- 0:18Speaker 2: Welcome to FAMA Law Talk. We have an interesting topic today.
- 0:21The topic is court date questions and this episode today
- 0:25is based on an article on our blog Familylawheadquarters dot
- 0:29com dated March twenty eight, twenty twenty five, and the
- 0:32title of that article is what to know before court Date. So,
- 0:36as a follow up to the episode today, going over
- 0:39to our blog and read this article from more information
- 0:42on this topic. But let's go ahead and jump on in.
- 0:44When there's a court date and a divorce or family
- 0:47law matter, obviously it's important. Those who have no legal
- 0:51background oftentimes have lots of questions about the court date. Right.
- 0:55They start spinning, they start thinking, they start contemplating, they're
- 0:58wondering what's going to happen and what they need to
- 1:01know coming into the court date. Okay, so this is common,
- 1:05this is normal in any non lawyer or anybody who
- 1:08doesn't have a legal background is going to be here.
- 1:10So this is you don't feel bad this is common.
- 1:14Court dates are stressful for a lot of individuals. Court
- 1:17dates bring uncertainty. Obviously, court dates can cause people to
- 1:21become nervous and anxious and they can worry. Okay, So
- 1:24there's lots of questions individuals can have coming into a
- 1:28court date. But here's some of the most common ones
- 1:31that I've heard over the course of the time, and
- 1:33I wanted to cover them because these are good questions
- 1:35to ask an attorney coming into a court date in
- 1:39a divorce or fama law matter. All right, So the
- 1:41first one is what type of court date is this? Right?
- 1:44There's lots of different court dates that can be sent
- 1:48in a divorce or fame law matter. Okay. It could
- 1:50be a trial, like the final trial in a case,
- 1:53and obviously a trial is very important. That's where there's evidence,
- 1:58there's testimony at the inclusion of a trial, than the
- 2:01judge or commissioner is going to make a decision on
- 2:05the case itself. Okay. There can be other hearings that
- 2:08are evidentiary hearings, so they're not a trial, but it's
- 2:12an evidentiary hearing. These can be PDL court dates called
- 2:17pedentate light where the court determines custody and child support
- 2:22in other matters while the case is pending okay. Some
- 2:27jurisdictions use different terminology for it, so it could be
- 2:29a temporary custody hearing. It could be called a temp
- 2:33hearing or tempts hearing. It's goin to very based on
- 2:36what state and locality you're in. Okay. These are obviously
- 2:39very important types of court dates because it can determine
- 2:43how things are going to work while the case is pending. Okay.
- 2:46There are other types of court dates like pre trial conferences.
- 2:51Status conferences. Could be a settlement conference, it could be
- 2:55some other type of motion date where there's not testimony.
- 3:00Could be a motion to compel their emotion for guardian
- 3:03ad litem. There are lots of other possibilities as well.
- 3:07So knowing the type of court date is a big key,
- 3:11all right. If it's a trial or an evidentiary hearing,
- 3:15obviously that can require a party to testify, right, so
- 3:18party's got to be very prepared for that. But if
- 3:20it's another type of court date where they're not going
- 3:22to have to testify and it's a lawyer doing the work,
- 3:26then it's a lot less stress on the party because
- 3:29they don't have to perform in the courtroom. Sometimes they
- 3:31just have to be there to observe, but they don't
- 3:35have to do anything. Okay. So question number one is
- 3:37what type of court date? And am I going to
- 3:40have to testify? Very important? All right? Question two, which
- 3:44is do I need to appear for the court date? Okay?
- 3:48Some court dates a party has to show up to court. Right,
- 3:52Sometimes they just have to be present. Maybe the judge
- 3:55wants them there in theory, that way the case they're
- 4:00could settle. Right, they've got settlement authority because the parties
- 4:03are there. Sometimes the judge wants the parties there that
- 4:07way they can sign temporary custody agreements or something like that. Okay,
- 4:14But knowing whether a party has to be there or
- 4:17not is very important. There's some court dates, particularly the
- 4:20non testimonial motion court dates, where sometimes a party doesn't
- 4:24have to show up to court. But look, when in
- 4:26doubt show up to court. But if a court date's
- 4:29been set, you definitely want to talk to your attorney
- 4:32find out whether you need to be there, and if
- 4:35you need to be there, then you need to be there.
- 4:37Otherwise a judge could take offense to it, so it
- 4:39might entail taken a personal day or a vacation day
- 4:42at work. If you've got kids, getting childcare, like if
- 4:46the kids aren't school, it could be summer vacation. If
- 4:49the kids aren't school, AIDS and getting childcare for the kids.
- 4:54That way you can attend, but it's very important to
- 4:56know whether you need to be there. The third question,
- 5:01which is if you've got to be in court, how
- 5:04do you get to the courthouse? Okay, this can seem obvious,
- 5:08maybe a little bit mundane, but these kinds of details
- 5:12can stress a party out. So what's the address of
- 5:15the courthouse? And not only that, where do you park?
- 5:19In certain locations? This is easy. Maybe it's a courthouse
- 5:22square and you can park on the courthouse square, But
- 5:25in other jurisdictions you might have to pay to park,
- 5:28and you're going to want to know where you can
- 5:31pay to park. It's a huge key, all right. And
- 5:35then other questions are once you get to court, where
- 5:38do you go? Do you go in the courtroom when
- 5:41you get there, Maybe you sit outside on a chair
- 5:45or a bench outside of the courtroom, or maybe there's
- 5:48a conference room where you can go in and wait
- 5:51for your attorney. I mean knowing the answers to these
- 5:53questions are huge. Okay, this is going to be different
- 5:56different jurisdictions for different cases. In some cases you're going
- 5:59to go in the courtroom. In some cases you're going
- 6:02to sit outside or maybe go in a conference room
- 6:04or something like that at the courthouse. But you need
- 6:07to know otherwise you're going to have more stress coming
- 6:09to the court date. All right. I kind of alluded
- 6:12to this one already, But the fourth question is are
- 6:14you going to have to testify? All right? If you're
- 6:16going to have to testify, then preparation is really vital,
- 6:20all right. So if you're going to have to testify,
- 6:23it's almost always advisable to meet with your lawyer in
- 6:27advance of the court date. That way, you're prepared in
- 6:29terms of what types of questions your lawyer might ask you,
- 6:33in terms of what type of questions the other lawyer
- 6:36or the guardian at lightam might ask you, or maybe
- 6:38even the judge. But being prepared for most individuals, right,
- 6:42they're not used to being in the courthouse. They're not
- 6:45used to being in court. That causes somebody to be
- 6:47stressed already. Some individuals might be better on their other feet.
- 6:51They think quickly on their feet. Some people can be
- 6:54very stressed out and then they can be at a
- 6:57loss for their words. They can stutter, stammer, they can
- 7:01be nervous, jittery, you name it. And so meeting your
- 7:05lawyer in advance if you're going to testify as a
- 7:08huge key, huge key, and I almost always advise a
- 7:13client to do that or at a minimum have a
- 7:15zoom meeting or do a telephone call. Be prepared. You
- 7:18don't want to go on the witness stand and not
- 7:20be in any way prepared for what's coming. All right.
- 7:24The fifth question is what issues are before the court
- 7:28at the court date? Right. Knowing what the court can't
- 7:31address or will address, and what the court can't address
- 7:34and won't address is very important. And look for non
- 7:38lawyers this can be hard to understand, but certain court
- 7:41dates put certain issues before the court and other issues
- 7:45might be out there, but it's not before the court
- 7:47on that court date, so the court's not going to
- 7:49address it. So knowing coming into the court date what's
- 7:53before the judge, what's before the court, is a great
- 7:56thing because then your expectations are set in terms of
- 8:00what the issues are in play, and you're going to
- 8:02have a better idea unless frustration walking out of that
- 8:05court day in terms of what did or didn't happen. Okay,
- 8:09So knowing the issues at hand, it's a good question
- 8:11for your lawyer, all right. Another important question is how
- 8:17should you dress in court? All right? This might seem insignificant, okay,
- 8:21but some judges can be much more concerned with etiquette
- 8:24and dress code than others. Right. Some can get really
- 8:26uptight about this, can be offended by it. Some judges
- 8:30might be more laid back about it and it doesn't
- 8:33bug them as much. But knowing how you should dress
- 8:36in court, in a particular court room before particular judge
- 8:39is a huge key when in doubt. I've always told
- 8:42people overdressing is better than underdressing. So if you're not sure,
- 8:47dress a little bit nicer than you think. But I
- 8:50think it's huge to know what a particular judge expects.
- 8:53And if your lawyer has been before this judge before,
- 8:57is familiar with this judge, hopefully they can give you
- 8:59a little bit better idea. But when in doubt, dress
- 9:02nicer than you think you ought to. All right. Another
- 9:06important question, and really the last one I have on
- 9:08my list is this, which is what's the demeanor and
- 9:12the personality of the crucial players in the case. Okay,
- 9:16so some judges, guarding at items, opposing attorneys can be
- 9:20easier to deal with or harder to deal with. And
- 9:25knowing this coming into the court date is just huge
- 9:28because then you know what to expect and it can
- 9:32help guide a party in terms of how to behave
- 9:35and it can help a party have more clarity in
- 9:39terms of what to expect. Okay, so having a conversation
- 9:42with your attorney about this can be huge. You know,
- 9:46what's the judge like, what's the guarding atl item like?
- 9:49What's the other attorney like? Are they easy to deal with?
- 9:51Are they hard to deal with it? Are they aggressive
- 9:54in court? Are they a little bit more laid back
- 9:56and passive? Knowing these deeps hills coming into the court
- 10:01date can be a huge thing, all right. Obviously there's
- 10:04lots of other questions individuals might have about their specific
- 10:08case coming into court date, but again from my vantage point,
- 10:13having a conversation with the attorney that's representing you getting
- 10:17answers to these questions is huge, and then getting answers
- 10:20to other questions you might have might be equally as important.
- 10:24You don't want to come into the court date not
- 10:26be prepared, not know what to expect, and not have
- 10:30answers to your questions. You're going to be less stressed,
- 10:32less worried, less anxious, less jittery if you have a
- 10:37better idea, if how court is going to play itself out. Obviously,
- 10:41no attorney can predict with certainly what's going to happen.
- 10:44Sometimes parties go to court and something out of left field,
- 10:48something unpredictable happens. But to the extent you can get
- 10:51a better idea and surprises can be as minimal as possible.
- 10:56That can be a good thing for most parties going
- 10:58into court date. All right, so that's the top today.
- 11:01As a follow up to the episode, today, going over
