Paperwork Over Predators: How New York Tried to Soften Jeffrey Epstein’s Crimes · The Epstein Chronicles

• 0:00
Speaker 1: What's up, everyone, and welcome to another episode of the
• 0:03
Epstein Chronicles. In this episode, we're going to take a
• 0:06
look at the argument made by Jeffrey Epstein's legal team
• 0:10
trying to get his offender status in New York knocked
• 0:13
down to the lowest level. And to do that, we're
• 0:15
gonna jump right into the transcript from the hearing in
• 0:19
front of Judge Ruth Pickholtz. For the defense, you have
• 0:24
kirkland Ellis. That's Jeffrey Epstein's legal team. It's going to
• 0:28
be Jay Lefkowitz and Sandra Mussumichi. And then for the
• 0:32
government or for the State of New York, I should say,
• 0:35
you have Jennifer Gaffney and Cyrus Vance. So after they're
• 0:41
all sworn in, Jennifer Gaffney begins, your honor. This is
• 0:45
a case on a sorry hearing this afternoon. The people
• 0:48
did receive the board recommendation of a level three. However,
• 0:52
we receive the underlying information from them and also had
• 0:55
some contact with Florida, and we don't believe that we
• 0:58
can rely on the entire probable cause is Affid David.
• 1:02
I don't know if the board sent that to you
• 1:03
as well. The court I don't know why you can't
• 1:06
rely on it, Miss Gaffney, because in Florida, all of
• 1:10
the victims in that probable cause Affidavid, they actually only
• 1:13
went forward on one case. There was only an indictment
• 1:16
for one victim, and that is what the defendant pled to.
• 1:20
So it's unlike a situation where everything was indicted and
• 1:24
then we get to sort of assess points for all
• 1:27
of the victims if it was part of a plea bargain.
• 1:30
They did not actually choose to go forward on any
• 1:33
except for the one victim. So under the board guidelines,
• 1:36
the Risk Assessment Interim guidelines, it actually says, you know,
• 1:40
by the way of contrast, if an offender is not
• 1:42
indicted for an offense, it's strong evidence that the offense
• 1:46
did not occur. And I don't think the court cuts
• 1:49
her off. Do you find that if somebody is not indicted,
• 1:52
it's strong evidence that it did not occur, Miss Gaffney,
• 1:56
I don't know that we can rely on it as
• 1:58
clear and convincing evidence if the prosecutor's office never went
• 2:02
forward with it. The prosecution said that the victims, although
• 2:05
they spoke to the police early on, did not cooperate
• 2:08
with them, so we don't have any follow up information
• 2:12
the court. But the board found a level three. I
• 2:15
have to tell you, I'm a little overwhelmed because I
• 2:17
have never seen the Prosecutor's office do anything like this.
• 2:20
I have never seen it. I had a case with
• 2:22
one instance. It was a marine who went to a bar,
• 2:25
and I wish I had that case before me. But
• 2:27
he went to a bar and a seventeen year old.
• 2:30
He was an adult, obviously he was a marine. A
• 2:32
seventeen year old came up to him and one thing
• 2:35
led to another, and he had sex with her. And
• 2:37
people would not agree to a downward modification on that.
• 2:40
So I'm a little overwhelmed here because I see, I mean,
• 2:43
I read everything here. I'm just a little overwhelmed that
• 2:46
the people are making this application. I could cite many
• 2:50
many I have done many sores much less troubling than
• 2:54
this one, where the people would never make a downward
• 2:57
argument like this, Miss Gaffney. I agree with your honor,
• 3:00
it's incredibly unusual for us to make a downward argument.
• 3:04
But the problem is the one thing that we have
• 3:06
from the board. It seems to be a contradiction to
• 3:09
their own guidelines, which if something was not indicted, you're
• 3:12
not supposed to rely on it the court. They obviously
• 3:15
took that into consideration, Miss Gaffney, and I tried to
• 3:19
reach I reached the authorities in Florida to try to
• 3:22
see if they had all the interview notes or other
• 3:24
things that we can then subsequently rely on that might
• 3:28
be considered clear and convincing evidence if they had interviewed
• 3:31
these women on their own, and they never did. No
• 3:34
one was cooperative, and they did not go forward on
• 3:37
any of the cases, and none of them were indicted.
• 3:40
So I don't know. The court. And you spoke to
• 3:43
the prosecutor, Miss Gaffney, the actual prosecutor left the office.
• 3:47
I spoke to the prosecutor that took over the case
• 3:50
the court. Maybe you can find the prosecutor that left office.
• 3:53
You've done more in other cases looking into it. I
• 3:56
have never seen the prosecutor's office do this. I have
• 3:59
to tell you, I'm shocked, Miss Gaffney, right, but I
• 4:03
spoke to the prosecutor that took over the case, and
• 4:05
they don't have anything any affid David's, any statements, any notes,
• 4:10
And just to interject here, you guys see what I
• 4:12
mean about the fix being in. Once again, the paperwork
• 4:16
proves it, the court, why don't you speak to the
• 4:20
prosecutor that did the case. I'm sure you could find
• 4:23
that prosecutor, Miss Gaffney. I can find her, But based
• 4:27
upon what the other prosecutor said, they did not speak
• 4:30
to that prosecutor either the court. You didn't speak to
• 4:33
the prosecutor yourself. You didn't speak to them. That's hearsay.
• 4:37
You did not speak to the prosecutor that handled the case,
• 4:40
Miss Gaffney. That's right, the Court. I don't think you
• 4:43
did much of an investigation here, Miss Gaffney. I mean
• 4:46
I called the prosecutor, even the first prosecutor that left,
• 4:49
presumably the prosecutor's office has the files. The Court, I
• 4:53
would still call the prosecutor, Miss Gaffney. Anything from these
• 4:57
women would have forwarded it to us the Court. I
• 5:01
don't know that. I think you have to speak to
• 5:03
the prosecutor. But be that as it may. I hear
• 5:06
your argument anything else, Miss Gaffney. I mean that's why
• 5:10
  I don't think I can or we can. I don't
• 5:12
think we're entitled to rely on this because they did
• 5:14
not go forward the court. The board maker of recommendation,
• 5:18
Miss Gaffney, correct, Miss Mussumichi, one of the lawyers for Epstein,
• 5:22
May I speak your honor the court. Yes, Miss Musumichi,
• 5:26
good afternoon. I would like to bring a few additional
• 5:28
points to your honor's attention that don't come across in
• 5:31
the board recommendation. The first is that mister Epstein is
• 5:35
not a resident of New York. Unlike most of these
• 5:38
out of state he has not changed his address and
• 5:40
moved to New York. He maintains a vacation home in
• 5:43
New York. His primary residence is the US Virgin Islands.
• 5:47
Another bunch of bullshit. He's registered in the US Virgin Islands.
• 5:52
He has been since his release from jail. He noticifies
• 5:55
the US Virgin Island authorities every time he leaves that jurisdiction.
• 5:59
Virgin Island Authority's rated him at the lowest level of registration. Oh,
• 6:03
I bet they did, because they were all being paid
• 6:05
by them. I mean, are you guys not disgusted yet?
• 6:09
And don't you have more questions for Stacy Plaskett and
• 6:11
everybody down in the USVII. Probably a good idea to
• 6:15
focus there, huh. He also registered in Florida, which is
• 6:19
the state of this particular offense, and the only reason
• 6:22
that this conviction is even before your honor. The offense
• 6:25
for which he was convicted is not a registrable offense
• 6:28
in New York. So picking up a little girl in
• 6:30
New York is not a registrable offense. And that was
• 6:32
the whole point of them kicking it down to state.
• 6:35
They didn't want this to be a real thing. They
• 6:37
didn't want this to follow Epstein to other places, so
• 6:41
they manipulated the whole situation and made it a state
• 6:44
charge that never had any teeth. And guess what, that's
• 6:47
not speculation, that's fact. He is only registerrable here, arguably
• 6:53
because based on the provision of the SORA that says
• 6:55
if a crime is registrable in the state of conviction,
• 6:58
then it's registrable here New New York, and the Florida
• 7:01
authorities that considered that rated him the lowest level of
• 7:04
their Sores statute. He additionally has a vacation home in
• 7:09
New Mexico and is registered in New Mexico. The New
• 7:12
Mexican authorities, when they considered his offenses to determine that
• 7:16
he not register at all. Nevertheless, he has voluntarily registered
• 7:21
with New Mexico and maintains that registration. Additionally, because of
• 7:25
his possession of a vacation home in New York, he
• 7:28
has been voluntarily registered with New York SOMU, the Sex
• 7:33
Offender Monitoring Unit, since May of this year. He notifies
• 7:36
them whenever he comes to travel to New York. He
• 7:39
never comes to New York for more than seven days,
• 7:42
or at least he has not since he has been registered.
• 7:45
He has no intention to ever be here for a
• 7:48
longer period of ten days. Like I said, he does
• 7:52
notify the authorities when he's here. He fully understands the
• 7:55
reason for voluntary registration. He wants to be compliant with
• 7:59
the federal Sora law law, which requires wherever you own
• 8:02
a property to register. Cool. Let's see all those logs.
• 8:05
I want to see every single time he checked in.
• 8:09
That's part of the files, right, let's see it. That's
• 8:11
not national security. I want to know who was and
• 8:14
who wasn't doing their job. To require mister Epstein to
• 8:18
register as a Level three offender in New York would
• 8:20
actually require him to come to New York more than
• 8:23
he actually does. Who would require him to come every
• 8:26
ninety days and renew his registration. He is very diligent
• 8:29
in registering with New York authorities. All the other jurisdictions
• 8:33
that have considered his case have determined that he is
• 8:36
either not to register at all or register at the
• 8:39
lowest level, and that he has been more than compliant
• 8:42
with all of those requirements, Your honor, we would join
• 8:45
in the prosecutor's application. Now think about that for a minute.
• 8:49
The prosecutor and Epstein together, the City of New York,
• 8:52
by the way, cy Vance, Jennifer Gaffney, and the New
• 8:55
York Prosecutor's Office, all arguing in favor of making Epstein
• 9:00
register at the lowest level. Now chew on that for
• 9:04
a little while, the court, I'm sure you would miss Musumichi.
• 9:08
By the way, a background. We have been in contact
• 9:10
with the Prosecutor's office on this matter since I believe
• 9:13
certainly mister Epstein got his notification, which I believe was
• 9:16
in August. We have met with the prosecutor and provided
• 9:20
numerous material for the prosecutor to consider. We have included
• 9:24
in that a deposition from the detective who headed this investigation,
• 9:28
who acknowledged in a sworn deposition that the lead prosecutor
• 9:32
who originally had the case, whose name I cannot pronounce,
• 9:35
Lana Bellohovlik, I apologize for the mispronunciation, said to the
• 9:39
detective after her investigation. There are no real victims here,
• 9:43
So Lana Bellohovlick, you're next up on the chopping block. Bro.
• 9:49
Why isn't this lady being called before Congress? Why isn't
• 9:52
this lady being forced to give a sworn statement? And
• 9:56
how much money did Jeffrey Epstein pay her and her friends?
• 9:58
That's basically where I'm going with this. Now, I can't
• 10:01
prove that, but what else is going to motivate somebody
• 10:04
to give Jeffrey Epstein the Homy hookup. All of the
• 10:07
alleged conduct that is cited in the board's rite up
• 10:10
was of commercial value. All of the alleged conduct the
• 10:12
women went voluntarily. There are no allegations of force, certainly
• 10:16
none the court. There was no allegation of force in
• 10:20
the marine either. Who met a girl in a bar,
• 10:22
a young girl seventeen? There was no force there, Miss Mussumichi.
• 10:26
It's our understanding that a prosecutor in Florida conducted a
• 10:29
full investigation, as full as she was able with the
• 10:32
cooperation afforded by these complaints and determined that there was
• 10:36
only one case that she could present to the grand jury.
• 10:39
Was this indictment for non registerable offense then, and the
• 10:43
judge cuts her off mid sentence. The court, but it
• 10:46
is registrable here. I don't know what you mean a
• 10:49
non registrable offense, Miss Mussumichi. Let me explain, your honor.
• 10:53
Mister Epstein pled to two charges. One was an indictment,
• 10:56
which is an offense that is not registrable. It is
• 10:59
a Florida in indictment for cut off again by the court.
• 11:02
Then why is he after register here, Miss Mussumichi. It
• 11:05
was the second offense that he pled to the court
• 11:08
that is registrable, Miss Mussumichi. That is registrable. That offense
• 11:12
was by information and that is the only registrable offense.
• 11:17
That is what the DA's office is considering and doing
• 11:19
their scoring. The indictment, which was the only case that
• 11:23
the prosecutor even prosecuted through grand jury, is not even
• 11:27
a registrable offense the court. He pled guilty to a
• 11:30
registrable offense, Miss Mussumichi, yes, the Court. What did he
• 11:34
plead guilty to, Miss Gaffney. He pled guilty to procuring
• 11:38
a person under the age of eighteen for prostitution the court.
• 11:42
Procuring a person under eighteen for prostitution, Miss Gaffney, right,
• 11:47
the court. How old was she, Miss Gaffney. It appears
• 11:50
the first time they met she was either sixteen or seventeen.
• 11:53
Then for the remainder of their relationship, she was probably seventeen.
• 11:57
The Court. How long was their relationship, Miss Gaffney, She
• 12:01
met him, she had more approximately fifteen massages, including with
• 12:04
sexual contact, and ultimately, when she was seventeen, had intercourse
• 12:08
with them. The court, she is still a child, Miss Mussumichi,
• 12:13
Your honor, I would note that under SORA, it's clear
• 12:16
that prostitution offenses are only registerrable when in fact, by
• 12:20
clear and convincing evidence, the women or victim is seventeen,
• 12:23
is under seventeen. I can't believe they're even making this argument.
• 12:27
It's really disgusting, and the fact that they let them
• 12:30
get away with this down in Florida is the whole
• 12:33
entire problem. The whole entire issue here is that they're
• 12:36
saying that it was prostitution. But the big problem for
• 12:39
them is this, if you're underage, you can't consent, you
• 12:42
can't be a prostitute. So it's not prostitution. It's child abuse.
• 12:48
It's underage child abuse. That's what it is. Why don't
• 12:51
we just call it what it is? The court, well,
• 12:54
she met him at sixteen, he procured her at sixteen.
• 12:57
From what I read, Miss Mussumichi, there's evidence that we
• 13:00
challenged the court he pled guilty to. That, didn't he,
• 13:03
Miss Mussumichi, he pled guilty to under eighteen, which is
• 13:07
the law in Florida, which is a different standard than
• 13:10
the law in New York. And there is no evidence,
• 13:12
there is no clear and convincing evidence as to her
• 13:15
specific age at the time of the specific conduct. The court, well,
• 13:19
the DA just told me she was most likely seventeen.
• 13:22
She just said it on the record, Miss Mussumichi, Your honor,
• 13:25
we agree that the evidence is that she was seventeen
• 13:29
on the one occasion he had consensual intercourse with him,
• 13:33
And seventeen is not registerrable or criminal under New York law,
• 13:38
and the prostitution aspect of having intercourse with the seventeen
• 13:41
year old is not a registrable conduct. Oh yeah, I
• 13:44
guess not. Everything's all good. Do you think she'd be
• 13:47
saying the same thing about her seventeen year old daughter
• 13:51
the court, Why does he have to register here, Miss Gaffney,
• 13:54
because it's a registrable offense in Florida, New York State
• 13:57
Board of Examiners. The court recognizes it, Miss Gaffney recognizes it. Yes,
• 14:03
the Court. I have had many cases like that where
• 14:06
it was not registerrable here, but it was in the
• 14:08
state where the person came from, and New York recognized that.
• 14:12
Miss Mussumichi, your honor. We're not saying that we should
• 14:15
not register. Mister Epstein has already registered and recognizes his
• 14:19
duty to register the court. I'm glad of that. I
• 14:22
am very glad of that. I'm sorry that he may
• 14:24
have to come here every ninety days. He can only
• 14:27
give up his New York home if he does not
• 14:29
want to come every ninety days. Anything else, I rely
• 14:32
on the board. Miss Mussumichi, your honor, we would reserve
• 14:36
our right to appeal. Your honor is ruling the court,
• 14:38
of course, do so, Miss Gaffney, for the record, Your honor,
• 14:42
he is going to be deemed a Level three offender
• 14:44
with no designation. Correct the court correct Miss Mussumichi. For
• 14:49
purposes of the appeal, I believe that your honor the
• 14:52
court give me the board scoring. The board has scored
• 14:55
use of violence the least ten sexual contact with victim
• 14:58
twenty five. I agree number of victims three or more.
• 15:01
He only pled guilty to one, but apparently there were
• 15:04
more than one, and I think the people can see that.
• 15:07
Although they say it was not reliable duration of the offense,
• 15:11
conduct with victim continuing the course of sexual misconduct, the
• 15:15
people have told me it was continuing for twenty points.
• 15:18
Age of victim eleven through sixteen. He got twenty points
• 15:21
for that, and she was sixteen at the time. Other
• 15:24
victim characteristics. There was no mental disable or helplessness. I
• 15:28
agree relationship with victim stranger twenty points age at first
• 15:33
act of sexual misconduct twenty or less. They scored him
• 15:36
zero on that number. In nature of prior crimes no history,
• 15:39
they scored them five on that. Recency of prior offense
• 15:43
less than three years. They gave them zero drug or
• 15:46
alcohol abuse history. They gave him zero acceptance of responsibility.
• 15:50
They gave him zero conduct while confined. They gave him
• 15:53
zero and supervision. They gave him zero living employment situation zero.
• 15:58
They gave them one hundred and thirty points, which is
• 16:00
the highest level. And I agree with that. Now, mister Lefkowitz,
• 16:04
one of Epstein's other lawyers, chimes in, if I could
• 16:07
be heard for one moment, it appears that the state
• 16:09
board made its determination based on access to a police
• 16:12
report in Florida. The prosecutor, the lead prosecutor, the lead
• 16:15
sex crimes prosecutor in Palm Beach, made a determination that
• 16:19
the complaints in the police report itself was not credible
• 16:22
and decided not to prosecute on the basis of all
• 16:25
of that. And right there in itself is a big problem.
• 16:28
None of this was believable or credible. The only thing
• 16:31
that's not credible is the whole ass investigation, from top
• 16:34
to bottom. So yes, save the bullshit, save the lies,
• 16:37
save the gas lighting, save the bullying, shut the fuck up,
• 16:40
and release the files. In addition, there has been, through
• 16:42
the course of the last few years, some civil litigation,
• 16:45
as you might imagine, involving these matters, and now we
• 16:49
have sworn testimony and evidence from the complaintants themselves disclaiming
• 16:53
much of what appears in the police report. So your honor,
• 16:55
we would submit, and this is not to make light
• 16:58
in any way of the conduct of mister Eppstein did
• 17:00
or what mister Epstein played guilty to, but with the
• 17:03
respect to everything, and that's why mister Epstein voluntarily registered
• 17:06
in New York, even though there is a question about
• 17:09
whether he has any obligation, just as jurisdictional matter. But
• 17:13
your honor, with respect to the appropriate level for him
• 17:16
to register, we would submit, your honor that the evidence
• 17:18
simply does not support the foundation of the state's determination
• 17:22
the court. You have made a very clear record, and
• 17:25
you have a right to appeal. I feel the board
• 17:27
looked into all of this, made their recommendation, found them
• 17:30
to have one hundred and thirty points, and I see
• 17:32
no reason to disturb that. Thank you, and with that
• 17:36
the hearing ends. But the fact that the State of
• 17:38
New York actually got on board and tried to argue
• 17:41
this is just straight up disgusting, and I think that
• 17:44
everybody is in agreement at this point. Save the bullshit nonsense,
• 17:48
save the narrative, and release the files all of the
• 17:52
information that goes with this episode can be found in
• 17:55
  the description box.
