Transcript
- 0:00Speaker 1: Hi, I'm Jason Flamm and I'm the host of Wrongful
- 0:02Speaker 1: Conviction with Jason Flamm.
- 0:04Speaker 2: And I'm Robbia Jaudry, attorney and co host of Undisclosed.
- 0:07Speaker 2: So today we want to talk to you about your
- 0:09Speaker 2: rights and how they relate to interactions with the police,
- 0:12Speaker 2: especially if your immigration status is a little sketchy.
- 0:14Speaker 1: Now, immigration law is a specialty of yours, Rabia, what
- 0:18Speaker 1: do you want to tell undocumented people? What do they
- 0:20Speaker 1: need to know when they're talking to law enforcement? This
- 0:22Speaker 1: is so important, I think to all of us.
- 0:25Speaker 2: First of all, remember you don't ever have to answer
- 0:27Speaker 2: questions about your nationality or your immigration status. Just remember,
- 0:31Speaker 2: regardless of your immigration status, it does not matter what
- 0:34Speaker 2: your immigration status is. All the constitutional protections still apply
- 0:38Speaker 2: to you in any kind of police interaction. You have
- 0:40Speaker 2: the right to remain silent. That does not depend on
- 0:42Speaker 2: your immigration status. You do not have to answer any
- 0:45Speaker 2: questions at all. Just very clearly tell the police I
- 0:48Speaker 2: have the right to remain silent. I'm exercising my right.
- 0:51Speaker 2: If you're pulled over in a car, like anybody else,
- 0:53Speaker 2: you want to roll down your window, provide the documents
- 0:55Speaker 2: you've been asked for. You don't have to consent to
- 0:58Speaker 2: a search of your personal belongings. You don't think that
- 1:00Speaker 2: you have less legal rights in this arena if you
- 1:03Speaker 2: are not documented, if you don't have legal status here,
- 1:06Speaker 2: and if you don't consent to a search, let the
- 1:08Speaker 2: cops know I do not consent to a search on
- 1:10Speaker 2: my person or belongings. Do not, under any circumstance volunteer
- 1:14Speaker 2: your immigration status. That's something for them to find out
- 1:17Speaker 2: on their own. If you are being arrested, however, do
- 1:20Speaker 2: not resist arrest. If you are an immigrant, it's really
- 1:23Speaker 2: important to protect your legal rights because, as many of
- 1:26Speaker 2: you know, any kind of legal repercussions can have a
- 1:28Speaker 2: direct impact on your immigration status.
- 1:31Speaker 1: Just because you're an immigrant doesn't mean that you don't
- 1:33Speaker 1: have legal rights. You do. We want you to exercise
- 1:36Speaker 1: them and stay safe out there. To learn more and
- 1:40Speaker 1: get involved, listen to Undisclosed.
- 1:43Speaker 2: And listen to Wrongful Conviction podcasts.
- 1:46Speaker 1: These are your legal rights.
- 1:48Speaker 2: Know your rights, understand your rights, and most importantly, exercise
- 1:51Speaker 2: your rights.
