- 0:00Speaker 1: Now more of the Mark Simone Show on seven to
- 0:03Speaker 1: ten WR Filling in for Mark, here again is Ken Rosato.
- 0:08Speaker 2: That's a way on a beautiful Friday.
- 0:10Speaker 1: Again.
- 0:11Speaker 2: If you're just tuning in, you say, wait a minute,
- 0:13Speaker 2: we're gonna get the rain later. Thuders, No, it's beautiful today,
- 0:16Speaker 2: tomorrow's Sunday sunshine, not too hot, not too humid, heights
- 0:20Speaker 2: only in the low eighties. Enjoy what probably is going
- 0:23Speaker 2: to be the best summer of the entire weekend.
- 0:25Speaker 3: Ken Rosato went.
- 0:26Speaker 2: Former New York City news anchor Channel seven for twenty years.
- 0:29Speaker 2: It was Channel five anchoring Good Day New York before that.
- 0:32Speaker 2: But it's nice to be with you today. And if
- 0:34Speaker 2: you have had your head in the sand and haven't
- 0:37Speaker 2: been paying attention, Mayor Zoron Mumdani has been threatening to
- 0:41Speaker 2: arrest Israeli Prime Minister Benjamin Ettinnah who for several years now,
- 0:45Speaker 2: even from his days as a New York State Assemblyman.
- 0:48Speaker 2: He cited the International Criminal Court which issued a twenty
- 0:51Speaker 2: twenty four arrest warrant for netanyahuo over the war in Gaza.
- 0:55Speaker 2: Remember Hamas invaded Israel October seventh of twenty three. Slow
- 1:00Speaker 2: ordering over twelve hundred innocent people, many in their sleep.
- 1:03Speaker 2: So all Prime Minister Netanyaho did was respond to that. Now,
- 1:06Speaker 2: the US does not and has never submitted to the
- 1:10Speaker 2: decisions of the ICC, but without any authority to do so,
- 1:14Speaker 2: I'm Donnie has threatened to arrest Netanyahoo when he comes
- 1:17Speaker 2: to the US for the UN General Assembly in September.
- 1:20Speaker 2: With US right now, Fox News legal analyst Greg Jarrett
- 1:23Speaker 2: here to talk about it. Truly one of my favorite
- 1:24Speaker 2: people on Fox News, Greg. I now will bother on
- 1:28Speaker 2: and on about how much I love watching it, but
- 1:30Speaker 2: it's good to have you answered.
- 1:32Speaker 3: Thank you, Ken, I appreciate it.
- 1:34Speaker 2: Well, So you see a guy like this, I call
- 1:37Speaker 2: him the boy mayor. You see a guy like this
- 1:39Speaker 2: who stupidly comes out and publicly proclaims that he will
- 1:44Speaker 2: have net Yahoo arrested, which number one, he as a
- 1:46Speaker 2: mayor can't do. It's up to the police commission in
- 1:49Speaker 2: the police department, and they're not going to be so stupid,
- 1:51Speaker 2: knowing what the law is to do that. Why would
- 1:54Speaker 2: even come forward and say that.
- 1:57Speaker 1: Well, as one of the great American philosopher for as
- 2:00Speaker 1: Forrest Gump said, you know, stupid is as stupid does.
- 2:04Speaker 1: And you're right that you know, this is a boy
- 2:08Speaker 1: mayor who never held a real job, never built anything,
- 2:14Speaker 1: never accomplished anything. He's he's young and doesn't know much.
- 2:18Speaker 1: But you know, I think even a high school civic student,
- 2:23Speaker 1: you know, would red flag this idea of arresting that Yahoo,
- 2:29Speaker 1: recognizing there's got to be something wrong with it, and
- 2:31Speaker 1: there's several things wrong with it. First of all, a
- 2:35Speaker 1: municipal mayor does not have the authority to arrest anyone.
- 2:40Speaker 1: Second of all, as you point out, the ICC is
- 2:45Speaker 1: a joke. America never signed on to it. In fact,
- 2:49Speaker 1: we rejected it and in passed a law that you know,
- 2:56Speaker 1: makes it illegal for anybody to follow its dictates. And
- 3:02Speaker 1: the third, if Mondomi were dumb enough, then he might
- 3:06Speaker 1: be to try to detain or arrest Yahoo.
- 3:14Speaker 3: Mondomi would find himself.
- 3:16Speaker 1: Arrested by the FBI and prosecuted by the DOJ for kidnapping,
- 3:21Speaker 1: because there's a specific federal law that says that internationally
- 3:27Speaker 1: protected people who were guessed in the United States cannot
- 3:32Speaker 1: be taken into custody. If they are, it's kidnapping. And
- 3:36Speaker 1: if you conspire with others to do so, as it
- 3:40Speaker 1: appears mondomi was trying to do and you take an
- 3:45Speaker 1: avert act, that's conspiracy to commit kidnapping. I am sure
- 3:52Speaker 1: that after Mondomie hauled off and issued the threat of
- 3:56Speaker 1: arresting Yahoo, that the lawyers that work for his administration
- 4:02Speaker 1: yanked him into a nearby office and said, you can't
- 4:06Speaker 1: do this for the reasons I just explained, and then
- 4:09Speaker 1: sheepishly Mondana had to back off of his ridiculous idea.
- 4:16Speaker 1: And now he's got a new idea. He is encouraging
- 4:19Speaker 1: people to take to the streets, which risks the safety
- 4:25Speaker 1: of the NYPD to protest net Yahoo. So you know,
- 4:31Speaker 1: this is what you get when you elect.
- 4:33Speaker 3: A boy mayor don't known anything?
- 4:36Speaker 2: I think. I find it ironic that this is the
- 4:39Speaker 2: same guy who refuses to enforce federal law when it
- 4:43Speaker 2: comes to things like illegal migrants, which is something that
- 4:46Speaker 2: we are subordinate to and subjected to in the City
- 4:49Speaker 2: of New York. But yet he wants to follow international
- 4:53Speaker 2: law which we have never signed on to and enforced that.
- 4:57Speaker 2: From New York City's perspective, it just is mind that
- 5:00Speaker 2: this is the person in charge of the city.
- 5:03Speaker 1: Well, it really is, and of course he you know,
- 5:07Speaker 1: loves to confer sanctuary status to people who are here illegally,
- 5:12Speaker 1: breaking the law. And I argued a long time ago,
- 5:16Speaker 1: and in several different columns, that it's high time for
- 5:20Speaker 1: the federal government to go after sanctuary jurisdictions because it's
- 5:27Speaker 1: a crime to harbor people who are here illegally. It's
- 5:34Speaker 1: a further crime to interfere obstruct in federal enforcement of
- 5:40Speaker 1: immigration laws. But that's what we have seen in places
- 5:45Speaker 1: like New York and out in California, where they openly
- 5:51Speaker 1: defy federal law and provide sanctuary. And you know, there
- 5:56Speaker 1: are several ways you can go after these people, both
- 5:59Speaker 1: civil but also criminally, and maybe it's time that people
- 6:03Speaker 1: be prosecuted.
- 6:04Speaker 2: Well, the fact that you have local municipalities all over
- 6:07Speaker 2: the country, the sanctuary cities and states saying that we
- 6:11Speaker 2: are under no obligation to enforce federal law. That's up
- 6:15Speaker 2: to you. Okay, Well, kidnapping is a federal law, yet
- 6:18Speaker 2: local police enforced that, and so is harboring a fugitive,
- 6:23Speaker 2: kidnapping and taking people across state lines. How about bank robbery,
- 6:27Speaker 2: that's a federal offense, right, the FBI gets involved in that,
- 6:30Speaker 2: But yet they'll follow the law from a local perspective.
- 6:34Speaker 2: And of course I know you're a lawyer, Greg, and
- 6:36Speaker 2: lawyers will say yes, but Ken, that's because there are
- 6:38Speaker 2: simultaneous local and state laws. Yes, but you involved the
- 6:42Speaker 2: FBI for those things. Don't tell me the local police say, oh, no, FBI,
- 6:47Speaker 2: you can't get involved in this bank robbery. Of course
- 6:49Speaker 2: they do. But yet when it comes to something they
- 6:51Speaker 2: don't like, they then selectively choose not to have any.
- 6:55Speaker 3: Part of it.
- 6:57Speaker 1: Yeah, I think a lot of it. And look, I
- 6:59Speaker 1: speak is a lawyer for forty six years. You know
- 7:03Speaker 1: a lot of it comes down to a lack of
- 7:05Speaker 1: knowledge of the law, which is why you know politicians
- 7:10Speaker 1: generally have a feelanx of lawyers to advise them.
- 7:13Speaker 3: And I'll give you another example.
- 7:15Speaker 1: You know wealth taxes, which you know Rocanna is pushing
- 7:22Speaker 1: representative from California far left liberal but Mondommie as well.
- 7:27Speaker 1: You know in New York at some point in time,
- 7:31Speaker 1: you know there will be lawsuits filed to stop it
- 7:36Speaker 1: because wealth taxes are a violation of the Constitution, and
- 7:41Speaker 1: in particular the sixteenth Amendment, which imposed income tax. But
- 7:47Speaker 1: you know, wealth tax is not income, it's assets that
- 7:53Speaker 1: go up and down. You're not taxing somebody when they
- 7:58Speaker 1: take the income that's part of their wealth invested in
- 8:04Speaker 1: tax and bonds and businesses and so forth. And a
- 8:08Speaker 1: constitution says direct taxes must be apportioned by state population.
- 8:14Speaker 1: Well that's not what this wealth tax is. So you know,
- 8:20Speaker 1: this is a violation of Supreme Court rulings. It's a
- 8:24Speaker 1: violation of the sixteenth Amendment. I think it's only a
- 8:26Speaker 1: matter of time when the you know, wealth tax goes
- 8:32Speaker 1: the way of the Dodo bird because it's blatantly unconstitutional.
- 8:36Speaker 2: Now, let's penalize people for their success and working hard
- 8:39Speaker 2: to contribute to society. And in this case, as you
- 8:42Speaker 2: point out, we're not talking about taxing income from their successes.
- 8:46Speaker 2: We're talking about assuming, at this point in time what
- 8:50Speaker 2: their total worth is and taxing it based on that
- 8:53Speaker 2: which tomorrow the buildings I own could all burn down
- 8:55Speaker 2: and they could be worthless.
- 8:57Speaker 3: So you can't do it exactly exactly.
- 9:01Speaker 1: And you know, what they fail to recognize is that
- 9:06Speaker 1: wealthy people invest in businesses that drive jobs and innovation.
- 9:13Speaker 3: You take that away and it.
- 9:15Speaker 1: Harms jobs and innovation and businesses, which hurts society as.
- 9:21Speaker 2: A whole Oh stopurologic.
- 9:23Speaker 1: Nice, yeah, stop it, you know, I mean it really is.
- 9:28Speaker 1: It's fundamental economics and it's fundamental law.
- 9:33Speaker 3: And these people who push this, like Mondami and you
- 9:37Speaker 3: know the.
- 9:40Speaker 1: Squad and Rocanna and Gavin Newsom, the governor of California,
- 9:46Speaker 1: their bereaft of knowledge of both fundamental economics and the law.
- 9:50Speaker 2: Unfortunately, they're like candy to children. They speak to the
- 9:53Speaker 2: lowest common denominator and get people agitated and all excited.
- 9:57Speaker 1: It holds really well for them, which is why they
- 10:00Speaker 1: do it, because they only care about perpetuating their own
- 10:03Speaker 1: power and elevating it.
- 10:05Speaker 2: All right, well we are unfortunately at a time I
- 10:07Speaker 2: could talk to you all day, my friend. I appreciate
- 10:09Speaker 2: you taking the time today. Fox News Legal analyst Greg Jarrett, Attorney,
- 10:14Speaker 2: brilliant man. Thank you for coming on this morning.
- 10:17Speaker 3: Ken, thanks for having me on.
- 10:18Speaker 2: Take care you bet you too, all right, and when
- 10:20Speaker 2: we come back, we'll take your calls. Eight hundred and
