Transcript
- 0:00Speaker 1: What's up everyone and welcome back to the program. Yesterday,
- 0:04Speaker 1: Tyler Robinson appeared before Judge Graff to find out if
- 0:09Speaker 1: he would go to trial for the alleged murder of
- 0:12Speaker 1: Charlie Kirk. And when all was said and done, that's
- 0:16Speaker 1: exactly what's going to happen. Because Judge Graff decided that
- 0:21Speaker 1: there was more than enough evidence to bind Tyler Robinson
- 0:24Speaker 1: over for trial. And not only that, he didn't get
- 0:28Speaker 1: rid of the aggravated enhancement that could have gotten rid
- 0:32Speaker 1: of the death penalty for Tyler Robinson. So, not only
- 0:36Speaker 1: is Tyler Robinson facing murder charges, he's facing the death penalty.
- 0:42Speaker 1: Today we have an article from CBS News and the headline,
- 0:46Speaker 1: Charlie Kirk's accused killer will stand trial for aggravated murder.
- 0:49Speaker 1: Utah judge rules. This article was authored by Carter Evans.
- 0:57Speaker 1: Charlie Kirk's alleged killer will stand trial for aggravated murder
- 1:01Speaker 1: in the September 10, 2025 shooting of the right-wing political
- 1:05Speaker 1: activist in front of a crowd at Utah Valley University,
- 1:09Speaker 1: a judge ruled on Tuesday. Judge Tony Graff decided, in
- 1:13Speaker 1: favor of prosecutors who say they have enough evidence against
- 1:16Speaker 1: Tyler Robinson, to put the 23-year-old on trial on a
- 1:20Speaker 1: charge of aggravated murder, which could see him face the
- 1:23Speaker 1: death penalty, life in prison without parole, or 25 years
- 1:27Speaker 1: to life in prison with parole. So I highly doubt
- 1:32Speaker 1: it'll be 25 years to life in prison with parole.
- 1:35Speaker 1: It's either going to be the death penalty or life
- 1:38Speaker 1: in prison. And I think that if the evidence keeps
- 1:42Speaker 1: coming in the way it is, it's going to be
- 1:44Speaker 1: rough for Tyler Robinson to not end up meeting the
- 1:48Speaker 1: hangman's noose. And if he's guilty of all of this,
- 1:52Speaker 1: I think he should. Society has to pass a message here.
- 1:56Speaker 1: That shit like this is not okay. And I don't
- 1:59Speaker 1: give a flying fuck what your politics are. Nobody should
- 2:03Speaker 1: be getting killed on live TV or anywhere else because
- 2:06Speaker 1: they have a political view that leans one way or
- 2:09Speaker 1: the other. Before the court in Provo, Utah went to
- 2:12Speaker 1: recess earlier Tuesday, Graff said he needed time to go
- 2:15Speaker 1: over the 24 pages of notes that he took during
- 2:18Speaker 1: the closing arguments of Robinson's prelim hearing. Well, I can't
- 2:23Speaker 1: blame him. A lot going on, right? and you want
- 2:25Speaker 1: to be thorough, especially as a judge. And so far,
- 2:29Speaker 1: so good when it comes to Judge Graff. Prosecutors presented
- 2:34Speaker 1: much of the evidence against Robinson during a five-day hearing
- 2:37Speaker 1: back in July. A factor for the aggravated murder charge
- 2:41Speaker 1: is a reasonable belief that the defendant knowingly endangered others
- 2:45Speaker 1: in Kirk's death. The state of Utah argued Robinson targeted
- 2:48Speaker 1: Kirk because of his political beliefs, and knowing that children
- 2:52Speaker 1: were present and would witness the shooting. And I find
- 2:55Speaker 1: the defense's argument here a bit laughable. The guy's sitting
- 3:00Speaker 1: up on top of a building, allegedly, and fires a
- 3:03Speaker 1: bullet at somebody. How can you say with a straight
- 3:07Speaker 1: face that nobody else was in danger? Sure seems to
- 3:10Speaker 1: me that everybody that was in the path was in danger.
- 3:16Speaker 1: So I'm not shocked to see the judge keep the
- 3:18Speaker 1: aggravated enhancement attached to the charges. And I think it's
- 3:22Speaker 1: the right way to go. The judge said his decision
- 3:27Speaker 1: was based on the documented position of several individuals in
- 3:30Speaker 1: and around the canopy area where Kirk was speaking, among
- 3:34Speaker 1: other factors. These circumstances support a reasonable inference that defendant
- 3:39Speaker 1: was aware that other individuals were positioned near Mr. Kirk
- 3:43Speaker 1: when he fired, Graff said. And I think that is legitimate.
- 3:46Speaker 1: Are we going to pretend that nobody else could have
- 3:48Speaker 1: been injured? Like, for real? Remember, it's not that somebody
- 3:53Speaker 1: was injured. It's the risk of people being injured. And
- 3:57Speaker 1: that's why the judge decided to go with the prosecution
- 4:00Speaker 1: when it comes to that enhancement. And I thought that
- 4:04Speaker 1: would be the case. I think the prosecution has done
- 4:07Speaker 1: a good job making the argument. Now, does that mean
- 4:10Speaker 1: they have all the evidence they're going to need to
- 4:12Speaker 1: get this over the finish line? I don't know. I
- 4:15Speaker 1: haven't seen all the evidence yet. But as of now,
- 4:18Speaker 1: certainly enough to go to trial. And there's certainly an
- 4:20Speaker 1: overwhelming amount of evidence to get it over That hump.
- 4:25Speaker 1: Not that there's an overwhelming amount of evidence that's been
- 4:28Speaker 1: produced that makes Tyler Robinson guilty at this point, but
- 4:32Speaker 1: certainly enough evidence to have it go to trial. And
- 4:36Speaker 1: that's what this whole prelim hearing was about. It wasn't
- 4:39Speaker 1: the real argument. It was the appetizer. Today's decision, which
- 4:43Speaker 1: comes nearly a year since Charlie was taken from us,
- 4:46Speaker 1: marks an important step in our family's pursuit of justice
- 4:50Speaker 1: for him. Kirk's family said in a Tuesday, In an
- 4:53Speaker 1: emailed statement, every step in the process carries the weight
- 4:56Speaker 1: of all that Charlie's murder has taken from his family,
- 4:59Speaker 1: especially his children, who will grow up without their father.
- 5:03Speaker 1: We're grateful to all those who continue to pray for us,
- 5:06Speaker 1: support us, and stand with us through a year of
- 5:10Speaker 1: unimaginable grief. And the fact that people like pile on
- 5:14Speaker 1: this woman is bizarre to me. Like, I don't care
- 5:17Speaker 1: about Erica Kirk one way or the other, and I
- 5:19Speaker 1: wasn't a big fan of Charlie Kirk. I didn't dislike them.
- 5:22Speaker 1: I just didn't care one way or the other. But
- 5:25Speaker 1: I think it's reprehensible, honestly, the way some people have
- 5:28Speaker 1: carried on. And the fact that they're profiting from it
- 5:31Speaker 1: is crazy. And you know the sad truth? A lot
- 5:35Speaker 1: of the people out here that have all of a
- 5:37Speaker 1: sudden inserted themselves in the conversation, inserted themselves in the debate,
- 5:42Speaker 1: weren't even fans of Charlie Kirk. And I have a
- 5:44Speaker 1: suspicion that a lot of these people are chaos agents.
- 5:48Speaker 1: They're not looking for justice. They don't care what really happened.
- 5:52Speaker 1: They want to cause as much chaos and sow as
- 5:55Speaker 1: many seeds of pain as possible. And there's always going
- 5:58Speaker 1: to be an audience for that kind of shit. Always.
- 6:00Speaker 1: Because the truth is, when it comes to the media,
- 6:03Speaker 1: you're not selling papers on happy stories, right? If it bleeds,
- 6:08Speaker 1: it leads. As the next phase of the judicial process begins,
- 6:14Speaker 1: our family remains united in our love for Charlie, our
- 6:17Speaker 1: commitment to the pursuit of justice, and our prayer for
- 6:20Speaker 1: a transparent and timely process, the statement said. On Tuesday,
- 6:25Speaker 1: prosecutors said Robinson shot and killed Charlie Kirk because he
- 6:28Speaker 1: disagreed with him, and he did it by firing a
- 6:31Speaker 1: high-powered rifle into a crowd of thousands. They added that
- 6:35Speaker 1: there is a mountain of evidence against Robinson, and it's overwhelming. Look,
- 6:39Speaker 1: I agree. So far, not looking good. And if you
- 6:43Speaker 1: go and look at my track record talking about these
- 6:45Speaker 1: kinds of cases, I've pretty much called them all spot on.
- 6:50Speaker 1: And that's because I read the court documents, right? And
- 6:52Speaker 1: if you're seeing the arguments develop in the background on
- 6:55Speaker 1: the docket, you know what to expect. And when it
- 6:58Speaker 1: comes to Tyler Robinson, the circumstantial evidence is as high
- 7:03Speaker 1: as Mount Everest. Now, again, just to be clear, that
- 7:06Speaker 1: doesn't mean that they're going to have enough when all
- 7:08Speaker 1: is said and done. And when Robinson's team begins challenging
- 7:12Speaker 1: what they've shown us, because at this stage, this has
- 7:15Speaker 1: mainly been one-way traffic, right? And what I mean by
- 7:17Speaker 1: that is we've only really heard from the prosecution. And
- 7:22Speaker 1: that's because that's how this process works. But now that
- 7:26Speaker 1: he's been binded over, I expect his team to start
- 7:29Speaker 1: challenging this shit section by section, evidence by evidence, and
- 7:34Speaker 1: we'll see what they come up with. But as of now,
- 7:37Speaker 1: not looking good for Mr. Furry. The defense's closing argument
- 7:43Speaker 1: mainly focused on the enhancements to the charges that would
- 7:45Speaker 1: allow the prosecution to seek the death penalty against Robinson.
- 7:49Speaker 1: The attorneys argued that the aggravating factor needed for a
- 7:53Speaker 1: capital case in which other lives were knowingly put at
- 7:56Speaker 1: great risk hasn't been proven because the shooter had a
- 7:59Speaker 1: clear shot and only fired once over the crowd. Well,
- 8:03Speaker 1: I think the law states that if other people are
- 8:06Speaker 1: in danger of being harmed, then that aggravator certainly kicks in.
- 8:11Speaker 1: And I don't think there's any debate here. If you're
- 8:13Speaker 1: firing over a group of people, thousands of them, shit
- 8:17Speaker 1: can go south real quick. To counter that argument, prosecutors
- 8:20Speaker 1: said you can't shoot a rifle into a crowd of 3,000
- 8:24Speaker 1: people and not know that you're posing a significant risk
- 8:27Speaker 1: of death. And I think that's very logical, right? I mean,
- 8:32Speaker 1: when you look at it from a neutral perspective, and
- 8:34Speaker 1: that's certainly what I'm doing, I don't have any problem
- 8:38Speaker 1: with the aggravator. Robinson had no visible reaction to the arguments.
- 8:44Speaker 1: His mother Amber Robinson watched from the courtroom gallery as
- 8:47Speaker 1: his father Matt listened with his head bowed. Kirk's parents,
- 8:51Speaker 1: Robert and Catherine Kirk, entered the heavily secured facility arm-in-arm
- 8:55Speaker 1: before the hearing at the 4th Judicial District Courthouse in Provo.
- 8:59Speaker 1: Erica Kirk was seated beside them. The family stepped out
- 9:03Speaker 1: during part of the prosecutor's argument that described the shooting. Yo,
- 9:07Speaker 1: I don't blame them. Imagine living with that shit every day,
- 9:11Speaker 1: seeing it all the time. All these people talking out
- 9:14Speaker 1: of the side of their neck. Has to be horrible.
- 9:17Speaker 1: Think about how you feel when somebody passes away, even
- 9:20Speaker 1: when it's from natural causes. Imagine if some fucking Yahoo
- 9:24Speaker 1: on the internet started popping off about your mom or
- 9:26Speaker 1: your dad or your husband. Shit's monstrous. And the people
- 9:30Speaker 1: engaging in it, they should check themselves. But they won't.
- 9:35Speaker 1: Because it's all about the engagement, right? It's all about
- 9:39Speaker 1: being part of the team. Robinson is also accused of
- 9:44Speaker 1: obstruction of justice, which carries a penalty of up to
- 9:47Speaker 1: 15 years in jail, and felony discharge of a firearm,
- 9:50Speaker 1: causing serious bodily injury, which carries a penalty of five
- 9:53Speaker 1: years to life in prison, according to the Utah County
- 9:56Speaker 1: Attorney's Office. Graff ordered Robinson to stand trial on all
- 10:01Speaker 1: seven counts. So look, this battle has just begun, and
- 10:05Speaker 1: it's going to be a very, very long process. How
- 10:08Speaker 1: long it takes, I'm not sure. That's going to depend
- 10:10Speaker 1: on how much discovery has to come in and how
- 10:13Speaker 1: much time it's going to require to go through all
- 10:15Speaker 1: of it. So buckle up. Unless Tyler Robinson decides to
- 10:20Speaker 1: plead guilty at some point and gets a plan to deal,
- 10:24Speaker 1: this is going to be a long ride. And when
- 10:26Speaker 1: I say a long ride, I don't mean months. I'm
- 10:29Speaker 1: talking years. So we're going to do our best to
- 10:32Speaker 1: swim through all the muck and get to the clarity
- 10:35Speaker 1: whenever we can. And when we have some more information,
- 10:37Speaker 1: we'll get that added to the catalog. All the information
- 10:41Speaker 1: that goes with this episode can be found in the
- 10:44Speaker 1: description box.
