- 0:18Speaker 2: Welcome to Family Law Talk. We have an interesting topic today.
- 0:21The topic is the real estate assessors valuation and this
- 0:24episode today is based on an article on our blog
- 0:28Familylawheadquarters dot com day to June eighth, twenty twenty five
- 0:33and the title of the article is is the real
- 0:36estate assessor's value accurate? So it as a follow up
- 0:38to the episode today, going over to Familawheadquarters dot com
- 0:42and read this article on this topic from more information,
- 0:45but let's go ahead and jump on in. And a
- 0:48lot of dissolutions of marriage, the value of the marital
- 0:51home is often a significant issue for some individuals who
- 0:55are going through a divorce. The marital home may be
- 0:58the most valuable asset out there, and so to resolve
- 1:02a divorce, the parties are going to have to either
- 1:05agree on a value of the marital home or the
- 1:09court's going to have to decide what the marital home
- 1:12is worth. And that's really the only way marital property
- 1:15and debt can be divided, which is dividing marital property
- 1:19and debt in a just manner. But to do that,
- 1:21you've got to know the value of all the assets,
- 1:23and that includes the marital home. Obviously, in some cases,
- 1:26it can be more complicated when parties own more real
- 1:29property than just the marital home, like maybe they have
- 1:32a vacation home, or maybe they have rental property or
- 1:35commercial property, and certainly in those circumstances, all of those
- 1:39properties would need to be evaluated as well. Okay, but
- 1:42one of the big questions lots of individuals have when
- 1:47going through divorce and trying to figure out how to
- 1:50divide property and debt is whether or not the real
- 1:52estate assessor's valuation is acurate or not. In other words,
- 1:56will the court rely on that valuation or can we
- 1:58rely on that valuation for settlement purposes? Can we introduce
- 2:03that valuation into court? And sometimes parties look at the
- 2:07real estate assessor's valuation and all candor and they think
- 2:10it's way off base. A lot of cases, parties might
- 2:13think the real estate assessors valuation is way high, so
- 2:19they're making the property worth way more than it ought
- 2:22to be worth. In some circumstances, one or both parties
- 2:26could think the opposite. They might think the assessor's valuation
- 2:29is really low. So maybe the assessor thinks the value
- 2:33of the property is a certain amount, but the party
- 2:36disputes it. They don't think it's accurate or not okay,
- 2:39And so this is very common in divorce cases. Parties
- 2:43looking at the assessor's value and neither thinking it's way
- 2:46too high or it's way too low, and they want
- 2:49to know what to do, and they want to know
- 2:51whether the assessor's valuation is accurate or is it no accurate,
- 2:55And so that's the topic here today. Obviously, every case
- 2:58is different. The circumstances regarding the real estate assessor valuating
- 3:04certain property is going to be a little bit different.
- 3:06But candidly, there are some things, at least I've seen
- 3:11through the years in representing clients and lots of cases
- 3:15and certainly in dealing with assessors valuations. And one of
- 3:18the big issues is that a lot of assessors do
- 3:21what's called a drive by assessment. Okay, so they might
- 3:24drive by the property, they might observe it from the outside,
- 3:28but oftentimes they don't even go inside the marital home.
- 3:31If the homeowner's not home, they might not even speak
- 3:35to the homeowner, right, so the assessor might not know
- 3:38all kinds of things like what upgrades have been made
- 3:41to this house? What improvements have been made to it?
- 3:43And then on the flip end, if there's repairs that
- 3:46are needed, if there's things in the house that's outdated
- 3:49and maybe need to be updated, like new carpets, new flooring,
- 3:52maybe new AC units, right, maybe new air handlers or
- 3:57new water heaters, of these kinds of things. A lot
- 4:00of parties would be upset and say, look, the real
- 4:03estate assessor didn't even take this stuff into account, and
- 4:06so their valuation doesn't make a whole lot of sense
- 4:10and it ought to not be relied upon. Okay, on
- 4:13the flip end, if one party thinks the assessor's valuation
- 4:18is off base and that it's too low, their argument
- 4:22might be, look, they didn't go inside the house. They
- 4:24didn't see all the improvements that were made inside of it.
- 4:27Maybe there's new water heaters, maybe there's new AC units.
- 4:31You know, maybe new flooring or carpeting was put in,
- 4:34and all these things increased the value, But the assessor
- 4:38didn't even know this stuff as well, so look, adherent
- 4:42in real estate assessors valuations in terms of the critique
- 4:45is the fact that oftentimes they're not even going inside
- 4:48the home and so they don't even know for sure
- 4:52what's been done, what hasn't been done, you know, the
- 4:55areas of the home that need to be improved upon,
- 4:58you know, maybe or even out of code. You know,
- 5:00maybe the homeless bill long ago, and certain setups within
- 5:05the home might be outside of best practices in this
- 5:08day and age, and maybe wouldn't even clear code if
- 5:11somebody went in and expected it, and maybe that could
- 5:14impact the value. Okay, So this is one of the
- 5:16biggest critiques when you get into real estate assessors evaluations.
- 5:22So in a lot of cases, what parties want to
- 5:24do instead of using the real estate assessors valuation is
- 5:28hire a real estate appraiser. Okay, so there's lots of
- 5:31outside real estate appraisers. They can come, they can see
- 5:35the marital home. Typically they're going to come and sign,
- 5:38They're going to walk around the outside of the property
- 5:41inspect that too. Typically, they can ask the homeowner about
- 5:46right the pros and the cons of the property. They
- 5:48can ask about the upgrades that have been made and
- 5:51maybe ask about the items where upgrades haven't been made
- 5:54but they need to be made, and they can then
- 5:57take a better you know, take better data in information
- 6:02order to have a more accurate valuation of the property itself. Okay.
- 6:07Another advantage of having a real estate appraiser come in
- 6:11is that they can actually come into court and they
- 6:14can testify in court. And so in a divorced manner,
- 6:18it's important to not only hire a real estate appraiser
- 6:21if this is an issue in the case, but to
- 6:23hire a real estate appraiser who has experienced testifying in court,
- 6:28because frankly, a lot of real estate appraisers have never
- 6:31done this before, so that would be difficult for them,
- 6:33and maybe some would not even be willing to do
- 6:36that in terms of coming into court. So finding a
- 6:38qualified real estate appraiser who's properly licensed, who's willing to
- 6:42come into court and testify, that's typically the best path.
- 6:47Where parties disagree on the value of the marital home
- 6:51or other property, just hire a real estate appraiser. Candidly,
- 6:54in some cases both parties will have separate appraisals done right.
- 6:59Husband might have one done, wife might have one done.
- 7:01Those appraisals could turn out to be pretty similar or
- 7:04they could turn out to be pretty different, in which case,
- 7:07you know, parties have to decide whether to meet in
- 7:09the middle or to present the case to the court,
- 7:11and then the court has to decide what appraisal they
- 7:14think is more credible or not. Okay, one of the
- 7:18other questions is this, which is sort of interesting, and
- 7:20this is a little bit in the weeds, I should say,
- 7:23out of the gates, but it's this which is will
- 7:26a real estate assessor's valuation? Can it even come into court?
- 7:30So could a lawyer even admit it and present it
- 7:33to the judge? And this is really kind of an
- 7:35interesting question. And again this is in the weeds. But arguably,
- 7:39if the real estate assessor isn't in court, an attorney
- 7:43could argue that it's hearsay, so it's an on a
- 7:45court statement offered for the truth of the matter asserted.
- 7:48They could argue lack of foundation in that nobody came
- 7:51in and testified in terms of the foundation for the valuation,
- 7:56in other words, what facts and data will relied upon.
- 7:59So you know, a savvy lawyer who doesn't want the
- 8:02assessor's valuation coming in for one reason or the other.
- 8:05They think it's too high, or they think it's too low.
- 8:06If they don't want it in, they're going to object
- 8:09and say that it shouldn't come in, and from my
- 8:11experience in a lot of instances, it's not going to
- 8:14come in. And then again not to get too too
- 8:16much into the weeds. An attorney if they want to
- 8:19admit it and the other side's objecting for here's say,
- 8:23lack of foundation, maybe some other reasons than an attorney
- 8:26who once to admit it might argue, wait a minute,
- 8:29there's an exception for printouts from government web pages. This
- 8:31is a printout from a government web page. I think
- 8:34I can admit it on those grounds. Maybe that works.
- 8:36Maybe that doesn't work because it has opinion based testimony
- 8:40contained within it. It's not just data, and so this
- 8:44is real murky too. So the reality is, unless the
- 8:47other sign's going to consent to the admission of the
- 8:50real estate assessor's valuation, I don't think a party or
- 8:53an attorney can necessarily rely on the fact that this
- 8:56is going to be admissible in court of the other
- 8:58signs likely to object. Okay, another interesting situation that I've
- 9:05seen a lot of cases is people looking at online
- 9:07web page valuations. So I know one of the big
- 9:09web pages is Zillo. You know, most parties can go
- 9:13to Zilo, type in their address. It'll have an approximate
- 9:16value for property, and it'll have some property history in
- 9:20terms of what it's sold for and when it lasts
- 9:22sold to these kinds of things. And again the question
- 9:25here is is that accurate or not? Again, the problem
- 9:28is Zilo didn't go on the homes. Zillo didn't inspect
- 9:32the homes. Zillo's doing approximations based on sales that have
- 9:37been made in the area, presumably the size of the home,
- 9:41the features of these kinds of things. But again, Zillo,
- 9:45whether it's accurate or not, I think a lot of
- 9:46people would say not so accurate. And then you get
- 9:48into an issue of can you admit a Zillo valuation
- 9:51in court or some similar web page And the answer
- 9:54is probably not unless the other side is going to consent. Again,
- 9:58you're going to get hear Saale Foundation objections and this
- 10:01is not a government web page, so you can't argue
- 10:04that exception to get it admitted. So you know, if
- 10:07a party is saying I don't want to do a
- 10:09real estate appraisal. I just want to get Zillo admitted
- 10:12to court. That might be easier said than done because
- 10:16of these evidentiary hurdles I've already mentioned. So listen, for
- 10:21most cases, okay, where parties disagree on the value of
- 10:25the marital home and this is a big, big issue
- 10:28in the case, okay, and it's not going to be reconcilable.
- 10:31Parties aren't going to be able to meet in the
- 10:32middle or something like this, And most instances, what's advisable
- 10:37is to get a real estate appraiser who's license and
- 10:41who has experienced testifying in court to come and valuate
- 10:44the home. That's almost always the best practice, that's the
- 10:48best path. Some parties might be resistant because I don't
- 10:51want to pay for real estate appraisal, but if this
- 10:54is a big issue of the case, this is almost
- 10:56always the path that a party has to undertake. Real
- 10:59estate is users in zill valuations maybe not that reliable
- 11:04and hard to get admitted into court. Okay. So that's
- 11:06the episode today. Definitely an interesting topic and one I
- 11:09wanted to cover. Is a follow up to the episode today,
