- 2:24Coming up on the show, we're gonna get a little conversation on barbecue,
- 2:29one of my favorite subjects. Charlie West Barbecue Fest is happening this Saturday.
- 2:32It had at Riverfront Park in Charleston, and we're going to talk to
- 2:36one of their folks about that. Coming up, also, Brad mcahanney will
- 2:38be here as well. Lots of talk about with Brad, including some not
- 2:45so flattering news from the governor's financial situation and now he and his family firing
- 2:51back against the bank that has been there their right hand bankers. I guess
- 2:53you would say for many, many years. Brad's got that story covering up
- 2:57a little bit later on, but I want to welcome into the show Attorney
- 3:00Earl Patrick Morrissey, Good morning, Sarah. How are you. I am
- 3:02doing well. Good morning to you. Thank you for being here with us,
- 3:07Sir. I do appreciate it, and I wanted to talk to several
- 3:09we'll talk to you about several things we're gonna get and of course to your
- 3:15bid for governor a little bit later on. So a lot of things I
- 3:19want to I want to talk to you about. But before we get to
- 3:23that run for governor, there's a couple of other things that I wanted to
- 3:27mention. This settlement that your office has with Kroger. It's a sixty eight
- 3:30million dollar deal and you've already got Walgreen's CVS and write Aid on board.
- 3:37Kroger just the latest to be added to the list. Give us a story
- 3:39on this or how did this whole thing come about? Absolutely so, as
- 3:44many people know, we've been working to bring accountability to the pharmaceutical supply channel
- 3:49for many years. And in fact, you might remember when people were critical
- 3:53because they wanted more to happen, or they suggest that I should accept the
- 3:58earlier national elements, and I held out for West Virginia, we doubled the
- 4:02national settlements and now we've been able to bring in the gross amounts probably going
- 4:09to exceed one billion dollars, and this particular settlement is a sixty eight million
- 4:15a lot of it frontloaded, which is really important. And now the resources
- 4:18will go in as per the recent law that passed, which is it affirms
- 4:24the West Virginia First Memorandum of Understanding and not to split between the counties the
- 4:30cities, and also the private foundation that is being created. And the real
- 4:34value on that is to target the resources to those who need it most,
- 4:40to have needs assessments done throughout the entire state, and to make sure we're
- 4:45attacking this problem from a supply, a demand, and an educational perspective.
- 4:49And Dave, especially with the massive influx of fetnol coming in, this is
- 4:55going to be sorely needed because fetnol is wrecking so many lives, killing so
- 5:00many people in West Virginia. I think it's critical finally have a plan to
- 5:05attack that here in the state and then also to make sure that that plan
- 5:10is funded. That's the first time that's ever happened. So this suttiment is
- 5:13one part of a multi part piece. This also means that this phase of
- 5:17the litigation is concluded from our perspective, and that's significant. Doesn't mean there
- 5:24won't be future litigation. It just means that this round with all of these
- 5:28entities, we've been able to reach agreements with. So that's obviously significant development
- 5:33for the state. I want to talk about that foundation for a moment,
- 5:35and you alluded to it there. The governor signed a bill that would create
- 5:40that West Virginia First Foundation, and you touched on it a little bit there,
- 5:44sir, But explain to us again exactly what it is and how it
- 5:48will be used and again I know you touched on it just a little bit.
- 5:51How exactly will cities and counties benefit from this? Absolutely? So,
- 5:55first of all, cities and counties are going to be getting direct resources,
- 6:00So is their number one ask in the negotiations, and so of every net
- 6:04dollar that comes in, twenty four and a half percent go directly to the
- 6:09counties and cities and they can use that for addressing the opioid and the fetmoal
- 6:15mass that we have. And that's really up to them and they wanted and
- 6:19that was their top negotiate item and they're getting a lot of resources directly.
- 6:27The second piece, which is probably most relevant for the folks across the state
- 6:31is this foundation that's getting created. That's going to be an organization. It's
- 6:38private. It's set up with appointments from six people within the regions of West
- 6:44Virginia. So the local communities the counties are going to come together. They're
- 6:47actually going to have to have an election process to name the board members who
- 6:53will serve on this foundation. And then in addition, the governor will pick
- 6:58five members of the board and that's significant, and so there'll be eleven people
- 7:03on this board. And what they will be doing is they will obviously be
- 7:08managing the resources. They'll very likely start with a needs assessment across West Virginia
- 7:14to determine the specific needs. Some areas have different needs than other areas,
- 7:18and then they will establish the process by which applications will come in from across
- 7:26the state. It could be private sector applications, it could come from certain
- 7:30communities, and then they'll people will make requests, but that the decisions get
- 7:34made based on the needs assessment and the board makes those decisions. So it's
- 7:41really an important process because this is how a lot of the needs of the
- 7:46opioid and the feedmal epidemics are going to get addressed. Nine fifteen. We're
- 7:50talking to Attorney General Patrick Morrissey here on five eighty five ety lie presumed in
- 7:55park by Meek's Realty Group. Our areas was beautiful properties deserve the finest realtors
- 8:00Meeks Realty Group. Visit of online Meeks dot us are called three or four
- 8:03four four zero one zero one, mister ag. Just about everybody who represents
- 8:07West Virginia being in Washington, or those who represent their individual areas and the
- 8:11counties and the districts, and everybody had something to say about the EPA's new
- 8:16proposed rules on power plans. Even your old nemesis, Sir Senator Mansions book
- 8:20against it. You know it must be bad when you and Joe Mansion come
- 8:24to the same conclusion talk about it. Well. As many people know,
- 8:28we've spent now nine ten years of fighting off these different proposals, and in
- 8:35fact, last June, we had a significant victory on these similar issues at
- 8:41the US Supreme Court where they ruled that the old Obama A power plan was
- 8:46actually not permissible under the Clean Air Act, and a significant victory for West
- 8:52Virginia, our jobs, our way of life, Unfortunately, looks like the
- 8:56Biden administration is trying to dust everything off again and go back to the drawing
- 9:01board, and we're seeing different parts of the clean power plant kind of get
- 9:07revisited. So they're putting lipstick on the pig, and they're trying to once
- 9:13again target West Virginia and really get rid of coal. And so we've been
- 9:18out in front leading this very effort. I applaud anyone who wants to help
- 9:22in our effort to try to block this, because it really matters from a
- 9:26job's perspective. It matters in terms of how much people pay us the power
- 9:31bills. This is an orageous proposal, and I think that it's going to
- 9:37suffer the same fate that the other one did. But we're going to have
- 9:41to get to work. We're actually still unpacking the regulation, and we know
- 9:46that what they're trying to do by suggesting that immediately or if in a very
- 9:52short period of time people are going to be moving over to carbon capture sequestration
- 9:56or to the green hydrogen, this is not real. This stick in any
- 10:00way, and I think that West Virginia would be hurt very badly if this
- 10:05ever were in effect. So it's my goal to try to prevent that from
- 10:09happening, and obviously welcome everyone's help to try to continue to fight this fact.
- 10:16You, sir, I currently hold the office of Attorney General. You
- 10:18will not be seeking at the term as you've opted instead and run from governor.
- 10:22Two people though, want your current job at least too that we know
- 10:26of right now. A couple of state Senators Mike Stewart and Ryan Weld,
- 10:28have taken shots at each other already, mainly on this show. Don't want
- 10:33to put you in a bad position, sir, but if you've been following
- 10:35this or any thoughts on that race, look, I think campaigns will always
- 10:41occur, and they'll be vigorous debate between the two candidates right now, and
- 10:46perhaps even more people will come through. But you know, right now,
- 10:50I'm focusing on doing my gay job as attorney General. I think one of
- 10:54the things that they said that they agreed with is that they thought that we
- 10:58were doing a really good job, and I'm I'm grateful for that right because
- 11:01I think folks know I'm the only proven conservative with the record of really moving
- 11:07the needle on huge issues and challenges based in West Virginia, so being ready
- 11:11for day one as governor came from all the terrific work we've done is ag
- 11:16So I think that that's a part of what they're talking about. And you
- 11:20know, obviously I'm always hopeful to people stick to the issues and they focus
- 11:26on the reasons why they want to have the job. So I'm not going
- 11:30to get in the middle of the race right now, but I think that
- 11:33you know, there's some fine people running and West Virginia my expectation is going
- 11:39to have another strong attorney general in the future. Let's lose by talking about
- 11:43the governor's office. There is polling out so far and again way early.
- 11:48It's early, but it's looking pretty good for your campaign. In fact,
- 11:52I was talking to a leading Republican the other day who gave me this quote,
- 11:56The race is Patrick Morrissey's to your thoughts. Look, I think what
- 12:03you're seeing right now is a reflection of the fact that we've taken on all
- 12:07the big challenges. We've taken on the political elites, and we've been able
- 12:13to be so aggressive to protect West Virginia, our jobs, our way of
- 12:18life. We've fought for educational attainment by winning the hope scholarship case or in
- 12:24the middle of defending charter schools. Right now, when you're looking at the
- 12:28person who is most qualified to lead on day one, you have to look
- 12:31at someone who's been around the block a little bit, and we've been able
- 12:35to win on these huge issues. So I think that's what voters are seeing.
- 12:41And obviously I'm not here to critique others right now. I think that
- 12:46there'll be some other fine people. There may even be fine ideas, but
- 12:50there's no one else with the qualifications and the records that we have, and
- 12:54I think that's what you're seeing in the early polling, and my expectation is
- 12:58that's going to continue. But we'll take nothing for granted. We're gonna four
- 13:03hard every day. I'm going to continue to do my gay job. We
- 13:07were just talking about those issues here, and I think by continuing to do
- 13:11really good work as Attorney General, people will continue to see there's really no
- 13:18contest in terms of the qualifications and the record compared to everyone in the field.
- 13:22Attorney General and gubernatorial candidate Patrick Morrissey, I appreciate as always you being

- 17:12away from politics just for a moment, and let's talk about something we can
- 17:15all agree on this crazy world, and that is barbecue. Coming to Charleston
- 17:21this weekend Hadad Riverfront Park is the Charlie West Barbecue Fest. Starts at two
- 17:25o'clock on Saturday. Here to talk about it at Sam Summerville. Sam,
- 17:27good morning, How are you more? And Dave doing well? How how
- 17:30are you? I'm doing fine. Thank you for stopping about. Is it
- 17:33too early to talk barbecue? It's never too early, tokarbe never too early
- 17:34to talk about barbecue. I just wanted to tell you about what's going to
- 17:40be happy in this weekend on the Charleston down Hadad Riverfront Park on the Boulevard,
- 17:45We've got the sixth annual Charlie West Barbecue Fest. It starts at two
- 17:49o'clock on Saturday afternoon, but we'll be there Friday night. We're gonna have
- 17:53commercial vendors, barbecue folks, will have backyard barbecue folks. Back Yard folks
- 18:00will be coming in Friday night. They'll be cooking all night, be getting
- 18:03prepared for Saturday. Commercial vendors will be coming in Saturday, but we started
- 18:07at two o'clock and we run from two o'clock to eight pm on Saturday the
- 18:11same Let's talk about your background and all this. How did you get involved
- 18:14in this and what do you do? Okay, I'm I'm president of the
- 18:18board of directors of the Bobardett Center and the we offer after school programming on
- 18:22Charleston's West Side. We've been doing that. This is our twenty fifth year,
- 18:26and I didn't realize that to I started preparing for this to meet with
- 18:30you to time flies that it does. Time flies. This is our twenty
- 18:33fifth year of providing after school programming on Charleston West Side for children there and
- 18:38services to the children and their families. So now what is the time with
- 18:42the Bobaradet Center and the barbecue PESTI Well, we started this, as I
- 18:45mentioned, this our sixth annual one. We started this as our annual fundraiser
- 18:51they have had and we've been doing that now for well we took a break
- 18:55during COVID, of course, but this is our sixth one and so we
- 18:59wanted to have this barbecue fast. It was the brainchild of Dave Minser or
- 19:03vice president and Dave heads this up for us, and we wanted to do
- 19:07that to get the name of the Bob Bardette Center out, but also to
- 19:10do something to raise money, of course, and to have an event that
- 19:14families and their families can come down and take some great barbecue and listen to
- 19:18some live music and then have a great day. And in West Virginia,
- 19:21nothing brings people together like good food, whether it's barbecue or any other kind.
- 19:25Let's talk about the Bob Bardette Center for a moment. And I am
- 19:29aware of it because of this job and because of the interviews I've done over
- 19:32the past. But for those that may not be familiar with it, how
- 19:34did the whole thing come about? As far as the Bob Bardette Center,
- 19:37And you said it had been around for a number of years, and talk
- 19:41about some of the success stories that you've seen there through the program. Well,
- 19:45it's started, I said, twenty five years ago a church on the
- 19:48west side, Emmanuel Baptist Church. We started started the center, set up
- 19:52a separate organization for that. We initially served students from this elementary school right
- 19:56across across the street from the church, and then it grew from there and
- 20:02we now serve about one hundred and twenty students today K through fifth grades at
- 20:07four different locations, and we provide after school programming to give the kids a
- 20:12safe place to come and there's no charge to the parents. Children are able
- 20:17to come there. We serve him a meal when they arrive, we give
- 20:19him a snack before they leave. We have certified tutors that help them with
- 20:23their homework. We have computer labs, recreation and all kinds of things for
- 20:27them. And the ballpark. Figure, how many kids do you serve through
- 20:30there? About one hundred and twenty a day, about one hundred and twenty
- 20:33day. That's amazing. And here's the thing about it. And again we're
- 20:36talking to Sam Summerville talking a little bit about the Bobaradette Center, but also
- 20:38talking about the Charlie West Barbecue Fest this weekend, and had that The thing
- 20:42about it is, Sam, is the statistics are proven that the more idle
- 20:48time that kids have on their hands, the worst things turn out usually.
- 20:52And if you can get kids involved in anything once that bell rings in the
- 20:56afternoon, whether it's sports, whether it's it's musical stuff, that's it's art,
- 21:00it's it's just hanging out with others and seeing mentors and things like that,
- 21:04working on homework. The better of those kids turn out, no question,
- 21:08Dave. I mean, like I said, it's a safe place for
- 21:11the children to be. We our staff works with them, they establish relationships
- 21:15with them. You know, they're a place that they can go. They
- 21:18know they're safe, they can trust our staff, and and it's it's just
- 21:22just a great organization. It is. Indeed, I've heard a lot of
- 21:23good things we have. Again, we're talking with Sam Summer. Then let's
- 21:26go back to the barbecue here for a moment. Now, Friday night,
- 21:30you said this is going to be kind of like for the I guess the
- 21:32backyard barbecue type folks. And so, now, how does somebody get involved
- 21:36in that? If they just want if they think, well, you know,
- 21:37I make I make a pretty mean brisket, I can get involved in
- 21:40this. How do they do well, that'd be great. All they have
- 21:41to do is sign up. We have a Facebook page, Charlie West Barbecue
- 21:47Fest. They can sign up there. We have a website Charlie West Barbecue
- 21:51Fest dot com. They can sign up there as well. So now when
- 21:53they come out, these the guys like me and you you know, just
- 21:57cook a little for fun. When they come out on Friday night, they're
- 22:00just gonna be cooking their their stuff and then they sell it, they give
- 22:03it away. How does it work? Well, the way it works is
- 22:06again, they'll come out Friday night sometimes early Saturday morning, and they'll they'll
- 22:10start setting up and we have a have a location for each of them.
- 22:12And then the way it works about we have different judging events for them,
- 22:18and we look at the best ribs, pulled pork a wildcard, and they
- 22:22can prepare whatever they want from both the backyard folks and the commercial folks.
- 22:29But then about two o'clock then on the Saturday afternoon, then we start selling
- 22:33tasting tickets to anyone who wants to come down. So you can buy a
- 22:37tasting ticket and then you can go around to the different backyard folks and sample
- 22:42they're pulled pork ribs or whatever they have. Yeah, it's gonna be good.
- 22:47So now, are you primarily drawing as far as the Saturday event,
- 22:51Sam, are you primarily drawing from local people? We get people from the
- 22:53tri State, we get people from all over. It's uh, primarily local
- 22:57folks. Okay, okay, Well for folks regional folks. Okay, Well,
- 23:00I mean there's no such thing as bad but there's some sub barbecue that's
- 23:03better than others. But there's no such thing, in my opinions as bad
- 23:07barbecue. And here's one of the things about it. Again, as I
- 23:08said, nothing saying pulls people together like food. And you've not only got
- 23:12food at this but you've got a lot of other events in great music.
- 23:15Talk about that. Oh, that's right, and we've got u live music.
- 23:18We have three bands coming this year. We have first one starts at
- 23:23two o'clock. Canvases is our first one and they play from two to three
- 23:27thirty. Jay Hatfield, Well, then we'll come on at four and they'll
- 23:30play to five thirty. And then at six o'clock m Emily Deal and the
- 23:37hot Mess will be there as well. I love that name seven the hot
- 23:40Mess. And she's been a great spart she's been there for the last three
- 23:42or four years. Right, that's really been good. Well, it's going
- 23:45to be a great event and I'm looking forward to it. Friday night again,
- 23:48that's that's kind of for the backyard folks, the folks like me and
- 23:52you. And then then Saturday night you're going to do for the for the
- 23:53commercial barbecue. Well, well it's really and I didn't mean to confuse it
- 23:56day, but it's really for everyone. Friday Nights is kind of a up
- 24:00Okay, okay, okay. Event really starts Saturday. Okay, they'll still
- 24:03be cooking Saturday, and then at two o'clock it really kicks off. For
- 24:06everything. They can buy from uh you know, anyone who's there. Like
- 24:08I said, we sell tasting tickets and they can use those to taste backyard
- 24:15folks what they've prepared. The commercial vendors you can buy from them as well.
- 24:18And so I guess with the tasting tickets, Sam, I guess that
- 24:21you know, you can you can get a little bit of a sample and
- 24:22then you look at and go, okay, I need more of that.
- 24:25Oh yeah, exactly, I need to take that home. You've got fifteen
- 24:29to twenty backyard folks and you can go down and talk with them. Every
- 24:32it's a it's a great event. It's just people talking with each other,
- 24:36uh, listen to some great music and enjoying some great barbecues. Well,
- 24:38it's gonna be a lot of fun. These things always are when you get
- 24:41people together like that, and especially this time of year, we're getting into
- 24:45that backyard barbecue season. I know you and I were talking in the green
- 24:48room before the show that you said you're not necessarily a the barbecue expert.
- 24:52I'm not a barbecued expert either. I'm just the expert eater. And I
- 24:56know and I know what I like. You have a favorite barbecue dish yourself.
- 25:00I like ribs. Yeah, you can't go wrong with good ribs.
- 25:03I'm more of a brisket guy or the smoke sausage type gap. But but
- 25:06I'll do the ribs. And you got to have the sides. You got
- 25:08to have all the quality sides. I know the job that they're going to
- 25:11have those as well. And again, this is a family friendly event.
- 25:15And there's so many things, you know, going on in Charleston and the
- 25:18Canal Valley, but this is a good family friendly event. People can come
- 25:19down and bring the entire family and uh and just have a good time.
- 25:23It is and you can come down, you know, like I said,
- 25:26starts at two runs through eight o'clock, So come down and have dinner.
- 25:29Yeah, exactly, right back. Uh, it's traffic, there's no traffic.
- 25:32Bulevards blocked off and you can just walk around and see. Okay,
- 25:36they are blocking off the boulevard foot so yes, it is blocked off.
- 25:38Okay, I want to make sure it's for a traffic purposes. People know
- 25:41that the boulevard will be blocked off for this again. Everything starts Saturday at
- 25:45about two o'clock. Bring the entire family down and and enjoy some great barbecue
- 25:49and some great music and fell as we used to say growing up in the
- 25:52church, fellowship one with the other and uh and come down and have a
- 25:55good time. Sam, I appreciate you being here. If somebody needs more
- 25:59information, give us the website, the Facebook, phone numbers, whatever you
- 26:00got man. Okay, as I said, website, we have Charlie West
- 26:06Barbecue Fest dot com, facebook page Charlie West Barbecue Fest. And I was
- 26:10able to find at very as I put a nice little graphic up on the
- 26:11on the Facebook page this morning, so you won't have any trouble find it
- 26:15again. The Backyardists will be there setting up on Friday night, but the
- 26:18event really gets going Saturday afternoon at around two o'clock. Goes so about eight
- 26:22or so, right, yes, and proceeds will benefit the Bob Burdette Center.
- 26:26If people would like more information about the Bob Bardette Center, which you're
- 26:29the I think you said the chairman of the of the board there, what
- 26:30do Where can people learn more information about the programs? Like I said,
- 26:34you can go online on our website, uh Bobardette Center dot org and find
- 26:40more information there. All right, Sam, I appreciate you being here.
- 26:42Thanks a lot. Thank you, Dave. We appreciate it. And everyone
- 26:45come on down on Saturday. Come on down and enjoy some great barbecue again.
- 26:48That's happening this Saturday and had the Riverfront Park. It is the Charlie
- 26:52West Barbecue Fest and proceeds benefit the Bob Bardette Center for Kids on the West

- 30:37We need competition. Good green jobs are coming to the state thanks to
- 30:41Biden, not to Republicans, according to a text. Right now, back
- 30:45to the barbecue for a moment. I just got a text, Ryan from
- 30:48our friend Danny Jones. Danny says he will be bringing some ribs to the
- 30:53Charlie West Barbecue Fest this weekend. That's the best news Danny that I've heard
- 30:57in along with well, actually best news I had was last Thursday when Danny
- 31:02got the call while live on the air that he did not have cancer.
- 31:06So that's a really good news. But the fact that Danny's gonna be bringing
- 31:08barbecued ribs to the Charlie West Barbecue Festival this weekend. That is even more
- 31:15good news bringing Brad mclhonney. Brad, good morning, how are you?
- 31:18Oh hi? Now you're making me hungry. Well, I was gonna say,
- 31:21as we say in southern West Virginia, Brad, you have a tough
- 31:23road to hoe following not only Patrick Morrissey but barbecue talk. Now, you
- 31:30seem like a ribs kind of guy. Am I wrong? Oh? Yes,
- 31:34yes, but I don't want to eat them in public because I want
- 31:37to lick my fingers. Well it's okay if you lick your fingers. The
- 31:40problems come if you start licking other people's fingers. That's when it becomes the
- 31:44whole thing. And as I mentioned when I was talking, I'm not gonna
- 31:47talk about barbecue the whole time. But it's Sam Summersville fault man. He's
- 31:49the one that got me started on this. You don't want to forget about
- 31:52the quality sides and the main events are okay. As I said, I'm
- 31:56a brisket and smoke sausage kind of guy, but I gotta have the ba
- 32:00beans and my wife by the way. I gotta give her credit. My
- 32:01wife makes the best baked beans I've ever had in my entire life. But
- 32:06you gotta have the potato salad, you gotta have the cold slaw, the
- 32:08macaroni salad, et cetera. Or it's just not a real barbecue, am
- 32:12I Right? Oh my gosh, you're making me so hungry. And the
- 32:15thing is, I don't have leftovers from Mother's day brunchers. What I ate
- 32:22for my breakfast this morning? So it included sausage and centaters and a little
- 32:30bit of bacon like all made of cauliflower and soy products. By the way,
- 32:38had a lot of tale I'm making up the second part. Okay,
- 32:42it's gonna say, who are you? I mean, you are a disgrace
- 32:45to media everywhere. But now I'm to each their own food is food,
- 32:50all right? So now we have that. Well, you have a story
- 32:52posted on the website that the company is owned by Governor Justice and his family
- 32:55aren't exactly happy about the way that they're bankers are going about collecting the over
- 33:00three hundred million dollars that the Justice companies own in debts. Break that story
- 33:05down, Force Bran, Well, this is a resumed dispute between the companies
- 33:10headed by a Governor Justice, ranging from the resorts, to the coal properties
- 33:15to the agricultural entities. And on the other side Carter Bank, which is
- 33:22their long time banker that they used to have quite a personal relationship with,
- 33:29and at one point the Justice has had seven hundred million dollars of debt with
- 33:32Carter Bank. Carter decided that is unwieldy and we do not want that much
- 33:39in one basket, so they started trying to get out of from under some
- 33:44of the Justice debt. As you'll recalled, just a few years ago,
- 33:49there was a dispute about three hundred and sixty eight million dollars the Carter Bank
- 33:58was trying to cash in on personal guarantees and Justices countersued they resolve that issue
- 34:06for the time being and essentially renegotiated the debt. Well, now it has
- 34:10flared back up, and it's a little bit of a smaller amount, but
- 34:15still one that would make me lose sleep at night. Three hundred probably wouldn't
- 34:17you. But three hundred and two million dollars pocket change, man, pocket
- 34:22change. That is debt that came to April fifteen, and you know,
- 34:30this this relationship has turned sour. So it was personal guarantees, and there
- 34:36was another aspect of it called a confessed judgment, which I have never been
- 34:40subject to. But essentially it's it's a contractual agreement where if you were not
- 34:45good for the debt, the bank can just take it straight to court and
- 34:49cash it in. Look here, here is the signed document. Here's how
- 34:52much you owe and has come due. I'm cashing it in. The Justices
- 34:58have countered in a couple of ways. One was a press release that they
- 35:01sent out on a Friday night about a month ago, and it essentially said
- 35:07that they believe they've been negotiating in good faith to try to pay that debt
- 35:12down, and so what they get your whiteboard out. What they've described in
- 35:15that press release was we refinancing through another company, borrowing from someone else two
- 35:24hundred and fifty million dollars and then paying cash to Carter Bank to close out
- 35:30that amount on some of those debts. Two hundred fifty million dollars. All
- 35:34right, we're giving you two hundred fifty million dollars. They acknowledged that there
- 35:37would still be fifty seven million dollars left, and the Justices say in that
- 35:43press release that they would secure that amount through collateral appraised at more than three
- 35:47hundred and twenty five millions. In that press release, they essentially the justices
- 35:52did accused Carter of not operating in good faith, of being impatient, of
- 35:57not knowing a good deal when they see it. The second part of the
- 36:01dispute on the justice end is this is all in court trying to cash in
- 36:07those those confessed judgments. It's in court in Martinsville, Virginia, which is
- 36:12if you can imagine in the map in your head, it's halfway between Roanoke
- 36:15and Greensboro, North Carolina. And so the justices now have entered emotion to
- 36:24try to get the whole thing held up in court because they say that the
- 36:30confessed judgment is a radical move, that it doesn't allow them their rights to
- 36:36do process, to be heard in court. They actually say the fourteenth Amendment,
- 36:39and they say that they deserve the right to prevent to have a broader
- 36:45defense where you know, being on the trial docket, actually going before court,
- 36:52rather than just cashing in these confessed judgments. So it's it's a financial
- 36:59dispute that has gotten it's it's a bunch of financial disputes that are just lined
- 37:09up nipping at the heels of the governor and his properties. And you know,
- 37:17this is a political figure who has cast himself over the years as being
- 37:22a business guy. I run the numbers, I buzzed the numbers, and
- 37:25it again seems ready to be a part of the political whirlwind. First for
- 37:34the primary against Congressman Alec Mooney, Alex Mooney, who is there are ads
- 37:39being run on Mooney's behalf by Club for Growth, which is a right erwing
- 37:45political action committee to say to call Justice a deadbeat billionaire. And then if
- 37:51Justice makes it out around one, he potentially has Joe Manson on the other
- 37:54side, and you can bet that these are things that they're going to be
- 37:58hammered in that race too. Or he doesn't have Joe Mansion either way,
- 38:02because I was listening to talk Line and Hobby had an interview with Aaron Blake
- 38:06of the Washington Post on impossible White House run by Senator Mansion. And you
- 38:12know, Brad, this has been talked about a lot, but a third
- 38:14party candidacy is almost impossible these days. I mean, you know, even
- 38:17on our statewide races that we see you know, it's I mean, the
- 38:22electric can only handle about two people going at it at a time, Blake,
- 38:25HARKing back to the days of Teddy Roosevelt and even Ross Perow if you
- 38:30want to go back to ninety two. But there are a lot of people
- 38:35that still think that this could be done, especially Brad, considering that forty
- 38:39seven percent of all Americans, regardless of party lines, do not want Donald
- 38:45Trump or Joe Biden to run for president. Your thoughts, I do think
- 38:51it is an uphill battle likely to I mean, history would show you running
- 38:55as a third party candidate, unless you consider him Lincoln back part of the
- 39:01Civil War to have been a third party candidate. It's just hard to win
- 39:06that way, you know, darn near impossible. So it's it would be
- 39:09unprecedented, But you were right. The binary choice that people have would show
- 39:17you that people are not particularly excited about the incumbent President Biden or about the
- 39:23return of the former president Donald Trump. On the other hand, if you
- 39:30feel that way, you know, if it's a lot of people feel that
- 39:34way, viewing it as an existential crisis. But you know, maybe you
- 39:37feel like Biden is beholden to the radical left and he just doesn't have it
- 39:43anymore. Maybe you feel like President Trump has authoritarian impulses and as a threat
- 39:47to democracy. And when you view it that way, a third party candidate,
- 39:53particularly a potentially a high profile one, you know, you can begin
- 39:58to view it as a factor. Oh my gosh, he's gonna tip it
- 40:02to whichever one you think is the most threatning. Yeah, it's you know,
- 40:07I think that there's a sort of sense of for voting people might have
- 40:10about it rather than a welcoming impulse despite the unpopularity of the two likely major
- 40:16Canada. It's amazing to me, and I'm going to get into this maybe
- 40:20on a later show that the number of people that I talked to Brad on
- 40:23a daily basis of Democrats not all liberal. Let me just say democrats a
- 40:29general from the liberal and more conservative Democrats that will privately say, gosh,
- 40:32I wish anybody but Joe Biden was running. And and I hear the same
- 40:37thing from a lot of my Republican counterparts that say I wish anybody but Donald
- 40:43Trump was running. However, neither one of them will say it publicly.
- 40:47And this is where we are, and it's just frustrating to me, I
- 40:52mean, it's just frustrating. All right, let me move on to something
- 40:54else where. We let you go and they get a busy day. Could
- 40:58be an interesting battle shaping up one of many in the in the States Senate.
- 41:04Two names anonymous for politics out of the Eastern Panhandle Delicate Paul Espinosa and
- 41:07the sitting senator there, Patricia Rucker. Espinosa announcing on our sister station Panhandle
- 41:15Alive up there, which is the Eastern Hanhal's version of this show, that
- 41:17he's going to give it a go, uh, and that he's going to
- 41:21try to unsee Patricia Rucker. You had the story posted at wv Metro news
- 41:24dot com. Brad, this could be a very interesting battle. Oh man,
- 41:29it really could be. I mean, that's a growing area, and
- 41:31those are two people who have been friendly and political allies to this point.
- 41:37A couple of things that I would point out to kind of broaden it.
- 41:43One is that you know, with apologies to frequent guests Michael Pushkin, chairman
- 41:46of the Democratic Party, that that is not where the political competition is these
- 41:51days. It's within the Republican Party itself. And you see that down the
- 41:55line from from governor Justice facing off in a primary against Congerman Mooney, a
- 42:00very competitive race amongst several people for governor, the attorney general's race between between
- 42:08Senators Weld and Stewart. Did you and then let me just jump here if
- 42:13you if you heard Senator Stewart on this show two weeks ago, then you
- 42:15heard Senator Weld on this show last week. If you haven't heard it,
- 42:19go back and listen to those two are already like squaring off. I mean,
- 42:22they are going at it. But just to add to your point,
- 42:24to go ahead, yeah, well that's what's happening here. Also, I
- 42:28mean Espinoza, the delegate who is now announcing he's running for state Senate,
- 42:35and State Senator Rucker. Are you know, they are relatively aligned on the
- 42:43Republican political spectrum. There may be some differences Rutgers probably a little more populist,
- 42:49but you know, what you're getting is a clear choice, is a
- 42:52choice for voters in that Jefferson and Berkeley County district for Republican primary voters.
- 43:00The other thing that's worth mentioning about it is that there is a larger split
- 43:06in the Senate itself between you know, sort of more traditional you know,
- 43:13I suppose you'd say pro business. If you were not going to be super
- 43:19kind to them, you might say establishment Republicans and more populist Republicans. And
- 43:29so Rutger is probably among the more populist wing, and they have given the
- 43:35President Craig Blair some headaches, you know, deservedly so or not. Nothing
- 43:40says the caucus always has to agree. It's a marketplace of idea. That's
- 43:45why they get together, and that's why they have a caucus. But you
- 43:49know, I think that the more populist end, you know, it's a
- 43:53real tipping point for the balance of power in the Senate. And I feel
- 43:59like at this point it's likely the Senate President Blair wouldn't mind seeing a few
- 44:06of those more populist caucus members be replaced by some other people. And that's
- 44:13what you got here. Rutger of course, flirted with running for a spot
- 44:19against Blair, wound up deciding not to do it. He took her off
- 44:25as chairman of the Education Committee and replaced her with Amy Nicole Grady. So
- 44:31there is there is a track record there, and I don't think he is
- 44:37mining at all. But the delicate Esperinoza has mounted a campaign for that seat,
- 44:42currently held by Senator Rutger. I would agree. All right, Brad
- 44:45boy, let you go. What are you looking at today? What's on
- 44:47the what's on the brad radar today? The brad are today? You know,
- 44:52I hate to tell you in the listeners this it is a very exciting
- 44:55day. But unlike the governor, my calendar doesn't actually show any major events
- 45:02today. So if you were, if you were looking for my calendar or
- 45:07the governors, they would both have blank spots. And so I am.
- 45:09I am digging for news, but I guarantee you the listeners and this news
- 45:15organization, once I find it, it will be very exciting new. It
- 45:17will be very exciting news that always is. Brad. I appreciate it,
- 45:21man. We'll talk soon. Thanks a lot. Eight minutes away from ten

- 45:42Actually use the Google machine on that and yeah, yeah, today is National
- 45:46Barbecue Day. So it was pretty good stuff too too. I'd like to
- 45:50say I was smart enough to know that ahead of time when I had Sam
- 45:52Somerville talking about Charlie West Barbecue Fest. But I did not know that until
- 45:57the text or sent it to me, and I do I appreciate it.
