- 0:04Speaker 1: All right, let's get right to it. Five past the hour,
- 0:06Speaker 1: second hour, Friday, June twenty seventh, Here on the Morning
- 0:10Speaker 1: Show with Preston Scott, Please to have with us. He
- 0:12Speaker 1: is known as the gun Writer. His work is found

- 0:20Speaker 1: get his columns, investigated pieces sent directly to your email box.
- 0:27Speaker 1: And it's as simple as just going to the website.
- 0:29Speaker 1: And he's Lee Williams. Good morning, Lee, how are you?
- 0:32Speaker 2: Good morning? I'm doing well. How are you, sir?
- 0:34Speaker 1: I am doing great. You and I both are compared
- 0:37Speaker 1: to Patrick Tate Adomiak. Let's catch everybody up who is
- 0:43Speaker 1: Tate and tell us about his life, what he was doing,
- 0:48Speaker 1: what he was involved in before he came into the
- 0:52Speaker 1: crosshairs of the ATF.
- 0:55Speaker 2: Tate was a maybe E six. He was their version
- 0:58Speaker 2: of an MP in military's He had been accepted to
- 1:02Speaker 2: go to seal school as an officer. He had a degree,
- 1:05Speaker 2: has a degree, and he was going to go to
- 1:07Speaker 2: basic bugs as a seal officer. Just getting there is amazing.
- 1:17Speaker 2: In the meantime, he had another life where he had
- 1:19Speaker 2: a website where he sold military surplus. I'm not talking guns.
- 1:24Speaker 2: I'm talking gun parts, and that was thriving. He would
- 1:29Speaker 2: buy junk basically the way I look at it and
- 1:32Speaker 2: sell it. Guys would buy parts for their guns. The
- 1:35Speaker 2: ATF got a tip that he was selling all kinds
- 1:37Speaker 2: of illegal stuff, so they hit his house, nine separate
- 1:40Speaker 2: law enforcement agencies. They didn't find a damn thing illegal,
- 1:46Speaker 2: So they bring in this kid. The first time he
- 1:48Speaker 2: ever testified in court. He made everything illegal illegally. I
- 1:54Speaker 2: took a RPGs that he had bought rocket Republican Aid
- 1:58Speaker 2: launchers that he had bought at some darre in California.
- 2:01Speaker 2: They were do what They had never fired a rocket.
- 2:04Speaker 2: They were made for training. He paid one hundred bucks
- 2:06Speaker 2: for him. They turned those into rockets. He had a
- 2:09Speaker 2: toy submachine gun, a toy you can buy one right
- 2:13Speaker 2: now and haven't sent your home out of Spain. They
- 2:16Speaker 2: made that into a machine gun. I mean, they just
- 2:18Speaker 2: went absolutely crazy. I think at this point in their
- 2:21Speaker 2: career the ATF was tired of looking like buffoons for
- 2:26Speaker 2: trusting their wrong informants, which they did. In this case,
- 2:30Speaker 2: Tait was the prosekers warned him sentenced to thirty years,
- 2:35Speaker 2: but Q and A, I'm sorry, a special agent, a
- 2:39Speaker 2: senior special agent, Daniel Kelly, who was hired by his
- 2:43Speaker 2: defense team, talked about a ten yere So he was
- 2:46Speaker 2: only sentenced to twenty years in prison. He's on his
- 2:49Speaker 2: fourth year right now, out of prison up in New Jersey.
- 2:52Speaker 2: I got to tell you, I've been doing this for
- 2:53Speaker 2: a long time. I've never talked to anybody who has
- 2:56Speaker 2: eaten that much time that did not do anything wrong.
- 3:00Speaker 2: And I tell you, brother, I've gone through everything that
- 3:03Speaker 2: he's done. There's not a crime there.
- 3:07Speaker 1: You've literally searched out and found everything that was in
- 3:12Speaker 1: the ATF's case and shown that all of those items
- 3:17Speaker 1: are available for purchase legally online in stores in secondhand
- 3:23Speaker 1: marts all over the country right now.
- 3:27Speaker 2: Yeah, And some of them were very high dollar items.
- 3:29Speaker 2: These were not items yet for sale. These were items
- 3:31Speaker 2: you had in a safe like mac ten the fires
- 3:35Speaker 2: from an open bolt semi automatically. If you want on
- 3:38Speaker 2: right now, Preston, you're gonna pay about six to seven
- 3:41Speaker 2: grand for that. He had several of those, which, of
- 3:44Speaker 2: course the idiot from the ATF called machine guns. He
- 3:49Speaker 2: had nine hundred and seventy seven flat pieces of metal
- 3:53Speaker 2: that were cut, but they were flat pieces of metal
- 3:55Speaker 2: that needed to be bent and termed. They wanted to
- 3:58Speaker 2: charge him with possessing and seventy seven machine guns. Again,
- 4:03Speaker 2: they're flat pieces of metal that need to be bent
- 4:06Speaker 2: and tooled, and I don't know what to make them
- 4:09Speaker 2: many machine guns. That's what our great guy, Dan O'Kelly
- 4:16Speaker 2: was able to talk to judge out of doing, thus
- 4:20Speaker 2: saving him ten years in prison. Now I interviewed Dan O'Kelly.
- 4:25Speaker 2: He's spent twenty four years in the ATF as a
- 4:29Speaker 2: senior official. I mean he joined in ninety eight having
- 4:33Speaker 2: got a cop. For ten years, ran the ATF in Delaware,
- 4:38Speaker 2: ran the Atlanta Tampa Field Division. Was a hell of
- 4:41Speaker 2: an instructor in the National Academy, wrote a technology course
- 4:45Speaker 2: for ATF personnel, which they're still using. This is the
- 4:49Speaker 2: guy that the defense brought in. This is the guy
- 4:51Speaker 2: that the prosecution wouldn't allow to testify except for those
- 4:57Speaker 2: nine and seventy some flat piece of metal they wanted
- 4:59Speaker 2: to call a machine guns. This is the guy that
- 5:02Speaker 2: got him ten years. And I asked him, I said,
- 5:06Speaker 2: should a Domiak be in prison? He said no, No,
- 5:10Speaker 2: I mean, did the ATF covet forerjury, and he basically said, yes.
- 5:16Speaker 1: Lee, when you talk about the prosecution wouldn't let him,
- 5:21Speaker 1: didn't want him to testify, referring to retired ATF senior
- 5:25Speaker 1: special Agent Daniel O'Kelly. Well, how do they have say
- 5:29Speaker 1: in that? I mean, how is it that his entire
- 5:32Speaker 1: testimony was not allowed?
- 5:35Speaker 2: They control the issues, They agreed to the issues that
- 5:38Speaker 2: he was there to talk about, so therefore they rendered
- 5:44Speaker 2: him moved. It was, Oh, it was not the best
- 5:49Speaker 2: defense in the world. Let me say that, say that
- 5:54Speaker 2: about his attorneys. But he's got a good crew getting
- 5:58Speaker 2: ready for his PA and I think they're going to
- 6:01Speaker 2: do if it gets that far. Now here's what I've
- 6:04Speaker 2: been dying to tell you. We're getting movement on Tate.
- 6:09Speaker 2: My boss, Alan Gottlieb, head of the Second Amendment Foundation,
- 6:12Speaker 2: said Sunday that that Tate's case has reached d C.
- 6:17Speaker 2: They've talked about it in the White House. What Alan
- 6:20Speaker 2: wants to do is for Tate to be released immediately
- 6:22Speaker 2: and then given some money. I mean, his life has
- 6:26Speaker 2: been up ended. He I don't know if he's going
- 6:28Speaker 2: to file suits or I don't know if the Trump
- 6:30Speaker 2: administration will just give him some money for the basically
- 6:34Speaker 2: four years that he's spent in prison for no damn reason.
- 6:37Speaker 2: But that's where we're at. We've got people in New
- 6:40Speaker 2: Jersey that are having a huge event tomorrow for Tate.
- 6:45Speaker 2: They're setting up there having people come in and sign
- 6:49Speaker 2: papers that they're going to present to the court. You know,
- 6:54Speaker 2: it's taken off around the country and I've never been
- 6:57Speaker 2: followed like this. I've never seen my stories turnout like
- 7:01Speaker 2: this before. I think people are angry that, you know,
- 7:04Speaker 2: here we got a kid who basically committed himself to
- 7:06Speaker 2: the military, committed his life to the military, and then
- 7:10Speaker 2: he was taken out by this damn atf What are the.
- 7:14Speaker 1: You've shared just a fraction, but of what you've covered,
- 7:20Speaker 1: what are the most egregious fabrications and anomalies that took
- 7:24Speaker 1: place in the trial and the sentencing.
- 7:27Speaker 2: Basically, the toy submachine gun, you're buying a toy they put,
- 7:33Speaker 2: they took it apart, They put a reel barrel in
- 7:35Speaker 2: a real action in it.
- 7:37Speaker 1: Well, let me again, I've got to stop you. I
- 7:38Speaker 1: gotta stop you right there. How was that allowed as
- 7:41Speaker 1: evidence when they took quote the evidence and then cut
- 7:47Speaker 1: it apart? And remanufactured it. I mean that is in
- 7:50Speaker 1: my mind and helped me out because I'm not the
- 7:52Speaker 1: sharpest knife in a drawer here, Lee, That to me
- 7:56Speaker 1: is taking a clock and some fertilizer that's separate and
- 8:01Speaker 1: then somehow pulling it all together, adding a detonator and
- 8:04Speaker 1: say see it's a bomb.
- 8:07Speaker 2: Yeah, exactly. Well you'd have to ask firearms enforcement officer
- 8:10Speaker 2: Jeffrey Bodell why he did what he did, because he
- 8:14Speaker 2: got that toy submachine gun. Again, this metal costs you
- 8:18Speaker 2: a couple hundred bucks and everyone sent your home in
- 8:20Speaker 2: a couple of days. It's made in Spain. He turned
- 8:23Speaker 2: that and he got it to fire one round. It
- 8:26Speaker 2: wouldn't take around from the magazine. It wouldn't take around
- 8:30Speaker 2: to the magazine. You had to put one in there,
- 8:31Speaker 2: one at a time. What did he call it? Of
- 8:34Speaker 2: course he called it a machine gun.
- 8:37Speaker 1: All that proved is that he's a crappy fabricator.
- 8:41Speaker 2: Yeah, this was his first time and he went completely
- 8:44Speaker 2: nuts on everything. Why because they were sick of these
- 8:50Speaker 2: type of warrants where they have bad investigators who work
- 8:53Speaker 2: in bad seiyes, who kick down doors and don't find
- 8:56Speaker 2: anything legal and let me tell you something. Tate was playing.
- 9:00Speaker 2: He was playing with his career in the seals. He
- 9:02Speaker 2: was extremely cautious about what he had and about what
- 9:06Speaker 2: he offered for sale. He had nothing illegal because he
- 9:10Speaker 2: didn't want to screw up his career in the Navy
- 9:12Speaker 2: or break the law.
- 9:14Speaker 1: Well, you mentioned the appeal and the movement that seems
- 9:19Speaker 1: to be happening around the case of tatea domiac. Any
- 9:23Speaker 1: sense of time here, do we know how? Because I
- 9:25Speaker 1: mean sometimes the lethargy of the judicial process is agonizing.
- 9:32Speaker 2: That's a very polite way of putting it. I would
- 9:34Speaker 2: say his appeal is scheduled for September. I hope that
- 9:39Speaker 2: he's pardoned before then. I think he's the buzz around
- 9:43Speaker 2: the certain circles in DC right now. They're trying to
- 9:46Speaker 2: figure out how to help this kid. Getting him out
- 9:49Speaker 2: of prison would be the first step. He's in a
- 9:51Speaker 2: cell with eleven other dudes. The whole prison knows the Tate,
- 9:56Speaker 2: and as he's in a federal prison New Jersey, the
- 9:58Speaker 2: whole prison knows he's innocent. So let's get him out.
- 10:01Speaker 2: Let's get him out first thing. And I think we're
- 10:05Speaker 2: getting close to that, brother, I really do.
- 10:08Speaker 1: Is there a chance this is so egregious, that's the word.
- 10:13Speaker 1: I keep circling back to how the charges were fabricated
- 10:17Speaker 1: out of thin air, how the evidence was even more
- 10:20Speaker 1: so fabricated, literally fabricated and poorly done. Is there any
- 10:27Speaker 1: chance that members of ATF, namely the one member of
- 10:31Speaker 1: ATF you mentioned, is there any chance they face charges?
- 10:36Speaker 2: I hope so, I think. If you know, Dan O'Kelly
- 10:40Speaker 2: was considered to run ATF, they went another direction. He's
- 10:45Speaker 2: a guy interviewed. I asked him hard questions whether he's
- 10:52Speaker 2: lost faith in the ATF, and he said he's lost
- 10:56Speaker 2: faith in the ATF for years because he's seen these
- 11:00Speaker 2: firearms enforcement officers testify about things they knew were not
- 11:04Speaker 2: true under oath. That's a huge issue that is going
- 11:09Speaker 2: to kill you. You know, ATF, the agents go out
- 11:11Speaker 2: and make an arrest, they arrest the guy, they throw
- 11:13Speaker 2: him in prison, he gets a trial. The firearm enforcement
- 11:16Speaker 2: officers the one who testifies about what he had and
- 11:20Speaker 2: why it was illegal. And if you can't trust that part,
- 11:23Speaker 2: that huge part of the organization, why do you have
- 11:26Speaker 2: an organization?
- 11:28Speaker 1: Did Dan O'Kelly sense was there anything that a Domiac
- 11:32Speaker 1: did that was even remotely against the law.
- 11:36Speaker 2: No, no, And I asked him that five different ways,
- 11:39Speaker 2: and no, there was nothing he did wrong. I mean,
- 11:45Speaker 2: he's he's strong. I said, what should happen to the
- 11:48Speaker 2: ATF who falsely testified in the Domiac's case? He said,
- 11:51Speaker 2: any FEO testified to something different, and it's a wilful
- 11:55Speaker 2: falsehood that there's supposed to be the gun experts of
- 11:58Speaker 2: the gun police. He said they should be charged with
- 12:01Speaker 2: perjury and jailed. Not to mention being fired. He said,
- 12:04Speaker 2: this is the worst case he's ever seen.
- 12:08Speaker 1: I suppose you could maybe push back on that and
- 12:12Speaker 1: say the case of the guy in Arkansas who lost
- 12:16Speaker 1: his life is maybe worse.
- 12:20Speaker 2: Yeah, yeah, another case of someone who did nothing wrong.
- 12:27Speaker 1: Boy, this is this is the best and the worst
- 12:33Speaker 1: of what you do for a living lee. The best
- 12:36Speaker 1: is uncovering digging. The worst is having to uncover and dig. Yeah.
- 12:42Speaker 2: Well, gladly give it up. As long as ATF promises
- 12:45Speaker 2: to leave people alone.
- 12:47Speaker 1: Is there a role for ATF?
- 12:50Speaker 2: No, not in my opinion. I mean, I know the
- 12:54Speaker 2: Trump administration wants to pair ATF with DEEA, my employer.
- 12:58Speaker 2: Second Amendment Foundation opposes that would actually give ATF access
- 13:02Speaker 2: to more money and more agents, and they don't need
- 13:06Speaker 2: that right now.
- 13:07Speaker 1: Brother, ATF has not shown itself as a whole I'm
- 13:13Speaker 1: sure there are individual people within the agency that are
- 13:16Speaker 1: good people, but the bottom line is as a as
- 13:18Speaker 1: a whole entity, they've not shown themselves trustworthy enough to
- 13:23Speaker 1: have the authority it has no When I was.
- 13:26Speaker 2: A cop years ago, there were something we used to
- 13:29Speaker 2: especially when I was a detective, we used to talk
- 13:31Speaker 2: to ATF occasionally and they were good guys. They were
- 13:34Speaker 2: all extremely pro gun. There were fun guys to go
- 13:37Speaker 2: to the range with. They knew what their job was.
- 13:40Speaker 2: Their job was not harassing's in people. They were there
- 13:45Speaker 2: as kind of a well, we made this arrest and
- 13:47Speaker 2: we caught it with this gun, what's going on here?
- 13:49Speaker 2: And then they would bring in their experts and they
- 13:51Speaker 2: would do a fantastic job. Nowadays, they want to spotlight.
- 13:55Speaker 2: They want to go out there and commit the big
- 13:57Speaker 2: case and find somebody who's doing something wrong. Unfortunately they
- 14:03Speaker 2: don't know how to do that, so that's how we
- 14:04Speaker 2: end up with Tata domniacs.
- 14:07Speaker 1: Yeah, it'd be fine if they found the right people
- 14:09Speaker 1: that are actually doing things that are wrong.
- 14:12Speaker 2: They're not doing that unfortunately. Lee.
- 14:15Speaker 1: As always, thank you thanks for the hard work on
- 14:17Speaker 1: this case and hopefully we'll soon be talking about it
- 14:20Speaker 1: in a rearview mirror sense and repercussions coming to ATF
- 14:25Speaker 1: as a result.
- 14:27Speaker 2: So hopefully you can have Tate on your show soon.
- 14:30Speaker 1: That would be lovely, all right, Lee, thanks very much, brother,
- 14:34Speaker 1: Talk to you all right. Lee Williams with us The
