justin Alan Hayes: I know that San Diego District Attorney Summer Stephan is also against this.
- 1:00:08Voices for VoicesⓇ, Justin Alan Hayes: We also had on the show in a previous episode.
- 1:00:11Voices for VoicesⓇ, Justin Alan Hayes: I believe it's in the 290s.
- 1:00:14Voices for VoicesⓇ, Justin Alan Hayes: We're over 302 episodes at least by now.
- 1:00:16Voices for VoicesⓇ, Justin Alan Hayes: I believe it's in the 290s or over 300, and two episodes at least by now when this airs and comes out.
- 1:00:24Voices for VoicesⓇ, Justin Alan Hayes: And so check out that conversation.
- 1:00:32Voices for VoicesⓇ, Justin Alan Hayes: I thought it was a good conversation.
- 1:00:36Voices for VoicesⓇ, Justin Alan Hayes: I learned a whole lot.
- 1:00:38Voices for VoicesⓇ, Justin Alan Hayes: Maybe you could too.
- 1:00:43Voices for VoicesⓇ, Justin Alan Hayes: So until next time, please be a voice for you or somebody in need, and I have been your host.
- 1:00:54Voices for VoicesⓇ, Justin Alan Hayes: Founder of Voices for Voices, Justin Alan Hayes.
- 1:01:01Voices for VoicesⓇ, Justin Alan Hayes: Why don't we do something together?
- 1:01:02Voices for VoicesⓇ, Justin Alan Hayes: Why don't we celebrate the voices of everybody, and let that begin with us, our families, especially keeping our children safe.
- 1:01:19Voices for VoicesⓇ, Justin Alan Hayes: Talk to you next time, everybody.
- 1:01:20Voices for VoicesⓇ, Justin Alan Hayes: Bye-bye.
