- 0:04We are faith and fury, love and fire.
- 0:09This is the human equation where every voice counts and every truth cuts deep.
- 0:17With your host, Joseph Panker.
- 0:20Good evening, everybody, and welcome to the human equation.
- 0:24I'm your host, Lieutenant Joe Hangar.
- 0:27So the title of this particular little get together we have here is Another Death in Minnesota.
- 0:35Now for my law enforcement brothers and sisters.
- 0:41I think there's an understanding of what it's like to be out there, out on the road, trying to do your job when people cooperate and when they don't cooperate.
- 0:52And that can cause a lot of problems.
- 0:55But I know a lot of people watch this, this and other programs that I do, because they're trying to have an understanding of what happened here.
- 1:03You know, a lot of people begrudgingly might look at the death of Renee Good in her confrontation with the ICE officers as being really difficult, unnecessary, but understandable.
- 1:20She did try and hit the guy with a car, he's allowed to protect himself, and she ended up dead.
- 1:26This one, Mr.
- 1:28Pritty, is having a little more difficulty.
- 1:31I think for everybody, law enforcement included, because we all know how much we train to employ force in the appropriate amounts.
- 1:43Now, first of all, the reality here is this.
- 1:47This is a terrible tragedy, as it is any time someone dies in a confrontation with law enforcement, whether it's justified or unjustified, it's it's a tragedy for everyone involved.
- 1:59And this is too.
- 2:00I would much rather Mr.
- 2:02Pretty be home right now with his family or in the hospital taking care of people who need care.
- 2:08That's I think we have to all say that in the beginning.
- 2:13But I think there's a lot, there's a lot being said out there and being done out there.
- 2:18Emotions are extremely high.
- 2:21And we can't, we can't truly comprehend the situation.
- 2:26We can't truly understand it and put it into perspective so that we can make a judgment on what happened here, justified or unjustified.
- 2:36That's what it comes down to.
- 2:40But the reality is that those two things are not as simple as black and white answers.
- 2:52There's there's there's a there's a whole panoply of things that we have to take take into account.
- 3:00Now I know a lot of you don't want to do that, and I think the reality is that many people, including many of the people who've written to me and texted me and reached out, are just so emotionally angry right now that they they're not thinking clearly, they're not seeing clearly, they are just emotionally reacting, and that's normal.
- 3:24That's a normal thing for people to do, but that is not how our justice system works.
- 3:31So I got an email from one woman who listens to this show.
- 3:35She's not law enforcement, uh, and a couple of the other shows that I do.
- 3:39And she has written to me several times.
- 3:41She's obviously very liberal, very far to the left, very progressive, and we made some progress in our conversations, you know, back and forth.
- 3:50But she just wrote to me recently, and she said, Okay, I can't wait to hear what Lieutenant Joe has to say about this murder and how you're gonna justify it as comply or die, which seems to be another left-wing tag that they're throwing out there now.
- 4:02Comply or die.
- 4:05And I'm not mad at this woman.
- 4:08I understand, but the reality is our justice system does not work when we just allow emotion to run wild.
- 4:16You know, words mean things, you know.
- 4:19We're hearing a lot of people who are conflating a bunch of things, and Mr.
- 4:27Pretty is simply the vehicle which to express those things.
- 4:32I think honestly, they are angry, they feel a sense of injustice, they feel a sense of anger.
- 4:40Uh, but I don't think it's just at this particular situation because these same people in reality, come on.
- 4:46Were they just as upset over Lake and Riley getting killed?
- 4:50No, they didn't they didn't say a word.
- 4:52They're upset with this because it is connected to something else in their life, and that thing that it's connected to is their hatred and disagreement of President Trump and his policies, and it's Trump derangement syndrome to a large degree.
- 5:11Now, I I thought that that was a funny, you know, a funny term that people came up with uh a couple years ago.
- 5:17But the more I've looked at it, the more it absolutely is true.
- 5:19People are psychologically damaged by this hatred they have for Donald Trump, and therefore it colors everything they see, and they sometimes they can't see clearly.
- 5:30I see all the comments now.
- 5:32People I know, people I went to school with that I thought were pretty reasonable people, they're on there going, okay, you MAGA animals, you Trumpers, let's you know, look at this now, what you caused, right?
- 5:43So, right off the bat, they're not talking about the interaction between Mr.
- 5:48Pretty and law enforcement and how it went right or it went wrong.
- 5:53They're throwing out there, you maggas, you Trumpers.
- 5:56So it shows that connection very, very clearly.
- 6:01And I know a lot of people don't want to hear that.
- 6:03They don't want to look at themselves and say, well, I'm reacting because of this.
- 6:07They're just there's a sense of injustice that this wasn't right.
- 6:10And like I said in the beginning, any time something like this happens, it's horrible.
- 6:16Um, it's it's horrible for Mr.
- 6:18Pretty for his family, his friends, for everyone who knew him and loved him, that he's gone.
- 6:24He's dead, right?
- 6:26But the law and justice demands that we remove emotion from the situation, and we review it for what it is, and it'll come out.
- 6:38The facts will bring out what happened here.
- 6:42So there's a couple of choices.
- 6:43So, first thing I'm gonna do is we need to understand the words, words are important.
- 6:47So, my book, The Investigation.
- 6:49Because I'm talking about criminal investigation, and in this book, I use a homicide that I investigated as the learning tool, as the vehicle to move the learning.
- 6:59Well, one of the first things I did in this book is I figured we have to understand the words.
- 7:03We have to understand what words mean.
- 7:06And I don't like to read out of things, but you know, one of the first things I put here is homicide.
- 7:11What is a homicide?
- 7:13Well, homicide recognizes that there are different kinds of killing of people.
- 7:20So, and then I break them down murder, manslaughter, justifiable homicide, excusable homicide, homicide by misadventure, uh, negligent homicide, reckless homicide, vehicular homicide, all of these different kinds of things.
- 7:33You say, Well, how can that be?
- 7:35It's murder, and this is where the problem comes in.
- 7:39Murder is a very specific thing.
- 7:43And people want to believe that, and this is where I think people are connecting their anger, their Trump derangement syndrome, their hatred of Trump and conservatives and conservative policy and all that it means, they're connecting that to this incident.
- 7:59So, as an investigator, as a human being, I have to look at this situation without emotion and try and figure out what happened here.
- 8:12So, people screaming and calling it murder, it's murder, it's murder, because we don't really understand words.
- 8:17People aren't in court, they aren't, you know, lawyers parse things into a thousand different things.
- 8:22Our law does that as well because there are different examples.
- 8:25If somebody was trying to break into your house and you protected your home by killing that person, is that a murder?
- 8:33No, the person's still dead.
- 8:34You did it, but was it a murder?
- 8:37It's not a murder, because there are different motivations that go along with the things that we do that determine what something is.
- 8:46So again, I'll go to the book, the investigation, and the first one I put in there, first definition besides homicide is murder.
- 8:55And here's the definition.
- 8:57Murder is the deliberate taking of another person's life with malice aforethought.
- 9:04That is done purposely with planning beforehand and with the intent to kill.
- 9:11This motivation must be established at trial for the finding of murder in the first degree in most jurisdictions.
- 9:17It is malice aforethought that distinguishes murder from other forms of homicide.
- 9:23So there are many different levels of homicide of taking a person's life, right?
- 9:28And we kind of went over that.
- 9:30So when I look at this as a law enforcement officer, I don't like how it looked.
- 9:34I'm gonna be absolutely honest with you.
- 9:37You know, I looked at the Renee uh good death, and I saw there was a lot of contributing factors, but it was inevitable what was going to happen once she decided she made the decisions, put that car in gear and go forward towards the officer, that that getting killed, getting shot was a distinct possibility for her, and that's what ended up happening.
- 9:58In this case.
- 10:00When we watch the videos and we see what took place, we saw an encounter where ICE was doing actually was border patrol was doing a job.
- 10:15My dog is even concerned, was doing a job, a particular job.
- 10:20They were trying to make an arrest.
- 10:22They have a legitimate, legitimate uh task at hand.
- 10:28It's lawful.
- 10:29They are law enforcement officers.
- 10:32They have a legitimate task to take someone into custody, to arrest someone, right?
- 10:38And that doesn't mean when it's convenient for the person or you know, when they have to go to a picnic or not before they go to church.
- 10:46The reality is if someone is wanted, they get arrested when law enforcement can find them and take them into custody.
- 10:54So in this particular case, they were doing an operation, the law enforcement personnel, border patrol.
- 11:01Mr.
- 11:02Pretty was there, and a woman got shoved and pushed out of the way.
- 11:05Why did she get shoved and pushed out of the way?
- 11:08Because she was in the way of the officers.
- 11:11We can't go around that.
- 11:12We can't get around that.
- 11:14I am a proponent.
- 11:16Protesting, I think is legitimate.
- 11:18You don't like something, you protest.
- 11:20There's I like to protest.
- 11:22But the reality is you have to protest in a particular way, otherwise, everything's out of control.
- 11:28So you protest, you stand on the sidewalk with a sign, you yell and scream, you bang your drums, whatever it is you want to do.
- 11:34You do not interfere with law enforcement officers doing their work.
- 11:40You don't stand in front of them.
- 11:42You don't get in their face, you don't spit at them, you don't throw rocks and bottles and chunks of ice.
- 11:47You don't wave your hands at them, you don't touch them.
- 11:51You do not interfere with their arrest.
- 11:53You don't do that.
- 11:54If you do all that, you're wrong, and those are crimes that you should be held accountable to.
- 12:01That being said, I watch this video and I see this start to unfold.
- 12:06Woman gets shoved, Mr.
- 12:08Pretty is there, he doesn't like it, he thinks it's inappropriate.
- 12:12He goes in to try and help this woman, he puts his hand on the officer.
- 12:17A scrum involves, and I like that they talk that it's scrum.
- 12:20Okay, it's it's a it's a conflict.
- 12:22Now you have multiple officers there because they need to have multiple officers, because the politicians in Minnesota will not have the local police assist the federal law enforcement.
- 12:34Therefore, they have to do two jobs.
- 12:35They have to do their arrest job and crowd control and riot control and protect themselves from the crowds, which have shown they will be violent.
- 12:46And I know some of you right now, especially people on the left.
- 12:50You you already can't see through your anger and your upsetness, you're already screaming, you're justifying it.
- 12:56I haven't said a word yet about whether I think it was justified or not.
- 13:00I haven't said a word about that.
- 13:01I'm trying to lay the groundwork of clear thinking, looking at an event like this.
- 13:07Okay.
- 13:08Uh juxtapose it with the Lake and Riley murder.
- 13:11Now that was a murder.
- 13:13This young man targeted this girl, assaulted her, and then purposely took her life.
- 13:18And that was his intent to take her life to keep her quiet.
- 13:21He murdered her.
- 13:22That was his intent when he went out there to find a victim, right?
- 13:26This case, we have officers doing a legitimate job, and citizens who have been enraged that they don't like the law being followed, and that's the butt again.
- 13:38We got to follow it back.
- 13:40What is it they're so upset about that rapists and pedophiles are being arrested to be removed from the country?
- 13:46Well, it's not that they don't that they like rapists and pedophiles, they don't like that illegal aliens are being removed.
- 13:55They think they should be allowed to stay.
- 13:57So that's firing them up.
- 13:59They don't they don't care what the law is.
- 14:02They think these people should be allowed to stay, and ICE is illegitimately doing that.
- 14:06Plus, they've been told their anger, their upsetness, their their rage has been fed by politicians who see benefit in doing that.
- 14:16All right, so I'm I'm getting off, but I want to make sure that we're still on the same page here.
- 14:22So Mr.
- 14:23Pritty goes over it, interferes with the officer.
- 14:27He didn't like the woman being shoved, he didn't think it was right.
- 14:31That's unfortunate.
- 14:32That's something you take up in a court.
- 14:33Did the officer shove the woman inappropriately?
- 14:36He'll have to pay a penalty for that if he did the wrong thing.
- 14:41So she gets shoved, he goes to try and help her.
- 14:44Now, in the moment, you know, there's a reason they call it fog of war, the heat of battle.
- 14:50Unless you've been there and done it, you have no idea what that's like.
- 14:54You just don't.
- 14:55People think they do.
- 14:57How many armchair quarterbacks do we have watching?
- 15:00Well, I would have done this, I would have done that.
- 15:02They never should have done this.
- 15:03Is not the right.
- 15:04Unless you've been in the middle of one of those things, one of those potentially bad things.
- 15:11You don't know what it's like, you don't know how it feels, you don't know how it changes your perception of things, which is the next thing we want to look at.
- 15:19The courts, the Supreme Court, all after the Supreme Court of the United States, has looked at interactions between law enforcement officers and citizens when there's been an injury or a death.
- 15:33And one of the things that the courts recognized, nine to nothing, even the liberals on the court had to recognize the reality of this, is that you have to take into consideration the totality of the circumstances.
- 15:49Now, for my friends on the left right now, I know your heads are blowing up because you just see murder, and Lieutenant Joe's trying to justify it.
- 15:56I'm not justifying anything.
- 15:59I'm helping walk you through this so you can think clearly to come to a an understanding of whether it was justified or not justified, whether it was murder, whether it was manslaughter, whether it was unintentional, whether it was intentional.
- 16:13See, there's all these different layers we have to figure out before we can make a judgment on what happened here.
- 16:19So I'm trying to give you the so Mr.
- 16:23Pretty goes over to interfere because he didn't like this woman got pushed.
- 16:26He doesn't like that ICE is out there doing their job anyway, and now you have this scrum that takes place, and people are wrestling around.
- 16:36Now, did he simply say, okay, I shouldn't I should have done it, but I didn't do it.
- 16:41But you know what?
- 16:43Let me just lay on the ground, put my hands behind my back and get handcuffed.
- 16:46And again, heads are exploding.
- 16:48He shouldn't have to do that.
- 16:49No, he does.
- 16:49That's what we all have to do when law enforcement tries to take us into custody.
- 16:54We submit to the arrest, whether we like it or not, believe it and not believe it, that's what you're supposed to do.
- 17:00He should have submitted to the arrest.
- 17:02They would have he should have told the officers.
- 17:05I'm armed, I'm a legal permit carrier.
- 17:08No problem with that.
- 17:09You're legal permit carrier.
- 17:11I carry a gun everywhere I go.
- 17:12I'm a legal permit carrier, right?
- 17:14Many people are.
- 17:16So he should have submitted immediately.
- 17:19He shouldn't have interfered with what they were doing.
- 17:23Once he was handcuffed, he could say, Listen, I'm armed, I'm a permit carrier, my gun is on my hip.
- 17:28They would have removed the gun and taken him into custody.
- 17:33That's a reality.
- 17:34That's a truth.
- 17:35You cannot like that truth.
- 17:37You can uh he had a right, he had no right to interfere and do the things that he did.
- 17:42Does that mean he should have gotten killed?
- 17:44No, it does not.
- 17:46Does not mean that at all.
- 17:48But we have to look at what the court said, the totality of the circumstances.
- 17:52That means everything that went on and the officer's mindset.
- 17:58Now, we already talked about the difference between the different types of homicides.
- 18:04Murder is specifically going, I'm gonna kill this man because I don't like him.
- 18:09I don't I don't care for him, I don't like his hat, I don't like what he stands for.
- 18:14That's murder, right?
- 18:16Is that what happened here?
- 18:19So we have to look at this.
- 18:20I so the totality of the circumstances have the officers that are involved, border patrol ice, have they been able to do their job all over Minnesota where they have a legitimate reason to do their work and legitimate authority to conduct raids and arrests and everything else.
- 18:40That's all legitimate.
- 18:41You might not like it, but it's all legitimate.
- 18:47So this confrontation takes place, and in the course of that, they're wrestling on the ground.
- 18:55Now that, like I said, unless you've been involved in one of those things, you have to really say to yourself, I can imagine, I think I know what it might be like, but you don't.
- 19:07The totality of the circumstances, these officers have been interfered with all over the city.
- 19:12They've been assaulted, they have been uh people tried to hit them with cars.
- 19:17A guy at one of the ICE agents had his finger bitten off the other day.
- 19:21They're getting rocks and bottles and things thrown at them day and night.
- 19:25This you can say, well, they shouldn't be there, it wouldn't happen, but that's not legitimate.
- 19:30Legitimate is they're there to do a law enforcement task, a job that's legitimate and legal, and they have a right to do it, and people are not just protesting, they're not waving signs.
- 19:42We hate ICE, get out of ice, ice get out of here, leave our friends alone.
- 19:46That's legitimate.
- 19:47They are getting in the road, getting in the way, trying to pull the officers off, trying to let people out of cars, hitting people with cars.
- 19:55All of this has been going on for weeks.
- 19:59Now the
- 20:00These officers are living with this every single day.
- 20:03Well, they should be better than that.
- 20:04They should be trained.
- 20:05They're human beings.
- 20:08Right?
- 20:08And they are trained.
- 20:11But you know what?
- 20:12There's a thing that things build up.
- 20:14And you start to anticipate the last three times we went to make an arrest.
- 20:18The crowd came out and did this.
- 20:21So therefore, you're preparing that that might happen again.
- 20:25So what am I going to do this time?
- 20:26You learn from each one of these encounters, don't we?
- 20:29Law enforcement guys and girls, don't we learn from these encounters that what might happen next, we have to be prepared for.
- 20:37So let's go back now.
- 20:39We have the totality of the circumstances.
- 20:41It's chaotic.
- 20:42People are very forward.
- 20:45They're interfering illegally.
- 20:47They are coming after the officers.
- 20:49There's a history officer who've been uh injured, almost hit by cars, all kinds of things.
- 20:55Now they have this guy who interferes with what they're doing, whether he liked it or not, the woman getting pushed.
- 21:01She shouldn't have been in their face, and she wouldn't have got pushed.
- 21:04She was on a sidewalk, she wouldn't have got pushed.
- 21:07And we can't discount that.
- 21:09Well, if the guy didn't rob the store, he wouldn't have got shot.
- 21:12Well, that's true.
- 21:13If he didn't go in there to rob the store and the cops showed up and shot him, he wouldn't have got shot.
- 21:17There are realities that our emotions prevent us from seeing truth.
- 21:24All right.
- 21:24And again, I'm not justifying or unjustifying what happened here.
- 21:27Laying out the facts, how to think about it.
- 21:31So Mr.
- 21:32Pritty involves himself in this situation.
- 21:34He gets shoved back.
- 21:35Then the officer decides I'm gonna pepper spray him.
- 21:38What's the purpose of the pepper spray?
- 21:41The purpose of the pepper spray is to cause pain and uncomfort so that the person backs away.
- 21:49That's what it's there for.
- 21:50That's called less than lethal tools that officers have.
- 21:56So officers don't immediately go to deadly force.
- 21:59There's a continuum.
- 22:01And the continuum raises the level of force based on what?
- 22:06The officer not liking the person.
- 22:08No.
- 22:09The level of the use of force on the continuum goes up depending on what the people, the officers are in uh interacting with, what they do.
- 22:18Put your hands behind your back and they do it.
- 22:20That's it, verbal.
- 22:21Handcuff them, you take them away.
- 22:23You're under arrest, put your hands behind your back, and they start to pull away.
- 22:26You put hands on them, all these people screaming, don't touch me, you have no right to touch me.
- 22:30Yes, they do.
- 22:30They have every right to put hands on you if you're not following a legal order.
- 22:34Whether you like it or not, that's the law.
- 22:38You decide to pull away, and now the officers have a couple of options.
- 22:41If they're going to arrest you, right?
- 22:44They're going to arrest you, they can pepper spray you to incapacitate you.
- 22:47So you can't see and you can't fight and they can get control of you.
- 22:51The officers are allowed to use a baton if you're fighting back.
- 22:55The officers don't have to lose the confrontation, right?
- 22:59So they're allowed to use a baton if they have it to do a couple of different kinds of hits that tell you I better stop fighting.
- 23:05This isn't good.
- 23:06That's the idea to get them under control.
- 23:09If a weapon is produced, the officer doesn't have to get shot or stabbed.
- 23:14The officer can then go to the highest level on the use of force continuum and use deadly force to protect themselves or someone else.
- 23:21Now, this is where calm, rational thinking is important here.
- 23:26Because we have to put together all of these factors, unique to this confrontation, as well as court rules and everything else that we go by to make a determination.
- 23:39What happened here?
- 23:40Was it justified?
- 23:42Unjustified.
- 23:43Was it somewhere in the middle?
- 23:44Were mistakes made?
- 23:46Absolutely legitimate reality, right?
- 23:49Officers make mistakes, they see things and react to things that they see, and sometimes they're right, sometimes they're wrong.
- 23:57So when we look at this situation, let's go back to our scrum now.
- 24:01You have an individual who interfered with the officers.
- 24:04No matter how righteous you think he was, he shouldn't have done it.
- 24:08Now they're wrestling around.
- 24:11And somebody sees a gun on this guy.
- 24:16Somebody sees a gun.
- 24:17Now it's pretty clear one of the officers went over and took the gun out of the guy's holster or out of his waistband.
- 24:26Sort of gun and removed it.
- 24:30But they still shot him, they murdered him.
- 24:32Time out.
- 24:33This is where your lack of experience of being involved in these things in the fog of war, and that's what this is this conflict, this is combat that's going on.
- 24:43Now you got somebody in the video screaming, gun, gun, gun, which means telling all the officers, not that the cops got guns.
- 24:51We all know that that the person on the bottom of the pile or the person resisting or the has a weapon.
- 24:57You have now increased the danger to every one of those officers.
- 25:04Whether you like it or not, that's the truth.
- 25:07So somebody sees the weapon.
- 25:09Now, in that conflict of taking him into custody, trying to get control of him, an officer saw an opportunity and took the gun away from him.
- 25:20Apparently, the other officers did not see that.
- 25:22That's what it looks like.
- 25:24Now we'll see body cams, we'll see officer statements.
- 25:27We'll look at 72 different angles here, and we'll have to make a determination of what actually happened without the uh emotional.
- 25:36He committed, they killed him, they executed him.
- 25:38No, they did not.
- 25:39They did not do that, I can tell you.
- 25:43Whether they were justified or not, that's what we're gonna find out.
- 25:46But in this case, the officer takes the gun and goes away.
- 25:49It looks like it appears that as that officer was walking away with this Mr.
- 25:55Pretty's gun, that the gun went off, the gun fired.
- 26:00Now, I've seen videos with that same exact model of gun that shows you can have the gun fire without pulling the trigger, apparently.
- 26:08Now, I don't know if that's true or not.
- 26:09I've seen videos where I have an expert, a guy who claims to be an expert, he's got that gun, he loads it, and he's pushing on the slide in the front, and the gun goes off like six times in a row.
- 26:18Maybe that's possible.
- 26:20Reports on the news that that gun is prone to uh functioning, shooting a bullet without pulling the trigger.
- 26:27It could be a design flaw, it could be whatever.
- 26:29I don't know.
- 26:31See, we don't know, but it appears that as that officer walks away with that gun, looks like the gun goes off.
- 26:38Now the officers in the scrum that are in this pile with a resisting man who interfered with their actions, whether you think he was justified to interfere or not.
- 26:50He pushed a woman, but that's terrible.
- 26:52The officer should be held accountable if he did something wrong pushing that woman, but that doesn't mean you get to jump in and interfere with the officers.
- 27:01Now they're in this pile, you hear gun, gun, gun.
- 27:04Somebody saw the gun, and that's what we're trained to do, scream out guns, so everybody knows there's a gun.
- 27:08Another officer gets a hold of that gun, and it looks like it goes off.
- 27:12Now, from my experience there, unless I saw that gun go off over there where that officer is, or if I'm looking here where the fight's going on, which I'm probably looking at the guy I'm fighting with, not over there, and a gun goes off.
- 27:29I don't know that that guy didn't get a hold of that gun, and he's shooting at me and the officers.
- 27:37Now you might not like that because he didn't have the gun, he didn't have the gun.
- 27:42I know he didn't have the gun.
- 27:43I'm I agree.
- 27:44I saw the gun leave the scene.
- 27:47But the reality is, remember the totality of the circumstances.
- 27:54Sometimes this is uncomfortable, but the totality of the circumstances is that did the officers perceive gun gun gun?
- 28:03There's a gun on the scene, then a gun goes off.
- 28:06They're fighting with a guy that had a gun that's interfering, that's resisting.
- 28:14Did the officers at that moment perceive that they were in danger?
- 28:19And did that officer who appears that when you hear gun gun gun, he draws his weapon because his partners are screaming, somebody's got a gun, somebody better get ready.
- 28:30Right.
- 28:32He draws his gun, and now he sees the guy moving.
- 28:35Did he think hearing the gunshot, hearing gun gun gun in a fight with a resisting individual, think that that person had the weapon and just fired it, and therefore to protect himself and the other officers, did he fire his gun and hit Mr.
- 28:52Pretty ultimately who died?

- 32:40America Outloud Doc News is that place to awaken your heart, soul, and mind to the outlook.
- 32:58The reality of having to look at this situation, not just by the outcome, but what led to it.
- 33:04Does that mean it's not a tragedy?
- 33:06Of course it's a tragedy.
- 33:08It's horrible.
- 33:08A man lost his life.
- 33:11Right?
- 33:11He was just out there protesting.
- 33:13He was out there just interfering.
- 33:14He was just out there getting in the way.
- 33:16And he ended up dead.
- 33:18That's terrible for him and his family.
- 33:21For us, for all of us as Americans, it's terrible to watch this going on.
- 33:26But that's how we have to look at this.
- 33:28So by our own definitions, to say that it was murder for you people out there saying murder, murder is throwing that word on a on a law enforcement confrontation is like throwing gasoline on a fire.
- 33:42Right?
- 33:43Because murder is very specific.
- 33:46That would mean that those officers saw Mr.
- 33:49Pretty and said, Oh, let's kill this guy.
- 33:53We don't like what he stands for.
- 33:54We don't like that he's protesting.
- 33:57We don't like that he's trying to stop us from doing our job.
- 34:01Let's kill him.
- 34:03That would be murder.
- 34:04That would be murder.
- 34:07Is that what happened here?
- 34:09Is that what you really think happened here?
- 34:11That those officers are out there doing that.
- 34:13Remember, totality of the circumstances.
- 34:15They're legitimately in Minnesota.
- 34:18They are conducting a legitimate law enforcement operation.
- 34:22They were interfered with illegally.
- 34:24Mr.
- 34:25Pritty resisted illegally.
- 34:28And I'm not even getting to the fact that he's a permit holder, gun holder, and he was supposed to have ID until the cop said, I'm not even going to get into that.
- 34:35It happened too quick for that.
- 34:36It's a reality, these things happen very fast.
- 34:39And the courts recognize that as well.
- 34:43Officers have to make split second decisions based on their perception of what's going on, not your perception of watching a video or being angry with Trump or thinking I shouldn't be there or anything else that's going on.
- 34:58The courts recognize that in that moment, the officers are legitimate.
- 35:02They're doing a legitimate job.
- 35:04The situation got out of hand, and the officers reacted based on what they perceived at the moment.
- 35:11Now we have to stitch that all together.
- 35:14Now, based on the officer's statement, other statements people say, we'll find out.
- 35:19Was it a murder?
- 35:19Did they go there and say, let's kill that guy?
- 35:22I don't like that guy.
- 35:24I don't like that he's protesting.
- 35:27Let's kill him.
- 35:28If they do that, and they can they can find that his statements to that effect, that's murder.
- 35:32Then you charge murder and you go to trial.
- 35:36What's less than that though?
- 35:40Like I told you in the book.
- 35:41Get the book.
- 35:42The investigation.
- 35:43Learn when you're trying to figure out these things.
- 35:45Next down is manslaughter.
- 35:47Manslaughter is the unlawful taking of another human being under circumstances other than murder without expressed or implied malice.
- 35:57This includes reckless actions that cause the death.
- 36:00Such as like when you punch somebody in a bar fight, you're fighting.
- 36:10Guys dead.
- 36:11It's a homicide.
- 36:12But is it murder?
- 36:14Did you intend to kill him?
- 36:15No, you want to punch him in the face, get him away from you.
- 36:17And he hit his head and died.
- 36:18That's manslaughter.
- 36:19There was no intent to kill him, but he ended up dead anyway.
- 36:23Now the court looks at all of those factors.
- 36:26Doesn't say murder.
- 36:27It wasn't a murder.
- 36:28He didn't go to intending to kill the guy.
- 36:31It happened in the confrontation.
- 36:32So is that what happened here?
- 36:34Is this a confrontation that went bad?
- 36:39And the officers acted recklessly.
- 36:44Right?
- 36:45They acted recklessly that caused the death.
- 36:49On unlawful killing.
- 36:51See, so this is where all of these terms and case law makes a difference.
- 36:55So unlawfully killing him.
- 36:58So first of all, we have to go back now to what was the officer's perception.
- 37:03What led up to this?
- 37:04The scrum, the gun gun, gun gun, the gunfire.
- 37:11If it turns out that the court looks at this and says, in the totality of the circumstances, the officer thought he was in danger and he took action, firing his service weapon and killing Mr.
- 37:23uh Mr.
- 37:24Pretty.
- 37:25Then it's not unlawful.
- 37:29Then it's not unlawful if he acted under the law that exists.
- 37:34Therefore, it wouldn't be manslaughter.
- 37:37Right.
- 37:39Would it be a justifiable homicide?
- 37:41Could be.
- 37:42Somebody breaks into your home, you tell them to get out.
- 37:46Your wife and children are in that house, and this person's coming in, they're carrying a baseball bag.
- 37:51You have a handgun or a shotgun.
- 37:52You tell them, get out of my house, and they keep coming forward, and you shoot them.
- 37:57The totality of the circumstances.
- 38:01What happened here?
- 38:02Guy broke into your house.
- 38:04Well, he just wanted your stuff.
- 38:06Did you see that woman screaming and hollering her son robbed the guy and the guy killed him?
- 38:09And all he wanted to do was rob you and you murdered him.
- 38:12Ridiculous.
- 38:13We're ridiculous with some of our thoughts.
- 38:15So the burglar breaks into your house.
- 38:17He's got a baseball bag.
- 38:18Maybe he didn't have a baseball bag.
- 38:20Maybe he came in and when he saw you with the gun, he picked up something in your living room, a little metal statue.
- 38:26He's going to beat you over the head with it.
- 38:28Doesn't matter.
- 38:29If you felt and a reasonable person felt in danger for me and my family at that moment, and you fire and kill that person.
- 38:37Was it murder?
- 38:38Was not murder.
- 38:40Was it manslaughter?
- 38:41Well, if you were justified in doing what you did, it wasn't unlawful.
- 38:47Therefore, it could be a justifiable homicide.
- 38:50A police officer pulls over a car and the driver hops out with a gun and starts shooting at the officers.
- 38:57They return fire and kill the man.
- 39:01It's not murder.
- 39:02It's not manslaughter.
- 39:04It's a justifiable homicide.
- 39:06Force was used against them.
- 39:07They went right up to continuum, the deadly force, because that was being sent on them.
- 39:12And it's justifiable.
- 39:14Okay.
- 39:17Get the book.
- 39:19Civilians and cops.
- 39:21Let's let's all get on the same page here with things.
- 39:23All right.
- 39:24So now let's go back to Mr.
- 39:26Pretty in the situation.
- 39:27I'm gonna wrap this up.
- 39:28I know I've been gonna go a little bit here.
- 39:32Is it terrible and horrible that he is dead?
- 39:34It is.
- 39:35He's a human being, he has family, he has friends, people love him.
- 39:38Obviously, he's a great guy.
- 39:39He's a nurse.
- 39:40Nurses are are awesome, right?
- 39:44But we have to look at the facts.
- 39:46Is it a murder?
- 39:47It's not a murder.
- 39:49Is it a manslaughter?
- 39:51Maybe.
- 39:52If the court and everybody else determines based on the facts that a reasonable officer would not have thought they were in danger.
- 40:00And therefore it was reckless what the officer did, then the officer probably be held accountable.
- 40:07Manslaughter, some kind of manslaughter, reckless, reckless manslaughter.
- 40:10That's a reality.
- 40:11That's we all know that going into the job when we go there.
- 40:14If we if we do things wrong, purposefully, that can be one thing that we did.
- 40:21If we do something wrong negligently, carelessly, that can be another uh responsibility we have to carry as law enforcement officers.
- 40:31In this case, we're gonna find out.
- 40:36We're gonna find out by an investigation.
- 40:38Now I know people don't want to hear that.
- 40:41You see an unarmed man got shot.
- 40:43Well, unarmed men get shot all the time, justifiably.
- 40:48You know, I'm 220 pounds, and if I'm fighting a 390-pound linebacker who's 27 years old and he wants to choke me to death, and he don't have a gun, and I feel I'm gonna die.
- 40:59I can use deadly force to protect myself.
- 41:01He's an unarmed man, but his hands were weapons, his size was a weapon.
- 41:09A car can be a weapon.
- 41:10There's a lot of things out there that put people in danger, and we don't have to get hurt, anybody, civilian or a law enforcement officer, right?
- 41:18So, Mr.
- 41:19Pritty, let's look at let's look at this.
- 41:21The officer may have been wrong.
- 41:24He may have misjudged, he may have overreacted, he may have done a hundred things improper, and he'll be held to account if he did that.
- 41:35If the facts show he did something purposely wrong, he'll be held to account.
- 41:42If he did something recklessly, negligently, carelessly, he might be held to account for that.
- 41:48That's how the system is set up, right?
- 41:52He also might be found based on the totality of the circumstances, that he thought his life and the life of his partners was in danger, and he took action to protect himself and those officers.
- 42:04And unfortunately, horribly, Mr.
- 42:09Pritty is dead.
- 42:10Now, I wouldn't want that to happen to somebody in my family.
- 42:13I wouldn't want it to happen to me.
- 42:15But let's look now at the next thing that's uncomfortable, especially for my friends on the left who right now in the smoke's coming out of your ears, you're you're babbling, you're you you spitting foam up at the mouth.
- 42:25I understand.
- 42:26I've talked to you many times, I've emailed and talked to you in person.
- 42:30These are facts, this is reality.
- 42:33I don't like it that this man's dead.
- 42:35You don't like it.
- 42:37Doesn't take away from the reality that he was the officers were there legitimately to do a legitimate job.
- 42:42They are law enforcement officers, and citizens have a duty to comply with law enforcement, not interfere, not get in their way, not harass them.
- 42:52You could protest, stand on the side with your sign and wave you hate everybody in the world, doesn't matter.
- 42:56You're allowed to do that, and I support you.
- 42:58Do not get in the way of law enforcement.
- 43:01It's dangerous.
- 43:02Things can happen purposely, accidentally, right?
- 43:07And people can end up dead.
- 43:09So let's look at Mr.
- 43:10Pretty.
- 43:11And again, I have great sympathy for him and his family, and my whole country I have uh, and for the officers.
- 43:18He could have been protesting on the side of the road.
- 43:20He didn't like that woman got pushed.
- 43:22Well, I didn't like it either.
- 43:24I don't like to see a woman pushed and shoved.
- 43:26I've ever watched a thousand of those videos where these officers are shoving these people out of the way.
- 43:30I've been in other scenes where people get in your face, they're coming at you.
- 43:34Well, you don't have to take a beating, you don't have to be harassed, you don't have to be impeded with.
- 43:37You have a job to do, a legal job.
- 43:39You shove them out of the way.
- 43:41That's probably the least you could do when someone's right on top of you coming out, shove them out of your way.
- 43:45Maybe they'll get the idea.
- 43:47When that didn't seem to work, when Mr.
- 43:49Pretty kept coming, now the officer sees him with this woman.
- 43:52What's going on there?
- 43:54Is he wrestling with it?
- 43:55Whatever.
- 43:56So they try and pull him off.
- 43:57This guy is out of control.
- 43:58Let's pull him off, right, wrong or indifferent.
- 44:00That's what it looked like to me on the video.
- 44:02Mr.
- 44:02Pretty is now with this woman, and is he helping her?
- 44:06Could have been helping her, could have been picking her up.
- 44:08I don't know what their situation was.
- 44:09The officer decides, okay, pepper spray is the answer.
- 44:13Let me spray these people, back them up, and that'll be that.
- 44:16And he sprays them and backs them up.
- 44:18Then they made the decision for whatever reason, and we'll find out that they were going to take him into custody.
- 44:25Did he submit to being arrested?
- 44:28Doesn't look like he did.
- 44:30Looks like he resisted.
- 44:32Now, why?
- 44:33Maybe because he had pepper spray in his face and he was disoriented.
- 44:36It's possible.
- 44:38Maybe he was just so angry with ice for doing their job that he doesn't think they should be doing.
- 44:43Maybe because the mayor told him I you should stand up to these people.
- 44:47So he's gonna fight.
- 44:49Whatever, he fought.
- 44:50He was down on the ground, he's carrying a gun.
- 44:53The officer seed a gun, an officer removes the gun, gun goes off.
- 44:57An officer maybe, maybe, I don't know, whether he perceived that the gunfire was coming from the bad guy.
- 45:05Maybe he didn't see the gun taken away by the other officer.
- 45:08There's gunfire on the pile.
- 45:09Well, you know, it's not the other cop shooting at you.
- 45:12It's gonna be the bad guy.
- 45:14In this case, Mr.
- 45:15Pretty was the bad guy because he was resest resisting and impeding.
- 45:19And the officer took action.
- 45:21Now, ultimately, that action will be defined by a court.
- 45:26And if the court finds the officer acted purposely, negligently, recklessly, the officer will be held to account by the laws of our nation.
- 45:36And he will have a trial.
- 45:38People will determine was he right or wrong in doing what he did.
- 45:42Either way, it doesn't bring Mr.
- 45:44Pretty back.
- 45:45He doesn't come back.
- 45:47And that's the tragedy in this situation.
- 45:49So what's the lessons we can all learn?
- 45:52For all my friends out there in Minnesota and every other city and state where you don't like what's going on.
- 45:58Well, first of all, go to your legislature and tell them, oh, we want an open border.
- 46:04We want everybody to be able to come in and be left alone.
- 46:07That's the first thing you do.
- 46:08Go and protest.
- 46:09Hang go put your signs up.
- 46:11Let everybody in.
- 46:12Everybody's a person.
- 46:13There is no illegal person, right?
- 46:16Whatever you want to say, do that.
- 46:18Do not go out to the street and impede a law enforcement operation.
- 46:24Do not get in the middle of it.
- 46:26Do not go in and scream and yell in the face of officers that are conducting their work.
- 46:31Do not try and pull people out of cars.
- 46:33Do not try and pull the officers away.
- 46:35Do not try and stop the officers from making an arrest.
- 46:39These are the lessons we learn.
- 46:41Protesting is legitimate, and I support your right to protest.
- 46:46I think most officers do.
- 46:48We're constitutional kind of people.
- 46:50We live and breathe.
- 46:51We walk the constitution every day.
- 46:54But don't interfere with law enforcement.
- 46:58Don't get in the way of law enforcement.
- 46:59Don't impede them.
- 47:00Don't hurt them.
- 47:01Don't put your hands on them.
- 47:04And if we do that, the chances of us getting injured or killed by law enforcement.
- 47:10It's almost zero.
- 47:13Right?
- 47:14So that's what I want to talk about.
- 47:15So for all those people out there who wrote to me, emailed to me, talked to me, and said, Oh, we're just going to see Lieutenant Joe's just going to say comply or die.
- 47:24You're not really thinking clearly.
- 47:27You need to ask yourself, why am I not thinking clearly?
- 47:30I disagree with this.
- 47:32I don't think these Trumpers, these maggots.
- 47:35Well, if you're thinking like that, you're not thinking clearly.
- 47:40And if you're not thinking clearly, how can you make a judgment on anything?
- 47:44So ask yourself.
- 47:47Why am I so upset?
- 47:48Am I upset?
- 47:49Because I really want people from all over the world to be able to come here without a problem.
- 47:54Everybody should be able to come here.
- 47:56I believe that.
- 47:57Then you vote for people who are going to give you that.
- 48:00Right?
- 48:01I don't think I should be out there.
- 48:04Well, your local police are out there and you'll get arrested if you do something illegal and they see it, whether you like it or not.
- 48:10This is how our system works.
- 48:13You work through your legislature to change things.
- 48:15You don't go out and get in the way of the cops.
- 48:18Very simple.
- 48:20If Ms.
- 48:20Good got out of the car when she was told, if she wasn't blocking the road, she wouldn't have come in contact with the ICE officers.
- 48:28If she had gotten out of the car when she was told to get out of the car, she wouldn't have had a bigger confrontation.
- 48:35If she didn't drive towards the officer and hit him with her car, she wouldn't have got shot.
- 48:41Unfortunate, all the way around.
- 48:44If Mr.
- 48:44Pritty had been on the sidewalk and protesting, legitimate.
- 48:50The minute he stepped in to the road and got in the way of the officers, put a hand on the officers, tried to interfere with the officers.
- 49:00That led to the cascading set of events.
- 49:05Excuse me.
- 49:07Terrible.
- 49:09That led to the confrontation that led to his death.
- 49:13Now I'm not saying he's responsible for his death.
- 49:16We're going to find out.
- 49:16The courts are going to tell us, was the officer right or was the officer wrong?
- 49:23I wasn't on the scene, but I've been in those kind of scrums.
- 49:26I know what it's like.
- 49:27I know what that fog is like.
- 49:29The court takes that into account.
- 49:32As terrible and tragic as it is, if he stayed on the sidewalk and waved his sign and screamed and hollered, and I know he didn't have a sign, saying, could have had a sign, right?
- 49:43He'd be with his family and friends today.
- 49:45So there's our lesson for everybody out there.
- 49:47You want to protest, go do it.
- 49:51Don't commit crimes while you're doing it.
- 49:52Don't interfere with the police.
- 49:54All right.
- 49:54And I'm sorry if that hurts somebody's feelings, but that's how I feel about it.
- 49:58And I hope that we come to some kind
- 50:00Of a resolution of this quickly, and we understand going forward.
- 50:04The politicians there, the first thing you should do is turn around this sanctuary nonsense of saying you're not going to support the law.
- 50:12You're not going to support law enforcement.
- 50:14Get out there and help the officers do their job.
- 50:18You don't agree with it?
- 50:19Change the laws.
- 50:22So, as we can tell, it's a very serious topic, you know, this whole thing.
- 50:28Our country is so divided right now that it's very difficult sometimes to figure out exactly where we should stand.
- 50:36You know, we argue and fight over everything.
- 50:40And only now it's not it's not really just about policy.
- 50:45It's not just about we agree or disagree with each other.
- 50:50You know, the violence that's taking place in Minnesota is deeper than that.
- 50:55The violence in Minnesota is rooted in a fundamental change in how our nation is going forward.
- 51:04And I know President Barack Obama said the thing he wanted to do was fundamentally change America.
- 51:13And it was the beginning of an attack on traditional America.
- 51:22Now, it I don't mean he started the entire thing.
- 51:25His actually became effective.
- 51:27Let me put it to you that way.
- 51:28Up until then, we had people that wanted to change America.
- 51:31They, you know, wanted to change the way we are, you know, the whole uh denigrating of our nation and of our people and of uh specific groups like white men within our nation, you know, uh that began earlier, but it was enhanced by Barack Obama.
- 51:52And he really opened the floodgates to that.
- 51:58We have found ourselves where the people on the left, and I think we they are a diverse group of people, and I don't mean diverse by race or religion.
- 52:09They are a diverse group of people in thought, regardless of their race, religion, or etc.
- 52:15You have moderate Democrats who are more traditional, and then you have extremely radical socialist communist members of their party that they have now.
- 52:28The difference is, well, the Republicans, they have a diversity of opinion too.
- 52:32You have very weak spined backbone people who call themselves Republicans, and then you have some very strong conservative Republicans.
- 52:41They're outnumbered by the weak ones, unfortunately.
- 52:44But when we look at the Democrat Party, they have been overwhelmed by their uh outrageous left wing.
- 52:53The outrageous socialist communist progressive wing, the AOCs of their party.
- 53:00The Bernie Sanders was a guy that should have disappeared to the dustpin of history after the last couple of arrests, and instead he's gotten more prominent, and his role of socialist communist uh is actually gaining uh steam.
- 53:15We have uh uh mayor Mam Domini in New York, we have other social Democrats socialists uh who are actually communists.
- 53:24We see the hand of the uh enemies of America uh financing all the violence in Minnesota.
- 53:32They have chosen Minnesota to be the location where they have a population that's willing to join in.
- 53:39I'll the George uh Floyd riots where they burn the city down, they have a very weak left-wing progressive socialist governor who's willing to allow it to happen to enhance political goals.
- 53:52You have a very, very weak mayor, uh, same thing, he's willing to, you know, advance goals uh as opposed to doing what's right for the people of Minnesota.
- 54:04Now, the people of Minnesota have every right to be left-wing progressive, socialist democrats, communists, they can do whatever they want there.
- 54:13They certainly can.
- 54:15And that that's their right.
- 54:16If the community chooses that's what they want, well, then that's they should get what they want.
- 54:21But the problem we have as a nation is that this salvo is uh we we think people think it's well it's it's a homegrown kind of a thing.
- 54:33It's uh we're fighting for democracy and freedom.
- 54:36If you actually take time to go and study um the writings of Marx and Lenin, if you go to watch how left-wing communist uh governments have come to power, what they've said and done, the the methods that they use are exactly what's being exposed right in front of us today here in America.
- 55:00Only nobody wants to believe that because most of the people who are out there doing this, they are they are being manipulated, right?
- 55:08They're good people and they want to do good things, and we got this whole you know, twisted mindset uh in America now that just doesn't make any sense.
- 55:20One of the programs I did recently, I said we should we should find a way to to stand up and that's enough.
- 55:26That's enough of this nonsense.
- 55:27It's good to be um is good to be tolerant of other people's ideas and thoughts and lifestyles.
- 55:34Nobody deserves to have anyone attack them.
- 55:36You can be and do and say whatever you want.
- 55:40But there comes a time when the adults in the room have got to look around and say, that's nonsense what you're saying.
- 55:47Go ahead and do it in your community, but don't expect anyone else to go along with it because it's not good what you're doing.
- 55:54It is dangerous what you're doing, and they are being manipulated.
- 55:58You know, you you see you see such parallels to previous incidents of the rise of uh communist tyrannical types of governments, they do the exact same things over and over and over again, and except now it's happening here in America.
- 56:16And Minnesota is just a symptom of this.
- 56:19And the people that are there, like I said, and the people who support this all across the country, you know, Barack Obama deported many, many more millions of people.
- 56:29Nobody lifted a finger, nobody said a thing about it.
- 56:31It's Trump derangement syndrome, which is a very, very useful disease.
- 56:38Um that are the people on the left who are behind this, not the people who just want to do good and they're out in the street because they think they're fighting for justice, and they don't realize they are actually undermining democracy with their behavior, right?
- 56:54And this is what we're seeing all across the country, and I'm gonna say that it's probably going to pick up as time goes by because if you've listened to any of my previous programs going back years, I have always said the reality, as I see it, is that humanity uh humanity lives under the default position of tyranny.
- 57:14That is a natural way for human beings to live.
- 57:17The strong man makes the rules, and everyone else is just subjected to it.
- 57:21And I think America has been the experiment that's been different than that.
- 57:26And we're seeing that experiment be challenged.
- 57:29We're seeing the media on board, and we're seeing outside influences come in to try and destroy what we've had for 250 years.
- 57:37And we need to stand together, my friends, to make sure that America does survive.
- 57:42We'll be back again.
- 57:43Have a great day,
