- 3:53Tonight, we're going to be talking about bullying and the juvenile justice system.
- 4:00We're gonna tie that all together, me and my co host Cornell. He's
- 4:05joining me by the way of phone, all the way from Texas. So
- 4:11I'm gonna just give you a little re cap real quick. Before the show
- 4:18started, I had a little high ki attack, but I'm all better thanks
- 4:24to Angela, and I forgot the other young lady we talked. We just
- 4:31got out of a meeting. But now I'm good and I'm ready to talk
- 4:36to talk about our subject at hand. As we know, our children grandchildren
- 4:44are headed back to school in less than two weeks in some states, and
- 4:51last night, a co host, Patrice, she shared on her podcast how
- 4:58to get prepared your student, your children to get ready to go back to
- 5:01school. So tonight we have a case coming out of Arizona. The child
- 5:11is a minor, so we won't be saying no names. She was bullied
- 5:18and so that's what we're going to talk about on tonight because we know that
- 5:28well. I believe that half the school shootings that are occurring are because of
- 5:34bullying. Some child is being bullied and don't know how to go and get
- 5:42help or are they being brushed off. We have the suicide break with cyber
- 5:48bullying is up. So we need to get a handle on this and talk
- 5:56to our children, our grandchildren and let them know it's okay when they receive
- 6:01a text message or anything to come and talk to us and go through the
- 6:08proper channels. And if the school district doesn't do anything about it, we
- 6:13as parents and grandparents need to stand up and fight for our children. Now,
- 6:19I'm gonna let my co hosts come on. I'm gonna let him introduce
- 6:24hisself and we're getting ready to talk. Welcome Cornell. Okay, thank you
- 6:29man, thank you ma'am for having me on. My name is Cornell Drummer
- 6:32and I am a founder of the Free Bactor campaign from partner with the Free
- 6:38of Campaign, which is governed by missus Angela Thomas Smith and mssrus Sinnette Johnson,
- 6:45and I am here tonight willing to talk about and shared life on the
- 6:48topic of bullying and cyber bullying here in the United States. Well, okay,
- 6:55let's get to it. Everybody got they drinks, I got my water,
- 7:00So let's get into it. So what So what happened was in Arizona,
- 7:10this young lady was being bullied. She was receiving text messages from another
- 7:15young lady, and the young lady was saying what she was going to do
- 7:20to her and everything, and you know, like anybody else, if a
- 7:29person get in your space. Well, let me go back through the text
- 7:32message. She was sending text message to her to other classmates. Mind you,
- 7:38there are twelve they are twelve years old. Twelve years We're going to
- 7:43keep that in. They are twelve years old, going through the textbook,
- 7:47going through the texas and stuff. So one day the little girl, the
- 7:54bully is she's getting ready. You know, she don't send word to the
- 8:01other one. You come on out and all of this stuff and she's putting
- 8:05up her hair and everything. So when the young lady come out, the
- 8:11other young lady approached her, put her finger in her face, you know,
- 8:16got in her space. You know, not to be in nobody's face.
- 8:20Got in that young lady's face space, and she got you out of
- 8:26her face by shopping you So doing an altercation. The teacher come out,
- 8:37break off the fight, separate the young lady. It's the one that was
- 8:43being bullied stop instantly, you know. The other one, I don't know.
- 8:50Maybe she was a little dazed because her they're saying now she has a
- 8:54concussion. The police was bought into it. The one that was being bullied
- 8:58was suspect from school. The bully. Wasn't nothing done to that person,
- 9:05nothing, nothing, but the one that was being bullied was suspended. Okay,
- 9:16So the family transition over, you know, summer break hit. So
- 9:24the the family transitioned to another state, and within the state, you know,
- 9:33the it followed them. The the detective called the young lady parent first.
- 9:45They tried to talk to the young lady without first talking to the parents.
- 9:50They wanted out under age, you go through the parents. So that
- 9:58was number one. That was a strike so luckily the parent was there and
- 10:03heard the conversation and got on intervene and talked to the what's going on.
- 10:09Bottom line is they are trying to give the person that was bullied a felony
- 10:16for assault and the person that was doing this bullying because text messages it's considered
- 10:26cyber bullying. If you guys can know that, it's considered part of cyberbuilding.
- 10:33So now we're gonna me and Cornell, we're gonna discuss. I'm gonna
- 10:37open up the I'm gonna give out a phone number that you guys can call
- 10:41if you have a question, drop it in the chat if I see it,
- 10:46and we would touch on that. So h Cornell in that instant,
- 10:54the young lady she followed protocol when she received the Texas, she reported it
- 11:01to her mother's to the teachers. Then this incident came about. So now
- 11:09they're trying to charge this twelve year old with a salt and have well,
- 11:18a felony assault. So give me your take on that. Okay, man,
- 11:24In every state in the United States, because of the assists of brillion
- 11:31that has resulted in countless cases of suicide, lawmakers have passed laws to you
- 11:37know try to prevent suicide, I mean brillion attacks. So what has happened
- 11:43in the United States? They have created it what they call a Sidebok brillion
- 11:46attack law, and with that it has a four point test to it,
- 11:52and one of them that states that the lawmakers have created a four point test
- 11:56for a substantial brillion violations as follows. One was the student and victim of
- 12:01brilliance? Two? Did the school have noticed a substantial brilliance of the students?
- 12:07Three? Was the school deliberately indifferent to the bullion or did they fail
- 12:13to take reasonable steps to prevent the brillions? And four did the brillians substantially
- 12:18restrict the student educational opportunities? Wherewith this the courts have created liabilities on schools
- 12:26who fail to conduct for investigations in term assault to determine it for a lot
- 12:31of just an assault, or to determine the well or not as a brilliance.
- 12:35Because of the census of brillian the courts have also created liabilities and it
- 12:39states that if the school is aware of a student being bullied but dorees nothing
- 12:45to prevent a brilliance, it is reasonably foreseeable that the victim of the bullion
- 12:50might result the self form or even suicide. So but this being said,
- 12:56ma'am, the school has violated it the call of the legislations which prepats protocols
- 13:03that helps him to, you know, investigate these incidents. Now in your
- 13:07particular case with this little girl, who it is that the food is trying
- 13:11to solve criminal charges or against instigate criminal charges. Repol aganst the victim as
- 13:18opposed to conducting a proper investigation. To get the text messages that she sent
- 13:22to the victim saying that she was going to be the victim up to make
- 13:26sure that this investigation results into a proper investigation, to hold the aggressive accountable
- 13:33for her actions and not the victim. So now what's happening is that the
- 13:39student is deliberately indifferent to the victim, which is meaning that they are held
- 13:43loal and they should be hell lovel for their payer to conduct a proper investigation
- 13:48and to their team. Now I heard that the victim is being said that
- 13:52if she makeing apology that this might go away. But if you make an
- 13:56apology to the incident and you that you're assaulted a this little girl, you
- 14:01know what I'm saying, and that what's gonna happen is that the state is
- 14:03gonna follow telling the charges of assault on the victim as opposed to filing charges
- 14:09against the breast Amand so this case is basically being misinterpreted because now the school
- 14:18is circumventing the legislator's enact me by allowing the victim to be punished as opposed
- 14:24to the breast of them. And you know, and that's my take on
- 14:28it too, that you know, how did it get switched? You know,
- 14:35you want to know about you only concerned about the assault as as they
- 14:41saying they only worried about the assault, Well, how did we get to
- 14:46the assault? We got to that point with the text messages when the young
- 14:52lady was sending out the text messages and sending people to come, you know,
- 14:56go get it. So you know, that's how they leaving out that
- 15:01detail. They don't want to know about the text messages. They just want
- 15:05to know about the assault because the little girl, I guess you got a
- 15:09concussion. So that's what they can that's what they're concerned about. But why
- 15:16not be concerned about the text messages with the little girl was sending out to
- 15:22harass the other one? Threatening to fight the threatening her to do this.
- 15:26Why are you not concerned about this? Now? This is how you you
- 15:31know suicides happened. These kids is killing themselves because the people is doing cybrilwoolyan.
- 15:41Go look at your statistics. That's all you got to do. Look
- 15:45at the statistics. The statistics is not gonna lie to you. And then
- 15:50you have, with these shootings on the school campuses, somebody being bullied.
- 16:03Yes, ma'am, yes, ma'am, you know, well, can my
- 16:07stake with that? Come on, come on, go ahead, go ahead,
- 16:11and must take with this man. According to the way they consecuted this
- 16:15investigation, the school is liable. Why because the school has circumvented in laws
- 16:21man and a civil law who has to be filed against the school if they
- 16:25take any actions against the victims. Why because the simple fact that the school
- 16:29is aiding the police department and investigating the case to follow a complaints of the
- 16:34victim with the district Attorney's off. Now, whether we want to claim racial
- 16:40biasness, well let's call it what it is. Obviously there's racial biasness because
- 16:45of simple fact that the little girl who got beat up is hispanic or whatever.
- 16:49Nationality is and the other little girl the victim as our can American.
- 16:55So either the school is being rationally biased and administrative me biased towards the victim
- 17:00by their investigation in this case and should be held accountable. So what that
- 17:07the America pabol is that you need to get involved in the case, is
- 17:11as well as the attorney Kill's officers should get involved in this case because the
- 17:15fact that the school is being administratively and officially bias towards the victim in the
- 17:22case. You buy you So that's and you know, co hosts, I
- 17:32I felt the same thing when I heard it. You know, everybody'd be
- 17:36saying, oh, all you guys are saying, is racial? This racial?
- 17:41That you bring this up? But it is because nine times out of
- 17:47ten, if it's an African American person or a black person, as you
- 17:52would say, get into an artucation with somebody and they can be minding their
- 17:59bits, all of a sudden they switch it around and say that the aggressive.
- 18:04So tell me why why does that happen? Why do the the road
- 18:11switch? Okay, because racism is high in our country, ma'am. Okay,
- 18:18African Americans already pacified us. The aggressive of anything. Okay, this
- 18:22is why we don't have They don't allow blacks to be seting on jewels because
- 18:25they feel like blacks are too sympathetic either way, ma'am. And issues like
- 18:30this when getting with a fight or something. They always feel that the Ascan
- 18:33American individual is more aggressive than any other nationality. Why because they feel like
- 18:38we are always out for trouble. You know. That's why we're five to
- 18:42one in our criminal justice system because we have been targeted like this by our
- 18:47administration. So with that being said, ma'am, you know, in my
- 18:51opinion to that question, ma'am, yes, ma'am, call it what it
- 18:53is, the ball of balls like a strike, ma'am. It's racial biousness.
- 18:57In this particular case with the victim and the aggressive. The victim is
- 19:03bad funds because of her race as opposed to a proper investigation being conducted by
- 19:10the administration in order to make sure that this little girl do not lose out
- 19:14her education status because of being wrong with your future committed crime, did not
- 19:18commit And that's what we go back to, you know, And that's what
- 19:23we talk about, the injustice and the wrong for conviction where we have men
- 19:30and women that's in prison serving wrong for conviction over sentencing. So here we
- 19:37have a juvenile that's twelve years old that they're trying to stick with a felony
- 19:44is sought and she's no longer in the state that you know, she's no
- 19:52longer in that state, So she's no longer in estate. Now she's in
- 19:59she don't and she get into a fight at a school that she's currently going
- 20:07to say, Let's say she get into a fight, what's gonna happen.
- 20:11They gonna pull her record and they gonna see that she was charged with a
- 20:15felony assault in another state. But this the child that being that doesn't turn
- 20:25into the aggressor is a straight A students now no grades, don't have nothing
- 20:33to do what they can say, Oh, just because she is a straight
- 20:36A student, she still can you know, I understand all that. But
- 20:41if you don't have no pattering of her just out picking at somebody or sending
- 20:45text messages and see what happened. And another thing. And I commend a
- 20:49young lady for keeping her text messages and not respond them back to that person,
- 21:00because no one. If it was me, I probably would have responded
- 21:03to back I probably will say some flip to him, but yeah, I
- 21:10commend her. And I just feel that no children, whether they're black,
- 21:18white, Hispanic, green, whatever color they may be, should be put
- 21:26in this situation where they getting ready to, you know, go through court
- 21:33procidures because I you know, I told that parent to fight for your child.
- 21:38Because when my children was in school, when my son, my son
- 21:45had mean, I would Lord have mercy. I got a lot of stuff
- 21:48on he I done dealt with. But the school district that he was attended
- 21:56when my son was in I believe he was in a seventh grade and he
- 22:00was matter of fact, I'm just to come through the unified school district.
- 22:06You know. When he was there, I was at work and he had
- 22:11peed pe was his first class. He was out there playing football on the
- 22:18football field, went out there, stepped in a hole and broke his arm.
- 22:25When I get home from work, I didn't get home from work until
- 22:29probably about five or six that night, and I walked to the porch and
- 22:36he opened the door and he said, Mama. He picked up his hand,
- 22:38he said, Mama, look and I instantly looked at that hand and
- 22:44I said, boy, that's broke. Let's go took him to the emergency
- 22:51room. They said it. Then the next day I had to go to
- 22:53the Competix doctor. And then the next day I was at that school.
- 23:00Oh yeah, you was gonna give me some answers, because my thing was,
- 23:04why did you allow my son to sit go through the whole day and
- 23:12not call me. You can look at his hand, his arm, because
- 23:17the bone was hanging down. You can look at it and you can tell
- 23:21it was broke. That nurse did not offer my baby, not a tail
- 23:26and all, not an ice packed nothing. He didn't get aid until I
- 23:30got home. I was not notified. So I went to that school district
- 23:37and I fought. So I tell parents all the time, yes, we
- 23:41know our children because they are miniature reflections of us, and we know what
- 23:47we did as children. But sometimes you have to stand up and fight for
- 23:55your children. You have to fight for your children. I did it for
- 24:03him in junior high school. And I went before that school board again when
- 24:08he was in high school because a teacher raced her profile my baby, and
- 24:17they was on the verge of kicking him out of the district. But when
- 24:21I went and I stood up and I let them know where I was coming
- 24:23from and I had letters from his teachers. They couldnot do anything nothing.
- 24:30Oh then my last name was Whiteside, Miss Whiteside. We sawry, We
- 24:37apologized, yes you yes, So sometimes we have to stand up and fight
- 24:45for our children. Go ahead, co hosts, Well, ma'am, you
- 24:52know what that even includes the judicial right. Okay in this particular case,
- 24:56ma'am, h inmuticual victim. In this case, ma'am, she is gonna
- 25:03be made a victim of the judicial system. Why because if they allow them
- 25:08to follow any charge against the victim in this state, they are going to
- 25:12encourage her to plead guilty to a crime that she didn't commit. Now,
- 25:18regardless if they offer her probation, this will still be a conviction on from
- 25:22record that would destroy her education. And as you said earlier, any crime
- 25:27on her record, man will follow her for the rest of her life.
- 25:32Yeah. With this being said, man, we need to get the American
- 25:38Civilis re Union involved in this case to find out when he steady not conductive
- 25:44proper investigation from words say, go by getting all of the text messages to
- 25:48determine who said what to who and win whyan house. You know, I
- 25:56don't mean to stop you co hosts. They do. The school do have
- 26:00the text messages in the presents, in the possessions now they do have all
- 26:06the time. But the person that's representing her, I guess they ain't going
- 26:12to get the They said that it's up to the school to release the text
- 26:18message to them. Okay, okay, and I'll say something to that.
- 26:23Go ahead. During an investigation, man, an investigation has to be unbiable
- 26:30in any particular case. Why because of the fact that a person's liberty is
- 26:33upstates. Therefore, if anybody in the the little girl who is the oppressor,
- 26:44is encouraging the school administration determined whether or not any crime of charges need
- 26:49to be bold against anybody, expectedly the victim in the state, then that's
- 26:53judicial biasment number one. Why because you know, withholding information that con syndicate
- 27:00that can that condicate them, that can set up free from a crime sheet
- 27:06and not committed. So the lawyer represent the girl, the brilliant UH cannot
- 27:11encourage nobody, a fool administration to withhold information from the district attorney offers.
- 27:18So this is something that has to be investigated. But you know that you
- 27:23you know they do. They would hold evidence and wrongful convictions to they We
- 27:32see them do that all the time. Okay, And and and also you
- 27:37know, just by us having this conversation, we can see how it starts
- 27:44from juvenile up into the adults. You know, we and I mean,
- 27:52I just believe that we just have to stand up and you be a voice
- 27:56for our children. You know, we're losing We're lose too many of them
- 28:02to suicide and we move losing too many of them into the prison system.
- 28:07Yes, that's Mariam, well, ma'am. In this particular case, Mariam,
- 28:11I would encourage anybody to stand up and bell boys and to hold the
- 28:15school administration's accountable. But they're failure to conduct a proper investigation. Not only
- 28:22conduct a proper investigation, but to also encourage an investigation against the victim because
- 28:27that's what they can. They're encouraging an investigation against the victim when in fact,
- 28:33she should not be charged with anything, lords should be forced to apologize
- 28:37for anything when it's not her fault. It's the aggressive thought for encouraging the
- 28:41incidental occur anyway. But a lot of people, a lot of people will
- 28:47say that she was the aggressor because she hit first. You know, that's
- 28:52whar They wouldn't say that that that the text messages was anressive. They will
- 28:59say because the young lady hit first. Now she's the aggressor. Okay,
- 29:06well, let's make a difference. Man. There's a difference between public assought
- 29:11and brilliant. Man. And the legislations have separated the two. Why because
- 29:15the simple fact of the fact of the issue of suicide and brillian See,
- 29:19brilliant can create a results of self harm or even suicide. So whenever aggressor
- 29:27sends a text methode to an addiculous saying that she's gonna do this or do
- 29:30that to the victim and encourage the victim to engage into some type of altercation,
- 29:38you cannot separate that from brilliant as opposed to a timple assault. That
- 29:42if they should just walk up to each other and got into an argument,
- 29:45that's different as opposed to brillion So in this case, it's a brilliant attack
- 29:51man, and the text messages complete the fact of the brillian text. The
- 29:56bullying laws and any state this case you have is for you is a bully
- 30:02in case man, because number one in the state that was the students the
- 30:06victim of bullion. Yes. Did the school have noticed of the substantial bullying
- 30:10of the student? Yes? Was the school deliverately in different to the brilliant
- 30:15or did it fail to take reasical self to prevent the bullying? Yes?
- 30:18Did the bully is substantially strict the students education and opportunity. Yes. So
- 30:25therefore the big community case have a complaint for liability against the school man because
- 30:32this is what happens in the state. And so before we I'm gonna give
- 30:37out the number if anyone has a question that they would like to ask for
- 30:45now, we're going to have him called right back. Yes, I'm gonna
- 30:51give you the number. The number is nine five one, the four four
- 31:00zero. We're just gonna wait for our co hosts to call back in a
- 31:06minute. But until then, I would just like to thank you guys one
- 31:11more once again for tuning in to Let's talk about it. And I have
- 31:19some projects coming up. I will I'm actually gonna I'm working on a grief
- 31:27book, Coping with Grief, and I'm gonna be looking for some co authors
- 31:34to assist me in that, and I will be letting out more giving out
- 31:38more information in the future, I would be if you want to write on
- 31:45like a loss of a parent, a loss of a child, loss of
- 31:49a spouse, whatever may have been been or if you was incarcerated and you
- 31:56had lost someone, you can also so right on that. So when I
- 32:05get everything written out, I will be posting it and so you can get
- 32:14your feelings out because I want to tell you grief is it comes at any
- 32:21time. Before I got ready to do this podcast, it came knocking on
- 32:25my door and I've been I tried my best to fight it. I tried
- 32:31my best to fight it and I couldn't. I had to just go ahead
- 32:37and just go through the motion. And luckily, like I said, Angela
- 32:42was there and I can't remember her name, but she was there. They
- 32:49was there to talk to me, and I was able to release it.
- 32:54So I had my co host calling back, so we're gonna get him being
- 33:07recorded and the subject to monitoring to accept this free call press. Thank you
- 33:12for using conversation. If you have any questions, you can go ahead and
- 33:21just call the numbers and ask Cornell. That's what we're gonna call this subject.
- 33:27Ask Cornell. We can ask you can ask him anything about bullying anything,
- 33:35if that's all right with you co host, Yes, yes, ma'am
- 33:42that is. But if not, we're gonna just keep on talking, chit
- 33:46chatting about We don't talk about that. So you know what I want to
- 33:52talk about. I want to do. Frank up, What's what's going on
- 33:57in Texas? How how's everything going over there with everyone? Okay, Well,
- 34:05we just had another individual didn't make it, hit in the head with
- 34:07a fan moti today and they locked down the sea part sections of the uh
- 34:14TDC juh Conny unit and right now they're trying to investigate that and as opposed
- 34:22to anything else, the rest of the unit that is still up and running,
- 34:24ma'am. And we finally went to go eat today after a whole week.
- 34:30So peanut butter and jelly you said, you just y'all just finally go
- 34:35eat today, Yes, ma'am. We've ben get peanut butter in Deli,
- 34:38ma'am for the past week. And uh, yes, ma'am of course.
- 34:44And just the Sena Butt and Delhi unit John B. County, yes,
- 34:49ma'am, oh bro And and somebody got hit in the head with a motor,
- 34:55yes, ma'am. This is a second incident within within about a week
- 34:59and a half of an individual getting hit in the head with a fan motive.
- 35:02Okay, building an individual got hit in the head with a fan motor,
- 35:07and I think this individuals and conditions right now. And today another inmate
- 35:12just gotten hit in the head on seapart twenty three sail with a fan motive
- 35:15today again by his selling. So he's in critical condition right now. So
- 35:21they just locked him down so they can conduct an investigation into that issue.
- 35:25Man. So for the most hard violence is taken off now in the units
- 35:31because of the shortness of staffs and you know, indeed being forced to participate
- 35:39in drug activities and stuff like that, you know, because it's at an
- 35:44all time high now. And I'm talking about different types of serious drugs being
- 35:49you know, administer here in the prison system. So now you know that's
- 35:52what's going on here in the prison system, right. So I mean you
- 35:57said, are I mean, are the drugs band brought in? Are these
- 36:01prescribed drugs that they you know, no, ma'am, he's are ill legal
- 36:07drugs man from three world, illegal drugs man. That inmates are having some
- 36:13type of ways to get into the system and however they're getting it. Man,
- 36:17that's causing these individuals to have drug overdoses, you know, to owe
- 36:22each other money, to resulting to a person get hit in the head with
- 36:27a band motor because you don't want to pay his deal or whatever. You
- 36:30know what I'm saying. But you know, for the most part, you
- 36:34know, he is invested with drugs man, all types of bands, you
- 36:38know, and tr enough that administration tried to do whatever it came to try
- 36:42to resolve, but there's not enough staff for us. There's not enough enough
- 36:47you know, Uh, investigations or no, you know, pitten or whatever
- 36:52the side of resolve the issue. You know. Only what something happened was
- 36:54they do a pitch the other that you will not get one. So you
- 36:59know, I got we just died the other day. Uh. They wanted
- 37:01to just test it as a whole section. Other than that, they wouldn't
- 37:05have done it. So as of right now, you know, we lift
- 37:08him up and trail man. We left his family up and prayer. That's
- 37:12not gonna bring him back. Wow, yes, ma'am. Wow. So
- 37:15I mean, uh, wow, that's a that's a that's a lot,
- 37:20that's that's a lot going on. From just now getting getting something to eat
- 37:25after eating peanutburn and jelly for a week. Don yes, pl'am, yes,
- 37:31plam, yes, ma'am. Well, you know here in Texas,
- 37:36Mayor and my administration, not just our administrations, our legislation are not doing
- 37:40enough of anything man to try to you know, start to picking a system
- 37:45that's seriously broken. Man. You know, we haven't heard anything of any
- 37:50laws being passed or put on the on the on the brest about uh,
- 37:54anything that's gonna benefit our educational rehabilitation status, the roll board. Uh,
- 38:00these roleable convictions or anything judges being held account for corruption and bribery, or
- 38:07racial jury that's trunned up for a black to being convicted by all white jury,
- 38:10or the evidence candles where being said present some lawful convictions on being what
- 38:20the evidence is being falsified by laughs, And man, we don't have anything
- 38:23down here, anybody down here trying to fix the problem, man, you
- 38:29know, And there's not enough people vote. There's nobody really going to the
- 38:31post to vote. No, I've seen what money to a goal that the
- 38:38governor down there, Governor Abbot released the man that that did the did the
- 38:47shooting at the at the rally at the Black Lives Matter that rally. He
- 38:52got he's a free man. Now. Well, yes, bair uh,
- 38:58he's done that. And away, ma'am, to get to be honest about
- 39:01it. Okay. Here in Texas we have what we call the time cut
- 39:05process, our clemency review process. Well, our governor has not pass key,
- 39:10has not granted anyone of clemency since he's been offered, not one person.
- 39:16No. So with that being said, all of a sudden, this
- 39:20individual will come up and kill somebody, an African American, and the governor
- 39:23want to jump in and grant this guy clemency by utilizing the Parole Board to
- 39:29grant him that clemens And they did that, he got it. And yes'm
- 39:35and how do you know how long was that man in prison? Well,
- 39:43no, ma'am, it wasn't long at all, man, it was not
- 39:45long at all. Okay. And this is the second case here in Texas
- 39:49that we can uh identify that the Parole Board has granted it credited time served
- 39:58to an individuals and clemency. The other lady name is Sonya Casey. In
- 40:02nineteen eighty nine, nineteen eighty eighty eight, she got granted credit time served
- 40:08on the ninety nine yourself for merger. She only done six years and when
- 40:13nobody investigate her case, but the parole board said, well, okay,
- 40:16we're going to give up pread of time served, and that's what they did,
- 40:21and for sixteen she was exonerated because she did not commit the crime.
- 40:24But since deployed mayor, has nobody else been granted a credited time served,
- 40:30nor has anybody been granted a tremency review by any governor since Sonya case here
- 40:36recently when Greg Abbott has granted this guy a clemency through his parole boars system.
- 40:43So mind yourself. Everybody has followed requests for cremency all time cut and
- 40:49we have all been denied, even me, myself, I have been denying.
- 40:52Wow. So that's sad that we have a system like system places right,
- 40:58and you no, it doesn't. And it also happens in Colorado as
- 41:05well. Okay, oh shoot, I don't know what happened we got oh
- 41:14there we go. It also happened over there in Colorado as well, where
- 41:20you had a person that was guilty of a triple homicide and it happened in
- 41:30twenty seventeen, and they found jury mixed conduct. He was sentenced to three
- 41:37life sentence and he was brought back within I want to say a year or
- 41:44two and resentence. They resentenced him, they took the like they took the
- 41:50three life sentence from him, and they gave him forty two years. He
- 41:59got forty his and his new sentence is forty two years and plus they gave
- 42:04him seven and a half years of the credit of time. Okay, okay,
- 42:10So look at the percentages of the individuals we're talking about. That's two
- 42:15individuals in the last four decades malan, three decades premency reviews, two p
- 42:24out of hoursand of individuals making a complaint or request for up time for our
- 42:30primity. So how is it that we have a process where the legislator has
- 42:35stated that that you have a right or a privilege to a current cut,
- 42:39but it's not being granted. Are honored us to other courts? So I've
- 42:44made a request to the legislatures recently to ask them to get involved into this
- 42:50process. So they created it House Still seven eighty two. Begin for judge
- 42:55the power man to be able to grant a month modification or reduction of your
- 43:00center without the consideration of the plow boards. Well, the legislators Governor Grant
- 43:07after denied the first one. So now the public got involved and the public
- 43:12said that they wanted it to see that this bill get passed, so they
- 43:16made it joining our resolution fifty three. So now here it is an individual
- 43:22convicted it for a crime can make a request to a judge asking the judge
- 43:28for a modification or reduction of their centers, the same as you would afecial
- 43:31review or any other process. So now that's where we're at. So we
- 43:37don't know if judges are going to comply with it, or whether or not
- 43:39they're going to act on it or what you know. Hearing Greg to I'm
- 43:45sorry, but you know, I get this out. You know, it
- 43:49just went well, we just seen what happened where they threw the cases out
- 43:53for the president. So the former president that he was convicted of thirty fourth
- 44:02crimes or whatever you want to call. Okay, okay, and okay,
- 44:07they got dismissed. So you know, it's just like, well maybe maybe
- 44:16we should all run for the presidentcy Well, look at the issue we're talking
- 44:22about. You're talking about legislative government, you're talking about judicial government, and
- 44:25you're talking about executive government. Our president is under executive government. You cannot
- 44:31sue the executive government now were because he was the president acting or they say
- 44:37he was acting as a president at the time that he created it's the insurrection
- 44:42of the wife of the capitalil that he cannot be held wib Well, now
- 44:45they had to dismiss all the charges against him. Now the other people got
- 44:52compicted for a clerk for the direction that he has been getting an immunity from
- 44:58after being the encourager of this him to go and committed crimes. So hearing
- 45:04you, uh huh. So here in the United States, we have what
- 45:07we classify as the law party. So how is it that our president is
- 45:10not being associated it with the law parties the same as anybody else would be
- 45:17convicted for the same offense. That don't make no sense. So you're wearing
- 45:22him qualified immunity from prosecution when in fact you can see the other people from
- 45:27going to the capital that he encouraged. So this is why, right,
- 45:31So so anyway, ma'am, you know, like I say, ma'am,
- 45:38you know, we have a lot to deal with. You know, we
- 45:43pray that people come out and boot and start you know, addressing a lot
- 45:46of the issues affecting our school, our children, and our celtal justices.
- 45:52Because like the case you mentioned about the bullyings, it would hurt me to
- 45:57my heart to see them destroy this little girl wife, you know what I'm
- 46:00saying. But charging her would at a felony assault case and have her to
- 46:05free guilty with some type of form of probation that would destroy her career.
- 46:10How I hate did that happen to her? So if anybody listening to this
- 46:15segment tonight, you know regarding who this little girl is, please get involved.
- 46:21Please contact any legislator, any representative the American Civil Liberties Union and act
- 46:27these people to get involved into this particular case and to find out why is
- 46:30it that the school administrations are crying to encourage criminal charges against this little girl.
- 46:36That shouldn't happen. She's twelve years old. She shouldn't be thought to
- 46:39apologize, that admits you. In order for the district attorney's officer Paul charges
- 46:45against her for acquirement, you're gonna use against her, buy a many you
- 46:50that's not right? And then and then you don't buy no charges against the
- 46:53aggressor whow because she's being represented by an attorneys. Well, I don't have
- 46:59twenty thousand dollars to give no attorney to represent me, so that shouldn't happen
- 47:04like that. Man, that's my take on that. Man. People,
- 47:08we need to come out and vote exactly. You know, let's get involved
- 47:13with the man, because you know, that's sad that we have to wake
- 47:17up to deal with these type of issues of biasedness and stuff like this racism
- 47:22and our state. You know, I'm said, convicted by two all white
- 47:27jury trial rams, I'm a Tatholan American with the doors locked on me,
- 47:30with keen and white police officers sitting behind me in a course, So how
- 47:36can I receive a fair trial from something like that? Do that make any
- 47:39sense? You said? You? You said you was convicted by two what
- 47:45all white Jersey Yes, row to all white Jermany, separated by a quarter
- 47:52front an attorney who was a former assistant district attorney. Man, and I
- 47:55was sent one hundred and fifty four years. But what But but I thought
- 48:02you're supposed to have a jury of your peers on your on a jury.
- 48:08Well, ma'am, you know what that's true? If you ain't got at
- 48:12the door of the wide open. Yeah, but when they lock the door,
- 48:15it don't allow the public came out of See what's they're doing behind closed
- 48:17doors? Man. This is what happened to our kids. Our kids are
- 48:22being prosecuted by the all white jurys behind closed doors. Man, this being
- 48:30framed with false evidence. Our kids have been represented attorney for being paid off
- 48:37by the DA's office that helps get the conviction as opposed to defending your plents.
- 48:43Even the issues, ma'am that we have in our and our system man,
- 48:46that needs to be addressed. Man. So you know it's sad that
- 48:51countless individuals are in prison behind these operations. Man, but you know we
- 48:55have to stand. That's when we have to come out and both and both
- 48:58these people out would and not doing anything about a pass. I got say
- 49:07thank you for having your yeah, and I can't wait for our next topic.
- 49:19I think we're having Luke Kendrick back with us in two weeks. I
