Speaker 1: What's up, everyone, and welcome back to the program. In
• 0:03
Speaker 1: this episode, we're going to get right back to the
• 0:04
Speaker 1: Tyler Robinson prelim hearing, day number two. Question by Kathy Nestor. Okay,
• 0:12
Speaker 1: and then you've been talking a lot about a timeline here.
• 0:15
Speaker 1: That seemed you talked about it when you were watching
• 0:18
Speaker 1: the video, but you also talked about the fact that
• 0:20
Speaker 1: you developed the timeline. Is that right? Answer, correct. Question,
• 0:24
Speaker 1: and can you pull up Poll one, please. I'm pulling
• 0:27
Speaker 1: up on your screen your report that you prepared. Do
• 0:30
Speaker 1: you recognize that? Answer, I do, yes. Question, and what's
• 0:33
Speaker 1: the date that you drafted that report? Answer, it looks
• 0:36
Speaker 1: like September 14th. It says, date created. Question, and that's
• 0:40
Speaker 1: the place where, if you could, go to page two, please.
• 0:43
Speaker 1: Do you see down at the bottom where you summarize
• 0:45
Speaker 1: Sergeant Bricker's report listing the timeline? Answer, yes. Question, okay.
• 0:51
Speaker 1: And so it was actually Sergeant Bricker that prepared the timeline.
• 0:53
Speaker 1: Is that right? Answer, he prepared a timeline. Question, and
• 0:57
Speaker 1: you incorporated that into your report. Answer, no, I created
• 1:00
Speaker 1: a timeline. Question, you created your own timeline. Answer, yes. Question,
• 1:06
Speaker 1: separate from the one that's in this report. Answer, yeah,
• 1:09
Speaker 1: using information obtained in the investigation. Question, and when did
• 1:13
Speaker 1: you create the timeline? Answer, over the course of the investigation,
• 1:17
Speaker 1: over a long period of time, after a lot of
• 1:19
Speaker 1: reviewing video, and investigative time. Question, okay, so as of
• 1:23
Speaker 1: September 14th, Tyler Robinson had already turned himself into authorities.
• 1:27
Speaker 1: Is that right? Answer, yeah, I believe he turned himself
• 1:30
Speaker 1: in on September 11th. Question, so prior to that time
• 1:35
Speaker 1: that Tyler Robinson turned himself in, had you all prepared
• 1:38
Speaker 1: a timeline? Answer, a documented written timeline? Question, yes. Answer,
• 1:43
Speaker 1: not to my knowledge. I don't know when Sergeant Bricker
• 1:46
Speaker 1: produced his specifically. Question, and is it fairer? To say that,
• 1:50
Speaker 1: as of the moment, Tyler Robinson voluntarily surrendered to authorities
• 1:54
Speaker 1: in Washington County. As of the moment, you all did
• 1:58
Speaker 1: not know who the shooter was. Is that right? Answer.
• 2:00
Speaker 1: We had identified a person of interest, but we did
• 2:03
Speaker 1: not specifically know who the shooter was at the time. Question. Okay.
• 2:07
Speaker 1: And you became aware that Mr. Robinson was voluntarily surrendering.
• 2:10
Speaker 1: How did you become aware of that? Answer. The information
• 2:13
Speaker 1: came originally, I believe, from the Washington County Sheriff to
• 2:17
Speaker 1: the administration and at the control center, at the university
• 2:20
Speaker 1: on the evening of the investigation, or the second evening
• 2:23
Speaker 1: of the investigation? Question, all right, we're going to go
• 2:26
Speaker 1: back to that in a minute, but I just wanted
• 2:28
Speaker 1: to get the timeline down, all right? Now I want
• 2:30
Speaker 1: to go back to the videos that we've seen and
• 2:32
Speaker 1: the question that I just asked before, which is, is
• 2:35
Speaker 1: it fair to say that nothing about the video of
• 2:38
Speaker 1: the individual on the roof revealed to you, you couldn't
• 2:41
Speaker 1: see facial features, you couldn't see what they were wearing, correct? Answer, no.
• 2:47
Speaker 1: Of the individual on the roof? Question. Correct. Answer. I
• 2:51
Speaker 1: know that there was a meeting to discuss perhaps a
• 2:53
Speaker 1: pattern on the front of the shirt that was observed
• 2:55
Speaker 1: when the individual was jumping off the roof. Question. Okay,
• 2:59
Speaker 1: that's fair. But at the time, as of the 11th,
• 3:01
Speaker 1: before Mr. Robinson turned himself in, you all had not
• 3:05
Speaker 1: been able to determine that. Is that right? Answer. Excuse me.
• 3:09
Speaker 1: Determine who he was or determine distinguishing features. Question. Determine
• 3:14
Speaker 1: distinguishing features of the video of the person on the roof. Answer, yeah,
• 3:18
Speaker 1: we had a person of interest and those images were
• 3:21
Speaker 1: released to the press. Question, you're talking about the ones
• 3:24
Speaker 1: in the stairwell. Answer, correct. Nestor, from the parking garage. Answer, correct. Question,
• 3:30
Speaker 1: but the video on the roof was not distinguishable, fair. Answer,
• 3:34
Speaker 1: the video as a standalone. Answer, yes. Question, it was not, no. Question, okay,
• 3:40
Speaker 1: and in fact, the video on the roof, well, strike that.
• 3:43
Speaker 1: Is it true that you had some spectators that you
• 3:45
Speaker 1: interviewed that had gotten a photograph a few seconds before
• 3:48
Speaker 1: the shooting of someone on the roof? Answer, sorry, I
• 3:52
Speaker 1: don't understand the question. Question, did you at some point
• 3:56
Speaker 1: in your investigation collect from two young men who were
• 3:59
Speaker 1: present at the event a video that had been taken
• 4:02
Speaker 1: of someone on the roof about 10 seconds before the shooting? Answer, yes,
• 4:06
Speaker 1: a video, yes, not photographs. A video was collected from
• 4:09
Speaker 1: an individual who had a video. Question, and ultimately some
• 4:13
Speaker 1: screenshots were taken out of that video, is that right? Answer, by? Question,
• 4:18
Speaker 1: by you? Answer, not by me, no. Question, okay, that's fine,
• 4:22
Speaker 1: it could have been someone else. Answer, okay. Question, but
• 4:25
Speaker 1: did you see the video that those young men took? Answer,
• 4:28
Speaker 1: if you're referring to the video that's looking north and
• 4:31
Speaker 1: shows an individual dressed in dark clothing on the corner
• 4:33
Speaker 1: of the roof. Question, yes. Answer, if that's the video,
• 4:38
Speaker 1: I have seen that video, yes. Question, did you review
• 4:41
Speaker 1: the interview of those young men? Answer, I did not. Question,
• 4:45
Speaker 1: do you know how they described the person on the roof? Answer,
• 4:48
  Speaker 1: I don't know if I read it or if I
• 4:50
Speaker 1: heard it, but my understanding was they believed it was
• 4:52
Speaker 1: Overwatch or some kind of police Overwatch for the event,
• 4:55
Speaker 1: if that's my recollection. Question, okay. And do you remember
• 4:59
Speaker 1: anything specific about the person's build that they discussed when
• 5:03
Speaker 1: they described the person on the roof? Answer, I do not. Question, okay.
• 5:08
Speaker 1: There's a portion of the video after the individual jumped
• 5:11
Speaker 1: off the roof, which we all saw here, where the
• 5:13
Speaker 1: individual crosses, I believe, its campus drive. Is that right? Answer,
• 5:17
Speaker 1: that's correct. Question, and there's a moment where the individual waits,
• 5:22
Speaker 1: and there's two cars that pass in front of him,
• 5:24
Speaker 1: right in front of him. Answer, correct. Question, and is
• 5:28
Speaker 1: this the moment where you were submitting that he was
• 5:31
Speaker 1: holding a gun in his hand? Answer, as he crossed
• 5:33
Speaker 1: the road. Question, yes. Answer, I, from my observations, would
• 5:38
Speaker 1: show that he's carrying an object in his hand that's
• 5:40
Speaker 1: concealed or in a bag, and it's long and has
• 5:43
Speaker 1: the appearance, based on my training and experience, it could
• 5:47
Speaker 1: be a firearm. Question, but do you see a gun anywhere?
• 5:50
Speaker 1: The actual gun? Question in the video? Question, yeah. Answer, no. Question,
• 5:55
Speaker 1: all right. And did anybody that was driving by on
• 5:57
Speaker 1: campus that day report to you or any other investigative entity, hey,
• 6:01
Speaker 1: we just drove by a guy with a gun who
• 6:03
Speaker 1: was leaving campus and he's standing right by my car? Answer,
• 6:06
Speaker 1: we did not receive any reports to that effect, no. Question, okay. Also,
• 6:11
Speaker 1: when you were revealing the timeline, exactly how long was
• 6:14
Speaker 1: there between when the person was prone on the roof
• 6:17
Speaker 1: and when the shot was taken? Do you recall? Answer,
• 6:21
Speaker 1: if you would like to replay the video, I can
• 6:23
Speaker 1: time it for you, but I don't recall. It was
• 6:25
Speaker 1: my guess, my guess, I would estimate, between 15 and
• 6:28
Speaker 1: 30 seconds. Question, so between 15 and 30 seconds to
• 6:32
Speaker 1: lay flat, take a shot, get up, and run off, right? Answer, no.
• 6:36
Speaker 1: I think you asked how long he was prone. Question right. Answer.
• 6:39
Speaker 1: I think it took longer for him to crawl into position. Question. Okay. Answer.
• 6:44
Speaker 1: And then establish position and then take the shot. He
• 6:47
Speaker 1: appeared to be prone for approximately 15 to 30 seconds.
• 6:50
Speaker 1: But the video would verify that. Question. Okay. Thank you.
• 6:53
Speaker 1: All right. I want to talk to you for just
• 6:55
Speaker 1: a minute about the video that was taken. And I'm
• 6:58
Speaker 1: not going to get into. I'm going to show it.
• 7:00
Speaker 1: Just show. In case anybody concerned about leaving the courtroom.
• 7:04
Speaker 1: I'm not going to show it. but there was a
• 7:06
Speaker 1: video that was taken by Mr. Ty Phillips, and that
• 7:08
Speaker 1: was the individual that was speaking to Mr. Kirk. Answer, correct. Question,
• 7:14
Speaker 1: and it showed that on view of Mr. Kirk and
• 7:17
Speaker 1: his parts of his security team. Is that right? And
• 7:19
Speaker 1: then you also have video that you described that shows
• 7:22
Speaker 1: the back of the tent at the moment that the
• 7:24
Speaker 1: shot happened. Is that right behind Mr. Kirk? Answer, you're
• 7:29
Speaker 1: referring to the UVU video in the breezeway? Answer, yes. Question,
• 7:33
Speaker 1: or question, yes. Answer, yes. We have that video, yes. Question, okay.
• 7:38
Speaker 1: And can we pull up the last video? The last clip, 49?
• 7:41
Speaker 1: I want to show you, just you, this clip, that
• 7:44
Speaker 1: is a little clip from the video under the breezeway.
• 7:47
Speaker 1: That's behind the tent, right? Answer, correct. Question, and just
• 7:51
Speaker 1: to be clear, this area behind the tent would not
• 7:53
Speaker 1: have been visible to anybody that was on the Losey building.
• 7:56
Speaker 1: Is that fair? Answer, I can't answer that question. The
• 8:00
Speaker 1: judge jumps in. Can I just interrupt for a moment?
• 8:04
Speaker 1: And Ms. Nestor, as you're playing this, are you just
• 8:06
Speaker 1: being cognizant if the sound is on or not? Kathy Nestor,
• 8:10
Speaker 1: I don't want the sound, please. Judge, I just wanted
• 8:13
Speaker 1: to clarify. Nestor, thank you for bringing that up. Thank you.
• 8:17
Speaker 1: Kathy Nestor, no sound. I just want only the witness
• 8:20
Speaker 1: to look at it. So can you just watch this
• 8:22
Speaker 1: clip for just a minute? This one little clip of
• 8:25
Speaker 1: behind the breezeway at the time of the shot. Judge,
• 8:28
Speaker 1: that's fine. And also just a reminder to all the parties,
• 8:31
Speaker 1: it's on your monitor. Please be cognizant of that. It
• 8:34
Speaker 1: will not be displayed on the main monitor. Ms. Nestor,
• 8:37
Speaker 1: you may proceed. Question, thank you. Is it playing? Okay,
• 8:41
Speaker 1: do you remember that? Does that refresh your memory of
• 8:43
Speaker 1: what's in that clip? Answer, yes. Question? And having reviewed that,
• 8:48
Speaker 1: at the time the shot was fired, there was no
• 8:50
Speaker 1: one standing directly behind the tent. Is that correct? Answer,
• 8:53
Speaker 1: you'd have to show me again. I wasn't specifically looking
• 8:56
Speaker 1: for that. Question, okay. Answer, but I can answer that
• 9:00
Speaker 1: question if I can view the video again. Question, okay,
• 9:03
Speaker 1: and just before you do that, I think you testified
• 9:05
Speaker 1: that Mr. Kirk would have been dead center behind the banner,
• 9:08
Speaker 1: is that right? Answer, approximately. Question, okay, so what I'm
• 9:12
Speaker 1: asking is if anyone behind the banner, dead center behind Mr. Kirk,
• 9:15
Speaker 1: if there was any people standing there. Go ahead. Answer,
• 9:20
Speaker 1: so there's a videographer on the right side of the tent,
• 9:23
Speaker 1: and then I can only see as far as the
• 9:25
Speaker 1: video allows me to, so I can't speak to whether
• 9:27
Speaker 1: there's anybody out of frame who could have been behind
• 9:30
Speaker 1: the tent. Question, but what you can see, is there
• 9:33
Speaker 1: anyone directly behind the middle of the tent? Answer, yeah.
• 9:36
Speaker 1: There's a videographer who stood behind the tent. Question to
• 9:39
Speaker 1: the right. Answer, yes, behind the tent. Question. Correct, but
• 9:45
Speaker 1: directly in the middle of the tent. Is there anyone standing? Answer,
• 9:48
Speaker 1: there is no one stood in the middle behind the tent. No. Question,
• 9:51
Speaker 1: thank you. All right. I want to talk now about TP.
• 9:55
Speaker 1: You can take it down off the screen. Thank you.
• 9:57
Speaker 1: I want to talk now about TPUSA video. that you got.
• 10:00
Speaker 1: That was the angle that was taken from behind Mr.
• 10:03
Speaker 1: Kirk while he was talking, looking out at the audience
• 10:06
Speaker 1: when the shot was fired. Do you remember that video?
• 10:09
Speaker 1: Answer the video, the visual impulse videos. Answer. Yes. Question
• 10:14
Speaker 1: or question. Yes. Answer. Yes. Question, all right, is it
• 10:18
Speaker 1: true that Visual Impulse provided four videos? Answer, yeah, I
• 10:22
Speaker 1: believe there were a total four videos that encompassed everything
• 10:25
Speaker 1: that they provided to us, yes. Question, but then the
• 10:29
Speaker 1: one that you showed, that's only one of the four
• 10:31
Speaker 1: videos they provided to you? Answer, that one was shown
• 10:35
Speaker 1: had a Bates number. It was an item that was
• 10:38
Speaker 1: provided by the Utah County Attorney's Office. Question, okay, but
• 10:41
Speaker 1: there are more that you haven't seen in the courtroom
• 10:44
Speaker 1: in this prelim that you got from Gets cut off
• 10:47
Speaker 1: by the agent. There's original footage. Question. Okay. But there
• 10:51
Speaker 1: were other angles that they have not shown here in
• 10:53
Speaker 1: this prelim. Answer. Yes. Question. Okay. That's what I was
• 10:56
Speaker 1: trying to get to. Thank you. All right. Were you
• 10:59
Speaker 1: involved in the gun that was located in the forest? Answer.
• 11:02
Speaker 1: I was not involved in the search for the gun. No. Question.
• 11:06
Speaker 1: Did you get noticed when it was located? Answer. From
• 11:10
Speaker 1: the footage that we reviewed, we identified an area that
• 11:13
Speaker 1: we believed could potentially be an evidentiary value of And
• 11:16
Speaker 1: then it was secured. And then I was notified that
• 11:19
Speaker 1: as a result of that search, a gun had been located. Yes. Question.
• 11:23
Speaker 1: Were you involved in processing the gun? In other words,
• 11:26
Speaker 1: boxing it, shipping it, sending it wherever it was going
• 11:29
Speaker 1: to be analyzed? Answer. I was not. All right, folks,
• 11:32
Speaker 1: we're going to wrap up right here. And in the
• 11:34
Speaker 1: next episode, we're going to pick up with Kathy Nestor
• 11:37
Speaker 1: doing the questioning. All the information that goes with this
• 11:40
Speaker 1: episode can be found in the description box.
