- 0:18Speaker 2: Welcome to Family Law Talk. We have an interesting topic today.
- 0:22The topic is psycho sexual evaluations and chocusting matters. And
- 0:27this topic today is based on an article on our
- 0:30blog Famlawheadquarters dot com data July twenty second, twenty twenty
- 0:35five and the title of that article is what is
- 0:39a psychosexual evaluation? So as a follow up to the
- 0:42episode today, go on over to Famallawheadquarters dot com and
- 0:45read this blog article for more information. But let's go
- 0:48ahead and jump into the topic at hand. Sadly, in
- 0:52some chowcusting matters, sexual abuse allegations can arise. One party
- 0:57might allege that the other parent his sexual abuse the children,
- 1:01or maybe that they've sexually abused other children and that
- 1:05they could pose a risk to the kids who are
- 1:08part of the child custume matter. Again, these are sad cases.
- 1:11These are cases that nobody wants to see. Obviously, this
- 1:15topic is one that obviously causes grief and anguish and
- 1:22sorrow on the part of the individuals who are involved
- 1:24in these types of cases. I mean, these are not
- 1:26fun cases for attorneys to Okay and candidly, in some cases,
- 1:32a party might be falsely accused of sexual abuse, so
- 1:36maybe they didn't even do it, or it could be
- 1:39a situation where maybe they had criminal charges against them,
- 1:42but maybe they were acquitted of the criminal charges and
- 1:44they still want to have visitation in contact with their kids.
- 1:48But then the whole issue comes into play, which is
- 1:51are they a risk to the kids and if they
- 1:54were around the kids in an unsupervised manner, would be
- 1:57a risk of sexual abuse. And in some cases, one
- 2:02parent might alleges that the other parents shouldn't have any
- 2:06visitation at all. If they think that they've committed sexual abuse,
- 2:09then their position might be that the other parents shouldn't
- 2:12be around the kids at all. Okay, these are tough cases.
- 2:16These are difficult cases records, and the topic is the
- 2:20concept of a psycho sexual evaluation. So if you're listening
- 2:24to this episode today, you're probably wondering, what is this
- 2:28and why is this important? Okay, These are niche psychological
- 2:33evaluations that can be conducted on parties except that they're
- 2:38a little bit different. The whole issue with a psycho
- 2:42sexual evaluation is this, which is ultimately to come to
- 2:46conclusion about whether or not a party is a risk
- 2:50to sexually abuse the children that are part of the
- 2:53custody case. And so an evaluator is going to go
- 2:58through these testing methods with whoever the individual is who's
- 3:03accused of sexual abuse, or maybe again maybe they say, no,
- 3:07I didn't do this, I was falsely accused of sexual abuse.
- 3:10I never did this, I didn't do this, and these
- 3:13allegations are false and they're just really designed to try
- 3:16to keep me away from the kids. Okay, So in
- 3:19some of these custly cases where these sexual abuse allegations
- 3:23are out there, and take a case where there's really
- 3:26no tangible evidence of it, right, and again this is
- 3:32a thorny topic. This can be very much in the weeds, Okay.
- 3:36But in some cases with sexual abuse, there could be
- 3:39physical trauma and sometimes there could be a rape kit
- 3:43or something like that. Then it can be objectively shown
- 3:46whether or not somebody's been subjected to some kind of
- 3:50sexual abuse. But candidly, in some cases, if there was
- 3:55a rape kit at all, it came back negative, and
- 3:57maybe there's no signs abuse. There's no physical harm that
- 4:03a doctor or anybody could find to really prove that
- 4:07it happened, and so this gets to be thorny. But look,
- 4:10a psycho sexual evaluation, what this is is this would
- 4:15typically be a PhD, so a psychologist somebody who has
- 4:20this kind of specific background in training, and what they
- 4:23do is have an individual take psychological tests, okay, and
- 4:29these psychological tests can vary, so we're talking paper pencil tests,
- 4:34and they do various objective testing. They would say, now,
- 4:38some are critique it and say it's not really objective,
- 4:40it's subjective, but those who are in favor of these
- 4:44testings typically say that no, this is objective. Okay. So
- 4:48you're talking paper pencil test where there's scores in these
- 4:53tests and show a propensity for somebody to be somebody
- 4:58who might commit sexual abuse were show no propensity, okay.
- 5:02The other part of the psychosexual evaluation is typically a
- 5:07background history, So the psychologist is going to meet the
- 5:10individual who's been accused of sexual abuse, go through a
- 5:13detailed sexual history background. Sometimes they'll even have them take
- 5:18an intelligence test or what sometimes called an IQ test
- 5:22which can measure in individual's intellectual abilities. And again it
- 5:27can help the evaluate to determine is this individual somebody
- 5:33who's a risk to commit sexual abuse or is this
- 5:36somebody who's not a risk at all, and maybe somebody
- 5:40who's been falsely accused. Okay, there could be other sort
- 5:44of unsavory things that can take place at this psychosexual evaluation.
- 5:51For example, in male subjects. Okay, they can measure arousal.
- 5:57And again this is thorny. This is in the and
- 6:00I don't want to be too specific here, but ultimately
- 6:04there can be stimuli shown to individuals and then the
- 6:08issue is is does the individual become aroused of that
- 6:12certain stimuli? And based on that, and this we're talking
- 6:16particularly with males and so as part of the stimuli,
- 6:19if there was an arousal to a certain stimuli, then
- 6:23that could be relied upon buying an evaluator to say, hey,
- 6:28this individual perhaps is a risk to commit sexual abuse
- 6:31because there's arousal to stimulus that shouldn't arouse an individual
- 6:36something to that degree. Okay, So these are psychosexual evaluations
- 6:40in terms of more specifically how these can impact a
- 6:45child custy case. I mean the reality is they can
- 6:47have a big impact on a child custic case. Okay,
- 6:50If an evaluator believes that an individual has committed sexual
- 6:54abuse in the past, that there are risk to do
- 6:57it in the future, and they come to that inclusion
- 7:00based on the paper pencil test, based on the history,
- 7:06based on the IQ test, and then the arouse of
- 7:09the stimulus and whatever else they rely upon, then the
- 7:12reality is that an individual's access to their kids could
- 7:15be limited. Right. In some circumstances, they might just simply
- 7:19get supervised visitation. They might not be left alone with
- 7:23the kids. In other instances, where the kids have been
- 7:27victimized and then having contact with that parent who's victimized
- 7:31them could cause great harm, an individual might have no
- 7:34visitation with that parent whatsoever. Okay. On the flip end,
- 7:39if somebody has been falsely accused and they've never done
- 7:43this before, right, these are just false allegations that the
- 7:48other parent is raising to try to keep an individual
- 7:51away from the kids. Then if the results of the
- 7:54evaluation is that this individual is no risk to the
- 7:58kids and that this individ never committed sexual abuse in
- 8:02the past and there's just no reason to believe that
- 8:04they would do in the future, and that these are
- 8:06just simply false allegations. And sometimes you can also piggyback
- 8:10it on the lack of physical evidence. Right, maybe a
- 8:13rape kiss which I talked about before, took place, came
- 8:17back negative and there's no other physical evidence to show
- 8:22that this actually took place. And then you piggyback it
- 8:25with the psychosexual evaluation that shows that an individual's no risk.
- 8:30Then this can result in an individual getting normal visitation
- 8:33with their kids, right, not supervised, not no contact, but
- 8:38normal visitation with their kids. And in some cases where
- 8:42the other parties raising false allegations of sexual abuse just
- 8:46to keep a parent away when it didn't take place,
- 8:49it could result in the parent who's been falsely accused
- 8:52actually getting soul costly of the kids. And that could
- 8:54be so physical or so legal, you name it. You know,
- 8:58particularly where a parent is raising me false allegations and
- 9:01they and they know, or there's a reasonable degree of
- 9:04certainty that they know these allegations are false. They're just
- 9:08raising it in a bad faith manner in order to
- 9:11keep a parent away all right. Again, you know, some
- 9:16critique of psycho sexual evaluations is while while some people
- 9:19would argue that a lot of is testing is objective.
- 9:22Some would say it's subjective that different psychologists could, you know,
- 9:28do the evaluation on a particular individual and come up
- 9:31with different results. So there's some subjectivity here, you know.
- 9:34One of the other big drawbacks of psycho sexual evaluations
- 9:38is that if somebody omits or withholds material information to
- 9:43the individual doing the evaluation, or they're dishonest and they're
- 9:48not candid and they don't tell things that they should tell,
- 9:51then this can obviously skew the results as well, and
- 9:55so that can be a potential weakness as well. Okay, again,
- 9:58this is a nasty topic. This isn't really a fun topic.
- 10:01Hopefully most of the listeners never have to experience these
- 10:05types of cases, but the reality is they do happen
- 10:08circumstances where sexual abuse has taken place. These are terrible cases.
- 10:13And then there are cases where individuals have been falsely
- 10:15abused and there's been no sexual abuse at all. So
- 10:18I wanted to cover this topic today because it does happen,
- 10:21and these can be gut wrenching types of cases for
- 10:24individuals going through it. All right, as a follow up
