Speaker 1: Now we turn to the Mountain Eagle to read news
0:04
from Whitesburg. Your reader today is Bill an Arsdale. We
0:09
will begin with the addition dated March fourth, twenty twenty six,
0:13
which the publishers have donated to RADIOI as reminder. RADIOI
0:19
is a reading service intended for people who are blind
0:21
or have other disabilities that make it difficult to read
0:24
printed material. The first story is civil rights suit tied
0:31
to ex bailiff settled pre trial. Four years after a
0:37
former inmate filed a federal civil rights lawsuit against former
0:41
court bailiff Ben Fields and the Letter County Sheriff's Department,
0:46
the case has been settled. The case had been scheduled
0:50
to go to trial Tuesday. A jury had arrived at
0:54
the courthouse, but the matter was resolved before jurors were seated.
1:00
Sabrina Atkins sued Fields, then Sheriff Mickey Steins, and East
1:05
Kentucky Correctional Services EKCS in January twenty twenty two, alleging
1:12
that Fields coerced her into having sex in exchange for
1:15
not activating an electronic monitoring device she was required to
1:19
wear as a condition of her bond. At the time,
1:23
Fields was moonlighting for EKCS supervising individuals released on bond
1:29
with electronic monitoring. Atkins alleged that the Sheriff's Department and
1:34
EKCS failed to adequately train Fields regarding sexual harassment and
1:40
appropriate conduct. She further claimed that Steins failed to follow
1:45
departmental policies governing training and outside employment. According to the lawsuit,
1:51
Atkins had fallen behind on monitoring fees when Fields told
1:55
her they could work something out. Fields maintained that Atkins
2:00
initiated the relationship by sending photos and sexually suggestive text messages. However,
2:07
Fields later admitted wrongdoing and pleaded guilty to third degree rape, sodomy,
2:12
and perjury in connection with the case. E KCS settled
2:18
with Atkins last year and is no longer in business.
2:22
Steins is currently charged with the murder of District Judge
2:26
Kevin R. Mullins. The shooting occurred in Mullins's chambers, located
2:31
in the same office suite where Fields admitted taking Atkins
2:35
after hours before the courthouse opened to have sex in
2:38
a restroom. Atkins's attorney, Joe Childers of Lexington, filed a
2:44
writ of habeas corpus in December, seeking to compel Stein's
2:48
to testify at trial. A federal judge denied the motion.
2:54
Steins had sat for a deposition in the civil case
2:57
three days before a security camera recorded here standing up
3:01
from what authorities described as an informal meeting with Judge
3:04
Mullins and shooting him at least eight times. Stein's has
3:10
been incarcerated in Leslie County since the shooting. He retired
3:14
from his position shortly after his arrest. Following his arrest,
3:18
Steins was dismissed as a defendant in the civil case
3:21
in his official capacity, and Sheriff Billy Jones was substituted
3:26
in that role. Before being elected sheriff, Steines served as
3:31
bailiff in Mullins's court, and, like Fields, worked part time
3:35
for EKCS. No evidence has been presented indicating that Steins
3:41
engaged in inappropriate conduct with individuals he supervised. However, the
3:46
timing of his deposition relative to the shooting has prompted
3:50
public speculation about motive. The terms of the settlement were
3:55
not disclosed. Fields has completed his six month jail sentence
4:00
and is currently on probation. The next headline is State
4:05
trooper visitor injured in dog attacks a Kentucky State Police
4:11
trooper investigating a reported dog attack at Dry Fork was
4:15
forced to shoot one of the animals after it also
4:18
attacked him. Authorities said the incident occurred February twelfth in
4:23
the four hundred block of Dry Fork. Kentucky State Police
4:27
Post thirteen in Hazard received a report of an animal
4:31
attack at four thirty seven pm, and Trooper Charlie Moore responded.
4:37
According to police and neighbors, a twenty one year old
4:40
man from Lexington was in Letcher County to attend a
4:43
funeral and was walking along the road when several dogs
4:47
attacked him. His name was not available at press time.
4:52
Matt Gayheart, public affairs officer for Kentucky State Police Post thirteen,
4:57
said the man was transported to whitech Bourg Appalachian Regional
5:01
Hospital for treatment. Neighbours said his injuries were to his
5:05
legs and ankles. When Trooper Moore arrived and began investigating,
5:10
the dogs returned to the area. Gayheart said Moore attempted
5:14
to deter the animals by deploying the electrical arc from
5:18
his taser, but the dogs continued their aggressive behavior. One
5:23
of them latched onto his uniform pant leg and Trooper
5:27
Moore drew and fired his issued service weapon, striking and
5:31
killing one canine. Gayheart said. Neighbours alleged the dogs have
5:37
not been properly fed and have bitten at least two
5:40
other people. Kim Sturgell, who oversees the county's sanitation department
5:45
and serves as Electric County Dog Warden, said she has
5:49
received multiple complaints about the dogs, including one from Moore.
5:53
Following the incident, Stergil said at least two dogs and
5:57
possibly more, remained roaming the neighborhood. The dog Warden has
6:02
set a live trap in an effort to capture a
6:05
smaller dog believed to be part of the group, but
6:08
so far neither animal has been caught. Court records show
6:12
that in twenty fifteen, the woman neighbours identify as the
6:16
dog's owner was sued in small acclaims court after her
6:20
dogs entered a neighbour's yard and attacked his Pomeranian. The
6:25
dog required surgery and two veterinary visits. The court ordered
6:29
her to pay five hundred eighty five dollars and ninety
6:32
nine cents in restitution for veterinary expenses. The next story
6:37
is weather wipes out spring break and lecture schools. Students
6:43
in the Electra County School District will not have a
6:46
spring break this year. After a string of winter weather
6:49
closures forced the school system to miss thirteen days of classes,
6:55
the Electra County Board of Education voted at its February
6:58
meeting to use the entire spring break period as make
7:01
up days. Karen Baker, director of pupil Personnel, told the
7:06
board the district had exhausted its available weather days. The
7:10
district has missed more school this winter than in any
7:13
of the past five years. Baker said the previous high
7:17
was eleven days, not including non traditional instruction days used
7:22
during the COVID nineteen pandemic. Schools in Whitesburg also lost
7:26
instructional days earlier this year because of water outages. Board
7:31
reviews next year's calendars. Board members also reviewed three possible
7:37
school calendars for the twenty twenty six twenty seven school year.
7:42
Under the earliest option, teachers would begin August third and
7:46
students August fifth. The school year would end May twentieth
7:50
for students and May twenty first for staff, and would
7:54
include a full fall break and Thanksgiving break along with
7:58
the usual holidays. A second option would begin August third
8:02
for staff and August sixth for students, with the school
8:06
year ending May eighteenth. That calendar would include a shorter
8:10
fall break, a full Thanksgiving break, President's Day, and other
8:15
customary holidays. The latest starting option would begin August tenth
8:20
for staff and August thirteenth for students. Classes would end
8:25
May twenty fifth for students and May twenty sixth for staff,
8:28
while still including a full fall break and Thanksgiving break.
8:33
Renovations nearing completion. Contractors also reported that renovations to the
8:38
Alternative Education Building in Whitesburg are nearing completion. Zach Duncan
8:44
of Trace Creek Construction said about ninety percent of the
8:48
work has been finished, the buildings moving along. Duncan told
8:52
the board, we've gotten all the mechanical electrical plumbing completed,
8:57
all of the L B T flooring installed, rubber bases installed,
9:01
and all the ceiling grids installed. Final construction work and
9:06
clean up were expected to wrap up soon, though painters
9:10
will return to complete touch up work after the remaining
9:12
construction is finished. The Alternative Education Building serves students who
9:18
have been removed from regular classes for disciplinary reasons or
9:22
who need additional academic support. The former vocational school also
9:27
contains large rooms once used as mechanics bays that now
9:32
serve as practice space for archery, cheerleading, and wrestling. Located
9:37
near the Kentucky River, the building was flooded in twenty
9:40
twenty two. While temporary clean up made the facility usable,
9:45
repairs to flood damage are only now being completed other business.
9:51
In other actions, the board voted to allow Superintendent Denise
9:55
Jaants to take steps to obtain three surplus police vehicles
10:00
for school resource officers. Lecher County School's police chief, Jackie Joseph,
10:05
has applied for Kentucky State Police grant to provide the cruisers,
10:10
which the district would insure and register. The board also
10:14
heard several reports. Amber Stewart, director of Instruction, said classroom
10:20
coaches have been working with teachers at elementary schools to
10:24
strengthen K through five reading and math instruction despite weather disruptions.
10:30
A team from the Kentucky Department of Education also visited
10:33
the district to assist with reading training. Baker reported that
10:38
Lecher Elementary Middle School had the district's highest attendance in
10:42
February at ninety five point one two percent district wide,
10:47
attendants averaged about ninety two percent, though Superintendent Yahns noted
10:52
the figures were skewed because schools were in session only
10:55
five days and held two NTI days. Said the district
11:01
expects to reduce the number of teachers next year because
11:04
of declining enrollment and reductions in federal Title I funding.
11:09
Letcher County Central High School is projected to have twenty
11:12
six teachers next year, down from twenty nine. Student Representative
11:17
Colby Ambergy reported that several winter sports teams are heading
11:22
to regional tournaments, and the Letcher County Central High School
11:25
speech team placed third in nor region and will advance
11:29
to state competition. Ambergie also qualified for the state Student
11:34
Technology Leadership Program competition and recently received a forty thousand
11:39
dollars scholarship. The board also re hired Darryl Hall as
11:44
board attorney and Bridget Begley as board secretary. Board members
11:50
met in closed session to discuss a lawsuit filed by
11:54
the late Roger Hall, who alleged injury from long term
11:58
exposure to asbestos while working at the former Lectra High School.
12:03
And in the next story, Weather Railroad slow progress on
12:09
Roxanna Mill Branch project water lines to the Roxanna Mill
12:14
Branch area have been held up by the weather and
12:17
the railroad and likely won't be completed until late spring.
12:22
Commonly called the Federal Bureau of Prisons Project, because the
12:26
lines are needed to supply water to the proposed federal
12:29
prison there at Roxanna, The lines were still on schedule
12:33
in January, the contractor asked a ninety day extension to
12:38
make up for the time spent waiting for permits from
12:41
the railroad and for the snow and ice to thaw.
12:45
An engineer for the project told the Electra County Water
12:48
and Sewer District that contractors have laid sixteen thousand, five
12:52
hundred feet of eight inch ducto iron pipe, two hundred
12:57
six feet of four inch plastic pipe and see thy
13:00
two hundred feet of four inch ductel iron pipe, and
13:03
has made most of the road bors that need to
13:06
be made for the lines to cross Kentucky five eighty
13:08
eight and other roads. The company was still waiting to
13:12
bore under the railroad. At the regular February meeting of
13:15
the water district Board of Directors that work was planned
13:19
to be done last week. The company completed an agreement
13:23
with a property owner on Judy Branch to drill from
13:26
their land to the opposite side of the Kentucky River.
13:30
The project is seventy six point eight percent complete, but
13:34
ninety two point six percent of the contract time has
13:37
been used. Work is progressing a land purchase for a
13:42
water treatment plant at Ova. That project had been temporarily
13:46
paused after the landowner became concerned that the plant would
13:50
be too close to his home. The district and its
13:54
engineers are now working with the same landowner on finding
13:57
a different site on the same property. Work is also
14:01
expected to begin soon on water lines to a proposed
14:05
autism center to be built by Mountain Comprehensive Health Corporation
14:09
near Dry Fork. That line will also serve nearby areas.
14:14
The district also voted to hire Vanguard Utility Services the
14:19
low Bidder to install water meters damaged by floods in
14:23
twenty twenty two, twenty twenty three, and twenty twenty four
14:27
in Loggy Hollow. In the next headline, girl fourteen hurt
14:34
after dirt bike hits her in Fleming. A fourteen year
14:38
old girl was flown out for medical treatment after being
14:41
hit by a motorcycle in Fleming, Neon Kentucky State Police
14:46
were called to the three hundred block of Kentucky three
14:49
forty three in the Fleming section of town about six
14:52
forty six p m. On February twenty eighth. The call
14:57
was originally dispatched as a female being ejected from four wheeler,
15:01
but that original call was not correct. The girl was
15:05
apparently walking across the road when she was struck by
15:08
a dirt bike being ridden on the highway. The dirt
15:12
bike was being operated by a juvenile boy. Police said
15:16
dirt bikes are not legal to ride on public roads
15:19
unless they are street and trail motorcycles with working headlights,
15:24
tail lights, stop lights, turn signals, mirror and a muffler
15:29
and are licensed operator under twenty one or with lerner's permit,
15:33
must wear a helmet. Trooper Matt Gayhart, spokesman for Kentucky
15:38
State Police Post thirteen in Hazard, said the girl was
15:42
flown out by helicopter due to critical injuries suffered in
15:46
the incident. Trooper Charlie Moore is in charge of the investigation.
15:51
The next story is Marker recognizes Italian Stonemasons. Part of
15:58
Lectra County's melting pot is high highlighted on a sign
16:01
just installed in front of the Graham Memorial Presbyterian Church
16:05
in Whitesburg. The sign highlights construction of the church by
16:09
Italian Stonemasons who moved to America to work for the
16:13
railroad and coal companies. It also recounts the placement of
16:18
a stone shaped like a boot in commemoration of their
16:21
home land, and how that stone was split into pieces
16:25
during World War II. The sign was created as a
16:29
result of family research by John Ranieri, a descendant of
16:33
one of the early Stonemasons, who happened to see a
16:36
college thesis written by Justine Richardson, formerly of Whitesburg. Mountain
16:42
Eagle reporter Sam Adams wrote the text and the sign
16:45
was designed by graphic artist Claudia Ergot of New Jersey.
16:50
Ergot's family name is Codispatti, and they came from the
16:53
same small Italian town as the late August Codispatti, who
16:57
lived here on College Hill. The sign was paid for
17:02
by a grant from the Lectri County Community Foundation and
17:05
private donations. The next story is PSC grant's rate hike.
17:14
In a detailed two hundred twenty five page order issued
17:18
over the weekend, the Kentucky Public Service Commission PSC approved
17:23
a fifty five point zero five million dollar rate increase
17:27
for Kentucky Power Company, cutting more than forty million dollars
17:31
from the utility's original request and modifying a settlement agreement
17:36
reached earlier this year. Kentucky Power had sought a ninety
17:41
five point five to six million dollar increase, or about
17:45
fourteen point nine per cent above current base rates. A
17:49
January settlement between the company and several interveners proposed reducing
17:54
that amount to seventy seven point four million dollars. For
17:58
the average residential cutoustomer using one thousand, two hundred eight
18:02
kilowat hours per month, the five point eight seven percent
18:07
increase will amount to about ten dollars and seventy six
18:10
cents per month in the first year, hiking the bill
18:14
from one hundred eighty three dollars and thirty seven cents
18:17
to one hundred ninety four dollars and thirteen cents. An
18:21
additional point seven six percent increase will take effect next year,
18:25
putting the increase at six point sixty three percent. Many
18:29
Eastern Kentucky residents, however, pay an average monthly base rate
18:34
of about four hundred and fifty dollars. Those customers will
18:38
see their bill increase to four hundred seventy six dollars
18:42
and forty two cents a month before taxes and other
18:44
charges are added in. When those extra charges for a
18:48
fuel adjustment clause, a securitized search charge rider, an environmental
18:54
adjustment clause, and a school tax are added in, their
18:58
total monthly bill will from five hundred forty dollars and
19:02
forty eight cents to five hundred sixty nine dollars and
19:06
seventy eight cents. The next story is Medicaid changes advance
19:12
in Frankfort What residents here should know about it. The
19:17
Kentucky House of Representatives has approved House Bill II, a
19:21
seventy seven page Medicaid overhaul that would require certain adults
19:26
to work, volunteer or attend school at least eighty hours
19:30
per month to maintain coverage, and would mandate eligibility reviews
19:35
every six months. The bill passed the House on February
19:40
twenty eighth by a vote of seventy seven to twenty one.
19:45
Among those voting in favor of it were ninety fourth
19:48
District Representative Mitch Whitaker of Fleming, Neon eighty fourth District
19:52
Representative Chris Fuget of breathatt County, ninety second District Representative
19:57
John Blanton of Saliersville, ninety seventh District Representative Bobby McCool
20:02
of Johnson County, and Chris Feuget of Perry County. All
20:07
Republicans voting against the bill were twenty Democrats, including one
20:12
from Eastern Kentucky ninety fifth District Representative Ashley Tackett Lafferty
20:17
of Prestonsburg. One Republican voted against the bill eighty second
20:22
District Representative Nick Wilson, who represents all of Whitley County
20:26
and a portion of Laurel County. Should the bill become
20:30
law beginning in twenty twenty six, the Cabinet for Health
20:34
and Family Services would be required to conduct semi annual
20:38
eligibility reviews and cross check enrollees against a wide array
20:43
of federal and state databases, including unemployment records, tax records,
20:48
vehicle registrations, corrections data, and national address databases. The legislation
20:55
also means the Cabinet for Health and Family Services would
20:59
no longer allow how Medicaid enrollees to self declare their income, residency,
21:04
and age. In most circumstances, Supporters argue the bill strengthens
21:09
program integrity and accountability. Opponents warn the increased documentation requirements
21:16
could lead to coverage losses for eligible residents, particularly in
21:21
rural and economically distressed regions. Here's what the bill would
21:26
do and what it could mean locally if it passes
21:29
the Senate and is signed into law. An eighty hour
21:33
monthly requirement for some The most talked about section of
21:37
House Bill to would require certain adults covered through Medicaid
21:41
to complete at least eighty hours per month of community engagement.
21:47
That engagement can include paid employment, community service, participation in
21:52
a work program at least halftime, enrollment in school, a
21:56
combination of these activities, or earnings to at least eighty
22:01
hours at Kentucky's minimum wage. The requirement applies to adults
22:06
ages nineteen through sixty four enrolled under Medicaid expansion unless
22:11
they fall into one of several exemption categories eligibility checks.
22:17
Under current practice, most Medicaid recipients renew coverage once a year.
22:23
House Bill two would require the state to conduct eligibility
22:27
redeterminations every six months for certain adults, beginning in mid
22:31
twenty twenty six. That means twice as many renewal notices,
22:36
twice as many paperwork deadlines, and twice as many chances
22:40
for a coverage interruption. In addition, the Cabinet for Health
22:45
and Family Services would be required to check multiple state
22:48
and federal databases when determining eligibility. If conflicting information appears,
22:54
the state could issue an initial finding of ineligibility, which
22:58
the recipient would have to appeal. Another major change in
23:03
House Bill two is the tightening of documentation rules. The
23:08
bill states that the Cabinet may not accept self attestation
23:12
of income, residency, or age, except in limited situations. Self
23:18
attestation could only be used as a last resort for
23:21
certain other eligibility factors. In practical terms, that means many
23:26
applicants and current recipients may need to provide documentation such
23:31
as pay stubs, tax records, lease agreements, utility bills, or
23:36
government issued identification. For people with steady employment and stable housing,
23:42
this may not pose a problem data matching and address checks.
23:48
House Bill two would also require the state to routinely
23:51
check Medicaid recipients against multiple databases, including unemployment insurance records,
23:57
tax records corrections, data change of address databases, and other
24:02
public data systems. If mails sent to a Medicaid beneficiary
24:07
is returned as undeliverable and a valid Kentucky address cannot
24:11
be confirmed within fourteen business days, the Department could move
24:15
to disenroll that individual, subject to federal law, new co
24:23
payments for some adults. House Bill two would also introduce
24:27
limited cost sharing for certain adults on Medicaid whose income
24:32
is above one hundred percent of the federal poverty level.
24:36
Beginning January first, twenty twenty seven, those patients would be
24:40
required to pay an eight dollars copay for non emergency
24:44
use of an emergency room and a thirty five dollars
24:47
copay for an inpatient hospital stay. Beginning October first, twenty
24:52
twenty eight, the cost sharing rules would be expanded to
24:56
include a twenty dollars general copay, a thirty five five
25:00
dollars in patient copay, a one dollar copay for preferred
25:04
prescription drugs, and a five dollar copay for non preferred drugs.
25:10
Total cost sharing would be capped at five percent of
25:13
family income. Primary care, metal health services, substance use disorder treatment,
25:21
federally qualified health centers, and rural health clinics are among
25:25
services exempt from these copays more changes. Not all provisions
25:31
of House Bill two focus on eligibility. The bill also
25:35
strengthens oversight of Medicaid managed care organizations and creates new
25:41
accountability standards. It establishes a Medicaid Managed Care compliance Fund,
25:47
financed by penalties imposed on contractors. Lawmakers state their intent
25:53
that money in this fund support future Medicaid reimbursement rate
25:56
increases if appropriated by the General Assembly. For rural hospitals
26:01
and clinics in eastern Kentucky, many of which rely heavily
26:05
on Medicaid reimbursement, any future rate support could be significant. However,
26:11
no rate increase is automatic. It would require legislative approval.
26:17
House Built two also includes reforms aimed at non emergency
26:21
medical transportation services for residents who must travel long distances
26:27
for a dialysis, specialty care, or behavioral health treatment. Reliable
26:32
transportation is often essential. Whether those changes improve service will
26:37
depend on how they are implemented. House Built too was
26:41
received Monday in the State Senate. It has been assigned
26:46
to the Committee on Committees. This concludes the reading of
26:50
the Mountain Eagle. Your reader has been built in Arsdale. Now,
26:54
please stay tuned for continued programming on behalf of everyone
26:58
here at Radio. I thank you for listening and have
27:02
a good day.
