- 0:03Happy Thursday morning everybody drinking my high octane coffee
- 0:12fueled by Sunoco. Deep breath everybody.
- 0:17This is probably one of the biggest coffee with Kenny's I've
- 0:22I've done in a long time. Yesterday, December 18th, on
- 0:28Wednesday, Wednesday, December 18th is a day that will go down
- 0:33in NASCAR history. Before we get started on the
- 0:38lawsuit victory, yes, the lawsuit victory.
- 0:43I want to pay my condolences to the Golden Boys family, the
- 0:48great Freddie Lorenzen. I remember Kyle Petty years ago,
- 0:53Kyle Petty said to me. He goes, you know, Herm, Freddie
- 0:57Lorenzen has one of the greatest winning percentages in NASCAR.
- 1:03And I said, tell me more. Kyle Petty, He said, yeah, He
- 1:07said Freddie Lorenzen, his nickname was the Golden Boy.
- 1:12He didn't race a lot in NASCAR, but his short time in NASCAR and
- 1:17the time that he raced, he won more than anybody.
- 1:21So my prayers to the great Freddie Lorenzen the Golden Boy.
- 1:29That was a time in NASCAR history.
- 1:33I guess you could say it was golden, right?
- 1:35That I don't know why they gave him that Golden Boy nickname.
- 1:38Respond right here with why they called Freddie Lorenzen the
- 1:43Golden Boy. Freddie Lorenzen has died and on
- 1:48December 18th, 2024. All right, everybody, let's take
- 1:55a sip of coffee before we move on.
- 2:03OK, Deep breath now. We, we not going to get mad this
- 2:07morning. OK, We we're going to talk like
- 2:10Larry McReynolds. We're going to skip some words.
- 2:13We not going to get mad this morning instead of we are not
- 2:18going to get mad. We not going to get mad this
- 2:21morning. We're not going to get jacked up
- 2:24on sun Drop and start screaming. We're going to keep our voice
- 2:27just like this, OK? I'm not a judge.
- 2:33I'm not into legal verbiage. But yesterday, on December 18th,
- 2:41let me get it right, I got it wrote down here.
- 2:44Judge Kenneth D Bell said NASCAR is a monopoly.
- 2:54Whoa. OK, I'm going to say it one more
- 2:57time. I didn't say this a big time
- 3:00judge, like, like a big time judge Kenneth D Bell, he ruled
- 3:08that NASCAR is a monopoly. Now it's it's his.
- 3:16His ruling is shared everywhere on social media.
- 3:21So I don't want to hear it. I don't want to hear it, OK?
- 3:27That's what he said. So.
- 3:30So talk to him, not ME3. I'm going to say it for the
- 3:35third time, just for Earnhardt, Judge Kenneth D Bell.
- 3:40He ruled NASCAR as a monopoly. All right, now let's let's talk
- 3:48about it. OK, Let's talk about that.
- 3:51OK, Now I know I was a little bit of a smart ass right there,
- 3:55but see, I don't, I don't want to hear it because here's why.
- 3:59Now we're going to talk about it.
- 4:01There's a phenomenon that happened.
- 4:04A phenomenon means something that is like rare, like whoa,
- 4:09like he's a phenomenon. We didn't see him coming.
- 4:13Well, one thing we never saw coming was this.
- 4:19The fans, a lot of you, a lot of the older fans that that love
- 4:26NASCAR, but they hate NASCAR too because the olden days are gone.
- 4:32They're mad at NASCAR because they're old and NASCAR is not
- 4:37the way it used to be. All of you are mad at 2311 in
- 4:45front row that they're suing NASCAR and now they won this
- 4:50preliminary injunction. So this phenomenon rages.
- 4:55It's like, OK, this doesn't make sense.
- 4:57The fans, the old school fans that want to talk bad about
- 5:01NASCAR. It's kind of like I can talk bad
- 5:04about NASCAR but not you. So this phenomenon is crazy, but
- 5:11it it the fans will talk bad about NASCAR, the old school
- 5:15fans, because you're mad that the olden days are gone.
- 5:19Like you talk crap about NASCAR all the time, but now you're mad
- 5:24at 2311 and Front Row Motorsports that they sued
- 5:27NASCAR. OK, respond right here.
- 5:30Tell me why that is. You talk bad about NASCAR, but
- 5:35but you don't want the judge. You don't You don't want Judge
- 5:39Kenneth D Bell to talk bad about NASCAR.
- 5:43So that's a weird one. OK, let's break this down now.
- 5:48Hey, Herman, dumb it down so us kids that went one through 8 can
- 5:54understand this. All right, I'll do it.
- 5:58That was funny. You got to admit it.
- 6:00That was funny. All right, go put my coffee mug
- 6:05down a little bit. OK, let me dumb this down OK,
- 6:132311 in front row Motorsport did not sign their charter agreement
- 6:19for 2025. And the reason they did not sign
- 6:24it is because they did not believe in the in the new
- 6:29charter agreement. OK, I'm not going to repeat
- 6:33myself. You heard what I said.
- 6:36Now, however, 2311, Michael Jordan, Denny Hamlin and Front
- 6:45Row Motorsport, they're suing NASCAR for for monopolistic
- 6:51practices and the judge agreed. The judge said, wow, NASCAR is a
- 6:58monopoly. They are the only game in town.
- 7:01There's no weather. There's no other place to go and
- 7:03do do this. You can't race on NASCAR.
- 7:07There's there's no other. There's no other NASCAR.
- 7:10Just like the judge said, read a statement, You read his
- 7:13statement, it's all over NASCAR. But here's what, here's where
- 7:18the the lawsuit, the preliminary injunction.
- 7:22OK, so while 2311 in front row, while they're suing NASCAR for
- 7:28monopolistic practices, 2311 in front row said, well, we want a
- 7:34preliminary injunction. We want to race in 2025 as a
- 7:40charter team, but we're not signing this charter agreement
- 7:44'cause we don't like it. We're not signing this.
- 7:46However, we do want to race with a charter it it's kind of like
- 7:54you want your cake and eat it too.
- 7:56So they they went to court for this, this situation.
- 8:01OK, Now I do want to be very clear.
- 8:05This was a monumental, monumental win for 2311 and
- 8:12Front Row Motorsport only for 2025.
- 8:15Now I'm going to be repeat that again.
- 8:17This is a victory only for 2025. Judge Kenneth D Bell said 2311
- 8:27and Front Row have won. They've won their preliminary
- 8:30injunction only for 2025. It sounds like the judge is
- 8:36going to give it a year and figure out this whole situation
- 8:42in 2026. So basically this whole deal is
- 8:46going to go on for a year and a half, two years as expected.
- 8:51OK, does everybody understand? I'm not.
- 8:54I'm not going to repeat it because you all tell me.
- 8:56I repeat myself. So I'm assuming you understood
- 8:59me. I'm a little bit of a smart ass
- 9:01this morning. OK, all right, Ain't nothing
- 9:04wrong with that. Just sometimes I'm a prick and I
- 9:09feel like that this morning, OK, now why is this a big deal if
- 9:16you go back? I said nobody has ever beaten
- 9:22NASCAR in a legal judgment ever. So this is a shocking blow and
- 9:31I'm going to leave you with this.
- 9:34Major NASCAR executive texted me and said one word on the ruling.
- 9:43Stunning. Do you hear what I just said?
- 9:47A major NASCAR executive texted me last night, on December 18th,
- 9:53on that Wednesday evening, and they texted me this.
- 9:58Stunning. People are shocked and stunned
- 10:03because NASCAR has never, ever lost a legal judgment court
- 10:09case. And if they have, respond right
- 10:12here. But I don't ever remember
- 10:15because as I've always said, NASCAR has got friends in
- 10:19Washington, DC. And when that, now this is my,
- 10:22this is my opinion. When NASCAR goes to do something
- 10:25big, they go to make sure they right.
- 10:28They they're going to make sure they're right.
- 10:31December 18th, 2024, NASCAR lost its first huge court case.
- 10:40Big one. Not a little one.
- 10:42Big one because 2311 in front row, they don't want anything.
- 10:49They don't want anything. All they want is NASCAR to come
- 10:53back to the bargaining table and give the teams a bigger portion.
- 10:59OK, NASCAR saying we did give you a bigger portion.
- 11:03We spent two years on this arguing with you all, we're
- 11:07done, take it or leave it. And that's what NASCAR said.
- 11:13They said take this or leave it. So a lot of the old school
- 11:17owners like a Richard Childress or Rick Hendrick, they got tired
- 11:21and they just signed it. Well, Michael Jordan, being the
- 11:25fighter and gamer, he is one of the greatest basketball players
- 11:29of all time. He said we're not signing this.
- 11:34And Can you believe they won? OK, well, now, I will admit
- 11:39everybody, on a different note, I have a little bit of a cold.
- 11:43I'm a little cranky. I'm a little cranky.
- 11:47All right, respond right here. I think I've said everything I
- 11:52need to say. I told you the ruling, and I
- 11:55told you I don't want to hear it.
- 11:57Go, go, go, go. Tell Kenneth D Bell he was the
- 12:01judge that ruled that said NASCAR is a monopoly, and I told
- 12:05you why it's the biggest deal in NASCAR history.
- 12:09I gave you my opinion. See, I just gave you my opinion.
- 12:14All right? It's early in the morning.
- 12:17It's 625 Central in Saint Louis, so it's 7/25, and all of you at
- 12:25Penske Racing are watching this because you guys start some
- 12:28stupid time in the morning so you all can get off at 2:30.
- 12:34I know that, I know that. Hello to all the race teams out
- 12:39there. I see you watching me this
- 12:41morning. All right, have a great Thursday
- 12:45evening. Everybody talk to you all later.
