- 0:58two on this Thursday morning at her Are you painting this here with the Peyton
- 1:00Law Firm in Nitro. I'm Jeff Jenkins and Harvey's right by my side and
- 1:04he's ready to take your call and he questions about the law. Three oh
- 1:07four three four five fifty eight fifty eight. Three oh four three four five
- 1:12fifty eight fifty eight. Good morning, sir, well, good morning,
- 1:15Jef Jingins. I understand you, uh you grace the wilds of Putnam and
- 1:21Mason County this past week. But you did not get a shovel at the
- 1:23New Core right now. There are only five hundred and fifty of them,
- 1:26so I can't well, I mean, they didn't think the Metro News was
- 1:30was one of the top five. They probably they probably let me grab one
- 1:34if I wanted one. Probably, Well, yeah, I mean it's it's
- 1:38a big deal New Core. It's not a it's not a phantom deal.
- 1:42It's not like you know, sonically tuned ammunition or or a billion dollars,
- 1:49billions of dollars from the Chinese. This is a solid development on really great
- 1:53property, great land down there. You saw it, Yeah, the Apple
- 1:56Grave area, that area, it's amazing piece of property is And you know
- 2:00from my family on my dad's side or my grandmother's side, my grandmother Peyton.
- 2:07I mean they're from like sixteen mile Creek, Henderson's south side couch.
- 2:14So you know, all my life that I can remember, had been driving
- 2:16up now it was in Route seventeen it's now thirty. It was it was
- 2:22the thirty five now it's eight seventeen down the river to Point Pleasant and Henderson
- 2:28to visit like my dad's first cousin. I thought call him my uncle because
- 2:32he was my dad's in Houston. Kaufman and his wife Emma had a dairy
- 2:37farm there, and then his sister Rachel Somerville lived next door at a nice
- 2:42farm, and you know, every now and then we'd drive down route to
- 2:47to visit some relatives at Applegrove. But you know, it's over the years.
- 2:53I just watched Point Pleasant. It's sort of slowly contracted. Once the
- 3:00Silver Bridge fell. You know, the traffic used to have to run right
- 3:04through downtown Point Pleasant if you were going over to Ohio, like if you
- 3:07were on the road to date and you would drive down seventeen. I mean
- 3:13Route thirty five was on the north side of the river at that time,
- 3:15which is now Route sixty two. It's much worse road, so most people
- 3:20would go down seventeen. You'd cross what was called the Shadle Bridge, named
- 3:23for the Shadle family. They had the dairy, which is the Mount Vernon
- 3:29mansion you see there. Now. Go down Main Street where Vyan turn left
- 3:36and go across the bridge at the Silver Bridge right there by the courthouse.
- 3:40And didn't a little town called Canaga on the other side of the High River
- 3:45and then back down to Point Pleasant now on thirty five, I mean once
- 3:47that happened in the fall of sixty seven was yeah, in December sixty seven
- 3:54the bridge fell. Well, that just killed traffic three point Pleasus and then
- 4:00the new Silver bridge was built across the river. And it's but I look
- 4:04for a bounce back, you know. My daughter went down to the Mothman
- 4:09Festival. As time said, it was so crowded that you had to stand
- 4:13in line for most things. They've got at the old hotel, the Low
- 4:15Hotels now changed hands again, it's been revitalized. They've got beautiful if you
- 4:19go down to Point Pleasant and go out, go outside the flood wall on
- 4:24the on the river side, there's a nice walkway. They have gorgeous murals
- 4:28done professionally by an artist from a belief Pittsburgh. And in the two Indie
- 4:33museum there at the Point quite interesting, the Riverboat Museum. And I understand
- 4:41that now we're going to perhaps have a Hilton Garden or some sort of Marriotte
- 4:47affiliated hotel on the other side of the river where Henderson is now, not
- 4:51in the the point land there that's owned by mccauslin's and that's probably not going
- 4:57to change hands. But right downtown we're Henderson b McDonald's over there until the
- 5:02new bridge was built to replace the Shale bridge, and he took the land.
- 5:05But good things are happening, and it's good for Putnam County. It's
- 5:09actually good for the whole region, as you found out when you drive from
- 5:15if you're at the Winfield interchange off of I sixty four, or say you're
- 5:21at the Crooked Creek interchange, we were out thirty five and sixty four come
- 5:26together, you're as close to the New Core plant as if you're in downtown
- 5:30Point Pleasant, because it's sort of that upper loop. You know, the
- 5:33High River runs almost due north past New Core. That makes a little bend
- 5:39to the east and south, and there's Point Pleasant where the Kanal River comes
- 5:43in. But you can cut straight across from Buffalo on what's called Jerry's Run
- 5:48and man pop pop right out there at it's the Palmar store, and then
- 5:54take it right and you're right there at the plant. So what you say,
- 5:57it took you forty nine minutes. Forty nine minutes from the plant parking
- 6:00lot to downtown Charleston yeah, in the ring. In the ring. Yeah,
- 6:04I wasn't pushing it either, Yeah, it was it was. Yeah.
- 6:06I suspect that road's going to be improved. Jerry's run will be because
- 6:11you've got so much developable land. You've got Fraser's Bottom, You've got a
- 6:16lot of land there at Buffalo. You know, you've got really good industrial
- 6:21locations right off the Route thirty five there at the Putnam County Development Authorities Industrial
- 6:28Park, which is now starting to really boom again. You know, they
- 6:30sold two big parcels last month. We'll see. I mean, it's good
- 6:35for everybody. And that's the kind of a big starting with eight hundred employees.
- 6:41Well, you never know where that's going to lead. You know,
- 6:43when Toyota came to Buffalo, he started what seven hundred employees, Well that's
- 6:49almost two thousand, and the attendant industries. There's this trucking company, a
- 6:55Rush Transport. There's sort of a captive company with Toyota to the hall where
- 7:00there's a recycling company there. There's also over in the industrial park, you
- 7:04know, an Italian company that makes wiring harnesses. There's another enterprise in Eleanor
- 7:12that makes parts that are used by Toyota. So you know in Puttinnham,
- 7:15we've probably got three thousand. Now they don't all to live in Putnam County,
- 7:20so in Mason County. Some of them live over in Ohio. But
- 7:24hey, job's a job, right, They got to spend their money someplace.
- 7:27So it's an exciting time. We look forward to it. It's a
- 7:30long way from I first had an open an office in Nitro in May of
- 7:38nineteen seventy seven. That's a long time ago, right, that's forty what
- 7:43forty five years ago or better. And the only thing at the Winfield interchange
- 7:48at that time. Paul Cooper, whose son Steve still has a garage down
- 7:53in or bought a repair shop down near Winfield. Paul Cooper had an Exxon
- 7:58station which is the bill is now med Express. Across the road. A
- 8:03man named Frank shirt Singer had a little truck stop it's now Truck Stops of
- 8:07America ta Eddie Row and had a tractor sales. And that was it.
- 8:13Mount Vernon Baptist Church, which is ever present, was there on the hill.
- 8:16That was it was. The rest of it was this farmland. Calvin
- 8:20James had a fishing lake down there which is now Lake Sheedessa Drive surrounded by
- 8:24houses and it was a miniature golf course, and I mean that was just
- 8:30it. You drive down the valley road and you passed more cows than you
- 8:33would houses. And now you know, forty some years later, it's just
- 8:39booming and has been could have been booming even greater had we had the foresight
- 8:43in the nineteen sixties to overcome the resistance of the Kanawa County Commission and the
- 8:48children controlled newspaper bull the Dickinson controlled newspapers and built a modern airport. But
- 8:54you never know. That's that's that's a counter factual, but it's it's almost
- 9:00painful to think about what could have been had we had a really regional approach
- 9:03at the time, and seeing like Huntington, Capitell and Putnam County. Did
- 9:09you know, a job here is as good as a job there. If
- 9:11you're all in this together, we'll see. So what's happening in illegal Well,
- 9:16yeah, three or four given the number here, three or four,
- 9:18three four five fifty eight fifty eight. Three oh four three four five fifty
- 9:24eight fifty three or four three four five fifty eight fiftyeight, Harvey's here any
- 9:28questions about the law. Well this whole there's some things going on about and
- 9:33we've talked about this a little bit about the class action lawsuit against in connection
- 9:39with corrections right in the state of West Virginia, and so Jojobahasson or Magister
- 9:46Judge alba Haasson, you know, Governor Justice and Brian Abraham don't want to
- 9:52give depositions, and so I think Albaha Haaston yesterday kind of took a step
- 9:56back. So well, let's take a look at this. I mean,
- 9:58no one seems to be be able to agree whether they should. So you
- 10:01know, I'm going to issue a stay right for the time being and see
- 10:05what happens. Yeah, the way it works in the federal system, there's
- 10:09a city, there are magistrates. In the state court system are the lower
- 10:13level of courts from the federal system. In every district, like this is
- 10:18a southern district, it was from in the southern district, we have three
- 10:22magistrate judges. Now they're selected by the judges, the district court judges,
- 10:30and they serve for a limited term. They're sector reappointment. So down in
- 10:33in the southern part of the state, it's omar Ablehusen who's from Princeton.
- 10:39Then here got doing Tensley and then Sheryl Efford and Huntington, and the structure
- 10:46in federal court as matters of discovery, which is like depositions and irrogatories,
- 10:52requests for the production of documents from one party in a civil lawsuit to the
- 10:58other side or to a independent third party that has information. If there's a
- 11:03dispute that arises there there's a general order that's been entered in the district and
- 11:07it's been in place for decades that all those matters go to the magistrate judge.
- 11:13The magistrate judge here's the dispute and makes a decision in the form of
- 11:20a recommendation that then can be If the parties aren't satisfied, then they can
- 11:24go to the district court judge to whom the case is. Aside of the
- 11:26district court judges, of course, it's a presidential appointee confirmed by the Senate
- 11:31of the United States. That's the first level in the form of federal judiciary.
- 11:37So and this is not out of the ordinary. I mean, there
- 11:41are any number of cases. I heard Tom on the air last week.
- 11:45You are there any number of cases where I mean if you've got a suit
- 11:50against a large private corporation and you want to depose the president of CSX,
- 11:56you're going to meet with the same response from councilor cs AX. Look,
- 12:01you can't just be jerking our CEO up here for a deposition because it has
- 12:07this adverse effect on the operations of the entity. So we're not going to
- 12:13produce some Somebody has to decide that, and it's in the federal court system
- 12:20here in West Virginia. That's the magistrate court judge. So I think it's
- 12:26hard not to refer to somebody that you've known, like Omar. I knew
- 12:30Judge Apple Houston for a long time. He was actually he was elected,
- 12:33I believe, to a circuit, the circuit Mercer County County. Yeah,
- 12:37and when I have all the confidence in the world and him to sort this
- 12:41out, he said, let's just take the steam off here. Let's say
- 12:43everybody quit barking at each other. Let's hear some testimony and decide what we're
- 12:46going to at least maybe lay some ground rules, which is what I think
- 12:50will ultimately happen. Right, we have a call, Yeah, we got
- 12:52a call from Ron. Ron. You're on the ear at Harvey Payton.
- 12:54Go ahead, run morning Ron morning guys, how you quite well? It's
- 13:00good good to hear you on there, are we? I got a quick
- 13:05question. I was out on quarter geez, it's been three months ago,
- 13:09and driving home from work one day, and some people inside of me locked
- 13:15up their brakes and my first thought is there's gonna be an accident. And
- 13:18about the time I thought that I was blindsided by a car hit me in
- 13:22the side, And come to find out, the boy that hit me in
- 13:28he was a nice young man, but he only had a liar from it.
- 13:31Didn't have anybody in the car with him. But make a long story
- 13:35short, I mean, I'm three months in and I still don't have my
- 13:39truck back. I didn't have any injuries personal injuries, I mean as far
- 13:46as physical is concerned, but I've been through all kinds of stuff of this.
- 13:50He give me the wrong insurance company. I had to make acclaim with
- 13:52my company. Then they found out he had insurance with another company. Is
- 13:58there another recoal worse for somebody like me who don't have a physical injury but
- 14:05has been through all this situation. Is there no recourse for somebody like me?
- 14:09Well, there may well be, but I'll tell you what. It's
- 14:11all facts driven. Why don't you do this? You know, we do
- 14:16a lot of things by telephone. Now Tom, neither Tom or I are
- 14:20going to be in the office the rest of today or tomorrow because we're going
- 14:24to We've got a family and get together down in North Carolina. But the
- 14:28first of the week, it's call the office and asked to speak to Tom.
- 14:31If I'm not there and he let him get the facts. Then there
- 14:33are circumstances where a property damage claim can result in the availability of some general
- 14:39damages, not all. But we need to find out the facts, and
- 14:43you probably don't want to talk about all that on the air. So just
- 14:45give us a call of three or four seven five five five, five five
- 14:48six, ask for Tom and or me if I'm there, and then we'll
- 14:54get the facts and see what we can tell you. Okay, We'll be
- 14:56glad to help you. We never charge for that. I mean that's something
- 14:58that if someone wants to call and say, do I have a claim?
- 15:03Or I have a claim? But is this something a lawyer should get involved
- 15:05in? Or I have I think I might have a claim. What's the
- 15:09you know what are the parameters, what maybe might I expect? I mean,
- 15:13we just do that as a matter of course, because yeah, because
- 15:18if we can help you, well, we can always help you. We
- 15:20can tell you one way or the other what direction to go. But if
- 15:22it needed something that you need the fine end of a lawyer to represents you,
- 15:26we can do that. If not, we'll pinch you in the right
- 15:28direction to get it resolved. How's that sounds like playing? I appreciate it,
- 15:33you know, I just don't. I didn't know which way to go.
- 15:35I'm glad you weren't hurt. First of all, you know, I
- 15:39called injuries an automobile accidents or you know, like this morning, coming in,
- 15:43I called my office because my receptionist is from down in Buffalo and there
- 15:46was an accident yesterday that injured a Putnam County deputy from who's from that area.
- 15:54You're just really lucky. I mean, you see what happened out on
- 15:56Quarter G last week. Someone was killed out there, ejected from a vehicle.
- 16:00Another t boat accidents, just too much speed, too much speed and
- 16:03too little enforcement. We got the I I was in the slow lane just
- 16:08trying to get home from work one day, and all this happened, and
- 16:12like I said, here, I am three months in and I'm not sure.
- 16:17Well, I'm sure we can do something to I'm sure we can do
- 16:18something to help you. If you're talking about that kind of you to give
- 16:21us a buzz. Okay, all right, I appreciate it. Thankanks you.
- 16:23All right, great question there three oh four, three four five fifty
- 16:26eight fifty eight three oh four, three four five fifty eight fifty eight or
- 16:32one and only break back with Harvey in a moment on five eighty WCHS.

- 18:41Harvey Payton with the Peyton Law Firmace with us and give Harvey call three oh
- 18:45four three four five fifty eight fifty eight three oh four three four five fifty
- 18:52eight fifty eighth. Let me say you one thing about Ron's call. I'm
- 18:55gonna use him to segue into this. Let's yeah. When we first started
- 18:59doing this program twenty almost twenty five years ago, I think about twenty five
- 19:04years ago, the whole point was number one, to raise top of mind
- 19:10awareness about the Peyton Law Firm. Because we we're proud of what we do
- 19:15and we do a really good job. We don't advertise on television or on
- 19:21mass uber mass media. We do this radio program and a few other things
- 19:26mostly through community involvement. What was secondarily is to try and let folks know,
- 19:30don't be afraid to call a lawyer. Lawyers are here to help you.
- 19:34Now, there are some terrible examples of lawyer gouging, and lawyer dishonesty,
- 19:40and the lawyer of abuse. You know, you get someone who represents
- 19:44a big vested interest and they just pile up on the little guy unmercifully.
- 19:49But you know, look at ninety five percent of the attorneys that I've dealt
- 19:55with in my career, across the board, ninety five percent or more.
- 20:00Honor the fact that we've been vested with training in one of the learned professions.
- 20:07And we owe a duty of loyalty and honesty to the public that we
- 20:14deal with, and we owe duty to people that try and help them if
- 20:18we can. And so don't be afraid about mantre has always been, don't
- 20:22be afraid to pick up the phone, call a lawyer. You can save
- 20:23yourself money in the long run by spending a little bit now, or you
- 20:27can so if we have a call like Ron Here's had an automobile like so,
- 20:33well, what do you do? I mean, it is a perplexing
- 20:36situation. All of a sudden, through no fault of your own, things
- 20:40change now. In the absolute worst situation, things can change horribly. I
- 20:45mean, I represented a wonderful young woman a few years ago who was victimized
- 20:49by Route thirty five. Her husband went out to get some pizza for her
- 20:55and their little boy, and all of a sudden, the lights went out.
- 20:57She didn't know why they're electricity are off? Well, it went off
- 21:00because two miles away attractor trailer driver wasn't paying attention and struck her husband's vehicle
- 21:07in the rear and killed him. What do you do? I mean,
- 21:12nobody knows what they're do in that situation. Here's a gentleman driving home from
- 21:15work, he's going to truck he do you know? His life is in
- 21:18order, and now all of a sudden, through no fault of his own,
- 21:22everything changes. Well, what do you do? So? Uh,
- 21:27don't be afraid to ask and to call a lawyer and ask. And somebody
- 21:34shouldn't ask you for money to answer your questions or to point you in the
- 21:40right direction. With the Payton Law Firm, we've never charged anyone and he
- 21:48you hear these big TV advertisers you won't pay us unless we went Well that's
- 21:52the norm, that's the norm. Uh, you know, pick up the
- 21:59phone, own a call, or send us an email through Peyton Lawfirm dot
- 22:03com. There's a tab that only come and I see when it comes in
- 22:07and we can get some facts. Because almost everything is driven by the facts.
- 22:10The law. The law changes all the law hasn't been written. The
- 22:15law changes sometimes in to accommodate shifts in a cultural norm, the way people
- 22:21think about things, the way people work. Right, you know in the
- 22:25old days when when you had w two workers were represented by unions with the
- 22:30primary source of wages in the economy. Well, there's one way to look
- 22:34at laws turnings. In today's economy, where you've got an opportunity, an
- 22:40entrepreneurial economy, people who are dropping out of the workforce to take advantage of
- 22:42opportunities, well you have to look at that differently because the law was pretty
- 22:48tough on that those kinds of recoveries years ago. And now you need to
- 22:52be more creative. And how you look at seeing that people are compensated adequately
- 22:56for an injury. So pick up the phone and call we we do it
- 23:00all the time. Either Tom will call back, or I will call back,
- 23:04or for there we'll take the call. And you know there isn't a
- 23:11full blown attorney client relationship in place. Through a telephone call or through an
- 23:18inquiry over the internet. But our rule is strict confidentiality. What you call
- 23:26and tell us. If you're talking to either me or Tom in a circumstance
- 23:32where you're giving us information to make a decision about how you should act,
- 23:37how you should react, how you should guide your future conduct relative to an
- 23:42injury, that's a confidential relationship. Nobody's ever going to find out what you
- 23:49say to us unless you're calling about committing a crime. And we've seen here
- 23:56lately with a couple of lawyers out of Georgia where those those communications aren't privileged.
- 24:02And certainly if we can help you, we will. If the biggest
- 24:07way to help is to say, look, you don't need a lawyer to
- 24:08do this, or look I'm sorry, but even with the changing and evolving
- 24:15law, there's not going to be a recovery for that. So that you
- 24:21can at least tell the person what their situation is and they can adjust to
- 24:25it. That's what we're there for now. If it leads to representation,
- 24:29that's good. I mean, you won't get it any better anywhere else than
- 24:32you will at the Peyton Law Firm. We've I've been practicing law since nineteen
- 24:36seventy four. Come next May I have been practicing for fifty years and pretty
- 24:41vigorous practice. I've tried real trials, like where you go in and you
- 24:47select a jury and you put a jury in the box and you call witnesses
- 24:51and you cross examine witnesses and you argue the case of the jury and you
- 24:56get a verdict. Way over two hundred of those, way over ten of
- 25:00them were first degree murder cases. I'm five and five on this, which
- 25:03is a pretty good record. That's really good record, pretty good, right,
- 25:07well, and all it's all involved in the fights. I mean,
- 25:11if three of the acquittals were self defense, right, I mean, it's
- 25:17just one of those things. There are difficult cases. They are horrible because
- 25:21you well, two of them were family members and one was a close friend.
- 25:26He's got a fight, They got in a fight, and readily the
- 25:29ready availability of firearms. One was a firearm that was in a car and
- 25:33I just was in the car for whatever reason. We started fighting around.
- 25:38One guy's getting whipped really bad and the gun comes out. They fight over
- 25:42that, and absent the presence of a firearm, that wouldn't have been a
- 25:47killing. There might have been an assault charge. But mostly it was in
- 25:52a fist fight that would have gotten over with. But you know, and
- 25:55Tom has tried i'd say a hindred twenty years, including his huge verdicts up
- 26:03in Morgan County's drive cases over in Cleveland. He and I tried a big
- 26:06case over in Columbus for a railroad worker, got a big verdict. He's
- 26:08argued a case successfully down the Sixth Circuit Court of Appeals in Cincinnati. I've
- 26:14done some work in the sixth Circuit in Cincinnati and the District Court. But
- 26:18that's a jewel in your crowd to have cases argued and decided in both both
- 26:25adjoining circuits, the fourth and the sixth. Plus if you look at our
- 26:30website, we've got about thirty reported cases decided about the Supreme Court, all
- 26:36the way from murder to well talked about Mason County. I got, you
- 26:44know, just another unfortunate thing. Young man got electrocute to doubt the Phillips
- 26:48pouring plant, and we were grateful enough to represent his wife and kids and
- 26:55it came out very very well. I mean, you can see those two
- 26:56cases reported because they were appealed by the power cut me and upheld. So
- 27:02doing what Ronda did is what you should do. I don't. Let don't
- 27:07feel pressured. I mean you feel these TV as a call call, call,
- 27:11call, Well, take a breath, take a deep breath. Let
- 27:15me just get my feet on the ground here first, let me find out
- 27:18what my options are. And then if you want to talk to more than
- 27:19one lawyer, that's fine. If you talk to us and you like us,
- 27:23you feel comfortable, we'll be representing you. We got another call.
- 27:26Yeah, Bob, Bob's on the line. Bob, go ahead, you're
- 27:29on with Harvey. Morning, Bob, good morning, good morning. Go
- 27:33ahead, Bob. Turned down your radio, don't listen to your radio.
- 27:37Just talk to us on the phone. Jeff, is it okay to talk
- 27:41about something that doesn't have anything to do with a law if you want to
- 27:44ask him. Harvey's usually a good taker on that. Go ahead. Well,
- 27:47it's it's more about you, oh about me? Okay. Over the
- 27:53years, your station, you Chris Lawrence and all other newspeople a horrible habit
- 28:00of calling anything that happens around the corner from Little Page Terras on Route twenty
- 28:08one as happening in Sissonville. A couple months ago, a car went through
- 28:15a house on Wolf Pen Drive about a mile from Charleston city limits, and
- 28:21y'all had that happening in Sissonville. And the latest thing is the two kids
- 28:29that were rescued from the barn. You had that in Sissonville. That happened
- 28:37if you know where Cistonville High School is. That happened about half a mile
- 28:42from Cissonville High School, six and a half miles from Sissonville. And it
- 28:51seems like there's just case after case after case of things happening around the corner
- 28:57there and it's either in Sistemville or the Sistonsville area. In Sisonville is about
- 29:03a mile from the Jackson County line. And the truth being known, nothing
- 29:11newsworthy has happened in Cistonville in the last thirty years, but they get in
- 29:18the news. Yeah, just about every day. And before I hang up,
- 29:23Harvey, yes, I understand you're a graduate of Fairview Grade School.
- 29:30That's exactly right, A proud graduate of Fairview, the Hilltoppers, Fairview Grade
- 29:33School, west side of Saint Albans. I graduated from Fairview in nineteen forty
- 29:38nine. Well, my dad graduated from Fairview in I think nineteen thirty six,
- 29:45and my uncle in nineteen thirty nine, and my, oh, that
- 29:49was the end of the line. Fairview closed before my grandkids. They live
- 29:55over on West Main where I did, but they go to Central because Fairview
- 29:57shut down. It was a wonderful play. Was the Roy Farrell principle there
- 30:03when you went there? Roy Farrell was the principal. And I have lessons
- 30:07that got in my life even today that I learned from Roy Ferrell and some
- 30:11that I didn't understand at the time. Have you ever heard the legend of
- 30:17CP geis who preceded him? Well, mister geist was the principal and my
- 30:22dad was there, but no, not any Your dad ever tells stories about
- 30:27a lot of disciplinarian CP. Goh yeah, oh yeah, I heard about
- 30:33that. Well. CP retired when I was in the fourth grade. After
- 30:37I finished the fourth grade, and boy kids were celebrating. Well, so
- 30:48under the heading of be careful what you wish for. Our replacement in September
- 30:55was Roy Ferrell and he was a Marine sergeant who had just finished island hopping
- 31:03in the Pacific in World War Two. So we did not get an adventage
- 31:08and Roy Ferrell gave me the whipping of my life over nothing. And I've
- 31:15finished college, passed a CPA exam, and worked in tax and blow and
- 31:22behold. Later on, I got a chance to do Roy Ferrell's tax return,
- 31:27and I thought, boy, I've got a chance to get even here
- 31:33that I didn't And thank you, Bob. We'll keep that in mind.
- 31:40It's amazing, you know. At that time, mister Ferrell had his hands
- 31:45full. He was from Putnam County. His wife also worked at the school.
- 31:52But when I started grade school in nineteen fifty five, it was the
- 31:59first year in that end of Pinawa County that schools were integrated. And it
- 32:07fell upon Ruy Ferrell and the staff to maintain a calm and accepting atmosphere at
- 32:17Fairview Gracel, which he did, and he would come around and I didn't
- 32:23think about it at the time, but Fairview, I mean the west side
- 32:27of Saint Albans a lot of some of us in an area which is known
- 32:29as lick skillet, which because people were so poor in the depression, they
- 32:32would lick bacon grease off skellets. And it was a Title one school.
- 32:37When it closed, it would have been what was considered a Title one school
- 32:40at that time. And mister fare would come around to the classes about nine
- 32:45thirty in the morning and bring a tray and he would have commodity cheese.
- 32:50You know what commodity cheese is a boxes cut up, maybe some crackers,
- 32:54or they have a peanut butter with carrots cut up in it. And I
- 33:00thought, that isn't that nice? And I realized later that Roy Ferroll was
- 33:05smart enough and empathetic enough to know that when I got breakfast at my house,
- 33:13I could walk to grades go I didn't live a quarter mile away.
- 33:16That that was the first thing most of some of those kids ever had to
- 33:19eat that day, right, And he didn't make a big deal of it.
- 33:22It was like here, everybody had one of these, and you know,
- 33:24some children ate more than I. Nobody paid any attention because he just
- 33:28treated it as a part of the school atmosphere. And then he came in
- 33:31when I've learned that I can remember to this day, and he asked a
- 33:36child, now, have you been to a movie? Well, they said,
- 33:40well, if you were going to go to a movie, where would
- 33:43you go as well? The albur theaters. They said, okay, now
- 33:46want you to tell me, give me directions on how you would get from
- 33:52here. To the albur Theater. And I guess that was the sort of
- 33:54part of his military when he was a citizen soldier, like everybody else was.
- 34:00I was in grade school. Everybody wore the patches that their parents and
- 34:02their fathers had had. I mean I had my dad's he was an aom
- 34:06and the Navy, and my uncle was a gunnery mate. So you'd have
- 34:10all those patches on your what was in a blue jean jacket. And you
- 34:15know, teach children how to give people directions. Well, so I said,
- 34:22no, no, no, Where would you go? Do you say
- 34:23you'd go to here and you pick out a place that you would know,
- 34:27didn't go from there to there? And you know, since that day when
- 34:30I was like at the third grade, I've always concentrated, I think,
- 34:36to give people directions on how to get from a to b. To think
- 34:38in a linear fashion as opposed to a circular fashion. You know, summer,
- 34:44fall, winter spring, summer, fall, winter spring, think about
- 34:46today, tomorrow and the next day, or this place to that place.
- 34:51Good education. I was blessed. I mean I went to grade school where
- 34:55they were caring, loving teachers. I went to a in your high school.
- 35:00Well, first to Saint Albans and after a year to Hayes where we
- 35:04had Dick side Bottom was the principal. Becky Goodwin was my English teacher.
- 35:07They really Bill Lepley was the coach, a gentleman named Lewis was just wonderful,
- 35:15and high school was the same. I mean, we had this huge
- 35:17sense of community, which I think about this morning when I was listening to
- 35:21Hoppey's commentary on the transfer rule. Yeah, if you went to Junior High
- 35:25you were going to go to Saint Albans High School. That was home.
- 35:29That was the whole community. When I you know, if you needed a
- 35:32haircut, Oshel Kraigo at that time, I had a barber shop in Saint
- 35:36Albans. That's where I went because my dad worked at post office, which
- 35:39right across the street from ocal shop. Well, you went in there and
- 35:43they knew all the older men. Well, how are things going to practice?
- 35:47Who anybody hurt? How are you going to do against Dunbar? I
- 35:52mean, it was just a whole part of the community itself, which I
- 35:55think is the biggest students They're all seen and recruited talent wise based upon their
- 36:02club and travel teams. Anyway, but it undermines the sense of community.
- 36:08And what does it do to parents who spend all who spend all their spare
- 36:14time with their children on travel teams and AAU teams, looking forward to see
- 36:17him play at the high school where they went to school, only to show
- 36:22up the first day of school and find five transfers sitting there who take their
- 36:24place. I mean, I just think it's horrible. I think copies on
- 36:28the right track. Read his commentary today, folks and be positive. Call
- 36:30your legislators. We got a thirty seconds. Oh gosh, Well, pat
