Murder In Moscow: Bryan Kohberger Claims Innocence After Pleading Guilty (7/29/26) · The Vault: The Epstein Files

Speaker 1: What's up everyone, and welcome back to the program. Brian
0:05
Speaker 1: Kolberger pled guilty to murdering the Idaho four. Well, now
0:09
Speaker 1: that same scumbag, Brian Colberger is claiming that he's innocent
0:14
Speaker 1: and that the only reason that he pled guilty is
0:16
Speaker 1: because he had ineffective counsel. And for anybody who followed
0:20
Speaker 1: the story or the case, they know that that's not true.
0:24
Speaker 1: They jumped through every single who trying to get Brian
0:28
Speaker 1: Colberger off. You know what, Brian Colberger didn't have on
0:31
Speaker 1: his side and still doesn't have on his side the truth.
0:36
Speaker 1: And that's pretty hard to overcome, especially when there's as
0:38
Speaker 1: much evidence as there was against Brian Colberger. But now
0:44
Speaker 1: he's making this push to try and get an appeal,
0:47
Speaker 1: to try and overturn his sentence and have a new trial,
0:51
Speaker 1: and spoiler alert, I don't think he's going to be successful.
0:55
Speaker 1: So today we have an article from the Idaho Statesman
0:58
Speaker 1: and the headline there were no appeals, So how is
1:01
Speaker 1: Coburger essentially appealing? Could it work? This article was authored
1:06
Speaker 1: by Alex Breezy. When Brian Colberger admitted to stabbing for
1:11
Speaker 1: University of Idaho students to death, he was asked by
1:14
Speaker 1: the presiding judge question after question to make sure all
1:17
Speaker 1: aspects of his plea were offered voluntarily, and they were.
1:22
Speaker 1: Of course, the convicted murderer is now claiming that wasn't
1:26
Speaker 1: the case, and despite the fact that his plea agreement
1:29
Speaker 1: included waiving his right to appeal, he's taking another legal
1:33
Speaker 1: avenue to try to get the same result, have his
1:36
Speaker 1: guilty plea tossed out so he can pursue a trial.
1:39
Speaker 1: My prediction, the Candice Owen's crowd is going to latch
1:43
Speaker 1: onto this shit. This will be their next grift. Oh,
1:46
Speaker 1: Brian Colberger's innocent. It's a big government cover up. Ninety
1:50
Speaker 1: six FBI agents broke in there and they stabbed him
1:53
Speaker 1: to death on the orders of Joe Biden. That's the
1:56
Speaker 1: kind of bullshit you hear from these people, So I
1:58
Speaker 1: wouldn't be shocked to hear it here, especially considering their
2:02
Speaker 1: high priestess can Dune. Soewen has already tried to dip
2:06
Speaker 1: her toes into the coburger water previously, so I expect
2:09
Speaker 1: that griff machine to really pick up. A Boise based
2:14
Speaker 1: defense attorney told The Idaho Statesman that Coberger's claim doesn't
2:17
Speaker 1: make a lot of sense. But how is it that
2:20
Speaker 1: Colberger is allowed to go down this path to begin with?
2:23
Speaker 1: Here's how it breaks down. Judge Stephen Hipler of Idaho's
2:27
Speaker 1: fourth Judicial District stressed during a hearing last summer that
2:30
Speaker 1: he wanted to be sure that Colberger did not plead
2:33
Speaker 1: guilty unless he actually was understood and agreed the deal
2:37
Speaker 1: was not threatened or coerced, was satisfied with his attorney's representation,
2:42
Speaker 1: and comprehended the consequences of cleating guilty. Colberger answered affirmatively
2:47
Speaker 1: every time. So, look, we're gonna have to go through
2:49
Speaker 1: this dog and pony show. But in my opinion, Brian
2:52
Speaker 1: Colberger has no shot at getting this overturned. We're not
2:55
Speaker 1: talking about a Becky Hill type situation where the court
2:58
Speaker 1: clerk came in and he took a fat dump in
3:01
Speaker 1: the middle of the jury room. Nothing like that. And
3:04
Speaker 1: my guess is he's seen all this crap about Tyler
3:06
Speaker 1: Robinson and wants to get in on it. Wants to
3:10
Speaker 1: make sure there's some grifting going on for him. And
3:13
Speaker 1: considering how many Lemmings are willing to follow can don
3:16
Speaker 1: so Owen's off that cliff what you think that's not
3:19
Speaker 1: going to be the case here, it most certainly will be.
3:23
Speaker 1: And when asked whether he willfully, unlawfully, deliberately, with premeditation
3:27
Speaker 1: and with malice a forethought, stab Madison Mogan, Kaylee Gunsalvis,
3:32
Speaker 1: Xana Kernodle, and Ethan Chapin to death after breaking into
3:35
Speaker 1: their off campus home on November thirteenth, twenty twenty two,
3:39
Speaker 1: Coburger answered yes four times. So if he didn't do it,
3:43
Speaker 1: if he didn't get good counsel, why would he agree
3:46
Speaker 1: to all these different stipulations. Why would he even plea
3:50
Speaker 1: in the first place. Why not go to the judge
3:52
Speaker 1: and say, look, my council's ineffective, they're not doing the
3:55
Speaker 1: right thing, and I can't go on with my trial
3:58
Speaker 1: right now until I have better representation. Didn't even say that,
4:02
Speaker 1: didn't even make a peep about Ann Taylor. And in fact,
4:09
Speaker 1: I think Ann Taylor did more than any lawyer could have.
4:12
Speaker 1: Basically she was on point. You see how frustrated everybody
4:18
Speaker 1: on the other side was. That was because Ann Taylor.
4:21
Speaker 1: She exhausted every avenue trying to get this scumbag off,
4:25
Speaker 1: every last avenue, and there was nothing there but now
4:29
Speaker 1: all of a sudden, he has a new narrative. Oh,
4:34
Speaker 1: I'm innocent. I didn't do it. All of that was
4:36
Speaker 1: just a big lie. Like what And to anybody out
4:41
Speaker 1: there that believes this guy's bullshit, congratulations, you are dumb
4:45
Speaker 1: as fuck. Despite that, the former Washington State graduate student
4:50
Speaker 1: has now asserted that he's innocent and wants to be
4:53
Speaker 1: let out of the plea agreement which took the death
4:55
Speaker 1: penalty off the table. Coberger thirty one has filed a
4:58
Speaker 1: petition for a postc relief, and the same judge who
5:02
Speaker 1: sentenced them will decide whether his claims have merit. Oh
5:05
Speaker 1: I highly doubt that Judge Hipler is not exactly the
5:08
Speaker 1: kind of guy to play these games. Among the consequences
5:14
Speaker 1: the judge asked Coburger about was that he agreed to
5:17
Speaker 1: wave his right to appeal in the case, but that
5:20
Speaker 1: does not include the right to ask the court for
5:23
Speaker 1: postconviction relief, something any incarcerated person has the ability to
5:27
Speaker 1: do regardless of their case's circumstances. The petition is a
5:31
Speaker 1: civil remedy that allows someone convicted of a crime to
5:34
Speaker 1: contend that their sentence was a violation of the law.
5:38
Speaker 1: In fact, the US Supreme Court addressed the possibility of
5:40
Speaker 1: challenging convictions even after a defendant signs away their rights
5:44
Speaker 1: to appeal in Guarza verse Idaho. The fact that a
5:47
Speaker 1: defendant waves the right to appeal doesn't mean they don't
5:50
Speaker 1: have the right to appeal, Hipler explained in court, referring
5:54
Speaker 1: to the twenty nineteen ruling. So it may affect the
5:56
Speaker 1: outcome of that appeal, and it may affect the underlying
5:59
Speaker 1: case and the place agreement, But nonetheless, the right to
6:01
Speaker 1: appeal does not go away because of the waiver. Justice
6:05
Speaker 1: Sonya Sodomyor wrote in the Supreme Court's majority opinion that
6:09
Speaker 1: no appeal waiver serves as an absolute bar to all
6:12
Speaker 1: appellate claims. Well, that's true, and good luck have at it.
6:17
Speaker 1: Go ahead and waste everybody's time, waste everybody's resources, and
6:21
Speaker 1: your bitch ass is gonna end up staying where you are,
6:25
Speaker 1: exactly where you belong. In fact, if I had my way, helicopters, volcanoes,
6:31
Speaker 1: and I'll do the pushing. Most fundamentally, Sodomyor wrote, courts
6:36
Speaker 1: agree that defendants retain the right to challenge whether the
6:38
Speaker 1: waiver itself is valid and enforceable, for example, on the
6:42
Speaker 1: grounds that it was unknowing or involuntary. Consequently, while signing
6:46
Speaker 1: an appeal waiver means giving up some, many, or even
6:49
Speaker 1: most appellate claims, some claims. Nevertheless, remain cool, make the
6:54
Speaker 1: claim and then watch it go up and smoke, because
6:57
Speaker 1: that's what's gonna happen. And I can't wait to watch
7:00
Speaker 1: all these idiots gas people up, acting like Colberger is
7:03
Speaker 1: gonna get off only for that ought to happen. It's
7:06
Speaker 1: gonna be joyful, very joyful. In a handwritten aff of
7:12
Speaker 1: David that was filed with Idaho's court system, Coberger alleged
7:15
Speaker 1: that he was convinced to falsely confess to the burglary
7:19
Speaker 1: and for a murder charges by coercion, disinformation, false promises,
7:23
Speaker 1: and the withholding of exculpatory discovery. He was convinced that
7:28
Speaker 1: actual guilt was not an important factor in accepting his
7:31
Speaker 1: plea deal, as he could have faced the death penalty.
7:33
Speaker 1: He wrote, and was advised to lie. Oh, I'm sure
7:37
Speaker 1: that that's happened. I'm sure that Ann Taylor told him
7:39
Speaker 1: to lie. Is this guy for real? Like, honestly, guess
7:43
Speaker 1: what the meter was running? So Ann Taylor was gonna
7:47
Speaker 1: get paid. From her perspective, at least financially speaking, it
7:51
Speaker 1: would have been a good thing for this trial to continue.
7:54
Speaker 1: But sure, I'm sure that Ann Taylor was just like
7:56
Speaker 1: you know what, Brian lay, and we can just you know,
7:59
Speaker 1: get on with our lives. Those claims, which mainly fall
8:04
Speaker 1: under the umbrella of ineffective assistance of counsel, are hard
8:07
Speaker 1: to prove Edwena L. Cox, a Boise based defense attorney,
8:11
Speaker 1: told The Statesman Colberger had a team of well respected
8:14
Speaker 1: attorneys who filed dozens of emotions covering many potential avenues,
8:19
Speaker 1: and were able to get the death penalty taken off
8:21
Speaker 1: the table, something she called an incredible defense victory for sure,
8:26
Speaker 1: and I think the court's gonna see it that way. Now.
8:29
Speaker 1: Colburger is entitled to make whatever argument he wants, but
8:32
Speaker 1: I'm entitled to tell him I don't believe his argument.
8:36
Speaker 1: And guess what, there's no alleged deer. This piece of
8:39
Speaker 1: shit murdered them. So if you think I'm going to
8:41
Speaker 1: say alleged when I'm talking about bitch ass Brian Colberger,
8:44
Speaker 1: you got another thing coming. This rotten, dirty son of
8:48
Speaker 1: a bitch is trying to cause more pain, more suffering,
8:51
Speaker 1: and put himself back in the spotlight. That's what he's doing.
8:54
Speaker 1: It just seems to me to be an incredulous claim,
8:57
Speaker 1: she told The Statesman. Of Coburger's post conviction relief, we move.
9:01
Speaker 1: El Cox particularly pointed to one of Coburger's claims in
9:04
Speaker 1: the filing that his attorneys fail to inform him about
9:07
Speaker 1: a supposed clump of unknown hair found in Ethan Chapin's hand,
9:11
Speaker 1: something that seems unlikely to her. It was one of
9:14
Speaker 1: dozens of samples that were examined by investigators microscopically. According
9:18
Speaker 1: to a lab report from the FBI, none of the
9:21
Speaker 1: samples matched Coburger's hair, but one of the defense own experts, Siree,
9:25
Speaker 1: wrote in a report that the hair was morphologically consistent
9:29
Speaker 1: with Japin's own hair. If there really was a bombshell
9:33
Speaker 1: piece of evidence, Coberger's attorneys would have chased it down
9:36
Speaker 1: and veted it. El Cox said. She noted that some
9:39
Speaker 1: people might try to frame this as exculpatory evidence, but
9:42
Speaker 1: she doesn't agree with that at all, and I don't either,
9:46
Speaker 1: and I doubt the court's going to so now that
9:49
Speaker 1: this is back in the news. Obviously we're going to
9:51
Speaker 1: be talking about it, and we'll follow along wherever it goes,
9:56
Speaker 1: and maybe we have to dive into some more core
9:58
Speaker 1: documents and see what's what. But as far as Brian
10:02
Speaker 1: Colberger is saying that he wasn't given a fair shake,
10:05
Speaker 1: that things went in a direction that was unfairer, that
10:09
Speaker 1: is just false and I wholly disagree with it. Now,
10:13
Speaker 1: does that mean that he shouldn't get another crack here?
10:16
Speaker 1: If that's what the system says he's allowed to do, No,
10:20
Speaker 1: go for it. You want to waste your time, you
10:22
Speaker 1: want to waste everybody else's time? Cool? But I think
10:25
Speaker 1: when all is said and done, Brian Colberger's bitch ass
10:29
Speaker 1: is going to remain exactly where he is, and in
10:32
Speaker 1: my opinion, he should feel lucky about that, because if
10:35
Speaker 1: this did go to trial, does anyone out there really
10:37
Speaker 1: believe that a jury in Idaho wasn't convicting him and
10:41
Speaker 1: sending him to the death chamber, because in my opinion,
10:44
Speaker 1: that was the likeliest scenario. Oh, we'll follow along, we'll
10:47
Speaker 1: see what Brian Colberger has to say. But I think
10:49
Speaker 1: when all is said and done, this clown's on a
10:51
Speaker 1: long road. To nowhere. All the information that goes with
