Transcript
- This is the New Realm Compliance Brief, Volume 1, Edition 69, for Wednesday, October 21. Our top story: Delaware's THC beverage law takes effect today. House Bill three seventy three, signed in July, sets the state's first full framework for making, distributing and selling THC-infused beverages. Manufacturers, in state and out of state, must be authorized and must deliver product to licensed importers who meet notice, testing and recordkeeping requirements. Retail sales run through package stores and licensed retail marijuana stores. A fifty cent per container tax is collected at the warehouse distributor level, and civil penalties for selling to anyone under twenty one rise to the greater of two hundred fifty dollars or up to ten percent of average gross monthly sales. For partners selling into Delaware, market access now runs through importers, and the tax lands at the distributor tier. At the federal level, Herb Light, a maker of low-dose hemp THC drinks, launched a campaign that lets customers add a six pack delivered to their members of Congress, with a letter urging support for pending legislation to keep hemp THC beverages federally legal. Co-founder Gordy Sang said most consumers do not even know there is a federal ban in the works. Around the states: a Colorado audit found gaps in marijuana product testing oversight. Businesses select their own test samples, and safety advisories issued from twenty twenty three to twenty twenty five took more than seven months on average. Auditors said they found no evidence of widespread safety problems, and the state division agreed with the recommendations. And in Massachusetts, two new polls show strong majorities opposed to Question Eight, the November third ballot measure that would repeal regulated commercial sales. On the radar: the federal ban on synthetic cannabinoids in hemp products takes effect November twelfth, and the new total THC standard with its point four milligram per container cap follows December eleventh. New Jersey's transition period for hemp beverages ends November thirteenth. Full details and source links are in today's email. This update is for general information only — it is not legal advice.
