- 0:00I am Samuel Trapp.
- 0:01Hello, good morning, and welcome.
- 0:04I am Samuel Trapp.
- 0:05This is International Flavor.
- 0:07You happen to be listening to DAM Radio.
- 0:12damradio.com forward slash live is where you
- 0:16are.
- 0:18And if you're listening later, not between 7
- 0:21.30 a.m. and 9 a.m. central
- 0:24standard time, seems like you're probably on my
- 0:31website, internationalflavor.com and listening to me there,
- 0:35which I'm also not against, but I prefer
- 0:38when people listen live just because I do.
- 0:42So there's been a lot of, you know,
- 0:44I'm not alone in my trashing of the
- 0:47moves in Venezuela.
- 0:50I don't want to spend a lot of
- 0:52time on that today or this week, but
- 0:54I did want to share something.
- 0:55I watched an interesting one last night, and
- 0:57I don't usually watch very often because, you
- 1:01know, most of the, even the, what do
- 1:05you call it, the right-leaning media is
- 1:11unbelievable these days.
- 1:13You can't believe it.
- 1:14You got to get your news from elsewhere
- 1:16because the national news, I suppose I could
- 1:20be taught something or someone could push me
- 1:23in the right direction of a national news
- 1:25program that isn't completely full of crap that
- 1:29I might be willing to listen to.
- 1:31But I've started going to just independent shows
- 1:35and stuff, and I just, I used to
- 1:39be a pretty big fan of O'Reilly
- 1:42long ago.
- 1:43I'd listen to the O'Reilly Factor, and
- 1:45every once in a while I'll watch him
- 1:47on his independent on whatever that is, YouTube
- 1:51or however he puts it out.
- 1:53I am not a fan, and many, many
- 1:56years ago I was a fan of the
- 1:57other guy that was on Fox News at
- 2:01nights, Hannity, and I just, now he's, he's
- 2:06just a neocon cheerleader, you know, that's, that's
- 2:09all he is, and so I quit watching
- 2:11him long ago.
- 2:12Maybe he's changed his tune these days, but
- 2:15I don't think so.
- 2:16But I still like to go out and
- 2:17find people in America that actually will speak
- 2:20the truth, that'll speak things that, that matter,
- 2:25that won't just blanket, God bless you, Donald
- 2:29Trump, you're saving the country, and I don't
- 2:31like that, because I think he's saving the
- 2:33country.
- 2:34But I also think one of his big
- 2:37goals, and I found somebody who said something
- 2:39similar, and I've been talking about this, maybe
- 2:41not in as, as, maybe not as well
- 2:46or with some sort of thesis as I
- 2:49should have been doing, but I know, I
- 2:52know what I meant.
- 2:53A guy tell me something was like, what
- 2:56the hell are you talking about?
- 2:57He'd go, well, I know what I meant.
- 2:59It's like, well, that's good, because nobody else
- 3:01does.
- 3:01So I just want to make sure that
- 3:03everybody knows what I meant and what I
- 3:06mean.
- 3:07And, you know, I never wanted to be,
- 3:09because I take the point of view from
- 3:12traveling, from being outside of the country.
- 3:17And if you've gone around in as many
- 3:21places as I have, and I'm only at
- 3:2357, I'm trying to figure out the next
- 3:26place to go.
- 3:28And I'm thinking, you know, I said something
- 3:33the other day about going through Qatar to
- 3:37St. Petersburg.
- 3:40I really want to get to Russia in
- 3:42a winter month.
- 3:44And I really wanted to do the, the
- 3:47Christmas holidays.
- 3:48You do realize that tomorrow in the Pravoslavianskaya
- 3:52Tserkva, Russian Orthodox Church, Christmas is celebrated tomorrow,
- 4:01the 7th.
- 4:02And so that's a holiday for them.
- 4:04They're a bit the opposite.
- 4:05So I wanted to be over there for
- 4:08this season in particular.
- 4:11And it looks like I'm going to have
- 4:13to figure that out for next year.
- 4:16Yesterday, I spoke with Anna Cherkasova.
- 4:21She's from Ukraina.ru. It's the news agency
- 4:26that publishes my papers, my articles.
- 4:34And only through telegram, we had a discussion.
- 4:38We didn't do anything formally, but we did
- 4:40a telegram sort of following.
- 4:44And she put my comments out there.
- 4:46And I'm telling you, I truly am not
- 4:49alone in what I believe regarding this Venezuela
- 4:58deal.
- 4:58And I wanted to share with you, because
- 5:00I watched, anyway, she put some of my
- 5:03questions, she basically answered questions, and I answered
- 5:07them, asked questions, and I answered them.
- 5:11And I got a little article published out
- 5:15there again yesterday about this Venezuela travesty, this
- 5:20nonsensical.
- 5:21Now, I heard somebody yesterday, I watched a
- 5:23little bit more of the because it's really
- 5:26troubling to me to watch the decline.
- 5:31And I haven't put it the way that
- 5:34it needs to be put, obviously.
- 5:36I haven't done so.
- 5:38And I really kind of need to, because
- 5:40I talk a lot about the end of
- 5:43the global order, the end of US dominance.
- 5:50Multipolarity is something I've spoken about.
- 5:53And I recognized it long ago and kind
- 5:57of culminated in my desire to go to
- 6:00that BRICS conference in Kazan in October 2024.
- 6:04And it was an eye opener for me.
- 6:07It was a big one.
- 6:08And it's stuff like this that just kicks
- 6:11you right in the nuts, right?
- 6:13Right in the doodads, if you want to
- 6:15call them that.
- 6:16That you're going, you know, we speak about
- 6:20America as, you know, oh, gee, you know,
- 6:23let's pull some Bill Clinton or some Hillary
- 6:25out of the shining city on the hill
- 6:28or something like that, you know, but we
- 6:30all love America.
- 6:31And we all love what it's doing.
- 6:33And what I love is the fact that
- 6:36we're supposedly the good guys.
- 6:39Well, we aren't the good guys.
- 6:40We're the bad guys for the last 30
- 6:44years.
- 6:44Easy.
- 6:46And it's because of the reality, the world
- 6:51reality of multipolarity.
- 6:55And I saw somebody agree with me yesterday
- 6:57and say something much, much better formulated than
- 7:04the way I do it.
- 7:05America, we're not declining.
- 7:08We're still powerful.
- 7:09We're still whatever.
- 7:10And I don't want anybody to say that
- 7:12we're declining, but everybody else is coming up
- 7:16to our level.
- 7:17You know, a rising tide raises all ships
- 7:20and all that.
- 7:21And the rest of the world are rising.
- 7:24OK.
- 7:25And I don't mean anything bad about America.
- 7:28We we started it, if you want to
- 7:32put it that way.
- 7:33We're supposed to be the good guys.
- 7:36But now we're making no bones about it.
- 7:38We're stealing people's resources and we are.
- 7:43I don't know what we're we're threatening.
- 7:47Well, I mean, watch that Trump thing again.
- 7:51The guy's becoming a neocon blowhard.
- 7:54And he threw he threw Lindsey Graham in
- 7:56there.
- 7:57And Lindsey Graham is a freaking nightmare.
- 8:00And that guy makes no bones about it.
- 8:02Yeah, we're coming.
- 8:03We're taking everything.
- 8:04You know, we're we're we're screw everybody.
- 8:08We got war, America.
- 8:10And he ain't losing anything.
- 8:12That guy's not losing a damn thing.
- 8:14And he never will.
- 8:15And it's it's it's it's nonsense because this
- 8:20is who's running our foreign policy now.
- 8:25It is the neocon and always Marco Rubio
- 8:30has been a neocon.
- 8:31I mean, he's hidden it some.
- 8:33I thought he hid it for the first
- 8:35year, but oh, no, he is deep involved
- 8:38in this.
- 8:38Him and Lindsey, they're joined at the freaking
- 8:40hip.
- 8:42And, you know, having Lindsey Graham on Air
- 8:44Force One was like, it just made me
- 8:46want to throw up knowing that that a
- 8:50hole is there and guiding our foreign policy.
- 8:55And who's Trump listening to?
- 8:57I think he's finally figured out that the
- 8:59only way to prolong the decline, if you
- 9:05want to call it that, but it's not
- 9:07a decline.
- 9:08Everybody else is coming up.
- 9:09But to force the issue and maybe keep
- 9:12all the subjugated, you know, masses in Venezuela
- 9:16or anywhere else, keep them in their proper
- 9:19places is to go on the offensive and
- 9:22attack people and get into and go into
- 9:24stealing Greenland.
- 9:27You know, I mean, he was pretty blunt
- 9:28about that.
- 9:29Yeah.
- 9:29Greenland's coming.
- 9:30We'll talk about that in a couple of
- 9:32months.
- 9:32You know, Cuba, you know, maybe we'll take
- 9:35them to it.
- 9:36This is nonsense.
- 9:38This is why people don't like Americans.
- 9:42And when you travel, you got to be
- 9:44careful about, you know, broadcasting the fact that
- 9:46you're an American.
- 9:48And that's terrible.
- 9:50And, you know, it's terrible that we can't
- 9:53be proud of who we are.
- 9:54And being proud doesn't mean that, oh, gee,
- 9:58we get to go be condescending to the
- 10:00rest of the world.
- 10:01The rest of the world are people, too.
- 10:03We're all people on a common planet.
- 10:07And just because we happen to be born
- 10:09in what I believe to be the greatest
- 10:11country on Earth, although my conviction of that,
- 10:16you know, with these terrible people like Lindsey
- 10:19Graham, he's not even a good person.
- 10:22It's nonsense.
- 10:24He wants to destroy other people.
- 10:27The fact that nearly a hundred people got
- 10:29killed in seizing a criminal and bringing him
- 10:33to justice in New York is beside the
- 10:36point.
- 10:36You know, the hundred people dead, the Venezuelans
- 10:40dead, or the Cuban guards dead, that means
- 10:43nothing.
- 10:43We're supposed to jump for joy for that.
- 10:46We're supposed to go, oh, yeah, we got
- 10:47the greatest armed forces on the planet, which
- 10:50we do.
- 10:50But so what?
- 10:52Walk softly, carry a big stick, don't go
- 10:55killing people needlessly.
- 10:57And this was needless.
- 10:59And so now what are we doing?
- 11:00We're broadcasting to the world that we are
- 11:02a bunch of assholes and that we are
- 11:04a bunch of domineering, colonializing imperialists.
- 11:10That's what we are.
- 11:11And that is disgusting to me that we
- 11:14have to admit that to people.
- 11:16I don't want to.
- 11:18So but I did want to share with
- 11:19you, if you haven't seen it yourself.
- 11:22So McGregor, Ritter, and Johnson were all on,
- 11:27I think it was Judge Napolitano was there.
- 11:31And I think there was a group of
- 11:33people there.
- 11:35And unfortunately, when you transcribe these shows, they
- 11:41only say speaker this, speaker that.
- 11:43It doesn't tell you which one's which.
- 11:45So I'm not positive which one said that.
- 11:48And here's here's the very first question that
- 11:51they that he gave, said, how can President
- 11:53Trump possibly justify the invasion and takeover of
- 11:57the government in Venezuela in terms of American
- 12:01national security?
- 12:03Because we all know that's shit.
- 12:05That is that is not remotely what he's
- 12:08doing here.
- 12:09This is a narco terrorism.
- 12:11This is nothing but a resource grab and
- 12:14a domineering stuff.
- 12:15And here's how he put it.
- 12:17He said, well, Judge, that's a question that
- 12:20I think is irrelevant because he's already done
- 12:23it.
- 12:24And we have to accept the fact that
- 12:26he's now committed the United States Armed Forces
- 12:29and the wealth and power of the United
- 12:31States to intervention in Venezuela.
- 12:34I mean, we could sit here and pick
- 12:36apart the drug allegations or the presence of
- 12:38Hamas, Hezbollah and all this other nonsense, but
- 12:41it doesn't make any difference.
- 12:43He's already acting.
- 12:44That's why he didn't.
- 12:45That's why he had to get Lindsey Graham
- 12:47in on it.
- 12:48Right.
- 12:48And Marco Rubio had to be in on
- 12:50it.
- 12:50This is this is the neocon strategy.
- 12:53This is the people destroying Donald Trump.
- 12:56Trump is no Trump can no longer claim
- 12:58to be an outsider.
- 13:00He is hip deep in the shit and
- 13:03getting deeper.
- 13:04And and right now, as far as I
- 13:07can tell, the Senate Armed Service Committee has
- 13:10signed on for the operation characterizing it as
- 13:13law enforcement, which is horseshit because you can't
- 13:17engage in law enforcement outside of the country.
- 13:20And that is presumably because the DEA was
- 13:23part of the team that went in with
- 13:25Delta Force to seize Maduro and his wife.
- 13:29And so the question continues.
- 13:31So I guess the neocons have triumphed, notwithstanding
- 13:35everything Donald Trump and his accolades said during
- 13:39the campaign.
- 13:40And the guy says this is the important
- 13:42part that I wanted to get to you.
- 13:45I think that what we're learning here is
- 13:48that Washington, led by President Trump, is ready
- 13:52to use whatever means it has at its
- 13:55disposal, including military power to stop the diminishment
- 14:02of U.S. national influence in its bid
- 14:06to manage the sort of decline and dissolution
- 14:11of the so-called postwar liberal order.
- 14:15That's what it all seems to be about.
- 14:18Remember, the rules based order is effectively gone
- 14:23and rules based, meaning whatever Washington wants to
- 14:27impose.
- 14:28And President Trump simply stated very, very categorically,
- 14:34we can do it again because nobody can
- 14:37stop us.
- 14:39There's nothing with the capability that we have.
- 14:42You know, somebody said, well, Team America is
- 14:45back.
- 14:46If you ever saw the funny puppet show,
- 14:48I think that's where we are right now.
- 14:51And lots of people are saying, fine, this
- 14:53is great.
- 14:54The question is, what happens now?
- 14:57That's, you know, difficult to answer, but we
- 15:01need to talk about that.
- 15:03And, you know.
- 15:08Here you go, he says, and you got
- 15:11to see this, he said, because they were
- 15:14showing some of the things that I'm complaining
- 15:15about, and I'm on the radio, so I'm
- 15:17not even going to play it for you.
- 15:19But before we get into what happens now,
- 15:22I just can't resist showing you RFK Jr.
- 15:27and President Trump together at the Republican National
- 15:31Convention two summers ago.
- 15:34Watch the look of glee on President Trump's
- 15:38face when Bobby, whom you and I both
- 15:41know, says Trump will end the grip of
- 15:44the neocons on the government.
- 15:49And he said, play this cut.
- 15:51Then he said, he also told me he
- 15:53wanted to end the grip of the neocons
- 15:55on U.S. foreign policy.
- 15:58And don't you want a president who's going
- 16:00to get us out of wars and who's
- 16:03going to rebuild the middle class in this
- 16:06country?
- 16:07He said, we don't have that.
- 16:09We have a president who wants to start
- 16:12wars.
- 16:13So the question is, who's really in charge?
- 16:17I'm not convinced that President Trump is, because
- 16:21remember, during the convention, you had this giant
- 16:24Israeli flag suddenly appear in the middle of
- 16:27the Republican convention.
- 16:29And certainly in my lifetime, perhaps you can
- 16:32remember an example, but I don't know of
- 16:35a single instance where either the Democrat or
- 16:37Republican parties held a convention and hoisted a
- 16:41giant foreign flag at the convention talking about,
- 16:45quote, unquote, Israel first.
- 16:48I've never heard of that before.
- 16:50And I tell you what, these are frightening
- 16:55times, people.
- 16:56This is, I mean, if we are going
- 16:58to be starting wars, there's some people are
- 17:01going to have some things to say about
- 17:02that.
- 17:03There really are.
- 17:04And I told you yesterday in my rant
- 17:06that people are certainly watching us.
- 17:13And for all those of you who think
- 17:14that Trump is the answer, he's the greatest
- 17:19thing since sliced bread.
- 17:22I tell you what, I have always thought
- 17:25positively of this guy, always.
- 17:28But he is certainly in the pocket of
- 17:31the Lindsey Grahams of the world right now.
- 17:34And if that Air Force One bullshit didn't
- 17:38show that to you, you better look again,
- 17:42because who's running that show?
- 17:44It ain't Trump.
- 17:45And Trump has bought on to this whole
- 17:48thing.
- 17:49And if this is how he thinks, so
- 17:51and I've thought about this.
- 17:53It's been a couple of days now.
- 17:54Now, similarly, I don't believe there's crap you
- 17:57can do about it, except bitch about it,
- 18:00which I'm doing now because that's what I'm
- 18:03good at.
- 18:04But there's not much you can do about
- 18:07it.
- 18:07Who are we?
- 18:09We're nobody.
- 18:10And frankly, we're the people that Lindsey Graham
- 18:13will send off to slaughter without thinking twice
- 18:16of it.
- 18:17You don't care.
- 18:18We're nothing but little red risk pieces in
- 18:22denominations of one, five, or ten.
- 18:25That's it.
- 18:26And that's all we are to that guy.
- 18:28And he cares about money.
- 18:31He cares about power.
- 18:33And he cares about whether he gets reelected.
- 18:35That is it.
- 18:36And he don't care about a damn thing
- 18:39else.
- 18:40He cares about destroying Ukraine.
- 18:42Why?
- 18:43Because that might weaken Russia.
- 18:46But in the meantime, we'll just destroy Ukraine
- 18:48and it doesn't matter because they're dying for
- 18:50it.
- 18:51He was pretty upfront about that, where none
- 18:53of our guys are dying.
- 18:54That's not true either.
- 18:55We've had some people dying over there, but
- 18:58our guys aren't dying.
- 18:59What do we care?
- 18:59We'll just keep funding it.
- 19:01We'll keep funding it until Ukraine is gone
- 19:03and hopefully we can come in and make
- 19:04a deal with Russia and get half of
- 19:06the resources.
- 19:07But they lost that resource battle.
- 19:09Russia took the Donbass, which is in the
- 19:11eastern side.
- 19:12Why do you think Ukraine doesn't want to
- 19:13give it up?
- 19:14We can't give up our territorial integrity.
- 19:16They're all talking about territorial integrity.
- 19:19It's talking about the UN charter and how
- 19:22that works and territorial integrity and no other
- 19:25country can do it.
- 19:26And what does the US do?
- 19:27We go replace leaders.
- 19:29You can't.
- 19:29Everything in the UN charter, we ignore it.
- 19:33But by God, we won't enforce it against
- 19:35everybody else.
- 19:36What's wrong with Xi Jinping wandering into Taiwan
- 19:39now?
- 19:40Anything?
- 19:41What's wrong with North Korea taking over South
- 19:43Korea?
- 19:44Anything at all?
- 19:46And what is wrong with wandering into Greenland
- 19:49and saying, Jesus, if you guys really wanted
- 19:51this, you'd put more than 70,000 people
- 19:53here.
- 19:54And we need this.
- 19:55Like Trump said on Air Force One the
- 19:56other day, we need this because strategically, we
- 19:59need it.
- 20:00Denmark, you know, I think most of Europe
- 20:02wants it anyway.
- 20:03So screw it.
- 20:04Me and Lindsey, we're just going to put
- 20:07a fleet up there.
- 20:08We'll put a fleet up there.
- 20:11And, you know, if Iceland had anything to
- 20:13offer, we'd have taken that long ago.
- 20:16They don't have anything to offer.
- 20:18So we'll just stick with taking all of
- 20:20Greenland.
- 20:20So we have a seat in the Arctic.
- 20:23Well, Jesus Christ, why don't you take over?
- 20:25Sorry, I shouldn't talk like that.
- 20:27Why don't you take over Canada, too?
- 20:29I mean, Canada's run poorly.
- 20:31We could knock them over.
- 20:32The only reason they don't have an army
- 20:34or military is because we do.
- 20:36And they know we'll get their back.
- 20:38They don't have to have defense.
- 20:39A huge chunk of their money doesn't have
- 20:42to go to defense.
- 20:43Meanwhile, we're a trillion bucks in and we're
- 20:4538 million on the world debt or trillion.
- 20:49I'm sorry, million.
- 20:50Yeah, Jesus.
- 20:51God, that'd be awesome.
- 20:53But 38 trillion and counting and rising every
- 20:58day and the crap ain't going down.
- 21:00Anyway, I've ranted on that long enough and
- 21:02I said I wasn't going to do that,
- 21:04but I have.
- 21:06I was playing for you a little bit
- 21:09of that song when I just happened to
- 21:12hear it on the car coming in, and
- 21:14it was the Stonebridge radio edit of a
- 21:18song called The Fear.
- 21:20And and I like it.
- 21:22Now, where is it?
- 21:23How come we're not hearing it?
- 21:24I don't know.
- 21:25We're going to.
- 21:26We're going to maybe play it some more,
- 21:28but I doubt it because I don't want
- 21:31to go through and cut it.
- 21:32And when I upload it to my to
- 21:34my podcast site, I got to take it
- 21:38out so they don't bitch about having a
- 21:40license and we have a license on the
- 21:43radio show.
- 21:44But somehow I paid for a license ages
- 21:47ago, but I can't figure out how to
- 21:49transfer it over there.
- 21:50So anyway, I'm bitching about nothing.
- 21:52I wanted to continue with the with the
- 21:57the latest news regarding Venezuela.
- 22:02And I heard yesterday on.
- 22:06Let's see, who was I watching?
- 22:08I can't remember Christopher.
- 22:10One of the two Alex's I listened to
- 22:13and in in in English and they were
- 22:19saying that this turns out that there's further
- 22:23information.
- 22:24They're saying that the New York Times was
- 22:25reporting that this was a coup, that they
- 22:29were supported on the way in.
- 22:31Well, if it was a coup, why in
- 22:32the world are they killing 100 people?
- 22:34Why is it?
- 22:35And I saw something very interesting on Telegram
- 22:39last night in in Russian, and I needed
- 22:42to translate it to English.
- 22:45And I wonder and it's hard.
- 22:47I see if I can do it on
- 22:48the fly.
- 22:49I think I can, because it wasn't that
- 22:51difficult if I can just provide it to
- 22:53you on the fly, because they were showing.
- 23:00Apache helicopters attacking inside of.
- 23:05Inside of.
- 23:09What do you call it?
- 23:13Venezuela.
- 23:15And I forgot my glasses.
- 23:16No, I didn't.
- 23:17They're here hanging on my shirt and hard
- 23:19to read my phone in my old age.
- 23:22But I'm going to save this or tell
- 23:24this for you.
- 23:25This is something I saved, and this was
- 23:27from Venezuela sent to Russian on my Telegram
- 23:32channel.
- 23:33And it shows a video and the video
- 23:35is this Apache helicopter bombing the crap out
- 23:38of places inside of Venezuela.
- 23:42And it says a team of attack helicopter
- 23:47Apaches with appeared over targets in the region
- 23:51of Caracas.
- 23:52If these pictures can be supported, this is
- 23:58a serious escalation, strikes not from drones and
- 24:08not one time drones and not divert.
- 24:12What do you call it?
- 24:12Diversity are protesters.
- 24:15They're not really protesters, but rebels, rebels, a
- 24:20full scale strike of but a full scale
- 24:27strike of a machine of American aviation.
- 24:31The Apache is not a the weapon of
- 24:37Venezuela.
- 24:38It's a symbol of the direct participation of
- 24:42the U.S. and its allies.
- 24:45All of Latin American history of the last
- 24:49decades was built on a simple proposition.
- 24:58Whoever talks the loudest about sovereignty and independent
- 25:04politics, that person sooner or later will receive
- 25:09a colorful resolution, a color resolution, or a
- 25:15serious pressure.
- 25:16Venezuela is in the list, was on that
- 25:20list long ago and quite seriously.
- 25:23And now, judging from everything that has happened,
- 25:27the pressure has the pressure and the revolution
- 25:33or the change to a military sphere is
- 25:40a great pinch that shows how far you
- 25:45can go without formally declaring war.
- 25:49How far can U.S. go without formally
- 25:51declaring war?
- 25:54On the whole, we see a very similar,
- 25:59a very familiar underline.
- 26:03Well, a podchork is emphasis.
- 26:06We see this emphasis.
- 26:08Strikes on infrastructure, work on capital objects in
- 26:12the capital, and maximum bringing up of chaos.
- 26:20The logic is simple.
- 26:22Show everyone around that any country deciding to
- 26:27play, to not play by the rules of
- 26:30Washington risks sooner or later seeing in their
- 26:36own territory, above their heads, the helicopter of
- 26:43democracy.
- 26:44And I didn't, that's not a, that was
- 26:47on the fly, not a great interpretation, but
- 26:50that I thought was very telling.
- 26:54And I'm sitting there reading it and going,
- 26:55you know, I get the feeling completely.
- 26:58So now, we're bringing, so Venezuela was working
- 27:04with, very seriously with China.
- 27:06Like I told you yesterday, $100 billion committed,
- 27:10paying off loans, funding their governments, giving a
- 27:13lot of things, and they made no bones
- 27:15about it.
- 27:16The oil is coming to the U.S.
- 27:18It's not going to be developed and infrastructure
- 27:22developed by China.
- 27:24Nope, we're not doing it.
- 27:26Now, you can agree with that, but why
- 27:29in the world freaking lie to me about
- 27:31it?
- 27:32And I'll say, I'm much more likely to
- 27:34be on your side if you don't freaking
- 27:37lie and do what's called fraud in the
- 27:41inducement.
- 27:42Fraud in the inducement is a legal term
- 27:45that means somebody's trying to get you to
- 27:47go into a contract.
- 27:49And if you lie to get him into
- 27:52this contract, it's called fraud in the inducement.
- 27:54And it's a way to void the contract.
- 27:56If you say, geez, I need to get
- 27:58a loan so that I can get a
- 28:00loan to, you know, build a house and
- 28:03then your nephew can live in that house
- 28:06with me.
- 28:06And then you get the loan, they give
- 28:08you the loan to build the house.
- 28:10And instead of building the house so the
- 28:11nephew can live in it, you go on
- 28:13a world trip and you take a cruise
- 28:15around the planet for 365 days with the
- 28:18money.
- 28:19So the loan was a valid loan.
- 28:21It's a valid contract, but it was fraud
- 28:24in the inducement.
- 28:25You induced him with a fake thing.
- 28:27Well, that's exactly what they've done to us.
- 28:30They sell it to us and then slap
- 28:32the truth upon us at the end, which
- 28:35is bullshit.
- 28:36And they take this and they say, you
- 28:38know, oh, gee, it's narco-terrorism.
- 28:42They're killing us in the homeland, which is
- 28:44bullshit anyway.
- 28:46It's nonsense.
- 28:47It's not Venezuela doing that.
- 28:50If they are, it's very minimal.
- 28:53And he certainly isn't a narco-terrorist.
- 28:55Jesus, they're charging him with having machine guns.
- 28:59This is nonsense.
- 29:00And then we find out what the real
- 29:02deal is.
- 29:03Oh, you know what?
- 29:04This is anti-China.
- 29:06We're taking over the oil so China don't
- 29:08get it.
- 29:08And now they're coming out of the closet
- 29:10and telling us this.
- 29:12Why didn't you say that before?
- 29:14You know why?
- 29:15Because then you can't go and use the
- 29:17use of force.
- 29:18And by the way, that's another topic altogether
- 29:21is the use of force be declaring war.
- 29:26Basically, they've just done it.
- 29:28And Lindsey Graham helped get away with it.
- 29:30They structured how we did this in Iraq.
- 29:33It's been going on ever since.
- 29:35We don't declare war in Afghanistan.
- 29:37We don't declare war in Iraq.
- 29:39We don't declare war in Venezuela.
- 29:42We certainly don't talk about the buildup that
- 29:44we did inside of Ukraine.
- 29:46But in the end, it's all the same.
- 29:49Congress Lindsey Graham is funding it, and he's
- 29:52making sure that your dollars are going to
- 29:55pay for the continued dominance of the elite
- 29:59oil company owners.
- 30:00We're certainly not doing this to protect Venezuela.
- 30:03This has nothing to do with democracy, nothing
- 30:08to do with taking care of or fixing
- 30:11Venezuela.
- 30:13All it is is a satellite.
- 30:18That's it.
- 30:20And we're going, but Trump, oh, now we,
- 30:22this sure as hell ain't me.
- 30:23We are going to force them.
- 30:25Who is the guy that moved out of
- 30:26the country with his wife?
- 30:27And everybody's going, oh, good riddance, try to
- 30:30fix it from within.
- 30:31I think it's too far gone to fix
- 30:33from within.
- 30:34It's too far gone.
- 30:35What's going to happen the next time?
- 30:37Some Democrat's going to come in, and his
- 30:38favorite place is going to be France, and
- 30:40he'll just go take over France.
- 30:42Declare war without declaring war, by the way.
- 30:46You don't have to.
- 30:46Who needs congressional approval for that?
- 30:49This is a slight military, this is a
- 30:51law enforcement action.
- 30:52Oh, really?
- 30:53Why don't you send in 10 cops then?
- 30:54Why are you sending the military?
- 30:59A small coffee break whilst I yell at
- 31:02people.
- 31:02Anyway, that really isn't what I wanted to
- 31:04talk about today, but I'm glad I have.
- 31:06And so that is my thought on that,
- 31:09and I think you should follow along, and
- 31:12I think that was a Judge Napolitano show
- 31:15that they were talking on the one that
- 31:18I told you about with these various speakers.
- 31:21You know, I think we have to understand
- 31:28we had all these allegations about Hamas, Hezbollah,
- 31:32training camps, not that anybody in the intelligence
- 31:35business believes that, but because that's how we
- 31:39sell it to the American people.
- 31:40I don't think anybody in the intelligence business
- 31:44believes the bit about Maduro is a drug
- 31:46kingpin either.
- 31:48We're interested in the most significant exporter of
- 31:52cocaine in modern history.
- 31:54Well, let's set aside for a moment that,
- 31:56and chalk it up to one of money
- 31:58justifications for what's going on.
- 32:01But none of them are the correct, you
- 32:04know, they are, you know, only in the
- 32:07top five.
- 32:07But what you do have in Venezuela, oil
- 32:10reserves, natural gas, nickel, rare earth, and massive
- 32:16endowed gold, lots of gold, and one of
- 32:20the largest iron ore deposits in the western
- 32:24hemisphere.
- 32:25So all of those things are what's wrapped
- 32:27up in this, and now he's telling everybody,
- 32:30we're going to rebuild everything, we're going to
- 32:33restore the health of oil's structure, infrastructure.
- 32:38And he admits it's going to take a
- 32:41long time, and American corporations are going to
- 32:44march into the country, and everybody's going to
- 32:47get rich.
- 32:48No.
- 32:50No, no, no, no.
- 32:53Will Washington provide an economic package to lift
- 32:57Venezuela out of poverty?
- 32:59No.
- 33:00I don't think they're going to do crap
- 33:02about that.
- 33:04And, you know, they've taken it over.
- 33:06Now what?
- 33:07So we just bought Venezuela, or stole Venezuela,
- 33:12and I just want to go on the
- 33:14record of being against how this happened.
- 33:17If you wanted to fix it, then you
- 33:21support some kind of other person.
- 33:23And not through our shady CIA BS either.
- 33:28People have to, I mean, who supported us
- 33:31on the way up?
- 33:33I mean, seriously, what happened when we wanted
- 33:36to depart from England?
- 33:38And I know it was 250 years ago.
- 33:39It was a different world.
- 33:40Now it's, oh, gee, America just comes in
- 33:43and bombs the crap out of people using
- 33:45Apache helicopters, and then takes a leader under
- 33:49false pretenses.
- 33:51We all know that's not what this is
- 33:53about.
- 33:53And they're saying it.
- 33:55They keep saying it.
- 33:56Well, just take the package we gave you,
- 33:58and we'll send you off to, you know,
- 34:00an island somewhere where you and your wife
- 34:04can retire.
- 34:05That's why they brought the wife along.
- 34:07They don't believe their wife was a narco
- 34:09-terrorist.
- 34:10They want them to be together.
- 34:11Take them out of the picture, pay them
- 34:13off, make a display.
- 34:15They perp-walked.
- 34:15They drove the guy in a van through
- 34:17the streets of New York so everybody could
- 34:20have a look at him.
- 34:22They did that on purpose.
- 34:24This was a victory lap.
- 34:27And it's bullshit.
- 34:28That's not how you treat even an arrested
- 34:31head of a foreign state.
- 34:33These people have no idea what they're doing,
- 34:35and all they are is selling crap to
- 34:38the masses who will clap loudly and go,
- 34:42yeah, yeah.
- 34:43This is a guy at a football team
- 34:45cheering his team.
- 34:46That's it.
- 34:48And I think it's nonsense.
- 34:50A real thinking population would be thinking far
- 34:54ahead of this.
- 34:55What do we look like to the rest
- 34:57of the world?
- 34:57We look like a bunch of clowns.
- 34:59And I know most of you don't care
- 35:02because you don't travel.
- 35:03But if you go to other countries and
- 35:05you find out, you know, it's pretty funny
- 35:07because you meet people, and then you're sitting
- 35:10there, you're having a good conversation with them,
- 35:12and they go, where are you from?
- 35:13And you go, America.
- 35:14And you know how many times I get
- 35:16the, you don't seem like the typical American
- 35:18to me?
- 35:19Even in Europe, I get that.
- 35:22You're not the typical American.
- 35:23Well, it's because, you know, a lot of
- 35:25Americans have no perspective other than the tiny
- 35:31bit of news they get from America.
- 35:34It doesn't make me a better person.
- 35:36I don't claim that at all.
- 35:37I'm a piece of crap in a lot
- 35:39of regards, you know what I mean?
- 35:41But at least I have a different perspective.
- 35:44You know, I've gone through some crap in
- 35:46my life, and that number one has given
- 35:48me a little bit of a different perspective.
- 35:49But I've also been other places and seen
- 35:53other things and tried to learn how other
- 35:56people live and how they think.
- 35:58Our government doesn't do that at all.
- 36:02They didn't do this for Venezuela, not remotely.
- 36:05This was not for Venezuela.
- 36:07Will they have a few that will go,
- 36:10oh, yeah, great.
- 36:11Same thing, cheering their football team, waving the
- 36:14flag.
- 36:14Sure they will.
- 36:16Will they have a whole bunch that are
- 36:17plunged into poverty that you'll never hear anything
- 36:20about?
- 36:21People that are killed on the sidelines, you'll
- 36:24never hear anything about that.
- 36:25The 100 or so that were killed in
- 36:28this quest to advertise that we are doing
- 36:34the right thing and we're stealing your oil.
- 36:39That's not the right thing, by the way.
- 36:41You know, taking things that don't belong to
- 36:44you are never the right thing, and they
- 36:47don't belong to us, but we've just stolen
- 36:49them.
- 36:49And Trump is proud of it, and they're
- 36:52very proud of the fact that we're thieves,
- 36:54we're criminals, we're robbers, we're imperialist bandits.
- 36:59That's what we are, and that's what this
- 37:01represents.
- 37:02We could have done something with diplomacy, but
- 37:06nope, all we have is force and the
- 37:08threat of force and parking our Navy outside
- 37:11of there, blowing up ships with zero, and
- 37:13you know what?
- 37:14We watched them do that for two, three
- 37:16months, blow up ships, and the uproar, you
- 37:20know, they were watching.
- 37:21They're going, oh, well, there's not much uproar
- 37:23about that.
- 37:24There's some people bitching about it, but not
- 37:26very many.
- 37:27You know, nobody's bitching about that.
- 37:29What if we go in and kill 100
- 37:30people and steal a guy and claim it's,
- 37:33you can imagine him sitting in the back
- 37:36office of the White House with Lindsey Graham
- 37:38and Marco Rubio and Donald Trump all rubbing
- 37:40their hands together in, you know, like Dudley,
- 37:45what was Snidely, Snidely whiplash or whatever, sitting
- 37:48back there and going, yeah, yeah, they won't,
- 37:51you know, we've convinced them.
- 37:52Nobody said anything, and we'll just go a
- 37:54step further, and that's incrementalism going further and
- 37:57further and further, and then you pull the
- 37:59rug out from underneath and you go, oh,
- 38:01by the way, everything we told you the
- 38:02last three months was a complete lie.
- 38:04This isn't about narco-terrorism.
- 38:07It's about nothing but stealing resources and keeping
- 38:11China out.
- 38:12Well, why didn't you tell me that in
- 38:14the first place?
- 38:15I might have been able to help you,
- 38:17you know, figure, or at least support you
- 38:19in your effort to do it.
- 38:20I don't support this type of behavior, and
- 38:23I think it's just wrong.
- 38:25And so, anyway, that's my rant on that
- 38:26topic.
- 38:27I really got to get off of it
- 38:28because I said I wasn't going to.
- 38:30I wanted to get back to the craziness
- 38:31that's going on here in Missouri, and there's
- 38:36plenty of that going on.
- 38:37All of you know that, well, I only
- 38:41meant to spend 20 minutes on that, and
- 38:43I doubled it.
- 38:44I spent 40, so sorry about that, but
- 38:48we're going to continue on because there's something
- 38:51I've been working on for a little while.
- 38:53I've been involved with the group, and I
- 38:55put a little ping, and hopefully, you know,
- 38:57how you can get on CaseNet, and you
- 38:59can tell it to, what do you call
- 39:04it, ping you when activity occurs on a
- 39:08particular case.
- 39:09That's what I have done, and I'm watching
- 39:11this case, and I want to know where
- 39:15it is.
- 39:16And so, I'm waiting for this judgment, and
- 39:24the hearing was December 3rd.
- 39:26The parties, the attorneys had to submit their
- 39:31proposed judgments by December.
- 39:34Turned out to be December 17th, I think,
- 39:37is when they were all submitted a couple
- 39:38weeks later.
- 39:41And now, you know, with the holidays and
- 39:43stuff, no ruling's going to be made, but
- 39:45I've been waiting for a ruling, and it's
- 39:48on the, or we have been waiting for
- 39:49a ruling, and we're very interested in where
- 39:53we go from here, and this has to
- 39:56do with alcohol and tobacco control.
- 39:59Last week, I walked you through the Chevron
- 40:02Doctrine, what it meant, the overturning of that
- 40:06doctrine by a Supreme Court of the United
- 40:09States case called Loper Bright, and Loper Bright
- 40:13overturned the Chevron deference, and deference was when
- 40:19a court was, or had a case before
- 40:26it, predicated upon agency action against, you know,
- 40:33somebody, license holder, agency action, and I don't
- 40:36know what, pick one, and people fighting a
- 40:42term of either a regulation, an interpretation of
- 40:50a regulation, an action on a regulation, anything
- 40:54regarded to a regulation or a statute that
- 40:56was interpreted by an agency.
- 41:00The Chevron Doctrine said that the court should
- 41:07defer to the professional bureaucrat, right?
- 41:11That, well, the professional bureaucrat's been doing this
- 41:15for, you know, 30 years, the agencies are
- 41:18usually built with people who know what they're
- 41:21doing, which is totally wrong, by the way.
- 41:26Thinking that agencies are built with people that
- 41:28know what they're doing, or taking that as
- 41:31a presumed fact is not a good idea,
- 41:34because it's not a good fact.
- 41:37Have a lot of respect for a lot
- 41:38of government workers, but I got a lot
- 41:41of lack of respect for plenty more that
- 41:46clearly love their position more than they love,
- 41:49you know, the law, and they truly love
- 41:52the fact that they were the ones interpreting
- 41:56the agency action, right?
- 42:00And so they would interpret the agency action,
- 42:02and under the Chevron Doctrine, which was in
- 42:05place for, I can't remember when Chevron came
- 42:07out, 71, 72, I really don't remember, and
- 42:10I could be off decades in that, I
- 42:12don't remember.
- 42:13But I think it was in the 70s
- 42:15when the Chevron Doctrine came about.
- 42:18And from 40, 50 years, let's call it,
- 42:22maybe it's long, and maybe it's less than
- 42:23that, who knows?
- 42:24But some, a decent period of time, I
- 42:26could look it up, but I'm not going
- 42:28to, because it's, for that period of time,
- 42:31courts would defer to the professional bureaucrat interpretation
- 42:36of whatever this, whatever they were interpreting.
- 42:40If they're interpreting a regulation, a statute, a
- 42:43guide, a handbook, you know, whatever, an action
- 42:48against an individual, a business, or anything, and
- 42:52the court would say, well, these guys are
- 42:54the experts, I'm not the expert, I'm a
- 42:56judge, you know, I'm not the expert in
- 42:58this case, alcohol and tobacco rules.
- 43:02They are, you know, they're experts on alcohol
- 43:04and tobacco rules, not me.
- 43:06So, I will defer to their interpretation, because
- 43:10they've been doing it a long time, and
- 43:12presumably, they won't use the interpretation one way
- 43:16for one person, and another way for another.
- 43:19What that allowed was exactly that to happen,
- 43:22though.
- 43:23Agencies could pick and choose who they targeted,
- 43:27and that's my biggest beef with administrative action.
- 43:30It isn't given in a blanket manner to
- 43:33everyone.
- 43:35It is selective.
- 43:37These guys selectively go out and choose who
- 43:40to go after.
- 43:41They selectively pick and choose what issues they
- 43:44like and don't like.
- 43:47Targeting is prevalent, and in fact, a preferred
- 43:51method of destroying people in Missouri and many
- 43:55other places.
- 43:56And so, the Chevron doctrine kind of allowed
- 44:00that to happen, right?
- 44:01The Chevron doctrine would go, because when you
- 44:03sued them, you'd get into court, and the
- 44:05judge would go, well, you know, the agency
- 44:07gets the, you know, ties go in their
- 44:11favor, you know, if there's a tie.
- 44:13And so, you know, we're going to go
- 44:14with their, we're going to defer to their
- 44:17understanding.
- 44:18And, you know, sorry, but your understanding doesn't
- 44:21count.
- 44:22You know, what the statute says doesn't count.
- 44:25How they've interpreted it does count.
- 44:28Even if the interpretation is BS, you know,
- 44:31we defer to what they decide.
- 44:33So, Loper Bright came along in 2024 and
- 44:37changed all of that.
- 44:41Loper Bright, on the Supreme Court of the
- 44:43United States, overturned the Chevron doctrine and said
- 44:47what should have been said, in my view,
- 44:49all along.
- 44:50It said, listen, this is nonsense.
- 44:54The interpretation of the law is a legal
- 44:59matter, and judges determine what the law is.
- 45:06Not some bureaucrat in an agency, even if
- 45:10they've been there 30 years, doesn't matter.
- 45:13Law judgments should be interpreted by the court.
- 45:18The meaning of a statute shouldn't be interpreted
- 45:22by some, you know, I don't know, non
- 45:26-lawyer, you know, all judges are lawyers.
- 45:30Well, actually, that's not true in Texas.
- 45:32But in most places, all judges are lawyers.
- 45:36And so, when they make an interpretation, presumably,
- 45:41they were listening in administrative law class in
- 45:46law school.
- 45:46I enjoyed administrative law class.
- 45:49I enjoyed going through all this stuff.
- 45:50I liked it, you know, talking about all
- 45:53those things.
- 45:54And I took even a couple of years,
- 45:57some advanced courses in it.
- 45:58I liked it, you know.
- 45:59Not that I ever wanted to be in
- 46:01an agency.
- 46:01I thought it'd be fun to run the
- 46:03planet, you know, but I'm done with that.
- 46:06You know, let the idiots, you know, like
- 46:08Lindsey Graham do that.
- 46:10I can't kiss ass that much.
- 46:12I just, I can't do it.
- 46:14Makes me wish I could.
- 46:16But look at me.
- 46:17I went straight back to Lindsey Graham because
- 46:19he's such an easy target.
- 46:21Jeez, what up?
- 46:22Oh, you know, I forgot to mention yesterday
- 46:26when I was going on about all the
- 46:27five things that he did.
- 46:29I forgot Afghanistan for that a-hole.
- 46:33You know, what about Afghanistan?
- 46:34You know, he, well, he was involved in
- 46:37that nonsense too.
- 46:39You know, another big knife in the back
- 46:41to the American public.
- 46:43Another big stealing money for a failed mission
- 46:46by Lindsey Graham and company.
- 46:49And there were six, not five.
- 46:51Yesterday I went through five of them and
- 46:54there were actually a sixth one.
- 46:56Cause I can't believe I forgot all about
- 46:58Afghanistan.
- 46:59He was out there talking about that too.
- 47:0220 freaking years we were over there.
- 47:05Lost all kinds of stuff.
- 47:06And don't go acting like that's all Joe
- 47:09Biden and we can blame it on him.
- 47:11You know, Lindsey Graham, if he was the
- 47:13genius, uh, uh, that, that he pretends to
- 47:16be riding around in air force one, then
- 47:19that wouldn't have happened.
- 47:21Nor would any of the other wrong results.
- 47:26The absolute opposite of what he said on
- 47:30every single instance.
- 47:32And here's Trump listening to him.
- 47:34Anyway, sorry to get sucked back into that.
- 47:37We're going to go right back to our,
- 47:38uh, regularly scheduled programming and not rail about
- 47:42the federal government.
- 47:43Cause I have no power against Missouri government,
- 47:46let alone the federal a-holes.
- 47:48You know, this is nonsense.
- 47:49And we just need to understand as Americans,
- 47:52they are not your friend.
- 47:54They are not your friend.
- 47:56Why do we have the right to bear
- 47:58arms?
- 47:58Because the government is not your friend.
- 48:01I don't even own any weapons right now,
- 48:03but I tell you what, I feel like
- 48:05I need to go buy a bunch.
- 48:07You know, I wouldn't pull the, you know,
- 48:09the actor thing and move to another country.
- 48:11Although I would do that just cause I
- 48:12like other countries, I wouldn't do it to
- 48:15avoid the U S you know what I
- 48:17mean?
- 48:17It's not that bad.
- 48:19Yeah.
- 48:19It's a great play.
- 48:20I don't mean it's not that bad.
- 48:21It's a fantastic, but you know, I'm so
- 48:24tired of, of, of these negative things that
- 48:27do nothing for us and only line the
- 48:31pockets of a-holes like Lindsey Graham.
- 48:33Anyway, back to the other stuff, when you
- 48:36look, sorry, I sidetracked myself like a numb
- 48:39nuts and I shouldn't do that, but, but
- 48:43here we go.
- 48:44The, so with Chevron being overturned by Loper
- 48:47Bright, and then the U S or here
- 48:50in Missouri, the, the statute or the Congress
- 48:54in its legislature, in its wisdom, which is
- 49:00rare too, they codified it in 536.140,
- 49:06which I shared with you last week.
- 49:08And basically 536.140 says that in the
- 49:14event, there's a dispute.
- 49:16There's a question.
- 49:17There's an interpretation that needs to be reviewed
- 49:22that that interpretation is the realm of the
- 49:27judiciary of a judge, a judge.
- 49:30When a dispute is brought before him, he
- 49:32will not defer to an agency.
- 49:36He will not, he shall not defer to
- 49:39the agency and he shall interpret it DeNovo
- 49:43brand new, you know, as, as if new,
- 49:46he will interpret it himself and say what
- 49:52it means based on what he knows of
- 49:54the law.
- 49:55And he will do so.
- 49:56They added this key phrase and I'm paraphrasing
- 50:00the phrase, but the key phrase is, and
- 50:03he will do it in a way that
- 50:05maximizes individual liberty and minimizes government overreach.
- 50:13That's basically the last line of this interpretation.
- 50:17And so what the, what the legislature have
- 50:20done, and I've got my, my problems with
- 50:22the legislature and the idiot rules they put
- 50:24into place in a lot of respects, but
- 50:27not that everyone, you know, what they say
- 50:30in the military, you do something right.
- 50:33And the Sergeant look at you go, well,
- 50:34trap, even a blind squirrel finds a nut
- 50:37every once in a while.
- 50:39Right?
- 50:39Well, that's how I feel about the legislature.
- 50:42Even a blind squirrel finds a nut sometimes.
- 50:45And there's the legislature having done the right
- 50:48thing.
- 50:49Wow.
- 50:50What a surprise.
- 50:52Curious.
- 50:53They've done the right thing.
- 50:55We ought to write that down somewhere and
- 50:57go, look, they've done it.
- 50:59They've pulled their collective heads out of their,
- 51:01you know, each other's asses.
- 51:03And look where we've gotten.
- 51:05We've gotten somewhere positive.
- 51:08So this is positive.
- 51:09Okay.
- 51:10And I believe that we are the first
- 51:13to have this, this, this, this law went
- 51:16into effect August 28th of this year, 2025.
- 51:20I'm sorry.
- 51:21It's 2026 now of 2025 and nobody that
- 51:24I'm aware of.
- 51:25And I did some looking has, has asked
- 51:28a court to rule or to make a
- 51:33ruling based upon 536.140. I think we're
- 51:36the first.
- 51:38And so I think that the, the judge
- 51:39in this case is going to be particularly
- 51:41careful with what he does.
- 51:43I mean, why not?
- 51:44He's going to have to be particularly careful
- 51:47because somebody is appealing me the way it's
- 51:49going to be appealed.
- 51:50And I told you a little bit about
- 51:52the case last week and a little bit
- 51:54about what we're doing.
- 51:55Well, turning this, okay.
- 51:58So the alcohol and tobacco control, they have
- 52:02taken, taken it upon themselves to say that.
- 52:08And now did you know, and if you
- 52:11go out to civic warriors or civic outlaws
- 52:13.com, you'll see the start of a webpage
- 52:17that we have going on.
- 52:18It's not finished yet.
- 52:19We have, you know, we have a sample
- 52:21out there, but it's not done.
- 52:23We're testing out the donation links and we're
- 52:26testing out a couple of other things for
- 52:29people to help us go after government overreach
- 52:32and to fund us going after government overreach,
- 52:38which is rampant in America.
- 52:40It's, and, and we believe that with the
- 52:43changes in the Loper Bright decision and with
- 52:47the 536.140 in Missouri, that the, the
- 52:54path is clear and it allows people to
- 52:58revisit issues where they're getting screwed by administrative
- 53:05governmental overreach everywhere.
- 53:09People taking authority that doesn't belong to them.
- 53:12The department of public safety, putting up cameras
- 53:15somewhere and spying on people now needs to
- 53:20be reviewed.
- 53:20They don't have the ability.
- 53:21They don't have the right to do that.
- 53:23They put up these traffic cams, but they
- 53:26don't use them for that.
- 53:27They don't put up traffic cams to, I
- 53:29don't know, to see what happened when an
- 53:32accident occurred.
- 53:33That's not why they're put up.
- 53:35That's one tiny reason, but what they're doing
- 53:38is tracking people.
- 53:39What they're doing is selling the information.
- 53:42Private companies are holding this information.
- 53:45We spent a lot of time on this
- 53:47when I got arrested for being a forward
- 53:50looking and a good man and took down
- 53:54that damn camera because the county has a
- 53:57rule that says you can't put them up.
- 54:00You can't put them up.
- 54:01And yet the sheriff signed something that said
- 54:03that he could.
- 54:04And then the prosecutor helped go after him.
- 54:07Nonsense.
- 54:08And well, somebody needs to get that interpreted
- 54:11and to do it correctly.
- 54:13And somebody needs to file another suit like
- 54:15the one going on in Richmond, Virginia against
- 54:18flop cameras who now with gusto, you know,
- 54:23with...
- 54:27Sorry, excuse me.
- 54:30Maybe put on a song for you for
- 54:32a minute whilst I clear my throat.
- 54:35Oh, no song, just a sip of coffee.
- 54:39How about that?
- 54:40But anyway, the reason that the overturning of
- 54:46Chevron is so important and the reason that
- 54:49the codification of that overturning at a state
- 54:55level in Missouri is so important, still not
- 55:01out of the woods, is that now courts
- 55:05have to determine, you know, what's the right
- 55:08activity in a case.
- 55:11The courts get to determine why a statute
- 55:15was written in this manner.
- 55:18They will look at the...
- 55:19Because one thing an administrative person, a bureaucrat,
- 55:25does not do, has zero interest in, is
- 55:30why.
- 55:31They don't care.
- 55:33To them, everything is black and white.
- 55:35You know, the true...
- 55:36Or everything is according to what they think
- 55:39is right.
- 55:40Doesn't matter what the rules say.
- 55:41This is how I run my ship.
- 55:43This is what I do.
- 55:45You know?
- 55:45And so now we see the path.
- 55:51And the path allows us to go places
- 55:55for anybody.
- 55:57And our start was, I mean, we wish
- 55:59to get into the cameras.
- 56:00We wish to get into things like HOAs
- 56:03and the overreach of HOAs that are approved
- 56:06by the government.
- 56:07Or sort of funding of housing by, you
- 56:12know, the government.
- 56:14Child care nonsense with money that is appropriated
- 56:20by the state.
- 56:23Name it.
- 56:23Anything administrative.
- 56:25And I'm interested in digging in.
- 56:29And one of the greatest tools of that
- 56:31is Sunshine Law, FOIA, Freedom of Information Act,
- 56:37on the federal side.
- 56:40And those tools, unfortunately, are somewhat expensive.
- 56:47We have spent a great deal of money
- 56:49trying to get 36...
- 56:52Well, what we've received so far is like
- 56:544,000 pages of records from the Alcohol
- 57:00and Tobacco Control.
- 57:02Which, you know, we have reviewed.
- 57:05We have gone through.
- 57:06We have combed through pretty deeply using some
- 57:10proprietary tools that we have for that purpose.
- 57:14And we're developing our methods to gather information.
- 57:19And we're going through it.
- 57:20And it's paying off big time.
- 57:23Because what we're finding and what we're seeing
- 57:27is their own words are hanging them.
- 57:30You know?
- 57:31At least in our view.
- 57:32And we don't know what the judge is
- 57:34saying.
- 57:34But we think the path is pretty clear
- 57:36for what he has to do.
- 57:38But ATC has created their own definitions that
- 57:41don't exist in the statute.
- 57:43They have taken on power that was never
- 57:46given to them in an enabling statute.
- 57:49I went through a little bit last week
- 57:51of Section...
- 57:53Chapter 311 of the Revised Statutes of Missouri
- 57:57and Chapter 407 of the Revised Statute of
- 58:00Missouri, which gives the enabling language to Alcohol
- 58:04and Tobacco Control.
- 58:06And so, Alcohol and Tobacco Control.
- 58:08The only power you can take as an
- 58:12administrator is the power that is given to
- 58:16you.
- 58:16Let me equate this to you like somebody's
- 58:19power of attorney.
- 58:20Okay?
- 58:22When I'm old and feeble, it's possible that
- 58:27I need to have a power of attorney
- 58:29because...
- 58:30Simply for the fact that I can't get
- 58:32around as fast as I used to.
- 58:35Okay?
- 58:35And so, I can say something to somebody
- 58:38like, listen, I'm going to give you this
- 58:41piece of paper that gives...
- 58:43It's a grocery list.
- 58:45All I want you to do is get
- 58:46out in the grocery store.
- 58:47Here's my credit card.
- 58:48I want you to use my credit card
- 58:50to buy this thing.
- 58:51There's a grocery store.
- 58:52I'm going to write a thing on the
- 58:54bottom that says, I give this person the
- 58:56authority to use my credit card, but only
- 58:58to buy these 10 items.
- 59:00He can't put on candy bars for himself.
- 59:02And I sign the bottom.
- 59:03Arguably, that's an enforceable power of attorney.
- 59:06I've authorized someone to act on my behalf.
- 59:11So, when you authorize an agency to act
- 59:16on behalf of the king, you know, the
- 59:18governor's the king in this scenario.
- 59:21And when the governor has to be given
- 59:23that power, first of all, any power he
- 59:26gets is derived from the legislature giving him
- 59:30the power.
- 59:31And he's kept in check by the judicial
- 59:35branch, right?
- 59:36But the power comes through the law, through
- 59:39the statutes, through the things that are written,
- 59:42right?
- 59:42And then he can go through and he
- 59:45appoints...
- 59:46It gets even worse because now he appoints
- 59:49the head of the Department of Public Safety.
- 59:51And the head of the Department of Public
- 59:53Safety has all of the rules that he
- 59:55has to abide by for the highway patrol,
- 59:58for the water patrol, for whatever, name it.
- 1:00:01One of those other ones is the alcohol
- 1:00:04and tobacco control folks, right?
- 1:00:07So, the Department of Public Safety, ATC is
- 1:00:10underneath them.
- 1:00:11So, now you've got a power of attorney.
- 1:00:14Well, an authorizing statute.
- 1:00:17Now, we're not going to call it a
- 1:00:18power of attorney, but it's basically what it
- 1:00:19is.
- 1:00:20It's an authorization to act.
- 1:00:22And that authorization to act and to enforce
- 1:00:25or to carry out the law is given
- 1:00:31to the governor to carry out the law.
- 1:00:33The legislature created it.
- 1:00:35The governor has to carry it out.
- 1:00:37He does that through the Department of Public
- 1:00:40Safety head.
- 1:00:40And that guy appoints somebody to alcohol, tobacco
- 1:00:44control.
- 1:00:45That person has 500 others.
- 1:00:48I don't know the number.
- 1:00:49That could be a BS number.
- 1:00:50God knows how many there are that work
- 1:00:53for her in this case.
- 1:00:55And each one of those things has a
- 1:00:58level of authority of interpretation and of things
- 1:01:01like that.
- 1:01:02Well, at the core of it, though, the
- 1:01:06only authority, because what's happened is the legislature
- 1:01:12created the alcohol and tobacco control back in
- 1:01:17the 40s, I think it was.
- 1:01:19Back during, right after Prohibition or maybe even
- 1:01:22during.
- 1:01:22So, it's been around for a long time.
- 1:01:24And they created it.
- 1:01:26And over the years, they've narrowed it down.
- 1:01:28But they've now, the only authority they ever
- 1:01:31gave them is to enforce things under alcohol
- 1:01:36and tobacco controls, enabling language inside Chapter 311
- 1:01:41and 407.
- 1:01:43What that means is they can't, we call
- 1:01:46it bootstrapping.
- 1:01:47You can't bootstrap and steal power from somewhere
- 1:01:51else that you don't have.
- 1:01:53Or you can't suck in, I don't know,
- 1:01:59law from somewhere else that you cannot enforce.
- 1:02:04And we allege that's what they've been doing.
- 1:02:07And so, over the years, ATC has gotten
- 1:02:10pretty proud of themselves.
- 1:02:12And they've created circulars to send around and
- 1:02:15tell people that, oh, gee, you better watch
- 1:02:18out, hooters.
- 1:02:19And you better not have girls running around
- 1:02:21with the bottom, with their butt cheek.
- 1:02:23They call it the butt cheek.
- 1:02:25And, oh, you people at Twin Peaks, the
- 1:02:29one with the girls where they all got
- 1:02:30big boobs.
- 1:02:32Cleavage is okay, but you better make sure
- 1:02:34that the under boob, that the under boob
- 1:02:38isn't hanging.
- 1:02:39Tube tops aren't going to be okay.
- 1:02:41We don't want to see any under boob.
- 1:02:45Well, who gave them that authority?
- 1:02:49Who said that, I mean, what does your
- 1:02:52alcohol license, what does alcohol or tobacco have
- 1:02:57to do with whether a girl, because they
- 1:03:01happen to be serving alcohol and she's got
- 1:03:04big boobs or a big ass and she
- 1:03:08can't have the under, you know, your under
- 1:03:12part of your butt or your under boob
- 1:03:17can't be visible.
- 1:03:19And certainly a can't be visible.
- 1:03:21But, you know, that's nudity.
- 1:03:22It's not allowed.
- 1:03:23But usually nudity was more of a local
- 1:03:25thing.
- 1:03:26I don't know.
- 1:03:26I haven't done any serious research on that,
- 1:03:30but I remember the free the nipple thing
- 1:03:32that was going on in Columbia several years
- 1:03:35ago.
- 1:03:36And I made sure to go to this
- 1:03:38place because the women were all wandering down
- 1:03:40the street topless.
- 1:03:41And I was like, well, you know what?
- 1:03:42I'm for this.
- 1:03:44Suddenly, I'm for it.
- 1:03:45No, I'm kidding.
- 1:03:47I honestly don't even think I went to
- 1:03:48that.
- 1:03:49But I remember hearing about it.
- 1:03:50But that's humor from a Sam side.
- 1:03:54And sometimes my humor kicks me in the
- 1:03:55butt.
- 1:03:56But at any rate, the whole point of
- 1:03:59saying that is who in the world gives
- 1:04:02you alcohol licensing people the authority to go
- 1:04:09into hooters and say, gee, don't hire girls
- 1:04:13with big boobs, you know, because, you know,
- 1:04:18or make sure that when you do, boy,
- 1:04:20they better have them propped up correctly.
- 1:04:23And, you know, nothing is hanging out below
- 1:04:25the top.
- 1:04:26Or if they happen to have a big
- 1:04:28butt in their butt cheek, you can see
- 1:04:31the bottom of the butt cheek.
- 1:04:32What the hell is the difference in the
- 1:04:34bottom of a butt cheek?
- 1:04:35Is everybody supposed to wear underalls?
- 1:04:38You know, women don't do that.
- 1:04:40And you can go to any swim up
- 1:04:42bar in this place.
- 1:04:44And the girls that are serving alcohol, the
- 1:04:47waitresses or the servers that are running around
- 1:04:50providing stuff are wearing bikinis.
- 1:04:54And the bikinis are bikinis.
- 1:04:57Women don't wear the ones that, you know,
- 1:04:59they don't wear shorts for, I don't know,
- 1:05:04bikini bottoms.
- 1:05:05They don't do it.
- 1:05:06It doesn't cover the under cheek of the
- 1:05:10butt.
- 1:05:11It doesn't do it.
- 1:05:12But that is what, you know, there's a
- 1:05:14story going around, and this is true.
- 1:05:16We can get an affidavit for this.
- 1:05:18This is disgusting to me, okay?
- 1:05:21Now, personal grooming is definitely a personal matter.
- 1:05:25You know, how you choose to groom is
- 1:05:28a personal matter.
- 1:05:29And I remember being in the Army years
- 1:05:32and years ago.
- 1:05:32And I was on a three-man team
- 1:05:34on something called Quick Fix.
- 1:05:36And Quick Fix was something way back when
- 1:05:39you could, when it was hard to target
- 1:05:42where a radio signal was coming from.
- 1:05:45And so what you would do would be
- 1:05:47you would triangulate.
- 1:05:48There'd be three Quick Fix units.
- 1:05:51And each one of us had a Tilky
- 1:05:5317 Alpha that would jam, and a collection
- 1:05:57module, a 32 Victor that would collect radio
- 1:06:01signals.
- 1:06:02And then later, in a helicopter, we did
- 1:06:05the same thing in helicopters.
- 1:06:07But in order to get it to work,
- 1:06:08and today this is not the case, but
- 1:06:10way back then, you had to have a
- 1:06:14mile apart on three different hills, three separate
- 1:06:17apparatus.
- 1:06:19And I'd be in one of them, and
- 1:06:20I'd have two more on hills a mile
- 1:06:22on either side of me, right?
- 1:06:24And when I pushed a button, I could
- 1:06:26triangulate a position and catch a radio signal
- 1:06:29from an enemy and pinpoint to within, it
- 1:06:33had an error of probability, but to within
- 1:06:35so many feet of where that guy was
- 1:06:38standing.
- 1:06:39And I could call in artillery and go,
- 1:06:41take out this guy.
- 1:06:42He's bombing the hell out of people.
- 1:06:43You know, that's triangulation.
- 1:06:47And so you could put that into place
- 1:06:50and have that.
- 1:06:52And the point of that for this sort
- 1:06:59of thing is I came over a hill
- 1:07:01one day inspecting one of my teams, and
- 1:07:04it was in the middle of the Mojave
- 1:07:06Desert.
- 1:07:06And so that part of the story was
- 1:07:08really not relevant at all.
- 1:07:09But I come over the hill, I had
- 1:07:10a girl on my team.
- 1:07:12And this is back when girls couldn't be
- 1:07:14in combat, but they could be in military
- 1:07:16intelligence.
- 1:07:17And so we were out in the field,
- 1:07:18two guys and a girl.
- 1:07:20And this girl, I come over the hill,
- 1:07:22and she's laying out on a beach chair
- 1:07:27in the middle of the desert.
- 1:07:29And I'm going, and she's sunning herself, wearing
- 1:07:32a bikini.
- 1:07:33And I'm like, you can't do that.
- 1:07:35And I was sent there by a guy
- 1:07:36named Figaro.
- 1:07:37He's like, Sergeant Trapp, you got to go
- 1:07:38over and check her.
- 1:07:39Oh, she's beautiful.
- 1:07:40I can't go see her.
- 1:07:41And she was not beautiful.
- 1:07:43But that's neither here nor there.
- 1:07:46When you went over and you saw this
- 1:07:47girl, it has to do with grooming.
- 1:07:51I'm telling you, this girl was wearing a
- 1:07:54bikini.
- 1:07:55And everywhere she did not shave.
- 1:07:59She was a pubic hair heaven.
- 1:08:01It was everywhere.
- 1:08:03Some women are that way.
- 1:08:05And who are you to determine who gets
- 1:08:07to do it?
- 1:08:07Well, the story goes that here at the
- 1:08:10lake, one of the owners of a club
- 1:08:14here, an ATC guy was inspecting him on
- 1:08:18a day when there were a lot of
- 1:08:20people out.
- 1:08:21And there was a middle-aged woman eating
- 1:08:23and having a drink on the side of
- 1:08:26the pool, the swim-up pool at the
- 1:08:28bar.
- 1:08:29And the woman was similar to the girl
- 1:08:32I just told you about, her grooming.
- 1:08:35She wasn't one of those that shaves everything.
- 1:08:37And the ATC guy made the owner of
- 1:08:42the bar go over and tell this woman
- 1:08:46she had to either put on some shorts
- 1:08:50or leave the facility because there was pubic
- 1:08:55hair coming out the side of her bikini.
- 1:09:03Now, let that sink in a minute, okay?
- 1:09:06I'm not for or against.
- 1:09:08I don't care.
- 1:09:09People's grooming is their own grooming.
- 1:09:11But who the hell made you in charge
- 1:09:14of determining what somebody gets to wear or
- 1:09:17not wear based on your arcane view of
- 1:09:22grooming for women or anything else for that
- 1:09:25matter?
- 1:09:26If you're going to target a facility because
- 1:09:30it allows middle-aged women to come and
- 1:09:33sit on the side of a pool unshaven,
- 1:09:37that is not what you were enabled to
- 1:09:40do by the legislature of the state of
- 1:09:43Missouri.
- 1:09:44That's the issue.
- 1:09:46Who in the world told you?
- 1:09:48And the justification is that is lewd.
- 1:09:53That's lewd to you.
- 1:09:55Who allowed you to come in and interpret
- 1:09:57that lewd is there?
- 1:09:58Where did the legislature write a definition for
- 1:10:01lewd that said if a woman is showing
- 1:10:04pubic hair and she's a middle-aged woman
- 1:10:07sitting on the side of the pool drinking
- 1:10:08a drink, you can kick her out of
- 1:10:10a bar.
- 1:10:11That's nonsense.
- 1:10:13It's crap.
- 1:10:14And the legislature, if they're doing that, I
- 1:10:17would target that too.
- 1:10:18But the legislature isn't doing that.
- 1:10:20This is some over the years, many years
- 1:10:24of interpretation.
- 1:10:25The ATC has created these rules that they
- 1:10:31created, they interpreted, they bootstrapped from other places
- 1:10:38and said you can't do it.
- 1:10:40You can't because all they can enforce, all
- 1:10:44they can enforce is laws having to do
- 1:10:47with alcohol or tobacco.
- 1:10:51They weren't, they're not the pubic hair police.
- 1:10:54What is this nonsense?
- 1:10:57This is ridiculous.
- 1:10:59And it is a terrible story.
- 1:11:02It's a shame that you have to report
- 1:11:03that.
- 1:11:04The guy, I won't say who it is,
- 1:11:10you know, if he ever wants to, you
- 1:11:11know, we'll let him come on and chat
- 1:11:13about it.
- 1:11:14But these are, whether they're important issues to
- 1:11:18you or not, they're certainly important real issues
- 1:11:26about the overreach of government everywhere.
- 1:11:31Everybody knows that I believe, I detest government
- 1:11:36overreach.
- 1:11:37I detest government stretching their authority.
- 1:11:44And you know, the president can declare war.
- 1:11:47Well, but over the last 30 years, we've
- 1:11:51discovered that he doesn't have to do that.
- 1:11:54He can create war in many, many places
- 1:11:56and never declare it.
- 1:11:59That way you can always claim that the
- 1:12:01US hasn't lost when it's a war and
- 1:12:04we leave a place in ruins.
- 1:12:06Worse than we started with it.
- 1:12:09The goal should be that we leave a
- 1:12:10place better off than when we came in.
- 1:12:13That ain't going to happen in Venezuela.
- 1:12:16You know, the people that'll be better off
- 1:12:19will be the board of directors of, you
- 1:12:22know, Chevron.
- 1:12:23Again, a new Chevron doctrine is we give
- 1:12:27you, we give you Venezuela.
- 1:12:29You know, that's the new Chevron doctrine, right?
- 1:12:33Nonsense.
- 1:12:34And at any rate, government overreach is where
- 1:12:38I like to spend some time.
- 1:12:41And one of the ways to do that
- 1:12:43is through sending out of sunshine law requests.
- 1:12:50And we sent out a sunshine request.
- 1:12:54And I want to share with you this
- 1:13:01comical response.
- 1:13:03Where is it?
- 1:13:09Let's see if I can bring this up
- 1:13:11without hurting myself too much.
- 1:13:18Because it is downright comical what they responded
- 1:13:26here.
- 1:13:27And this I target.
- 1:13:29This I do not like.
- 1:13:31This is foolish.
- 1:13:36And I may have shared some of it
- 1:13:43with you.
- 1:13:46Where is it?
- 1:13:48But I don't think I shared all of
- 1:13:50it with you.
- 1:13:52And I need that letter.
- 1:13:55And I think I'm going to have to
- 1:13:56search for it in my drive here.
- 1:13:58It'll take me just a second to get
- 1:14:00there.
- 1:14:01And but it's, I find it to be
- 1:14:05entertaining.
- 1:14:07You may not, but I like it.
- 1:14:10And it is the response to a request
- 1:14:14for information from Alcohol and Tobacco Control.
- 1:14:20And we had asked for a number of
- 1:14:26documents, certain topic areas.
- 1:14:30And what we got in return, where is
- 1:14:35it?
- 1:14:36Come on, give us the long one.
- 1:14:38So they sent us two on the same
- 1:14:40day.
- 1:14:41And I keep opening the first one and
- 1:14:44I can't find the second one.
- 1:14:47And where in the world is it?
- 1:14:51Hello, how is the family?
- 1:14:56Um, come on, come on, come on, come
- 1:14:59on.
- 1:15:02Let's see here.
- 1:15:05I think I have found it.
- 1:15:09Here we go.
- 1:15:12This is a long letter.
- 1:15:14Okay.
- 1:15:14And so I'm not going to share all
- 1:15:16of it with you.
- 1:15:17But basically, we have requested a number of
- 1:15:22documents.
- 1:15:24And the request was responded to as follows.
- 1:15:33We received your December 4th and December 9th
- 1:15:37letters, which include additional requests.
- 1:15:42Since August, we have in good faith made
- 1:15:45every reasonable effort.
- 1:15:47And I'm paraphrasing, I'm not reading all this
- 1:15:49to you.
- 1:15:50To fulfill your request in an organized manner.
- 1:15:54To date, more than 3,600 pages of
- 1:15:57records have been provided.
- 1:16:00Our communications with you have consistently included clear
- 1:16:05estimations of dates on when the records would
- 1:16:08be made available for inspection, detailed explanations when
- 1:16:12appropriate for why access was delayed, specific statements
- 1:16:17of the provision of law under which we
- 1:16:19closed our records when applicable, and clarifications regarding
- 1:16:25which of your expanded requests the documents produce
- 1:16:29pertain to.
- 1:16:31We believe our team's extraordinary efforts to fulfill
- 1:16:35your request demonstrate our respect for Missouri's policy
- 1:16:39favoring open conduct of business.
- 1:16:43Despite our good faith efforts, and remember, I'm
- 1:16:47paraphrasing because this is a long letter, but
- 1:16:49I'm not adding anything.
- 1:16:51It is plain from the increasingly hostile and
- 1:16:54argumentative tone of your communication and the overly
- 1:16:59broad, unduly burdensome, that's a legal term, nature
- 1:17:04of your repeated demands, particularly those made in
- 1:17:08October 3rd, 7th, 10th, November 10th, December 4th,
- 1:17:12and December 9th, that your invocation of Missouri
- 1:17:16sunshine law is intended not as a tool
- 1:17:19to examine public meetings and records, but as
- 1:17:23a weapon to harass the division, burden the
- 1:17:27government, and strain agency staff.
- 1:17:31It seems to the division that due to
- 1:17:36the obvious connection between the record and the
- 1:17:39nature of your pending legal action, these requests
- 1:17:42are in retaliation for administrative actions taken against
- 1:17:46your liquor license, and a means to conduct
- 1:17:50improper discovery, okay?
- 1:17:58The estimates provided below are calculated assuming at
- 1:18:04this time that the requests are completed using
- 1:18:07currently available agency resources.
- 1:18:11Historically, the division has not received sunshine requests
- 1:18:15in quantities or volume necessary to consider the
- 1:18:18assignment of additional employees or resources.
- 1:18:22Therefore, as currently staffed, ATC's capacity to process
- 1:18:27requests of the size you submitted will unfortunately
- 1:18:33result in a very lengthy fulfillment time.
- 1:18:37When upon receipt of payment, ATC commences with
- 1:18:43processing the requests outlined below, the agency will
- 1:18:48explore avenues through which it might reduce the
- 1:18:52time and expense estimated to fulfill the request.
- 1:18:55Such possible solutions might include, but aren't limited
- 1:18:59to, outsourcing review to a private firm.
- 1:19:03Well, if you're going to do that, why
- 1:19:05don't you just let me in there?
- 1:19:07I'm a private firm.
- 1:19:08I'll go have a look at all your
- 1:19:10records and decide what it is.
- 1:19:12If you're going to hire somebody outside anyway,
- 1:19:14why wouldn't you just let me do it?
- 1:19:16Anyway, continuing, employing additional temporary or part-time
- 1:19:20personnel for document review, or hiring a full
- 1:19:23-time employee dedicated permanently to matters related to
- 1:19:27sunshine law.
- 1:19:28We caution, however, that requests of this nature
- 1:19:32must be formally submitted and approved as budget
- 1:19:35items.
- 1:19:36So now, me requesting a sunshine item, or
- 1:19:39anyone, we cannot guarantee either their approval or
- 1:19:43timeline within which they would be considered if
- 1:19:46submitted.
- 1:19:46Thus, the time required to fulfill your request
- 1:19:49stated below should not be assumed to change
- 1:19:54unless indicated otherwise by authorized agency personnel.
- 1:19:59Any expenses approved will be billed to you
- 1:20:02as allowed prior to completion.
- 1:20:05So the remaining records encompassed by the letters,
- 1:20:11the previous letters, we have processed all portions
- 1:20:15of these records sought.
- 1:20:18Okay.
- 1:20:20Communications.
- 1:20:21We asked where they get the authority to
- 1:20:24patrons or served alcohol by servers wearing bikinis
- 1:20:29or attire that is deemed to be lewd,
- 1:20:33right?
- 1:20:34We want communication, email, text message, enforcement, discussion,
- 1:20:37or actions regarding bars, restaurants, or other establishments
- 1:20:40licensed to sell alcohol where servers are wearing
- 1:20:44clothing deemed lewd by ATC.
- 1:20:48So the request is go out and tell
- 1:20:52us.
- 1:20:53Every instance where you have targeted somebody's license
- 1:20:58because of lewd clothing by a woman, okay?
- 1:21:05This is what they, with respect to these
- 1:21:08records, we indicated in December 7, November 7
- 1:21:13correspondence that the division doesn't categorize licensees in
- 1:21:17this manner.
- 1:21:18But they have a piece of paper that
- 1:21:21judges people according to it.
- 1:21:24One of the check marks on the inspection
- 1:21:26sheet is lewdness.
- 1:21:30They check every less licensee for whether or
- 1:21:33not they are lewd.
- 1:21:35You can't go through and tell me how
- 1:21:37many people you've punished or questioned or fined
- 1:21:42for being lewd.
- 1:21:45Apparently they can because listen to what they
- 1:21:48say after this.
- 1:21:51This list, and they gave all of these
- 1:21:53things, right?
- 1:21:55Keyword searches.
- 1:21:57Lewd.
- 1:21:58The list resulted in the retrieval of 691
- 1:22:03,463 email files alone.
- 1:22:07We conservatively estimate the cost associated with fulfillment
- 1:22:13of this portion of these records will total
- 1:22:17$368,783.77. And
- 1:22:29the earliest these records will be available for
- 1:22:33you for your review is 44 years, 3
- 1:22:38months, and 26 days from the receipt of
- 1:22:42payment.
- 1:22:4444.32 years.
- 1:22:48Should fulfillment of this request result in fees
- 1:22:52lower than those estimated here, the difference will
- 1:22:56be credited to you.
- 1:22:58And they want the party requesting to pay
- 1:23:02this amount up front, right?
- 1:23:10Yeah.
- 1:23:10Okay.
- 1:23:11No, no.
- 1:23:12Hey, this is going to cost a lot
- 1:23:13of money.
- 1:23:14No.
- 1:23:14Hey, we got personnel problems.
- 1:23:16No, you know that no, they, nothing in
- 1:23:19the sunshine law says that, you know, you
- 1:23:21get to do this when, when the, this
- 1:23:23is one of your duties and responsibilities, by
- 1:23:26the way, this is one of the things
- 1:23:27you are required to do under sunshine law.
- 1:23:32And somebody would, you know, you would normally,
- 1:23:37somebody would send not this accusatory letter, but
- 1:23:40something to say, hey, you know, maybe we
- 1:23:45could tailor that a little bit.
- 1:23:47Maybe we could come up with something like
- 1:23:51that.
- 1:23:52We also asked for another, another document.
- 1:23:56There was another request in a December 9th
- 1:24:00letter requesting any documents, including incident reports, investigative
- 1:24:05reports, forms, memoranda, emails, in which any of
- 1:24:09the following phrases appear in the heading, title,
- 1:24:14body, footer, where they define themselves because what
- 1:24:18they have done is they have taken the
- 1:24:20authority not given to them and called themselves
- 1:24:23the Alcohol and Tobacco Control Police Department.
- 1:24:27And we have several examples of this, or
- 1:24:30the ATC Police Department, or the Alcohol and
- 1:24:33Tobacco Control Police Department.
- 1:24:36We explained in an email dated October 10
- 1:24:39that the division does not identify itself as
- 1:24:43Division of Alcohol and Tobacco Control Police Department.
- 1:24:46They actually do.
- 1:24:48To clarify, this phrase appears only at the
- 1:24:50top of specific printed investigative reports entered into
- 1:24:55the computer-assisted report entry database, the CARE
- 1:24:58database.
- 1:24:59The header of these reports is auto-generated
- 1:25:03by the database, which was built by the
- 1:25:06St. Louis County Police Department and is used
- 1:25:08by multiple government agencies and appears only when
- 1:25:12reports are generated from the database in current
- 1:25:15printable format.
- 1:25:17Several report formats accurately populate the header using
- 1:25:21the correct identifier, Division of Alcohol and Tobacco
- 1:25:25Control.
- 1:25:26It is a bug in the system that
- 1:25:28resulted in the alternative header for some entities
- 1:25:32and accounts for ATC's oversight of this discrepancy.
- 1:25:38In the previous five years, 8,428 approximately
- 1:25:43reports have been entered by ATC agents.
- 1:25:45We conservatively estimate that the fee for producing
- 1:25:48every CARE report bearing the phrase Alcohol and
- 1:25:52Tobacco Control Police Department in the associated emails
- 1:25:57in the last five years will be $34
- 1:26:04,839.45. The earliest we estimate these records
- 1:26:11will be available to review is four years,
- 1:26:14two months, and two days from the receipt
- 1:26:16of payment.
- 1:26:18Yeah, seems odd, doesn't it?
- 1:26:22So who is being rude to whom is
- 1:26:26the question?
- 1:26:27Who is using fees as a deterrent or
- 1:26:32responses to sunshine requests as a deterrent?
- 1:26:37And you can't just go out and maybe
- 1:26:40you should only search for the word Alcohol
- 1:26:42Tobacco Control Police Department and why deny it
- 1:26:45if you know damn well it's on your
- 1:26:47reports and has been.
- 1:26:50They knew about this and they were coming
- 1:26:51up with a reason why.
- 1:26:53This is bureaucracy, friends and neighbors.
- 1:26:56You create defenses to yourselves later.
- 1:27:02And one of the defenses is to scare
- 1:27:03people off with large amounts of money.
- 1:27:06But you can run in a shoddy fashion
- 1:27:10and take power that doesn't belong to you
- 1:27:12and nobody can question you because you're not
- 1:27:15permitted.
- 1:27:16You're just a riffraff out there.
